A comparative survey of the law relating to strikes in South Africa and the NetherlandsTroskie, Herman R. W. 06 1900 (has links)
In the first section of the dissertation, strike law in the Netherlands is focused upon. The
following issues are inter alia dealt with: the historical background of the strike
phenomenon, the right to strike and restrictions on this right, the reluctance of the Dutch
legislature to legislate in the field of industrial action, and the directly applicable
provisions of the European Social Charter.
The second section of the dissertation deals with South African strike law and also starts
off with a discussion of the historical background thereof, whereafter the provisions of the
1995 Labour Relations Act are analysed and discussed.
The third and last section highlights some of the major differences and points to some
similarities between the two legal systems. It concludes that the detailed South African
labour legislation does not provide more certainty than the Dutch judge-made law in

The effective management of a strike is generally a challenging phenomenon which impacts on employers, employees and the general public. The main purpose of this study was to analyse the legal implications of employees’ participation in an unprotected strike. The study also explored requirements for a strike to be protected in compliance with the prescribed legislation. From the literary review, cases and legislation, it became clear that compliance plays a key role when a consideration is taken by employees to take part in a strike during dispute resolution.
In analysing the legal consequences for participating in an unprotected strike, a finding was made that employers in the end have an upper hand in that when all due processes and procedures are followed, they are empowered to dismiss employees. certain acts (inter alia termination of contracts of
employment) which must be executed by the employer
with a certain purpose.
The Appellate Division has recently found that the
employment relationship not necessarily terminates
similarly to the common law contract of employment,
but may subsist after termination of the contract of
employment.
The industrial court does not easily accept that it
has been deprived of its unfair labour practice
jurisdiction where terminations of employment take
place in consequence of a lock-out. The motive of the
employer seems to be decisive.
In line with both the trend in first world countries
and principles established by the courts in South
Africa, the Constitution and especially recent labour
legislation significantly curtail the bargaining power
of the employer because it is progressively being
believed that the employer has sufficient economic

Strategies for curbing strike action by nurses in public institutions, South AfricaNala, Ntombifuthi Patience 07 April 2015 (has links)
The healthcare strike action that rocked South Africa in 2007 and 2010 highlighted the trend of professional nurses towards exercising their rights as employees to embark on strike actions, often also in solidarity with other categories of employees. This study aimed to highlight the problem brought about by the lack of proactive strategies to maintain a balance between human and professional rights and responsibilities of nurses within the legal framework of South Africa. The theoretical grounding of the study included both organisational change models and transformational leadership models.
A descriptive and analytic design was followed, using both qualitative and quantitative non-probability sampling approaches to meet the research objectives of determining factors for nurses‘ involvement in strikes and their impact. Eighty professional nurses were included as the total sample of the study with 53 that did not participate in strike action and 27 that participated in strike action. A sample of eleven nurse managers was also included in the study to determine their views on strikes by nurses and their understanding of the changing work environment. To determine the overall impact of the nurses‘ strike, 40 healthcare consumers were included. The sample was selected from four provinces: Eastern Cape, KwaZulu-Natal; Western Cape and Gauteng. The study was limited to professional nurses, nurse managers within the public-health sector and healthcare consumers using public-health facilities. The findings and the relevant literature referred to in this study indicate that though there are different reasons for strike action in the public-health sector by area or by country, remuneration is undoubtedly the most mentioned reason. Important to note is that salary per se is not the most critical actor but it is a
tangible measure of the value that the employer places on people. In the absence of other incentives in the nursing environment, it becomes the focal point. Lucie Božková Annotation In my thesis Operation 'Allied Force' in Selected Czech Daily Newspapers I am tracing the representation of the topic - NATO's air strikes in the former Federal Republic of Yugoslavia (the so called Operation 'Allied Force') in 1999 in selected Czech Daily Newspapers. I am observing the effects, media's impact, frames and agenda setting. To support the integrity of the topic I added a chapter about the Kosovo crisis which enlightens the initiation of the air attacks. Furthermore, and mainly I am focusing on professional studies dealing with military news. The dominant theme of these articles is the foreign media coverage of the Kosovo War. In the experts 'outputs I predominantly center on their choosing and the method of analysis, on which I then base my analysis on. I decided to use the method of the quantitative content analysis for my own research. The first period of exploration is the bombing period (March 24, 1999 - June 10, 1999). Cette recherche a pour objet l’analyse de l’impact d’un événement d’importance, le Front populaire, sur un département, le Finistère, essentiellement rural et fortement marqué par la question religieuse.Les affrontements y sont nombreux pendant toute la période de l’entre-deux-guerres. Un puissant syndicalisme agricole s’y développe en s’appuyant sur une vie économique qui repose essentiellement sur le monde rural. Il cherche à filtrer les influences extérieures, y compris celles de la hiérarchie catholique, et à assurer son ascendant sur la société par le biais du corporatisme. En face, la société urbaine, qui a certes des velléités hégémoniques, vit ses propres antagonismes, entre un mouvement ouvrier en mutation et une élite qui durcit ses positions devant les manifestations d’émancipation du salariat. La pénétration des idées sociales est faible dans les campagnes, au regard des populations concernées. L’Église catholique, au travers d’un appareil militant bien implanté, cherche à conforter son emprise sur l’ensemble de la société. La crise radicalise les positions des uns et des autres. Les affrontements s’intensifient pendant la période nous utilisons les outils d’analyse sur les mouvements sociaux pour mesurer les capacités de mobilisation des acteurs, en croisant les sources afin de confronter les attitudes. Clashes are numerous throughout the period of the interwar period. A powerful agricultural union developed there based on an economy based mainly on rural areas. It seeks to filter out external influences, including those oft he Catholic hierarchy, and to ensure its influence over society through corporatism. Face, urban society, which certainly hegemonic ambitions, lives its own contradictions between a workers’ movementand changing an elite that hardens his positions before the emancipation of the wage protests. Penetration of social ideas is weak in the countryside, in view of the populations concerned. The Catholic Church, through a well-established militant unit, seeking to consolidate its grip on the whole of society, the crisis radicalizes the positions of each other. Fighting intensifies during the period. We use the analytical tools on social movements to measure the actors mobilization capacities, crossing sources to confront attitudes. We look to see how rub the urban and rural areas and if this apparent position of blocks is not disturbed by a third actor, the clerical bloc. The struggle for hegemony is played not only in the political field but also in the social field.

A dissertação enfoca o movimento grevista ocorrido na Empresa Jornalística Caldas Júnior, em Porto Alegre, entre fins de 1983 e início de 1984, motivado por atrasos salariais. A greve durou 56 dias e acabou por ser declarada legal pela Justiça do Trabalho, com base na lei 4.330, legislação à época apelidada de lei “antigreve” pelos dirigentes sindicais. O trabalho discute como este acontecimento se tornou possível, a partir do exame de suas características específicas, entre elas a união de três categorias de trabalhadores (jornalistas, gráficos e rodoviários), relacionando-o com a análise do contexto sindical da época, marcado pela emergência e institucionalização do chamado novo sindicalismo. A investigação busca examinar quatro questões centrais: a relação entre a mudança tecnológica verificada no setor gráfico e a mobilização grevista, a ruptura das relações de dominação de caráter paternalista no nível da produção, a articulação possível entre os três sindicatos envolvidos e a questão jurídica. / The present dissertation focus on the strike movement that took place at Caldas Júnior News Company, in Porto Alegre, between late 1983 and early 1984, motivated by belated wage payments. The strike lasted 56 days and it was declared to be legal by the Superior Labor Court, based on the law nº 4.330, legislation at that time known as “antistrike” law, name coined by the Union managers. This study discusses how this event was possible, from the examination of its specific characteristics, among them the union of three categories of workers (periodists, compositors, drivers), woven into the analysis of the trade union context at that period which was marked by the emergence and institutionalization of the “novo sindicalismo” (new syndicalism movement). The investigation examines four central questions: the relation among the technological change seen in the graphic sector and the mobilization of strikers, the rupture of the paternalism relations in the production level, the possible articulation among the three involved unions and the legal issues.

Os discursos sobre a identidade docente em espaços de escritas online: valoração e reenunciação discursiva / Teacher's identity discourses in online writing spacesRucinski, Vilson Rodrigo Diesel 07 June 2017 (has links)
A presente pesquisa teve como objetivo principal compreender como a identidade do professor é discursivizada em comentários online produzidos no perfil institucional da APP-Sindicato PR na rede social Facebook durante o período da Greve dos Professores, ocorrida no primeiro semestre de 2015. Como a identidade docente tem sido constantemente questionada, contestada, depreciada e reformulada tanto por discursos depreciativos quanto por políticas públicas, que precarizam a carreira docente, faz-se relevante o desenvolvimento de estudos acerca dos discursos que emergem em período de crise para compreender as novas maneiras de “olhar” o professor. Para isso, compõem a base teórico-metodológica dessa dissertação estudos a respeito da identidade (HALL, 2006; GEE, 2000) e da identidade docente (FREIRE, 1967; NÓVOA, 1991, 2009; KLEIMAN, 2006; TARDIF, 2012; GERALDI, 2010); pesquisas relacionadas a ambientes online de interação e sites de redes sociais (RECUERO, 2009, 2014; BARTON e LEE, 2015) e conceitos fundantes como: discurso, enunciado, alteridade e dialogismo, ancorados nos estudos do Círculo de Bakhtin (BAKHTIN, 1997[1979], 2006[1929],2015 [1929], 1987[1965], 2015[1975] 2010 [1986]; VOLOCHÍNOV, 2013[1926], 2013[1930]). Os dados gerados para a análise constituem-se de enunciados produzidos no primeiro semestre de 2015, período em que a greve dos professores e funcionários públicos da educação pública do estado do Paraná estava acontecendo. Esse evento propiciou um ambiente de arena discursiva, em que o confronto de vozes e ideologias gerou, nos espaços midiáticos, uma grande produção de enunciados que tematizavam a identidade docente. Assim, compõem o conjunto de dados gerados para este trabalho um total de 180 enunciados do gênero comentário online, selecionados do perfil oficial do Facebook da APP-Sindicato, instituição sindical que organizou e promoveu o movimento de greve. Dentre as regularidades discursivas acerca da identidade docente, destacaram-se discursos depreciativos, a saber: a identidade do professor “mal formado”; o professor “massa de manobra” da esquerda política; a docência como um dom; a (in)competência da escola pública. Além das diferentes formas de discursivizar a identidade do professor, foi possível observar que, nos espaços de escritas online, os sujeitos tendem a utilizar um tom mais agressivo ao produzir e reenunciar discursos depreciativos acerca da identidade docente, ignorando a responsabilidade do ser e agir. Em outros termos, produzem um discurso que não leva em conta o não álibi do ser. Por fim, além dos comentários que depreciam a docência e a educação pública de modo geral, foram salientes enunciados que apontam para a discursividade de uma nova identidade docente, a do professor que luta pelos seus direitos e ensina o agir democrático por meio de atos de cidadania. / The present research aims to comprehend how teacher's identity is represented by discursive interactions in online comments produced in the APP-Sindicato's Facebook profile, in the period of Teachers Strike that occurred in the first semester of 2015. With the teacher's identity being constantly questioned, contested, depreciated and reformulated both by depreciative discourses and public policies that weakens the teacher's career, it becomes important to study the discourses that emerges within this crises period to comprehend the new ways to "look" the teacher's identity. For this porpouse, the theoretical and methodological approach is composed by studies about identity (HALL, 2006; GEE, 2000) and teacher's identity (FREIRE, 1967; NÓVOA, 1991, 2009; KLEIMAN, 2006; TARDIF, 2012; GERALDI, 2010); researches about online interaction environments and social networks websites (RECUERO, 2009, 2014; BARTON e LEE, 2015) and founding concepts as: discourse, alterity, dialogism and enunciation as seen in the Bakhtin's Circle studies (BAKHTIN, 1997[1979], 2006[1929],2015 [1929], 1987[1965], 2015[1975] 2010 [1986]; VOLOCHÍNOV, 2013[1926], 2013[1930]). The research data were produced at the first semester of 2015, period when the Teachers Strike of State of Paraná took place, which provides a discoursive arena where the voices and ideologies confrontation are produced, in the media spaces, a large amount of enunciations that approaches the teacher's identity as the main theme. Thereby, this research data set are composed by an amount of 180 online comments, selected from the APP-Sindicato Facebook profile, syndical institution which organized the strike movement. Within the discursive regularities observed in the comments, we highlighted: the "poorly academic educated" teacher; the teacher as a "maneuver mass" for the left-wing political parties; the teaching as a "gift"; the (in)competence of public school. Besides the different ways of represent teacher's identity in discourse, it was possible to observe that in the online interaction environments, the subjects tend to use an aggressive tone when produces and reenounce depreciative discourses about teacher's identity, ignoring their responsability of being and acting, in other terms, producing discourses that does not consider the non-alibi of being. Lastly, besides the comments that depreciate the teaching and the public school in general, we highlighted comments pointing to a new discourse about the teachers identity, the identity of a teacher who fights for its rights and teaches the democratic acting through their acts.
