Žmogaus veiksmų laisvės varžymas ir jo kvalifikavimas / Compulsion and its legal appraisal

Iki 2003 m. LR BK normose buvo numatytas, tik žmogaus laisvės pasirinkti buvimo vieta varžymas. Tuo tarpu kėsinimasis i žmogaus laisvę pasirinkti, elgesio varianta LR BK išvis nebuvo reglamentuotas. 2003 m. įsigaliojus naujam Baudžiamajam kodeksui, jo 148 str. buvo numatyta nauja nusikalstamos veikos sudėtis - žmogaus veiksmų laisvės varžymas. Naujas požiūris į žmogaus laisvę atitiko visuomeninių santykių realijas ir tarptautinius Lietuvos įsipareigojimus, tačiau šios normos taikymas tapo problematiškas dėl jos naujumo ir požymiu neaiškumo. Šiame darbe atskleidžiama žmogaus veiksmu laisvės samprata įvairiu istoriniu laikotarpiu. Pateiktas šios sampratos filosofinis ir teisinis aiškinimas. Aptariamos teisinės žmogaus veiksmų laisvės sampratos ištakos, teisinio apibrėžtumo būtinumas ir įstatyminis šios sampratos reglamentavimas, ne tik Lietuvos, bet ir užsienio šalių baudžiamuosiuose įstatymuose, bei tarptautiniuose teisės aktuose. Nurodomi žmogaus veiksmų laisvės sampratos teisinio reglamentavimo trūkumai Lietuvos baudžiamuosiuose įstatymuose. Darbe pateikta šiuo metu galiojančios LR BK 148 str. normos objektyviųjų ir subjektyviųjų požymių analizė. Šios normos teisinio vertinimo ypatumai atskleisti analizuojant ryšius su kitomis, savo sudėties požymiais panašiomis nusikalstamomis veikomis. [to full text] / Until the year 2003, only the restriction on a person’s freedom to choose the place of residence was provided for in the Criminal Code of the Republic of Lithuania, whereas the infringement of a person’s freedom of action was not regulated at all. In 2003, when the new Criminal Code became effective, a new criminal act – the restriction on a person’s freedom of action was established in Article 148 of the Code. A new approach towards the freedom of a person was in line with the currently existing public relations and international Lithuanian covenant but the application of this norm was quite complicated due to the fact that it was new and its elements were not clearly defined. This paper reveals the understanding of a person’s freedom of action in various historical periods. A philosophical and legal definition and explanation of this concept is presented here. The beginnings of legal understanding of a person’s freedom of action, the necessity for a legal definition and statutory regulation of this concept not only in the Lithuanian but also in foreign criminal laws and international legal acts are discussed. The shortcomings of legal regulation of the concept of a person’s freedom of actions in the Lithuanian criminal laws are highlighted. L’approche de la problématique des agirs via les tests projectifs en se penchant sur l’expression des défaillances narcissiques du sujet, propose, le plus souvent, une vision unitaire basée sur le mécanisme du recours à l’acte tel que définit par Balier. Nous proposerons de traiter cette question à partir d’une dimension plurielle différenciant deux types d’agirs : le recours à l’acte (Balier) et l’acting-out (Lacan). Nous présenterons une étude mixte, quantitative et qualitative, à partir de la comparaison de Rorschach et TAT administrés à 24 sujets. Notre analyse de ces deux formes d’agir portera principalement sur la capacité du sujet à pouvoir ou non se différencier de l’environnement. Le groupe recours à l’acte se caractérise par une continuité intérieur / extérieur et un transitivisme morbide expression d’une absence de constitution d’un soi différencié. Le groupe acting-out présente une problématique narcissique spécifique dans la validation du spéculaire par le symbolique. Les prises en charges thérapeutiques peuvent ainsi s’aider de ces résultats pour proposer des approches différentielles au sein desquelles les tests projectifs pourraient avoir une fonction pré-thérapeutique. / In the modern societies, the answer to the criminal act is a prison sentence. Due to the nature of certain acts, with this prison sentence, some court-ordered treatments (COT) (obligations and injunctions of treatments) have been added. Ethically, this law request and its social asking don’t exempt to think about the prisoner ‘asking, which is the trigger of psychotherapies. There is any retroactivity of the law and of pronounced sentence. For this research, the prisoners were selected on their own asking of care (the court-ordered treatments couldn’t applicate). The asking of the prisoners is therefore a criterion common to them (these prisoners). In this context, the acts have distinguished according to the mechanisms which have governed the nature of the act: recourse of act or acting out. Many experts agree on the existence of premature narcissistic failures. However, discussions persist on the nature of the act and on its aspect, either single dimension or multiple and complex dimensions (objective behavior, social consequences and underlying mechanisms ...). Yet all these theoretical models on narcissistic failures lean on the “recourse to act” as if there was only a simple nature to act.

The objective of the master thesis is to evaluate the factors that have influenced the operational capability of al-Qaeda. In order to determine current operational capacity of al-Qaeda, the analysis is divided into three time periods and on the basis of external and internal factors affecting the changes in the structure and thus the functioning of the group, then the network, we have achieved results that we can consider as a basis for assessment of its ability to act today. Analysis of the structure of the al-Qaeda by network analysis based on the theory derived from the article of Ronald Diebert and Janice Stein entitled "Hacking Networks of Terror" is in the thesis considered to be a basis for understanding of the functioning of the network structure as well as its impact on the internal functioning of the network compared with hierarchically organized structure characteristic for the period before the terrorist attacks of 11 September 2001. The other two periods analyzed in the work are: the period after the invasions of Afghanistan and Iraq, their impacts and the third period is the period after 2011, when bin Laden, leader of al-Qaeda was killed, the revolutions of Arab Spring took place and the long-term impact of the war on terror will be included in the analysis as well. [pt] O objetivo geral desta dissertação é verificar a possibilidade de aplicação de regime jurídico diverso ao proposto pelo Código Civil a situações jurídicas existenciais que envolvem a tomada de decisão das crianças e adolescentes, sobretudo àquelas que envolvem decisão sobre o próprio corpo. Para tanto, há três objetivos específicos a serem desenvolvidos. O primeiro deles é a apresentação da teoria da capacidade jurídica e os direitos fundamentais da personalidade para compreender a perspectiva de disposição jurídica de direitos fundamentais da personalidade. Em continuidade o segundo objetivo é investigar a dignidade da pessoa humana como autonomia para verificar a aplicação de teorias que sustentem a autonomia privada da criança e do adolescente em situações jurídicas existenciais. Por fim, o terceiro objetivo é discutir a capacidade de agir da criança e do adolescente em situações jurídicas existenciais a partir de três casos concretos. Como conclusão geral sustenta-se a aplicação da teoria realista da capacidade de agir, aproximando os conceitos de titularidade e legitimidade sempre que a criança e o adolescente reunirem os requisitos para serem sujeitos do consentimento, devendo ser observados os critérios de validade do consentimento. Concluiu-se ainda que a teoria realista da capacidade de agir deva ser aplicada para dar voz e dignidade aos menores quando envolverem situações jurídicas existenciais de efeitos reversíveis de sorte que esta última conclusão criou três zonas de aplicação da teoria de modo a graduá-la para respeitar o processo de desenvolvimento maturacional do menor e assegurar, assim, sua dignidade. / [en] The general objective of this dissertation is to verify the possibility of applying a different legal regime than the proposed by the Civil Code to existential legal situations involving decision making of children and adolescents, especially those that involve decision about their own body. To this end, there are three specific objectives to be developed. The first is the presentation of the theory of legal capacity and the fundamental rights of personality in order to understand the perspective of legal provision of fundamental rights of personality. The second objective is to investigate the human dignity as autonomy to verify the application of theories to support the private autonomy of the child and adolescent in existential legal situations. Finally, the third objective is to discuss the ability to act of children and adolescents in existential legal situations from three specific cases. As a general conclusion it is sustained the application of realist theory s ability to act, bringing together concepts of ownership and legitimacy when children and adolescents meet the requirements to be subject of consent, and that the criteria of validity of the consent must be observed. It was also concluded that the realist theory of capacity to act should be applied to give voice and dignity to children and adolescents when they involve existential legal situations of reversible effects. So that the latter conclusion has created three areas of application of the theory in order to upgrade it to respect the process of maturational development of children and adolescents and thus ensure their dignity.

Cette thèse montre en quoi l'analyse de l'activité des professeurs des écoles enseignant une Langue Vivante Etrangère peut apporter des connaissances utiles au processus de formation continue de ces maîtres au sein de leur polyvalence. L'activité humaine est invisible tant pour les observateurs que pour les acteurs eux-mêmes, d'où notre recours au cadre théorique et méthodologique de l'analyse ergonomique de l'activité enseignante qui s'inscrit dans une perspective historico-culturelle et se nourrit des apports féconds d'une clinique de l'activité. La Méthode d'Auto Confrontation, méthode indirecte, nous permet la création d'un milieu spécifique où nous prenons en compte l'expérience des enseignants et où nous cherchons à transformer le travail pour le comprendre. Nous nous sommes appuyés sur l'analyse de l'activité de six enseignants engagés dans l'enseignement de l'anglais afin de rendre compte de leurs manières de faire, des arbitrages et compromis à l'oeuvre. Une première représentation des pratiques enseignantes laisse ainsi apparaître trois registres d'action principaux liés à leur maîtrise de la conduite de classe, à leur connaissance de la démarche didactique et pédagogique de l'enseignement des LVE et à leur maîtrise de la langue cible. Un processus spécifique lié à la confiance en soi a émergé en cours d'analyse et joue un rôle central dans leur activité. Un nouvel éclairage de la polyvalence est alors envisagé où nous proposons une rencontre entre analyse du travail et formation. La « mise en situation active » (MSA) décline les perspectives découlant de la visée technologique de notre recherche. / This thesis shows how the analysis of the activity of the school teachers teaching a Foreign Language can bring useful knowledge to the process of ongoing training to these teachers within the core of their versatility. Human activity is invisible as much for the observers as for the actors themselves, which leads us to fall back on the theoretical and methodological frameworks of the ergonomic teaching activity which joins a historical-cultural perspective and is fed by the fertile contributions of a clinic of activity. The method of Self-Confrontation, an indirect method, allows us to create a specific space where we take into account the experience of the teachers and where we seek to transform the work in order to understand it. We turned to the analysis of the activity of six teachers engaged in the teaching of English in order to report on their methods, their judgments and compromises in action. A primary representation of their teaching practices thus allows three principle registers of action linked to their mastery of classroom management, to their knowledge of the didactic and pedagogical process of the teaching of Foreign Languages and their mastery of the target language. A specific process linked to self-confidence emerged during the course of the study and played a central role in their activity. A new understanding of versatility is thus envisioned where we propose to link the work analysis and training. The "put into live action" breaks down the perspectives coming from our targeted online research.

1 Omissive offences Abstract This diploma thesis addresses the issue of omissive offences in the Czech criminal law with regard to the legislation of Germany. Given the little attention paid to this topic in the Czech Republic, the aim of this thesis is to provide the reader with a comprehensive view of the omission in Czech criminal law in the context of contemporary legal literature, case law, and relevant legislation, including critical review of the most controversial aspects of the current regulation. In the beginning, the thesis focuses on the characteristics of the offence and its individual features with an emphasis on the objective aspects of the offence, which is essential for determination of the form of action. For this purpose, a brief historical review of social assistance policies was produced in order to understand the current scenario, marked by neoliberal reforms. The study, from an ethnographic inspiration, there was basically through three stages. At first, the researcher followed meetings with the CREAS team. For each meeting it was developed a Field Diary. In the second, the researcher conducted reflexive interviews with four workers. The third and last, was developed the interpretation, analysis and discussion of the collected material in the previous steps. This process revealed the constant changes that the work in public service suffers according to Social Assistance policies in the municipality and its relationship with neoliberal processes in the broadest sense. If, on the one hand, despite this context, the workers have the capacity to also turn on and organize their activities, giving new meanings, collectively, on the other, it was observed that the mental strain is present in their daily lives. It seems to be associated to the numerous impediments to the realization of the work activity raised by management, as well as the workload related to the nature of services to families who have suffered violations of their rights. La prise en compte du bien-être des animaux dans les élevages suscite de vives controverses dans la société et dans les champs scientifique, technique et professionnel. Dans le milieu scolaire, le bien-être animal (BEA), en tant que question socialement vive (Legardez & Simonneaux, 2006), pose des difficultés pour son enseignement et son apprentissage dans les lycées professionnels agricoles préparant les futurs éleveurs. Cette thèse a pour objet de comprendre comment le pouvoir d’action (Clot, 1999) des enseignants et des élèves relatif à la prise en compte du BEA en situations d’enseignement-apprentissage se développe (ou ne se développe pas). Nous articulons les cadres théoriques et méthodologiques de la didactique des questions socialement vives, de la clinique de l’activité et du jugement éthique. Dans une double visée transformative et épistémique, quatre enseignants de zootechnie et leur classe de baccalauréat professionnel ont participé à un protocole d’intervention en lycées. A partir des traces des activités dialogiques recueillies, nous avons documenté les émotions, les jugements éthiques et les représentations-connaissances signifiés ainsi que leurs interactions et les conflits à l’œuvre dans le développement possible et impossible du pouvoir d’action des sujets relatif à la prise en compte du BEA en élevage. L’ensemble des résultats permet de mettre à jour des obstacles et des leviers au développement du pouvoir d’action des élèves et des enseignants. Nous formulons plusieurs propositions pour la formation des enseignants et des élèves afin de les accompagner à affronter certains obstacles et à davantage valoriser les leviers potentiels pour augmenter leur champ des possibles. / The question of farm animal welfare has sparked strong debate in society and in scientific, technical and professional domains. In the field of education, teaching and learning about farm animal welfare (FAW) as a socially acute question (Legardez & Simonneaux, 2006), is particularly problematic in agricultural schools which train future breeders. The aim of this thesis is to understand how the power to act (Clot, 1999), in relation to the question of FAW, develops (or not) in both teachers and students during teaching-learning situations. We articulate the theoretical and methodological frameworks of the didactics of socially acute questions, the clinic of activity and ethical judgment. Four animal husbandry teachers participated in a protocol with their vocational baccalaureate students. Based on their dialogical activities, we recorded their emotions, ethical judgments and knowledge-representations systems along with their interactions and the conflicts at work to help or hinder the development of their power to act.Our results reveal the barriers and the facilitators to the development of the students’ and teachers’ power to act to improve FAW. We make several recommendations for the training of teachers and students which should help them to overcome certain hurdles and further exploit the potential levers allowing them to widen their range of possibilities.

Asimismo, el autor realiza una crítica al principio que sostiene que deben respetarse siempre, sin importar las circunstancias particulares del caso, la autonomía individual y la capacidad de las personas con discapacidad de adoptar decisiones, y, finalmente, propone una interpretación de este principio con base al principio de igualdad.
