Protection et valorisation des recettes et créations culinaires / Protection and enhancement of recipes and culinary creations

Le droit positif français n'est pas en mesure d'offrir une protection aux recettes et créations culinaires. L’Etat, certes, n’est pas insensible à la question. Nonobstant, les mesures existantes ne suffisent pas, tels la mise en valeur du patrimoine culinaire et le droit de l’alimentation. Quant au droit des créations par excellence, le droit de la propriété intellectuelle, il reste étranger à la question. En droit de la propriété littéraire et artistique, les droits d'auteur ne considèrent pas les créations culinaires comme des oeuvres de l'esprit. Seules les créations envisagées sous leurs aspects littéraire ou esthétique peuvent, sous certaines conditions, être prises en compte par ces droits. En droit de la propriété industrielle, le brevet, le dessin et modèle et la marque apparaissent comme des titres protégeant de façon inappropriée les recettes et créations culinaires. Le secret et le savoir-faire constituent, quant à eux, des éléments de protection mais a posteriori seulement. Par conséquent, une évolution des droits d'auteur apparaît nécessaire en réponse aux attentes des métiers de bouche, potentiellement par un revirement de jurisprudence. Qui plus est, il semblerait idéal qu'un système sui generis puisse voir le jour. Dès lors, les créateurs culinaires auraient la possibilité d’utiliser le certificat de création culinaire afin de valoriser leurs recettes et créations culinaires. / There is no protection provided by the French positive law regarding recipes and culinary creations. Nevertheless, the government is working on it. This lack of rights does not allow the development of matters such as culinary heritage and food law. While IP rights are inadequate, copyright law proves few considerations of those creations. In fact, only literary and artistic creations may, in certain circumstances, be taken into account by the copyright law. So, IP rights are not the better way to protect recipes and culinary creations. Secrecy and know-how can be considered as prospective but only retrospectively. Therefore, a change of copyrights law is necessary in response to the expectations of the food business, perhaps by departing from previous case law. The problem of copyrights recently is one of the most relevant, talking about legal aspects of information society. The objective risk of expropriation of sofware or various documents arises, while using communicative network, which is very popular among members of the society nowadays, without compliance with authors. This concerns the lack of legislation, which should regulate the rights of using the software, variuos files or production situated in the network. The problem of copyrights is the most relevant for data put in the net, as communicative web has become more and more popular source of information lately. Practice evidences, that protection of intellectual property only by means of civil defence of copyrights, is not possible, therefore administrative and criminal responsibility carries out an important role. Consequently, the administrative and criminal responsibility for violation of intellectual property will be analysed in the final work. The peculiarities of violation of administrative and criminal responsibily were not studied widely by any of the lithuanian authors. While improvement of information technologies is increasing, thereby it is essential to sift legal laws regulating administrative and criminal responsibility for violation of these rights, taking into consideration both theoretical and practical aspects. A presente dissertação se propõe a analisar a interação entre o sistema internacional de direitos humanos e o sistema internacional de propriedade intelectual e as implicações desta relação para o ordenamento jurídico brasileiro, no que concerne especificamente aos direitos de autor e direitos conexos. No ano em que o Acordo TRIPS completará vinte anos, é oportuna a reflexão a respeito da efetividade de suas regras, especialmente quanto à capacidade de interagir com os demais sistemas jurídicos internacionais, especialmente o sistema internacional de direitos humanos. A leitura da seção de princípios e regras gerais (especialmente do artigo 6°, referente à exaustão de direitos) e da seção relativa aos direitos de autor do Acordo TRIPS (especialmente do artigo 13, que estabelece a Regra dos Três Passos) parece indicar para a previsão de limites à exploração destes direitos em vistas dos objetivos de promoção do desenvolvimento e de equilíbrio de interesses entre, de um lado, autores e titulares e, de outro lado, utilizadores das obras artísticas e literárias protegidas. Contudo, tem se verificado que o sistema internacional de propriedade intelectual tem caminhado na via contrária. Com a proliferação, particularmente na última década, de acordos bilaterais e de livre comércio, temos assistido à propagação indiscriminada das denominadas regras TRIPS-plus, caracterizadas pela previsão de padrões mais rígidos para a proteção da propriedade intelectual em comparação àqueles previstos pelas regras do sistema multilateral de comércio, o que tem dificultado a aplicação de regras mais flexíveis e que possibilitam mais facilmente a adoção de políticas públicas focadas no desenvolvimento econômico e social dos Estados-membros da OMC. Em paralelo, visando a coibir eventuais abusos praticados pelos Estados em suas políticas de direitos de autor, o sistema internacional de direitos humanos que, por meio dos Pactos Internacionais de Direitos Civis e Políticos e de Direitos Econômicos e Sociais, busca estabelecer o equilíbrio dos interesses dos autores e usuários, em vista do aparente conflito entre os direitos fundamentais de primeira e segunda dimensões, caso dos direitos de autor e dos direitos de acesso ao conhecimento e à educação, respectivamente. Neste sentido, destacam-se, além das ações promovidas pela UNESCO para a ampla disponibilização de material de educacional para instituições de ensino e bibliotecas, a iniciativa capitaneada por Brasil e Argentina junto à OMPI, a conhecida Agenda para o Desenvolvimento, que tem revolucionado o modo como administrar as regras previstas nos tratados da OMPI, especialmente a Convenção da União de Berna. Por meio da Agenda para o Desenvolvimento foram propostas novas maneiras de se pensar e reconstruir o direito internacional da propriedade intelectual, levando em consideração o fortalecimento do domínio público, a disponibilização de material educacional em larga escala e acesso à informação por parte dos grupos hipossuficientes, começando pelos deficientes visuais. Alinhado às discussões nos foros multilaterais, o Brasil está passando por uma fase de reforma da Lei de Direitos Autorais, a qual tem na revisão das limitações aos direitos de autor, consubstanciadas no artigo 46, um dos principais pontos de atenção e insatisfação social, em vista das restrições atualmente impostas para a reprodução integral de obras artísticas e literárias. Ainda, o sistema nacional de direitos de autor tem sido desafiado pelas novas tecnologias e formas de promover o acesso à educação no sistema público de ensino. Assim, a proposta de propagação do material de ensino por meio de recursos educacionais abertos, em que o autor ou titular autoriza, no momento da aquisição do material pelo Estado, a reprodução, atualização e distribuição futura do material didático, sem que seja necessária nova autorização a cada tiragem ou alteração do conteúdo pelo corpo de professores. Em estrutura, o trabalho se divide em quatro capítulos. O primeiro capítulo (Direitos de Autor na Ordem Internacional) analisa o sistema internacional de propriedade intelectual, com foco nas regras internacionais relativas aos direitos de autor. O Segundo Capítulo (Interface entre Direitos de Autor e Direitos Humanos) aborda a presença dos fundamentos dos direitos humanos na estrutura dos direitos de autor e sua influência nas atuais demandas desta matéria. O terceiro capítulo (Direitos de Autor sob a Perspectiva Constitucional) analisa o sistema brasileiro de direitos de autor e as garantias fundamentais que envolvem este aparente conflito. Por fim, o quarto capítulo (Limites na Prática) apresenta o posicionamento da jurisprudência nacional e internacional sobre a matéria. / The main goal of this dissertation is to investigate the interaction between international human rights law and the international intellectual property system, as well as the implications of this relationship to Brazilian copyright system. In the year when TRIPS Agreement is turning twenty years old, it is proper to reflect about the effectiveness of its rules, especially the ability to interact with other international legal systems, mainly the international human rights system. In the sections about general principles and rules (v. article 6, regarding exhaustion of rights) and copyrights (v. article 13, regarding Three Step-Test), TRIPS seems to indicate the limits for the exploitation of IP rights, bearing in mind promoting the development and balancing of the interests involved, mainly those related to authors and users of copyrights. However, it has been found that the international intellectual property system has moved in the opposite direction. International trade system have witnessed the proliferation of bilateral and free trade agreements, which contain indiscriminate TRIPS-plus rules, more restrictive than the rules established for the multilateral system, which obstacles the implementation of more flexible rules focused on economic and social development, allowed by WTO system. In order to curb abuses practiced by its Member States, the international human rights system, through the International Covenants on Civil and Political Rights and Economic and Social Rights, seeks to establish a balance between authors and users interests, considering the apparent conflict between fundamental rights of first and second dimensions, case of copyrights and access to knowledge and education, respectively. In this sense, must be mentioned the actions promoted by UNESCO to make available educational materials for institutions and libraries, and the initiative headed by Brazil and Argentina, the well-know WIPO Development Agenda, which has proposed a revolution in the manner how States should interpret the rules established in the treaties administered by WIPO, mainly the Berne Convention. New ways of thinking and rebuilding the international intellectual property law are being taken into account, like strengthening the intellectual goods in public domain, increasing the availability of educational material on a larger scale and conceding access to information to vulnerable groups, starting with visually impaired person. Considering this scenario, Brazil is reforming its Copyright Law. The role of limitations to copyrights, embodied in the article 46, is one of most important issues in the mentioned reform, and society is expecting for structural changes, especially because of the general dissatisfaction with the restrictions imposed by law for the reproduction of intellectual works. Still, the national system of copyright has been challenged by new technologies and new ways to provide access to education in the public school system. Thus, proposals like Open Educational Resources, which allows the State, upon previous authorization from the author, to reproduct, update and distribute of educational materials in a large scale. The dissertation is divided into four chapters. The first chapter (Copyrights in the International Order) analyzes the international intellectual property system, focusing on international copyright law. The second chapter (Interface between Copyrights and Human Rights) discuss the human rights framework and the influence of this system on IP Law. The third chapter (Copyright according the Constitutional Perspective) studies the Brazilian Copyright System considering the fundamental guarantees involved. Finally, the fourth chapter (Limits in Practice) analyzes national and international court cases about the matter.

[pt] Desde o início do século XXI, com o avanço das plataformas digitais, a imprensa tradicional perdeu parte de sua principal fonte de receita, a publicidade, para novos integrantes da cadeia jornalística, sobretudo Google e Facebook. Posicionando-se como distribuidoras do material noticioso, as big techs passaram anos lucrando sem remunerar as empresas de mídia pelo conteúdo produzido. Nesse contexto neoliberal, alicerçado pela utopia da internet como um território livre e democrático, a presente dissertação analisa a cobertura do jornal O Globo a respeito da regulação de direitos autorais na internet, base legal para que as plataformas remunerem os produtores do conteúdo jornalístico. O referencial teórico é a Economia Política da Comunicação e sua abordagem crítica sobre o conhecimento construído no mundo a partir das relações de poder nas esferas econômica, social e política. A metodologia utilizada foi a Análise de Conteúdo, a partir de um corpus de 41 matérias, além de nove editoriais e artigos de opinião, publicados entre 2016 e 2022. Aliado a um olhar qualitativo, o ferramental quantitativo revelou o despertar tardio da empresa para a questão em análise - que afeta a viabilidade do modelo de financiamento jornalístico e, consequentemente, a sobrevivência corporativa de O Globo. / [en] Since the beginning of the 21st century, with the advancement of digital platforms, traditional press has lost a significant portion of its main revenue source, advertising, to new players in the journalistic chain, mainly Google and Facebook. Presenting themselves as news distributors, big tech companies have been profiting for years without compensating media companies for the content created. In this neoliberal context, based on an utopian idea of the internet as a free and democratic territory, this dissertation analyzes O Globo newspaper s coverage regarding the regulation of copyright on the internet, which provides a legal basis for platforms to remunerate journalistic content producers. The theoretical framework is the Political Economy of Communication and its critical approach to the knowledge constructed in the world based on power relations in economic, social, and political spheres. The methodology used was Content Analysis, based on a corpus of 41 articles, in addition to nine editorials and opinion pieces, published between 2016 and 2022. In conjunction with a qualitative approach, the quantitative tools revealed the company s late awakening to the issue under analysis - which affects the viability of the journalistic financing model and, consequently, O Globo s corporate survival.

著作肩負著人類對文化傳承、藝術發揚及知識分享的重責大任,影響深遠,自應創造因誘因加以鼓勵並給予適當的法律保障;惟現代著作權法保護創作人的思維均藉由「創作完成自動保護」的途徑,賦予創作人各種著作人格權及著作財產權,一改往昔仍須藉由註冊審查或登記列冊方能享有著作權的傳統作法。然而,任何偉大的著作,其價值乃貴在廣為利用方能源遠流傳,前述各類創作人是否分享或放棄著作權之意願,由法律自動保留全部權利(all rights reserved)的預設(default)立場,使得利用人在利用著作或接續創作的平台受到重重的限制,除了能符合較抽象的「合理使用」範疇以外,利用著作前均須依法取得權利人之同意或授權方能免除因此所生侵權責任。 對於一向主張著作應視為公共財的自由派學者,前述加諸廣大利用人動輒得咎的法律限制,顯然會認為對於知識分享擴散造成阻礙的結果無法忍受,於是美國史丹福大學Lawrence Lessig教授即於2002年間號召有識之士,倡導「Creative Commons」(本研究稱為「創作共享」)之運動,藉由「保留部分著作權」(some rights reserved)的理念,設計鬆綁著作權法以釋出著作權的機制,現正積極在世界各國間推廣中。 本研究即針對上述理念之興起,思考此一創新機制與知識分享擴散及著作權保護間有無相關,並試圖找出可能直接影響機制之關鍵因素提供建言。在第一章部分,除敍明研究動機、目的、範圍、限制外,更直指本研究之問題所在及預期之貢獻;第二章即針對研究主題,包括過去對著作權保護、創作共享機制、知識分享擴散及制度創新的研究進行文獻探討,第三章則對研究核心創作共享機制具體實踐之契約條款予以法律剖析檢驗,並釋疑部分易為外界混淆或誤解之觀念;第四章則詳細闡明研究方法後,設定各個命題及假設,並各賦予操作化定義,落實為問卷調查之問題及選項,第五章則以立意取向調查方式發放及回收共547份有效問卷,並以11.0版SPSS軟體執行問卷數據分析並進而出各項判讀,印證前述命題及假設相關程度,另從管理意涵賦予各項解讀之詮釋;第六章則藉由坊間已先後運行的四個類似創作共享機制的個案,將前述檢驗的內外因素、體質因素、驅動因素等研究構面逐一比較,第七章即就研究成果列出結論並提出後續研究之建議以供來者繼續接棒發揚。 / Creative work carries the responsibilities of cultural inheritance, artistic manifestation, and knowledge sharing; its influences are far reaching and the work ought to be encouraged and properly protected by law. In contrast to traditional copyright laws, whereby protection was given only after registration or examination, current copyright laws give protection to creative work upon its completion, and provide the creator with all kinds of moral integrity rights and copyrights. However, the value of a masterpiece lies in its widespread use, and the current legal system gives the creator, by default, all rights to reserve their intention to share or forfeit their copyrights. From the user’s standpoint, this protective system means limitations and restrictions in using creative work or in continuing creative platform—requiring the user to obtain agreement or license from the rights owner for any use of the work outside the scope of “fair use.” Liberal scholars who believe creative work ought to be public property find these legal restrictions on users and limitations on the proliferation of knowledge sharing intolerable. In 2002, under the appeal of Stanford’s Professor Lawrence Lessig, the movement for Creative Commons was begun. Under this model, relaxation of copyrights with some rights reserved is called for, and this idea is being widely promoted throughout the world. This study focuses on the development of this new ideology and examines its relationship with the proliferation of knowledge sharing and copyrights protection, and further inspects the key factors that may directly influence this new mechanism as well as provides necessary suggestions. Chapter One explains the motivation, purpose, scope, and limitation of this study as well as pointing out the problems and expectations of this study. Chapter Two focuses on the main theme of this study, including empirical studies on past copyright protections, creative commons mechanism, proliferation of knowledge sharing and innovation of its system. Chapter Three examines the legal aspects of the creative commons licensing agreement and clarifies the parts that are confusing or can be easily misunderstood. Chapter Four explains the research approach and sets up theories for each topic, and defines the procedures for selecting questions for the survey. Chapter Five analyzes the 547 valid surveys, which were distributed using the conceptual approach, using v.11.0 of SPSS against the topic and theories set forth in the previous chapter, and interpret each item in the survey via management connotation. Chapter Six compares four existing mechanisms similar to the creative commons model in terms internal and external factors, physical factors, and driving factors. Chapter Seven discusses the results of this study and states suggestions for subsequent research.

[pt] O objetivo principal da presente dissertação é discutir a dinâmica dos relacionamentos entre estados, e entre estado e sociedade, que giram em torno da produção e do acesso ao conhecimento, entendido como o estado da arte, da ciência e da tecnologia e as crenças e idéias de cada época a esse respeito. O exame desses relacionamentos será feito através do estudo do regime da Propriedade Intelectual, o que torna necessário discutir as teorias de regimes a fim de entender sua importância nas relações internacionais. Trata-se, portanto,de duas discussões interligadas, cada uma em seus aspectos substantivos, que levam a conclusões tanto a respeito da importância dos regimes como a respeito da dinâmica dos relacionamentos que giram em torno da produção e do acesso ao conhecimento. Minha proposta é discutir os dois temas centrais desse trabalho através da análise de como aconteceram as mudanças no regime internacional da propriedade intelectual e a mudança de regime. As mudanças serão identificadas a partir dos instrumentos legais que constituem o regime, dos debates sobre a adoção de agendas de revisão desses instrumentos legais, e do exame das coalizões formadas em função dos interesses particulares dos atores em cada um dos diferentes foros de negociações. Outra contribuição que esse estudo pretende trazer é uma pesquisa da literatura sobre o tema da propriedade intelectual que adota abordagens teóricas e ferramentas analíticas da disciplina de Relações Internacionais. / [en] The proposal of this work is to discuss the dynamics of interactions between states and between states and society, in which the main object is the production and access to knowledge - here understood as the state of the art, science and technology, and the beliefs and ideas about it. This dynamics is analyzed through the study of the Intellectual Property International Regime, what makes it necessary to discuss also regime theories and the meaning of regimes to International relations. Two separate and interconnected discussions will be developed, each one with its own aspects, and will bring us to conclusions both about the importance of regimes and about the dynamics of interactions on production and access to knowledge. The two main discussions are advanced through the analysis of regime changing. The changes are identified on the legal instruments which constitute the Intellectual Property regime, through the analysis of the debates over the agendas of revisions on these legal instruments, and through the exam of the coalitions created around particular interests of the actors in each of the different forum of negotiations. Another contribution this study intends to bring is a research on the literature about Intellectual Property that takes a theoretical approach and uses analytical tools of the discipline of International Relations.

Musiikkialan tekijänoikeuksien kesto, ansaintalogiikat ja digitaalisen aineiston saatavuus internetissä

Abstract This study addresses the justifications of the duration of copyright, the revenue-generating models in the music business, and the availability of digital music in Finland. The first goal was to understand how different stakeholders in the music industry relate to copyright and how they justify what they consider the optimal duration. The second goal was to map out the revenue-generating models in the music industry at a time when the consumption of music has changed from analogue to digital formats, from physical products to streaming services. The third goal was to find out the different ways in which digital music is available on the internet in Finland. The research material consists of survey research, half-structured theme interviews and documentary material. The applied research methods are theory- and material-based content analysis. The theoretical approaches utilized are the theory of justice by John Rawls, the theory of hegemony by Antonio Gramsci, the classical communication model by Roman Jakobson, and power theory by Lawrence Lessig. It uses as its interpretational theory the model of justification of copyright by Laura Leppämäki. The results state the following: The most common justification provided for the optimal duration of copyright is utilitarianism – advantage to society as a whole. The same justification is given by stakeholders who want to keep the duration as it stands, and also by those who wish to shorten it. Another common justification is to see copyright as a natural item of ownership, claimed by work, and especially as a subject of inheritance, preferably for two subsequent generations. The problems concerning the revenue-generating models in the digital world tend to focus on distribution of income on three different levels: record contracts; the distribution models of the streaming companies; and contracts between content sharing companies, record companies and rights organizations. The authors and artists have the weakest bargaining position in the negotiations. The results on availability of digital music show that digital music can be discovered via public services (music libraries), commercial services (streaming companies), and ad hoc societal services (peer-to-peer networks). The role of music libraries as a content provider has decreased since the majority of music consumption has altered to digital services. / Tiivistelmä Tutkimus käsittelee musiikin tekijänoikeuden keston perusteluja, musiikkialan ansaintalogiikoita ja digitaalisten musiikkiaineistojen saatavuutta Suomessa. Tarkoituksena oli hahmottaa, miten musiikkiteollisuuden eri osapuolet suhtautuvat tekijänoikeuteen ja miten ne perustelevat tekijänoikeuksien optimaalista kestoa. Tavoitteena oli myös kartoittaa musiikkialan ansaintalogiikat, jotka ovat muuttuneet siirryttäessä analogisesta musiikin kulutuksesta digitaaliseen musiikin kulutukseen, ennen kaikkea suoratoistopalveluihin. Kolmantena tehtävänä oli selvittää, millä tavoilla digitaalista musiikkia on saatavilla internetin välityksellä Suomessa. Tutkimusaineisto koostuu kyselytutkimuksesta, puolistrukturoiduista teemahaastatteluista sekä dokumenttiaineistosta. Tutkimusmenetelmänä käytettiin sekä teoria- että aineistolähtöistä sisällönanalyysia. Tutkimuksessa sovellettuja teorioita ovat John Rawlsin oikeudenmukaisuusteoria, Antonio Gramscin hegemoniateoria, Roman Jakobsonin klassinen kommunikaatiomalli ja Lawrence Lessigin valtateoria. Tutkimus käyttää tekijänoikeuksia koskevan tutkimuskysymyksen kohdalla tulkintateoriana Laura Leppämäen esittämää mallia oikeuksien perusteluista. Tutkimuksen tuloksena on, että sekä tekijänoikeuden nykyistä kestoa että sen lyhentämistä perustellaan ennen kaikkea utilitarismilla. Toinen keskeinen perustelukeino oli työn kautta teoksiin saatava omistusoikeus ja tämän omistusoikeuden kautta tarjoutuva mahdollisuus oikeuksien jättämiseen perintönä tekijän jälkipolville. Ansaintalogiikoiden kohdalla esiin nousi digitaalisesta myynnistä generoituvien tulojen jakamiseen liittyvät ongelmat, joita esiintyy niin musiikintekijöiden ja levy-yhtiöiden välisissä sopimuksissa, suoratoistopalvelujen sisäisissä maksumalleissa kuin internetin alustapalveluiden ja oikeudenhaltijoiden sekä heitä edustavien järjestöjen välisissä sopimuksissa. Heikoimmassa asemassa sopimuksia koskevissa neuvotteluissa ovat musiikintekijät ja artistit. Digitaalisen musiikkiaineiston saatavuuden kohdalla keskeisenä tuloksena on, että aineistoa on saatavilla julkisen palvelun eli yleisten musiikkikirjastojen, kaupallisten palveluiden eli suoratoistopalveluiden ja yhteisöllisten palveluiden eli vertaisverkkojen välityksellä. Musiikkikirjastojen rooli aineistojen tarjoajana on pienentynyt siirryttäessä analogisen musiikin kulutuksesta digitaalisen musiikin kulutukseen.
