It turns out that part of the doctrine and the jurisprudence opposed barriers to the application of the referred legal dispositive to the procedural labor law, for they understand that it would not be fulfilled the requirements set out in article 769 of the CLT. In other words, under the arguments that there is no gap in the labor process ordinance and that the analytical reasoning would be incompatible with the procedural labor law. On the other hand, the other part of the doctrine and jurisprudence holds that the analytical reasoning is an important legal mechanism in combating judicial activism present in the labor courts, supporting the completion of the requirements set out in the law for implementation of common standards in labor process. Therefore, the doctrinal and jurisprudential debate, it abides to this work to address scientifically the question inherent in the requirement of analytical reasoning of judicial decisions in the labor process, mainly aiming to submit a proposal of a solution to this problem. After long research stabilized in doctrine and jurisprudence, it reaches two main conclusions. The first is that the article 489 of the CPC is not incompatible with the systematic and principiology of the procedural labor law, which is, therefore, perfectly applicable supplementarily to the labor process, before the existence of partial regulatory gap in CLT. Finally, the second conclusion is that it is essential that they are committed to efforts for the creation of a Code of Labor Procedure that contains sufficient mechanisms for the solution of the problems that plague labor relations in the present days, because, only that way, the labor process will return to have its vanguard status of a rapid, simple and effective process model, pursued by other procedural systems.

In infraconstitutional legislation it was already present in the procedural documents of 1939 and 1973. However, the Code of Civil Procedure of 2015 sought to improve what is already provided for in constitutional and infraconstitutional legislation. The present study draws an analysis of art. 489, paragraph 1, of the Code of Civil Procedure of 2015, explaining what cannot be considered a reasoned decision. More specifically, subsection IV of the article, which provides for the obligation of the judge to face all the arguments brought by the party who, at least in theory, can contradict the conclusion adopted in the decision and, therefore, to base a position different from that of the judgmental. As the excessive volume of litigation that has weakened respect for the duty to state reasons has become more frequent among us, through decisions based on ready-made utterances of empty character. The idea of said device is to reinforce that the magistrate cannot choose the arguments of the succumbing party that wants to face. It ceases to be relevant in the process only what the magistrate arbitrarily believes to be worthy of consideration, and everything that could lead to a result different from that obtained has become important. The purpose of art. 489, paragraph 1, subsection IV, of the Code of Civil Procedure of 2015 is that if the decision does not analyze all the fundaments of the succumbing thesis, whether invoked by the author or defendant will be considered invalid for lack of reasoning. And the lack of reasoning goes against the constitutionally foreseen, thus facing the Democratic State of Law. O presente estudo tra?a uma an?lise do art. O objetivo do art.

No. of bitstreams: 1 468576 - Texto Parcial.pdf: 251154 bytes, checksum: cd0e4dc1bde63e9bc3163143fb40d034 (MD5) Previous issue date: 2015-02-26 / In the Paternal Procedural System (PPS of 1973 and the new PPS), implement the suspension rule of sentence effects in the event of an application for appeal, which is longer included by the legislature only for certain sentences categories exhaustively indicated in the Civil Procedure Code and externally to this, in fancy law. The main problem of the existence of this rule is the fact that this constitutes an insurmountable obstacle to the effectiveness of those sentences that have no immediate effect under the Law, but, however, need it by the tutelary right equipment at the risk of damage or extinction, and therefore, cannot even wait for the deadline on which proceedings were an appropriate resource to be satisfied and issued to its holder, problem which, therefore, must be addressed in the light the procedural content of the 1988 Federal Constitution and of the fundamental rights applicable to the Civil Proceedings, and with particular emphasis, of the adequate right-guaranteed fundamental to the judicial, timely and effective protection. In both the 1973 PPS and the new PPS, the solution is found in their own national plan by applying the technique of granting ope judicis immediate effectiveness, i.e., through the use of anticipatory provision in the sentence or upon appeal in order to remove the suspension and to release the immediate execution. To verify the legitimacy of the proposed solution, this study made use of the Application Method of the proportionality principle proposed by Robert Alexy, through which it was observed that the ope judicis immediate effectiveness technique of the decision implemented through the application of the Anticipatory Provision in the sentential act or upon appeal constitutes in proportional solution, because (i) protects effectively and timely the law which requires immediate satisfaction, (ii) among that the existing alternative solutions in the legal system reveals itself less harmful to legal security, to the extent that provides immediate effect only to those sentences that really need it, and not to all, thereby preventing the inversion of the damage risk to the parts resulting from the risk of the anticipatory provision irreversibility, as with the adoption of the ope legis immediate effective rule. Thus, constitutes valid, healthy and in full compliance choice to the constitutional model of Civil Procedure, because it protects at the same time, two of the most expensive and essential values and fundamental rights of paternal constitutional order: the effectiveness and legal certainty, given, thereby, the principle of practical harmonization of values to the extent of factual and legally conceivable.

This project is an update and joinment of the criminal laws in a new penal code. To conduct the research, the union of interdisciplinar knowledge areas such as Political Science, Criminology and Sociology has been necessary. We have seeked to delimit the subject of our research to the consumption and sale of narcotics, since it is one of the main problems faced by the penal system nowadays. For such, we have selected the legislative amendments related to the topic and tabulated them, which allowed us to reach some conclusions. We have divided the research in two distinct axes: one dealing the drug prohibition, its theoretical support and consequences, and the other discussing the alternative possibilities to the model, such as harm reduction policies and the drug decriminalization process. The chosen methodology has provided the analysis of the amendments related to the subject, which allowed the researcher to study the parliamentarians' individual ideas, and with the later confrontation, he might realize whether they are similar to the proposals or speeches of the legend. Besides that, the behavior of the left has been according to one of the hypothesis formulated. This behavior can be justified based on the concepts of symbolic penal law and punitive populism / O estudo realizado se prop?e a analisar quais os discursos presentes nas emendas propostas no projeto de lei 236 do Senado Federal.

Made available in DSpace on 2015-04-14T14:34:03Z (GMT). No. of bitstreams: 1 455951.pdf: 118304 bytes, checksum: afd29f3469a4e03dfc247127fe2a27e2 (MD5) Previous issue date: 2014-02-27 / This dissertation focuses on the General Theory of Jurisdiction and Process concentration area of this Master of Laws program, and specifically analyzes the procedure of repeated appeals regarding their effectiveness, instrumentality and legal certainty. The analysis looks into the issues of the goal and purpose of civil procedure, considering how court relief is offered via the higher courts' adjudication of appeals representing the controversy. Based on such parameter, at first we seek to identify the type of legal certainty that should be offered to parties under the court's jurisdiction, encompassing their interactions with the law, the judicial branch, and the very judge. In order to subsequently analyze the procedure of repeated appeals, we also examined the relevant role of procedure-related constitutional principles which would be veritable optimization orders to be applied by law operators and lawmakers, focused on the effectiveness of court relief. The meaning of the principle of due process was looked into, and we point to its character of a true vector-principle that informs the other principles provided for in the constitutional text. The principles of adversary proceeding and the right to be heard have been equally clarified and play a relevant role in terms of influencing judges, so that the court remedy is appropriately offered to the material case under examination. Finally, we present the proper notion of the principle of reasonable duration of the process, which is a recent constitutional command meant to improve court relief by achieving timely court protection. Addressing procedural constitutional principles makes it possible for us to fully understand the procedure of repeated appeals, especially considering the intention of making court decisions even, and may be seen as an adjudication technique that improves court relief in cases currently being considered and future ones. Adopting the sample-based adjudication technique may be considered an approximation of Brazil's legal system to common law, although gaps still remain which must be bridged so the appeals system may be better used. The judge has some latitude to issue decisions on appeals representing the controversy, which latitude must be duly understood so that the legal solution given is according to the best apprehension of the legal problem faced, considering that it is used for repeated claims. The new Code of Civil Procedure draft improves the sample-based adjudication system and fills in the omissions found in articles 543-B and 543-C of the Code of Civil Procedure. Although it is still subject to criticism and future improvements, we can say that the sample-based adjudication technique will be improved by the new procedural rules being set up. Finally, it should be noted there are alternatives that may be added to the procedure of repeated appeals, whether by means of rediscovering collective relief or via binding or barring Supreme Court precedents, or through the new repeated appeal resolution model, everything in an effort to provide parties under a court's jurisdiction with legal security in repeated litigation.

Evangelism and folk Islam: a case study in South Coast Kenya

Nyagwoka, Joseph B., 1971- 09 1900 (has links)
The Islamic religion has become a challenge to Christianity due to its rapid growth around the world today. Christianity and Islam are both devising strategies on how to reach out to each other with their conflicting messages. Christian missiologists have come up with several approaches of doing Mission to the Muslims. However, because of the Islamic practices and beliefs that vary in different contexts or from place to place, some of the approaches are not effective in some areas. The nature of the cultural context has more often made it progressively difficult for the Christian churches and missionaries to do Mission among the Muslim countries, including those at South Coast of Kenya, the Digo folk Muslims. The call for a suitable understanding of an evangelism approach among the Digo folk Muslims is an essential concept for an effective Mission to them. There is no doubt that in Digoland, there is still a great challenge in evangelising the Digo people. Even though currently there is a good number of un-indigenous churches in this area, the problem remains that the Digo Muslims have not effectively responded to the Gospel of Jesus Christ at large. It is also clear that the evangelism approaches that the Christian churches are using have not been effective. This thesis analytically examines evangelism approaches to Mission among the Digo folk Muslims by seven selected Christian churches from different denominations in the South Coast of Kenya. The study investigates the effectiveness of the evangelism approaches, which these churches are using with the Digo folk Muslims in sharing the gospel. Mostly using data collected from oral interviews, the study finds that Mission involvement to Digo Muslims is slow and not as effective as evidenced by the small number of the Muslim background believers in the selected churches. The churches and the Muslim background believers face challenges that include fear due to threats from the Muslim community as they perceive the Christians as adversaries who are stealing their members. Moreover, the few Muslims are, at times threatened with death. The churches also face challenges from the lack of effective training in Muslim evangelism in context including the financial constraints for Muslim Mission in the area. The research concludes that significantly, there is a need for the selected churches to reexamine and reconsider their evangelism approaches to Digo folk Muslims with a view to improving their ways of engaging in sharing the gospel with them. Finally, the study formulates and proposes a practical biblical model for effective Mission to these Digo Muslims. / Christian Spirituality, Church History and Missiology / D. Th. / DNA sequences for species-level identification of biological materials have achieved considerable popularity in the last few years, especially in the context of the DNA barcoding initiative. Species assignment of biological samples such as hairs, feathers, pelts and particularly faeces is a crucial step for those interested in studying ecology and evolution of many species with these samples. This is especially the case for carnivores, whose elusive habits and low densities highlight the importance of studies based on noninvasive samples. However, the current lack of standardized assays for carnivore identification often poses challenges to the large-scale application of this approach, as well as the cross-comparison of results among sites. Here we evaluate the potential of two short (<250 pb) mitochondrial DNA (mtDNA) segments located within the genes ATP synthase 6 and cytochrome oxidase I as standardized markers for carnivore identification. Between one and eleven individuals of 66 carnivore species were sequenced for one or both of these mtDNA segments and analyzed using three different approaches (tree-based, distance-based and character-based), in conjunction with sequences retrieved from public databases. In most cases, conspecific individuals had lower genetic distances from each other relative to other species, resulting in diagnosable monophyletic clusters. Notable exceptions were the more recently diverged species, some of which could still be identified using diagnostic character attributes, species-specific haplotypes, or by reducing the geographic scope of the comparison (restricting the analysis to a single zoogeographic region). Additional in silico analyses using a short cytochrome b segment frequently employed in carnivore identification were also performed aiming to compare performance to that of our two focal markers. We then tested the performance of these segments in the identification of carnivore faeces via three case studies: (i) felid faeces collected in a controlled zoo experiment, aimed at assessing whether DNA from rabbit prey would contaminate the resulting sequences; (ii) field-collected faeces from the Brazilian Cerrado presumed to be from maned wolves and containing prey remains (hairs, bones, feathers), aimed at investigating the efficiency of predator identification and occurrence of prey DNA interference; and (iii) field-collected scats from an Atlantic Forest study site, also addressing the issue of PCR success rate and identification efficiency. In spite of some relevant differences in some aspects of their performance, our results indicate that both of our focal segments have a good potential to serve as efficient molecular markers for accurate species-level identification of carnivore samples.

In order to do so, it critically investigates the propositions used in the preliminary hearing of conciliation or mediation brought by the Civil Procedure Code of 2015 (CPC/15). From a deductive approach method, starting from the ideas related to the transformation occurred in the society and, consequently, going through the consolidation of new forms to regulate litigation ? adequate methods of conflicts resolution ? concluding with the analysis of the preliminary hearing that aims the reach of consensus, foreseen in article 334 of the CPC/15. It can be concluded that a culture of consensus is not achieved by imposing a legal device, but through policies that effectively encourage its application, which cannot be restricted solely to the Judiciary. Therefore, the preliminary hearing, in essence, is beneficial to the realization of a jurisdictional policy, once it allows a consensual dialogue before a statement of defense is offered. If critically considered the models exposed by the legislator, there is a distortion in its arguments, which in article 334 prioritize the reduction of numbers through a legal imposition, thereby becoming indifferent or even harmful its application, as it ends up being considered only a mere procedural step.
