Race mindedness in the physical architecture of Winnipeg's former civic auditorium

Centred on the architecture of the Winnipeg Civic Auditorium, this thesis tangentially investigates the presence of Anglo-Saxon race mindedness in a place civic planners call the metropolitan centre of North America (Watt, 1932). The introduction situates the building tangentially in Manitoba's history. By thinking about the Civic Auditorium in a tangential manner I aim to attack the linear and sequential framework found in Eurocentric historical accounts. Doing this, my thesis criticises western architectural history and welcomes Indigenous reinterpretations of civic planning and urban aesthetics. I aim to philosophically attack the informational rhetoric of the cultural turn (Fabian, 1983). My thesis participates in the production of a material turn discourse, wherein the important philosophical relationship between objects and occidental culture is demonstrated (Otter, 2010; Bennett & Joyce, 2010; Hamilton, 2013). It utilises the Civic Auditorium as a touch stone to demonstrate the important ways that architecture has agency in the production of racism. / February 2016

Practically Human. : Performing Social Robots and Feminist Aspects on Agency, Body and Gender.

Through an experimental theatre play, this thesis explores the development of human-like agency in contemporary “social robot” technology. The entrance point of this study is the gender gap and lack of diversity in contemporary AI/robot development, with an emerging need for interdisciplinary research across robot technology and social sciences. Using feminist technoscience and critical posthumanism as the theoretical framework, this research involves an analysis of a particular social robot case, currently being developed at Furhat Robotics in Stockholm. Inspired by Judy Wajcman (2004), I analyze how socially intelligent machines impact perceptions of human agency, body, gender, and identity within cultural contexts and through interaction. The first part of the empirical research is carried out in the robot-lab. The robot is then, in the second part, invited to perform as an actor in a theatre play. Entangled amidst the other players and audience members, a queered agency starts to reveal itself through human-machine “intra-action” and embodiment (Barad 2003). Human-like agency in machines is shown to be a complex matter, drawing the conclusion that human-beings are vulnerable to a myriad of entanglements and preconceptions that artificial intelligence potentially embodies.

Articulations of Liberation and Agency in Yanagi Miwa's "Elevator Girls"

Miwa Yanagi’s Elevator Girls series, a collection of glossy photographs featuring groups of similarly clad women lingering in expansive, empty arcades, made its international debut in 1996. While the pieces garnered positive reactions, Yanagi found that most Western viewers read her work as predominantly “Oriental”—confirming stereotypes of a highly polished techno-topic Japan that was still negotiating gender equality. In this thesis, I explore alternative ways of reading Yanagi’s Elevator Girls series, which, I argue, call attention to myopic views of commercialism and identity in order to provide an alternative reading of these women as agents of transgression and ideological transcendence. Whereas many viewed Yanagi’s works as a comment on capitalist machinations, where consumerism has produced soulless, vapid feminine identities, I focus on the ways in which these women exercise agency without relying on notions of an individualized, unique ego.

This is a study ofD.RZ. Ntuli's radio trilogy: Isivumelwano, IsivumelwanoEsisha and Ngenxa Yesivumelwano. Since the term trilogy is not a familiar concept in Zulu literary studies, this is an attempt to fill that void. This thesis provides some new insight into this concept, while also devising a practical method for the analysis of the radio trilogy. Chapter one outlines the aim of the study, scope of the study and the definition of some terms. This is followed by explaining the method of research and theories on radio serial dramas. There is also a discussion of the historical background in the development of Zulu radio serial drama and Ntuli's position and contribution to it. Finally, there is a review of previous research studies in Aincan Languages on radio drama. In chapter two plot structure of a radio trilogy is discussed. Theories of drama trilogy by trilogists like Hitchcock, Bakhtin, Asimov and Norris are discussed in detail. This is followed by an in-depth analysis of the plot structures of Isivumelwano, Jsivumelwano Esisha and Ngenxa Yesivumelwano. Chapter three deals with the characterization of radio trilogy. It distinguishes between the actors and characters. Different methods of character portrayal are investigated. Chapter four deals with perspectives on the theme of the radio trilogy. Types of themes are dealt with. Chapter five discusses the dialogue in radio trilogy. It deals with the differences between a dialogue, duologue and monologue, and explains the functions fulfilled by dramatic utterances and dialogue. Lastly a nature of dialogue as a characteristic of the dramatic action is discussed. Chapter six concentrates on the style of radio trilogy. Elements and different types of styles are discussed. Kinds of images, figurative language, proverbs, idioms, biblical allusions and various influences are discussed in detail. Chapter seven concludes by summarizing the main finding ofthis study, and giving observations about the quality ofNtuli's contribution to radio drama trilogy. lt also explores some possibilities regarding future studies on Ntuli's radio trilogy. / African Languages / D. Le régime de cession des droits sociaux applicable des entre les membres d’une même famille est certes privilégié. Mais le législateur ne prend en compte que certains d’entre eux, à savoir, les ascendants, les descendants et certains collatéraux. Pourtant, les parts sociales ou actions font parties des biens patrimoniaux de la famille. Cette mise en société sert de prétexte à une meilleure gestion du patrimoine familial, mais aussi à sa cession au sein de la famille. L’objectif souvent non avoué est la pérennisation de l’entreprise familiale au sein de la famille. Toutefois, législateur ne reconnait toujours pas tous les types de schémas familiaux contemporains. Et pour cause, la notion de famille n’est pas définie en droit. Pourtant cette définition serait bien utile pour soumettre les cessions entre proches à un régime bien spécifique. La conséquence est que la pratique des affaires a développée quantité de règles pour permettre aux associés familiaux soit de rester ensemble au sein de la société ou d’en sortir. En effet, les aléas de la vie familiale commandent les cessions. Ce sont souvent des pactes extra-statutaires qui servent de support à la cession des titres. Le problème est qu’ils n’engagent que leurs signataires. Autrement dit, les associés familiaux non signataires de ces pactes ne sont pas concernés par ceux-ci. Pourtant, ils font partie de la même société et de la même famille. Peuvent-ils pour autant élever contestation en justice ? Car à bien des égards, ces pactes sont souvent à la frontière de l’illégalité notamment celle de l’interdiction des pactes sur succession future. Alors, la liberté de cession du cédant serait-elle empêchée dans le cadre d’une société familiale ? L’élément de réponse se trouve sans doute dans la consécration du pacte de famille, un nouvel outil juridique autonome destiné à compléter efficacement les statuts de la société. / The system of transfer of the corporate holdings of the company applicable between members of the same family is certainly privileged. But the legislator only takes into account some of them namely, ascendants, descendants and some collaterals. However, shares or stocks are part of the family's patrimonial assets. This incorporation serves as a pretext for better management of the family patrimony, but also for its transfer within the family. The often unstated aim is the sustainability of the family business within the family. However, legislator still does not recognize all types of contemporary family patterns. And for good reason, the notion of family is not defined in law. Yet this definition would be very useful to submit the transfers between relatives to a specific regime. The consequence is that business practice has developed a lot of rules to allow family partners to either stay together in society or get out of it. Indeed, the vagaries of family life command shares disposal. These are often extra-statutory pacts that serve as a support for the sale of securities. The problem is that they only commit their signatories. In other words, non-signatory family members of these pacts are not affected by them. Yet they are part of the same company and the same family. Can they raise a challenge in court? Because in many ways, these pacts are often on the borderline of illegality, including the prohibition of pacts respecting a future succession. Could the transferor's freedom of assignment be prevented in the context of a family company? The element of response is undoubtedly in the consecration of the family pact, a new independent legal tool designed to effectively supplement the company statutes.

Äventyrsgenrens funktioner från fiktionsprosa till interaktiv fiktion : En intermedial jämförelse mellan fyra verk / The Adventure genre’s functions from fiction prose to interactive fiction : An intermedial comparison between four works

The purpose of this thesis is to apply the adventure formulas laid out by John G. Cawelti and the dramatis personae written by Vladimir Propp to the traditional adventure books Le Tour du monde en quatre-vingts jour (1874) and Treasure Island (1883) and the interactive fictions The Secret of Monkey Island (1990) and 80 Days (2014), both in the adventure genre. After they have been applied, I will compare Le Tour du monde en quatre-vingts jour with 80 Days and Treasure Island with The Secret of Monkey Island by how the formulas and dramatis personae work and evolve in the fictions. To start things off, I will present the four works and then go through the relevant parts of Cawelti’s formula and Propp’s dramatis personae. Thereafter, I will explain what interactive fiction might be by using Espen J. Aarseth’s Cybertext. Important concepts will be clarified as well.    The analysis in this thesis starts afterwards. Le Tour du monde en quatre-vingts jour and 80 Days will be the first two works to be analysed after Cawelti and thereafter Propp. When that is done, I will conclude what I have found. The same process will be done with Treasure Island and The Secret of Monkey Island. After that, I will make a concluding comparison between 80 Days and The Secret of Monkey Island and finally conclude whether Cawelti and Propp can be applied to interactive fiction.

Ainsi, dans la première partie, à travers l'identification des principaux pouvoirs qu'un tribunal arbitral possède ou peut posséder, nous aurons à préciser la notion de juridiction arbitrale. L'étude sera axée sur la détermination du contenu et sur l'identification de la source de chacun des pouvoirs traités. Par ailleurs, dans la deuxième partie, l'identification des limites desdits pouvoirs nous permettra de préciser la notion de compétence arbitrale. Thus, in the first part, by identifying the principal powers an arbitral tribunal has or could have, we specify the concept of arbitral authority. The study focuses on determining the content and identifying the source of each of the powers treated. Moreover, in the second part, identifying the limits of said powers enables us to specify the concept of arbitral jurisdiction. The study allows us to conclude that, with a few exceptions such as physical imposition, the powers of a national judge are the same as those of an arbitral tribunal. In fact, the latter, owing to the intention of the parties, may have more than the former. However, the hybrid character of arbitration leads us to assert that, with a few exceptions such as natural justice, the limits of the national judge's powers differ from those of the arbitral tribunal.

Defining the crime of aggression : cutting the Gordian knot ?

Le crime d'agression se veut etre un des quatre crimes internationaux sous la juridiction de la CPI. Lorsque les delegues a la Conference de Rome n'eurent point atteint de consensus sur une definition du crime, celui-ci resta, depuis, indefini en droit. En consequence, la CPI n'aura juridiction pour entendre des causes portant sur le crime d'agression qu'une fois la definition sera adoptee par l'Assemblee des Etats Parties au plus tot en 2009. Ce memoire traite trois problematiques liees au crime d'agression : la question de la responsabilite penale individuelle, le role du Conseil de securite de l'ONU, et les parametres du crime en tant que tel. La responsabilite penale individuelle est analysee, inter alia, du point de vue du principe des sources du droit international. Quant al'eventuelle implication du Conseil de securite dans le champ de competence de la CPI sur le crime d'agression, l'auteure soutient tel que suit: Si le Conseil de securite se voit accorde un pouvoir plus large que celui dont il est presentement dote en vertu des articles 13(b) et 16 du Statut de Rome, chaque membre permanent aura un veto sur toute situation d'agression qui serait autrement portee devant la Cour. Ceci aura pour consequence de politiser la CPI en ce qui a trait au crime et rendra hypothethique toute definition eventuelle. Si la definition est bien con9ue et redigee, on fait valoir, qu'il n' est point necessaire de limiter davantage la competence de la CPI. Les parametres de la definition du crime proposes par l'auteure sont etablis selon les conclusions d'une analyse des notions composantes de l'agression. L'essentiel du concept se veut un recours illegal et non-necessaire qui constitue une rupture ala paix. Amoins qu'il ne soit exerce en « legitime defence» ou en vertu d'un mandat du Chapitre VII, Ie recours ala force constitue prima facie une agression et s'il est suffisamment grave, il s'agira d'un crime d'agression. Ce memoire termine avec un projet de definition du crime d'agression en vue d'avancer Ie discours vers un consensus sur ces problematiques majeures. Non seulement est-il possible d'arriver aun consensus sur la definition, croit l'auteure, mais nous sommes plus que jamais al'aube d'y parvenir. / The crime of aggression is one of the four international crimes under the jurisdiction of the ICC. When delegates at the Rome Conference were unable to agree on the content of a definition, the crime was left undefined. As a result, the ICC can only begin prosecuting individuals for the crime of aggression once a definition is adopted by the Assembly of States Parties in 2009, at the earliest. This thesis examines three issues associated with the crime of aggression: the question of individual criminal responsibility, the role of the UN Security Council and the general scope of the definition of the crime of aggression itself Individual criminal liability is reviewed, inter alia, from the perspective of international sources doctrine. Regarding the role of the Security Council in relation to the crime of aggression, the author concludes: if the Security Council is vested with more powers than it already has under Articles 13(b) and 16 of the Rome Statute, each permanent member will have a veto over any situation of aggression that might otherwise be brought before the Court. This would result in a complete politicization of the ICC and render moot any future definition of the crime of aggression. If a definition for the crime of aggression is properly conceived and constructed, it is argued, there is no need to further limit the Court's exercise of jurisdiction. The author proposes general parameters for the scope ofthe definition based on conclusions reached in the analysis of the conceptual components of aggression. At its essence, the act of aggression is the unnecessary, unlawful use of force which constitutes a breach ofthe peace. Unless employed in "self-defence" or under a Chapter VII mandate, the use offorce constitutes prima facie an act of aggression, and if it is sufficiently grave, a crime ofaggression. This thesis concludes with a working definition ofthe crime of aggression to promote dialogue and ultimately a consensus on these core issues.
