Explaining domestic inputs to Israeli foreign and Palestinian policy politics, military, society

Approved for public release; distribution in unlimited. / Advancing the peace process between Israel and the Palestinians is of great interest to the United States. To this aim, an understanding of the main factors involved in Israel's foreign policymaking is needed. This thesis shows internal pressures are most significant and assesses the influence of domestic access points to Israel's Palestinian policy. For a complete and current analysis of Israel's policymaking process three areas are discussed. First are the fundamentals that makeup Israel's political system such as the Knesset, political parties, ruling coalition, and prime minister. Second is the role of the Israeli Defense Force and the balance in civil-military relations. Third is the mixture of players that color Israel's societal landscape including subcultures, interest groups, and public opinion. The purpose of this thesis is to describe V. French Republic, its unique mode of operation and particularly the position of president, as a characteristic symbol of semi- presidential systems. The beginning of the thesis and its first chapter is devoted to historical conditions and circumstances that led to the creation of the Fifth Republic. Afterwards, the work describes basic political institutions of the French system. The second part of the work deals with various theories of the semi-presidential systems and understanding of the French prototype within these definitions. The third chapter then compares the political practice in the United States and France. Likewise it compares the two kinds of presidents in those countries. Finally, the theme of the final chapter is French president's ability to govern as a modern "monarch" within the V. French Republic. Keywords V. Terrorism, war and international law: the legality of the use of force against Afghanistan in 2001

The thesis examines the international law pertaining to the use of force by states, in general, and to the use of force in self-defence, in particular. The main question addressed is whether the use of force, which was purported to be in self-defence, by the United States, the United Kingdom and their allies against al Qaeda, the Taliban and Afghanistan, beginning on 7 October 2001, was lawful. The thesis focuses not only on this specific use of force, but also on the changing nature of conflict, the definition of terrorism and on the historical evolution of limitations on the use of force, from antiquity until 2006. In the six chapters which trace the epochs of international law, the progression of five inter-related concepts is followed: limitations on the resort to force generally, the use of force in self-defence, pre-emptive self-defence, the use of forcible measures short of war, and the use of force in response to non-state actors. This historical analysis includes a particular emphasis on understanding the meaning of the 'inherent right of self-defence', which was preserved by Article 51 of the United Nations' Charter. This analysis is then applied to the use of force against Afghanistan which occurred in 2001. Following the terrorist attacks of 11 September, the US and the UK notified the United Nations Security Council of their resort to force in self-defence under Article 51. Each element of Article 51 is analysed and the thesis concludes that there are significant doubts as to the lawfulness of that decision to employ force. In addition to the self-defence justification, other possible grounds for intervention are also examined, such as humanitarian intervention, Security Council authorisation and intervention by invitation. This thesis challenges the common assumption that the use of force against Afghanistan was an example of states exercising their inherent right to self-defence. It argues that if this particular use of force is not challenged, it will lead to an expansion of the right of self-defence which will hinder rather than enhance international peace and security. Finally, this thesis draws on recent examples to illustrate the point that the use of force against Afghanistan could become a dangerous precedent for the use of force in self-defence.

Die gesag van die cabinets is kontroversieel en word enersyds geprys en andersyds gekritiseer. Die Franse ministeriele cabinet neem die plek in van 'n permanente departementshoof. en bestaan uit 'n groep persoonlike personeel wot aan elke minister verbonde is. Sy funksie is om horn te ondersteun en te adviseer sodat hy 'n ingeligte oordeel kan fel voordat hy besluite neem, en ook om te verseker dot sy beleid geformuleer, verduidelik en uitgevoer word. The authority of the cabinets is either praised or criticised. The French ministerial cabinet substitutes for a permanent head of a deportment, and consists of a group of personal staff serving each minister. Its function is to support and advise him, in order to enable him to make informed judgements before taking decisions, and also to ensure that his policy is formulated. clarified and executed. In its original form the ministerial cabinet was a political institution, generally consisting of political allies of the minister. However. in the Fifth Republic it was transformed into a formal institution. It acquired an indispensable role in effecting liaison and co-ordination of the political system with the administrative system. The author has found that where cabinets function as efficient and effective mechanisms, they strengthen the relationship of the political and administrative systems in general to the advantage of good governance. Ineffective cabinets, however. impair the relations within and among ministries to the disadvantage of the government. It has also been established that cabinets play an important role in bridging the gap between the minister and the officials in his ministry. Ce mémoire vise à évaluer les réformes consistant à encadrer le pouvoir de nomination que confère la prérogative royale au premier ministre. Notre étude s’inspire largement de l’institutionnalisme historique en science politique et des analyses en termes de « path dependency ». Selon cette approche, lorsque les décideurs amorcent une trajectoire de politique publique, leurs décisions subséquentes auront tendance à suivre la même direction. À partir des documents gouvernementaux et des transcriptions de comités parlementaires, ainsi que de l’exemple de la Grande-Bretagne, ce travail cherche à évaluer si les réformes visant à contraindre le pouvoir de nomination du premier ministre canadien ont suivi une trajectoire « path dependent ». Nos conclusions nous amènent plutôt à constater qu’en ce qui concerne les nominations, le Canada est plus monarchique que la Grande-Bretagne. Pour le Canada, l’impression générale qui se dégage à la fin de ce mémoire n’en est pas une de « path dependence » mais plutôt d’incrémentalisme disjoint. / This paper aims to assess the reforms that regulate the appointment power conferred by the Royal Prerogative to the Prime minister. Our study is largely based on historical institutionalism in political science and analysis in terms of “path dependency”. This theory argues that once policymakers begin a course of public policy, their subsequent decisions will follow the same direction. Based on governmental documents, transcripts of parliamentary committees and the example of Great Britain, this work seeks to assess whether the reforms to constrain the appointment power of the Prime Minister of Canada validates the “path dependence” approach. Our findings leads us rather to see that with regard to appointments, Canada is more monarchical than Great Britain. Our general conclusion is that the Canadian approach is not “path dependent” but can be better described as “disjointed incrementalism”.

Sovereignty, Peacekeeping, and the United Nations Emergency Force (UNEF), Suez 1956-1967: Insiders’ Perspectives

This research is concerned with the complex and contested relationship between the sovereign prerogatives of states and the international imperative of defusing world conflicts. Due to its historical setting following World War Two, the national vs. international staking of claims was framed within the escalating imperial-nationalist confrontation and the impending “end of empire”, both of which were significantly influenced by the role Israel played in this saga. The research looks at the issue of “decolonization” and the anti-colonial struggle waged under the leadership of Egypt’s President Nasser. The Suez War is analyzed as the historical event that signaled the beginning of the final chapter in the domination of the European empires in the Middle East (sub-Saharan decolonization followed beginning in the early 1960s), and the emergence of the United States as the new major Western power in the Middle East. The Suez experience highlighted a stubborn contest between the defenders of the concept of “sovereign consent” and the advocates of “International intervention”. Both the deployment of the United Nations Emergency Force (UNEF) and its termination were surrounded by controversy and legal-political wrangling. The role of UNEF and UN peacekeeping operations in general framed the development of a new concept for an emerging international human rights law and crisis management. The UNEF experience, moreover, brought into sharp relief the need for a conflict resolution component for any peace operation. International conflict management, and human rights protection are both subject to an increasing interventionist international legal regime. Consequently, the traditional concept of “sovereignty” is facing increasing challenge. By its very nature, the subject matter of this multi-dimensional research involves historical, political and international legal aspects shaping the research’s content and conclusions. The research utilizes the experience and contributions of several key participants in this pioneering peacekeeping experience. A Revolução Federalista e o ideário parlamentarista remonta à história política do Império do Brasil. Com a proclamação da República em 15.11.1889, a vida política e social modificou-se sobremaneira. A forma de Estado deixou de ser Unitária para ser Federativa, o sistema de governo deixou de ser Parlamentarista para ser Presidencialista, a forma de governo deixou de ser Monárquica para se tornar Republicana. Tais reformas lideradas pelo Marechal Deodoro da Fonseca e por Benjamin Constant depositaram grandes expectativas no povo brasileiro. Todos os males do império projetavam-se na república. Com o tempo, o povo foi vendo, pouco a pouco, que as velhas mazelas que assombravam a vida imperial, rondavam, igualmente, a vida republicana. O sistema eleitoral e as reformas eleitorais não garantiam a plena democracia, tanto que Deodoro e os seus garantiram, artificialmente, a maioria na Constituinte de 1891. O alistamento ainda era forjado, a grande naturalização favorecia os Republicanos Históricos, sendo que a vontade da Nação distanciava-se, cada vez mais, da vontade dos proclamadores da República. A instabilidade política e social era acompanhada pelo abalo econômico. As constantes emissões, a jogatina na bolsa, o encilhamento, a substituição do trabalho servil pela mão de obra livre, a substituição dos velhos liberais e conservadores do Império pela mocidade imberbe da República, toda ela inexperiente, toda ela não versada no serviço público é que passou a gerir a vida pública nos mais diferentes estados da nossa federação. A ala jovem republicana, lotada em importantes cargos administrativos e governamentais, trocou os pés pelas mãos, angariando a raiva das forças tradicionais do Império. O Estado do Rio Grande do Sul, por exemplo, assistiu, durante o Governo Provisório, passar pelo Estado, nada menos que seis Governadores. A instabilidade política era total. A diátese revolucionária prenunciava levantes armados em poucos dias. Parafraseando D. Pedro, Deodoro abandonou o poder, momento em que assina o decreto de alforria do verdadeiro escravo do Brasil. Assume o poder o Vice-Presidente, Marechal Floriano Peixoto, o qual presta apoio político ao Governador do Estado do Rio Grande do Sul, o Sr. Júlio de Castilhos. Ambos aliam-se contra o exército libertador de Gaspar Silveira Martins, que havia retornado do exílio e fundara o Partido Federalista Rio-Grandense, no Congresso de Bagé, para fazer frente ao Governo autoritário de Júlio de Castilhos. Travou-se no Rio Grande do Sul uma das mais sangrentas guerras de nossa história. A Revolução Federalista foi um guerra fratricida, que matou mais de dez mil homens. Estes revolucionários liderados intelectualmente por Gaspar Silveira Martins e militarmente pelo General Joca Tavares, Gumercindo Saraiva e Aparício Saraiva, guerrearam por três estados da federação (RS, SC e PR), fazendo a república tremer. Em certos momentos, a revolução parecia que garanharia contornos nacionais, e o Presidente Floriano temia o futuro da República. The state form stopped being unitary to be federative, the government system stopped being parlamentarism to be presidentialism, the government form stopped being a monarchy to be a republic. Such reformations, leaded by Marshal Deodoro da Fonseca and by Benjamin Constant created great expectations in the Brazilian people. All the evils of the empire protruded in the republic. Over time, the people started to understand, inchmeal, that the old evils that haunted the empire, also prowled the republican life. The electoral system and the poll reformations do not assured full democracy, so that Deodoro and his cronies achieved, artificially, majority in the 1891´s constituent. The voter registration was wrought, the great naturalization favored the historic republicans, as the nation´s will distinguished increasingly from the will of the republic proclaimers. The social and political instability was accompanied by the economic debacle. The constant issuance of paper money, the gambling on the stock exchange, the encilhamento, the change from the slave work by the free work, the substitution of the old empire´s liberal and conservative politicians by the republic´s beardless youth, all of them lacking experience, without knowledge of the public service, started to manage the public life in the diferent states of the Brazilian federation. The republican´s youth wing, occupying important administrative and governmental positions, created confusion, causing rage by the traditional forces of the empire. The Rio Grande do Sul´s state, for instance, under the Brazilians Provisional government, had no less than six governors. There was a complete political instability. The revolutionary diathesis foreshadowed armed uprisings in few days. Paraphrasing D. Pedro, Deodoro abandoned the power, in the moment in which signs the emancipation decree of the true Brazi´s slave. The vice president, Marshal Floriano Peixoto, assumes the power, and provides political support to the Rio Grande do Sul´s state´s governor, Mr. Júlio de Castilhos. They both allied against the Gaspar Silveira Martins´s liberator army, which had returned from the exile and founded the Rio Grande do Sul´s Federalist Party, in the Bagé´s Congress, to oppose Júlio de Castilhos ´s authoritarian govern. Then happened one of the bloodiest wars of our history. The Federalist Revolution was a fratricidal war, that killed over ten thousand men. These revolutionaries, intellectually leaded by Gaspar Silveira Martins and military commanded by General Joca Tavares, Gumercindo Saraiva e Aparício Saraiva, waged war in three states of the federation (RS, SC and PR), making the republic tremble. In certain moments, the revolution seemed to gain national contours, and the President Floriano feared for the future of the Republic. In the Prudente de Morais presidential government was signed, in the town of Dom Pedrito, the farroupilha peace, when the Silveira Martins´s maragatos and the Júlio de Castilhos´s chimangos shaked hands: the Republic was consolidated, once and for all.

Pour le Canada, l’impression générale qui se dégage à la fin de ce mémoire n’en est pas une de « path dependence » mais plutôt d’incrémentalisme disjoint. / This paper aims to assess the reforms that regulate the appointment power conferred by the Royal Prerogative to the Prime minister. Our study is largely based on historical institutionalism in political science and analysis in terms of “path dependency”. This theory argues that once policymakers begin a course of public policy, their subsequent decisions will follow the same direction. Based on governmental documents, transcripts of parliamentary committees and the example of Great Britain, this work seeks to assess whether the reforms to constrain the appointment power of the Prime Minister of Canada validates the “path dependence” approach. Our findings leads us rather to see that with regard to appointments, Canada is more monarchical than Great Britain. Our general conclusion is that the Canadian approach is not “path dependent” but can be better described as “disjointed incrementalism”.
