[pt] A legalização dos procedimentos de terceirização irrestrita (Lei. 13.429/17) e da reforma trabalhista (Lei. 13.467/07) representam um contexto de crise e reorganização do direito do trabalho no Brasil. Essa dissertação tem como objetivo questionar as bases do contrato de trabalho, centralizando o corpo das pessoas que trabalham como ponto fundamental para a discussão. Tratarei de críticas ao direito do trabalho, procurando como a própria construção abstrata e universal de seus sujeitos e objeto podem ter contribuído para essa crise. Mobilizando correntes interseccionais e decoloniais, argumentarei como os sistemas de dominação do capitalismo, colonialidade, heteropatriarcado e racismo operam nas diversas discriminações no mercado de trabalho. Para isso, analisarei diretamente o texto da reforma trabalhista, mais especificamente o seu Título II-A / Do dano extrapatrimonial, que simboliza a positivação de discriminações no direito brasileiro, relacionada principalmente às reparações dos danos extrapatrimoniais, agora vinculados ao último salário da vítima. / [en] The legalization of unrestricted outsourcing procedures (Law 13.429/17) and the labor reform (Law 13467/07) represent a context of crisis and reorganization of labor law in Brazil. This dissertation aims to question the basis of the labor contract, centralizing the body of the people who work as a fundamental point for the discussion. I will deal with criticisms of labor law, looking at how the very abstract and universal construction of their subjects and objects may have contributed to this crisis. By mobilizing intersectional and decolonial currents, I will argue how the systems of domination of capitalism, coloniality, heteropatriarchy, and racism operate in the various forms of discrimination in the labor market. For this purpose, I will directly analyze the text of the labor reform, specifically its Title II-A / Dignitary Torts, which symbolizes the discrimination by positive law in Brazilian law, related mainly to reparations for dignitary torts, now linked to the last salary of the victim.

[pt] Esta dissertação tem como objetivo analisar os efeitos das modificações legislativas nos últimos anos relacionadas ao mundo do trabalho, com destaque para as ocorrências durante o governo de Michel Temer, no período de 2016 a 2018. Observa-se a reforma trabalhista, Lei 13.467/2017, agregada à terceirização, Lei 13.429/2017 e seus impactos nas relações de trabalho no Brasil, dentro do contexto de intensificação da precarização do trabalho. Para tanto, foram analisadas as transformações recentes do trabalho na sociedade capitalista contemporânea, enfatizando a regressão de direitos em face da rotatividade no emprego, do enfraquecimento da capacidade de organização dos trabalhadores e da dificuldade no exercício dos direitos trabalhistas, problematizando a reforma trabalhista e a regulamentação da terceirização e suas consequências. Para o desenvolvimento do estudo utilizou-se a pesquisa bibliográfica, tomando como embasamento teórico a literatura sobre direito do trabalho e sociologia do trabalho, bem como a análise documental, constitucional e infraconstitucional, principalmente no tocante à evolução jurídica e legal sobre o tema, além de dossiês e notas técnicas de institutos de pesquisa e/ou órgãos do governo. Percebe-se que a terceirização tem funcionado como um mecanismo capitalista de degradação das condições e relações de trabalho, como estímulo à ampliação de condições favoráveis apenas à classe patronal, visto que a desregulação das relações trabalhistas se traduz em dispositivos jurídicos que ampliam a flexibilização e acentuam elementos que rompem com princípios e garantias assegurados pela Constituição Federal vigente e Consolidação das Leis do Trabalho (CLT). A sucessão de acontecimentos não configurou, ainda, na própria literatura e nas experiências jurisdicionais, elementos para se asseverar expectativa de resposta à classe trabalhadora para os prejuízos advindos deste problema, que é a intensificação da precarização no mundo do trabalho, fazendo com que a insegurança jurídica seja a única certeza nessa circunstância. / [en] This dissertation aims to analyze the effects of legislative changes in recent years related to the world of work, highlighting the occurrences during the government of Michel Temer, from 2016 to 2018. It observes the labor reform (Law 13.467/2017), added to outsourcing (Law 13,429/2017) and its impacts on labor relations in Brazil, within the context of intensification of precarious work. To this end, the recent transformations of work in contemporary capitalist society were analyzed, emphasizing the regression of rights in the face of labor turnover, the weakening of workers ability to organize and the difficulty in exercising labor rights, problematizing labor reform and outsourcing regulation and its consequences. In the development of the study, we used the bibliographical research, taking as theoretical basis the literature on labor law and sociology of work, as well as documentary, constitutional and infra-constitutional analysis, especially regarding the legal and legal evolution on the subject, and also dossiers and technical notes from research institutes and/or government agencies. It is possible to say that outsourcing has functioned as a capitalist mechanism for the degradation of working conditions and relations and as a stimulus for the expansion of conditions favorable only to the employer class. The deregulation of labor relations translates into legal provisions that expand the flexibility and emphasize elements that break with principles and guarantees included by the current Federal Constitution and the Consolidation of Labor Laws (CLT). The succession of events has not yet constituted, in literature and jurisdictional experiences, elements to assert expectation of response to the working class to the damages arising from this problem, which is the intensification of precariousness in the world of work. Causing insecurity is the only certainty in that circumstance.

A legal analysis of incompatibility as a ground for dismissal in the South African labour law

Thesis (LLM. (Labour Laws)) -- University of Limpopo, 2022 / This study discusses a legal analysis of incompatibility as a ground for dismissal in the South African labour law. Incompatibility refers to the inability of an employee to maintain a harmonious relationship with his or her employer, or unable to adapt to the corporate culture of the workplace. The corporate culture is associated with the values, beliefs and behaviour to determine how employees interact with each other in the workplace. Therefore, in cases where the employer contemplates dismissing an employee on the ground of incompatibility, procedural fairness and substantive fairness should be implemented in order for the employer/s to make informed decision and ensure that the dismissal of such an employee is effected in accordance with the procedural and substantive fairness couched in the Labour Relations Act 66 of 1995 („the LRA‟). Section 23 of the Constitution of the Republic of South Africa, 1996 provides broadly the right of everyone to fair labour practices. Consequently, the LRA was established to give effect to this constitutional provision. In terms of section 185 of the LRA everyone has the right not to be unfairly dismissed. Be that as it may, incompatibility is not clearly defined in section 188 of the LRA. In fact, there are no guidelines nor corrective measures implemented in the workplace to deal with incompatibility. Hence incompatibility is dealt with under dismissal based on incapacity. In most cases employers use their discretion in dismissing employees, thereby using improper procedure to end disharmony in the workplace. In summation, the central thesis of this study focuses on a legal analysis of incompatibility as a ground for dismissal in the South African labour law.

The regulation of non-standard employment in Southern Africa : the case of South Africa with reference to several other SADC countries

This doctoral thesis deals with the regulation of non-standard employment in Southern Africa: the case of South Africa with reference to several other SADC countries. The growth and presence of non-standard employment since the 1970s has revealed an important concern in a number of countries, both at the global and national levels. The overall significance of non-standard employment has increased in recent decades in both developed and developing states, as its use has grown exponentially across economic sectors and employment. Non-standard employment is the opposite of the standard employment relationship, which is work that is full time and indefinite. Non-standard employment includes an unequal employment relationship between an employee and an employer. Some workers choose to work in non-standard employment, and the choice has positive results. Nonetheless, for the majority of workers, non-standard employment is associated with job insecurity, exploitation, and the absence of trade unions and collective bargaining. Non-standard employment can also create challenges for firms, the labour market and the economy, including society at large. Backing decent work for all entails a comprehensive understanding of non-standard employment and its ramifications. This study explores the regulation and protection of non-standard employment in Southern Africa with focus on South Africa. The study draws on international and regional labour standards, the South African Constitution of 1996, and the national experience to make policy recommendations that will ensure workers are protected, firms are sustainable and labour markets operate well. An analysis of legal implications for participating in an unprotected strike

The effective management of a strike is generally a challenging phenomenon which impacts on employers, employees and the general public. The main purpose of this study was to analyse the legal implications of employees’ participation in an unprotected strike. The study also explored requirements for a strike to be protected in compliance with the prescribed legislation. From the literary review, cases and legislation, it became clear that compliance plays a key role when a consideration is taken by employees to take part in a strike during dispute resolution. In analysing the legal consequences for participating in an unprotected strike, a finding was made that employers in the end have an upper hand in that when all due processes and procedures are followed, they are empowered to dismiss employees. The Appellate Division has recently found that the employment relationship not necessarily terminates similarly to the common law contract of employment, but may subsist after termination of the contract of employment. The industrial court does not easily accept that it has been deprived of its unfair labour practice jurisdiction where terminations of employment take place in consequence of a lock-out. The motive of the employer seems to be decisive. In line with both the trend in first world countries and principles established by the courts in South Africa, the Constitution and especially recent labour legislation significantly curtail the bargaining power of the employer because it is progressively being believed that the employer has sufficient economic power to his disposal. / Die omskrywing van die uitsluiting in wetgewing omvat sekere handelinge {onder andere beeindiging van dienskontrakte) wat deur die werkgewer met 'n sekere doel verrig moet word. The legal position of domestic workers in South Africa

Until recently, the legal position of domestic workers in South Africa could be described as a relic of the nineteenth century, when the contract of employment and the common law defined the employer-employee relationship. The legal rules which regulate the relationship between the domestic worker and her employer are examined. International labour standards and the legal position of domestic workers in other countries are considered. Cognisance is taken of the social phenomenon which finds domestic workers at the convergence of three lines along which inequality is generated, namely gender, race and class. Furthermore, the unique economic forces at play in this sector are examined. The law will be stretched to its limits when attempting to resolve what is, essentially, a socio-economic problem. However, the working lives of a million people are at stake. The legislature has a constitutional, political and moral responsibility to attend to reform in this sector as a matter of urgency. / Private Law / LL.M.

Picketing in terms of the Labour Relations Act 66 of 1995

Picketing, a method used by employees, collectively, to assert their demands against employers, is a controversial subject arising from the conflict of interest existing between labour and employers! Previously, South African law neither forbade nor regulated picketing. Consequently, no immunity from civil liability existed in relation to a person's conduct during a picket. Presently, picketing is regulated by section 17 of the Constitution of the Republic of South Africa Act 108of19% (right to picket) and section 69 of the Labour Relations Act 66 of 1995, which provides for a protected picket (one that complies with the requirements of section 69) whereby immunity from civil liability attaches to a person's conduct during a picket. These provisions and their coexistence is examined, comparing foreign law where relevant, in an attempt to provide a foundation for a topic relatively disregarded. Disability discrimination and undue hardship within the working environment: a critical analysis

South Africa is faced with a huge challenge of disability discrimination and inequality. Disabled people are not enjoying equal treatment as compared to others. Those who are on the working sector are not reasonable accommodated. The study examines challenges faced by people with disabilities. The study further submit that people with disabilities should be reasonably accommodated and be retained in the working sector as they have a positive role to play in the economy. The study also looks at the various legislations and argues that they are ineffective as they fail to address the imbalances of the past. The study further suggest that there is a need for all people to understand disabled people and not to isolate them as such stigma cause people with disabilities to be unfairly discriminated against in society and in employment / College of Law / L.L.M (Commercial Law)
