Honra no direito ático / Honor in Attic law

Esta dissertação aborda o Direito Ático por um prisma axiológico. Admite a influência dos valores na formulação de normas e institutos, e destaca um valor que considera como dos mais importantes na cultura grega dos séculos V e IV a.C., a saber, a honra. Uma primeira parte do trabalho se propõe a delimitar a honra, distinguindo seu uso em dois sentidos principais de: valor que se tem, e de fenômeno da percepção deste valor. Uma segunda parte demonstra a origem do apreço pela honra e pela excelência na poesia épica, esclarecendo depois que posição a honra ocupa na escala grega de valores. Trata-se ainda da guerra como local para o nascimento e consolidação dos significados de honra de que dispomos, e em seguida, aborda a tormentosa situação enfrentada por Drácon por conta da prática da vingança privada, destacando a vinculação desta ao restabelecimento da honra e comentado as características da lei de homicídio de Drácon. A terceira parte dedica-se a detalhado exame de três institutos jurídicos Áticos que têm na honra sua razão de ser: perda dos direitos civis, atimía; serviços ao povo de Atenas, liturgias; a tratamento e punição da hýbris. / The present work examines Attic Law through an axiological perspective. Admits the role of values in forming norms and juridical institutes, focusing in a special value considered to be one of the main forms of excellence in 5th and 4th century: honor. The first part of the work delimits honor, indicating two meanings for the term: a value that the subject has, and the perception of such a value by others. A second part demonstrates the origin of the greek concern with honor and excellence in Homer´s epic poetry, establishing a post for honor in greek axiological rankings. Identifies war as the birthplace of the meanings of honor we discussed, and analyzes the difficult social condition that Draco had to face in its time, related to private revenge, emphasizing it connection with the theme of honor and commenting Draco´s Homicide Law. The third part brings a detailed exam of three of attic law´s institutes related to honor: disenfranchisement, atimía; public service in Athens, liturgies; treatment and punishment of hýbris.

Magistro baigiamajame darbe nagrinėjami neturtinės žalos atlyginimo objektai bei jų teoriniai ir praktiniai skirtumai Lietuvos, Italijos, Didžiosios Britanijos, JAV, Vokietijos bei Prancūzijos teisinėse sistemose. Bandoma parodyti, kad teisė į neturtinės žalos atlyginimą, pažeidus asmens neturtines vertybes tiek bipolinėse, tiek singuliarinėse valstybėse yra plečiama, grindžiant žmogaus teisių doktrinos idėja ir siekiu įgyvendinti visiško žalos atlyginimo principą, nors, kita vertus, pripažįstama, jog pilnai pritaikyti restitutio in integrum neturtinės žalos atlyginimo srityje dėl prarastos vertybės specifiškumo nėra įmanoma. Pagrindinis darbo tikslas yra išnagrinėti neturtinės žalos atlyginimo objektus, jų raidos bei taikymo teisminėje praktikoje tendencijas, atskleisti kiekvieno objekto pažeidimo atveju keliamus reikalavimus ir taikomus neturtinės žalos atlyginimo apribojimus. Todėl lyginamojo, istorinio, loginio, sisteminio bei kitų metodų pagalba analizuojama pasirinktų šalių teisinė patirtis, bandoma įžvelgti ne tik panašumų, bet ir atskleisti tam tikrus skirtumus, sutinkamus teisės į neturtinės žalos atlyginimą įgyvendinimo procese. Darbą sudaro įvadas, keturi skyriai, išvados, literatūros sąrašas bei santrauka. [toliau žr. visą tekstą] / The objects of non-pecuniary damage and their theoretical and practical differencies in Lithunian, Italian, Great Britain, American, German and French legal systems are analysed in this Master work. It is attempted to show, that a right to non-pecuniary damage redress after infringement of non-economical values is being expanded both - in singular and bipolar countries, as a result of the concept of human rights doctrine and aspiration to entirely implement the principle of damage compensation, though accepting the impossibility of restitutio in integrum in the field of non-pecuniary damage because of the specificity of the lost value. The primary aim of this work is to explore the objects of non-pecuniary damage, the trends of their development and application in judicial practice, to reveal the requirements, raised in every case of the infringement of the object, and the restrictions applied to the redress of non-pecuniary damage. Therefore, with the help of comparative, historical, logical, systemic and other methods, the experience of chosen countries is analysed, trying to envisage not only some similarities, but also to reveal the diferrencies, applied in the implementation process of the right to non-pecuniary damage. O mandado de segurança coletivo como instrumento de tutela coletiva / The class mandamus writ as an action for the protection of collective rights.

O presente estudo tem como objetivo discutir o mandado de segurança coletivo como verdadeira demanda a serviço da tutela processual de direitos coletivos em sentido amplo. Nesse sentido, as intenções principais residem em destacar o mandamus coletivo naquilo em que o distingue do mandado de segurança individual. Desse modo, são propositalmente lançados problemas que acentuam essas substanciais diferenças entre os dois institutos, o que passa pela discussão da natureza jurídica, dos direitos tutelados, da legitimidade, da coisa julgada, da litispendência, do procedimento (especialmente no tocante ao deferimento de liminares), da intervenção de terceiros e da desistência. É evidente que a construção do trabalho não prescinde da análise da Lei 12.016/2009, primeira lei a regulamentar o mandado de segurança coletivo cujo fundamento de validade, até então, se concentrava apenas na Constituição Federal (art. 5o, inc. LXX). Essa Lei trouxe várias disposições acerca do writ coletivo, fracassando, no entanto, em dialogar diversos de seus pontos com o microssistema de tutela coletiva. / The aim of this dissertation is to discuss the class mandamus writ as an action for the protection of collective rights. It seeks to underline the distinction between the individual and the class mandamus writ with a focus on the latter. In order to emphasize the substantial differences between the two institutes, particularly with regard to their nature, the rights they protect, res judicata, pendency, other procedural issues (particularly in relation to interim injunctions), joint of parties and quitclaim, the dissertation proposes questions related to these topics. It is clear that this dissertation cannot dispense with the analysis of Lei 12.016/2009, which was the first act to regulate the class mandamus writ. Until the enactment of that act, the class mandamus writ fundament of validity was exclusively the art. 5, LXX of the Federal Constitution. Although, this act has brought many provisions on the class mandamus writ, it failed in establishing a dialogue with the collective redress microsystem.

Recognition of prior learning in the real estate industry: a case study of the Johannesburg metropolitan area

Magister Artium - MA / This research paper investigates the extent to which the Recognition of Prior Learning (RPL) is implemented in the Real Estate industry within the Johannesburg Metropolitan area. The Real Estate industry is an ideal industry to assess the prior learning of real estate agents since there is no doubt that such a workplace has been recognized as an effective and efficient learning environment which allows workers to take part in an ever-changing work environment (Le Clus, 2011). Despite the availability of resources from different entities, i.e. the Services Sector Education and Training Authority (SETA), RPL centres, Umalusi, the Department of Higher Education and Training (DHET), the Estate Agency Affairs Board (EAAB), and so on (OECD, 2010) there seems to be incompatibility between the existing policy and the implementation of such policy in the Real Estate industry. Hence, to paraphrase a common theme within the literature (Cameron and Miller, 2004) there is a gap between the promise and rhetoric of RPL and the actual reality, and a disjuncture between policy formulation and implementation of RPL. Also, most research (Cameron and Miller, 2004) reveals that RPL has neither fulfilled its promised potential of encouraging the previously disadvantaged groups to access formal education and training, nor achieved its goal as a mechanism for social inclusion. The two primary research questions for this research paper were: Why are potential RPL candidates not taking the RPL route to obtain their certification? What are the barriers that obstruct efficient RPL implementation within the Real Estate industry? The research design was exploratory within a qualitative framework employing focus group interviewing, individual interviewing and the distribution of questionnaires that consisted of open-ended questions. The research sample comprised nineteen participants that included eight estate agents, four principals, five RPL Centers‟ representatives, one representative from the Services SETA and one representative from the Estate Agency Affairs Board. Master of Education in Adult Education and Global Change - Dissertation [University of the Western Cape] The research findings show that there are serious issues with the implementation current RPL policy within the real estate industry. Many scholars (Colardyn and Bjørna°vold, 2004; Bjørna°vold, 2000) indicate that RPL comes with its challenges, for instance that of the role it can play and the extent to which it can address the twin goals of increasing educational level of participation and employment rates. RPL also takes much time, as Anderson, Fejes and Ahn (2004) stress, to transform non-formal and informal learning into more or less formal learning that is ratified in the form of officially acknowledged certificates. Elements such as lack of or insufficient learner support by advisors and language barriers, have contributed significantly to the dropping out of most candidates. The strength of RPL is that unaccredited knowledge and skills can be brought into the open for everyone to see and, in a sense, come into use (Berglund and Anderson, 2012). This was made evident by the candidates who made it through RPL. RPL has also contributed to social equity and redress by admitting candidates as recognised agents and principals who previously were about to be excluded from the industry due to lack of recognised qualifications.

The perceptions of principals on staff reduction in schools

This research project examines the experiences of school principals when implementing the staff-reduction process of the rationalisation policy stipulated by the National Department of Education in 1994. The implementation of this policy has its origins in the Transformation policy of the National government after the first democratic election in South Africa in 1994. The aim of the rationalisation policy is to bring about equity and affirmative action in the staff provision in schools. Achieving this is a collective agreement between the National Education Department and the teachers’ unions where the decision was made that the teacher:learner ratio would be 1:35 in secondary schools and 1:40 in primary schools. The aim of this research is to determine what principals experience during the staff-reduction process(es) and what impact it would have on the principal as the manager of the institution. The researcher also intends to examine the influence that staff reduction has on the working conditions of the principal as well as how this process affects the teaching and learning culture in a school. Ultimately the researcher intends to make recommendations to assist principals that are affected by staff reduction. The research concentrates on a selected group of principals, regardless of race, gender or religion (including principals from secondary, middle and primary schools) who are currently busy with their Masters Degree in Education Leadership and Management at the University of Pretoria. A qualitative research methodology is used to exemplify the perceptions and experiences of principals. The dissertation is divided into five chapters. Chapter One provides an overview and orientation of the study. The focus is the problem statement and the exposition of the aims of the research. Chapter Two concentrates on the literature study that is supported by the collection of empirical data with specific reference to the rationalisation process and the resulting staff reduction process in some schools. Chapter Three discusses the research design and data collection instruments. The focus is on the individual interviews (face to face) done with principals of schools where they air their views regarding the rationalisation process, staff reduction and the impact that the abovementioned has on the teaching and learning process in schools. Transcriptions are made of the audio recordings of the interviews and field notes have also been included as background information for the interviews. In Chapter Four the analysis of the collective interviewed data is done and the empirical data is discussed. Chapter Five is a summary of the research. Some of the elements that facilitate implementation include stringent quality criteria and common benchmarks that build trust in the process and ensures the protection of the integrity of the system. The Swedish procedural legislation on class actions before general courts, GrL, was when coming into force in January 2003 the first generally applicable class action regime of continental Europe. However, it seems, it was never used in any notable extent. In this thesis I have analysed GrL, it’s potential flaws, how it could be affected by the ongoing EU legislative procedure of establishing a directive regarding representative actions for the protection of the collective interests of consumers, and what the Swedish legislator could potentially learn from the Dutch model being primarily based on a regime of mass settlements. The ongoing EU legislative procedure will by all accounts result in a directive requiring Swedish class action regime to be adjusted with a few minor modifications, primarily the introduction of a certification procedure of entities to allow these to initiate representative actions in disputes concerning the protection of consumers’ collective interests. Apart from adjustments of Swedish class action legislation in order to harmonise it with the directive, I have argued for several additional adjustments of proceedings under GrL in order to make it in an increased degree correspond with the reasons by which the legislation was motivated, and in order to in general function in a more effective manner. For that purpose, I have argued that the opt in mechanism should be replaced with an opt out mechanism, or that opt out should at least be introduced as a supplementing option to an opt in main rule. Independently of the issue of whether an opt in or an opt out mechanism should be used to constitute the represented group, I have furthermore argued that the mechanism used should allow group members to leave the group during the proceedings. Finally, I have argued that the courts should be encouraged to use a for the Swedish legal system untypically active direction of proceedings in class actions specifically.
