Desde a criação da OMC em 1995, países desenvolvidos e em desenvolvimento intensificaram a busca por uma ação coordenada mais efetiva e, principalmente durante a Rodada Doha, passaram a influenciar o processo de tomada de decisão por meio da criação de coalizões internacionais. A atuação paradigmática do Brasil no processo de formação e atuação do G20 fez com que o país se tornasse um eminente player nas negociações agrícolas da Rodada de Desenvolvimento de Doha e entrasse de maneira definitiva no alto nível decisório da Organização. Dessa forma, o objetivo deste trabalho é explorar o debate relacionado à atuação das coalizões internacionais, bem como identificar os elementos que constituem a liderança política nesse modo de ação coletiva, sobretudo no que se relaciona ao caso da atuação do Brasil no G20 durante as negociações da Rodada Doha da OMC. / Since the creation of the WTO in 1995, developed and developing countries intensified the demand for a more effective and coordinated action, especially during the Doha Round, and began to influence the decision making process through the creation of international coalitions. The paradigmatic role of Brazil in the formation and performance of the G20 has rendered the country a prominent position in the agricultural negotiations of the Doha Development Round. Thus, the objective of this paper is to explore the debate related to the performance of international coalitions, and to identify the elements that constitute the political leadership in this mode of collective action, especially with regard to the case of Brazil\'s role in G20 during negotiations of the WTO Doha Round.

La Déclaration de la quatrième Conférence ministérielle de l’OMC s’est assignée comme objectif de rendre le traitement spécial et différencié plus contraignant, plus pratique et plus opérationnel. Par son mandat placé sous le signe de développement, la Déclaration de Doha marque une renaissance du traitement spécial et différencié dans les négociations commerciales multilatérales après que les résultats de l’Uruguay Round ont réduit celui-ci à de simples dispositions transitoires. Cette nouvelle impulsion donnée au traitement spécial et différencié est frappante à plusieurs égards : accès aux marchés, accès aux médicaments, assistance technique, etc. Cet intérêt aux questions des pays en développement intervient à un moment où les pays en développement se veulent très actifs au sein de l’institution genevoise. De par leur utilisation du mécanisme de règlement des différends ainsi que de par leur institution de diverses coalitions les pays en développement montrent leur prise en conscience de bénéfice qu’ils peuvent acquérir en participant pleinement au processus de l’OMC. / The Declaration of the fourth world trade Organization Ministerial Conference set itself the goal of making special and differential treatment more precise, effective and operational. The keynote of the conference being development, the Doha Declaration marked a return to including special and differential treatment in trade negotiations after the results of the Uruguay Round had reduced it to mere transitional provisions. The new impetus given to special and differential treatment was striking in several respects : access to markets, access to medicines, technical assistance, etc. This interest in the issues of developing countries came at a time when they were very active within the Geneva institution. Through the use of the dispute settlement mechanism or the various coalitions in the institution, developing countries became aware of the benefits which could be gained by fully participating in the WTO process.

Entre 1992 e 2005, representantes de 11.921 organizações não governamentais (ONGs) participaram de conferências realizadas pela Organização das Nações Unidas (ONU) e pela Organização Mundial do Comércio (OMC). Tendo em vista que, tradicionalmente, apenas os representantes dos Estados-membros dessas duas organizações seriam admitidos, a crescente presença de atores não-governamentais nesses eventos foi considerada uma das evidências empíricas do surgimento de uma sociedade civil global. Contudo, alguns críticos afirmam que a sociedade civil não seria global, mas concentrada geograficamente em alguns países. Nosso objetivo é analisar se, de fato, existe tal concentração e quais suas principais características. Com esse objetivo, analisamos a distribuição geográfica das sedes das ONGs credenciadas para esses eventos, discutindo dois dos principais argumentos contrários à idéia de sociedade civil global: o primeiro afirma que a sociedade civil não é global porque seus atores estão concentrados em países do Norte (gerando um desnível Norte-Sul, com predomínio numérico e político de ONGs do Norte sobre as do Sul); o segundo, defende que a concentração das ONGs espelha as atuais constelações de poder em âmbito internacional (pois as ONGs seriam, predominantemente, de países localizados no eixo Europa-América Anglo-Saxônica). Considerando que todos seríamos parte da sociedade civil global, procuramos constatar de onde são as pessoas e organizações que efetivamente têm participado das discussões e decisões a respeito de questões que dizem respeito a todos (os habitantes do planeta). / Between 1992 and 2005, 11921 representatives of nongovernmental organizations (NGOs) participated in conferences held by the United Nations (UN) and the World Trade Organization (WTO). Given that, traditionally, only representatives of Member States of these two organizations would be admitted, the growing presence of \"nongovernmental\" actors in these events was considered one of the empirical evidence of an emerging \"global\" civil society. However, some critics argue that civil society is not global, but geographically concentrated in some countries. Our goal is to examine whether, in fact, exist that concentration and their main characteristics. With this objective, we analyzed the geographic distribution of headquarters of accredited NGOs to conferences, discussing the two main arguments against the idea of global civil society: the first asserts that civil society is not \"global\" because their actors are concentrated in North countries (creating a North-South divide, with numerical and political dominance of NGOs from the North on the South); the second claims that the concentration of NGOs reflects the current constellation of power in the international arena (as the NGOs would be predominantly of countries located in EuropeAmerica Anglo-Saxon). Whereas we would all be part of global civil society, we see where are the people and organizations that have effectively participated in the discussions and decisions about issues that concern all (the inhabitants of the planet).

De l'adaptation dynamique du concept de juridiction : étude rapportée à une organisation internationale atypique, l'Organisation Mondiale du Commerce (OMC) / The dynamic adaptation of the concept of jurisdiction : a study relative to an atypical international organization, the World Trade Organization (WTO)

Une telle étude n'aurait pas été possible immédiatement après la conclusion de l'Accord de Marrakech, suite aux premières analyses. Des analyses qu'il convenait de prendre en compte avec du recul, la richesse du substrat est à souligner. Le choix de l'organisation, quant à lui, est dicté par un constat: l'Organisation Mondiale du Commerce qui est aussi en phase de mutation participe du réaménagement, de l'ordre économique mondial. Pour que cette participation de l'OMC contribue à l'équilibre global du système, il est nécessaire de proposer des pistes de travail aux représentants des Etats, aux négociateurs, aux différents groupes parties prenantes à ce processus évolutif. Proposer des pistes de réformes auto centrées exclusivement sur l'Organisation Mondiale du Commerce reviendrait, par le biais d'un schéma réducteur à l'excès, à ne pas tenir compte de la dimension de la sphère internationale. Le plan et le déroulement de la thèse ont été dictés par cet incontournable cahier des charges. Incontournable tout comme le constat qui a servi d'armature à la première partie, le modèle juridictionnel est accessible mais non atteint par l'OMC. Deux de ces éléments, l'existence d'un différend et l'application du droit ne posent pas de problèmes lorsqu'ils sont soumis à la matrice de règlement des différends de l'OMC. Mais le caractère obligatoire des recommandations pose le problème de la compatibilité avec les critères formel et organique du modèle juridictionnel. . L'atypisme de l'OMC est illustré par le dédoublement fonctionnel auquel se livre le Conseil Général-Organe de Règlement des Différends. La juridictionnalisation du traitement des différends commerciaux peut s'envisager via la configuration de nouveaux schémas coopératifs, y compris avec des ramifications hors du centre William Rappard. La conclusion de lathèse, tout en synthétisant les causes de la non validation du qualificatif juridictionnel pour l'OMC, rend compte de virages prospectifs qui pourraient permettre l'émergence d'une juridiction commerciale internationale entre Etats. / Such a study would not have been possible straight after the conclusion of the Agreement of Marrakesh, further to the first analyses. As for the choice of the organization, it is dictated by a report stating that the World Trade Organization which is also in the pro cess of being transferred participates in the reorganization of the world economic order. In order for this participation of the WTO ( .. ) to contribute to the global balance of the system, it is necessary to propose working tracks to the representatives of the States, to the negotiators, to the various groups involved in this progressive process. Proposing means of reforms centred only on WTO, excessive reduction and not taking into account the dimension of the international sphere. The plan and the progress of the thesis were dictated by these unavoidable specifications. As inevitable as the report which was used as a basis of the first part, the jurisdictional model is accessible but not reached by the WTO ( .. ). Two out of these elements, the existence of a dispute and the application of law do not pose problems when they are subjected to the matrix of dispute settlement of the WTO ( .. ). But the compulsory character of the recommendations poses the problem of the compatibility with the formaI and organiccriteria of the jurisdictional model. The atypism of the WTO ( .. ) is illustrated by the functional splitting in which the General-Organ Council of Dispute settlement is engaged. The 'jurisdictionnalisation" of the treatment of the trade disagreements can be envisaged via the configuration of new cooperative plans, including ramifications outside the William Rappard Center. The conclusion of the thesis, while synthesizing the causes of the invalidation of the jurisdictional qualifier for the WTO ( .. ), justifies means of prospection allowing the emergence of an international commercial jurisdiction between States.

Nesse contexto, o julgado DS332, como é identificado na OMC, é usado como ferramenta para abordagem da Justiça Ambiental, conceito novo e carente de fundamentação dogmática robusta, especialmente quando se vislumbra sua aplicação na esfera internacional. Buscou-se, pois, analisar a decisão sob a ótica do conflito entre interesses comerciais e ambientais. Como conseqüência dessa abordagem, é elaborada uma proposta de utilização da noção de Justiça Ambiental aos embates internacionais que contraponham esses interesses.

Verificou-se, que o crescimento do comércio multilateral e a degradação ao meio ambiente estão intrinsecamente relacionados e para tanto a presente tese discorre. No primeiro capitulo, discorre sobre o surgimento das instituições de caráter financeiro e comercial, bem como as primeiras rodadas de negociação do comércio multilateral e a mais importante, a rodada Uruguai, a gênese da OMC, e sua natureza jurídica, funções e estrutura. No capitulo seguinte examina-se como eram dirimidas as controvérsias do comércio multilateral no âmbito do GATT 1947 e como são atualmente na OMC através do Anexo 2- Entendimento Relativo às Normas e Procedimentos sobre Solução de Controvérsias. Também como são estabelecidos e quais as funções dos Grupos Especiais e do Órgão de Apelação e o meio alternativo de aplicação da Arbitragem. A terceira parte aborda os princípios de direito internacional utilizados na proteção do meio ambiente em decorrência do crescimento econômico dos Estados que buscam conciliar o crescimento e a proteção do meio ambiente. A ultima parte dedicada a analise dos trâmites e conclusões do caso Estados Unidos proibição da importação de camarões e produtos derivados de camarão. Por fim, uma parte conclusiva que delineia ao fato da incompletude no ordenamento jurídico da OMC em tomada de decisões que envolvam proteção ao meio ambiente, sendo certo que possa através da heterointegração utilizar-se de princípios de direito ambiental e outras normas para suprir esta lacuna de norma legal.

Nevertheless, some multilateral trade negotiations may violate Human Rights. This study aims the application of these rights into WTO decisions, since they are essential for human dignity and consequently for the development of a State. The research of national and foreign legislation, doctrine and jurisprudence, made in Brazil and in the International World Trade Organization, in Geneva, Switzerland, guided the study elaboration. The analysis purpose has been reached by reason of the review successfully verifies the way that WTO has been deciding the subjects related to international trade which oppose human rights or make harm to the environment. Additionally, it evaluates decisions in which the economic value overwhelms fundamental human rights. Finally, it presents reasoning and proposals to the application of inherent human rights to the WTO negotiations / A Organização Mundial do Comércio (OMC) é uma organização internacional a qual possui um sistema de regras que ordena o mercado mundial ao definir os comportamentos lícitos e ilícitos, além de prever mecanismos que garantam o cumprimento das suas normas. Ocorre que, algumas negociações comerciais multilaterais podem violar Direitos Humanos. O objeto do presente estudo é justamente a aplicação desses direitos nas decisões da OMC, pois são eles essenciais à dignidade da pessoa humana e, consequentemente, ao desenvolvimento de um Estado. A pesquisa da legislação, da doutrina e da jurisprudência, nacional e estrangeira, realizada no Brasil e na sede da OMC, em Genebra, na Suíça, orientaram a sua elaboração. A análise cumpriu o seu objetivo que tinha como finalidades: a verificação de como a OMC vem decidindo a respeito de relações de comércio internacional que prejudiquem os Direitos Humanos e causem danos ao meio ambiente; a realização de críticas a essas decisões quando prevalece o valor econômico em detrimento dos direitos fundamentais do homem; e a concretização de justificativas e propostas para a aplicação dos direitos inerentes ao homem às negociações no âmbito da OMC

L'émergence d'un double régime de subventions dans le système GATT/OMC : analyse du clivage entre subventions agricoles et non agricoles

Encore une fois, il semble que la question des subventions agricoles ait refait surface comme l'élément clé du présent cycle de négociations commerciales multilatérales à l'Organisation mondiale du commerce (OMC). Pourtant, le cycle d'Uruguay, qui s'est achevé en 1994, avait tenté de rétablir l'agriculture comme un secteur «normal» de négociations à l'OMC. Or, il semble que plutôt que d'en faire un secteur comme les autres en ce qui a trait aux subventions, le cycle d'Uruguay ait surtout contribué à établir un régime de disciplines pour l'agriculture qui se distingue à plusieurs égards du régime général établi par l'Accord sur les subventions et les mesures compensatoires (SMC). Une analyse des disciplines en place lors du système GATT (1947-1994) démontre que ce double régime n'avait pas formellement été mis en place avant la conclusion, en 1994, de l'Accord SMC et de l'Accord sur l'agriculture. En fait, malgré quelques distinctions qui sont apparues graduellement, ce clivage ne s'est véritablement effectué qu'à partir du cycle d'Uruguay. Tant sur le plan des subventions à l'exportation que du soutien interne, il apparaît que le système actuel impose des règles beaucoup moins contraignantes pour les subventions de produits agricoles que pour tout autre produit. Cette situation s'explique, en partie, par le haut degré de sensibilité politique de l'agriculture, de même que par certaines particularités économiques intrinsèques à cette industrie. L'avenir de ce double régime demeure encore incertain. Il semble cependant qu'aucun changement en profondeur ne peut être anticipé pour le présent cycle de Doha. / Once again, it seems that the issue of agricultural subsidies has emerged has the key concern of the current round of WTO multilateral trade negotiations - even as the Uruguay Round, which was completed in 1994, had tried to bring agriculture back into a "normal" negotiating sector at the WTO. Rather, it seems that instead of making it a sector like any other concerning subsidies, the Uruguay Round has above al1 contributed to establish a regime of disciplines for agriculture that distinguished itself in many respect from the general regime established by the Agreement on Subsidies and Countervailing Measures (SCM). An examination of disciplines in place during the GATT system (1947-1994) shows that this double regime was not formally instituted before the conclusion, in 1994, of the SCM Agreement and of the Agreement on Agriculture. In fact, despite a few distinctions that evolved gradual1y, this division only real1y established itself from the Uruguay Round onwards. With regard to export subsidies as wel1 as to domestic support, it appears that the current system subjects subsidies in the field of agriculture to rules are substantially less restricting than subsidies in other fields. This situation can be explained in part by the high degree of political sensitivity in agriculture, as wel1 as by some of the intrinsic economic characteristics of this sector. The future of this double regime remains uncertain. Si les fonctions principales de l’OMC sont de servir de cadre aux négociations commerciales et de faire respecter les règles commerciales multilatérales qui ont été négociées, figure parmi les nouvelles missions de l’OMC l’obligation de coopérer « (e)n vue de rendre plus cohérente l'élaboration des politiques économiques au niveau mondial ». En réalité, l’interdépendance du mandat de l’OMC avec d’autres organisations internationales est beaucoup plus large et imprègne une grande partie des accords négociés lors de l’Uruguay Round. La mondialisation a rendu encore plus nécessaire une coopération étroite entre les institutions multilatérales. Pour mettre en œuvre ce mandat sur la cohérence, l’OMC a établi un nouveau cadre général de coopération interinstitutionnelle. Et si l’OMC n’a pas vocation à devenir l’organisation internationale de la gouvernance, elle a réussi à trouver sa place dans l’archipel de la gouvernance internationale en contribuant à l’améliorer / If the main functions of the WTO are to serve as a forum for trade negotiations and enforce multilateral trade rules that have been negotiated, an important aspect of the WTO’s mandate is to cooperate with the International Monetary Fund, the World Bank and other multilateral institutions to achieve greater coherence in global economic policy-making. The interconnectedness of the mandate of the WTO with other international organizations is much broader and permeates much of the agreements negotiated during the Uruguay Round. Globalization has made it even more necessary close cooperation between multilateral institutions. To implement this mandate on Coherence, the WTO has established a new framework for interinstitutional cooperation. And if the WTO is not intended to become the international organization of governance, it has managed to find its place in the archipelago of international governance in contributing to the improvement.
