Architectures and Protocols for Performance Improvements of Real-Time Networks

When designing architectures and protocols for data traffic requiring real-time services, one of the major design goals is to guarantee that traffic deadlines can be met. However, many real-time applications also have additional requirements such as high throughput, high reliability, or energy efficiency. High-performance embedded systems communicating heterogeneous traffic with high bandwidth and strict timing requirements are in need of more efficient communication solutions, while wireless industrial applications, communicating control data, require support of reliability and guarantees of real-time predictability at the same time. To meet the requirements of high-performance embedded systems, this thesis work proposes two multi-wavelength high-speed passive optical networks. To enable reliable wireless industrial communications, a framework in­corporating carefully scheduled retransmissions is developed. All solutions are based on a single-hop star topology, predictable Medium Access Control algorithms and Earliest Deadline First scheduling, centrally controlled by a master node. Further, real-time schedulability analysis is used as admission control policy to provide delay guarantees for hard real-time traffic. For high-performance embedded systems an optical star network with an Arrayed Waveguide Grating placed in the centre is suggested. The design combines spatial wavelength re­use with fixed-tuned and tuneable transceivers in the end nodes, enabling simultaneous transmis­sion of both control and data traffic. This, in turn, permits efficient support of heterogeneous traf­fic with both hard and soft real-time constraints. By analyzing traffic dependencies in this mul­tichannel network, and adapting the real-time schedulability analysis to incorporate these traffic dependencies, a considerable increase of the possible guaranteed throughput for hard real-time traffic can be obtained. Most industrial applications require using existing standards such as IEEE 802.11 or IEEE 802.15.4 for interoperability and cost efficiency. However, these standards do not provide predict­able channel access, and thus real-time guarantees cannot be given. A framework is therefore de­veloped, combining transport layer retransmissions with real-time analysis admission control, which has been adapted to consider retransmissions. It can be placed on top of many underlying communication technologies, exemplified in our work by the two aforementioned wireless stan­dards. To enable a higher data rate than pure IEEE 802.15.4, but still maintaining its energy saving properties, two multichannel network architectures based on IEEE 802.15.4 and encompassing the framework are designed. The proposed architectures are evaluated in terms of reliability, utiliza­tion, delay, complexity, scalability and energy efficiency and it is concluded that performance is enhanced through redundancy in the time and frequency domains.

The Master's thesis describes and analyses the legislation of the on-site inspections conducted by the Czech Office for the Protection of Competition and the European Commission. The competition authorities may investigate business and other premises in order to find evidence proving the violation of competition rules. The on- site inspection or so called dawn raid is a main investigative and the most effective tool of the competition authorities in proceedings concerning the possible breach of competition law. The main aim of this thesis is to provide a detailed description of the relevant legislation and case law, to highlight any legal issues connected with on-site inspections and offer solutions of these issues, and finally to examine guarantees of the fundamental rights of the undertakings during the inspection. The thesis consists of eight chapters. Chapter One and Two are introductory and describe basic terms connected with the competition law. In Chapter Three the thesis deals with the scope of relevant Czech and EU legislation. Chapter Four is concerned with the guarantees of fundamental rights within on-site inspections. Le droit de la responsabilité et les fonds d'indemnisation : analyse en droits français et allemand / Compensation funds and tort law : an analysis under french and german law

L’importance croissante des fonds d’indemnisation, en droit français et dans les droits étrangers, invite à une étude approfondie de ces instruments alternatifs de compensation de dommages. Une analyse de leur champ d’application et de leur fonctionnement ainsi qu’une identification des objectifs de politique juridique font apparaître deux catégories de dispositifs : d’un côté, les fonds rétrospectifs chargés de gérer les conséquences d’un fait dommageable de grande ampleur survenu dans le passé et ayant fait l’objet d’une médiatisation importante ; de l’autre, les fonds prospectifs destinés à faciliter l’indemnisation de dommages isolés et à pallier des lacunes de la responsabilité civile ou administrative. Malgré des points de convergence, les fonds d’indemnisation se démarquent d’autres techniques d’indemnisation, telles que la Sécurité sociale et les assurances privées. Pour comprendre les raisons qui amènent le législateur à réserver un tel traitement particulier à certaines catégories de dommages, la notion d’indemnisation sociale, développée par la doctrine allemande, servira de point de départ pour construire un modèle explicatif qui appréhende notamment la diversité des régimes relevant d’un fonds d’indemnisation. Une comparaison de la procédure d’indemnisation devant un fonds et d’une action en responsabilité révèle un besoin d’ajustement de la réglementation des fonds pour exploiter au mieux les potentialités de ces instruments, aussi bien sur le terrain de la compensation que sur celui de la prévention des dommages. Une simplification des rapports entre les nombreux fonds et une meilleure articulation avec la responsabilité civile s’imposent pour assurer une intégration cohérente de ces régimes spéciaux dans le droit existant. / The increasing importance of compensation funds in French law and in other legal systems calls for a research study on this topic. The analysis of the scope and legal technique as well as the identification of the political aims behind those alternative compensation schemes reveals two categories: on the one hand, retrospective compensation schemes are introduced to manage the consequences of mass damages; on the other hand, the establishment of prospective funds remedies the gaps in tort law to facilitate the compensation of certain types of individual damages. In spite of similarities with Social security and private insurance, compensation funds form a unique compensation technique and can be held as the key element of social compensation, a concept which has been developed by German scholars and can explain the shifts between private and public compensation schemes as well as the diversity of fund regulations. However, a comparative approach of compensation under a fund regulation and a tort law action before the courts reveals a need for legislative adjustments in order to develop the full potential of alternative compensation schemes. A simplification of conflicts between different compensation funds and a better coordination with tort law actions have to be achieved to insure a coherent integration into the existing legal system.

Pulp fictions : the CCF government and the promise of a pulp industry in Saskatchewan, 1944-1964

This thesis brings together for the first time, in an organised account, Saskatchewans search for a pulp industry. This thesis will show that, in a fundamental tension between goals of fiscal prudence and of economic growth, fiscal prudence won out again and again, to the point that the CCF governments could be characterised as risk-averse where pulp production was concerned. The cautious approach is in contradiction both to the activist reputation of the CCF governments and to their aggressive development of other resources, notably mining. Pulp offers an example of the contradictions that plagued the CCF governments and their policies for the north, contradictions that included disagreements between moderates and radicals over the roles of public and multinational enterprise, colonial attitudes towards the north, and risk aversion despite bold rhetoric and announcements.<p>The methodology used in this thesis has generally maintained an economic policy and political discourse, and incorporates mostly a top-down governmental approach. The personal papers of Tommy Douglas and Woodrow Lloyd provided CCF government correspondence and departmental memos that included premiers, ministers, deputy ministers, and departmental directors involved with the Department of Natural Resources, the Timber Board, the Industrial Development Office, and the Economic Advisory and Planning Board, and with pulp company officials. Furthermore, pulp reports, surveys, and studies helped contextualise all of the interrelated correspondences. To supplement government discourse I utilised the Prince Albert Daily Herald to gain an understanding of what issues the public was debating and found to be most important.

Adaptive Resource Allocation for Statistical QoS Provisioning in Mobile Wireless Communications and Networks

Due to the highly-varying wireless channels over time, frequency, and space domains, statistical QoS provisioning, instead of deterministic QoS guarantees, has become a recognized feature in the next-generation wireless networks. In this dissertation, we study the adaptive wireless resource allocation problems for statistical QoS provisioning, such as guaranteeing the specified delay-bound violation probability, upper-bounding the average loss-rate, optimizing the average goodput/throughput, etc., in several typical types of mobile wireless networks. In the first part of this dissertation, we study the statistical QoS provisioning for mobile multicast through the adaptive resource allocations, where different multicast receivers attempt to receive the common messages from a single base-station sender over broadcast fading channels. Because of the heterogeneous fading across different multicast receivers, both instantaneously and statistically, how to design the efficient adaptive rate control and resource allocation for wireless multicast is a widely cited open problem. We first study the time-sharing based goodput-optimization problem for non-realtime multicast services. Then, to more comprehensively characterize the QoS provisioning problems for mobile multicast with diverse QoS requirements, we further integrate the statistical delay-QoS control techniques — effective capacity theory, statistical loss-rate control, and information theory to propose a QoS-driven optimization framework. Applying this framework and solving for the corresponding optimization problem, we identify the optimal tradeoff among statistical delay-QoS requirements, sustainable traffic load, and the average loss rate through the adaptive resource allocations and queue management. Furthermore, we study the adaptive resource allocation problems for multi-layer video multicast to satisfy diverse statistical delay and loss QoS requirements over different video layers. In addition, we derive the efficient adaptive erasure-correction coding scheme for the packet-level multicast, where the erasure-correction code is dynamically constructed based on multicast receivers’ packet-loss statuses, to achieve high error-control efficiency in mobile multicast networks. In the second part of this dissertation, we design the adaptive resource allocation schemes for QoS provisioning in unicast based wireless networks, with emphasis on statistical delay-QoS guarantees. First, we develop the QoS-driven time-slot and power allocation schemes for multi-user downlink transmissions (with independent messages) in cellular networks to maximize the delay-QoS-constrained sum system throughput. Second, we propose the delay-QoS-aware base-station selection schemes in distributed multiple-input-multiple-output systems. Third, we study the queueaware spectrum sensing in cognitive radio networks for statistical delay-QoS provisioning. Analyses and simulations are presented to show the advantages of our proposed schemes and the impact of delay-QoS requirements on adaptive resource allocations in various environments.

Le secteur de la construction constitue un pan majeur de l'activité économique qui sous-tend une large part de la croissance au plan national. Partant de ce constat, il a semblé opportun de s'intéresser plus particulièrement aux marchés de travaux privés et plus précisément encore à la question du paiement. Au coeur des relations économiques, le paiement défini comme l'exécution d'une obligation porte en son sein la question fondamentale de sa sécurisation. Préoccupation légitime du créancier, on trouve sa pleine consécration et son traitement le plus abouti en droit civil dans le droit des sûretés qui occupe le livre IV du Code civil. Toutefois, dans les marchés privés de travaux, la sécurisation du paiement est rendue possible tant au stade de la formation du contrat par la détermination de son objet - le prix - qu'au stade de l'exécution grâce aux modalités de l'opération de paiement elle-même et à la fourniture de garanties. Appréhendant l'opération de paiement tant d'un point de vue pratique que théorique, l'objet de la présente thèse est de montrer que la sécurisation du paiement dans les marchés privés de travaux peut être envisagée tant au stade de la formation que celui de l'exécution du contrat. / The construction sector is a major pan of economic activity that underlies much of the growth nationally. With this in mind, it seemed appropriate to focus specifically on private works contracts and even more specifically to the issue of payment. At the heart of economic relations, payment defined as fullfilment of an obligation is asking the question of its security. In private works contracts, securing the payment is possible both during the formation of the contract by the determination of its purpose - the price - at the stage of execution thanks to the operation of arrangements payment itself and the provision of guarantees. Apprehending the payment transaction from both a practical and theoretical, the subject of this thesis is to show that the security of payment in private building contracts can be considered both during training than the contract.

However, public finances are not dogmatically structured to solve the conflicts around the limitations of public spending. There are ethical conditioning factors, like morality, proportionality and impartiality, however, these principles act separately, while the problem of public shortage is holistic. Also, the subjectivity of politics discretionary in the definition of public spending, which is supported in an indeterminate concept of public interest, needs material orientation about the destination of public funds, making it vulnerable to ideological manipulation, resulting in real process of catching rights. Not even the judicial activism (such as influx of constitutionalism) is shown legally appropriate. The Reserve of Possible, also presents basic ethical failure. Understanding the formation of public shortage is therefore essential for understanding the crisis of effectiveness of state responsibilities, given the significant expansion of the state duty of protection, which does not find legal technique of defense of the established interests. The premise of argument, then, part of the possibility of deducting minimal model ethical of desire to spend (public interest) according to objective parameters of the normative system. Public spending has always been treated disdainfully by the Brazilian doctrine, according to the legal character accessory assigned to the monetary cost. Nonetheless, it is the meeting point between economics and law, or is in the marrow of the problem of public shortage. Expensive Subjects to modernity, as the effectiveness of fundamental rights, pass necessarily an ethical legal system of public spending. Droit au procès équitable et autorité administrative / Right to a fair trial and administrative authorithy

Principe trouvant une expression solennelle à l’article 6 C.E.D.H., le droit au procès équitable irradie aujourd’hui l’ensemble de notre droit interne. Dans un contexte de subjectivisation du droit, le droit administratif n’échappe pas à cette « irrésistible extension du contentieux du procès équitable » (Mme KOERING-JOULIN). Cette assertion trouve une manifestation éclatante quant aux pouvoirs de sanctions et de règlement des différends reconnus aux autorités administratives. La définition européenne du champ d’application du droit au procès équitable, suivie par la Cour de cassation et adaptée par le Conseil d’État, permet, en effet, à l'article 6 précité de faire florès en ce domaine. Ainsi, en l’état actuel de la jurisprudence administrative, le moyen tiré de la violation de cette stipulation peut utilement être invoqué à l’encontre des autorités administratives indépendantes, tant dans le cadre de leur activité répressive que contentieuse. Depuis maintenant huit ans, le respect de cette garantie s’impose à la procédure d’établissement des sanctions fiscales. A suivre cette ligne jurisprudentielle, l’extension du droit au procès équitable à l’ensemble des autorités administratives répressives voire contentieuses pourrait être la voie de l’avenir. Une telle évolution n’est toutefois pas sans soulever certaines questions. La processualisation croissante de la répression administrative, sous l’effet du droit au procès équitable, n’est-elle pas une contradiction en soi ? Ne va-t-elle pas à rebours de l’objectif initialement poursuivi par l’externalisation de la sanction ? Plus fondamentalement, l’assujettissement de l’administration aux garanties spécifiques à la procédure juridictionnelle ne participe-t-il pas au rétablissement d’une certaine confusion entre l’administration et la juridiction ? N'y a-t-il pas là renaissance, sous une forme évidemment nouvelle, de la figure que l'on croyait révolue de l'administrateur-juge ? / The right to a fair trial is enshrined in the article 6§1 of the European Convention on Human Rights and irradiates now all French law. In the context of the subjectivization of the law, administrative law is also subject to this "unstoppable rise of disputes in the name of the right to a fair trial" (Mrs. KOERING-JOULIN). This assertion is particularly true regarding the powers of sanction and the settlement of disputes granted to the administrative authorities. The European definition of the right to a fair trial applied by the Court of Cassation and adapted by the Council of State allows a wide application of this right. So, given the current state of the administrative case law, the right to a fair trial can be usefully claimed against independent administrative authorities as regard either their law enforcement activities or litigation practice. And the tax administration has also been compelled to respect this fundamental right for eight years now. In line with this settled jurisprudence, the extension of the right to a fair trial to all the administrative authorities may be the way of the future. But such an evolution raises a few questions. Isn't the increasing jurisdictionalization of the administration activities as a result of the right to a fair trial an inconsistency in itself? Doesn't it go against the primary goal of the outsourcing of the administrative penalties? More fundamentally, doesn't subjecting the administrative authorities to the specific principles of court procedures participate in reinstating some confusion between administration and jurisdiction? Isn’t it the rebirth, under a new form, of the administrator-judge we thought was long gone?

La mise à l'épreuve du régime de non-prolifération des armes nucléaires et leurs vecteurs au regard des crises contemporaines / Testing the non-proliferation of nuclear weapons regime and their means in light of the current crisis

La fin de la confrontation Est-ouest va apparaître comme un tournant décisif dans la lutte contre la prolifération des armes nucléaires. Alors que le monde se réjouissait de la chute du mur de Berlin, le contexte qui va succéder à cette période est marqué par la poursuite, et même l’aggravation de plusieurs crises graves liées à la prolifération nucléaire en Inde, au Pakistan, en Iran et en Corée du Nord. Ces crises, intervenues alors même que la totalité des armes nucléaires à l’échelle mondiale avait été réduite de plus d’un quart depuis la fin de la guerre froide, ont fait l’objet d’une réaction mitigée de la part de la « communauté internationale ». Ces crises montrent qu’il est indispensable de renforcer le régime de non-prolifération nucléaire en apportant des réponses promptes, crédibles et dynamiques. Alors que des doutes sont apparus sur la capacité du régime classique à décourager ceux qui souhaitent développer des activités nucléaires à des fins autres que pacifiques, la nécessité d’envisager des outils modernes et adaptées au contexte géopolitique en pleine mutations, s’est révélée indispensable. Cela suppose un réaménagement du régime classique de non-prolifération dans la perspective de renforcer la légitimité de la norme de non-prolifération. De surcroît, ces crises montrent qu’il est indispensable de renforcer les mécanismes de mise en œuvre du Traité de non-prolifération nucléaire (TNP). Il s’agira d’assurer l’application universelle des accords de garanties de l’AIEA, qui est une obligation du TNP, ainsi que par l’universalisation du protocole additionnel / The end of the East-West confrontation appeared to be a watershed in the fight against the proliferation of nuclear weapons. While the world was celebrating the fall of the Berlin wall, the context that will succeed this time is marked by the continuity and the aggravation of several serious crises linked to nuclear proliferation in India, Pakistan, Iran and North-Korea. These crises occurred even though all nuclear weapons were globally reduced by more than a quarter since the end of the cold war, have been a mixed reaction from the " International community ". These crises show that it is essential to strengthen the nuclear non-proliferation system by providing prompt, credible and dynamic responses. While doubts have been raised about the ability of the classical regime to discourage those who wish to develop nuclear activities for other than peaceful purposes, the need to consider appropriate modern tools to change rapidly geopolitical context seemed to be essential. This implies a rearrangement of the classic nuclear non-proliferation system with a view to strengthen the legitimacy of the norm of non-proliferation. In addition, these crises show that it is essential to strengthen the mechanisms for implementation of the Treaty on the non-proliferation of nuclear weapons (NPT). The application of an additional protocol, coupled with the implementation of a comprehensive safeguards agreement, is indeed essential to obtain full insurance compliance with non-proliferation commitments and is the current standard to allow the agency (IAEA) to fulfill its mission
