Identités religieuses contemporaines dans le miroir des droits de l’homme : contribution à une sociologie des droits de l’homme / The contemporary religious identities in the mirror of Human Rights : a contribution to human right sociology

La présente thèse essaye de renouer avec un type de recherche présent dès la naissance de la sociologie française : l’étude sociologique d’une notion centrale du champ juridique, en l’occurrence les droits de l’homme et l’invocation contemporaine par les individus ou les institutions des textes s’y référant pour faire valoir des prétentions religieuses. L’analyse est menée aussi bien sur un plan général à travers l’appréhension de l’invocation systématique des droits de l’homme à tous les niveaux de la société et, de façon plus particulière, à travers l’expression contemporaine de l’identité religieuse au miroir des droits de l’homme. C’est pourquoi à travers la question religieuse, le présent travail se veut une contribution à la sociologie des droits de l’homme. Le fait social ici dépend de la conjonction d’un élément structurant, la règle de droit, et de l’interaction résultant de la manière dont les individus l’interprètent ou se l’approprient.Nous avons ainsi identifié la spécificité radicale de notre époque sur deux plans distincts : les droits de l’homme, de textes à dimension politique, sont à présent devenus une norme juridique susceptible d’être invoquée dans n’importe quel type de conflit ; les religions, par le biais des droits de l’homme, justifient la modification des règles en vigueur dans la société sans que cette modification prenne la forme, comme par le passé, d’un combat politique. Nous avons systématisé cette spécificité à travers l’élaboration d’une distinction entre société du litige et société du différend :- Dans la société du différend à la différence de la société du litige, le contentieux concerne non seulement les parties en présence mais également les règles sur la base desquelles ils ont vocation à être jugés ; - Dans la société du différend à la différence de la société du litige, n’importe quel juge peut être amené à trancher une question dont la formulation juridique masque un vrai problème politique au titre desquels se situe bien évidemment la place de l’expression de l’identité religieuse. - Dans la société du différend à la différence de la société du litige, le droit pénal devient un mode de résolution des situations conflictuelles comme si l’impossibilité de trancher le conflit en raison de l’antagonisme des thèses soutenues par les parties en présence obligeait à figer celles-ci dans les statuts respectifs de coupable et de victime.Il en découle : - un ordre social en transition qui oscille entre communautarisme et droits de l’homme de façon à éviter que la logique du différend ne conduise inéluctablement à la violence ; - un ordre social dans lequel l’Etat se re-déploie sur la base d’organes administratifs pour essayer de limiter l’expression judiciaire du différend – c’est ce que les Canadiens appellent les accommodements raisonnables ; En somme, la logique de subjectivisation radicalisée par la référence constante aux droits de l’homme fait de la violence et donc du recours toujours accru à la norme pénale un élément consubstantiel de la société du différend. L’Etat pénal devient la forme étatique de la société du différend là où l’Etat social ou Etat-providence formalise la société du litige.Notre recherche s’est achevée sur un essai de typologie des pratiques religieuses fondée sur la perception des règles étatiques par les individus. / This thesis tries to revive a type of research that originates from first work of French sociology: sociological study of a central concept of juridical field, (that is to say, the so called) in this case Human Rights as much as contemporary invocation to serve religious claims by means of the related texts by individuals or institutions. Systematic invocations of Human Rights at every society level and particularly the contemporary way to express religious identity are the objects of this two levels conducted analysis. Considering this text a Human Rights sociology contribution to religious identity question is therefore appropriate. The rule of law and the way individuals take it over or interpret it is the structural factor on which (depends) is based social fact. Radical specificity of our times is identified in this work at two different levels: Human Rights have turned to a norm likely to be invoked in any type of conflict instead of being just a set of texts of political significance; alteration of rules in force in society, formerly a political fight, are now justified through Human Rights. This analysis has focused on this specificity by developing first a distinction between society of litigation and society of dispute and, in a second time, a typology of religious identities in accordance to the relationship that the individual maintains with the rule of law.

Evitar que o tempo atue como agente de corrosão de diretos durante o longo período de pendência do processo deve ser uma verdadeira obsessão do processualista moderno, consciencioso da finalidade e da existência da ciência processual que constitui o seu objeto de estudo. A visão teleológica do processo como instrumento de realização do direito material deve estar presente na interpretação de todas as regras processuais, sempre tendo em mente o sábio conselho de Chesterton, para quem o homem pode enxergar mais longe se subir aos ombros dos que vieram antes. Romper com velhos dogmas para proporcionar resposta aos novos problemas é fazer com que o direito processual seja dinâmico, conferindo-lhe a capacidade de superar crises de efetividade. A alteração dos fatos durante a longa travessia que é o processo constitui o objeto deste estudo, sobretudo no que se refere aos impactos sobre importantes figuras e institutos processuais como a causa de pedir, a estabilização da demanda, a rigidez do sistema preclusivo, a inércia da jurisdição e a interpretação destes, plasmada nos princípios constitucionais do contraditório e da duração razoável do processo, que integram o conceito amplo do devido processo legal. Para alcançar tais propósitos, esta dissertação está estruturada em cinco partes. O acesso à ordem jurídica justa é o tema inicial e o primeiro capítulo é destinado ao seu estudo. Acesso à justiça não se confunde com estar em juízo. O seu real significado está relacionado com a realização da promessa constitucional de entrega da tutela jurisdicional a quem efetivamente tem direito a ela, sempre lembrando que ela deve ser justa, igualitária e tempestiva. O capitulo dois, núcleo da abordagem teórica do objeto deste estudo, centra-se na identificação da demanda e de seus elementos objetivos, em que se busca demonstrar a existência de uma pluralidade de possibilidades para a investigação do mesmo problema. A concepção alemã do objeto do processo (ou objeto litigioso) enfoca o problema de modo absolutamente distinto daquele concebido pelo direito italiano (teoria dos três eadem). O tempero dado pelas teorias da substanciação e individualização para identificação do núcleo resistente da causa de pedir demonstram a necessidade da análise dos elementos que compõem a demanda, em atenção ao direito material que se busca fazer valer em juízo. Os direitos autodeterminados e heterodeterminados reclamam a utilização de métodos distintos para identificação da causa petendi, demonstrando que esta figura jurídica goza de certa elasticidade. O capítulo três desenvolve a conceituação do fato superveniente e do fato de conhecimento superveniente, bem como o impacto distinto destes na esfera jurídica do autor e do réu, analisando o último momento do procedimento em que é praticamente possível introduzir o fato novo e, sobretudo, o real alcance do art. 462 do Código de Processo Civil. A interpretação deste dispositivo processual revela um poderoso alcance de notável utilidade para aperfeiçoamento do processo como método estatal de solução de controvérsias. O quarto capítulo problematiza os limites da modificação da causa de pedir no curso do processo, com a superação do dogma da estabilização da demanda. A não-incidência ou não-aplicação de regras processuais meramente formais para dar efetividade aos princípios constitucionais informadores do devido processo legal é a pedra de toque para a conclusão a que se chega ao fim do trabalho. O capítulo cinco, conclusivo do percurso analítico empreendido, apresenta o estágio de compreensão do objeto alcançado neste estudo. Garantido o contraditório e a ampla defesa, deve ser prestigiado o princípio constitucional da duração razoável do processo, cuja correta interpretação é dele extrair uma garantia de resolução integral da crise de direito material com o menor grau de perturbação social possível, ou seja, com o menor dispêndio de energia e tempo, o que implica reconhecer a possibilidade de modificação da causa petendi. / Avoiding time to act as a corrosion agent of rights during the long period of a pending case must be a true obsession for the modern expert in civil procedure, conscious of the purpose and existence of procedural science that constitutes its object of study. The teleological vision of the judicial process as an instrument of realization of substantive law shall be present in the interpretation of all procedural rules, always keeping Chestertons wise advice in mind, to whom a man can see further if he climbs on the shoulders of those who came before. Breaking with old dogmas to provide solutions to new problems is to make procedural law dynamic, giving it the capability to overcome crises of effectiveness. The change of events during the long journey of the case is the object of this study, particularly with regard to the impacts on important procedural figures and institutions such as cause of action, stabilization of claim, rigidity of the preclusive system, inertia of jurisdiction and its interpretation, present in the constitutional principles of adversary system and reasonable time of proceedings, which form the broad concept of due process of law. To achieve such aims, this dissertation is structured in five parts. The access to the fair legal system is the opening theme and the first chapter focuses on its study. Access to justice should not be confused with being at court. Its real meaning is related to the implementation of the constitutional promise of delivery of legal protection to those who are actually entitled to it, always remembering that it must be fair, equitable and timely. The second chapter, the core of the theoretical object of this study, focuses on the identification of the litigation and its objective elements and seeks to demonstrate the existence of a plurality of possibilities for the investigation of the same problem. The German conception of the subject matter (or litigious matter) analyzes the 194 problem in a completely different manner from that designed by the Italian Law (theory of the three eadem). The effect given by the theories of substantiation and individualization for the identification of the resistant core of the cause of action demonstrate the necessity of analyzing the elements of claim, in response to the substantive law that seeks to be enforced in court. The self-determined and heterodetermined rights claim the use of different methods to identify the causa petendi demostrating that this legal concept hás certain elasticity. The third chapter develops the concept of supervening fact and supervening knowledge of the fact as well as their different impact on the legal sphere of the plaintiff and the defendant; the last moment of the proceedings that permits the introduction of the new fact is analyzed and, especially, the actual scope of article 462 of the Code of Civil Procedure. The interpretation of this procedural provision reveals a remarkable range of powerful utility for improving the legal process as a state method of settlement. The fourth chapter discusses the limits to change the cause of action during the course of action overcoming the dogma of the stabilization of claim. The nonlevy or non-application of purely formal procedural rules to give effect to the constitutional principles which inform the due process of law is the cornerstone of the conclusion reached at the end of the work. The fifth chapter concludes the undertaken analytical path and presents the understanding stage of the object of this study. Being the adversary system and full defense guaranteed, the constitutional principle of reasonable time of proceedings must be considered. Its correct interpretation is to acquire a guarantee of full resolution of the crisis of substantive law with the lowest degree of social disruption as possible, i.e., the lowest expenditure of energy and time, which means recognizing the possibility of changing the causa petendi.

The study covers the analysis of reasonable duration of the criminal process and its underlying approach to the institution of criminal prescription. To investigate the possibility of the fit of both theories between the two concepts. At first are considered the conceptions of time (absolute and relative) and their intimate relationships with the law, more specifically with the criminal procedural law, considering that all procedural acts are governed by lapse of time. In a second moment is directly addressed the fundamental right to duration of the criminal process and its current hermeneutics inaccuracy. Thus, it held a brief analysis of the doctrine of the fixed term and also the doctrine of non-term as well as the legal consequences and solutions proposed by the academy in the case of non-observance of reasonable time. The third moment it is analised the criminal prescription and the theories that give it grounds for the legitimacy, as well as the nefarious institution of criminal imprescriptibility. At the end it is examined the possibility of the punitive preintention to limitade the period of reasonable duration of the criminal process, taking into perspective the concepts of time previously developed. The research employed the deductive method and the research through the literature. / Examina-se o direito fundamental à razoável duração do processo penal previsto no artigo 5º, inciso LXXVIII da Constituição Federal, com a redação dada pela Emenda Constitucional nº 45/2004, com o escopo de (re)pensar sua interpretação jurídica, tendo em vista o instituto da prescrição da pretensão punitiva. O estudo percorre a análise da razoável duração do processo penal e sua latente aproximação com o instituto da prescrição penal. Para tanto investiga a possibilidade de adequação teórica entre os dois conceitos. Num primeiro momento são consideradas as concepções de tempo (absoluto e relativo) e, as suas intimas relações com o direito, mais especificamente com o direito processual penal, haja vista que todos os atos processuais são regidos pelo decurso do tempo. Num segundo momento é abordado diretamente o direito fundamental à razoável duração do processo penal e sua atual imprecisão hermenêutica. Assim, é realizada uma breve análise a respeito da doutrina do prazo fixo e, também da doutrina do não-prazo, bem como das soluções e consequências jurídicas propostas pela academia no caso de não observância do prazo razoável. Num terceiro momento é abordada a prescrição penal e as teorias que lhe fornecem fundamento de validade, assim como o famigerado instituto da imprescritibilidade penal. Ao final examina-se a possibilidade do prazo da prescrição da pretensão punitiva funcionar como limite para a duração razoável do processo penal, tendo em perspectiva as concepções de tempo desenvolvidas anteriormente. A pesquisa realizada utiliza-se do método dedutivo e como técnica de pesquisa a bibliográfica.

Perceptions of Reasonable Use of Force by Probation Officers and Civilians

There is little academic research that examines whether there are differences between the ways probation officers and community members perceive the use of force on juvenile offenders. Failure to understand the differences in these perceptions negatively affected a probation department in California, which failed to address public concerns regarding the use of force in the juvenile hall, which resulted in a consent decree and a costly financial settlement. Using socialization theory as the foundation, the purpose of this study was to understand if there is a statistically significant difference between probation officers and civilians regarding their perceptions of use of force against juvenile offenders. Data were collected from a nonprobability sample of probation officers (n = 71) and community members (n = 125) in a Northern California community through an online survey that featured 5 scenarios of escalating behavior from a juvenile offender. Respondents were asked to evaluate whether the use of force was appropriate or excessive for each scenario. Data were analyzed using an independent samples t test and chi-square tests of independence. Findings indicated that, overall, there is a statistically significant difference in the perception of use of force between the 2 groups (p <. -4.04). Specifically, community members are more likely to have a lower threshold of tolerance for use of force than probation officers in 3 of the 5 scenarios in the survey. The positive social change implications of this study include recommendations to probation departments in California for enhanced collaboration and training with community members to better understand the expectations of each group related to use of force and the treatment of juvenile offenders.

According to Section 29(1) of the Constitution of the Republic of South Africa, 1996 everyone is entitled to and has the right to basic education. “Everyone” includes disabled learners. The international framework regarding the right to basic education and the accessibility of the infrastructure for physically disabled learners in public schools was examined to determine whether or not South Africa complies with the formalities and obligations prescribed and what the implications are, if the state does not comply. To reach the purpose of the above statement made there has to be determined which legislation is applicable to disabled learners and a definition needs to be provided for the term „physical disability‟ (Chapter 1). Secondly the core of the research question concealed in the above statement and its applicable articles will be discussed as seen in General Comment No. 13 of the International Covenant on the Economic, Social and Cultural Rights (Chapter 2). Thereafter international legislation will be discussed with the focus on basic education, disability, the accessibility of the infrastructure and the obligations placed on the state (Chapter 3 and 4). The focus will then be moved to the regional framework and the provision made with regards to the right to basic education and disability (Chapter 5). The relevant constitutional sections will then be investigated before reaching a conclusion. The sections that will be taken into account are sections 7, 9, 28, 29, 36, 39 and 233 of the Constitution of the Republic of South Africa, 1996. The purpose of the investigation of the constitutional sections is to determine what basic education entails and if there is a uniform definition thereof. A further purpose with the investigation of the constitutional provisions is to determine whether there is an infringement of disabled learners„ rights to equality and to basic education. Another purpose is to determine to which extent South African schools are accessible to disabled learners in the provision of infrastructure of school buildings as it is now and the obligation that rests on the state to adapt the infrastructure (Chapter 6). After the discussion of the above mentioned chapters a conclusion will be reached on to what extent the state complies with its constitutional and international obligations to realize disabled children„s right to basic education can be come to (Chapter 7). It's time to talk: a study of the experiences of people with mental health in the workplace

In Canada mental health related concerns are estimated to cost the economy $20-$50 billion annually. 500,000 Canadian each week have to take time off of work because of a mental health disability. This study explores the experiences of people living with a mental health disability in the workplace. The goal is to provide an opportunity to highlight many of the obstacles they face every day. This study relies on qualitative methodologies, using semi-structured interviews to get a more detailed understanding of their experiences. This study not only highlights the perceptions, experience and challenges of people living with a mental health disability, it highlights coping strategies and suggestions for building mentally health workplaces. The participant’s personal narratives can help by providing a chance for a community to build and be used to challenge the stigma and discrimination associated with mental health. / October 2016

This study aimed to examine the reasoning among first line managers concerning the law from 2012 which gives older couples the right to continue living together even when only one of them needs special housing for service and care. We used a qualitative method with data collected through individual semi-structured interviews with six care managers in different municipalities in Sweden. The theoretical approach and interpretative framework for the analysis consisted of Michael Lipsky’s theory of street-level bureaucracy, Roine Johansson’s swedish adaption of this theory and Max Weber’s theory about social actions. We found that there was little variation in how the interviewed care managers used the law and the guidelines to support the work in the organisation rather than seeking individually based solutions for the elderly. The main conclusion of our study was that the law concerning the cohabitation guarantee for elderly has made little difference.

Protecting the environment is presented in the Federal Constitution as the supreme premise, given that it is, above all his life protection. Nevertheless, this research will seek to discover what are the biggest obstacles to give a reasonable time to the process, seek to demonstrate the accountability of the judiciary as the body responsible for the solution of conflicts in court level, as well as throughout the state that has the responsibility to provide the apparatus necessary for the production of the common good. By the same token, it will be made to demonstrate the changes necessary to the effective applicability of speedy trial, and the mechanisms to resolve such problems, so that the provision outlined in the abovementioned legal instruments produce practical results and noticeable to the community. / O presente trabalho tem como objetivo analisar o significado e alcance dos direitos da razoável duração do processo e acesso à justiça, traçando um paralelo entre a construção teórica e a realidade prática acerca do tema, caracterizando-o como um direito fundamental inerente ao indivíduo, analisando tal temática com vistas ao Direito Ambiental. A proteção ao meio ambiente é apresentada na Constituição Federal como premissa suprema, tendo em vista que se trata, sobretudo da proteção a própria vida. Não obstante, a presente pesquisa, procurará descobrir quais são os maiores óbices a conferir uma razoável duração ao processo, buscará demonstrar a responsabilidade do Poder Judiciário enquanto órgão responsável pela solução dos conflitos em âmbito jurisdicional, bem como, de todo o Estado que possui a responsabilidade de fornecer o aparato necessário à produção do bem-comum. No mesmo diapasão, procurar-seá demonstrar as transformações necessárias à efetiva aplicabilidade da celeridade processual, e os mecanismos capazes de solucionar tal problemática, de forma que, o preceito traçado nos diplomas legais supramencionados produzam resultados práticos e perceptíveis à coletividade.
