A model of performance management for the parole boards in South Africa : a penological perspective

One of the fundamental objectives of the criminal justice system in any country is to punish, rehabilitate, deter, incapacitate and reintegrate offenders into communities. The main motive of punishment therefore is to transform criminals into responsible and law-abiding citizens. Parole is acknowledged as an internationally accepted mechanism that allows for the conditional release of offenders from correctional centres into the community and forms one of the most important components of the criminal justice system value chain. The release of the offenders on parole therefore, does not negate the objectives of punishment but entrenches them through setting conditions by which all parolees must abide by. In other words, all offenders released on parole are supervised at all times by parole officials within their communities to ensure that they comply with their conditions. It is for this function- to grant parole to offenders, that the parole boards have been established in different countries. The Department of Correctional Services in South Africa has adopted the independent model of parole which provides for the parole boards that are headed by independent members from the public appointed by the Minister of Correctional Services. Parole is administered by the parole boards and has, as one of its main functions the release of offenders based on their eligibility. The absence of the performance management system for the parole board makes parole board decision making less transparent and government accountability difficult to establish. Performance management systems have been used to strengthen good governance. The purpose of this study is to contribute to the design of a model of performance management of the parole boards in the Department of Correctional Services in South Africa. / Penology / D.Litt. et Phil. Unit management in prisons

Research into unit management in prisons was necessitated by a need to change the way in which South Africa deals with prisoners. The lack of respect for human dignity, poor control in prisons before and after demilitarisation and the need to reduce crime in South Africa are some of the reasons why the study became important. Topics addressed include the role of architecture in corrections, direct supervision to enhance active custody, renewed emphasis on individuals by means of case management and decentralised delivery of development and treatment programmes. Apart from the aspects mentioned above, the philosophy of unit management is spelled out. Imprisonment in countries such as Australia, Canada, Germany, Japan, South Africa and the United States of America is discussed against the background of the unit management philosophy. During any process of incarceration, documentation forms an integral part of the process. In this study, the researcher discussed those documents that could play an important role in unit management. The importance of unit management in prisons cannot be overemphasised. The investigation contributes largely to scientific knowledge in that the importance of sentence planning for each individual within the Criminal Justice System is emphasised. Individual case plans, active involvement from both the inmate and the correctional official and the positive role of prison design are aspects that should form part of all new generation prison systems. / Penology / D.Litt. et Phil. Cette étude présente une caractérisation du mécanisme procédural de l'intervention des tiers en droit judiciaire privé québécois. Développée en trois volets, elle aborde successivement l'origine historique de l'intervention des tiers, qui révèle sa pérennité et sa longévité (première partie). Un modèle conceptuel de sa forme contemporaine selon lequel son bien-fondé repose sur sa légitimité et son utilité est proposé (deuxième partie). Enfin, une étude critique, dans une perspective sociologique et comparative, de la place de l'intervention des tiers dans les projets de réforme de la procédure civile, expose son incompatibilité avec les modes alternatifs de résolution des conflits et trouve, dans le pouvoir judiciaire de l'ordonner d'office présent la législation étrangère, une assurance contre l'iniquité à laquelle le droit québécois devrait souscrire (troisième partie). / This study is a characterization of the procedural mechanism allowing intervention or joinder of third parties in Quebec's civil procedure law. Consisting of three parts, it traces the history of this procedure, revealing its perennial longevity (Part one). A theory of its contemporary function is proposed, according to which its legal validity rests on its legitimacy and usefulness (Part two). Finally, the place of third party intervention in civil procedure law reform is analysed from a sociological and comparative standpoint, exposing its fundamental incompatibility with ADR (Alternative dispute resolution) and finding that the judicial power–in foreign law–to order intervention as of right is a safegard against unfairness worth incorporating into Quebec's procedural law (Part three).

L’efficacité contestée du recours aux agents de santé communautaires pour la prise en charge du paludisme : évaluation du programme burkinabé dans les districts de Kaya et de Zorgho

Contexte. Le paludisme provoque annuellement le décès d’environ 25 000 enfants de moins de cinq ans au Burkina Faso. Afin d’améliorer un accès rapide à des traitements efficaces, les autorités burkinabées ont introduit en 2010 la prise en charge du paludisme par les agents de santé communautaires (ASC). Alors que son efficacité a été démontrée dans des études contrôlées, très peu d’études ont évalué cette stratégie implantée dans des conditions naturelles et à l’échelle nationale. Objectif. L’objectif central de cette thèse est d’évaluer, dans des conditions réelles d’implantation, les effets du programme burkinabé de prise en charge communautaire du paludisme sur le recours aux soins des enfants fébriles. Les objectifs spécifiques sont : (1) de sonder les perceptions des ASC à l’égard du programme et explorer les facteurs contextuels susceptibles d’affecter leur performance ; (2) d’estimer le recours aux ASC par les enfants fébriles et identifier ses déterminants ; (3) de mesurer, auprès des enfants fébriles, le changement des pratiques de recours aux soins induit par l’introduction d’une intervention concomitante – la gratuité des soins dans les centres de santé. Méthodes. L’étude a été conduite dans deux districts sanitaires similaires, Kaya et Zorgho. Le devis d’évaluation combine des volets qualitatifs et quantitatifs. Des entrevues ont été menées avec tous les ASC de la zone à l’étude (N=27). Des enquêtes ont été répétées annuellement entre 2011 et 2013 auprès de 3002 ménages sélectionnés aléatoirement. Les pratiques de recours aux soins de tous les enfants de moins de cinq ans ayant connu un récent épisode de maladie ont été étudiées (N2011=707 ; N2012=787 ; N2013=831). Résultats. Les résultats montrent que le recours aux ASC est très modeste en comparaison de précédentes études réalisées dans des milieux contrôlés. Des obstacles liés à l’implantation du programme de prise en charge communautaire du paludisme ont été identifiés ainsi qu’un défaut de faisabilité dans les milieux urbains. Enfin, l’efficacité du programme communautaire a été négativement affectée par l’introduction de la gratuité dans les centres de santé. Conclusion. La prise en charge communautaire du paludisme rencontre au Burkina Faso des obstacles importants de faisabilité et d’implantation qui compromettent son efficacité potentielle pour réduire la mortalité infantile. Le manque de coordination entre le programme et des interventions locales concomitantes peut générer des effets néfastes et inattendus. / Context. In Burkina Faso, malaria causes approximately 25,000 deaths every year in children under five. In 2010, national health authorities introduced case management of malaria by community health workers (CHWs) as a way to increase prompt access to effective treatments. While this strategy’s efficacy has been demonstrated in controlled studies, very few studies evaluated its effectiveness under real-world and nation-wide conditions of implementation. Objective. The overarching aim of this thesis is to evaluate the effects of the Burkinabè program on treatment-seeking practices in febrile children. The specific objectives are: (1) to examine CHWs’ perceptions and investigate the contextual factors likely to affect their performance; (2) to estimate the use of CHWs in febrile children and its determinants; (3) to evalauate changes in treatment-seeking practices induced by the introduction of a concomitant intervention – the removal of user fees at health centres. Methods. The study was conducted in two similar health districts, Kaya and Zorgho. The evaluation design integrates quantitative and qualitative components. Interviews were carried out with all CHWs in the study area (N=27). Surveys were repeated every year from 2011 to 2013 in 3002 randomly selected households. Treatment-seeking practices of all children with a recent sickness episode (N2011=707; N2012=787; N2013=831) were examined. Results. Results show that the use of CHWs is really low in comparison to previous controlled studies. Feasibility issues in urban areas and barriers to implementation of the community case management of malaria programme were identified. Moreover, its effectiveness in rural areas was challenged by the removal of user fees at health centres. Conclusion. In Burkina Faso, community case management of malaria faces serious challenges of feasibility and implentation. These challenges compromise the programme’s potential to reduce child morbidity and mortality. The lack of integration between the programme and local concomitant interventions can generate unpredicted adverse effects.

La gestion de cas est une pratique professionnelle qui s’implante actuellement en France, en particulier dans le domaine des soins aux personnes âgées en perte d’autonomie. Les « gestionnaires de cas » interviennent auprès de personnes âgées vivant à domicile dont la situation est jugée particulièrement complexe sur le plan médical et social. Ils ont pour mission d’évaluer les besoins des personnes suivies, de mettre en place les soins et les aides nécessaires, et d’assurer un suivi à long terme. Ils participent au processus d’intégration de l’organisation des soins en identifiant les dysfonctionnements au niveau de leur territoire, dans le cadre du « dispositif MAIA ». L’apparition de cette nouvelle pratique professionnelle soulève des enjeux éthiques spécifiques, du fait du positionnement particulier des gestionnaires de cas vis-à-vis des personnes accompagnées et de leur rôle nouveau dans le système de soins. L’objectif de ce travail est de proposer un cadre cohérent pour penser l’éthique de la gestion de cas, à partir de l’analyse des valeurs, des attitudes et des pratiques des gestionnaires de cas. Notre approche méthodologique s’appuie sur une recherche qualitative permettant un dialogue permanent entre faits observés et constructions théoriques, selon les principes de l’éthique empirique intégrée. Notre recueil de données comprend des entretiens approfondis avec des gestionnaires de cas, des entretiens semi-structurés avec les « pilotes » qui les encadrent, des groupes de discussions et un questionnaire écrit. L’étude française est complétée par une étude de cas visant à évaluer les conséquences sur l’éthique des professionnels d’un contexte organisationnel différent, à partir de groupes de discussion réalisés au Québec (Sherbrooke) et en Allemagne (Greifswald). L’analyse des données nous a amené à reconnaitre l’individualisation de la relation comme une valeur phare de la gestion de cas. L’engagement des professionnels dans une relation soignante leur permet de faire face aux conflits de valeurs que crée leur double mission de protéger des personnes vulnérables et de respecter leurs choix. Les gestionnaires de cas s’appuient en effet sur cette relation pour négocier avec la personne accompagnée un projet de soin qui fasse sens dans son histoire de vie. Cette individualisation de la relation entre en tension avec la nécessaire à une organisation du système de soins juste et efficiente. Le développement d’une éthique professionnelle spécifique à la gestion de cas nécessite donc de penser conjointement le rôle clinique du gestionnaire de cas, vis-à-vis des personnes accompagnés, et son rôle institutionnel. L’équilibre entre ces deux rôles est à construire dans le cadre d’une éthique organisationnelle, compatible avec l’éthique des professionnels et garante des droits des personnes accompagnées, propre à chaque système de santé. / Case management is a professional practice currently implemented in France. It is addressed to elderly persons living in community whose social and medical situation is regarded as particularly complex. Case managers have to assess needs in order to plan and coordinate necessary services. They assure a long term intensive follow-up. Furthermore, they promote the integration of the health care system by identifying malfunctions on their territories, as expected by the “MAIA” model. The emergence of this new practice raises specific ethical challenges, because of case managers’ two missions, patient-centered and system-centered. The aim of this study is to propose a coherent framework for case management ethics, based upon an analysis of case managers’ values, attitudes and practices. This study is based on one qualitative inquiry, allowing a continuous dialogue between observed facts and ethical theories, according to the approach of integrated empirical ethics. Our data collection contains in-depth interviews with case managers, semi-standardized interviews with some of their “pilots”, focus groups and a written questionnaire. This French survey is completed with a “case study” in order to assess the consequences of different organizational contexts on professionals’ ethics. We have therefore performed focus groups in Canada (Sherbrooke) and Germany (Greifswald). Our data analysis leads us to identify the individualization of relationships as a core value of case management. The commitment of the professionals in a care relationship helps them to face the dilemma between client’s protection and client’s empowerment. They rely on this relationship to negotiate with the client a care project that makes sense in terms of his/her life story. However, this individualized relationship can conflict with the standardization, necessary for the equity and the effectiveness of the health care system. Hence, the development of a professional ethics for case managers implies handling both, their clinical client-centered role and their systemic role. The balance between these two missions has to be elaborated in terms of an organizational ethics, consistent with the ethics of the professionals and guaranteeing the respect of the clients’ right, specific to each health care system.

Penological investigation of the offender rehabilitation path

The thesis examine the process of rehabilitation offered by the Department of Correctional Service as from the time the offender is admitted (sentenced) until such time he is released back into society. Rehabilitation in the departmental context is based on four key delivery areas, which must be in place to ensure that offenders are rehabilitated. Faced with several challenges, e.g. demilitarization, structural defects of the facilities that are not conducive for rehabilitation or build for Unit management principles, career path developed for officials, and the transformation of the old penitentiary system to the new generation prison system, the department failed to achieve their objectives. The thesis will examine the current process of rehabilitation in the Department of Correctional Service, and identify areas of under performance to seek best practices to improve service delivery. Os poderes do juiz na Inglaterra e no Brasil: estudo comparado sobre os case management powers

The research approaches the judge powers, specifically the case management powers. Considering the issue s delimitation, new statutes and its practice are compared through the perspective of both countries. In conclusion, these judge powers have become similar due to the blending practices seen among different law families, as well as between different countries of the same family. However despite the convergence towards strengthening these powers the problems to be solved by these countries have distinct roots. In England the cost problem is the biggest one, while in Brazil the biggest problem is the delay. Moreover, despite their early convergence, the cultural roots of each system keep them somehow apart from one another. Thus it is not possible to state which would the best system (since they are unique) and the adoption of the English model by the Brazilian legislation should be done with caution (since the problems to be solved are different) / O presente trabalho é uma proposta de estudo comparado do direito processual civil inglês e do brasileiro. A tese é centrada no tema dos poderes do juiz, notadamente nos case management powers. Dentro do recorte proposto, são comparadas as normas e a prática judicial recentemente instituídas pelo direito de cada um dos mencionados países. Conclui-se que os poderes desses juízes tornaram-se bastante semelhantes em decorrência da assimilação mútua de práticas judiciais entre diferentes famílias do direito, bem como entre países distintos de mesma família. No entanto a despeito da convergência em torno do fortalecimento dos poderes do juiz os problemas a serem solucionados pelos referidos países têm raízes distintas. A Inglaterra tem como maior problema o custo, enquanto o Brasil tem como maior problema a demora. Ademais, a raiz cultural de cada sistema os mantém de alguma forma diferentes, apesar da aproximação recente. Por isso não é possível dizer qual dos sistemas seja melhor (já que são incomparáveis) e eventual importação do modelo inglês pela legislação brasileira precisaria ser feita com ressalvas (já que os problemas a serem solucionados são distintos)
