That is why the contract, basis of the society, is the instrument which regulates the human relationship in several dimensions being in harmony with those relations, making citizens respect each other and setting up limits between the right and the duty. The purpose of the current work is to build a doctrinal interpretation of the pattern of the 421 article of the Civil Law that guarantees the application of some protection mechanisms of the social concerns found in the contracts with no fragility of the protection of the established juridical relations. Researching the evolution of the Contractual Law and its principles, contemplated in a new paradigm, carrying out a survey of that issue in the foreign law and the principle of the social function of the property, it is revealed the sociability of the contract, finding developed and established interpretations by renowned authors of the juridical, philosophical and sociological literature. It is concluded under some notes that the social function of the contract is the recognition, even late, of the inherent essential function of the contract, for the contract is set up to make man able whenever necessary to make up for his natural and individual deficiency, as a vehicle that rules the social and human life. / Fruto do reconhecimento do que há de mais nobre no Direito Privado, a socialidade do contrato é a mais importante inovação trazida pelo Código Civil vigente. Isto porque o contrato, base da sociedade, é o instrumento que regula a inter-relação humana nas suas mais diversas dimensões através da harmonização dessas relações, obrigando o respeito recíproco entre os cidadãos e estabelecendo os limites entre seus direitos e deveres. O objetivo desse estudo é construir uma interpretação doutrinária da norma do artigo 421 do Código Civil que garanta a aplicação dos mecanismos de defesa dos interesses sociais face aos contratos, sem fragilizar a segurança das relações juridicamente constituídas. Com base em uma pesquisa evolutiva do Direito Contratual e seus princípios norteadores, contemplados em novo paradigma, do levantamento da matéria no direito estrangeiro e do paralelo inexorável do princípio da função social da propriedade, passa-se a expor a socialidade do contrato, deparando-se com interpretações desenvolvidas e já estabelecidas por consagrados autores da literatura jurídica, filosófica e sociológica. Conclui-se, sob o prisma de algumas observações, que a função social do contrato é o reconhecimento, ainda que tardio, da função precípua, inerente, e essencial do contrato, pois, o contrato nasce para conferir aptidão ao homem na necessidade de suprir suas deficiências naturais e individuais, como veículo orientador da vida humana e social.

The city of Dar es Salaam in Tanzania is still influenced by its colonial structure. This is particularly apparent in the former 'European quarter' Oyster Bay and its perception by the inhabitants of other parts of the city. On the basis of aerial photographs and interviews with people who lived in the city under British colonial rule as well as younger inhabitants this study analyses the extent to which Oyster Bay can be seen as 'heterotopia' in Foucault's sense. The focus is upon the social function of Oyster Bay as an 'other place' for the rest of the city.

Theory of Mind and Empathic Responding in Patients with Mood Disorders

<p>Theory of mind (ToM) and empathic responding are thought to rely on the joint contribution of cognitive and affective processes, and the corresponding complex neural networks involved in these diverse cognitive and affective functions. Individuals with mood disorders demonstrate deficits in many of the same cognitive and affective processes thought to mediate ToM and empathy, and demonstrate structural and functional changes in the neural regions that subserve these social cognitive domains. We examined ToM and empathic responding in patients with major depressive disorder (MDD) and bipolar disorder (BD) using standardized measures of social cognitive responding. Patients with BD and MDD with sub-syndromal depressive symptoms showed deficits on a cognitively challenging task that required them to integrate two perspectives simultaneously (second-order ToM stimuli). Sub-syndromal patients with BD also showed a trend toward poor performance on a less demanding first-order ToM task; no such deficit was observed for sub-syndromal MDD patients. Patients with BD were also impaired at discriminating mental states from pictures of eyes and in making complex social judgments. Both patient groups reported reduced levels of cognitive empathy, but differed in response on affective empathy domains. Specifically, whereas the BD group reported higher levels of distress in response to others' negative experiences, the MDD group reported less feelings of care and concern in response to another’s emotional experience. Across the BD studies, impaired ToM and empathic responding were found to be associated with poor social functioning and increased depressive symptoms, but the influence of illness burden variables on performance was variable. Across the MDD studies, the associations between social cognitive performance, illness variables, and social functioning were inconsistent. Taken together, our findings indicate that patients with mood disorders demonstrate altered ToM and empathic responding that may contribute to the difficulties in social communication observed in these patient populations.</p> / Doctor of Philosophy (PhD)

Early Parasympathetic Activity Predicts Later Childhood Social Functioning as Mediated by Emotion Regulation

Theories of emotion regulation and social engagement indicate that resting and reactive respiratory sinus arrhythmia (RSA), which reflect vagal activity, in early childhood can inform the development of social and emotional behaviors later in life. Low RSA at baseline and during a stressful task have been associated with symptoms of ED and disorders characterized by social impairments. The current study examined the mediating role of ED at 24-months-old (mo) on the prospective association between early infant resting and reactive RSA at 5 mo on social functioning outcomes at 48 mo, and the mediating role of social functioning at 24 mo on infant RSA at 5 mo and ED at 48 mo in 237 healthy children. It was hypothesized that ED would mediate the relationship between infant RSA and later childhood social function. Results largely indicated no support of the hypotheses and that there is no mediating effect of childhood ED on early RSA on later childhood social behavior; however, there was a significant relationship between infant resting and reactive RSA and later ED. Limitations and future directions for improving the methodology are addressed. / M.S. / Early childhood heart rate has been thought to influence the development of later child emotional and social development. The Polyvagal Theory suggests that low variability in heart rate, as measured by respiratory sinus arrhythmia (RSA), is related to greater difficulties in emotional and social behavior. Finding an underlying biological reason for emotional and social development can be important for understanding childhood psychological disorders. This research study examined healthy children at three different time points during development: 5 months old (mo), 24 mo, 48 mo. RSA was measured at 5 mo, and frustration levels and social abilities at 24 and 48 mo. It was hypothesized that low RSA at 5 mo predicts low social abilities at 48 mo because of high frustration levels at 24 mo. To rule out an alternate hypothesis, this study also tested if low RSA at 5 mo predicts high frustration levels at 48 mo because of low social abilities at 24 mo. The results of this study did not support the predictions and there was no evidence of emotional abilities affecting how RSA predicts later social abilities. Possible explanations for the lack of findings and ideas for future research were discussed.

The private autonomy concept itself reveals that this power isn t absolute. It means that people s will must be conformed to public order rules and good behavior. Some of theses limits are easy to be applied because they are detailed by law. However, there are limits in juridical order that are general clauses, and other limits that even have express determination, but are given by the dynamic of the system. In theses hypothesis, its complex to define private autonomy limits, due to the inexistence of a generic formula that can be applied to every situation. In these cases, the limits are extract case by case, taking into consideration elements that, sometimes, are beyond juridical order. This work aims to study private autonomy limits that are consequences of the general clauses, the property social function, the contract social function, the good-faith and from the conflict between private autonomy and individual rights / A autonomia privada é um dos princípios estruturantes do Direito Civil e consiste no poder que as pessoas têm de regulamentar suas relações jurídicas, nos limites fixados pelo ordenamento jurídico. O próprio conceito de autonomia privada revela que esse poder não é absoluto, o que significa que a vontade dos sujeitos deve estar conformada a normas de ordem pública e aos bons costumes. Alguns desses limites são de fácil aplicação por estarem detalhados na própria lei. Há, porém, limites que estão contidos no ordenamento sob a forma de cláusulas gerais e outros que sequer contam com determinação expressa, mas são depreendidos pela dinâmica do sistema. Nessas hipóteses, a determinação dos limites à autonomia privada é mais complexa, pois não há uma formulação abstrata aplicável a todas as situações, devendo os limites ser extraídos caso a caso, levando em consideração fatores que, às vezes, transcendem o próprio ordenamento jurídico. Thus we sought to demonstrate the impact on society at such negligence, given the various social differences existing in our country, which are constituted as fuel for the emergence of permanent land conflicts. This publication also alternatives for a better policy on the institute, and used as research techniques, secondary sources, ie literary duly cited, and inductive and deductive methods to achieve a positive result and easy to understand this study. / O presente trabalho busca discutir o real significado da expressão função social da propriedade prevista na Constituição Federal, sobretudo levando-se em conta a postura do Estado, o qual exige do particular que dê uma destinação social à propriedade, inclusive sujeitando-o a perda do direito real que possui sobre o bem, caso não cumpra sua função social, porém, acaba por não cumprir o mesmo papel, deixando diversas terras de sua propriedade sem destinação específica. Desta forma buscou-se demonstrar o impacto causado na sociedade ante tal desídia, haja vista as diversas diferenças sociais existentes em nosso país, as quais se constituem como combustível para o surgimento de conflitos de terras permanentes. No conteúdo foi feita uma análise de forma substancial da natureza jurídica da função social da propriedade e os efeitos dela decorrentes analisando-a sob vários aspectos, se está havendo uma preocupação e um debate acerca do tema, ou, se existe perspectiva para um melhor aproveitamento das propriedades ociosas. Foi feita ainda uma análise da questão da utilização racional da propriedade, tanto pelo particular quanto pelo Estado, verificando se as autoridades competentes estão cumprindo seu papel, qual seja, o de buscar alcançar a justiça social através da distribuição racional da terra e atribuir a função social a que esta se destina. Apresentam-se ainda alternativas para uma melhor política a respeito do instituto tendo utilizado como técnicas de pesquisa, fontes secundárias, isto é, obras literárias oportunamente citadas, além de métodos dedutivos e indutivos para se alcançar um resultado positivo e de fácil compreensão do presente estudo.

Será realizada uma revisão histórica do contrato de trabalho, bem como, uma investigação das teorias acerca de sua natureza jurídica, dedicando-se especial atenção à teoria comunitário-pessoal da relação de trabalho. O contrato de trabalho e suas características serão objeto de estudo, com especial atenção às críticas atuais ao instituto, a partir das quais será realizada uma comparação entre ele e os contratos civilistas e consumeristas. Analisadas as particularidades dos chamados contratos pós-modernos e a proposta de reconstrução dogmática elaborada por Maria do Rosário Palma Ramalho, será sugerida uma configuração diferente do contrato de trabalho clássico apoiada na boa-fé e a partir das concepções existencial, relacional e fraterna do contrato. A aplicação da boa-fé, sob a ótica da função social, será estudada como forma de viabilizar a noção comunitária do vínculo laboral. A historical review of the employment contract will be carried out and an investigation of the theories about its legal nature, devoting particular attention to community-personal theory of the employment relationship. The employment contract and its characteristics will be studied, with special attention to the current criticism of the institute, from which will be compared to civil law contract and consumer. Analyzed the characteristics of so-called postmodern contracts and the proposed dogmatic reconstruction drafted by Maria do Rosário Palma Ramalho, will be a suggested different configuration of the standard employment contract with emphasis on good faith and from the existential concepts, relational and fraternal contract. The application of good faith from the perspective of social function, will be studied as a way to enable the community concept of employment. It will analyze the concept and applicability of existential and relational categories contractual employment relationship, especially the ability to aggregate them to the classic characteristics of the labor contract. It will examine the fraternity as an essential element to the community conception of labor relations.

Vulnerability and Social Functioning in Schizophrenia

This thesis offers a broad approach in elucidating biological risk factors, as well as psychological and social functioning in schizophrenia. The aims are as follows: (I) investigate the association between birth characteristics and schizophrenia, (II) study the association between levels of neurotransmitter neuropeptide Y (NPY) in cerebrospinal fluid (CSF), social function and longitudinal outcome in schizophrenia, (III) compare social functioning of patients with schizophrenia with their biological siblings and (IV) explore how siblings to patients with schizophrenia perceive the sibling relationship and their role. Paper I was a cohort analysis of 11,360 same-sexed twins in which obstetric records were used. Low birth weight and small head circumference were associated with later development of schizophrenia. To some extent the results persisted in the within-pair analyses conducted on 82 pairs discordant for schizophrenia. Fifty-six patients with schizophrenia were included in paper II. Levels of NPY in CSF correlated to social competence at index admission. For each standard deviation increase in baseline NPY, there was a concomitant increased risk of being unemployed, having moderate or severe symptoms or recent hospitalization at the 3-year follow-up. In paper III, social functioning was investigated using the Swedish version of the videotaped test Assessment of Interpersonal Problem Solving Skills (AIPSS) in 70 participants (25 patients with schizophrenia, 20 siblings and 25 randomly selected controls). The patients presented severe deficits in social functioning. The siblings expressed subtle impairments in nonverbal language but did not generally differ from the controls. To explore the siblings’ perspective on schizophrenia a qualitative study was conducted with interviews of 16 siblings in paper IV. A unifying major theme was an emotional sibling bond. Siblings developed several coping patterns, including avoidance, isolation, normalization, care giving and grieving. A third major theme consisted of the fear of inheriting schizophrenia. In conclusion, fetal growth, altered levels of NPY in CSF and subtle impairments in nonverbal social behavior might be important risk factors in schizophrenia. Patients with schizophrenia revealed extensive impaired social functioning, and from the siblings’ perspective, a brother or sister’s diagnosis of schizophrenia seems to have a profound psychological impact on the siblings.
