Research on Assemblies and Parades Handled by Police Organizations Analysis the cases of assemblies and parades in Kaohsiung City ¡]during the period from 2001 to 2005¡^

This paper is mainly anchored in assemblies and parades handled by police agency¡¨. First of all, assemblies and parades are the basic human rights protected by our constitution. The purpose of the police¡¦s involvement in the handling of those activities is to safeguard citizens¡¦ exercise of their rights. Secondly, from analysis of practical cases and through verification of experimental activities and modification of theories, reasonable and proper principles of handling such activities can be submitted as a reference for policemen¡¦s law enforcement and education and training. Finally, the study discusses the contents and regulations of the Law of Parade and Demonstration. It also provides directions of modification of the law through theories and experiments in order to make the law more perfect, protect human rights granted by the constitution, and further inspire people¡¦s law-abiding spirit. From my practical experiences in handling assemblies and parades over the years in police organizations of basic level and this study, the author found that the cases of assemblies and parades in Kaohsiung City during the period from 2001 to 2005 were different in their types. Case-by-case analysis, examination of evidence and deductive method were adopted to examine if the police adhere to the principles of ¡§protecting lawful assemblies¡¨, ¡§banning unlawful assemblies, and ¡§imposing sanction against violence¡§, and if they take the positions of ¡§To rule by law¡¨, ¡§administrative neutrality¡¨ and ¡§strict enforcement of law¡¨ at the same time. If not, the results will turn out to be different. In recent years, people¡¦s political consciousness has been rising and the assertion of individual rights and interests has aroused more and more attention. Besides, the two-party system has almost taken shape in Taiwan. Consequently, assemblies and parades become normal in today¡¦s plural and diversified society. The police should know how to play the role of law enforcement and protector correctly. To achieve the goal, the policemen should accumulate their practical experiences and carry out case analysis continuously. By combining ¡§theories¡¨ with ¡§practices¡¨ together, this study reflects the advantages and disadvantages of the police in handling assemblies and parades at current stage, and point out the direction of amendment to the present Law of Parade and Demonstration. Finally, this study submits one set of concrete and feasible plan for the police agency to follow, and I hope that the plan will be helpful in handling assemblies and parades in the future.

Dualities In Bergson Revisited: Towards A Reconciliation?

The aim of this study is to make an inquiry on the nature and the development of dualities in Bergson&rsquo / s philosophy. Since the nature of each duality differs from the others and the dualistic pattern inherent in Bergsonian philosophy is subject to change, we base our study on a chronological structure in order to comprehend better how this pattern changes. We claim that such an inquiry will yield relevant outcomes with regard to ontological and epistemological evolution of Bergson&rsquo / s thought. To state more precisely, we are of the idea that the modification in the dualistic pattern in Bergson&rsquo / s ontology is reflected in a parallel manner in his epistemology. The fundamental question that shows us the way to follow in our study is whether the elements of the dualities (whether they be ontological or epistemological) are reconciled by Bergson or they are left as absolutely distinct elements. At the end of the inquiry regarding that question, which we believe can be taken as an inspiring point in developing new approaches especially to epistemological problems, our conviction is that Bergson points out to a meeting point.

Vad vi framför är ett alternativ till idealismen och vi bemöter det ideella med relationell ontologi. Vi jämför Peter van Inwagen (2011), Bryan E. Bannon (2011), Achille Varzi (2016), Gil C. Santos (2015) och Robin Durie (2002) för att skapa en förståelse för vad relationell ontologi innebär. Vidare väljer vi att använda Andrew Benjamins (2015) definition för vidare struktur av vår teoretiska metod. Denna konkretisering menar på att vår tillblivelse är skapad utifrån relationer, ett utbyte mellan singulariteter, de punkterna som definierar en artefakt eller ett fenomen. Vidare analyserar vi analog skissteknik och applicerar den analysen och dess beståndsdelar på digitala tekniker som bildredigering och 3D modellering i vad vi kallar den Rhizo – Singulär analys som process metoden. Vad vi får ut är ett alternativt sätt att skapa vilket vi väljer att definiera som relationell avbildning, med detta utmanar vi idealismen och de ideella mönsterbilderna (Ohlsson, 2013). Med andra ord att vi förhåller oss till en öppenhet och de förvrängningar inom sinnes – världen utifrån Aristoteles och estetiken enligt Danius, Sjöholm, & Wallenstein (2012). Vi diskuterar de val som vi gör i designprocessen och fortsätter att argumentera för öppna förhållningssätt och förståelse som vi hämtar och jämför från Benjamin (2015) och Deleuze & Guattaris (1987) rhizomen. Undersökningen och den metoden vi skapar kan bli förstådd samt tillämpad i flertalet variationer. Slutgiltligen att den teoretiska metoden växer och förändras utav personer i en plural händelse vilket är Rhizo - Singulär analys som processmetoden. / We present an alternative to idealism and we meet the ideal with the concept of relational ontology. We compare Peter van Inwagen (2011), Bryan E. Bannon (2011), Achille Varzi (2016), Gil C. Santos (2015) and Robin Durie (2002) to create an understanding for what relational ontology is or could be. We choose Andrew Benjamin's (2015) definition to structure our theoretical method. This concretization means relations are fundamental for our becoming as people and objects. Relations are an exchange between singularities, the points which define an artefact or a phenomenon. Continually we analyze sketching techniques and apply that analysis and its components on digital techniques as photo editing and 3D modeling in what we call the Rhizo – Singular analysis as a process method. What we get from doing this is an alternative way of creating which we choose to define as a relational imaging, with this we challenge the idealism and the ideal pattern images (Ohlsson, 2013). In other words we approach to a openness and the material worlds distortions from Aristoteles and the aesthetics of Danius, Sjöholm, & Wallenstein (2012). We discuss the choices that we have made in the design process. We continue to argue for the open approach, the understanding which we gain and compare from Benjamin (2015) as well as Deleuze & Guattari’s (1987) rhizome. In other words the research, it's methods themselves can be understood and be applied in several variations. Finally the theoretical method grows and changes by people in a plural event that is Rhizo - Singular analysis as a process method.

Given that, the process of diversification and pluralism of the Brazilian religious field has been considered in the scenario nowadays, creating new ways of thinking and of expressing religious faith. During that time, among the Baptists living in Belo Horizonte, specifically in the neighborhood called Lagoinha; a new religious organization emerged, the so-called Lagoinha Baptist Church (IBL). In its early days, even though carrying "the Baptist name", this new church took a very singular dynamic form of church liturgy known as " revival/awakening" or "charismatic," whose religious message and practice emphasized and highlighted the manifestation of "spiritual gifts" and experiential "awakening " as the evidence of" baptism in the Holy Spirit. " per se. As a result, there were reactions from the traditional Baptists because the IBL manifestations were deemed as similarly closed to another religious movement so-called Pentecostalism, which differs from those practices adopted by the Baptists from Minas Gerais, deemed as historic and traditional. As result of this new church engagement to Revivalism/Awakening and charismatic practices, the IBL achieved theological, organizational and administrative independence and autonomy. Consequently, the IBL was excluded from the list of cooperating and co-partners Baptist churches of the Brazilian & Mineira Baptist Convention. This church took a religious structure characterized by Revivalism and traces of the Pentecostalism movement within the Baptist denomination. These new traces and paradigms of the IBL were chosen to be analyzed in this paper. However, this thesis takes into account sociological studies regarding religion per se. In other words, the thesis wants to explore how the changes that occurred at IBL are intrinsically correlated to theories of cultural and socio-cultural symbolism. That is to say IBL history and identity are related to the processes of urbanization and modernization of society, which fostered the emergence of more flexible, adaptable and in constant changes of religious forms. Therefore, from this correlation we would like to postulate that the IBL is a religious organization, hybrid, changeable/adjustable, and "broadcasted" with an identity that makes and remakes it, as IBL is being adjusted to a kind of culture that is at the same time, urban, evangelical, technological, broadcasted and well advertised. / A diversidade religiosa brasileira na segunda metade do século XX tornou-se progressiva e tomou enorme velocidade. Com isso, o processo de diversificação e pluralização do campo religioso brasileiro começava a ganhar o contorno atual, abrindo espaço para novas formas de crer e de expressar a fé religiosa. Nessa mesma época, entre os batistas de Belo Horizonte, no bairro da Lagoinha, surgia uma nova organização religiosa, a Igreja Batista da Lagoinha (IBL). Já em seus primeiros dias essa nova igreja assumiu um dinamismo próprio de igrejas conhecidas como avivadas ou carismáticas , cuja mensagem e prática religiosa reforçavam, por meio de dons espirituais e de experiências extáticas , a evidência do batismo no Espírito Santo . Houve reações por parte dos batistas tradicionais, pois a IBL manifestava-se, por um lado, mais próxima de uma religiosidade em processo de pentecostalização e, por outro, mais distante daquela adotada pelos batistas mineiros, identificados como históricos. Esta nova igreja, devido ao seu engajamento no avivalismo e nas práticas carismáticas, alcançou independência teológica, organizacional e administrativa, pois foi excluída do rol das igrejas batistas cooperadoras da Convenção Batista Mineira e Brasileira. É essa igreja que assumiu uma forma religiosa avivada e que desenvolveu o processo de pentecostalização entre os batistas que escolhemos analisar neste trabalho. Entretanto, a análise que realizamos e que se embasou nos estudos da sociologia da religião, nas teorizações da cultura e na simbologia sociocultural, mostrou que as modificações ocorridas na trajetória e na identidade IBL, são correlatas aos processos de urbanização e modernização da sociedade e ao surgimento de formas religiosas, mais flexíveis, adaptáveis e em constante reconfiguração. Portanto, a partir dessa correlação é que podemos afirmar que a IBL é uma organização religiosa híbrida, mutacional, midiática e com uma identidade que se faz e refaz, já que ela está se ajustando a um tipo de cultura que é, ao mesmo tempo, urbana, gospel, tecnológica, mercadológica e comunicacional.

This event allowed the expansion of Christianity beyond its homeland since the first century AD. In little time, Christianity was able to establish itself in several locations throughout the ancient world. This shift led its division into separate sections, each trusting Jesus in their own way. The one which was projected into North Africa fostered a type of Christianity with Gnostic traces. That possibility came to light from some writings found in this region in the mid-twentieth century and that was also attributed to that Christian part. This research has as its objective to analyze this Christian bias based on these findings. This group, considered a minority, had some claims on the official Christianity that regarded them as heretics. The researched target was the way the Gnostics saw Jesus since they considered themselves Christians. / O encontro entre o cristianismo e a cultura grega foi um dos grandes eventos ocorridos na história da humanidade. Esse acontecimento possibilitou a expansão do cristianismo para além de sua terra natal já a partir do primeiro século d.C. Em curto espaço de tempo o cristianismo foi capaz de se estabelecer em diversas localidades do mundo antigo. Esse deslocamento propiciou sua divisão em várias vertentes, cada uma interpretando Jesus a sua maneira. A que se projetou para o norte do continente africano fomentou um tipo de cristianismo, ao que tudo indica, com traços gnósticos. Essa possibilidade veio à tona a partir de alguns escritos encontrados nessa região em meados do século XX e atribuídos a essa vertente cristã. Esta pesquisa tem como proposta analisar esse viés cristão com base nessas descobertas. Esse grupo, considerado minoritário, possuía algumas reivindicações frente ao cristianismo oficializado que os considerava herege. O alvo pesquisado foi à concepção de Jesus que os gnósticos sustentavam uma vez que se consideravam cristãos.

Les recherches en psychologie clinique interculturelle décrivent avec pertinence les aménagements psychiques et/ou psychopathologiques engagés par les processus acculturatifs. Cependant, se pose la question de la façon dont les différentes cultures au carrefour desquelles se situe un sujet vont interagir entre elles au sein même de l'individu. Ainsi, la rencontre des cultures ne se produit pas uniquement dans le champ social, mais aussi dans l'espace psychique, de sorte que l'interculturel ne décrit pas simplement un phénomène extérieur, mais plus singulièrement une composition subjective. Pouvons-nous produire une représentation topique de cette pluralité interne ? Que nous apporterait-elle dans la compréhension du sujet interculturel ? Afin de répondre à ces questions, nous proposons une approche interdisciplinaire et transversale entre ces deux « commutateurs » du social en l'individu que sont le Surmoi et l'habitus. La modélisation d'un « acteur pluriel » (Lahire, 2001), à l'image des matrices de socialisation et espaces sociaux auxquels il participe, servira de socle à partir duquel nous penserons la pluralité interne du sujet interculturel. Les dispositifs de régulation psychique (mécanismes de défense et stratégies de coping) seront nos indicateurs. Notre étude porte sur la comparaison de sujets (N=497) autochtones et issus d'une immigration, en fonction de l'aire géographique et culturelle d'origine et du degré d'ascendance immigrée. Nos résultats concordent globalement avec l'hypothèse d'un sujet interculturel sur le modèle d'un acteur pluriel. Cette perspective nous permet de proposer une représentation topique de l'incidence de l'interculturalité comme pluralité interne, mais aussi, à un niveau empirique de dégager une représentation dynamique des incidences de l'immigration sur les sujets qui en sont issus. / Research in intercultural clinical psychology describes the psychic and/or the psychopathological changes incurred by the acculturation process. However, the question arises of how different cultures will interact with each other within the psychological space of the individual. Thus, the meeting of cultures does not only occur within the social field, but also within the psychicological space. The intercultural aspects do not simply refer to an outside reality, but more particularly to a subjective experience. Can we produce a representation of this internal plurality? What would be its contribution in understanding the intercultural domain? To answer these questions, we propose a transversal and interdisciplinary approach that strives to understand how the two social "switches" of the individual operates, that is the superego and the habitus. The modeling of a "plural actor" (Lahire, 2001), in the image of socialization matrices and social spaces to which he belongs, will serve a basis from which the internal plurality of cultures will be addressed. The regulatory mechanisms of the psychic (the defense mechanisms and the coping strategies) will be our indicators. Our study focuses on the comparison between non-immigrant and immigrant individuals (N=497), in function of their geographical and cultural origin, and the degree of immigrant descent. Our results are consistent with the hypothesis according to which an intercultural topic should be integrated in the model of a plural actor. This perspective allows us to provide a clear picture of the impact of multiculturalism as internal plurality, but also to generate a dynamic representation of the effects of immigration on related topics.

Although it is a widespread theory, as the New Institutional Economics as a whole, its empirical application is still incipient in the context of organizational plurality, given that it aims deterministic solutions where transactional attributes align to an optimum governance, which minimizes transaction costs. However, companies often combine alternative forms of governance for the same type of transaction in a given institutional environment, which suggests that the understanding of governance is richer than the choice of alternatives modes of coordination. Therefore, it is extremely desirable the incorporation of plural forms phenomenon to Transaction Costs Economics, so in this research it is proposed, through two case studies, to identify the factors that influence the adoption of plural forms of governance on small size regional franchises from agrifood sector, on structuration and those are suppliers/producers of premiums goods. The choice of franchises as study object due to the fact that these are empirical cases of organizational plurality by excellence, because is usual the concomitant operation of owned and franchisees stores, besides the abundant data about the sector. Moreover, the focus in the agrifood segment is justified by its importance to the Brazilian economy, and mainly by the intrinsic peculiarities of its products – such as perishability and seasonality –, inducing agents to adopt solutions that are faster and more efficient in the management of their businesses. Size, niche market, time and operating range are regularities observed in both cases, similarities that allow comparing them to obtain higher-level theoretical findings, which abstract from the specificities of units analysis. Not only it was listed the reasons why such franchises adopt the organizational plurality, but also this study contributed to the incorporation of plural forms in the analytical scope of traditional Transaction Costs Economics. This research contributed to it in three ways: a) it was evident that the particularities of agrifood chains and products play an important role in the use of organizational plurality in the cases examined; b) the concepts of complexity, strategic behavior and ambiguity proved to be empirically valid and robust at the explanation of the phenomenon of plural forms, and the attributes of transactions contributed to this due to the various interfaces found between them and the other studied constructs; and c) the traditional factors that usually define the optimal hierarchical level in a franchise network, also help to justify why to adopt the organizational plurality in the examined companies, mainly to lead to an increased market power and better strategic positioning of the franchisor front of their franchisees. / A Economia dos Custos de Transação é um importante ferramental analítico no estudo da organização microeconômica das firmas, especialmente no que tange às estruturas de governança por elas adotadas. Mesmo sendo uma teoria amplamente difundida, tal como a Nova Economia Institucional como um todo, sua aplicação empírica ainda é incipiente no contexto da pluralidade organizacional, dado que visa, em primazia, soluções determinísticas em que os atributos transacionais estejam alinhados a uma governança ótima, minimizadora dos custos de transação. No entanto, as empresas frequentemente combinam modos alternativos de governança para o mesmo tipo de transação dentro de um determinado ambiente institucional, o que sugere que o entendimento da governança é mais rico do que a escolha de modos alternativos de coordenação. Assim sendo, torna-se extremamente desejável a incorporação do fenômeno das formas plurais à Economia dos Custos de Transação, de modo que se propõe na presente pesquisa, por meio de dois estudos de caso, apontar os fatores que influenciam na adoção de formas plurais de governança em franquias regionais em estruturação, de pequeno porte, do setor agroindustrial e ofertantes/produtoras de bens premiums. A escolha de franquias como objeto de estudo deve-se ao fato de que estas são, por excelência, casos empíricos de pluralidade organizacional, haja visto que é usual a operação concomitante de lojas próprias e franqueadas em uma rede, além de serem abundantes dados sobre o setor. Ademais, justifica-se o foco no segmento agroindustrial não apenas pela sua importância que para a economia brasileira, mas principalmente pelas peculiaridades intrínsecas de seus produtos – como perecibilidade e sazonalidade –, as quais induzem os agentes a adotarem soluções mais rápidas e eficientes na gestão de seus negócios. Quanto ao porte, nicho de mercado, tempo e raio de operação, tratam-se de regularidades observadas em ambos os casos, similaridades essas que permitem compará-los para obtenção de achados teóricos de mais alto nível, que se abstraiam das especificidades das unidades de análise. Portanto, não somente foram elencadas as razões que levam tais franquias à adotarem a pluralidade organizacional, como também se colaborou para incorporação das formas plurais ao escopo analítico da Economia dos Custos de Transação tradicional. A presente pesquisa contribuiu de três formas para isso: a) ficou evidente que as particularidades das cadeias e produtos agroindustriais têm importante papel no uso da pluralidade organizacional nos casos analisados; b) os conceitos de complexidade, posicionamento estratégico e ambiguidade mostraram-se empiricamente válidos e robustos na explicação do fenômeno das formas plurais, tendo os atributos das transações contribuído para isso devido às diversas interfaces verificadas entre eles e os demais constructos estudados; e c) os fatores tradicionais, que usualmente definem o nível ideal de integralização em uma rede de franquias, também auxiliam a justificar o porquê da adoção da pluralidade organizacional nas empresas examinadas, principalmente por levarem a um maior poder de mercado e melhor posicionamento estratégico do franqueador frente a seus franqueados.
