A suggested approach to solving the countermajoritarian dilemma in a constitutional democracy

The author explores the traditional approaches to interpretation in a constitutional democracy, with specific emphasis on Bill of Rights interpretation. The approaches adopted by the court in India and Canada, are briefly outlined with a view to gleaning from the experience of these countries, a theory which will inform a proper approach to interpretation in a South African context. He concludes that the value-based approach is most appropriate to concretise the rights entrenched in the Bill of Rights, and specifically the so-called second and third generation rights. Addressing the fear that this may lead to an undisciplined judiciary, he concludes that there are sufficient disciplinning mechanisms to ensure that the courts do not encroach upon the other branches of government. / Constitutional, International and Indigenous Law / LL.M.

A presente tese nasce da hipótese da existência da dualidade educacional (DE) nas políticas contemporâneas e que se confirma nesse trabalho. Por sua vez, a DE (uma escola para elite e outra para a classe popular) existe para que a classe hegemônica possa conservar a estratificação social e a divisão do trabalho a seu favor. Tem conivência do Estado, mesmo ele se expressando enquanto uma disputa de classe em movimento. Como metodologia de trabalho, utiliza-se o materialismo histórico-dialético no intuito de abranger o conflito de interesses entre classes sociais e poder caracterizar a materialidade e a dialeticidade nas subjetivações elucidadas. O trabalho de combate à DE é feito com mediações do ideário educacional anarquista e que se aproxima do marxismo através do nascedouro iluminista, comum às duas correntes. É um trabalho de cunho humanista e vai além da lógica iluminista. Pois é possível perceber o avanço em que o anarquismo trata as categorias igualdade, liberdade e solidariedade. No intuito de abranger melhor as relações do fenômeno da DE, é considerada a conjuntura política e econômica globalizada nas novas configurações entre Estado e sociedade civil no Brasil sob a vigência do capitalismo financeiro; além de ser levado em consideração o pensamento de Florestan Fernandes no que diz respeito ao Brasil ser um país de capitalismo dependente. Em relação às parcerias público-privadas na contemporaneidade, que promovem educação financiada pelo Estado, mas controlada pela sociedade civil; na prática, esse controle é feito por grupos empresariais, tendo em vista a falta de organização da população para esse fim. Desse modo, as estratégias hegemônicas de formatação e implantação das políticas educacionais neoliberais contribuem para a identificação do próprio fenômeno da dualidade educacional, no seio de estruturas organizativas bem planejadas. As novas faces da DE nas contradições de uma educação mercantilizada e alinhada aos ditames internacionais influenciam as políticas públicas educacionais locais. Por exemplo, a Gestão Integrada da Escola (GIDE), implantada desde 2011 na rede pública fluminense, é um projeto de caráter neoliberal, mas que tem uma lógica taylorista-fordista em seu funcionalismo gerencial administrativo-pedagógico. Nesse sistema fica patente a previsibilidade do processo fabril para a construção de um conhecimento sob a chancela de uma nova versão do tecnicismo que subtrai a criatividade e autonomia profissional e escolar, elege uma grade curricular fragmentada e mínima, prioriza o caráter quantitativo dos resultados nas estatísticas que, para tal, burocratiza o trabalho do professor e da própria escola. Na contramão desse ensino instrumental e padronizado desenvolvido pela GIDE, é conveniente rever o significado do que é o ensino libertário, que é aquele que consagra a liberdade e sacrifica progressivamente a autoridade numa educação que tem como objetivo final formar homens livres e respeitadores da liberdade alheia. Essa pesquisa no campo da educação apontou como uma forte pista a federalização das unidades escolares públicas. O chão da escola precisa assumir a sua autonomia possível frente ao sistema centralizador de ensino em um processo dialético de recriação de identidade e reafirmação da escola enquanto força organizativa local junto à comunidade / This Ph.D. dissertation springs from the hypothesis of the existence of an educational duality (ED) in contemporary policies, which is confirmed by this work. In its turn, ED (a school for the elite and another one for the lower classes) does exist for the hegemonic class to preserve the social stratification and work division to its benefit. It has the collusion of the State, even if it expresses itself as a class struggle in process. As a work methodology, it is based on the historical dialectical materialism aiming at embracing the conflict of interests among social classes and to be able to characterize the materiality and the dialecticality of the subjectifications explained. The work to fight against ED is made mediated by the anarchist educational thinking and approaches Marxism through the Enlightenment origins, common to both currents. This is a Humanistic-based work that goes beyond the Enlightenment logic. Its possible to notice how Anarchism advances its categories of equality, freedom and solidarity. In order to better embrace the relation of ED phenomena, the globalized political and economic context in the new configurations of the State and the social society in Brazil under the influence of the financial capitalism in force is taken into account; as well as Florestan Fernandess views on Brazil as a dependent-capitalism country. As for public-private partnerships in the present days, which promote an education funded by the State, but controlled by the civil society; in practice, such control is made by corporate groups, due to the lack of organization of the population for this purpose. Therefore, the hegemonic strategies of shaping and establishment of neoliberal educational policies contribute to the identification of the very phenomenon of the educational duality, within well planned organizational structures. The new faces of ED in the contradictions of a commercially-oriented education aligned with the international dictates influence local educational public policies. For instance, the School Integrated Management (GIDE), established since 2011 at the public-school network in the State of Rio de Janeiro, is a neoliberal-oriented project, based on a Taylorist-Fordist logic in its administrative pedagogical managerial functionalism. In such a system, it is evident the predictability of the plant process for the construction of knowledge under the seal of a new version of technicism that restricts school and professional creativity and autonomy, elects a fragmented and minimal curricular program, prioritizes the quantitative character of statistical outcomes which, for this purpose, bureaucratizes the work of the teacher and the school. Opposed to such an instrumental and standardized education developed by GIDE, it is convenient to review the meaning of a libertarian education, which is the one consecrating freedom and progressively renouncing to authority in an education having the ultimate purpose of forming free human beings respecting the freedom of others. This research in the Education field strongly points to the federalization of the public-school units. The school floor must take upon itself its possible autonomy against a centralizing teaching system in a dialectical process of identity recreation and reaffirmation of school as a local organizational force working side by side with the community

A Escola Moderna n.1 (São Paulo), sob a direção do professor libertário João Penteado, ofereceu uma alternativa de formação para os filhos da classe trabalhadora, inspirando-se na Pedagogia Libertária que, desde os primeiros debates da Internacional dos Trabalhadores até as experiências educacionais de Paul Robin, inseriu a luta de classes no espaço da escola. Assim, promoveu a interface entre educação e revolução social com base nos conceitos de Demopedia e Instrução Integral, desenvolvidos respectivamente por Pierre-Joseph Proudhon e Mikhail Bakunin. O presente estudo pretende desvelar como o espaço da Escola Moderna se converteu em ação revolucionária dos sindicatos operários, colaborando para os objetivos dos anarquistas que elegeram o sindicalismo revolucionário como a tática mais adequada para o estabelecimento da sociedade livre com a qual sonharam. Deste modo, entre os anos de 1912 a 1919, quando foi sumariamente fechada pelo Departamento de Instrução Pública do Estado, a Escola Moderna promoveu a ação direta e o mutualismo entre seus estudantes, tanto para que contribuíssem com o futuro da classe trabalhadora, de acordo com suas necessidades e conforme suas condições, como também para que os organismos de classe ultrapassassem as lutas mais imediatas.

Resumo: Este texto foca as relações de poder-saber e os dispositivos advindos de tais relações que se põem diante do desenvolvimento de práticas educativas constituídas a partir de cenários investigativos, com o propósito de intervir em problemas socioambientais locais. Tais práticas são apresentadas, a partir de um viés libertário, como forma de afrontamento e desestabilização aos dispositivos de controle do ensino tradicional de matemática, que serve à pedagogia panóptica e à ideologia do capital, defensora de uma educação voltada para o consumo. Os objetivos destas práticas são: estrategicamente, subverter o que está posto pelo modelo panóptico de educação; taticamente, pensando globalmente e agindo localmente, intervindo em problemas locais para minimizar os impactos socioambientais que degradam o planeta e nos submetem a valores, preconceitos e discursos de submissão e não-liberdade. Mais do que um grito em prol da liberdade, as práticas propostas visam romper com valores que nos atrelam ao instinto de rebanho comprometendo-se com a construção de conhecimentos em prol da liberdade — enquanto fim. O respeito à vida, ao indivíduo e, conseqüentemente, ao meio ambiente são princípios balizadores deste trabalho, da mesma forma que o afrontamento ao autoritarismo. / Abstract: This thesis focuses on power-knowledge relations and the control mechanisms that are in place in those relations, relations that oppose the development of educational practices built within investigative landscapes, proposed with the aim of intervening on socio and environmental local problems. Such practices are presented from a libertarian perspective, as a way to confront and destabilize the control mechanisms of traditional mathematics teaching, which serves a panoptical pedagogy and the ideology of the Capital. The objectives of those practices are: strategically, to subvert what is pushed by the panoptical educational model; tactically, to think globally and to act locally, intervening on local problems, aiming at minimizing the social and environmental impact of situations that degrade life in the planet and subject us to values, prejudices and discourses of submission and non-freedom. More than a cry for freedom, the proposed practices want to break links that attach us to the instinct of herd, committing themselves with the production of knowledge in favor of freedom taken as an end. Tea Party affects American politics since 2009 when she began under the name of former revolutionary movement to fight government interventions with massive demonstrations. There was often incorrect expectation concerning Tea Party's potential in the first years of her activity. Tea Party supporters cannot be easily characterized, since a very differentiated group of Americans identifies itself with the movement, they come from a broad scale of social groups from Religious Right to libertarians or radical populists, which makes Tea Party an easy subject of criticism. Such criticism is often related to accusations of racism and rigid approach to social issues, to which contributed also certain Tea Party candidates. Nationwide political radicalization, which Tea Party allegedly caused up to a great extent, cannot be confirmed, though, radicalization can be discerned rather within the ideologically differentiated Congress. Although the elections of 2010 and 2012 brought a group of Tea Party supporters into the Congress, it wasn't such a significant success, as many of her protagonists expected. The master's thesis is focused on the use of behavioural insights in public policy making. It presents possibilities and limitations that this approach brings in general and in the case study of shared medication record, describes the legislative framework and explores the ethical issues perceived by relevant stakeholders. The shared medication record is based on the principle of presumed consent of access doctors and pharmacists to the database of prescribed and dispensed medicines of the patient. He or she may thus make no effort to allow consent. If the patient does not agree with their access, he or she has the option of so-called opt-out, the granting of a prohibition of access. This type of public policy measure, i.e., nudge, is based on the libertarian paternalism. The paternalistic aspect in the shared medication record is represented by the protection of all citizens from possible unwanted medication interactions, the libertarian aspect is the possibility of opt-out.

Relecture de l'anarchisme classique à partir du concept d'éducationnisme-réalisateur

L’anarchisme vit un renouveau un peu partout sur le globe depuis les années 1990 et la montée du mouvement contre la mondialisation. Cependant pour les chercheurs contemporains, le lien est bien mince entre l’anarchisme du 21e siècle et le mouvement anarchiste du début du 20e siècle. Selon ces chercheurs, l’anarchisme contemporain serait davantage caractérisé par la nature expérimentale de ses stratégies et par son focus sur le moment présent. L’objectif de ce mémoire est de démontrer qu’il est possible de tracer des liens clairs entre les auteurs anarchistes classiques et l’anarchisme contemporain. En effet, certains auteurs classiques de ce courant vivent leur anarchisme dans le moment présent contrairement à ce que laissent entendre implicitement les chercheurs qui se sont penchés sur l’anarchisme contemporain. Nous analysons les cas d’auteurs anarchistes de la première moitié du 20e siècle comme Alexander Berkman, Emma Goldman, Joseph J. Cohen, Albert Libertad, Émile Armand et Rirette Maîtrejean. Une analyse de la colonie libertaire d’Aiglemont complète le tableau. Notre approche centrée sur l’étude des pratiques militantes repose sur trois conceptions idéal-typiques. Nous considérons trois types de pratiques anarchistes : l’action anarchiste de type insurrectionnel, de type syndicaliste et de type éducationnisteréalisateur. Nous concluons que les pratiques du mouvement anarchiste contemporain s’apparentent aux pratiques de certains anarchistes classiques, c’est-à-dire les pratiques de type éducationniste-réalisateur. / Anarchism has seen a revival across the globe since the 1990s and the rise of the movement against globalization. However for contemporary researchers, the link is thin between the current anarchist movement and the anarchist movement of the early 20th century. According to these researchers, contemporary anarchism is more characterized by the experimental nature of its strategies and its focus on the present tense. The objective of this paper is to demonstrate that it is possible to draw parallels between some of the classical anarchists writers and contemporary anarchism. Indeed, some anarchists of the early 20th century lived their anarchism from day to day contrary to what suggest implicitly some researchers who have studied contemporary anarchism. We analyze the cases of anarchists writers of the early 20th century such as Alexander Berkman, Emma Goldman, Joseph J. Cohen, Albert Libertad, Emile Armand and Rirette Maîtrejean. An analysis of the Aiglemont libertarian colony completes the picture. Our approach focus on the study of activists practices based on three ideals types designs. We consider three types of anarchists practices: insurrectionary anarchist action type, union type and the experimental-educationist type. We conclude that the practices of the contemporary anarchist movement are similar in some ways to the practices of at least a few classical anarchists, that is to say, the experimental-educationist type of anarchists practices.

La "ville intelligente" : de l'utopie urbaine au populisme technologique / Smart city : from urban utopia to techno-populism

L’enjeu de la thèse est de repérer et caractériser la circulation, à travers l’utopie de la « ville intelligente », d’un discours favorable à une gestion des affaires publiques apparemment dépolitisée, mais aux multiples soubassements idéologiques : le « populisme technologique ». Cette recherche en sciences de l’information et de la communication explore les différentes significations attribuées à la « ville intelligente », envisagée comme une « formule dans le discours » (Krieg-Planque, 2009). Nous nous interrogerons sur le statut d’utopie pouvant être attribué à la « ville intelligente », à la croisée des utopies urbaines (Picon, 2000 ; Riot-Sarcey, 2002) d’une part, et des utopies technoscientifiques et communicationnelles d’autre part (Breton, 1997 ; Musso, 2003 ; Mattelart, 1999). A cette fin, nous nous appuierons sur l’analyse des discours ayant pour objet la « ville intelligente » en France, sur la période de 2010 à 2017, et plus particulièrement sur l’étude de trois cas de projets de « ville intelligente », dans les villes et métropoles de Nice, Lyon et Paris. / The aim of the thesis is to identify and characterize the circulation, through the utopia of the "smart city", of a discourse favorable to an apparently depoliticized management of public affairs, but with multiple ideological bases: "technological populism" ". This research in information and communication sciences explores the different meanings attributed to the "smart city", considered as a "formula in the discourse" (Krieg-Planque, 2009).
