Social workers' conceptualizations of spirituality as lived experience in professional practice

This doctoral study explores social workers’ shared understandings of spirituality as lived experience in their personal lives and professional practice. It examines Canadian social workers’ shared conceptualizations of spirituality as lived experience, what it entails, its role and purpose (why), and how it informs professional practice. Data collection involved three steps: a national publicity led to 24 completed self-screening questionnaires (SSQ); 14 in-depth interviews conducted through constructivist grounded theory’s theoretical sampling and; the preliminary findings were validated by the 24 SSQ participants. This study generated two key findings. The central concepts category of the conceptual schema of spirituality as lived experience emerged as Transcendent Life Energy (TLE) as Unconditional Love (UL) in Transformative Relationships (TR) With Self (WS) in Support of Wellbeing (SW)- i.e. TLE-UL-TR-WS-SW. Second, the conceptual schema analyzed through Self as body-mind-emotions-spirit-social (B-M-E-S-S) being—the social work practitioners—illuminated that spirituality as lived experience is about inherent, interconnected, transformative relationships that involve individuation as a life-long process that support healing, development of personal values, growth, and wellbeing in participants’ lives, their clients’ and social life. These findings unveiled interrelated discoveries of significance in social work practice. The wellbeing of Self is inherently interconnected with practitioners’ professional practice, their clients’ and others’ wellbeing. This confirmation is consistent with the concerns about the use of Self in countertransference and religion/culture. However, the personal values that participants developed through the conceptual schema were consistent with human rights and social work values; they included: respect for inherent dignity and worth of persons, self-determination, personal and professional integrity, do no harm, and social justice. Participants’ process of developing personal values exposed a distinction between beliefs and values acquired through socialization and those developed through the conceptual schema. These findings illuminate the function of social work as catalyst for transformative relationships and clarify the role of individuation as directly related to wellbeing, in the midst of cultural and embodied hegemony. Furthermore, the findings illuminate how, why, and what spirituality as lived experience entails and; highlight the multidisciplinary nature of social work practice and theory as inherently interconnected, encompassing human, natural, and social sciences. / October 2016

This allows choices of coherent perturbations over the corresponding versions of the Floer trajectories proposed by Cornea and Lalonde ([CL]). These perturbations are intended to lead to an alternative geometric description of the (obstructed) A∞ and L∞ structures studied by Fukaya, Oh, Ohta and Ono ([FOOO2],[FOOO]) and Cho ([Cho]). Given a Pin± monotone lagrangian submanifold L ⊂ (M, ω) with mini- mal Maslov number ≥ 2, we define an A∞ -algebra structure from the critical points of a generic Morse function on L. We express this structure as a cochain complex extending the pearl complex introduced by Oh ([Oh]) and further ex- plicited by Biran and Cornea ([BC]), equipped with its quantum product. This could also be seen as an alternative geometric description of a Fukaya cate- gory of (M, ω) with L as its only object, a hamiltonian relative version appear- ing in [Sei]. Vědecko-výzkumná spolupráce z pohledu soutěžního práva EU / Research and development cooperation from the perspective of competition law of the EU

Presented thesis is focused on research and development cooperation between companies from the perspective of the competition law of the European Union. The thesis analyses the evolution of the legislation applicable to on this kind of cooperation in the context of examined axis of laissez-faire - interventionism. The emphasis is put on convergence of the EU legislation for this category of collaboration with the regulations applicable for R&D agreements in the USA. The aim of presented thesis is to analyse and determine the direction of the European Union competition law regulation of research and development cooperation in the context of abovementioned axis, namely the evolution of block exemptions for this category of agreements. Apart from the coherent description of the applicable set of rules, the analysis aims to foresee the future evolution of these rules. .Another aim is to compare the European course of research and development legislation with the same kind of legislation in the USA. That is why presented thesis contains detailed analysis of the legislation applicable to R&D agreements in the USA. En droit financier, la conception des investisseurs protégés apparaît imprécise, alors que le dispositif juridique de protection est composé d’un grand nombre de mesures. Le contraste est saisissant. La première partie de cette recherche souligne la nécessité d’une clarification. Le flou entourant les investisseurs protégés est détaillé et ses conséquences sur l’objectif de protection, d’une part, et sur le dispositif de protection, d’autre part, sont mises en lumière. Plusieurs questions se posent, relatives à la notion d’investisseur comme à la logique et aux critères de protection. Source d’insécurité juridique, une conception indéterminée des investisseurs protégés pèse de différentes manières sur la qualité de la protection. La seconde partie est un essai de clarification qui porte sur la notion juridique d’investisseur, d’une part, et sur la politique juridique de protection, d’autre part. Il est ainsi proposé d’introduire une définition légale de l’investisseur dans le Code monétaire et financier, en s’appuyant sur les notions de sujet de droit et d’acte d’investissement. Une définition juridique de l’acte d’investissement contribue aussi à distinguer la notion juridique d’investisseur, d’un côté, et celles d’actionnaire, de client et de consommateur, de l’autre. La politique de protection envisagée ensuite s’appuie sur des axes connus mais qui gagnent à être réaffirmés et précisés. La pleine mise en oeuvre de cette politique impose alors, compte tenu aussi des catégories redéfinies d’investisseur et d’investisseur qualifié, d’élaborer une nouvelle catégorie juridique d’intervenants sur les marchés financiers. / In financial law, the conception of “protected investors” appears to reveal many uncertainties while at the same time, investor protection measures are numerous. This raises a number of questions. The first part of this research shows that there is a need to clarify this conception. Such a need results mainly from the detailed description of existing uncertainties and their negative consequences on investor protection objective and measures. These difficulties, which are about the concept of investor, the logic of the protection and its criteria, are a source of legal uncertainty. As a result, the quality of the protection is undermined in many different ways. The second part of this research is an attempt to clarify these points. It focuses on the legal concept of investor and on investor protection policy. The idea is to amend the legislative part of the French Monetary and Financial Code to introduce a definition of the word « investor », which relies on the suggestion that an investor should have legal personality and that there should be an act of investment. The legal definition suggested for the concept of “act of investment” also helps to draw distinctions between the legal concept of investor on the one hand, and those of shareholder, client and consumer, on the other hand. The investor protection policy which is then described lies on grounds that may look familiar, but to state them more precisely appears to be useful. For this policy to be fully implemented, and taking into account the definitions or amendments brought to the categories of “investor” and of “qualified investor”, a new legal category of actors in the financial markets needs to be elaborated.

Abelian BF theory / Théorie BF abélienne

Cette thèse porte sur la théorie BF abélienne sur une variété fermée de dimen-sion 3. Elle est formulée en termes de classes de jauge qui sont en fait des classes de cohomologie de Deligne-Beilinson. Cette formulation offre la possibilité d’extraire les quantités mathématiquement pertinentes d’intégrales fonctionnelles formelles. La fonction de partition et les valeurs moyennes d’observables sont ainsi calculées. Ces calculs complètent ceux effectués pour la théorie de Chern-Simons abélienne et ces résultats sont liés entre eux de même qu’avec les invariants de Reshetikhin-Turaev et de Turaev-Viro abéliens. Deux extensions de ce travail sont discutées. Premièrement, une approche graphique est proposée afin de traiter l’invariant classique SU(N) de Chern-Simons. Deuxièmement, une interprétation géométrique de la procédure de fixation de jauge est présentée pour la théorie de Chern-Simons abélienne dans mathbb{R}^{4l+3}. / In this study, the abelian BF theory is considered on a closed manifold of di-mension 3. It is formulated in terms of gauge classes which appear to be Deligne-Beilinson cohomology classes. Such a formulation offers the possibility to extract the quantities mathematically relevant quantities from formal functional integrals. This way, the partition function and the expectation value of observables are computed. Those computations complete the ones performed with the abelian Chern-Simons theory and the results appear to be connected together and also with abelian Reshetikhin-Turaev and Turaev-Viro topological invariants. Two extensions of this study are also discussed. Firstly, a graphical approach is proposed to deal with the SU(N) classical Chern-Simons invariant. Secondly, a geometric interpretation of the gauge fixing procedure is presented for the abelian Chern-Simons theory in mathbb{R}^{4l+3}.

Investigating the Single Category Belief Problem in a Hybrid Product

Existing research suggests that when consumers encounter hybrid products or boundary-spanning products with attributes belonging to multiple categories, consumers tend to generate inferences based on only a single product category. Reliance on a single category for inferencing is termed as the “single category belief problem” which has been regarded as a vital marketing challenge because it leads consumers to underestimate the true utility of a hybrid product as certain product attributes are ignored. Our objective was to explore whether single category beliefs manifest in consumer choice for a hybrid product when strategically placed within varying contexts. The research used discrete choice experiment (DCE) to test hypotheses. Our research confirms that the single category belief is evident in consumer choice. We also found that the context the hybrid product is placed within has a major influence on what consumers preferred the most. Depending on the context a hybrid product was seen in had significant influence on how consumers evaluated product attributes and made purchase decisions. The findings for this research may be very beneficial for marketers.

Responsibility, spontaneity and liberty

Isaiah Berlin maintains that there are two distinct forms of freedom or liberty: negative and positive. Berlin’s principal claim is that negative liberty does not require that the self be somehow separate from the empirical world (causally aloof, or an originator of causal chains). My principal claim is that to be an agent is to be committed to a separation of self in this sense, thus that the self for its very being requires to possess a species of positive liberty. This conception proceeds in part from Immanuel Kant’s claim that there is a separation between spontaneity and receptivity. Commitment to this assertion allows there to be an understood distinction between the self as a spontaneous self-active agent that makes choices, and the self as a mere reactionary brute that does what it does by biological imperatives. In this thesis, I defend the view that negative liberty is subsumed under positive liberty: you cannot have the former without the latter. I am therefore taking a rationalist stance towards Berlin’s thinking. My methodology is to bring into consideration two perspectives upon the underlying normative principles within the space of reason. The first is of Kant’s understanding of the principle of responsibility and the activity of spontaneity; the second is John McDowell’s understanding of that principle and activity. The key claim of this thesis is that Berlin misunderstands what it is to be a chooser. To be a chooser is to be raised under the idea that one is an efficient cause; human children are brought up being held responsible for their reasons for acting. This principle allows mere animal being to be raised into the space of reason, where we live out a second nature in terms of reason. Using their conclusions I further investigate Berlin’s understanding of conceptual frameworks, taking particular interest in historic ‘universal’ conceptions that shape human lives. He too finds that that we are choosers is necessary for what it is to be human. I take his conclusion, and suggest that if he had had a clear understanding of the space of reason, the historic claim that we have choice would find a more solid footing in the principle of that space, in that we are responsible for our actions. I conclude that the upshot of understanding the ‘I’ as an originating efficient cause is that we treat ourselves as free from a universal determinism that Berlin himself disparages; and that the cost to Berlin is that all choice is necessarily the activity of a higher choosing self. It is part of a Liberal society’s valuing, by their societal commitment to, the ideology of raising our children to understand themselves as choosers, that we have choice at all. This is irrespective of whether that which fetters choice is internal or external to the agent, or of whether having self-conscious itself requires such a cultural emergence of second nature.

Subsistence at Si•čǝ’nǝł: the Willows Beach site and the culture history of southeastern Vancouver Island

Culture types in Pacific Northwest archaeology are characteristic artifact assemblages distinguishing different prehistoric periods. Assemblages indicate a culture type transition during the 2,630 BP–270 BP occupation of Willows Beach (DcRt-10), southeastern Vancouver Island. Faunal remains could reveal links to subsistence patterns, following Croes’s theory that culture type change reflects subsistence intensification. Five dated DcRt-10 faunal assemblages underwent taxonomic and size classification, weighing and MNI calculation. Vertebrate weight and NISP percentages were compared between stratigraphic units associated with the later Gulf of Georgia and earlier Locarno Beach culture types. The youngest assemblage contains a smaller proportion of land mammal bone, suggesting increased sea mammal, fish, and bird procurement. Faunal remains also suggest a greater variety of taxa exploited over time. Faunal assemblages suggest that culture type change at DcRt-10 is the product of subsistence change, increasing knowledge of the culture historic sequence of this region.
