Boj proti organizovanému zločinu v Japonsku - historie a současnost / Fight against organized crime in Japan - the past and the present

6 Abstract The goal of this thesis is to provide a basic overview of the legislative acts taken against organized crime in Japan, and to map the intriguing historical evolution of organized crime until the present day. Also, to show how the connection and the historically advantageous relationship between the yakuza and the ruling elites affected the law in Japan. The first chapter is dedicated to the historical milestones of organized crime in Japan from the 17th century to the implementation of the first comprehensive law against the organized crime - the Bōtaihō, in 1991. In the next part of this thesis the particularities of the legislation against organized crime can be found, including the differences of the American and European models as well as the details of the Bōtaihō law itself. The third chapter is dedicated to the complementary and follow-up legislations concerning the fight against organized crime. A expansão econômico-financeira do mercado, com a presença global das TNCs, dá a tônica da sociedade contemporânea, na qual, atividades sociais, políticas e econômicas adquirem facilmente uma dimensão mundial. Nesse sentido, eventos, decisões e atividades ocorridas em uma determinada localidade, quase que imediatamente, impactam a vida de indivíduos e comunidades em outras partes do globo, ainda que muito distantes geograficamente. Isso pode ser exemplificado pelas repercussões da recente crise econômica na Europa, nos Estados Unidos e em outros centros de pujança financeira, e que, em parte, foram desencadeadas por atos de corrupção. Dentro desse contexto, a bidimensionalidade clássica que contrapõe o Direito Internacional em ramos do DIP e do DIPr não é suficiente para compreender a conjuntura das situações atuais. Para tanto, a Transnational Law une o Direito Internacional Público e Direito Internacional Privado com novos temas do direito, tais como: Direito Administrativo Internacional, o Direito do Desenvolvimento Econômico, Direitos Humanos e as regras aplicáveis às empresas transnacionais, que passam a ser consideradas como atores do sistema internacional. Nesse sentido, o presente trabalho busca contextualizar, por meio da perspectiva da interdependência, o tema da responsabilidade das TNCs e dos investimentos dentro da ciência do Direito, contrapondo com o tema da corrupção, sua agenda global e seus efeitos nefastos. Com efeito, deu-se prioridade à análise do esforço internacional no combate à corrupção (tratados internacionais, leis, inclusive com efeitos extraterritoriais, e outras legislações internacionais com natureza de soft-law), para ao final comentar acerca das particularidades do Brasil quanto ao tema. / The financial-economic market growth, with the global presence of the TNCs, represents the most of the contemporary society, in which social, political and economic activities easialy acquire a worldwide dimension. In these sense, events, decisions and activities ocorred in a certain place, almost imediately, impact the live of individuals and comunities in other parts of the globe, even in the distant parts. That fact may be exemplified by the repercussions of the current economic crises in Europe, United States and other big economic centers, which was caused, in part, by corruption scandals. Within this context, the classical division that opposes the International Law in two subjects (Public International Law and Private International Law) is no longer suficient to understand current situations that poses to humanity. Thereunto, the Transnational Law unites both Public and Private International Law with new themes of Law, such as: International Administrative Law, Economic Development Law, Human Rights and rules applied to the TNCs, which are considered actors in the international system. Accordingly, this paper seeks to contextualize, through an interdependence perspective, issues such as the TNC`s responsibility, and Investment Law, opposing with the issue of corruption, its global agenda, and adverse effects. Indeed, we prioritized the analysis of the international effort in the fight agaisnt corruption (international treaties, laws, including the ones with extraterritorial effects, as well as other soft-law international legislation). Finally, we make brief comment about Brazils particularities.

Transformation from below? : the role of civil society organizations in the global governance of the response to HIV/AIDS

This thesis contributes to debates on the role of civil society organizations (CSOs) in global governance by asking if their participation in the global response to HIV/AIDS has been transformative – with transformation conceptualized as change towards a more equitable order. Adopting a critical International Relations approach, and applying qualitative methods, it analyzes how CSOs used the initial failure of biomedical responses to the epidemic to advance a human rights frame, which justified their participation in global governance. This frame complemented conceptions of AIDS exceptionalism, and has recently shifted in response to an increased focus on key populations. CSOs continue to advance the rights frame in global institutions – the focus here being on how they have done so within UNAIDS and the Global Fund to Fight AIDS, Malaria and Tuberculosis. However, rigid bureaucracies and dominant power relationships limit CSOs’ ability to transform these institutions to be more responsive to and representative of those affected by the epidemic. CSOs have further struggled to influence the largest global donors of the HIV/AIDS response – the Global Fund and PEPFAR – to direct greater resources to rights-based initiatives, despite CSO participation in resource mobilization. Though CSO participation has been restricted by donor state power, bureaucratic structures, and changes in the political economy of global health, CSOs have continued to promote potentially transformative alternatives, and so have continued to represent the interests of those most affected by the epidemic. This allows potential for further transformative alternatives.

As organizações da sociedade civil e o programa de controle da tuberculose - análise das parcerias no estado de São Paulo / Brasil / The civil societys organizations and the tuberculosis control program an analysis of the partnerships of the state of São Paulo/ Brazil

Este estudo objetivou identificar e caracterizar algumas parcerias, voltadas ao controle da tuberculose, estabelecidas entre organizações não-governamentais (ONGs) e o Programa de Controle da Tuberculose (TB) no Estado de São Paulo. Buscou, ainda, analisar as ações desenvolvidas, de forma a verificar seu potencial para responder aos determinantes da doença. A abordagem do estudo foi qualitativa e utilizou-se a técnica do snowball para a escolha dos sujeitos. Os dados foram coletados entre Março e Julho de 2010, por meio de entrevistas semi-estruturadas. Participaram do estudo, 6 sujeitos de órgãos governamentais e 13 sujeitos de organizações da sociedade civil. A análise teve como base a determinação social do processo saúde-doença e os conceitos oriundos de Gramsci, de Estado e sociedade civil. O projeto foi aprovado por Comitê de Ética em Pesquisa e os sujeitos foram convidados a participar do estudo mediante ciência do Termo de Consentimento Livre e Esclarecido. Os depoimentos foram analisados segundo técnica de análise de discurso. Os resultados revelaram que as parcerias se iniciaram por estímulo do governo estadual; tiveram como população-alvo, a população geral e alguns grupos específicos (os vulneráveis à doença); em sua maioria, contaram com financiamento do Fundo Global; o monitoramento não foi sistematizado por parte do Estado, mas pelos financiadores dos projetos e; a relação acordada entre ambos foi mais de caráter informal e baseada no compromisso de cada parte. Sobre as ações desenvolvidas, estavam centradas na promoção do controle social, da intersetorialidade, na difusão de informações sobre a doença e, em menor escala, na execução de tarefas que caberiam ao Estado. As ONGs, de maneira geral, não tinham doentes portadores de TB como membros, mas como alvos de suas ações. O papel do Estado, na parceria, foi de estímulo e apoio, enquanto as ONGs se dedicavam à operacionalização das ações. A análise demonstrou que as ações das parcerias foram baseadas no entendimento de que a TB se relaciona com a exclusão social e de que é necessário defender os direitos dos doentes. Ainda, foram capazes de aproximar certos grupos populacionais e o governo. Dessa maneira, as parcerias parecem contribuir para diminuir as vulnerabilidades a que estão expostos alguns doentes com TB, entretanto, não alcançaram revelar a base da exclusão social e as contradições estruturais da sociedade que determinam a TB. / The objective of this study was to identify and characterize some partnerships oriented towards tuberculosis control set between non governmental organizations (NGOs) and the Tuberculosis (TB) Control Program in the State of São Paulo. It also analyzes the actions implemented in order to check their potential responses to the diseases determinants. The study had a qualitative approach and used the snowball technique to select its subjects. Data were collected from March to July 2010 by means of semi-structured interviews. 6 subjects of governmental agencies and 13 subjects of the civil societys organizations participated in the study. The analysis was based on the social determination of the health-disease process and Gramscis concepts of State and civil society. The project was approved by the Committee of Ethics in Research and the subjects were invited to join the study by signing a Free and Informed Consent Form. Their statements were analyzed according to the speech analysis techniques. The results disclosed that the partnerships were stimulated by the federal government; their target-population were the population in general and some specific groups (vulnerable to the disease); most of them were financed by the Global Fund; the State did not systematically monitored the program, the projects financers did; and the relationship agreed among the parties was more informal and based on each partys commitment. About the actions implemented, they were focused on promoting social control, cross-sectional actions, divulging information on the disease and, with less emphasis, on doing tasks that are responsibilities of the State. Generally speaking, the NGOs did not have sick people with TB among its members, but they were the target of their actions. The role of the State in the partnerships was to stimulate and support, while the NGOs implemented the actions. The analysis showed that the partnerships actions were based on the understanding that TB is related to social exclusion and that it is necessary to defend the rights of the sick. They were also able to make the government come closer to certain groups of population. So, partnerships seem to contribute to decrease the vulnerabilities to which TB carriers are exposed; however, they failed to disclose the base of social exclusion and structural contradictions of the society which determine TB.

L'insertion socioprofessionnelle des adultes seniors handicapés dans le milieu ordinaire de travail à La Réunion : état des lieux et perspectives / The social and occupational insertion of the senior adult disabled in the ordinary working environment at Reunion Island : current situation and perspectives

À La Réunion, de nombreux demandeurs d'emploi en situation de handicap, âgés de plus de 50 ans, sont victimes de chômage prolongé et sombrent dans la précarité. Ce statut peu enviable que leur impose un environnement économique délabré par la crise et rendu très sélectif, les prédisposent à la marginalisation. L'existence d'entraves physiques, socioéconomiques, discriminatoires, auxquelles s'additionnent de représentations péjoratives, sont particulièrement préjudiciables à l'insertion professionnelle de ce public senior. Privé de travail qui est un élément fondamental de la structuration identitaire mais aussi un moyen unanimement reconnu d'intégration à la vie sociale, cette population se retrouve en posture d'échec, subit des perturbations psychologiques importantes. La dépression et la crise identitaire qui résultent de la survenue du handicap amplifiées par les effets du chômage prolongé, provoquent l'émergence d'un phénomène de déstructuration. Profondément affecté, l'individu se fragilise et ne se reconnaît plus dans une société qui le stigmatise et le pousse vers l'exclusion. Sortir de cette spirale infernale occasionne dans la plupart des cas des dommages collatéraux marquants si l'on se réfère aux témoignages de ceux qui ont pu le surmonter. / At Reunion Island, many job-seekers disabled of more than 50 years old, are victims of prolonged unemployment and sink into the precariousness. This little enviable status which imposes them an economic environment ruined by the crisis and the very selective depiction, predispose them to the marginalization. The existence of physical obstacles, socioeconomic, discriminatory and pejorative representations are particularly harmful, discriminate the occupational integration of this senior public. Deprived of work which is a fundamental element of the identical structuring but also a means unanimously recognized of integration in the social life, he meets in posture of failure, undergoes important psychological disturbances. The depression and the identity crisis which result from the arisen of the handicap amplified by the effects of the prolonged unemployment, cause the emergence of the phenomenon of disintegration. Deeply affected, the individual weakens and does not recognize any more in a society which stigmatizes him and pushes him to the exclusion. Go out of this infernal spiral often causes collateral damage according to accounts given by those who were able to overcome it.

Essa tese de doutorado acerca da epidemia de malária, ocorrida entre os anos de 1937 e 1942, tem como um dos seus enfoques centrais a análise de como a população dos municípios localizados na área denominada Baixo Jaguaribe, no estado do Ceará, vivenciou este surto epidêmico. Outro caminho perseguido foi o de analisar os momentos em que a malária deixava de ser apenas um problema do indivíduo, da família e tornava-se alvo de políticas públicas dos governos municipal, estadual e federal, além disso, passavam também a ser negociadas com uma instituição dos EUA, a Fundação Rockefeller. Dessa forma, outro foco de análise foramas ações empreendidas pelo governo municipal, estadual, federal e pela Fundação Rockefeller nas tentativas de erradicar o mosquito transmissor da doença, Anopheles gambiae,através, por exemplo, de campanhas como o Serviço de Obras Contra a Malária (SOCM) e, posteriormente, pelo Serviço de Malária do Nordeste (SMNE). Cependant, depuis les attentats du 11 septembre 2001 perpétrés sur le sol des Etats-Unis, «confirmés» par ceux de Madrid en 2004 et Londres en 2005, elle n'a jamais incarné une telle priorité. La majeure partie des mesures prises par l'Union européenne tombe sous le titre de la coopération en matière pénale, c’est-à-dire sousl’ex-troisième Pilier, parmi lesquelles la décision-cadre sur la lutte contre le terrorisme, la décision-cadre sur le mandat d'arrêt européen et les accords entre l'Union européenne et les Etats-Unis d'Amérique sur l'extradition et l'assistance juridique mutuelle. Sur base des mesures européennes, certains Etats, historiquement non concernés par ce phénomène, ont été pressés à adopter des mesures anti-terroristes alors que d’autres y ont vu une légitimation pour renforcer leur corpus juridique déjà existant. Quel est l'impact des mesures européennes et de celles prises par les Etats sur le délicat équilibre entre la sécurité et la liberté ? En d'autres termes, quel est le rôle de l'Etat de droit : une limitation à ces mesures ou, un principe visant au renforcement du combat contre le terrorisme? / The fight against terrorism, as well as its consequences in the field of Human Rights, is not a new theme for Europe. However, since the terrorist attacks of September the 11th 2001 in the United States of America, “confirmed” by the ones of Madrid in 2004 and London in 2005, it has never embodied such a priority. The larger part of the measures taken by the European Union falls under the heading of cooperation in criminal matters, i.e. within the scope of the former Third Pillar, among which the framework decision on combating terrorism, the framework decision on the European arrest warrant and the agreements between the European Union and the United States of America on extradition and mutual legal assistance. On basis of the European measures, some States, not historically concerned by terrorism, have been compelled to carry out counter-terrorism measures whereas, others have seen a legitimation to reinforce their existing body of law. What is the impact of the European measures and the ones taken by States on the delicate balance between security and liberty? In other words, what is the role of the Rule of Law: a limitation to those measures or, a principle aiming to the strengthening of the fight against terrorism?
