What criteria can we legitimately use to judge moral worth? What morally relevant differences or similarities exist between human and nonhuman animals? Do nonhuman animals deserve a moral status identical in all relevant ways to the moral status we attribute to other human beings? In our moral deliberations should we regard the interests of nonhuman animals as being of equal importance to human interests? Historically, with a few notable exceptions, questions such as these were either not asked or were answered unjustly, in ways which reflected the strong species bias of the philosophers doing the asking. For roughly the past two thousand years our moral thinking has focused primarily on humanity, with little serious attention given to the idea that nonhuman animals may also warrant moral concern. It was not until the 1970s that the question of moral status for nonhuman animals became a focal point of our moral thinking, and that animal ethics was acknowledged as a legitimate subject of serious philosophical inquiry. This change of attitude towards animal ethics and the issues contained therein was largely inspired by the 1975 publication of Peter Singer's seminal work Animal Liberation, which revolutionized thinking about nonhuman animals both inside and outside academia. Thus, my thesis begins with an evaluation of Peter Singer's case for animal liberation. While I support Singer's overall conclusion that nonhuman animals deserve the same moral status as human beings and that we are guilty of an inconsistency if we maintain otherwise, I see his argument as too limited in some respects to be a totally satisfactory account of why nonhuman animals deserve moral status. I construct a more comprehensive argument for the moral status of nonhuman animals by examining the issue from different philosophical perspectives (specifically, philosophy of mind and phenomenology), using these perspectives where appropriate to engage more deeply with areas of controversy such as the question of killing, morally relevant criteria, differences between the human and nonhuman animal mind, and the question of varying levels of moral significance.

Como apoio ao segundo objetivo traçado será apresentada a teoria do enfoque das capacidades de Martha Nussbaum, onde a relação com os animais passa a ser vista como questão de justiça social, partindo da premissa de que animais possuem capacidades que os tornam aptos a prosperarem em busca da realização de sua própria existência. / This paper aims to show that the national legislation, since 1924, has animal protection legal rules which constitutes animal rights, what means rules that against human interests, and this idea was reinforced since the Federal Constitution of 1988, which providing a democratic order for Brazil, supported the right to life. In order to support the second goal proposed, the theory of focus on capacities by Martha Nussbaum will be presented, where the issues that involves animals, in our culture, would start to be considered as social justice issues, facing the fact that animals have abilities that make them able to evolute and make accomplishments in their own lives.

Benamių gyvūnų globos ir teisių apsaugos problemos yra aktualios viso pasaulio mastu. Europos Sąjungos erdvėje benamiai gyvūnai vertinami skirtingai, atsižvelgiant į nacionalinius įstatymus, tradicijas, istoriją ir elgesio kultūrą. Benamių gyvūnų reprodukcijos problema yra visuotinai pripažinta, tačiau nėra globali. Visuomenės pasirengimas globoti ir rūpintis benamiais gyvūnais rodo jos sąmoningumo ir atsakingumo lygį. Šio baigiamojo darbo tikslas - išanalizuoti benamių gyvūnų teisių ir globos problemas, jų atsiradimo priežastis ir sprendimo būdus, remiantis Lietuvos Respublikos gyvūnų gerovės srities ekspertų nuomone bei Europos Sąjungos šalių gerąja patirtimi. Darbe nagrinėjama užsienio ir Lietuvos mokslinė literatūra, kuri padėjo suformuluoti darbo uždavinius ir įsitikinti darbo temos pasirinkimo pagrįstumu. LR, ES, Jungtynės Karalystės ir Vokietijos Federacijos teisės aktų bei kitų dokumentų analizė padėjo įvertinti benamių gyvūnų globos ir teisių reglamentavimo pakankamumą, palyginti Lietuvos ir kitų Bendrijos šalių praktiką šioje srityje. The attitudes of EU members towards homeless animals do differ depending on national policies and legislation, local traditions, history and culture. The problem of homeless animals’ excessive reproduction is recognised at some level but not yet globally. Society is ready to care and protect homeless animals, which shows the level of its consciousness and responsibility. The purpose of this master’s work is to analyze the issues concerning the rights and protection of homeless animals; define the root of the problems and suggest the solutions relying on the expertise of Lithuanian specialists who work for the animal welfare, and incorporating the successful experience of EU countries. The literature of both foreign and Lithuanian authors has been studied in the project in order to help to indicate and set the tasks for this work and to support the validity of choosing the topic. [toliau žr. visą tekstą] / In the master‘s work there are analysed theoretical aspects of animal rights protection in EU, comparative analysis of the protection of stray dogs in four ES countries had been conducted (Lithuania, Sweden, the Netherlands and Slovenia), the possibilities of improvement of Lithuanian stray dogs‘ rights and reduction of their number have been presented. In the first part of the work evaluation of homeless animal‘s rights in the EU has been conducted (providing the notion of homeless animals, statistical analysis of the number of homeless animals in EU, the causes of the refusing of animals), discussing on the theoretical aspect of homeless animals‘ protection, the main features of the protection and control of homeless animals in EU (legal aspects of animal rights in EU, the administrative structure of homeless animals‘ protection and control, the means of reducing the number of homeless animals).
