<p>I’ve chosen primary to analyze commercial form of advertising by world leading companies; <em>McDonald’s, Coca-Cola</em> and <em>HP</em> due to their implementation of global advertising. The fourth campaign that’s being analyzed is not of commercial type instead it’s characterized as an informative campaign that the ideal organization <em>Amnesty</em> is carring out. The study has been successful in gathering data that could be presented in correlation with already established theories and then comparing the results. The goal of the research is to create an understanding regarding global advertising as well as the scientific debate that’s going on within the subject. The scientific research has been debated for a long time regarding advertising that’s positioned globally; whether it should be standardized or adapted. This means whether advertising should look the same in all countries or if it should be adapted to a nation’s specific culture. Scientists haven’t yet been successful in establishing what’s considered to be more prominent due to various diverse opinions.</p><p>By implementing content analysis together with semiotic analysis as a reinforcer, the study was able to examine the global advertising’s design and their common characteristics. Within this study the campaigns have been studied both visually and verbally in addition to their messages and values. The McDonald’s and Coke campaign has been categorized as advertising that reflect specific kinds of lifestyles and therefore characterized as “lifestyle format”. HP campaign on the other hand was using celebrities. This contributed that their global campaign became very personal because the celebrities were reflecting their own personality in the commercials. That’s why HP was categorized as the “personalized format” while Amnesty remained characterized as an informative campaign. Results show that these campaigns’ global form of advertising weren’t only implementing standardized form but also incorporated adapted commercial characteristics as well. This is what the theorizers Hassan, Craft and Kortam call a”hybrid strategy” that’s by their opinion most effective form of global advertising. Another important result was that the “creative strategy” (its promise/statement) is what makes the campaign cohesive. While the “creative tactic” (the visual elements) differs more or less within an advertising campaign.</p> / <p>Jag har valt att främst analysera kommersiella kampanjer från de världsledande företagen<em> McDonald’s, Coca-Cola</em> och <em>HP</em> eftersom de tillämpar global form av reklam. Den fjärde kampanjen som analyseras är inte av kommersiellt slag då den karaktäriseras som en informativ kampanj som den ideella organisationen <em>Amnesty</em> har genomfört. Studien har lyckats generera data som kunde sättas i relation med de redan fastställda teorierna och på så vis jämföra resultaten.</p><p>Forskningens mål är att skapa en förståelse angående global reklam samt den vetenskapliga debatten i ämnet. Den vetenskapliga forskningen har länge debatterat angående om reklam som appliceras globalt borde vara standardiserad eller anpassad, det vill säga om den ska se lika ut i alla länder eller om man borde anpassa den till varje lands individuella kultur. Forskarna har fortfarande inte kommit fram till vad som anses vara mest effektivt då en splittrad syn angående denna fråga uppstår. </p><p>Genom kvalitativ innehållsanalys med förstärkning av den semiotiska analysen så kunde studien granska den globala reklamens utformning och dess gemensamma karaktäristiker som uppstår. I denna studie så har reklamkampanjerna granskats både visuellt och språkmässigt samt dess budskap och värderingar. Reklamkampanjerna McDonald’s och Coca-Cola blev kategoriserade som den form av reklam som reflekterar specifika livsstilar och därför karaktäriserades som ”livsstilsformatet”. HP är den reklamkampanj som använde sig av kändisar. Detta gjorde att deras globala reklam blev väldigt personlig då den reflekterade kändisarnas personligheter. Därför kategoriserades HP:s reklamkampanj som det” personifierade formatet” medan Amnesty förblev karaktäriserad som informativ form av kampanj. Resultatet visade att dessa reklamkampanjers globala reklam inte endast implementerade standardiserad form utan likaså integrerade anpassad form. Detta kallar teoretikerna Hassan, Craft och Kortam för ”hybridstrategi” och anses enligt dem vara mest effektivt tillvägagångssätt när det gäller global reklam. En annan viktig sak som resultatet påvisade var att den ”kreativa strategin” (dess utlovande/påstående) är det som gör kampanjen sammanhängande medan den ”kreativa taktiken” (dess visuella element) mer eller mindre skiljer sig inom en kampanj.</p>

This is a monograph on the South African artist Diek Grobler. The aim is to
contextualise the artist‟s oeuvre up to 2009 and to explore the visual
metaphors in his art.
Grobler has a fascination for stories. He blends tales of traditional Western
mythology, African mythology, Christian religion, folklore and magical
realism into narrative artworks. Through visual metaphors the artist
comments on the everyday human dramas that surround him – be they
political, social, psychological or cultural. Furthermore, he adds an element
of surprise to his sketches of human drama, by infusing them with irony
and humour.
My research reflects the diverse nature of Grobler‟s oeuvre as it
investigates works from various artistic genres such as painting, sculpture,
illustration, performance art, avant-garde theatre and animation. It also
examines a blend of different artistic media such as ceramics, oil paint,
gouache, pastels, scraperboard, earthenware, 2D computer animation,

著作權集體管理機制(Copyright Collective Management Mechanism),誕生已有數百年的歷史,國際間已經發展出相當成熟的運作機制,相較於我國自民國八十年起才開始有類似收費機制運作,發展經驗可說是相當地懸殊。而我國該機制之正式法制化—著作權仲介團體條例於民國八十六年十一月五日公布施行以來,十年間實務上爭議不斷,機制運作陷於巨大的危機。加以近年來我國推動數位內容產業,著作權授權議題更是攸關數位影音應用產業未來的發展,在在顯示我國著作權集體管理機制確有重新審視之必要。
於是自民國九十五年起在經濟部智慧財產局的主導下,開始召集各方進行對話,並藉此機會蒐集意見以推動著作權仲介團體條例的修法工程。除了國內的改革,國際間在過去十年來也開始對著作權集體管理機制的運作進行檢討,此乃由於數位時代的到來,著作權集體管理機制受到各種新興數位科技,諸如:網際網路、數位權利管理、點對點檔案分享等之巨大衝擊,此種態勢影響機制的保護、行使和管理的環境,使得國際著作權社群開始思考著作權集體管理機制應該如何因應數位環境所帶來的挑戰。
有鑑於此,本研究希望能夠立基於我國著作權集體管理機制的現況,以過去實務上及近日修法歷程中所遭遇的爭議問題為著眼點出發,回顧過去國際間著作權集體管理機制運作經驗,並探討近年國際間發展趨勢,以勾勒出我國機制未來藍圖。探討的重點包括:著作權集體管理機制的歷史與法律背景、意涵、功能與操作原則,以為我國機制擘畫運作之參考;著作權集體管理機制運作場域—我國著作權產業的發展現況;採納「利害關係人」觀點,釐清我國機制中的各方利害關係人為何、所追求的目標何在及互相的利益衝突,進而界定出各方利害關係人未來參與機制的適當形式;評析我國著作權集體管理相關法制的沿革、內容與修法;並針對國際間近年兩大發展趨勢:數位化及跨越疆界的著作權集體管理趨勢,先行探討有哪些新興的數位科技對著作權集體管理機制帶來衝擊,評估其影響與機制的新角色定位,其次討論跨越疆界趨勢:單一窗口、跨國界集體管理及其衍生的公平交易法課題。
最後回應本研究的研究問題,論述對我國實務現況之觀察、著作權集體管理法制總評、國際運作經驗及發展趨勢對我國的啟示,並且提出三大項建議:我國著作權集體管理團體現階段要務、政府的角色、對我國未來機制的幾點省思,是為本研究之結論與建議。 / Copyright Collective Management Mechanism has been established for centuries and developed maturely worldwide. However, it was not until 1991 that some similar collecting organizations started to operate in Taiwan. Compared with some countries around the world, the development experience is quite different. After the formal legalization—the enactment of the Copyright Intermediary Organizations Act on November 5 1997, there were lots of argues emerged in the aspect of law enforcement. Besides, Taiwan’s government has promoted the development of digital content industry in recent years. The issues concerning copyright licensing will have a big impact on the development of audio-visual application industry in the future. It is therefore, necessary to raise concerns and re-scrutinize Taiwan’s copyright collective management mechanism.
Since 2006, Taiwan Intellectual Property Office (TIPO) has started to gather public opinion for revising the act. Except the revolution in Taiwan, people started to examine the exercise situation of copyright collective management internationally in last ten years. This is because the advent of digital technologies, such as: the Internet, digital rights management, peer-to-peer file sharing, has changed the environment surrounding the copyrighted works. International copyright societies started to think about how to deal with the challenges brought in digital era.
This thesis aims to discuss some of these issues by exploring the current situation of Taiwan’s copyright collective management mechanism, the obstacles encountered in the past practice, the process of law revising, and the latest development trends worldwide.
First of all, Chapter One is an Introduction to this thesis. Then Chapter Two discusses the historical and legal background, definition, functions, and operating guidelines of the mechanism for future reference when Taiwan intends to modify current mechanism. Chapter Three describes the developing situation of Taiwan’s copyright industries. Chapter Four adopts “Stakeholder Analysis” to clarify who are the stakeholders in Taiwan’s mechanism, their pursuing goals, and conflicts of interest between them. Chapter Five traces the developing process, content and revision in relation to Taiwan’s copyright collective management legislation. Chapter Six outlines the two latest development trends: digital and cross-border copyright collective management. At first, it analyzes the impact of new digital technologies and the new role of copyright collective management mechanism. Integration trends: one-stop-shop, cross-border collective management and antitrust concerns, are explored as well. At the end of this thesis, Chapter Seven, I propose three recommendations for Taiwan’s mechanism in the future: the urgent missions of Taiwan’s collective management organizations, the role of government, and the self-examination. It is my hope the recommendations contribute to the better resolution of existing and future challenges.

Thèse réalisée en cotutelle avec la faculté de droit de l'Université d'Orléans en France. / Menée pour la première fois, l’étude des différentes dimensions de la prévention (la précaution, la cessation et la dissuasion) est rendue possible par la découverte des sanctions préventives en droit de la responsabilité civile.
Les sanctions préventives sont nombreuses en jurisprudence en vue de prévenir le dommage à différents stades : avant la réalisation du fait dommageable (mesure de prévention et de précaution), au cours de sa réalisation (mesure de cessation), après sa réalisation (dommages et intérêts provisionnels) et après sa reconnaissance juridique (dommages et intérêts punitifs). Concevoir une notion de sanction préventive devient alors essentiel pour comprendre les évolutions contemporaines du droit. Définie comme l’effet de droit résultant d’une interprétation de la norme susceptible d’être violée, la sanction préventive démontre que l’action introduite précocement par le justiciable peut aboutir. Si ces évolutions bouleversent les conditions classiques de la responsabilité, elles s’expliquent en revanche par une représentation de la responsabilité civile à partir de ses effets.
Sous l’angle des effets, l’existence des sanctions préventives met en lumière une mise en effet judiciaire des normes dans une finalité préventive. La mise en effet est une opération effectuée en pratique par le juge entre l’interprétation et l’exécution de la norme. Ce temps de la mise en effet est celui durant lequel le juge choisit l’effet de droit apte à résoudre le litige. Or, le choix de la sanction par le juge n’est pas entièrement libre. En effet, les sanctions préventives naissent d’un besoin sécuritaire. Cette effectivité désirée par les justiciables exerce une influence sur la mise en effet de la norme par le juge par l’introduction précoce de l’action en justice.
Qualifier les manifestations préventives de la responsabilité civile de sanctions juridiques naissant d’une opération judiciaire de mise en effet des normes permet ainsi de mieux rendre compte de la pratique du droit au sein d’une théorie renouvelée du procès. / The discovery of Preventive Sanction in the Law of civil responsibility is made possible by studying, for the first time, the various aspects of prevention (deterrence, cessation, precaution).
To prevent harm at different stages of realization, case law makes a broad use of Preventive Sanction: before harm is done (precautionary and preventive measures), while it is done (stop and cease order), after it is done (temporary damages) and after is has been legally recognized (punitive damages). Crafting a notion of Preventive Sanction becomes then central to the understanding of contemporary legal developments. Preventive Sanction defined as the legal effects arising from the construction of a norm which might be broken, show that early action brought by a plaintiff can be successful. The transformation of traditional requirements for responsibility by these developments can be explained by reframing civil responsibility from its effects.
This perspective allows for the preventive goal of judicial effectuation to be brought to light by the existence of Preventive Sanction. In practice, effectuation is performed by the judge and takes place between the construction and implementation of legal norms. The moment of effectuation occurs when the judge selects the legal effects destined to resolve a dispute. However, the judge is not entirely free when choosing a sanction. Preventive sanction originates from a need of security. Through early introduction of legal action, effectivity sought by plaintiffs impacts judicial effectuation of legal norms.
The practice of law, within a renewed theory of judicial action, is better accounted for by reframing “preventive expression” of the Law of civil responsibility as “legal sanction” arising from the judicial effectuation of legal norms.

Explicit Segmentation Of Speech For Indian LanguagesRanjani, H G 03 1900 (has links)
Speech segmentation is the process of identifying the boundaries between words, syllables or phones in the recorded waveforms of spoken natural languages. The lowest level of speech segmentation is the breakup and classification of the sound signal into a string of phones. The difficulty of this problem is compounded by the phenomenon of co-articulation of speech sounds.
The classical solution to this problem is to manually label and segment spectrograms. In the first step of this two step process, a trained person listens to a speech signal, recognizes the word and phone sequence, and roughly determines the position of each phonetic boundary. The second step involves examining several features of the speech signal to place a boundary mark at the point where these features best satisfy a certain set of conditions specific for that kind of phonetic boundary. Manual segmentation of speech into phones is a highly time-consuming and painstaking process. Required for a variety of applications, such as acoustic analysis, or building speech synthesis databases for high-quality speech output systems, the time required to carry out this process for even relatively small speech databases can rapidly accumulate to prohibitive levels. This calls for automating the segmentation process.
The state-of-art segmentation techniques use Hidden Markov Models (HMM) for phone states. They give an average accuracy of over 95% within 20 ms of manually obtained boundaries. However, HMM based methods require large training data for good performance. Another major disadvantage of such speech recognition based segmentation techniques is that they cannot handle very long utterances, Which are necessary for prosody modeling in speech synthesis applications.
Development of Text to Speech (TTS) systems in Indian languages has been difficult till date owing to the non-availability of sizeable segmented speech databases of good quality. Further, no prosody models exist for most of the Indian languages. Therefore, long utterances (at the paragraph level and monologues) have been recorded, as part of this work, for creating the databases.
This thesis aims at automating segmentation of very long speech sentences recorded for the application of corpus-based TTS synthesis for multiple Indian languages. In this explicit segmentation problem, we need to force align boundaries in any utterance from its known phonetic transcription.
The major disadvantage of forcing boundary alignments on the entire speech waveform of a long utterance is the accumulation of boundary errors. To overcome this, we force boundaries between 2 known phones (here, 2 successive stop consonants are chosen) at a time. Here, the approach used is silence detection as a marker for stop consonants. This method gives around 89% (for Hindi database) accuracy and is language independent and training free. These stop consonants act as anchor points for the next stage.
Two methods for explicit segmentation have been proposed. Both the methods rely on the accuracy of the above stop consonant detection stage.
Another common stage is the recently proposed implicit method which uses Bach scale filter bank to obtain the feature vectors. The Euclidean Distance of the Mean of the Logarithm (EDML) of these feature vectors shows peaks at the point where the spectrum changes. The method performs with an accuracy of 87% within 20 ms of manually obtained boundaries and also achieves a low deletion and insertion rate of 3.2% and 21.4% respectively, for 100 sentences of Hindi database.
The first method is a three stage approach. The first is the stop consonant detection stage followed by the next, which uses Quatieri’s sinusoidal model to classify sounds as voiced/unvoiced within 2 successive stop consonants. The final stage uses the EDML function of Bach scale feature vectors to further obtain boundaries within the voiced and unvoiced regions. It gives a Frame Error Rate (FER) of 26.1% for Hindi database.
The second method proposed uses duration statistics of the phones of the language. It again uses the EDML function of Bach scale filter bank to obtain the peaks at the phone transitions and uses the duration statistics to assign probability to each peak being a boundary. In this method, the FER performance improves to 22.8% for the Hindi database.
Both the methods are equally promising for the fact that they give low frame error rates. Results show that the second method outperforms the first, because it incorporates the knowledge of durations.
For the proposed approaches to be useful, manual interventions are required at the output of each stage. However, this intervention is less tedious and reduces the time taken to segment each sentence by around 60% as compared to the time taken for manual segmentation. The approaches have been successfully tested on 3 different languages, 100 sentences each -Kannada, Tamil and English (we have used TIMIT database for validating the algorithms).
In conclusion, a practical solution to the segmentation problem is proposed. Also, the algorithm being training free, language independent (ES-SABSF method) and speaker independent makes it useful in developing TTS systems for multiple languages reducing the segmentation overhead. This method is currently being used in the lab for segmenting long Kannada utterances, spoken by reading a set of 1115 phonetically rich sentences.

The aim of this work is to explore the joining of inspiration, such as different garments and materials, in relation to commonly used methods in the fashion industry when it comes to joining of different trends and references such as clashing and collaging. The work proposes a new method and framework for join- ing inspiration which generates different results depending on what kind of inspiration that is put in to it. A garment can roughly be broken down to a silhouette and shape, materials and details. The material put in to the method and framework is based on information from trend seminars for SS16, because that is how many of today’s trend-oriented fashion brands get there inspiration. Trendy garment silhouettes are mixed through processes of computational morphing in Adobe Flash by a generation of spin in the mixing process were shape hints are used in a new manner. The new generated silhouettes are further developed and materialized through procedures of interpretation and figuration. Different trendy materials are melded in a direct and concrete way through mixed media techniques such as laminating, fusing and vacuum-techniques. The final steps of the method is a garment shape and material synthesis with starting point in the generated shape with the final material. The projects intention is to let the physical experimentation, interpretation and figuration play a central role in the research process for new types of methods, garments, materials and expressive pos- sibilities.
