Barnkonventionen blir Svensk lag : En studie som undersöker de förväntade förändringarna / The Convention of the rights for the child becomes Swedish law : A stady that investigates the expected changes

Denna studie syftar till att undersöka vilka förändringar som förväntas av en inkorporering av Förenta Nationernas barnkonvention i svensk lagstiftning. Sveriges riksdag röstade sommaren år 2018 igenom regeringens förslag om att inkorporera barnkonventionen, vilket innebär att konventionen blir svensk lag. Sverige har sedan ratificeringen år 1990 varit tvungna att följa barnkonventionens bestämmelser, dock har konventionen inte fått det genomslag som förväntats i landet. Regeringen anser att barnkonventionen genom en inkorporering kommer bidra till ett tydliggörande för barnens rättigheter. Studien kommer även granska och identifiera hur barnkonventionen ska inkorporeras, vilka insatser som regeringen har beslutat om och hur dessa ska genomföras. En inkorporering är dels önskvärd men även kritiserad, därför ska studien även analysera för vilka utmaningar och svårigheter som finns vid en inkorporering. Huvudproblemet som studien syftar till att diskutera är om inkorporeringen av barnkonventionen kommer vara tillräcklig för att luckorna i det barnrättsliga arbetet i Sverige ska tillgodoses. Syftet har besvarats genom intervjuer med sex personer som har kunskap om barnens rättigheter och information om dels den kommande inkorporeringen, dels de insatser som beslutats om samt de utmaningar som finns vid inkorporeringen av barnkonventionen. Resultatet visar att de förändringarna som intervjupersonerna förväntade sig av en inkorporering av barnkonventionen var både positiva och negativa. De positiva förväntningarna är att barnkonventionen får mer genomslag. Att barnets bästa kommer att prövas och att dem kommer att komma till tals i större utsträckning än tidigare. Ytterligare en positiv förändring är att Barnkonventionens kan bidra till en synvända för alla människor i samhället. Det vill säga, hur vi ser på barn, behandlar barn och pratar med barn. De negativa förväntningarna och utmaningarna vid en inkorporering är att konventionen kan uppfattas vag och att den i sig inte utgör en beslutsgrund. Det är därför viktigt att barnkonventionens bestämmelser fortsätts transformeras in i nationell lagstiftning. I intervjuerna uttrycktes även en oro för att regeringens ansvar i att se till att barnkonventionen följs förflyttas till rättstillämparen och att arbetet med att transformera konventionens bestämmelser stannar av. Studien identifierar även behovet av övriga insatser i form av kunskapslyft i skolan där barnen får lära sig om barnkonventionen och deras rättigheter och behovet av att regeringen fattar ett beslut om att tillträda tilläggsprotokoll 3. Det frivilliga tilläggsprotokollet utgör en möjlighet för barn att överklaga beslut som fattats i ärenden som rör dem till FN:s barnrättskommitté. / This study aims to investigate what changes are expected of the incorporation of the United Nation Convention on the Rights of the Child into Swedish legalisation. The Swedish Parliament voted in the summer of 2018 through the Government's proposal to incorporate the Convention into Swedish legislation through incorporation. Since the ratification in 1990, Sweden has had to comply with the provision of the Convention, but the Convention has not had the impetus that was expected in the country. The Government believes that the Convention of the Rights of the Child, through incorporation, will introduce a symbolic clarification of the rights of the children. The study will also research and identify how the convention will be incorporated, what interventions the government has decided on and how these will be implemented. Incorporation is partly desirable, but also criticized, therefore, the study will also analyse the challenges and difficulties encountered in the incorporation of the convention of the Rights of the Child into Swedish legislation. The main problem that the study aims to discuss is whether the incorporation of the Convention of the Rights of the Child will be sufficient to accommodate the gaps in child justice in Sweden.     The aim of the study as well as the research questions has been answered through interviews with six individuals who are experts in the children's rights and who have information on the upcoming incorporation, they also have knowledge about the interventions that have been made and the challenges involved in the incorporation of the Convention of the rights of the child.      The result of the study shows that the expected changes that the interviewees had from incorporating the Convention of the Rights of the Child into Swedish legalisation were both positive and negative. The positive expectation is that the Convention will get more impact. That the best interests of the child will be tested in decisions that concern them and that they will be able to express an opinion to a greater extent than before. The negative expectations and challenges of incorporation are that the convention can be perceived undetermined and in itself does not constitute a basis for decision-making. It is therefore important that the provisions of the Convention continue to be transformed into national law. The interviewees also expressed a concern that the government's responsibility to ensure compliance with the Convention might transferred to the legal experts and that the work on transforming the Convention's provisions contingently stops.     The study also identifies the need of knowledge of the Convention of the Rights of the Child among the children. This will contribute to the positive effect that children will understand that they are carriers of rights. Furthermore the interviewees criticise the government’s decision to not incorporate the third additional protocol, optional protocol of the convention on the rights of the child on a communication procedure.

The purpose of the study is to examine the ways in which the Children’s rights convention is used to develop early childhood education for children with special needs. We want to examine how preschool teachers and municipalities relate to the Children’s rights convention when decisionmaking concerning children with special needs, and the resources that will be relevant for these children. In order to answer our questions, we conducted interviews with preschool teachers and officials in two municipalities in Sweden. This in order to identify any differences between theory and practice; does this correspond with what is said in the Children’s rights convention, the Education Act, various policy documents that are in and around the preschool or is there a need to develop this work further, so that the guidelines are followed to a greater extent? We have used a qualitative method with phenomenological and phenomenographic basis. We describe the ecological systems theory of child development, individual, and relational perspective, which we use to analyze our collected material. We also shed light on previous research in the Children’s rights convention and children's right to education, the incorporation of the Children’s rights convention, special education and resources, children's perspective and inclusion and exclusion. We have concluded that the need for an education initiative for the Convention should be used to strengthen children's rights, but also the need for a more active work to actualize what is said in the Children’s rights convention.

In this survey- and interview study based on 15 teachers in Sweden and their thoughts about their own experience of their teaching to students with migration backgrounds has the following information emerged. Some of the teachers who have participated admit that they find it difficult to base their work to the laws and guidelines. Many of the teachers testify that some principals do not place trust in their teachers’ abilities and do not give them the right conditions they need to be able to do their job. The teachers who enjoyed the work the most and who felt that they could manage their job were the once who experienced that they had committed and supportive principals behind them. But also, when they felt that they experienced a team spirit with their coworkers and that they worked together as like the whole school were united. It affected both students and teachers in a positive way being able to give the students the best conditions to achieve goal fulfillment. According to the teachers the teaching will work best when they are able to give the students the attention that they deserve and need and even when they can listen to the student’s thoughts and opinions as well, because those are important. The teachers pointed out that it is important for the teachers and students to get to know each other to build up trust between them, because it will be easier to get the students to be more involved in the classroom when they feel that connection. The teachers described that the most of their lessons often stop with briefings and that the teachers often did not have time to let the students work alone to prove what they are able to manage because of the classes different skills among the students. The teachers also described that they had a lot of work beside the teaching, like having phone calls and meetings with for example the children’s psychologists, the social service, the police, and the Migrations office, and that it took a lot of their time from them to do planning for the teaching. They also pointed out that they did not feel that they had the education for that part of the job. It also appeared that the language difference between the teachers and the students was a problematic cause of their job. The teachers said that the language must come before the learning part. It also came up that the schools gave the students a lot of different prerequisites when it came to get help with the schoolwork from interpreters. A suggestion from the teachers was to make new ways to build up the classes through the student’s skills instead of the way they make it now, through the student´s ages. Even more ways to show the students’ knowledge in different ways of grades was asked for by the teachers.

Abstrakt ”Bör barnkonventionen bli lag i Sverige? – En komparativrätts-lig studie on barnets rättigheter genom barnkonventionen i Sverige & Norge” Uppsatsen diskuterar med en komparativrättslig metodik implementeringen och inkorporering av barnkonventionen i Sverige och Norge. I tre steg ämnar uppsatsen att undersöka huruvida barnkonventionen bör implementeras till fullo och göras till svensk lag på samma sätt som Norge har valt att göra.Uppsatsen fokuserar på FN:s barnrättkommittés yttranden kring hur länderna sköter sina åtaganden gentemot konventionen och en jämförelse har gjorts som visar att kommittén generellt sett verkar ge Sverige mer grundläggande kritik vilket indikerar att kommittén anser sig ha större och allvarligare kritik kring Sveriges tillgodoseende av barns rättigheter än kring Norges.Uppsatsen tar också upp domstolsprocessen kring vårdnadstvister där barnet ofta riskerar att hamna i kläm. In three steps the comparison has lead the essay to a conclusion on whether Sweden should incorporate the conventions fully or not.The essay focuses on the UN child rights committee ”concluding observation report” on how the countries are managing the rights of the child through the convention. A comparison has been made and it has shown that the committee to some extent is giving more basic recommendations and serious criticism to Sweden. This may lead to a discussion about whether the committee have bigger and more serious concerns about some areas of the Swedish work with the convention rather than the ones in Norway.The essay also brings up the legal process of custody battles where the child is often neglected to some extent and a comparison has been made that shows that there are really very little differences that can be connected to the fact that Norway has a fully implemented child rights convention when Sweden has not.Further on the essay gives an insight into the Swedish debate on pros and cons for an incorporation and comes to the overall conclusion that an incorporation would have a positive outcome on the rights of the child in Sweden.

The Convention on the Rights of the Child was incorporated into Swedish legislation in 2020 to strengthen the child's best interests and perspective in areas such as asylum law (UNICEFSweden, 2020a). The purpose of this essay is to examine how the individual asylum grounds of unaccompanied children are handled in the asylum process and in what way the child's best interests are actually considered in the asylum process before and after the incorporation of the Convention on the Rights of the Child. This essay will answer the following question:How has the application of the best interests of the child according to Article 3 in asylum cases for unaccompanied children changed before and after the incorporation of the Convention on the Rights of the Child into Swedish law based on the theory of the best interests of the child as an open concept? Through a qualitative content analysis of judgments, changes and deficiencies in the protection of the rights of unaccompanied children are identified. The study examines how the courts take into account the best interests of the childbased on Schiratzki's (2005) legal theory of the best interests of the child as an open concept.The results of the study have shown that before incorporation, the judgments extensively consider the best interests of the child according to Article 3 of the Convention on the Rights of the Child by highlighting potential consequences upon return. However, after incorporation, the migration court fails in considering the best interests of the child. This is because the concept of 'the best interests of the child' is comprehensive, and the court does not assess this from a holistic perspective, which is important for a fair assessment according to Schiratzki (2005).

Abstract The ratification of the Convention on the Rights of the Child was adopted in 1990 and thereafter Sweden also ratified the Convention on the Rights of the Child. The Swedish Parliament voted in 2018 on the Government's proposal regarding the incorporation of the Convention on the Rights of the Child. The Convention on the Rights of the Child became law in Sweden since 1 January 2020. The purpose of the study has been to examine and analyze the transposition of the Convention on the Rights of the Child into Swedish law. Furthermore, all changes, challenges and problems encountered during the process regarding the incorporation of the Convention on the Rights of the Child are analyzed. To achieve the purpose of the essay, I have used a rights theory by the legal philosopher Ronald Dworkin who writes about legal rights.   The study clearly shows that the transposition of the Convention on the Rights of the Child acquires the status of Swedish law and this will help children to comply with children's rights in society, despite certain problems that remain. Children's rights are described on the basis of the articles of the Convention on the Rights of the Child and the three optional additional protocols, where additional protocol (TP3) has not been ratified in Swedish law. (TP3) gave children the opportunity to challenge decisions when children’s rights have been violated under the Convention on the Rights of the Child. The incorporation of the Convention on the Rights of the Child means also that children have no right to complain, because the courts have no direct obligation to use the articles and additional protocols of the Convention on the Rights of the Child.
