Open data in Swedish municipalities? : Value creation and innovation in local public sector organizations / Öppna data i svenska kommuner? : Värdeskapande och innovation i lokala offentliga organisationer

Digital transformation is highlighted as a way of solving many of the problems and challenges that the public sector faces in terms of cost developments and increased demands for better public services. Open data is a strategic resource that is necessary for this development to takeplace and the municipal sector collects information that could be published to create value inmany stages. Previous research believes that economic value is generated through new innovative services and productivity gains, but also social values such as increased civic participation and transparency. But despite previous attempts to stimulate open data, Sweden is far behind comparable countries and there is a lack of research that looks at exactly how these economic values should be captured. To investigate why this is the case and what role open datahas in value creation in the municipal sector, this study has identified several themes through qualitative interviews with an inductive approach. The study resulted in a deeper theoretical analysis of open data and its properties. By considering it as a public good, it is possible to use several explanatory models to explain its slow spread and but also understand the difficult conditions for value capture which results in incentive problems. In addition, there are structural problems linked to legislation and infrastructure that hamper the dissemination of open data and its value-creating role in the municipal sector. / Digital transformationen lyfts som ett sätt att lösa många av de problem och utmaningar som den offentliga sektorn står inför gällande kostnadsutveckling och ökade krav på bättre samhällsservice. Öppna data är en sådan strategisk resurs som är nödvändig för att dennautveckling ska ske och kommunsektorn samlar på sig information som skulle kunna publiceras för att skapa värden i många led. Dels menar tidigare forskning att ekonomiska värden kan genereras genom nya innovativa tjänster och produktivitetsökningar, men även sociala värden som ökad medborgardelaktighet och transparens. Men trots tidigare försök att stimulera öppna data, ligger Sverige långt efter jämförbara länder och det saknas forskning som tittar på exakt hur dessa ekonomiska värden ska fångas. För att undersöka varför så är fallet och vilken roll öppna data har på värdeskapande i kommunsektorn har denna studie genom kvalitativa intervjuer med en induktiv ansats identifierat flertalet teman. Studien resulterade i en djupare teoretisk analys av öppna data och dess egenskaper. Genom att betrakta det som en kollektiv vara går det att använda flera förklaringsmodeller för att förklara dess långsamma spridning och förstå de svåra förutsättningarna för värdefångst vilket resulterar i incitamentsproblem. Till det finns det strukturella problem kopplat till lagstiftning och infrastruktur som hämmarspridningen av öppna data och dess värdeskapande roll i kommunsektorn.

Strategic Decision Making With Inequality

<p dir="ltr">This dissertation investigates strategic decision-making under conditions of environmental inequality. The three chapters explore various forms of inequality across different decision contexts</p><p dir="ltr">The first chapter examines the impact of income inequality on individuals' participation in multiple public goods investments. Specifically, it analyzes how a global club good opportunity influences local public goods provision in indefinitely repeated interactions within a linear public goods game using a voluntary contribution mechanism. The study varies global club entry costs and local community endowment compositions to assess their effects on contributions and welfare. It finds that income inequality does not significantly alter contribution behaviors in single public good settings under indefinitely repeated interactions. With the introduction of a global club good, lower entry costs lead to higher participation rates among subjects, resulting in increased total welfare for both homogeneous and heterogeneous communities. Conversely, higher entry costs reduce participation and overall welfare. Heterogeneous communities discontinue club use sooner than homogeneous ones. Efficiency, measured as realized payoff relative to maximal social benefits, declines across all treatments following the introduction of a global club good. Additionally, counterfactual simulations using an individual evolutionary learning model demonstrate that the welfare benefits of a global club good opportunity hinge on its ability to yield substantial social benefits compared to local public goods.</p><p dir="ltr">The second chapter explores how power inequality influences cooperation in a dynamic game where competition and cooperation evolve over time. This research, conducted as part of a collaborative project with Yaroslav Rosokha, Denis Tverskoi, and Sergey Gavrilets, examines cooperation dynamics in scenarios where cooperation's benefits depend on political power derived from a contest. The study highlights that incumbency advantages in political contests precipitate a rapid breakdown of cooperation within social dilemmas. Furthermore, it investigates behavioral disparities between groups and individuals, leveraging simulations based on the Arifovic and Ledyard (2012) individual evolutionary learning model to shed light on the difference observed in the experiment.</p><p dir="ltr">The third chapter investigates the impact of unequal positions in a directed communication network on individuals' optimal stopping rules and social learning outcomes. The study involves subjects making predictions about uncertain states of the world using private information and social information obtained through a directed network. Theoretical predictions suggest that individuals should wait when the benefit of waiting exceeds the associated cost. Empirical results confirm that subjects indeed wait longer in more connected networks or when waiting costs are low. However, deviations from equilibrium predictions indicate influences of bounded rationality (supported by quantal response equilibrium) and heuristic decision-making, where some subjects consistently wait for a single turn regardless of positional advantage. Importantly, under-waiting at an information aggregator's position has negative externalities on group-wide information acquisition.</p>

Volksentscheide sind ein Instrument der direkten Demokratie. Durch sie erhält die Bevölkerung die Möglichkeit, sich an der politischen Willensbildung zu beteiligen und direkt über Sachthemen abzustimmen - so am 27. Februar 2005 in Dresden, als die Stadtbevölkerung zur Abstimmung über die Realisierung des Verkehrszuges „Waldschlößchenbrücke Dresden“ aufgerufen war. Die Untersuchung des Abstimmungsverhaltens der Dresdner Bevölkerung beim Bürgerentscheid ist Gegenstand dieser Arbeit. So werden mittels thematischer Karten und multipler Regressionsrechnung Zusammenhänge zwischen dem Abstimmungsverhalten beim Bürgerentscheid und den Merkmalen der Bevölkerung analysiert. Im Fokus der Untersuchung steht die Modellierung des Abstimmungsverhaltens, d.h. die Abbildung möglicher Einflussfaktoren und die Suche nach der richtigen Modellspezifikation. Unter Anwendung des Bottom-up-Ansatzes zur Suche nach der richtigen Modellspezifikation zeigt sich, dass die durch Variablen abgebildeten Einflussfaktoren Ideologie, Nutzen, Alter und Bildung ca. 84% der Gesamtvarianz des Abstimmungsverhaltens erklären. Aus diesen Schätzergebnissen lässt sich schlussfolgern, dass die ideologische Einstellung des Wählers, gepaart mit dem vom Wähler erwarteten Nutzen, dessen Alter und Bildungsgrad, den größten Einfluss auf die Zustimmung zum Verkehrsprojekt hatte. Darüber hinaus deuten der positive Einfluss des Alters und der negative Einfluss des Bildungsgrades auf die Zustimmung zum Verkehrsprojekt darauf hin, dass die Bereitstellung von Verkehrsinfrastruktur durch alte und weniger gut ausgebildete Wählerschichten bevorzugt wird. Um diese Erkenntnisse für künftige Volksentscheide zu Verkehrsinfrastrukturprojekten nutzbar zu machen, wird die Prognosegüte des Modells des Abstimmungsverhaltens mittels Kreuzvalidierung überprüft. Das Ergebnis der Kreuzvalidierung ist eindeutig: Mit einer deutlich unter dem Grenzwert liegenden Abweichung eignet sich das Modell für Prognosen.

An institutional approach to appropriation and provision in the commons : a case study in the Highlands of Eritrea

Thesis (MAgric (Agricultural Economics))—University of Stellenbosch, 2006. / The natural resources mainly land, forests, and grazing lands in the Highlands ago-ecological zone of Eritrea are in a severely degraded state. And much of these common pool resources comprise commons i.e. they are managed under the common property rights management regimes. “The tragedy of the commons”, model suggests that all commons will inexorably suffer overexploitation and degradation. Contrary to this deterministic proposition, however, common property theory argues that the ‘tragedy’ is not due to inherent flaws in the common property rights management regimes, but because of institutional failure to control access to resources, and to make and enforce internal decisions for collective use. If the commons dilemma situation exists- i.e. ‘tragedy’, then the underlying problem is the degeneration of the existing common property rights resource management regime into open-access-like regime—a condition that can potentially trigger “the tragedy of the commons”. The question of how to deal with the problem of the commons is, therefore, primarily an issue of the existence of efficient institutions. The prevailing severe degradation of the common-pool resources in the Highlands of the country thus calls into question the robustness of the common property rights regimes that are in place for the governance of these resources. This thesis attempts to address this important problem specifically in relation to forest and grazing land common pool resources. A case study based on a single-case qualitative and exploratory-explanatory research design was carried out in a village located in the Highlands of the country. Data were collected through various forms of interviews (semi-structured interviews, in-depth interviews, key informants interviews, group discussions, and informal conversational interviews), direct observation, and document review. The data, gathered largely through using these separate lines of enquiry, were crosschecked to provide a triangulation of methods and to strengthen the validity and reliability of the data. The empirical findings reveal that existing common property rights management regimes for the management of the local common pool resources of the case study area have weakened over time. These findings indicate that, there is a significant incongruence between appropriation and provision rules. And this is manifested in terms of appropriation externalities and demand side and supply side provision externalities. This situation implies that existing local institutional arrangements i.e. common property rights management regimes in the case study area are not sufficiently robust to solve common pool resource appropriation and provision externalities. Though generalisation cannot be made beyond the case that was studied, there are several lessons that may be drawn from this field analysis, which may have valid implications for the natural resources management challenges and opportunities of the entire Highlands agoecological zone of the country.

Application of stochastic differential games and real option theory in environmental economics

This thesis presents several problems based on papers written jointly by the author and Dr. Christian-Oliver Ewald. Firstly, the author extends the model presented by Fershtman and Nitzan (1991), which studies a deterministic differential public good game. Two types of volatility are considered. In the first case the volatility of the diffusion term is dependent on the current level of public good, while in the second case the volatility is dependent on the current rate of public good provision by the agents. The result in the latter case is qualitatively different from the first one. These results are discussed in detail, along with numerical examples. Secondly, two existing lines of research in game theoretic studies of fisheries are combined and extended. The first line of research is the inclusion of the aspect of predation and the consideration of multi-species fisheries within classical game theoretic fishery models. The second line of research includes continuous time and uncertainty. This thesis considers a two species fishery game and compares the results of this with several cases. Thirdly, a model of a fishery is developed in which the dynamic of the unharvested fish population is given by the stochastic logistic growth equation and it is assumed that the fishery harvests the fish population following a constant effort strategy. Explicit formulas for optimal fishing effort are derived in problems considered and the effects of uncertainty, risk aversion and mean reversion speed on fishing efforts are investigated. Fourthly, a Dixit and Pindyck type irreversible investment problem in continuous time is solved, using the assumption that the project value follows a Cox-Ingersoll- Ross process. This solution differs from the two classical cases of geometric Brownian motion and geometric mean reversion and these differences are examined. The aim is to find the optimal stopping time, which can be applied to the problem of extracting resources.

Les recompositions à l’œuvre sur les territoires ruraux décrivent une mosaïque de situations soulignant l’importance du rôle des dispositifs de coordination pour expliquer les trajectoires vertueuses ou de déclin. Mais, paradoxalement, les modalités d’intervention publique apparaissent de plus en plus difficiles, soulignant le caractère crucial de la question de la gouvernance territoriale. C’est l’objet de cette thèse, qui traite du rôle joué par la gouvernance territoriale dans le développement territorial, et des dynamiques de changement des dispositifs institutionnels qui composent la gouvernance territoriale. La première partie pose les termes du débat actuel sur les questions de gouvernance territoriale et sa place dans les processus de développement, et présente les principales conceptions et grilles analytiques de la littérature sur cette notion, avant de proposer une grille de lecture originale mobilisée dans des chapitres suivants. La seconde partie met l’accent sur deux dimensions majeures de la gouvernance territoriale, la place des conflits et des processus de négociation, et les mécanismes de changement institutionnel. Enfin, la troisième partie, traite de l’influence des formes de gouvernance sur les modalités de valorisation des ressources territoriales. Les réflexions portent plus précisément sur l’implication des acteurs dans la mise en œuvre des dispositifs de gestion des biens publics à partir de l’exemple des productions sous indication géographique, et sur le rôle des initiatives privées et associatives comme contributrices à la gouvernance des territoires ruraux, illustrées ici par la stratégie des coopératives agricoles. / The reorganization at work in rural areas describes a mosaic of situations stressing the important role of coordination mechanisms to explain territorial virtuous trajectories and situations of decline. But, as a paradox, public interventions appear more and more difficult to define and settle, emphasizing territorial governance as a core issue. This is the subject of this thesis, which deals with this issue through two questions: the role of territorial governance in territorial development, and the forms and changes in institutions devices as part of territorial governance. The first part addresses the terms of the current debate on territorial governance issues and their role in the development process, and presents the main concepts and analytical grids of the literature on this concept, before clearing an analytical grid mobilized in the following chapters. The second part focuses on two major dimensions of territorial governance, the role of conflict and negotiation processes and innovation in institutional devices. The third part deals with the influence of forms of governance on the valuation methods of territorial resources. Reflections relate specifically to the involvement of stakeholders in the implementation of management systems of public goods on illustrated by the example of geographical indication devices, and the role of private and community initiatives as contributing to the governance of rural areas, illustrated by the strategy of agricultural cooperatives.

La lutte internationale contre le blanchiment d’argent et le financement du terrorisme peut être définie comme l’ensemble des mesures qui concourent à l’éradication des flux financiers illicites.Le cadre juridique tel qu’il est défini de nos jours et intégré dans les ordres juridiques nationaux est une combinaison des conventions de l’Organisation des Nations Unies (ONU) et des Recommandations du Groupe d’Action Financière (GAFI). Il a été construit ces trente dernières années en raison de la menace que représentent certaines formes de criminalité : trafic illicite de stupéfiants, criminalité transnationale organisée, terrorisme et son financement.La présente étude se propose de matérialiser l’émergence d’un principe intrinsèque à la lutte contre les flux financiers illicites à travers le concept de sécurité financière internationale, qui apparait comme la finalité des mesures adoptées dans le cadre de la lutte internationale contre le blanchiment de capitaux et le financement du terrorisme.Nous illustrons cette hypothèse à partir d’une analyse de la politique criminelle internationale, autrement dit, l’ensemble des procédés par lesquels la communauté internationale organise les réponses au phénomène de la criminalité financière. Celle-ci permet de dessiner les contours de ce que nous qualifions de sécurité financière et démontre que la réponse de la communauté internationale au phénomène de la criminalité financière, tend inexorablement vers l’instauration d’un ordre à l’échelle internationale.Cette sécurité financière est synonyme d’ordre. Un ordre qui s’établit aussi bien en droit international que dans les droits internes, un ordre qui est caractérisé par un « droit à texture multiple avec primauté de la soft law ».Cet ordre justifie et fonde à la fois les obligations préventives et répressives, malgré les restrictions qu’il apporte à certains droits fondamentaux. Cet ordre regroupe de fait, un ensemble de prescriptions dont l’objectif est de préserver la société internationale des facteurs de désordre que sont les flux financiers illicites, le crime organisé, et le terrorisme.La sécurité financière est à la fois un objectif à atteindre et une nécessité majeure.Nous consolidons cette hypothèse par une réflexion sur les enjeux que représente l’instauration d’une sécurité financière et sur les moyens susceptibles d’en garantir l’effectivité. / The international fight against money laundering and the financing of terrorism can be defined as the set of measures helping eradicate illicit financial flows.The legal framework as it is settled on and implemented into national legal orders is a combination of the United Nations (UN) conventions and the recommendations of the Financial Action Task Force (FATF).It was built over the past 30 years in response to the threat posed by certain forms of crime such as drug trafficking, transnational crime and the financing of terrorism.This work ambitions to highlight the emergence of an inherent principle to the fight against criminal financial flows through the concept of international financial security, which appears as the main goal of the measures adopted in the context aforementioned.We illustrate this assumption with an analysis of the international crime policy, in other words all the processes through which the international community organizes responses to the phenomenon of financial crime. This analysis permits to behold the shape of what we call “financial security” and demonstrates that the answer of the international community tends inexorably to the establishment of a sort of “international financial security”.This financial security stands for an order.An order established in both international law and domestic law, an order that is characterized by what we call "droit à texture multiple avec primauté de la soft law".This order justifies and bases both preventive and repressive obligations, despite the restrictions it imposes on fundamental rights. This order contains a whole set of prescriptions whose aim to protect the international society from the factors of disorder such us illicit financial flows, organized crime and terrorism.Financial security is as much a goal to reach as a necessity.We consolidate this premise with an afterthought on the challenge of establishing financial security and the means that can be used to guarantee its effectiveness.

Promoção do acesso e inovação em saúde: alternativas ao modelo baseado na proteção à proriedade intelectual em discussão na Organização Mundial de Saúde / Promoting access and innovation in health: alternatives to the model based on intellectual property protection within the World Health Organization

O modelo de promoção da inovação em saúde predominante na atualidade é baseado na proteção da propriedade intelectual por meio da concessão de patentes. A patente permite ao seu titular explorar o objeto protegido com exclusividade por um determinado período de tempo, no qual seria obtido o retorno do investimento feito na pesquisa e desenvolvimento do produto. A obtenção de retorno do custo da P&D pela comercialização do produto final, potencializada pelo monopólio conferido pela patente, faz com o que o detentor da tecnologia estabeleça preço de venda elevado. O sistema de patentes potencializa, assim, a maximização de lucros das empresas farmacêuticas, ampliando seu interesse no desenvolvimento de produtos rentáveis e na mercantilização da saúde. Foram identificadas e sistematizadas evidências que demonstram que a aplicação do sistema de patente na área da saúde tem gerado problemas de inovação, ao direcionar recursos de P&D voltados para a produção de produtos rentáveis e não voltados a atender necessidades de saúde; e de acesso, uma vez que o preço elevado excluí milhões de pessoas do consumo do produto. Ficou demonstrada a necessidade de busca de medidas para superação desses problemas. Identificou-se medidas existentes dentro do sistema de patentes que poderiam ser utilizadas para minimizar os problemas identificados em curto e médio prazo, com uma abordagem caso a caso. Optou-se por utilizar uma abordagem sistêmica, demonstrando a necessidade de medidas alternativas ao sistema de patentes para resolução dos problemas identificados a longo prazo. A identificação de medidas alternativas foi realizada por meio da revisão de mais de uma centena de propostas enviadas em chamada aberta e recomendações feitas por diferentes órgãos da Organização Mundial de Saúde no período de 2003 a 2012. As medidas identificadas foram descritas, sistematizadas e analisadas. Conclui-se que a principal proposta atualmente em discussão é a criação de um Fundo Global de P&D, no marco de uma Convenção Global de P&D em saúde, que financiaria a P&D mediante a concessão de prêmios, e não de patentes. Os resultados da P&D seriam tratados como bens públicos, e poderiam ser produzidos por qualquer interessado. Esse modelo visa desvincular os custos da P&D do preço final do produto. Com isso, tem o potencial de solucionar os problemas de inovação e acesso à saúde identificados no sistema de patentes. No entanto, enfrenta grande oposição dos defensores do sistema de patentes, principalmente grandes empresas farmacêuticas interessadas na ampliação da mercantilização da saúde. / The model for promoting innovation in health prevalent nowadays is based on the protection of intellectual property by granting patents. The patent allows the holder to exploit the protected object with exclusivity for a certain period of time, in which he could obtain the return of investment made in research and development. The need to obtain the return of the investments made on R&D by selling the final product, boosted by the monopoly conferred by the patent, allows the patent holder to establish high price. The patent system maximizes profits of pharmaceutical companies, expanding its interest in developing profitable products and in health commodification. We identified and systematized evidence to show that the application of the patent system in the health sector has generated innovation problems, by directing R&D resources to the production of profitable products and not driven by health needs; and access, since the high price excludes millions of product consumption. It was demonstrated the need for seeking measures to overcome these problems. We identified existing measures within the patent system that could be used to alleviate the problems identified in the short and medium term, with a case-by-case approach. We chose to use a systemic approach, demonstrating the need for alternative measures to the patent system to resolve the problems identified in the long-term. The identification of alternative measures was conducted through review of more than a hundred proposals submitted in open call and recommendations made by different bodies of the World Health Organization from 2003 to 2012. The measures identified have been described, systematized and analyzed. It is concluded that the main proposal currently under discussion is the creation of a Global R&D Fund, as part of a Global R&D Convention on health, which would finance R&D by granting prizes, and not patents. The results of R&D would be treated as public goods, and could be produced by any interested party. This model aims to delink the costs of R&D from the final price of the product. Thus, it has the potential to solve the problems of innovation and access to health identified in the patent system. However, it faces strong opposition from advocates of the patent system, especially large pharmaceutical companies interested in expanding health commodification.

This happened by means of the modification of the matter relating to ordinary law rule on the subject, with the objective to obtain a more rapid process and the delivery of life asset as an accomplishment in an effective manner. Nevertheless, despite the modification introduced with Constitutional Amendment 45/2004, the execution against Public Treasury was not affected by any alteration, remaining, in full, the legal devices that examine the affair. The execution against the Public Treasury possesses peculiarities, which are justified due to the prerogatives granted to it aiming public interest, primordial for the maintenance of the State and its functions. The main peculiarity resides in the impossibility of constriction of the public goods, which tries the debit payment by means of the entitled payment notice to government. The judicial payment notice to government must observe the budgetary rules and a money order, under the risk of the Public Administration to suffer the impounding of public revenues. The impounding of public revenues is an exceptional measure, which occurs when some of the constitutional hypotheses are present. The jurisprudence still admits the impounding of public revenues in another hypothesis, not listed in the Federal Constitution. This hypothesis is the one which the subject creditor suffers from disease and requires urgently an amount for its survival. The non-effectiveness of the impounding of public revenues, ahead of the economic impossibility of the Federation being for effectual of the judicial sentence, is common. It is the entitled theory of the reserve of the possible. What is observed by the present work study is that the execution system in face of the Public Treasury does not reach its objective, mainly because the non-payment of judicial payment notice to government does not mean any more severe punishment. Attempting to solve the problem, there are reform projects. In our point of view, the proposals are shy ahead of the chaos established in the system of debits payments of the Public Treasury. This is the reason why we propose a more intense modification, as in the case of other countries, with the constriction of the dominical public good / A reforma constitucional introduzida com a Emenda Constitucional 45/2004 ensejou uma transformação profunda no processo de execução até então vigente no ordenamento jurídico brasileiro por meio da modificação da regra infraconstitucional sobre o tema, com o objetivo de se obter um processo mais célere e a entrega do bem da vida de forma efetiva. No entanto, em que pese a modificação introduzida com a Emenda Constitucional 45/2004, a execução contra a Fazenda Pública não sofreu qualquer alteração, mantendo-se, na íntegra, os dispositivos legais que versam sobre o assunto. A execução contra a Fazenda Pública possui peculiaridades, as quais se justificam em razão das prerrogativas a ela concedidas visando ao interesse público, primordial para a manutenção do Estado e suas funções. A principal peculiaridade reside na impossibilidade de constrição dos bens públicos, o que enseja o pagamento do débito mediante o denominado precatório judicial. O precatório judicial deve observar as regras orçamentárias e uma ordem de pagamento, sob pena de a Administração Pública sofrer o sequestro de rendas públicas. O sequestro de rendas públicas é medida excepcional, que tem vez quando presente alguma das hipóteses constitucionais. A jurisprudência ainda vem admitindo o sequestro de rendas públicas em mais uma hipótese não elencada na Constituição Federal, aquela em que o sujeito credor sofre de moléstia e carece com urgência de quantia para sua sobrevivência. É comum a não-efetivação do sequestro de rendas públicas, diante da impossibilidade econômica do ente da Federação para efetivação da decisão judicial. É a denominada teoria da reserva do possível. O que se observa pelo estudo do presente trabalho é que o sistema de execução em face da Fazenda Pública não atinge seu objetivo, principalmente porque o não-pagamento de precatório judicial não enseja qualquer punição mais severa. Na tentativa de solucionar o problema, há projetos de reforma. A nosso ver, as propostas são tímidas diante do caos instaurado no sistema de pagamento de débitos da Fazenda Pública, razão pela qual propomos uma modificação mais intensa, a exemplo de outros países, com a constrição do bem público dominical

Research advances and challenges for the democratization of access to public property developed in this work are guided by the following principles: Public property: Reconfiguration of public property in the evolution of the legal system, since the system of Sesmarias to the Federal Constitution of 1988, the City Statute (Law 10.257/2001), Land Federal Regularization Law (Law 11.481/2007) e Law Regularization of Urban Settlements (Law 11.977/2009). Investigate when governments can not only, but have to recognize the right to housing of low-income occupants of urban public areas. Subjective rights: Since the approval of the City Statute (Law 10.257/2001), new collective rights are recognized. We are dedicated to the study of the legal nature and scope of the Concession Special Use for Housing to public areas occupied for housing purposes in the light of art. 183 of the Constitution and MP 2.220/2001. D emocracy: Analysis of experience of land management of social interest in local and federal public areas, identifying challenges and progress made in the public policy of interest social regularization. These studies, suggest possible ways for the reduction of territorial segregation and the housing deficit in Brazil / O novo marco legal urbano nos convida a repensar a propriedade pública como forma de ampliar a esfera pública, reconhecendo nela a Cidade e o Direito produzido social e coletivamente. A investigação dos avanços e desafios para a democratização do acesso aos imóveis públicos desenvolvida neste trabalho é orientada pelos seguintes eixos: Propriedade pública: Reconfiguração da propriedade pública na evolução do ordenamento jurídico, desde o regime de sesmarias até a Constituição Federal de 1988, Estatuto da Cidade (Lei nº 10.257/2001), Lei nº 11.481/2007 (Lei de Regularização Fundiária de Terras da União) e Lei nº 11.977/2009 (Lei de Regularização Fundiária de Assentamentos Urbanos). Função social e discricionariedade: Superação do conceito de propriedade pública como patrimônio da Administração Pública , como condição para a vinculação da propriedade pública à efetivação de sua função social como patrimônio de todos , definida no âmbito do planejamento territorial participativo. Investigamos quando o Poder Público não só pode como deve reconhecer o direito à moradia de ocupantes de baixa renda de áreas públicas urbanas. Direitos subjetivos: A partir da aprovação do Estatuto da Cidade (Lei nº 10.257/2001), novos direitos coletivos são reconhecidos. Dedicamo-nos ao estudo da natureza jurídica e aplicação da Concessão de Uso Especial para fins de Moradia (CUEM) às áreas públicas ocupadas para fins de moradia à luz do art. 183 da Constituição e Medida Provisória nº 2.220/2001. Democratização: Análise de experiências de regularização fundiária de interesse social em áreas públicas municipais e federais, identificando os desafios e avanços obtidos no âmbito das políticas públicas de regularização fundiária de interesse social.
