OrIAs : uma infraestrutura de nível micro-organizacional baseada em artefatos para sistemas multiagentes / OrIAs : an artifact-based micro-organizational level infrastruture for multiagent systems

Neste trabalho é apresentada uma infraestrutura de nível micro-organizacional para sistemas multiagentes. A infraestrutura permite definir e gerenciar papéis e grupos de papéis organizacionais, que caracterizam o nível micro-organizacional das sociedades de agentes, em termos de quatro dimensões organizacionais: estrutural, funcional, dialógica e normativa. As principais características micro-organizacionais suportadas pela infraestrutura são: definição de papéis em termos de objetivos de realização (achievement goals) e objetivos de manutenção (maintenance goals), e seus respectivos planos; definição de normas organizacionais e um mecanismo para imposição das normas (norm enforcement); relações de dependências organizacionais entre papéis e grupos de papéis; mecanismo de reputação para auxiliar os agentes na busca de parceiros para seus objetivos individuais e selecionar parceiros para atingir metas coletivas; processo de reorganização não institucionalizado realizado por iniciativa dos agentes. A infraestrutura é baseada no metamodelo de agentes e artefatos e no conceito de organizações incorporadas (embodied organizations). Como resultado deste trabalho é disponibilizada uma infraestrutura de gerenciamento organizacional, independente de modelo organizacional, desenvolvida utilizando a plataforma CArtAgO que permite tornar a organização acessível aos agentes. / In this work, we present an artifact-based micro-organizational level infrastructure for multi-agent systems. It provides a way to define and manage the organizational roles and groups of roles that characterize the micro-organizational level of agent societies, in terms of the four organizational dimensions: structural, functional, dialogical and normative. The main micro-organizational features supported by the infrastructure are: definition of roles in terms of achievement and maintenance goals, and their corresponding plans; organizational norms and corresponding sanction-based mechanism of norm enforcement; organizational protocols to support the achievement of role goals; relations of organizational dependences between roles and groups of roles; reputation mechanism to help agents to find partners for their individual goals and to select partners to achieve collective goals; reorganization process not institutionalized performed by the initiative of agents. The infrastructure is based on the A & A meta-model and in the concept of embodied organizations. As a result of this work, we provide an organizational management infrastructure, independent of organizational model, developed using the CArtAgO platform that makes the organization accessible to agents.

La technique des obligations positives en droit de la Convention européenne des droits de l'homme / The positive obligations technique in Law of the European Convention on Human Rights

La Cour européenne des droits de l'homme a, en 1968, dès son cinquième arrêt au principal, établi que des droits civils et politiques pouvaient générer des obligations d'action à la charge des États. Cette affirmation venait remettre en cause la définition traditionnelle de ces droits. En effet, ils étaient classiquement considérés comme mettant à la charge des États uniquement des obligations négatives. En revanche, les droits économiques sociaux et culturels étaient présentés comme imposant seulement des obligations positives. Le juge européen a, depuis lors, mis au jour un nombre croissant d'obligations positives prétoriennes. Plusieurs techniques ont été développées pour ce faire. Cette étude vise à analyser ce que nous avons dénommé la technique des obligations positives, c'est-à-dire l'usage par la Cour des termes « obligations positives » ou « mesures positives ». Cette technique permet non seulement au juge européen de dégager des obligations d'action à la charge des États, mais également de reconnaître sa compétence pour contrôler l'exécution de ses propres arrêts, de conférer un effet horizontal à la Convention ou encore d'étendre la notion de juridiction au sens de l'article 1 CEDH. Elle est également un moyen de moduler son contrôle en permettant tantôt d'accorder une large marge nationale d'appréciation, tantôt de la réduire à néant. Cette diversification croissante de l'usage de la technique dans la jurisprudence européenne est toutefois source d'incohérences.La thèse défendue vise à démontrer que la technique des obligations positives est un outil d'adaptation de la norme juridique conventionnelle à l'évolution des États démocratiques et libéraux européens. / As early as 1968, the fifth merits judgment of the European Court of Human Rights established that civil and political rights could generate action obligations on the European States. This judgment was challenging the usual definition of those rights, which were traditionally considered as charging the public authorities with only negative obligations. In contrast, economic, social and cultural rights were positioned as imposing positive obligations on the public authorities. The European Court of Human Rights has since created an increasing number of positive obligations and several techniques were developed for this purpose. This study aims to explore the “positive obligations technique”, that is to say, the Court's use of the terms “positive obligations” or “positive measures”. This technique not only allows the Court judge to impose action obligations on the European States, also recognizes the Court judge's competence to monitor the implementation by the public authorities of its own decisions, to give a horizontal effect to the Convention and to extend the concept of "jurisdiction" within the meaning of Article 1 ECHR. This technique also permits to modulate the Court's control over the European States, granting a wide margin of appreciation or reducing it to nothing. The increasing diversification of the use of this technique in European case law is however a source of discrepancy.. This thesis aims to demonstrate that the technique of positive obligations is a tool for adaptation of the conventional norma to the changes of the democratic and liberal European States.

CoordenaÃÃo de AperfeÃoamento de Pessoal de NÃvel Superior / The growing demand for mobile telephony services and the advent of new technologies requires their continued expansion, in order to ensure safe, reliable and high quality to its users. As a direct consequence of this growth has been the need to increase the amount of Radio Base Stations (RBS) to be installed. This expansion may have visual impacts and damage to the health of the population in the surrounding areas of the base stations, seeking always the best practices for the deployment of base stations. This model is based on policies that allow for expansion of services of mobile networks and, at the same time reduce the visual impact of these facilities as well as damage to the health of the surrounding area of the population, in a complementary manner to the applicable legislation. This concern is motivated by the loss of quality of service presented by the mobile operators, due especially to the poor distribution of antenna signal distributors. The objective of this work is to make a diagnosis of the spatial distribution of Radio Base Stations in the city of Fortaleza, focusing on its normative aspects and the current management system and supervision of those cell sites. The technical and regulatory aspects of installations of base stations used in mobile telephony will be searched, focusing the case study in Fortaleza, in addition to identifying the public agencies responsible for managing the inspection of cell sites in this municipality, and establish their respective responsibilities. For this, the methodology used in the study is based on qualitative exploratory research, using the deductive method of approach, performing literature, through the consultation of books, periodicals, theses, dissertations and legislation available on mobile telephony in Brazil and world, its normative aspects and criteria for installation of base stations. Also we used a field survey, through structured interviews managers of public agencies responsible for the management and supervision of RBS. The study showed that Fortaleza has 843 base stations registered by ANATEL (2014), with 6.8 million active mobile lines. Research by the SEUMA showed, among other aspects, despite the demands of municipal law in 8914, supervising or is done randomly, or from accusations of \\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\"disagreement\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\\" made by the people and that the body responsible not talk to one itself. / A crescente demanda pelos serviÃos mÃveis de telefonia e o advento de novas tecnologias exige sua contÃnua expansÃo, de modo a garantir serviÃos seguros, confiÃveis e de elevada qualidade aos seus usuÃrios. Como consequÃncia direta dessa expansÃo tem-se a necessidade do aumento na quantidade de EstaÃÃes RÃdio Base (ERB) a serem instaladas. Essa expansÃo pode apresentar impactos visuais e danos à saÃde da populaÃÃo nas Ãreas de entorno das ERBs, buscando-se sempre as melhores prÃticas para a implantaÃÃo das ERBs. Esse modelo baseia-se em diretrizes que permitem a expansÃo das redes dos serviÃos mÃveis e, ao mesmo tempo, reduzem os impactos visuais dessas instalaÃÃes assim como danos à saÃde da populaÃÃo da Ãrea de entorno, de modo complementar Ãs legislaÃÃes aplicÃveis. Tal preocupaÃÃo à motivada pela perda de qualidade do serviÃo apresentado pelas operadoras de telefonia mÃvel, devido, especialmente, à mà distribuiÃÃo das antenas distribuidoras de sinal. Assim, o objetivo deste trabalho à fazer um diagnÃstico da distribuiÃÃo espacial das EstaÃÃes de RÃdio Base no municÃpio de Fortaleza, enfocando seus aspectos normativos e o atual sistema de gerenciamento e fiscalizaÃÃo dessas ERBs. SerÃo pesquisados os aspectos tÃcnicos e normativos das instalaÃÃes das ERBs utilizadas na telefonia mÃvel, focando o estudo de caso no municÃpio de Fortaleza, alÃm de identificar os ÃrgÃos pÃblicos responsÃveis pelo gerenciamento da fiscalizaÃÃo das ERBs neste municÃpio e estabelecer as suas respectivas competÃncias. Para isso, a metodologia utilizada no trabalho à baseada na pesquisa exploratÃria qualitativa e quantitativa, fazendo uso do mÃtodo dedutivo de abordagem, realizando pesquisa bibliogrÃfica, atravÃs da consulta de livros, periÃdicos, teses, dissertaÃÃes e da legislaÃÃo disponÃvel sobre a telefonia mÃvel no Brasil e no mundo, seus aspectos normativos e critÃrios para instalaÃÃo das ERBs. TambÃm serà feita pesquisa de campo, atravÃs de entrevista estruturada aos gestores dos ÃrgÃos pÃblicos responsÃveis pelo gerenciamento e fiscalizaÃÃo das ERBs. O estudo mostrou que Fortaleza possui 843 ERBs cadastradas pela ANATEL (2014), com 6,8 milhÃes de linhas ativas de celulares. A investigaÃÃo junto à SEUMA mostrou, dentre outros aspectos que, apesar das exigÃncias da lei municipal no 8.914, a fiscalizaÃÃo ou à feita de forma aleatÃria, ou a partir de denÃncias de âdesconformidadeâ feitas pela populaÃÃo e que os ÃrgÃos responsÃveis nÃo dialogam entre si.

Trabalho e normatividade: uma anÃlise Ãtica dos discursos prescritivos do bom comportamento no trabalho / Work and Normativity: an ethical analysis of the prescriptives discourses of good behavior at work

nÃo hà / Trata-se de estudo teÃrico acerca da normatividade caracterÃstica dos discursos que prescrevem o âbom comportamentoâ no trabalho. Amparado pelas discussÃes gadamerianas, parte-se do âpreconceito inicialâ, de que tais discursos sÃo passÃveis de uma crÃtica Ãtica. Os discursos que prescrevem jeitos de ser, sentir, falar e comportar-se no trabalho, sÃo primeiramente visados em textos informativos do cotidiano, presentes em um jornal e uma revista. Tais textos, apresentados de forma exemplificativa, funcionam como disparadores das questÃes centrais a serem enfrentadas pelo trabalho: seria possÃvel articular uma crÃtica de fundamentaÃÃo Ãtica a tais discursos? Em que eles seriam injustos? O recurso à crÃtica que se articula no campo psicossociolÃgico à o movimento inicial da pesquisa. Encontra-se um pensamento crÃtico articulado acerca da distÃncia dos discursos que âprescrevem autonomiaâ e que âobrigam a participarâ, por exemplo. Trata-se de um discurso paradoxal. Percebe-se o lugar de destaque da Teoria do Capital Humano como tecnologia de âautogestÃoâ, âinternalizaÃÃo do controleâ. Passa-se pela contextualizaÃÃo do discurso no campo mais amplo das transformaÃÃes sociais pelas quais passa a sociedade contemporÃnea lÃquida e suas inversÃes das responsabilidades pÃblicas e privadas. O discurso normativo do bom comportamento acompanha, ou vem acompanhado, das transformaÃÃes da sociedade privatizada, que cria o sujeito psicologizado. Enfrenta-se, por fim, o desafio de elaborar uma crÃtica que se faÃa notar como eminentemente Ãtica. A noÃÃo de subjetividade enquanto passividade frente ao Outro traz o Dizer Ãtico de LÃvinas ao dito do texto acadÃmico. O solo da Ãtica à o encontro face ao Outro, Ãnico Outro, desnecessidade de leis, de regras. Com a entrada em cena do Terceiro, sempre a partir de LÃvinas, tenta-se articular uma justiÃa que seja o equivalente social do apelo Ãtico da paridade eu-Outro. O julgamento Ãtico se faz necessÃrio com o Terceiro. Entram em cena as regras, as leis, o direito. O discurso prescritivo do âbom comportamentoâ no trabalho se revela como uma lei injusta sem Alteridade. O encurvamento do eu sobre si na autogestÃo do Capital Humano mostra-se como fechamento ao Estrangeiro. O preconceito inicial de que tais discursos sÃo passÃveis de uma crÃtica Ãtica parece legÃtimo. / This is a theoretical study on the normativity of speech which guides the âgood behaviorâ at work. Based on Gadamerian discussions, we start from the âinitial prejudiceâ, which states the speech is subject to a critical ethics. The speech which regulate the ways of being, feeling, speaking and behaving at work are primarily seen in daily informative texts, such as newspapers and magazines. Such texts, presented in a sample way, work as triggers of the main question to be faced at work: is it possible to articulate a critique of ethical basis to these kinds of speech? How fair would they be? The resource to the critiques articulated in the psycho-sociological field is the starting point of this research. An argumentative articulated thought about the distance between the speeches that âprescribe autonomyâ and the ones that âobligate participationâ, for example, could be found. It is about a paradoxical speech. We could also notice the importance of the Human Capital Theory as the âself-managementâ technology and âcontrol internalizationâ. We explore the speech contextualization in the large field of social transformations which the net contemporary society goes through and its inversions of public and private responsibilities. The normative speech of good behavior follows, or is followed by, the changings of the privatized society, which creates the psychologized subject. Lastly, we face the challenge of elaborating a critique which is eminently ethical. The notion of subjectivity as passivity before the Other brings LÃvinas‟ ethical saying to the academic text. The Ethics‟ soil stands for the meeting facing the Other, only Other, needless of rules and laws. With the Third coming in, always according to LÃvinas, it is articulated a justice which is the social equivalent of the ethical appeal about the me-Other parity. The ethical judgement is made with the Third. Then, the rules, laws and rights come into the scene. The prescriptive speech of âgood behaviorâ at work shows itself as an unfair law without Alterity. The self-curving over itself at the self-management of Human Capital is shown as the closing to the Other. The initial prejudice which state these kinds of speech are passive of an ethical critique seems rightful.

Um modelo conceitual para ambientes inteligentes baseado em interações formais em espaços físicos / A conceptual model for smart environments based on formal interactions in physical spaces

Neste trabalho apresentamos um modelo para ambientes inteligentes baseado em organizações de agentes, onde interações entre entidades são associadas a espaços físicos, pessoas carregam dispositivos e se movimentam entre diferentes espaços físicos e cada espaço físico contém definições de interações (comportamentos definidos por normas) próprias do seu contexto. São definidos três componentes deste modelo: (1) modelo conceitual, (2) linguagem de especificação e (3) ambiente de execução. A separação do modelo nestes três componentes traz como principais conseqüências: (1) a ativação de um ambiente inteligente é feita através de um mecanismo de alto nível, (2) a especificação de um ambiente inteligente é independente do domínio de aplicação e (3) as especificações podem ser executadas em mecanismos diferentes de execução. / We introduce a conceptual model for smart environments based on agent organizations where interactions between entities are associated with physical spaces, people (carrying mobile devices) move between different physical spaces and these physical spaces contain definitions of interactions (behaviors defined by norms) related to each context. This model defines three components: (1) conceptual model, (2) language specification, and (3) execution environment. The separation in these three components brings as main consequences: (1) activation of a smart environment is performed through a high-level mechanism, (2) specification of a smart environment is independent of the application domain, and (3) specifications can be performed on different mechanisms of execution.

Relativa cortadora : movimento ou apagamento?

Este trabalho é uma análise formal da construção das orações relativas em contextos de sintagmas preposicionais no português oral culto de Porto Alegre em que a preposição não está visível na forma fonética, apesar de a gramática normativa exigi-la. Antes da realização da análise propriamente dita, relembramos a estrutura e a classificação das orações relativas, os pronomes relativos empregados com ou sem preposições e algumas particularidades e inovações dessas estruturas que vêm surgindo no PB, além de apresentar o panorama da gramática gerativa até o modelo de Princípios e Parâmetros, destacando as abordagens gerativas mais relevantes sobre a construção Relativa Cortadora. A análise baseia-se em dados coletados em 24 (vinte e quatro) inquéritos, que correspondem a 24 (vinte e quatro) informantes, registrados no corpus do projeto NURC – Norma Urbana Culta – que totalizam 300 (trezentos) períodos de análise. Seguindo o modelo de pesquisa gerativa – Princípios e Parâmetros –, são levantadas as estratégias de construção das orações padrão e não-padrão, sendo estas classificadas em Relativas Cortadoras e Relativas Copiadoras. Os resultados atestam que a construção não-padrão é utilizada em 69,33% dos casos, sendo 67,00% de Relativa Cortadora e 2,33% de Relativa Copiadora, enquanto que a estratégia padrão é empregada em 30,67% (trinta e três por cento). No uso da estratégia padrão, o emprego do pronome relativo está garantido, sendo resultado de movimento do elemento QU, com fixação de parâmetro [+movQU]; e no emprego das estratégias não-padrão a tendência é o uso da partícula “que”, denominada de “juntor”, correlacionada com o fato de que as orações subordinadas são regidas à principal por meio da conjunção. Neste último caso, QU não resulta de movimento [-movQU], sendo gerado na posição de base e caracterizando que o Português Brasileiro (PB) é uma língua de parâmetro [±movQU]. / This work is a formal analysis of the relative clauses’ construction in prepositional sintagms in oral cult Portuguese from Porto Alegre, in which the preposition is not visible in the phonetic form, in spite of the normative grammar requires it. Before accomplishing the analysis, we reminded the construction of the relative clauses, the relative pronouns with or without prepositions and some particularities and innovation of these constructions which are lighting up in BP, besides presenting the generative grammar view until the Principles and Parameters Model, singularizing the most relevant generative subjects about the construction of PP-Chopping. The analysis is based on data collected in 24 enquiries, corresponding to 24 informants registered in the corpus of the NURC project – Urban Cult Norma – which complete 300 periods of analysis. Following the model of generative research – Principles and Parameters –, the strategies standard – Pied-piping – and non-standard clauses´ construction are verified, and classificated in PP-Chopping and Resumptive Pronoun. The results show that the non-standard constructions are used in 69,33% of the cases, being 67,00% of PPChopping and 2,33% of Resumptive Pronouns, while the standard strategy is used in 30,67%. In the usage of the standard strategy, the use of the relative pronouns is assured, being a result of the element WH moviment, with the parameter fixing [+movWH]; while in the nonstandard strategies is tended the usage of “que”, called “juntor”, related to the fact that the subordinate clauses are governed to the main one by the conjuction. In this last case, WH does not result of movement [-movWH], being generated in the base position and characterizing that Brazilian Portuguese is a language of parameter [±movWH].

Função normativa das agências reguladoras: natureza e hipóteses de exercício / Normative function of regulatory agencies: nature and cases

O presente trabalho analisa as hipóteses em que cabe às agências reguladoras exercer função normativa (compreendida como a edição de textos normativos gerais e abstratos), examinando a natureza dessa função, suas relações com as outras competências e instrumentos normativos do Poder Executivo e do Poder Legislativo e o controle jurisdicional que se realiza sobre essa atividade das agências reguladoras. Nessa tarefa, é examinada a evolução doutrinária e jurisprudencial, no sistema brasileiro e nos ordenamentos jurídicos que mais nos influenciaram nessa matéria, sobre a compreensão a respeito dos princípios da separação dos Poderes e da legalidade. As principais questões enfrentadas referem-se à identificação dos limites da válida edição de atos normativos pelas agências reguladoras, ao regime jurídico aplicável a essa figura normativa e às possíveis soluções para eventuais conflitos de normas envolvendo atos normativos editados pelas agências reguladoras. / This paper examines the assumptions according to which it is possible for the regulatory agencies exert regulatory function (understood as the enactment of general and abstract normative texts), examining the nature of such function, its relations with other powers and legislative instruments used by the Executive Branch and the Legislative Branch and the judicial review over the activities performed by the regulatory agencies. In this task, it\'s analysed the doctrinal and jurisprudential developments, in the Brazilian system and the legal systems that most influenced Brazil in this area, on the understanding about the principles of separation of powers and legality. The main issues addressed relate to identifying the limits of valid normative acts enacted by regulatory agencies, the legal regime applicable to such normative figure and possible solutions for conflicts of rules involving normative acts issued by regulatory agencies.

The practices on the Internal Social Responsibility considered herein were the social indications from ETHOS Institute of Companies and Social Responsibility, focusing the following points: dialogues and participation; human respect and decent work (ETHOS, 2006). This study has taken use of a documental and exploratory research(CERVO; BERVIAN, 1983). The research bibliography approached the social responsibility according to Ashley (2003), Mcintosh et al. (2005), Meyer e Herscovitch (2001). The documental research was a base for the research samples and for the identification of the developed actions held by the companies. The present research was done in two big companies in the areas of services: the sewage and water company in Cearà State(CAGECE) and Guanabara Transportation Company(GUANABARA), both winners of Delmiro Gouveia Award in social responsibility and in the social performance category. The data collection was done through a methodology of survey application divided in: elaboration of data collection, a series of ordered questions with three sets of RSI indices, and three bases of organizational commitment, where it was used Liket scale of variation from one to five to the answers. The questionnaire was answered by hand and was applied with two hundred and twenty operational level employees, divided in an equable way in the two companies. The presentation methods and the analysis of data expanded in three blocks: the first deals with the profile of the interviewees out of an arithmetic average and relative attendances; the second presents the main analysis of components through the factorial analysis which present the principal actions in RSI which produced commitment; and the third block deals with a comparative analysis involving the two companies. As instruments of process it was used the SPSS and the Excel programs. The results obtained in this research show that the internal social responsibility has a great influence in the organization commitment of the workers. The actions of the internal social responsibility which most influence in the expected commitment have a lot to do with the social index dialogue and participation, model quoted by Valladares, Leal Filho and Roman(2005); (GuimarÃes and Borges, Marques and Adorno(2005), and the model of commitment generated by these actions is the affectivity. / Este trabalho buscou investigar os vÃnculos existentes entre as prÃticas de responsabilidade social interna - RSI e o comprometimento organizacional. As prÃticas de responsabilidade social internas consideradas foram os indicadores sociais do Instituto Ethos de Empresas e Responsabilidade Social, enfocando os seguintes pontos: diÃlogo e participaÃÃo, respeito ao indivÃduo e trabalho decente (ETHOS, 2006). Este estudo caracteriza-se como uma pesquisa exploratÃria, descritiva e comparativa, apoiando-se em pesquisa bibliogrÃfica e documental (CERVO; BERVIAN, 1983). A pesquisa bibliogrÃfica abordou a responsabilidade social baseada nos autores Ashley (2003), Mcintosh et al. (2001), Oliveira (2002), Srour (2003) e o comprometimento organizacional com os autores Bastos et al. (1997), Bonavides, Oliveira e Medeiros (2006), Medeiros et al. Os resultados obtidos indicam que a responsabilidade social interna tem grande influÃncia no comprometimento organizacional do trabalhador. As aÃÃes de responsabilidade social interna que exercem maior influÃncia no comprometimento partem do indicador social diÃlogo e participaÃÃo, modelo citado por Valladares, Leal Filho e Roman (2005); (GuimarÃes e Borges, Marques e Adorno (2005) e o modelo de comprometimento gerado por estas aÃÃes à o afetivo.

The Normative Moral Codes Workshop : - A new thought-experiment aimed at investigating normative morality / Den Normativa Moraliska Kods Workshoppen : - Ett nytt tankeexperiment ämnat för att undersöka normativ moral

The normative moral code is considered to be such that it applies universally to all or at least to all who can understand and govern their behavior by it. All or almost all common folk think of and use their own moral codes as them being normative in that for example there simply seem to them to exist “oughts” that apply to all and that there simply, straightforwardly are “things” that are right and wrong, good and bad. Gert Bernard and Gert Joshua have written an article on the topic of defining morality, with the title of “The Definition of Morality”. The authors suggest that the terms ‘normative morality’ refer to a code of conduct that, given some specified conditions, would be put forward by all rational persons. The authors take this formulation as entailing true and important definitional features of what normative morality is, although the authors think of this basic definition, conception as not being complete and that some additional feature hence is lacking but that any such candidate addendum to the definitional basic schema that they surveyed within the article seemed to be controversial, contested. Normative morality seems apt to investigate by creating thought-experiments wherein the participants are for example, envisioned choosing to endorse, put forward or act in accordance with a moral code. Within this large investigative project into normative morality with the help of thought-experiments it seemed to me that there was an under-representation of thought-experiments exhibiting some worthwhile and relevant features and I felt that it was a warranted project to create a thought-experiment which concurrently exhibited these features. Such an experiment could be thought of as an unusual “puzzle-piece” which could be valuable in contributing to furthering the completion of the “puzzle”, i.e. what normative morality is and its moral code. These three features were: i) a high degree of aptness for investigating a major part of or the complete normative moral code and ii) a high degree of freedom pertaining to the participants, e.g. their actions, thoughts etc., as well as iii) a high degree of confidence or warrant concerning what the participants would do, think, feel etc. within the thought-experiment. A thought-experiment, the Normative Moral Codes Workshop (NMCW) was hence created, which was aimed at investigating normative morality and its code and which exhibited these features. It is a thought-experiment mimicking an actual empirical study wherein the participants are given the task to together put forward the moral code for them, that would apply to them and that would cover a major or complete part of what they consider their moral codes to entail. The participants employed within my run of the NMCW thought-experiment were all currently living adult persons who I knew well. The core or main aim of this essay was to investigate whether it would or would not be the case that most or all participants within my run of the thought-experiment the NMCW would decide to put forward the code together with the chosen formulation of the thesis being, that it would not be the case that most or all participants would put forward the code within my run of the NMCW thought-experiment. Part of the core aim was also to elucidate why the thesis was supported or not supported as well as how strong the support was for the outcome of the experiment, i.e. the outcome of a code being put forward or not. The essay also has some minor aims which radiate out from the core aim (see below). As the thought-experimenter, I then reported on the events that I envisioned as happening within my run the NMCW thought-experiment as my selected participants grappled with the task and their decision to put or not put forward the code together that would apply to them. The finding was that the thesis was supported and that the support was robust in that I could identify several reasons the participants had against putting forward the code and I found very little in terms of reasons among the participants for putting forward the code. The essay also had some minor aims to selectively discuss a few further relevant and interesting issues radiating out from the core aim. These minor aims revolved around discussing some selected salient features of the NMCW including how they could relate to the outcome. One such selected salient feature was the feature of the employed participant sample of my run of the NMCW. I for example, discussed the potential extension of it not being the case that most or all participants would decide to put forward the code, if the participant sample would have been modified but still employed currently living5adults and I ended up being of the opinion that pertaining to most potential samples a similar outcome as the one envisioned within my run of the NMCW would be expected. I also wanted to discuss some further selected salient features of the NMCW within the context of addressing whether the NMCW, given its features ought to be considered an unsound, inapt experiment for investigating normative morality, given Gert’s and Gert’s conception of normative morality, since if this was the case the outcome of the experiment ought to be disregarded, given no weight. Although, I did find potential targets for criticism of the NMCW experimental design I did not find any reasons strong enough to disqualify the NMCW experiment as an experiment inapt, unsound for investigating normative morality, given the features of normative morality entailed within the suggested basic definition provided by Gert and Gert. Finally, I also aimed to selectively discuss some aspects of what it could mean pertaining to the conception of normative morality, according to Gert and Gert, that the thesis was supported. For example, given one interpretation the outcome could be taken to provide support for the non-existence of a normative moral code, but given another be taken to mean that addenda has to be identified and added to the basic conception of normative morality and that such addenda would be such that they would disqualify the NMCW (and its outcome) as a sound and apt thought-experiment to be employed in investigating normative morality. I also attempted to briefly illustrate how the NMCW thought-experiment could be used as a substratum facilitating the identification and clarification of such potential addenda to the basic conception of normative morality, suggested by Gert and Gert, and I also suggest some potential candidate features of the NMCW that further potential specifications added to the basic conception of morality ought to be able to disqualify, exclude as acceptable features of experiments aimed at investigating normative morality. In this way, an unusual, under-represented kind of thought-experiment, “puzzle-piece” when it comes to the large investigative project of employing experiments in order to acquire further insight into normative morality, i.e. “the puzzle”, can regardless of whether it seems to fit or does not seem to fit the “puzzle”, still be employed in such a way as to potentially provide further insight into “the puzzle”. This since even when a “puzzle-piece” does not seem to fit the “puzzle”, “seeing” and understanding how and why could provide us with information about the “puzzle”. / Den normativa moraliska koden anses vara sådan att den gäller universellt för alla eller åtminstone för alla som kan förstå den och reglera sitt beteende i enlighet med den. Ett dylikt experiment kunde anses vara en ovanlig ”pusselbit” som kunde vara ett värdefullt bidrag till slutförandet av ”pusslet”, dvs vad normativ moral är och dess kod. De tre under-representerade egenskaperna var i) en hög grad av lämplighet för att undersöka en stor del av den normativa moraliska koden6eller den kompletta koden och ii) en hög grad av deltagarfrihet, exempelvis avseende deltagarnas handlingar, tankar osv samt iii) en hög grad av förtroende eller rättfärdigande avseende vad deltagarna skulle göra, tänka, känna osv inom tankeexperimentet. Tankeexperimentet, den Normativa Moraliska Kods Workshoppen (NMKW) skapades därför med målsättningen att undersöka den normativa moralen, dess kod samt att experimentet då skulle uppvisa de ovan nämnda egenskaperna. Det är ett tankeexperiment som liknar, ”speglar” en riktig empirisk studie inom vilka deltagarna ges uppgiften att tillsammans stödja och lägga fram den moraliska kod som skulle gälla för dem, reglera deras uppförande och som till en stor del eller fullständigt skulle täcka, innehålla det som de ansåg att deras moraliska koder innehöll. Deltagarna som användes inom min körning av tankeexperimentet var alla nu levande vuxna person som jag ansåg att jag kände väl. Kärn- eller huvudmålsättningen med uppsatsen var att undersöka huruvida det skulle eller inte skulle vara fallet att de flesta eller alla deltagare inom min körning av NMKW tankeexperimentet skulle bestämma sig för att tillsammans lägga fram och stödja en kod, med den valda formuleringen för tesen enligt, det skulle inte vara fallet att de flesta eller alla deltagare skulle lägga fram och stödja koden inom min körning av NMKW experimentet. Som en del av kärnmålsättningen var det att utreda varför tesen var eller inte var stödd samt utreda hur starkt stödet var för utfallet av experimentet, dvs utfallet att en kod lades fram eller inte lades fram. Uppsatsen har även mindre eller bi-målsättningar som strålar ut från uppsatsens huvudmålsättning (se nedan). I min roll som tanke-experimenteraren så rapporterade jag sedan kring vilka händelser som jag föreställde mig, som jag ”såg” uppträda inom tanke-experimentet NMKW då mina valda deltagare tog sig an uppgiften som de ombads att utföra, dvs att tillsammans lägga fram och stödja den kod som skulle komma att gälla dom själva, att appliceras på dom själva. Fyndet var att tesen stöddes och att detta stöd var robust eftersom jag kunde identifiera flera skäl hos deltagarna mot att lägga fram koden medan jag fann mycket litet i form av skäl hos deltagarna för att lägga fram koden. Uppsatsen hade även en del mindre målsättningar att selektivt diskutera några ytterligare relevanta och intressanta spörsmål som strålade ut från uppsatsens huvud-målsättning. Dessa mindre målsättningar kretsade kring att diskutera vissa valda tydliga, centrala egenskaper hos NMKW experimentet samt hur dessa kunde tänkas vara relaterade till experimentets utfall. En sådan egenskap vara den specifika deltagargruppen som användes vid min körning av experimentet. Jag diskuterade till exempel, den potentiella extensionen av utfallet att det inte var fallet att de flesta eller alla deltagare valde att lägga fram koden, ifall deltagargruppen modifierades men fortfarande bestod enbart av nu levande vuxna människor och min värdering var att ett liknande utfall, som vid min körningen av NMKW, verkade troligt för de flesta potentiella grupper av deltagare. Jag ville också diskutera vissa valda tydliga, centrala egenskaper hos NMKW experimentet inom kontexten kring huruvida NMKW experimentet givet dessa egenskaper, borde anses vara ett osunt, olämpligt experiment för att undersöka den normativa moralen, givet Gerts och Gerts konception av denna. Detta, eftersom om detta vore fallet så borde utfallet av experimentet förkastas och inte ges någon vikt. Trots att jag hittade potentiella saker att kritisera hos den experimentella designen hos NMKW så hittade jag inte några tillräckligt starka skäl för att diskvalificera NMKW experimentet som ett olämpligt, osunt experiment för att undersöka den normativa moralen, givet den normativa moralens egenskaper beskrivna, täckta inom Gerts och Gerts föreslagna basala, grundläggande definition av denna. Slutligen så ville jag även selektivt diskutera vissa aspekter kring vad det kunde betyda för konceptionen av den normativa moralen, enligt Gert och Gert, att tesen stöddes. Exempelvis, så givet en tolkning så kunde utfallet ses som ett stöd för icke-existensen hos den normativa moraliska koden, medan givet en annan tolkning så kunde utfallet anses betyda att ytterligare addenda till den basala definitionen av den normativa moralen måste identifieras och adderas till definitionen och att dylika addenda skulle komma att vara sådana att de skulle diskvalificera NMKW experimentet och dess utfall som ett sunt och lämpligt experiment att användas för att studera den normativa moralen, nu med dess extenderade specifikation. Jag försökte sedan att illustrera hur NMKW tankeexperimentet kunde användas som ett substrat för att underlätta identifieringen och förtydligandet av dylika potentiella tillägg till den basala konceptionen av den normativa moralen enligt Gerts och Gerts förslag, och jag föreslog även vissa potentiella kandidat egenskaper hos NMKW experimentet som dylika ytterligare tillägg till den basala konceptionen borde kunna diskvalificera, exkludera som acceptabla egenskaper hos experiment designade för att undersöka den7normativa moralen. På detta sätt så kan en ovanlig, underrepresenterad typ av tankeexperiment, ”pusselbit” när det gäller det stora undersökningsprojektet som använder sig av experiment för att erhålla ytterligare insikter inom den normative moralen, dvs ”pusslet”, oberoende om det verkar passa eller inte passa in i ”pusslet”, ändå användas på ett sådant sätt så att det potentiellt kan leda till ytterligare insikter kring ”pusslet”. Detta eftersom även när en ”pusselbit” inte verkar passa in i ”pusslet” så kan ”seendet”, förtydligandet och förståelsen kring hur och varför, ändå potentiellt förse oss med information om ”pusslet”.
