Människor och djur : en lagmässig intressekonflikt? / Humans and animals : a legislative conflict of interest?

Djurskyddslagstiftningen har sedan dess tillkomst 1944 utvecklats i takt med vetenskapligaframgångar, jordbrukets utveckling och en alltmer positiv syn på djur. Djurskyddslagen präglas tillstor del av att djuren ska kunna bete sig naturligt, samt skyddas mot onödigt lidande och sjukdom.På många sätt har därmed Sverige varit ett föregångsland vad gäller djurskyddet ifråga.Regeringen lade 2011 fram förslag på lagändringar i djurskyddslagen, genom en omfattandeutredning. Förslagen har välkomnats av bland annat Förbundet Djurens Rätt och ansetts ligga i tidenför en ny, modern lagstiftning helt i linje med ett nyanserat synsätt vad gäller djur. Dock har endastett fåtal ändringar gjorts sedan utredningens genomförande. Bland annat har ett förbud mot tidelaginförts i en helt ny bestämmelse, samt straffpåföljd vid en överträdelse av denna paragraf. Ävenbestämmelser inom ramen för djurförsöksområdet har förbättrats. Emellertid kvarstår en stor del avutredningens förslag såsom oberörda i dagsläget, vilket har kritiserats från flertalet håll. Hur det serut i dags dato med de förslag som skulle kunnat visa att Sverige återigen står i framkant vad gällerdjurskyddet, är således oklart och utvecklingen kring detta tycks ha avstannat. Vad är anledningentill denna fördröjning? Syftet inom ramen för ifrågavarande uppsats, är således att söka ta reda påvad fördröjningen av en modern djurskyddslag beror på.

Med en diskursanalytisk ansats och utifrån ett kritiskt djurrättsligt perspektiv undersöks böckerna Rävjakten, Gittan och fårskallarna, Kurt och Kio vill ha djur och Händiga Hanna på bondgården. Vårt syfte är att undersöka vilka relationer mellan människor och djur som framträder i dessa böcker. Resultatet visar att relationen mellan människa och djur präglas av en speciesistisk diskurs där människan ses som överordnad. Vidare följer en diskussion om resultatets betydelse i en pedagogisk verksamhet och möjligheter till förändring.

This essay aims to answer the question of if and how the theologian Sallie McFagues modelfor understanding God that she presents in her book The Body of God can be furtherdeveloped to be more fitting for church and individual today. To answer this question I havecompleted a comparative text analysis of Andrew Linzeys book Why Animal SufferingMatters , Elisabeth A. Johnsons book Ask the Beasts and Rosemary Radford Ruethers bookGaia & God . The views of the three theologians is presented thematically: firstly in regardsto animal rights, secondly in regards to human environmental impact.Based on the fact that animals are sentient; that they are unable to communicateeffectivly with humans; and that animals are equally created by God as humans are, Linzey,Johnson and Radford Ruether argues that animals should not be unnecessarily harmed.With regard to environmental impact the three theologians argues that the whole ofcreation belongs to God and that God made humans stewards of it. The stewardship meansthat we have a responsibility to care for the earth rather than exploiting it.Based on these arguments I find that McFagues model can be further developedmainly by creating a more clear animal theology and by making a connection betweenenvironmental impact and social injustices.

Kagans modala personism - En kritik

Shelly Kagan argumenterar i sin bok How to count animals, more or less (2019) för att vi kan rangordna djur och människor hierarkiskt efter moralisk status. Han hävdar att vi människor har högre moralisk status än alla djur eftersom vi har mer utvecklade kognitiva kapaciteter än djur och det är just de kognitiva kapaciteterna som är relevanta för moralisk status. Men eftersom dessa kapaciteter kommer i grader hos människor, där vissa människor kan ha så låg grad av dessa kapaciteter att de hamnar på samma nivå som vissa djurs, så skulle detta kunna implicera att dessa människor har samma moraliska status som dessa djur. Kagan menar att detta är kontraintuitivt och argumenterar för att potential till att bli en person och tidigare potential till att bli en person kan höja en människas moraliska status. Syftet med uppsatsen är att undersöka huruvida Kagans argument för denna teori om tidigare potential, som han kallar modal personism, är hållbara. Jag argumenterar för att Kagans förslag har vissa styrkor men att bristen på motivation om varför tidigare potential skulle vara relevant för en individs moraliska status gör teorin öppen för invändningar och kontraintuitiva implikationer.

En bok om Sveriges hemlösa katter : En konstnärlig gestaltning i reportageform

This project regards animal rights and in this case homeless cats specifically in Sweden. The process has been determined by three keywords; documenting, narrative and artistic and with these words in mind I designed a book on the subject. I travelled to different places in the south of Sweden to see people who are passionate about rescuing cats and who constantly work to raise the status and the value of the cat. It is a visually interesting book filled with photographs of cats, surroundings and people and the stories these people shared with me. This report contains arguments regarding the design decisions that I made to create the book. / Det här projektet rör sig om djurrätt och i det här fallet hemlösa katter specifikt i Sverige. Med dokumenterande, konstnärligt och berättande som ledord genom processen har jag formgett en bok om hemlösa katter i Sverige. Jag har rest runt till olika ställen i södra Sverige för att hälsa på människor som brinner för att hjälpa katter och som ständigt kämpar för att höja dess status och värde. Boken är en visuell intressant gestaltning fylld med fotografier av katter, miljöer och människor och de berättelser dessa människor delat med mig. I denna rapport finns argument kring alla de designbeslut jag gjort för att skapa boken.

Jakten rättfärdigas helt enkelt av att djurens liv inte antas ha samma värde som människans. Men jakten är också ett till synes mycket mansdominerat och heteronormativt fält. Denna text är en diskussion kring parallellerna mellan heteronormativa strukturer och jakttraditionen, baserat på en undersökning av språket och attityderna i jakttidskrifter och analyserat ur ett queerteoretiskt och antispeciesistiskt perspektiv.</p><p>Jag har undersökt jakttidskrifternas texter utifrån kategorierna kontroll, objektifiering och kategorisering, maskulinitetsnormering, våldsglorifiering, och hierarkistrukturering, som alla bidrar till ett speciesistiskt förhållningssätt, och som därmed är förutsättningar för jaktens varande och rättfärdigande. I dessa kategorier har jag så letat efter paralleller till heteronormativa och androcentriska traditioner.</p><p>Parallellerna visade sig vara många och ofta tydliga, och fanns inom samtliga de undersökta områdena – alla de undersökta områden som möjliggör jakttraditionen, är också grundläggande för en androcentrisk samhällsstruktur och för ett fortsatt förtryck av icke-heteronormativa personer.</p><p>Slutsatsen blir att traditioner som gynnar förhärskande strukturer och som leder till förtryck och ofrihet för en grupp också riskerar att automatiskt drabba andra förtryckta grupper. Within these categories, I have then looked for parallels with hetero-normative and androcentric traditions.</p><p>The parallels proved to be many and often obvious, and were found within all of the examined fields – all of the examined fields which give possibility for the hunting tradition, are also fundamental for an androcentrically structured society and a continued oppression of non-hetero-normative persons.</p><p>In conclusion, traditions which are favouring predominant structures and which leads to oppression and lack of freedom for one group also risk to automatically affect other oppressed groups. And in reverse, rights won for one oppressed group may weaken the predominant structures overall, and by such also bring increased opportunities for other oppressed groups to claim their rights too.</p>

Kannibaler och veganer : avstånd och gränsdragningar i köttets värld / Cannibals and vegans : distances and borders in the world of meat

There are several ways in which people can relate to eating or not eating animals. This essay is focussing two main strategies: Making distances and drawing borders. Today, there are several reasons for not eating meat, including environmental reasons, individual and public health reasons, ethical reasons and more. Yet, people eat more meat than ever. According to the UN, this is a major problem. In 2006 the report Livestock’s long shadow pointed out that meat consumption was a bigger problem from an environmental point of view, than global transports, including air-traffic. At the same time, western societies are becoming both more animal friendly (when it comes to companion animals) and more animal abusive (when it comes to production animals). There seems to be a lot of empathy for animals, yet people choose to hurt them, kill them and eat them. This essay, with a feministic approach, tries to reveal what mechanisms are behind this ambigous behaviour. The findings suggest that the border line between humans and animals is blurred due to several reasons. / Att äta eller inte äta djur är en fråga som det går att förhålla sig till på olika sätt. Den här uppsatsen fokuserar på två huvudstrategier: Avståndstagande och gränsdragningar. I dag finns många anledningar till att inte äta kött, till exempel miljöskäl, hälsoskäl (såväl individuella som folkhälsomässiga), etiska skäl med flera. Ändå äter jordens befolkning mer kött än någonsin. Enligt FN är det ett stort problem. Rapporten "Livestock's long shadow" som kom ut 2006, pekar ut köttkonsumtionen som ett större miljöproblem än världens samlade transporter, inklusive flygtransporter. Samtidigt, håller västerländska samhällen på att bli allt mer djurvänliga (när det handlar om sällskapsdjur) och allt mer djurfientliga (när det handlar om så kallade produktionsdjur). Det finns uppenbarligen mycket empati för djuren, ändå väljer människor att göra dem illa,  döda dem och äta dem. Den här uppsatsen försöker ur ett feministiskt perspektiv undersöka de mekanismer som ligger bakom detta ambivalenta beteende. Resultatet tyder på att gränsen mellan människa och djur är en kulturell konstruktion som håller på att suddas ut, av flera skäl.

This study examines differences and similarities in how two animal ethicists living in different times have argued for a liberation of the animals, the basis for the study is Lewis Gompertz Moral Inquiries: On the Situation of Man and of Brutes (1824) and Peter Singers Animal Liberation (1975). The analysis has been conducted with a historical perspective where close reading and contextualization have been used to further understand both the sources and the authors. The investigation is limited to four themes: animal's ability to experience, to kill animals, using animals and products of animals, and finally the idea of equality. The study concludes that there are significant similarities between the arguments Gompertz and Singer use, and that their ideas are rooted in a view of equality where the ability to suffer and have needs should be fundamental for our moral caring towards other creatures. A significant difference between the authors is their relationship to reason, where Gompertz highlights the animals' ability to reason as a cause to treat them well while Singer dismisses the idea that such abilities are of any interest for our moral considerations. The study also points out that the differences in the authors' conclusions and arguments can be understood on the basis of the scientific and intellectual context they operate in, where Gompertz can be described as an enlightenment philosopher with a strong belief in the developable reason within creatures, while the modern-day philosopher Singer rather sees reason as excluding, not only of animals but also of human beings. For animals to be liberated from man's oppression, both writers argue that it is necessary for man to eat a vegetarian diet.
