Source of tensions and arrangements, rich in mental elaborations attempting its elucidation, death is treated here as part of an intricate social mesh existing in a city in permanent transformation. Noticing its greater incidence among the children, the women, the poor and the slaves, we have investigated the probable reasons for this and quantified it in a set of tables that made possible the evaluation of the life expectancy of the inhabitants of de city of São Paulo in the mid nineteenth century. The tables are also used as source for further analyses. Death thus becomes the object of a complex history, ambiguous at times, since it is one of several stages in a process that starts by the contact with disease but does not end with the end of life, for there remains a body that is to become the source of conflicts and appropriations of diverse kinds. These complex social relationships in an interface with the city, with its problems and customs, can only be understood and disclosed when considered in the context of a hierarchical society submitted to several spheres of power and interacting with them. This being so, disease and death will be approached here as social phenomena, objetcs for historical reflexion, not the least because they do not occur secluded from their time, their space, or the individuals that experience them / O presente estudo tem como objetivo a análise das relações que se construíram na sociedade paulistana do século XIX tendo em vista a presença constante das doenças e da morte. Fonte de tensões e de arranjos, rica em elaborações que se forjaram no intuito de elucidá-la, a morte será tratada enquanto parte de uma intrincada rede social vivenciada numa cidade em constante transformação. Anotada a sua maior incidência entre crianças, mulheres, pobres e escravos, coube investigar as possíveis razões para isso, bem como utilizar as quantificações apuradas como base para a elaboração de tabelas que permitiram estabelecer a expectativa de vida dos paulistanos em meados do século XIX. Estas, por sua vez, não estarão aqui inseridas apenas enquanto demonstração senão, também, como fonte para outras análises. A morte, portanto, torna-se o objeto de uma história complexa, por vezes ambígua, até porque, como constatamos, ela é uma das várias etapas de um processo que, iniciado através do contato com a doença, não se esgota com o fim da vida, posto que resta ainda um corpo, daí por diante também transformado em fonte de conflitos e apropriações diversas. Numa interface com a cidade, com seus problemas e costumes, essas complexas relações somente se tornam inteligíveis e passíveis de serem desvendadas quando consideradas no bojo de uma sociedade hierarquizada, submetida a diversas esferas de poder e com elas interagindo. Nesse sentido, a doença e a morte estarão aqui sendo consideradas enquanto fenômenos sociais, objetos passíveis de reflexão histórica, até porque elas não ocorreram apartadas do seu tempo, do seu espaço ou dos indivíduos que as vivenciaram

Nella tesi si approfondisce in cosa consistano effettivamente le pratiche e le esigenze funebri dei musulmani, valutando in che misura esse siano compatibili con la legislazione statale dei Paesi occidentali (esaminando in particolare i casi di Italia, Francia e Svizzera). Nell'affrontare il tema si è adottata una prospettiva di tipo interdisciplinare, considerando la questione delle sepolture islamiche sia dal punto di vista del diritto musulmano (per definire in che misura e secondo quali modalità possano essere effettuati gli adattamenti richiesti dalla presenza di comunità musulmane in contesti non islamici), sia dal punto di vista del diritto statale laico, nel più ampio quadro dei rapporti tra Stato e religioni attualmente vigenti nei Paesi considerati.

Early Iron Age Cementeries at Knossos: The Appreciation of Oriental Imports and their Imitations by Knossian Society

The contextual study of the oriental imports and their local imitations discovered in the Early Iron Age cemeteries at Knossos is of great importance, as it reveals the attitude of the Knossian society towards imports coming from the Near East during a period that lasted more than four centuries. Another important part of this study is a coherent analysis of the distribution of the fully published tombs and cemeteries. The main argument of this thesis is that there were different elite groups at Knossos which were in competition with each other and, for this reason, used different clusters of tombs and/or cemeteries. It is argued that the oriental imports and their close copies were used by those different elite groups in order to mark political and ideologies differences. / El estudio contextual de las importaciones orientales y sus imitaciones producidas en Creta, descubiertas en los cementerios de la Edad del Hierro temprana de Cnosós, es de gran importancia porque nos revela cómo la sociedad de Cnosós reaccionó a las importaciones procedentes de Oriente Próximo durante un período que duró más de cuatro siglos. Otra parte importante de este estudio es un análisis coherente de la distribución de las tumbas y los cementerios cuyos datos han sido publicados en su totalidad y su asociación con las importaciones. El argumento principal de esta tesis es que hubo distintos grupos de élite que competían unos con otros y por eso utilizaron tumbas y cementerios distintos. Estos grupos también utilizaron las importaciones orientales y sus imitaciones con el fin de marcar sus diferencias, políticas e ideológicas.

The history of the Pietersburg [Polokwane] Jewish community

Jews were present in Pietersburg [Polokwane] from the time of its establishment in 1868. They came from Lithuania, England and Germany. They were attracted by the discovery of gold, land and work opportunities. The first Jewish cemetery was established on land granted by President Paul Kruger in 1895. The Zoutpansberg Hebrew Congregation, which included Pietersburg and Louis Trichardt was established around 1897. In 1912, Pietersburg founded its own congregation, the Pietersburg Hebrew Congregation. A Jewish burial society, a benevolent society and the Pietersburg-Zoutpansberg Zionist Society was formed. A communal hall was built in 1921 and a synagogue in 1953. Jews contributed to the development of Pietersburg and held high office. There was little anti-Semitism. From the 1960s, Jews began moving to the cities. The communal hall and minister's house were sold in 1994 and the synagogue in 2003. Les fondements du droit des sépultures / Foundations of the right of burials

La sépulture est souvent appréhendée à titre d’exception ou par une superposition de notions : copropriété familiale, bien familial, chose hors commerce, indivision perpétuelle, droit réel spécial... Cette approche disparate dissimule l’existence d’un droit des sépultures qui peine, en conséquence, à constituer un droit unifié. Le droit des sépultures se trouve fractionné en plusieurs branches : droit civil, droit pénal et droit public. A travers elles, apparaissent de nombreuses problématiques, liées à la nature et au régime proposés. Pour ces raisons, il est nécessaire d’aborder le droit des sépultures par la recherche de ses fondements, inchangés depuis le droit romain et le droit médiéval. Le premier fondement est le sacré ; le second la communauté. Tous deux prennent leur source dans l’histoire du droit et continuent d’exister dans le droit positif. Ils font apparaître une unité du droit des sépultures, autour d’une double fonction : assurer la séparation du mort et du vivant et perpétuer le culte des morts. Du point de vue anthropologique, le sacré, premier fondement, se distingue du religieux, et se manifeste selon deux opérations : la délimitation d’une frontière entre sacré et profane par la séparation, puis la protection de ce nouvel espace délimité par la répression de toute atteinte. Pour les sépultures, ces deux opérations sont effectuées respectivement par l’extracommercialité et par la protection pénale. Le premier mécanisme est issu du droit romain et montre une protection originale de la sépulture ; toute activité juridique qui n’est pas incompatible avec le respect des morts est autorisée. L’autre mécanisme concerne l’incrimination de violation de sépulture, qui perpétue sa dimension sacrée. Le second fondement est communautaire : il est apparu pour les sépultures de famille avec les communautés médiévales, à une époque où les biens et les personnes étaient soudés en un groupe familial unique. Désormais adapté par l’affectation familiale, un tel fondement se maintient dans notre droit avec un régime de propriété collective, à travers la transmission successorale restreinte au groupe familial et un principe égalitaire, ce qui fait de la sépulture une véritable propriété communautaire. Bien sacré, propriété communautaire, les fondements des sépultures mettent en exergue des dimensions originales de la propriété. / Burials are often considered in terms of acceptions or superimpositions of notions: family co-ownership, family property, off-trade affairs, joint possession, specific real right… This multi-entry approach conceals the existence of a right of burial which, as a consequence, is difficult to define as a unified right. The right of burial is divided up into various branches— civil law, criminal law, public law—which rise various questions linked to the very nature if the different systems. For this reason, it is necessary to tackle the right of burial from the point of view of its foundations, which have not changed since the establishment of Roman law and Medieval law.The first founding principle concerns the sacred; the second is about the community. Both originate in legal history and are still valid in the field of positive law. They show a unity in the right of burial as regards two main functions: ensure the separation between the living and the dead and keep up the traditional practice of ancestor worship. From the anthropological viewpoint, the sacred—the first principle—distinguishes from the religious, and is expressed in two main missions: the definition of a frontier between the sacred and the profane by the separation, then the protection of this new space delineated by the suppression of any violation. For the burials, these two missions are respectively accomplished by a position out of commerce and by the criminal procedure. The first mechanism comes from Roman law and shows an original protection of the burial process; every legal activity which is not incompatible with the respect of the dead is allowed. The other mechanism concerns the incrimination of the violation of the burial process and its sacred nature. The second founding principle is about the community: it was created for family burials by medieval communities, at a time when properties and people were seen as a unique family unit. Nowadays adapted by the family affectation, such a principle is maintained in our legal system because of a collective ownership regime, through the transmission of the succession restricted to the family and an egalitarian principle, which turn burials into a property of the community. Sacred property, property of the community, the founding principles of burials bring to light specific dimensions of the concept of property.

There are analyzed in this dissertation thesis the public services delivered on the municipal level. This issue is analyzed comprehensive at first. There are analyzed six services in detail after then. These are the six following services: waste, cemetery, greenery, communications, lighting and sewage. The text of this thesis is divided into two major units. The first chapter describes the theoretical background of the problem and the methodology for elaboration. The second chapter analyzes the problem of public services in terms of theoretical con-cepts, legal terms and authors own investigation. This chapter analyzes in detail six selected public services. It is completed draft measures for the municipal public ser-vices. The aim of this dissertation thesis is to find out the State-of-Art of public service deli-vering and to purpose possible changes leading to demand approach of municipal service delivering.

Les marqueurs osseux d'activités physiques : une étude des restes humains du cimetière St. Matthew à Québec (XVIIIe et XIXe siècles)

De nombreuses études en anthropologie ont porté sur l’examen d’altérations osseuses en vue de reconstituer les activités physiques des hommes du passé. Notre recherche se distingue dans la mesure où nous avons réuni deux indicateurs pour prédire le comportement physique et l’asymétrie bilatérale des membres. Les squelettes de dix-huit individus représentant des hommes matures provenant de la série ostéo-archéologique du cimetière protestant St. Matthew à Québec ont été sélectionnés. Douze sites d’insertion musculaire ont été mesurés et quatre indices de stress mécanique ont été calculés pour les membres supérieurs et inférieurs. Nous observons des différences par catégories d’âge et les résultats ont permis de constituer quatre groupes d’individus selon le niveau total de stress physique. Les variations observées entre les groupes laissent supposer des modèles spécifiques de comportement physique, qu’il est possible d’associer à des catégories sociales de travailleurs. / Recent bioarchaeological research managed to reconstruct physical activities of certain individuals on the basis of traces left on their skeleton. The integration of two indicators gives a good picture of the physical stress applied on the tissues. Consequently, we integrated bone structural adaptation and muscular modification in order to determine the level of physical stress and to establish the dominant limb implied in certain specialized tasks. We selected eighteen mature men out of the skeletal collection from the St. Matthew protestant cemetery in Quebec city. We recorded twelve muscular and tendinous insertions on a four point scale and measured medio-lateral and antero-posterior diameters to produce four activity related markers on the upper and lower limbs. Variations between the group suggest different models of physical behavior, which can be related to broad social categories of workers.
