Previous issue date: 2016-09-15 / The research has aimed at identifying the procedure of mortgage execution and the difficulty faced by mortgage creditors, both in what concerns running the administrative process as anticipated by Lei nº 9514/97, as well as the lawsuit, provided for in the Civil Procedures Code. The work presents an introduction that nominates the legislative framework from Lei nº 9.514/97 and it points out the problems identified from the application of the mentioned law. After that, the questions regarding the mortgage execution were presented in two chapters, the second one being dedicated to the administrative process and the third to the actual lawsuit or judicial execution. To conclude, the work analyzes the application of the theory of substantial compliance and in its conclusion brings an analysis of all questions pointed and suggestions towards the improvement of procedures related to collateral issues. / A pesquisa buscou identificar o procedimento de execução da garantia real de alienação fiduciária e as dificuldades enfrentadas, tanto no âmbito da execução extrajudicial conforme prevista na Lei nº 9514/97, quanto no âmbito da execução judicial, prevista no Código de Processo Civil. O trabalho apresenta uma introdução que indica o marco legislativo da Lei nº 9.514/97, os problemas identificados a partir da aplicação da lei. Em seguida, foram apresentadas as questões relevantes da execução da alienação fiduciária de imóvel em dois capítulos, o segundo dedicado à execução extrajudicial e o terceiro capítulo dedicado à execução judicial. Para finalizar foram realizadas análises sobre a aplicação da teoria do adimplemento substancial do contrato e uma breve análise sobre as questões apontadas, indicando sugestões para melhoria dos procedimentos relacionados à garantia real, bem como, sugerindo temas para novos estudos e debates.

On the other hand, the society is increasingly seeking for a more efficient, non-bureaucratical and speedier access to justice. However, this access is not being possible through traditional means of conflict resolution, what means lawsuits. Actually, the Judiciary seems inadequate in order to attend a constantly growing number of procedures and law professionals do not have awareness that we must privilege the pacification culture over the litigation culture. Therefore, due to so many crisis, either in Judiciary, in State, in the university legal education, it is necessary to find ways to provide practical and real effectiveness to make the access to justice as a citizen fundamental right, consequently, contributing to promote social, human and economic development in the democratic rule-of-law State. To achieve this objective, it must exist a join effort of society, legislators, legal scholars and students, in order to change the paradigm of a dogmatic and archaic legal education, which has its foundations in the history of a centralized and absolute Law, guided by utilization and application of what the laws dictate. This overpassed educational method, nowadays countered by several jurists, always withdrew the critical and interpretational power of the people, as it is evident in studies of the jurist theoretical common sense. Considering those aspects, this work aims to disseminate the phenomenon of extrajudicial conflict resolution as a new paradigm to be adopted for a legal education dedicated to alternative dispute resolution founded in negotiation techniques and game theory. / A experiência prática de disciplinas oferecidas nos cursos de direito das universidades federais brasileiras mostra que o ensino jurídico não está acompanhando as transformações sociais contemporâneas. Por sua vez, a sociedade vem buscando cada vez mais um acesso à justiça que seja célere, eficiente e desburocratizado. Todavia, esse acesso não tem sido possível através do meio tradicional de solução de conflitos, que é a prestação da tutela jurisdicional pelo Estado-juiz. Na verdade, o que se verifica é a insuficiência do Poder Judiciário para atender um número sempre crescente de demandas processuais e a falta de consciência dos operadores do direito de que é preciso privilegiar a cultura da pacificação, em detrimento da cultura da litigância. Assim, diante de tantas crises, seja do Poder Judiciário, seja do Estado, seja da educação jurídica universitária, faz-se necessário encontrar caminhos para que se dê efetividade prática e real de acesso à justiça como direito fundamental do cidadão, contribuindo, assim, para promover o desenvolvimento econômico, social e humano no Estado democrático de direito. Para que isso ocorra, é necessário um esforço conjunto da sociedade, dos legisladores, dos estudiosos do direito, dos docentes e discentes, no sentido de mudar um paradigma de educação jurídica dogmática e arcaica que tem suas origens na história de um direito centralizado e absoluto, disciplinado pela utilização e aplicação do que ditam as leis. Essa forma superada de educação, combatida atualmente por vários juristas, sempre tirou das pessoas o poder de interpretação e de crítica, consoante se evidencia nos estudos sobre o senso comum teórico do jurista. Levando em consideração esses aspectos, o presente trabalho tem por objetivo difundir o fenômeno da desjudicialização dos conflitos como um novo paradigma a ser adotado para uma educação jurídica que se volte para a prática da atividade advocatícia negocial, fundamentada por técnicas de negociação e pela teoria dos jogos.

O presente estudo enfoca o termo de compromisso de ajustamento de conduta celebrado perante o Ministério Público do Trabalho. Importante salientar que os conflitos de massa trouxeram nova roupagem ao sistema jurídico brasileiro de forma a consagrar e a insculpir o preceito da tutela coletiva. Neste sentido, a efetividade dos direitos metaindividuais ganhou corpo por intermédio das formas extrajudiciais e judiciais de solução de conflitos coletivos, tudo em prol da garantia dos direitos sociais, da paz social e do pleno emprego. A coletivização dos interesses implicou redução dos conflitos trabalhistas individuais, abrangência de interesses de grupo, categoria ou classe, maior observância dos valores sociais do trabalho, conciliando, portanto, os princípios fundamentais e basilares da República Federativa do Brasil. O alicerce dos direitos metaindividuais trabalhistas estrutura-se nos direitos humanos fundamentais e, neste contexto, devem pautar-se as cláusulas mínimas a serem estipuladas no ajuste de conduta como forma de tutela contra as lesões a interesses difusos e coletivos na esfera da relação de trabalho. A defesa da ordem jurídica, do regime democrático e dos interesses sociais e individuais indisponíveis foi conferida ao Parquet Trabalhista na qualidade de órgão agente e consagrada pela Constituição de 1988, dissociando-se, efetivamente, da função eminentemente parecerista (órgão interveniente) até então prevalecente. A estrutura do termo de compromisso de ajustamento de conduta, bem como sua forma de celebração, natureza jurídica, objeto, limite das cláusulas, dano moral coletivo, hipóteses de flexibilização da multa estipulada, competência territorial para assinatura, descumprimento do ajuste, além de outros aspectos polêmicos alusivos ao tema constituem objeto da presente dissertação. Não menos importante é a abordagem do procedimento investigatório e do inquérito civil, instrumentos comumente utilizados no exercício do poder de investigação consagrado pelo artigo 127 da Constituição Federal brasileira à Instituição do Parquet em defesa da ordem jurídica, do regime democrático e dos interesses sociais e individuais indisponíveis. / The present study focuses on the commitment/agreement term of conduct settlement signed before the Labor Public Prosecution Office (Prosecuting Counsel). It is important to stress that the mass conflicts brought new drapery to the Brazilian legal system in order to establish and inscribe the precept of the collective protection/injunction. So, the effectiveness of the metaindividual rights got stronger through the mediation of the extrajudicial and judicial forms of solution of the collective conflicts, everything in favor of the social rights guaranty, social peace and full employment. The collectivization of the interests implied reduction of the individual labor conflicts, coverage of the interests of group, category or class, better compliance of the social values of work, reconciling, therefore, the fundamental and basic principles of the Federative Republic of Brazil. The basis of the labor metaindividual rights structures itself in the fundamental human rights and, in this context, there should be the minimum clauses to be stipulated in the conduct settlement as a form of tutelage against the damages to diffuse and collective interests in the sphere of the working relationship. The defense of the legal system/order, the democratic regime and of the unavailable social and individual rights was given to the Labor Parquet as an agent organ and consecrated by the 1988 Constitution, dissociating, effectively, from the eminently function of giving an option (intervening Organ) prevailing until then. The structure of the commitment/agreement term of conduct settlement, as well as its form of celebration, legal nature, object, limit of the clauses, collective wounded feelings, hypotheses of relaxation of the stipulated fine, territorial jurisdiction for signature, noncompliance of the settlement/adjustment, besides other polemic aspects allusive to the theme are object of the present essay. Not less important is the approach of the investigative proceeding and of the civil investigation, instruments commonly used in the performance of the investigation Power consecrated by the section 127 of the Federal Brazilian Constitution to the Institution of the Parquet in defense of the legal system/order, of the democratic regime and of the unavailable social and individual rights.

L'utilisation du pouvoir discrétionnaire des policiers dans le cadre de la Loi sur le système de justice pénale pour les adolescents (LSJPA)Faubert, Camille 08 1900 (has links)
Le 1er avril 2003, l’entrée en vigueur de la Loi sur le système de justice pénale pour les adolescents (LSJPA) a fourni aux policiers canadiens de nouveaux outils pour procéder à des interventions non-judiciaires auprès d’adolescents contrevenants. Dorénavant, les policiers détiennent le pouvoir officiel d’imposer des mesures extrajudiciaires aux adolescents interpellés pour avoir commis des infractions plutôt que de procéder à leur arrestation formelle. La présente étude vise à déterminer quelles caractéristiques des adolescents et circonstances des infractions ont un impact significatif sur les décisions des policiers d’imposer ces mesures plutôt que de procéder à des arrestations. Les résultats sont basés sur trois échantillons de participations criminelles juvéniles enregistrées par un corps policier canadien entre 2003 et 2010: le premier composé d’infractions contre la personne (n= 3 482), le second, d’infractions contre la propriété (n= 8 230) et le troisième, d’autres crimes (n= 1 974). L’analyse de régression logistique multiniveaux a été utilisée pour déterminer les facteurs — tels que le sexe, l’âge et les contacts antérieurs avec la justice des adolescents ainsi que la localisation dans le temps et l’espace de l’infraction — ont un impact significatif sur le pouvoir discrétionnaire des policiers. Certains facteurs ont une influence universelle d’une catégorie de crime à l’autre, tandis que d’autres ont un impact spécifique selon le type d’infraction commise. / Since April 3rd 2003, the Youth Criminal Justice Act (YCJA) provides police officers with new tools to divert canadian juvenile offenders. Specifically, police officers can officially impose extrajudicial measures to juvenile delinquents instead of handing them directly to the justice system. The current study seeks to determine which characteristics of the offenders and circumstances of the offences significantly impact the decisions of officers to divert cases instead of sending them to the formal justice system. The results are based on three samples of juvenile offence participations recorded by a Canadian police force between 2003 and 2010: the first composed of violent offences (n= 3,482), the second, of proprety offences (n= 8,230) and the third, of other offences (n= 1,974). Multilevel logistic regression analyses were conducted to determine which factors - for example, gender, age, and criminal record of the offender as well as location in time and space of the offence - have a significant impact on police decision-making for each category of offence. Although some factors have similar significant impacts regardless of offence type, others have a differential influence depending on the type of crime that was committed.

search for actual access to courts.
The principle of access to courts is the purpose of this work, which analyzes its
hindrances and the ways to overcome them.
Accordingly, the exposition discusses the right to free legal assistance, as
established by the 1988 Brazilian Federal Constitution, as well as the addressees
thereof, and the way to implement it through Pro Bono Lawyers.
Thus, the institution of the Public Defense is carefully studied, through the analysis
of its characteristics, principles, attributions and institutional bodies; prohibitions,
guarantees, prerogatives and the responsibilities of the members of the Public
Defense Office, as provided for in Complementary Law No. 80/1994 and in State
Laws, with especial focus on Law No. 988/2006 of the State of São Paulo, since that
legal instrument presented several novelties and advancements in the performance of
the institution.
Besides this, the study focuses on the performance of Pro Bono Lawyers in class
actions.
Finally, the work discusses extrajudicial performances, with emphasis on
alternative means to settle conflicts (conciliation, mediation and arbitration), to be
developed by the Public Defense Office, in addition to proactive performances of the
institution in the education of the rights of the needy population / O presente estudo investiga a atuação da instituição da Defensoria Pública na
busca pelo efetivo acesso à justiça.
O princípio do acesso à justiça é o objeto deste trabalho, que analisa seus
obstáculos e formas para superá-los.
Nesse contexto, a dissertação trata do direito à assistência jurídica, consagrado
na Constituição Federal de 1988, bem como seus destinatários e sua forma de
implementação por meio da Defensoria Pública.
Assim, a instituição da Defensoria Pública é cuidadosamente estudada,
analisando-se suas características, princípios, atribuições e órgãos institucionais;
vedações, garantias, prerrogativas e as responsabilidades dos membros da Defensoria
Pública, previstos na Lei Complementar n. 80/1994, bem como em Leis Estaduais, com
enfoque na Lei paulista n. 988/2006, uma vez que esse diploma legal apresentou
diversas novidades e avanços na atuação da instituição.
Ademais, o estudo aborda a atuação da Defensoria Pública nas demandas
coletivas.
Finalmente, o trabalho trata das atuações extrajudiciais, com destaque para os
meios alternativos de composição de conflitos (conciliação, mediação e arbitragem) a

D’origine essentiellement religieuse, la répudiation est la rupture unilatérale et discrétionnaire du mariage décidée par l’époux. En droit musulman, elle permet au mari de mettre un terme à la relation maritale sans avoir à se justifier. En France, cette institution est critiquée et même rejetée tant elle paraît étrangère à la civilisation européenne. Pourtant, à y regarder de plus près, la rupture unilatérale et discrétionnaire du couple existe en droit français sous l’appellation de « divorce pour altération définitive du lien conjugal » pour le mariage, mais encore de «rupture unilatérale » s’agissant du pacte civil de solidarité et du concubinage. La différence tient au titulaire de l’exercice de ce droit, alors que la répudiation ne peut être mise en oeuvre que par l’homme, la rupture unilatérale et discrétionnaire du mariage, du PACS et du concubinage peut être décidée par l’homme ou la femme. Toutefois, fondamentalement, les effets sont les mêmes : l’un décide, l’autre subit. Que la rupture soit judiciaire ou non judiciaire, ce mode de dissolution laisse perplexe quant à l’attitude du juge et du législateur français face à la répudiation. Le premier refuse, depuis le 17 février 2004, de reconnaître des effets aux répudiations musulmanes en France sous couvert de la violation du principe d’égalité entre époux. Les crimes internationaux constituent des infractions dont les conséquences dramatiques affectent la communauté internationale dans son ensemble. Cette dernière s'est engagée dans la poursuite d'auteurs présumés de ces crimes à travers les différents mécanismes juridiques mis en place par la justice pénale internationale. Il incombe essentiellement aux États d'assurer l'effectivité de cette justice. Ainsi, quand des auteurs présumés de crimes internationaux se trouvent sur le territoire ou dans la juridiction d'un État, ce dernier est tenu de les poursuivre ou de les extrader vers d'autres États ou juridictions pénales internationales lorsque cela est nécessaire. Depuis la Deuxième Guerre mondiale, certains États mettent en application ces obligations en engageant des poursuites à l'encontre de criminels internationaux. La répression nationale des crimes internationaux se heurte à de nombreuses difficultés afférentes, le plus souvent, au manque de moyens ou de volonté, à l'inadéquation de certains systèmes juridiques nationaux, à la realpolitik (de l'allemand politique réaliste), à la nécessité de préserver les relations interétatiques, etc. Par ailleurs, il n'existe pas encore d'instance supranationale capable de contraindre les États à respecter leurs obligations internationales de répression des crimes internationaux. Since the Second World War, some States implement these international obligations by prosecuting international criminals. The national prosecution of international crimes faces many barriers related most of the time to a lack of financial resources or political will. This can also result from the inadequacy of some national legal systems, realpolitik, the need to safeguard inter-state relations... In addition to this, a supranational body compelling States to respect their international obligations to prosecute international crimes has not yet been created. Previous issue date: 2004-04-13T00:00:00Z / Analysis and, criticism of the proposed changes in Brazilian bankruptcy legislation based on an empiric study of Brazilian companies under debt rehabilitation (concordata) proceedings during the period from 1992 to 2002. Identification of the main features of the companies that petitioned for concordata (mainly in relation to their profitability) and moreover, identify the companies that were able to recover, using them as a basis to substantiate critical analysis of the bill for the new bankruptcy legislation, and presentation of suggestions to increase the recovery rates of companies facing financial difficulties. Comparison of the proposed changes with the current United States Law (Chapter 11), which is known to be more efficient in the recovery of companies in financial straits. / Análise e crítica das alterações propostas à legislação falimentar brasileira tendo como base o estudo empírico de empresas brasileiras que entraram em concordata no período de 1992 a 2002. Identificação das principais características das empresas que pedem concordata (principalmente quanto a sua lucratividade) e também das empresas que conseguem se recuperar e uso das mesmas como base para uma análise crítica do projeto da nova legislação falimentar, bem como apresentação de sugestões que visem aumentar as taxas de recuperação de empresas em dificuldades financeiras. Comparação das alterações propostas com a legislação norte americana atual (Chapter 11), que é reconhecidamente mais eficiente na recuperação de empresas em dificuldades.
