Criminal custody as an ultima ratio instrument This thesis deals with a criminal custody which is considered as the most serious instrument within criminal procedural security measures which should be used by law enforcement authorities only in the most extreme cases when all of the legal conditions are strictly fulfilled. One of the purposes of this thesis is to explicate, through personal freedom and presumption of innocence both guaranteed by the Czech Constitution and both significantly affected by custody, the importance of using this instrument only in situations without any other solution when is impossible to reach the purpose of criminal proceedings by using some of the more lenient measures, it means to use the custody just as an ultima ratio instrument. A crucial part of this thesis pays attention to the individual legal conditions of current effective legislation that should ensure observance of this principle also in practice. In the mentioned part the procedure of the authorities deciding on custody is analysed in detail that authorities firstly must resolve the question if the prosecution of a specific person is justified and if a certain specific degree of suspicion is achieved proving that this one perpetrated an offence. Constitutional limits of personal freedom Abstract The Master's thesis deals with the extensive theme of restriction or deprivation of the personal freedom. The aim of this thesis is not to analyse the reasons for deprivation of personal freedom in detail, but to look at personal freedom as a whole. In the Charter of Fundamental Rights and Freedoms (the Charter), personal freedom is the highest-ranked right to be most often interfered with by the state. Any restriction of personal freedom must meet a number of conditions resulting from legislation, international treaties and the supreme courts' decisions. The main goal of this thesis is to evaluate the frequency and intensity of the deprivation of personal freedom in the Czech Republic. In this thesis I pose the question whether all these limits of permissible deprivation of personal freedom are respected in practice or not. In this thesis I do not deal with the term of imprisonment but I focus on the reasons of deprivation of personal freedom expressly enumerated in the Charter. Criminal custody as a means of ultima ratio Abstract This diploma thesis deals with a custody in criminal proceedings as an institute which should, due to its strong intervention to personal liberty, be used in the uttermost cases. Although this conception has been enforced to the legal theory and also to the czech legislation for many years, it is necessary to state that practice has considerable reserves in this respect. With respect to planned recodification of criminal procedural law which could reflect needs of aplication, this thesis tries to look at custody in a broad scope focusing on options of subsitution of custody. Due to the fact that the custody cannot be perceive only within the limits of criminal law, the first chapter is devoted to guaranteed freedom on the constitutional level, i. e. personal freedom. To understand a context, the development of this fundamental freedom is briefly described. This thesis also submits its conception on the international and national standards. In relation to the custody, this chapter includes the solution of whether detention restricts personal freedom or deprives individuals of it. Le concept d'autonomie personnelle est apparu récemment dans l'ordre juridique européen, comme la faculté pour la personne humaine de mener sa vie comme elle l'entend. Ce concept trouve son ancrage dans un système juridique en pleine mutation, tiraillé entre deux traditions, l'une anglo-saxonne qui constitue un modèle autonomique de protection des droits de la personne, et l'autre continentale, plus paternaliste. Le rôle des juges constitutionnels européens et des organes de la Convention européenne des droits de l'homme s'est révélé décisif pour faire émerger la notion d'autonomie personnelle au sein de l'ordre juridique, et pour l'ériger progressivement en principe matriciel des droits fondamentaux. La prise en considération de l'autonomie personnelle vise, en effet, à modifier la protection juridique de la personne humaine, qui n'est plus générale et abstraite mais ajustée et concrète, répondant ainsi aux enjeux actuels de la protection des droits de l'homme et de la réalité sociale.Le but de cette étude est d'analyser la fonction de l'autonomie personnelle, vecteur d'intégration sociale de toute personne humaine, et élément participatif au pluralisme interne essentiel à une société démocratique. L'analyse porte sur les avancées permises par la reconnaissance de l'autonomie personnelle dans la protection des droits individuels et dans ceux des minorités. Malgré certaines réticences doctrinales, cette fonction se révèle limitée dans la remise en cause des valeurs sociales qu'elle pouvait induire, mais elle s'avère primordiale au développement de la protection des droits de la personne humaine. / The concept of personal autonomy recently appeared in the European justice system as a means by which people can lead their lives as they wish. This concept has its roots in an evolving justice system, torn between two traditions: the Anglo-Saxon model of individual rights; and the paternalist Continental approach. The role of constitutional European judges and the inner-workings of the European Convention on Human Rights has proved decisive for the development of the idea of personal autonomy which lies at the heart of the justice system, and its evaluation within the matrix of fundamental rights. Taking into account personal autonomy aims to effectively alter the judicial protection of the rights of the person which is no longer general and abstract but rather concrete and refined, and also addresses current issues of the protection of human rights and the reality of society.The aim of this study is to analyse the function of personal autonomy and the direction of human social interaction and the participative element of internal pluralism which is essential to a democratic society. The analysis focuses on advances permitted by the recognition of personal autonomy in the protection of individual rights and those of minorities. In spite of some doctrinal reluctance, this function proves limited in light of questions regarding social values which it might raise, but it proves essential to the development of the protection of the rights of the person.

Au cours du dernier siècle, les circonstances de la mort ont changé. La plupart des décès surviennent maintenant à des âges élevés. Ils ont principalement lieu en institution et sont souvent précédés d’une longue maladie chronique accompagnée de souffrances et d’angoisses qui ne peuvent être soulagées. Ces mêmes sentiments se retrouvent aussi chez les personnes accidentées de la vie. C’est pourquoi, désormais, les patients privilégient la qualité de la mort à la prolongation de la vie dans la souffrance. Ainsi, de plus en plus fréquemment, le corps médical est confronté à des demandes d’euthanasie ou de suicide assisté de la part des souffrants. C’est dans ce contexte qu’il est intéressant de s’interroger sur la législation française en matière de fin de vie et sur la place donnée tant aux professionnels de santé, qu’aux patients. Si la loi Leonetti du 22 avril 2005 a constitué une avancée considérable en la matière, elle ne répond malheureusement pas à l’ensemble des situations existantes et demeure actuellement insuffisante face aux requêtes constantes des personnes souffrantes et de la majorité de la population française. En témoigne la récente affaire Vincent Lambert dans laquelle, l’équipe médicale confrontée à des avis discordants au sein de la famille proche du patient et à l’absence de volonté exprimée de celui-ci, a été amenée à prendre une décision collégiale sur la poursuite ou non du traitement délivré à ce patient tétraplégique en état de conscience minimale, qui semble-t-il ne voulait plus survivre. S’en sont suivies plusieurs mêlées judiciaires qui ont permis de relancer le débat sur l’évolution de la législation en matière de fin de vie / During the last century, the circumstances of the death changed. Most of the deaths arise now at high ages even very high. They mainly take place in institution and are often preceded by a long chronic disease accompanied with sufferings and with fears which cannot be relieved. The same feelings also find themselves at the more or less young people, damaged by the life.That is why, from now on, the patients favor the quality of the death to the extra time of the life in the suffering. So, more and more frequently, the medical profession is confronted with requests of euthanasia or suicide assisted on behalf of the suffering.It is in this context that it is interesting to wonder on the French legislation regarding the end of life and on the place given as long to the healthcare professionals, and the patients.If the Leonetti’s law of April 22nd, 2005 constituted a considerable advance on the subject, she does not unfortunately answer all the existing situations and currently not sufficient in front of constant requests of the suffering people and the majority of the French population. The recent affair Vincent Lambert shows it in which, the medical team confronted with clashing notices within the family close to the patient and in the absence of will expressed by this one, was brought to make a collective decision on the pursuit or not of the treatment delivered to this patient tetraplegic in state of minimal consciousness, who it seems did not want to survive any more. En este trabajo, más allá del análisis y veredicto que se realizará de la sentencia del Tribunal Constitucional (en adelante, “TC”) N° 02005-2009-PA/TC, es fundamental para la autora destacar la importancia que tiene el reconocimiento de los derechos sexuales, reproductivos y, de forma más amplia, el derecho a la libertad personal y dignidad que tienen todas las personas y familias; los cuales les permiten desarrollar, a voluntad propia, su proyecto de vida, el cual implica, dentro de otras cosas, la planificación familiar de cada individuo. En la sentencia en cuestión, el TC decidió retirar los Anticonceptivos Orales de Emergencia (en adelante, “AOE”), más conocidos como la Píldora del Día Siguiente, del listado de métodos anticonceptivos que el Ministerio de Salud había establecido para la ejecución de su programa estatal de planificación familiar, el cual tiene como finalidad propiciar el bienestar sexual y desarrollo humano de las personas. A estimación de la autora, resulta crucial entender cómo esta decisión del TC afecta, no solo a las familias en su planificación familiar, sino también a las mujeres de sectores socioeconómicos bajos; puesto que, además de ir en contra de los derechos mencionados en el primer párrafo, esta sentencia “resuelve” la controversia de una forma discriminatoria, ya que deja la posibilidad abierta a que las personas puedan acceder a este método anticonceptivo en el sector privado; sin embargo, restringe esta posibilidad para aquellas mujeres que no tienen la posibilidad de acceder por sus propios medios a esta pastilla. / Trabajo de suficiencia profesional

Life is the common denominator for all beings. Unless individuals are taught to be careful about how they deal with it, great harm could be caused to the whole ontological order. Life therefore is a public property for which precepts had to be established to guard against any misuse. This guarantees that life and its processes are used to everyone's advantage. The Community has put itself in position as the monitor of the processes of life. To it belongs the right to distribute, regulate and even withdraw life as different situations would warrant. The community is both the promulgator and the judge over vital matters. The individuals are taught to be conscientious in dealing with life. In making choices the individuals have to be conscious of the historical experiences of the community and be disposed to being influenced by it. Le dommage causé à soi-même a très longtemps constitué un sujet hors du droit, synonyme de stigmatisation morale ou de fatalité. Depuis la fin du XXème siècle, c’est un enjeu essentiel des politiques publiques qui fait encore aujourd’hui l’objet d’un débat éthique et juridique. D’une part, la volonté de se causer un dommage exprime les aspirations de l’homme contemporain à obtenir la maîtrise de son corps, qu’il s’agisse de choisir le temps et les conditions de sa mort, de revendiquer des pratiques masochistes ou bien de faire don de ses organes. D’autre part, cette prise de risque dommageable pour soi révèle très souvent une opposition de l’État et de la société en général, en raison de l’atteinte susceptible d’être portée aux valeurs sociales et aux équilibres budgétaires. En tant que sources croissantes de préoccupation, les manifestations et les limites du dommage causé à soi-même méritent d’être soumises à l’étude de leur contexte historique, social et juridique. / The damage caused to oneself was for a very long time a topic outside the law, as a synonym for moral stigmatization or for fate. Since the end of the XXth century, it is an essential public policy issue that is the object even today of an ethical and legal debate. On the one hand, the will to harm oneself reflects the aspiration of the contemporary man to have the control of its body, that it is a question of choosing the time and the conditions of its death or claiming masochistic practices or donating organs. On the other hand, this harmful risk-taking for oneself reveals frequently an opposition of the State and more generally of the society, because of the potential violation of the social values and the budget balances. As increasing sources of concerns, the manifestations and the limits of the damage caused to oneself deserve to be subjected to the study of their historic, social and legal context.

Vazební zajištění obviněné osoby / Custodial Assurance of The Accused Person

The diploma thesis is focused on the custodial assurance of the accused person. The institute of the custody is seen as a freedom restriction and the person's personal freedom and also it is seen as one of the kinds of ensuring measures. The core is to keep the conditions set by the law and basic principles of the criminal proceedings to not to allow over-use or abuse of the custody. The aim of the diploma thesis is the analysis of the custodial assurance legal frame, custody basic characteristics, its reasons, measures to substitute custody and to map the or of the social worker in this field. It is overall summary of legal adjustments concerning the custody. The thesis is divided into twelve chapters. The first chapter is dedicated to the person assurance itself before the custody procedure and the second chapter includes custody basic characteristics and its legal anchor. The third chapter deals with custodial conditions, reasons and its duration. The fourth one concerns the custody length and other legal terms. The fifth chapter is focused on the decision about custody in proceedings before the court and in the legal proceedings and that in the frame of the authorities by particular organs. The sixth chapter concerns the custody itself, including the place and personal section. There are defined the measures which can be used to substitute the custody in the seventh chapter. There is analysis of the link in the case of youth offenders and there are also stated the main differences from adult accused ones in the eighth chapter. The ninth and tenth chapter mention psycho-social impact of the custody, social work with people in the custody proceedings and the role of the social worker in this field. The last chapter is in short focused on the comparison of the custody and the punishment. The diploma thesis comes out primarily from the judicature, legal regulations - in particular from the Law nr. 141/1961, about the criminal proceedings of justice (legal code), literature with comments, professional articles and internet sources.
