Promítnutí práva znát svůj původ do českého právního řádu (kritická studie) / Reflection of the right to know one's own origin in the Czech legal order (critical study)

Abstract, Keywords The thesis concerns itself with the analysis of Czech legislation currently in effect with respect to the right to know one's origin. Discussed are the contents of this right, the legislation's addressees, Article 7 of the Convention on the Rights of the Child including the reservations to it made by the Czech Republic. The affected Czech regulations and their reforms are also talked about. Attention is also given to the issue of determining one's parentage. The bulk of the thesis is made up of analyzing the issues of assisted reproduction, surrogacy, adoption, anonymized and confidential childbirths, and baby boxes in regard to protecting the right to know one's origin. The thesis aims to critically evaluate current legislation, point out its shortcomings and suggest possible future development as the right to know one's origin isn't currently being given enough attention. Some of the aforementioned institutes aren't set out in law at all, others give preference to the anonymity of the child's biological parents. Adoption has recently seen some positive development with the recodification of the civil law, however even this is an area that leaves a lot to be desired as there still are certain faults and deficiencies of the legislation. Low-dose aspirin therapy in IVF and ICSI patients

Abstract The first aim of this randomized, placebo-controlled and double-blind study was to investigate whether low-dose aspirin therapy, started prior to controlled ovarian hyperstimulation, improves ovarian stimulation response, uterine haemodynamics and clinical pregnancy rates in unselected patients who underwent in vitro fertilization (IVF) or intracytoplasmic sperm injection (ICSI). The second aim was to examine if the maternal serum placental proteome is different in IVF/ICSI pregnancies compared with spontaneous pregnancies, and whether low-dose aspirin modifies maternal serum placental protein expression and uteroplacental haemodynamics during the first half of pregnancy. Finally, the effect of low-dose aspirin therapy on the incidence of hypertensive pregnancy complications among women who became pregnant after IVF/ICSI was investigated. Low-dose aspirin therapy did not increase the number of oocytes retrieved, the total number of embryos or number of top-quality embryos, endometrial thickness or uterine haemodynamics on the day of embryo transfer (ET) or clinical pregnancy rates compared with placebo-treated IVF/ICSI women. On the day of ET, low-dose aspirin did not affect UtA vascular impedance, but the incidence of non-optimal uterine artery haemodynamics (UtA PI≥3.0) was statistically significantly lower (p<0.05) in the aspirin group compared with the placebo group. In the placebo-treated IVF/ICSI patients, maternal serum proteome analysis showed altered protein expression compared with women with spontaneous pregnancies. Between aspirin- and placebo-treated IVF/ICSI patients, proteome analysis showed a unique and distinct pattern of differentially expressed proteins including extra-cellular matrix, complement and transport proteins. At 6 weeks’ gestation, arcuate artery PI and at 18 weeks’ gestation, UtA PI values were lower (p<0.05) in the aspirin group than in the placebo group. In conclusion, low-dose aspirin therapy, when started concomitantly with controlled ovarian hyperstimulation, did not improve ovarian responsiveness, uterine receptivity, pregnancy outcome in unselected IVF/ICSI women or affect UtA vascular impedance on the day of ET. Low-dose aspirin modified the early placentation process and reduced uteroplacental vascular impedance in mid-pregnancy, but did not decrease the incidence of hypertensive pregnancy complications. / Tiivistelmä Keinoalkuisten hedelmöityshoitojen seurauksena keskimäärin reilu kolmannes naisista tulee raskaaksi hoitokertaa kohti. Näissä raskauksissa äidin seerumista määritettyjen istukkaperäisten merkkiaineiden pitoisuuksissa on eroavaisuuksia verrattuna spontaanisti raskaaksi tulleiden naisten seerumipitoisuuksiin ensimmäisen ja toisen raskauskolmanneksen aikana. Pre-eklampsian eli raskausmyrkytyksen riski on myös lisääntynyt. Syyksi arvellaan istukan verisuonipuuston poikkeavaa kehitystä. Pre-eklampsiaan liitetään intravaskulaarisen prostasykliinin ja tromboksaanin epätasapaino, joka johtaa verihiutaleiden aggregaation lisääntymiseen ja verisuonten supistumiseen. Matala-annoksinen asetyylisalisyylihappo (ASA) vähentää tromboksaanituotantoa ja korjaa tromboksaani- ja prostasykliinituotannon epätasapainoa, mutta sen ei ole todettu merkittävästi vähentävän näiden raskauskomplikaatioiden esiintyvyyttä edes riskiryhmillä, kun lääkitys on aloitettu toisen raskauskolmanneksen aikana. Tämän satunnaistetun ja plasebo-kontrolloidun kaksoissokkotutkimuksen tavoitteena oli tutkia keinoalkuisia hedelmöityshoitoja saavilla naisilla matala-annoksisen ASA-hoidon (100 mg/vrk) merkitystä munasarjojen stimulaatiovasteeseen, alkion kiinnittymiseen, istukan muodostumiseen ja kehittymiseen sekä lääkehoidon vaikutusta kohdun, istukan ja sikiön verenkiertoon, kun lääkitys aloitettiin munasarjojen stimulaatiohoidon alkaessa. Lisätavoitteena oli selvittää, onko lapsettomuushoitoja saavien naisten raskauksissa todettavissa spesifinen istukkaproteomiikkalöydös (istukan tuottamat valkuaisaineet) verrattuna spontaanisti raskaaksi tulleisiin naisiin ja voidaanko siihen vaikuttaa matala-annoksisella ASA-hoidolla. Toisena lisätavoitteena oli selvittää matala-annoksisen ASA-hoidon vaikutus pre-eklampsian esiintyvyyteen loppuraskaudessa. Matala-annoksinen asetyylisalisyylihappo (ASA) ei paranna keinoalkuisten hedelmöityshoitojen hoitotuloksia eikä vaikuta kohdun verenkiertoon tai kohdun limakalvon paksuuteen ultraäänellä arvioituna alkion siirtopäivänä. Matala-annoksista ASA-hoitoa käyttäneiden potilaiden ryhmässä todettiin kuitenkin merkitsevästi vähemmän naisia, joilla oli huonoa hoitotulosta keinoalkuisissa hedelmöityshoidoissa ennakoiva korkea molemminpuolinen kohtuvaltimoiden verenvirtausvastus alkion siirtopäivänä verrattuna plasebo-ryhmään. Raskaaksi tulleilla naisilla, jotka käyttivät matala-annoksista ASA-hoitoa, todettiin kohdun verenvirtausvastus matalammaksi alku- ja keskiraskaudessa verrattuna plasebo-ryhmän naisiin. Istukkaproteomiikkatutkimusten mukaan varhaisistukan proteiinituotanto on erilainen keinoalkuisissa raskauksissa verrattuna spontaanisti alkaneisiin raskauksiin ja siihen voidaan vaikuttaa matala-annoksisella ASA-hoidolla. Pre-eklampsian ja sikiön kasvunhidastuman esiintyvyydessä ei ryhmien välillä todettu eroa. Matala-annoksinen ASA-hoito aloitettuna ennen raskautta munasarjojen stimulaatiohoidon alkaessa ei paranna munasarjojen vastetta lapsettomuushoidoissa käytettäville hormonihoidoille, raskauslukuja eikä kohdun verenkiertoa alkion siirtopäivänä. Hoidon todettiin kuitenkin vaikuttavan varhaisistukan kehittymiseen sekä parantavan kohdun verenkierto alku- ja keskiraskaudessa viitaten istukan verisuonipuuston parempaan kehittymiseen. Matala-annoksinen ASA-hoito ei vähentänyt istukkaperäisten raskauskomplikaatioiden esiintymistä.

Embryonic stem cell research and cloning : a proposed legislative framework in context of legal status and personhood

The aim of this dissertation is to examine and analyse the judicial framework with regard to embryonic stem cell research and cloning in South Africa. The examination is conducted within the framework of the South African and United Kingdom's legal systems. Focus is placed on aspects of medical law, human rights law as envisaged in the Constitution of the Republic of South Africa, and the law of persons. The specific focus of this dissertation is to examine the intense debate on the moral and legal status of the embryo and fetus in South Africa. A comparative study is undertaken, with the United Kingdom as a background against which recommendations for the South African framework are made. The study firstly provides a clinical overview of stem cell research and cloning. Secondly, the concept of life, in particular human life; the protection of the embryo and fetus under the constitutional guarantee of the right to life, among other constitutionally protected rights, are examined. In this context, the most important finding is that although the fetus is not a bearer of constitutional rights the state has a constitutional duty to protect fetal life in terms of an objective value system. Thereby, the state is permitted to regulate abortion, fetal tissue research, and embryo research to protect fetal life. In particular, the aim of this dissertation is to present a critical summary of the major debates and policy responses relating to embryonic stem cell research and cloning techniques, drawing attention to some of the challenges posed by conflicting moral values in an era of global scientific endeavour, and to provide an analysis of the key ethical and regulatory implications for stem cell therapy. The most important findings are that current South African legislation remains fragmented and ineffective in the manner in which embryonic stem cell research and cloning are regulated. Utilisation de la reproduction médicalement assistée, les grossesses multiples et les malformations congénitales majeures

L’infertilité touche environ 11 à 15 % des couples au Canada. Les modalités de la procréation médicalement assistée (PMA) incluent la stimulation ovarienne (SO), l’insémination intra-utérine (IIU) et les techniques de la reproduction assistée (TRA). Les grossesses multiples sont parmi les effets indésirables les plus communs de l’utilisation des TRA. Toutefois, il n’y a pas de consensus sur l’ampleur du risque de grossesses multiples associé à l’utilisation des modalités de la PMA. De plus, il n’est pas clair si les modalités de la PMA sont associées à un risque élevé de malformations congénitales majeures (MCM) d’un ou plusieurs systèmes et organes du corps humain. Un projet de recherche en trois volets a été développé afin de répondre à ces questions. Dans un premier volet, une étude cas-témoin a été conduite afin de quantifier le risque de naissances multiples associé à l’utilisation des modalités de la PMA. Comparativement à une conception spontanée (CS), le recours à la SO seule, l’IIU, et les TRA étaient associés à une augmentation significative de plus de quatre, neuf et 31 fois du risque de naissances multiples, respectivement. Les femmes ayant fait appel à une IIU+SO ou aux TRA avaient un risque accru de naissances multiples (odds ratio (OR)ajusté, 1,98; IC95%, 1,12-3,49; ORajusté, 6,81; IC95%, 3,72-12,49, respectivement) comparativement à l’utilisation de la SO seule. Dans un deuxième volet, une analyse cas-témoin a été conduite afin de quantifier le risque de MCM associés à l’utilisation des modalités de la PMA. Comparée à une CS, l'utilisation des TRA était associée à une augmentation du risque des malformations du système urogénitale (ORajusté, 3,11; IC95%, 1,33–7,27) et l'utilisation de l'IIU était associée à un risque accru des malformations du système musculosquelettique (ORajusté, 2,02; IC95%, 1,10–3,71). L'utilisation des TRA était associée à une augmentation du risque des malformations du système urogénitale (ORajusté, 7,18; IC95%, 1,59-32,53) par rapport à l’utilisation de la SO seule. Dans un troisième volet, les résultats de la revue systématique et méta-analyse ont démontré que l'utilisation de la SO seule et l’IIU±SO étaient associée à une augmentation significative de presque 9 fois du risque de grossesses multiples par rapport à une CS. Des augmentations similaires ont été observées suite à l’utilisation du citrate de clomifène seul. Par rapport à une CS, l'utilisation de la SO seule était associée à une augmentation significative de 48% du risque des malformations du système musculosquelettique, de 73% le risque des malformations du système nerveux, de 76% le risque de malformations congénitales du système digestif, de 68% le risque de malformations des yeux, des oreilles, du visage et du cou, et plus de deux fois le risque de malformations congénitales du système respiratoire. L'utilisation de l'IIU était associée à une augmentation significative de 52% du risque de malformations du système urogénitales et de 54% du risque de malformations musculosquelettiques par rapport à une CS. Bien que le risque de grossesses multiples associées aux TRA puisse être contrôlé par le transfert d'un embryon unique, un suivi particulier devrait être accordée au risque de grossesses multiples associé à l’utilisation des traitements n’impliquant pas un transfert d’embryons. L’effet tératogène potentiel associé à l’utilisation des modalités de la PMA doit être considéré dans la prise des décisions thérapeutiques. La mise en place d’un registre de la PMA pour la surveillance des effets périnataux indésirables devient nécessaire / Infertility affects 11 to 15% of couples in Canada. The modalities of medically assisted reproduction (MAR) include ovarian stimulation (OS), intrauterine insemination (IUI) and assisted reproduction techniques (ART). Multiple pregnancies are among the most common side effects of using ART. However, there is no consensus on the magnitude of the risk of multiple pregnancies associated with the use of MAR modalities. In addition, it is unclear whether the modalities of MAR are associated with a high risk of major congenital malformations (MCM) affecting one or more specific organ system. A three-part research project was developed to answer these questions. In the first part, a case-control study was conducted to quantify the risk of multiple births associated with the use of the three MAR modalities. Compared to spontaneous conception (SC), the use of OS alone, IUI, and ART was associated with a significant increase of more than four, nine, and 31 times the risk of multiple births, respectively. Women who used IUI with OS or ART had an increased risk of multiple births (adjusted odds ratio (OR), 1.98; 95%CI, 1.12-3.49; adjusted OR, 6.81; 95%CI, 3.72-12.49, respectively) compared to the use of OS alone. In a second part, a case-control analysis was conducted in order to quantify the risk of MCM associated with the use of MAR modalities. Compared to SC, the use of ART was associated with an increased risk of urogenital malformations (adjusted OR, 3.11; 95%CI, 1.33–7.27) and the use of IUI was associated with increased risk of musculoskeletal malformations (adjusted OR, 2.02; 95% CI, 1.10–3.71). The use of ART was associated with an increased risk of urogenital malformations (adjusted OR, 7.18; 95% CI 1.59-32.53) compared to the use of OS alone. In a third part, results of the systematic review and meta-analysis demonstrated that the use of OS alone and IUI ± OS were associated with a significant increase of nine times the risk of multiple pregnancies compared to a SC. Similar increases have been found following the use of clomiphene citrate alone. Compared to SC, the use of OS alone was associated with a significant 48% increased risk of musculoskeletal malformations, 73% increased risk of malformations of the nervous system, 76% increased risk of digestive system malformations, 68% increased risk of malformations of the eye, ear, face and neck, and more than twice the risk of congenital respiratory system malformations. The use of IUI was associated with a significant 52% increased risk of urogenital malformations and 54% increased risk of musculoskeletal malformations compared to SC. Although the risk of multiple pregnancies associated with ART can be controlled using a single embryo transfer in IVF cycles, monitoring the risk of multiple pregnancies associated with the use of treatments that do not involve embryo transfer is essential. The potential teratogenic effect associated with the use of MAR modalities should be considered when making therapeutic decisions. The establishment of a registry for the surveillance of MAR adverse perinatal outcomes becomes necessary.

This thesis describes and analyses discourses that preceded the legislation changes regarding assisted reproduction in connection with setting an upper age limit for women who are undergoing assisted reproduction treatments in socialist system as well as in democratic system. This work defined discourses of both political systems compares with the accent on governmentality as a tool for population control. This analysis is valuable primarily because of describing principles of working the whole "system of assisted reproduction" and provides insight into the political discourse of infertility, respective on its part concerning the Czech legislation taking into account the phenomenon of reproductive tourism. No one from the topics - both the political discourse of infertility then the reproductive tourism have not had been in the Czech literature written up yet. The work shows the establishment of proper parenting standards in the political discourse through the topic of artificial insemination. Stabila föräldrar för barnets bästa : Hur statliga riktlinjer för IVF-utredningar konstruerar goda föräldrar och påverkar tillgången till föräldraskap för personer med psykiska funktionsnedsättningar

This thesis investigates the access to IVF-treatment for people with psychiatric disabilities who intend to carry the child themselves. It explores how the Swedish welfare state resonates around people with psychiatric disabilities wanting to become parents, and how their reproductive rights might differ from others seeking the same treatment. Therefore, different official reports from the Swedish government and documents from the National Board of Health and Welfare that deals with the legal framework and state-sanctioned guidelines for medical professionals regarding IVF has been examined in a qualitive discourse analysis. Two interviews with two medical professionals working with IVF has also been conducted. The focus has been on the psychosocial interviews every treatment-seeking individual has to go through to determine if they are fit as parents. The main body of theory consists of work surrounding feminist disability studies, crip theory, discourse analysis, repronormativity and critical studies of the welfare state. This thesis set out to investigate how the demand from the government to put the best interest of the child first when deciding over who gets access to IVF are used to resonate around if people with psychiatric disabilities can be seen as fit parents. It also seeks to understand what these state-sanctioned guidelines and the way medical professionals interacts with them can say about the reproductive politics of the Swedish welfare state regarding people with psychiatric disabilities. The general conclusion is that the welfare state has implemented tools for reproductive control over the group that has been studied (particularly women and trans people) since at least the 1930’s, and while there has been significant change, the gatekeeping practises surrounding IVF can be seen as another tool for reproductive control. It is evident that people with psychiatric disabilities have to prove themselves in order to be seen as fit parents, and it is assumed that there is a risk trying to combine their psychiatric disabilities with the best interest of the child. While there is no legal framework denying this group access to IVF outright, this thesis shows that they face challenges to gain that access that people without psychiatric disabilities does not.

Development and Application of Techniques for the Control of Captive Breeding in Elasmobranchs

Tesis por compendio / [ES] Los tiburones y rayas aparecieron hace 420 millones de años, conformando el antiguo y ecológicamente diverso, grupo de vertebrados acuáticos conocido como elasmobranquios. Este variado grupo posee unas estrategias vitales que los hace muy vulnerables a los cambios rápidos del entorno, como los derivados de la acción antrópica. Pese a ser elementos clave en la regulación de los ecosistemas en los que habitan, en la actualidad, se trata de uno de los grupos vertebrados más amenazados del planeta. Paralelamente a la conservación in situ, los programas de conservación ex situ se pueden utilizar para mejorar la situación de algunas especies sensibles. Entre estos programas, los planes de cría en cautividad aumentarían la sostenibilidad de acuarios públicos y centros de investigación, además de permitir el desarrollo de estrategias de conservación en estado salvaje. Sin embargo, para que sean efectivos, estos planes deberían incluir el uso de técnicas de reproducción asistida. Desafortunadamente, estas técnicas apenas se han desarrollado en el pasado, por lo que su utilidad no se ha demostrado adecuadamente. Esta tesis aborda el uso de técnicas de reproducción en elasmobranquios, con énfasis en la obtención y preservación del esperma. Inicialmente, se centró en dos especies modelo, Scyliorhinus canicula y Raja radula, pero luego se incluyeron otras especies. Esto reveló variabilidad en las estructuras reproductivas, lo que puede afectar la eficacia y calidad de las técnicas. Los capítulos 1 y 2 se enfocaron en catalogar y describir estas estructuras en diversas especies, destacando las mejores prácticas de obtención de gametos e inseminación. La conservación a corto, medio y largo plazo del esperma es esencial para planes ex situ, reduciendo el transporte de machos, conflictos durante el cortejo y endogamia. Malgrat ser elements clau en la regulació dels ecosistemes on habiten, actualment són un dels grups més amençats del planeta. Els programes de conservació ex situ es poden utilitzar per millorar la situació d'algunes espècies. Entre aquests programes, els plans de cria en captivitat augmentarien la sostenibilitat dels aquaris públics i els centres de recerca, a més de permetre el desenvolupament d'estratègies de conservació a l'estat salvatge. No obstant això, aquests plans haurien d'incloure l'ús de tècniques de reproducció assistida. Desafortunadament, aquestes tècniques gairebé no s'han desenvolupat en el passat. Davant d'aquesta situació, aquesta tesi pretén omplir certes mancances en el coneixement sobre l'ús d'aquestes tècniques en diverses espècies d'elasmobranquis. La nostra investigació va començar centrant-se especialment en dues espècies model, el tauró gat Scyliorhinus canicula i la ratjada peluda Raja radula, però al llarg de l'estudi es va aconseguir tenir accés a altres espècies. Aquest accés ens va permetre ser conscients de la gran variabilitat en la disposició de les estructures del sistema reproductor. Malgrat que en la literatura hi ha descripcions generals i, en ocasions, detallades dels sistemes reproductors de certes espècies, aquestes descripcions mai s'han centrat en l'aplicació pràctica de les tècniques de reproducció assistida. Per aquest motiu, els capítols 1 i 2 es van centrar en la catalogació i descripció de les diferents estructures d'espècies que abasten un ampli espectre taxonòmic. La conservació de l'esperma juga un paper clau per poder desenvolupar plans de conservació en condicions ex situ. Disposar d'esperma de qualitat permet limitar el transport de mascles entre institucions, minimitzar problemes derivats de la manca de sincronia entre adults reproductors, reduir conflictes durant èpoques d'aparellament i reduir l'endogàmia. El tercer capítol es centra en com es van desenvolupar i provar diferents fórmules per aconseguir el manteniment en fresc de l'esperma, fins a aconseguir un medi on diluir l'esperma capaç de mantenir-lo amb vida durant més de 30 dies. Posteriorment, mitjançant l'addició de diversos crioprotectors (ou, DMSO i metanol) en diverses concentracions, s'explica com es va aconseguir la criopreservació de l'esperma de diverses espècies de ralles i, per primer cop, la criopreservació de l'esperma de diverses espècies de taurons. Un dels primers obstacles que es van detectar en treballar amb els espermatozoides es va deure a la morfologia d'aquestes cèl·lules en comparació amb les d'altres espècies. El cap dels espermatozoides presenta una forma helicoidal, amb un nombre variable de voltes en funció de l'espècie. A més, en moltes ocasions les cèl·lules no apareixen lliures en el fluid seminal, sinó que formen agregacions estructurades anomenades espermatotzeugma. Al llarg del capítol 4 s'explora com aquestes dues característiques sorgeixen com a resultat de la fecundació interna i les característiques mecàniques del medi en què han de realitzar la seva funció. Per primer cop, es pot observar com les cèl·lules reaccionen davant mitjans amb diferents propietats, posant de relleu la importància de la viscositat en l'aplicació de tècniques de reproducció assistida. Això inclou la possibilitat de fer descripcions detallades mitjançant tècniques d'anàlisi d'imatge, avaluar la importància de la viscositat i els agregats en els processos de preservació i la possibilitat de realitzar inseminacions artificials. / [EN] Sharks and rays emerged 420 million years ago, forming the ancient and ecologically diverse group of aquatic vertebrates known as elasmobranchs. This diverse group possesses vital strategies that make them highly vulnerable to rapid environmental changes, such as those resulting from human activities. Despite being key elements in the regulation of the ecosystems they inhabit, they are currently one of the most threatened vertebrate groups on the planet. In parallel with in-situ conservation efforts, ex-situ conservation programs can be used to improve the status of some sensitive species. Among these programs, captive breeding plans would enhance the sustainability of public aquariums and research centers, as well as enable the development of conservation strategies in the wild. However, for these plans to be effective, they should include the use of assisted reproduction techniques. Unfortunately, these techniques have been scarcely developed in the past, and their utility has not been adequately demonstrated. This thesis addresses the use of reproduction techniques in elasmobranchs, with an emphasis on sperm retrieval and preservation. Initially, it focused on two model species, Scyliorhinus canicula and Raja radula, but later, other species were included. This revealed variability in reproductive structures, which can affect the effectiveness and quality of the techniques. Chapters 1 and 2 focused on cataloging and describing these structures in various species, highlighting best practices for gamete retrieval and insemination. The short, medium, and long-term conservation of sperm is essential for ex-situ plans, reducing the need for transporting males, conflicts during courtship, and inbreeding. Chapter 3 details formulas for maintaining sperm freshness and a medium for its survival for over 30 days. Subsequently, sperm cryopreservation in several species of rays and sharks is described using cryoprotectants. Chapter 4 addresses challenges in handling elasmobranch sperm due to its helical morphology and the formation of aggregates called spermatozeugma. The importance of viscosity in assisted reproduction techniques is emphasized. In the Discussion, the effectiveness of the methods is compared, and new opportunities are explored by having access to various species. This includes detailed descriptions with image analysis, viscosity assessment, and aggregate preservation, as well as the consideration of artificial inseminations. / This research was partially funded by the Fundación Biodiversidad ( ). La notion de filiation renvoie au lien familial entre un parent et un enfant, lien qui ancre l'individu dans une lignée généalogique et permet de l'identifier par rapport aux membres de sa famille. Notion universelle, il a semblé pertinent d'examiner comment deux systèmes juridiques distincts, tels que ceux de droit civil et de common law, l'appréhendaient. Évoquant intuitivement un lien génétique entre le parent et l'enfant, la notion de filiation pourrait se réduire à cette dimension purement physique. Pourtant, le droit tient compte du fait qu'elle recouvre d'autres réalités, sociales et affectives, révélant ainsi une notion plus complexe. Entre la réalité génétique, devenue accessible grâce aux progrès de la science, et la volonté, employée pour fonder toutes les fictions juridiques telles que l'adoption, la procréation médicalement assistée et la gestation pour autrui, une tension est née. Le droit s'efforce de trouver un équilibre entre ces fondements grâce à la nouvelle« boussole » qu'est l'intérêt de l'enfant ainsi que grâce au cadre éprouvé de l'ordre public. L'étude comparée des droits français et anglais a permis également d'observer une dissociation croissante entre la notion et son régime, le régime pouvant être attribué indépendamment de l'existence juridique du lien. Cette dissociation en a révélé une autre, aux contours plus précis encore, entre le statut, c'est-à-dire le lien de droit initial auquel est attaché le régime, et le rôle, c'est-à-dire le comportement de fait qui se verra attribuer tout ou partie du régime de la filiation. C'est ensuite autour de l'exercice effectif de ce rôle que se réagrège une grande partie des effets de la filiation, interrogeant par conséquent la notion sur sa capacité à rendre compte des évolutions du droit de la famille. / The notion of “filiation” refers to the family relationship between a parent and a child, which place each on ein a family lineage and identify him from the members of his family. Because of its universality, it seemed appropriate to examine how two different legal systems, such as those of civil law and common law , understood it. Referring intuitively to a genetic link between parent and child, the notion of “filiation” could be, at first sight, reduced to a physical aspect. However, the law recognizes that it covers other realities like social and emotional ones. Thus, it reveals a more complex concept. In recent years, a tension appeared between genetic reality, which became available thanks to advances in science, and will, used to base alllegal fictions such as adoption, assisted reproduction and surrogacy. The law seeks to check and balancethese foundations with the child's welfare and public policy.The comparative study of French and English law also revealed a growing dissociation between the notion and its effects. Indeed, the effects can be assigned independently of the legal existence of the link. This dissociation has revealed a more precise one between the status, that is to say the initial link which isattached the effects, and the role, that is to say, the behavior which will receive all or part of the effects of filiation. Then, the effective exercise of this role can re-aggregate the effects of filiation. Thus, it is questioning the notion on its ability to account for changes in the family law .

Cette thèse de caractère pluridisciplinaire traite des progrès de la biologie de la reproduction dans le domaine de l’infertilité face à la Convention internationale des droits de l’enfant (CIDE) des Nation-unies. La première partie montre que, en France, il y a conciliation entre l’intérêt supérieur de l’enfant et l’assistance médicale à la procréation, encadrée par le triptyque des lois de bioéthique de 1994. La deuxième partie traite des dérives de ces techniques pratiquées à des fins sociétales et non médicales. Des parents intentionnels désireux d’un « enfant à tout prix », puisque la loi n° 2013-404 du 17 mai 2013 ouvrant le mariage aux couples de même sexe n’a pas « ouvert » le droit à l’accès de ces techniques de reproduction assistée, se rendent au cours d’un « tourisme procréatif » dans un pays où la maternité de substitution ou gestation pour autrui (GPA) est licite et ont un enfant grâce à une mère de substitution, qui assure la gestation de l’embryon, puis du foetus via une fécondation in vitro. Mais lors du retour en France de l’enfant, eu égard aux articles 16-7 et 16-9 du code civil, se pose le problème de la filiation de l’enfant sans compter sur les risques de la maternité de substitution, d’où l’incompatibilité des techniques de reproduction assistée à des fins sociétales avec la Convention internationale des droits de l’enfant, l’adage latin "mater semper certa est" étant la garantie de l’intérêt supérieur de l’enfant. / This thesis has a plurisdisciplinary approach and deals with the improvements of biology of reproduction in the field of infertility regarding the International Convention on the Rights of the Child of the United Nations (ICRCUN). The first part shows, that in France, there is conciliation between the best interests of the child and the medical assistance to procreation, legalised by the triptych of the bioethics law of 1994. The second part deals with the drifts of those practices used for societal ends and not medical. Intended parents willing to have “a child at all costs”, as the law n° 2013-404 of May 17, 2013 allowing the marriage to couples of the same sex has not “allowed” the right to have access to thoses technics of assisted reproduction, do “procreative tourism” and go to a country in which the surrogate maternity or gestational surrogacy (GS) is legal and have a child thanks to surrogate mother who ensures the gestation of the embryo, and the foetus through an in vitro fertilization (IVF). However, back to France, according to articles 16-7 and 16-9 of the Civil Code, the issue of the filiation of the child arises, without counting on the risks of the surrogate maternity, hence the incompatibility of the methods of assisted reproduction to societal purposes with the International on Rights of the child, the Latin proverb "mater semper certa est" being the guarantee of the best interest of the child.
