The Constitution is full of principles, which are legal rules with differentiated normativity, whose application demands a specific methodology. Thus the Theory of Principles took a central role in the new constitutional hermeneutic. The identification and construction of principles, and the methodology used to extract its normativity, are tasks of utmost importance for the interpretation and application of the Constitution. Nevertheless, regardless of how much the national studies on constitutional principles evolved, we see that they have not focused on the field of application of the Constitution that falls specifically on the electoral legal order. Consequently, the electoral law resents the lack of systematization of its rules and a theoretic referential to support it and guide its interpretation and integration. This study humbly seeks to collaborate in the overcoming of these difficulties. It seeks to identify and help the construction of what would be the constitutional principles of electoral law. In order to reach this daring objective, we start from a clear stance regarding the Theory of Principles and the definition of a scientific methodology, within a dogmatic perspective, which allows the outlining of a safe path in the disclosure and construction of these principles, to then pursue the field of constitutional electoral order. It is not a study that seeks to exhaust the subject. This work is necessarily incomplete, considering that principles, by their own nature, can be implicit and constructed through an evolutionary interpretation. On the other hand, the study allows one to safety attest that the rules expressed herein are constitutional principles that shall inform the Brazilian electoral law. The result of this study is a list of constitutional principles of electoral law, classified according to their scope and with the definition of their contents, theoretic justifications and their jurisprudential development / O objetivo deste estudo é a identificação e o desenvolvimento teórico dos princípios constitucionais do direito eleitoral. A Constituição está repleta de princípios, que são normas jurídicas de normatividade diferenciada e cuja aplicação requer metodologia específica. É por isso que a Teoria dos Princípios assumiu papel central na nova hermenêutica constitucional. A identificação e a construção dos princípios, bem como a metodologia para extrair sua normatividade, são tarefas do maior relevo para a interpretação e aplicação da Constituição. Entretanto, por mais que tenham evoluído os estudos nacionais sobre os princípios constitucionais, verificamos que estes ainda não tomaram por objeto o campo de incidência da Constituição que recai especificamente sobre o ordenamento jurídico eleitoral. Consequentemente, o direito eleitoral se ressente da falta de uma sistematização de suas normas e de um referencial teórico que lhe dê sustentação e lhe paute a interpretação e integração. Este estudo visa, humildemente, a colaborar na superação destas dificuldades. Visa ele a identificar e ajudar na construção de quais seriam os princípios constitucionais do direito eleitoral. Para cumprir com este ousado objetivo, partimos de um posicionamento claro a respeito da Teoria dos Princípios e a definição de uma metodologia científica, dentro de uma perspectiva dogmática, que permita traçar um caminho seguro na revelação e construção destes princípios, para então enveredar-se no campo do ordenamento constitucional eleitoral. Não se trata de um estudo que pretende esgotar o tema. Este é um trabalho necessariamente incompleto, eis que os princípios, por sua própria natureza, podem ser implícitos e construídos através de uma interpretação evolutiva. De outra parte, o estudo permite atestar, com segurança, que as normas aqui vertidas são princípios constitucionais que devem informar o direito eleitoral brasileiro. O resultado do estudo é um rol de princípios constitucionais de direito eleitoral, classificados conforme o seu objeto e com a definição de seus conteúdos, justificativas teóricas e seu desenvolvimento jurisprudencial

The intention in this work is to reveal the poetic to Mario Quintana, seeking to understand and explain how the poet manipulates the imagery of incitement and as evidenced by his poetic concepts. To this end, the work The Anthropological Structures of the Imaginary (2001), and the imaginary, of Gilbert Durand (1994), will provide the theoretical basis and the poetics of reverie, of Gaston Bachelard (2009). Therefore, consider the style and the plurality of styles in Quintana, making a foray into the poetic to prove that the author is not attached to any literary style, though, has it left contaminated by the surreal beauty as a means to seek the freedom of creation, escaping the limitations imposed by so-called literary schools, because the author walked against material society. Thus, his poems explore dreams, fantasies, visions and hallucinations. This dissertational work will be guided by a simple language, even in the case of the theories explored here, since another goal that will guide is to make it work in a research material for teachers and high school students. Therefore, the didactic character will be a goal to be achieved at the end. Thus, it is expected to instigate the reader of this work to pursue the work of Mario Quintana and her make object pleasant and constant reading. / Este estudo objetiva analisar as obras O Aprendiz de Feiticeiro e Espelho Mágico para apresentar Mario Quintana como um feiticeiro aprendiz de mágico capaz de transformar imagens em conceitos e o cotidiano em linguagem. A pretensão nesse trabalho é desvendar o fazer poético de Mário Quintana, buscando entender e explicitar a forma como o poeta manipula a incitação do imaginário e como evidencia seus conceitos poéticos. Para atingir essa finalidade, as obras As estruturas Antropológicas do Imaginário (2001), e O imaginário, de Gilbert Durand (1994), servirão de aporte teórico, bem como A poética do devaneio, de Gaston Bachelard (2009). Para tanto, consideraremos o estilo e a pluralidade de estilos em Quintana, fazendo uma incursão pelo poético para comprovar que o autor não se prendeu a nenhum estilo literário, muito embora, tenha se deixado contaminar pela beleza surreal como meio de buscar a liberdade da criação, fugindo das limitações impostas pelas chamadas escolas literárias, pois o autor caminhou na contramão da sociedade material. Assim, seus poemas exploram sonhos, fantasias, visões e alucinações. Este trabalho dissertativo será pautado por uma linguagem simples, mesmo em se tratando das teorias aqui exploradas, uma vez que outro objetivo que o norteará é fazer com que resulte num material de pesquisa para professores e estudantes do Ensino Médio. Para tanto, o caráter didático será uma meta a ser conquistada ao final. Dessa forma, espera-se instigar o leitor desta dissertação a buscar a obra de Mario Quintana e dela fazer objeto de leitura prazerosa e constante.

The research started from the conviction that, in its course through Brazilian territory, this curricular component is related to the space of political tensions, which involves negotiations between state and religions. In addition to the pedagogical questions, there are elements of legal, religious and epistemic order at stake. The main objective of the research was to analyze models and practices of religious education in these two schools, considering the presence in them of a plural religious public. It was considered their dilemmas and complexity from a threefold classification of Religious Educational models (Catechetical, Theological and Religious Sciences) present in theory and practice. The work was divided into three steps. Initially, it was shown how the Religious Education is present in the Brazilian Constitutions and on the educational legislation of the States of Sao Paulo and Rio de Janeiro, for later explaining of the present models at course in the Religious Education practice in Brazilian education. After, the field research made in the schools sought to identify the conflicts generated between students and teachers in the Religious Education classes, and tried to determine how the model of Sciences of Religion could set an important option in teacher training for the Religious Education, also being the one that can surpass with more gains the challenges of religious diversity among students. Finally, the main results of the survey were presented, which pointed to the need to have a greater clarity regarding the definition of the object of Religious Education and the contribution of Religious Science for this area of knowledge, since it will be necessary to rely always more, in the pedagogical plans of schools, with a religious multiplicity between students / Resumo: Esta dissertação tenciona expor as coerências e ambivalências no Ensino Religioso escolar (ER) a partir de um estudo do lugar do ensino religioso no projeto pedagógico de duas escolas distintas: o Colégio Municipal Ana Elisa Lisboa Gregori e o Colégio Franciscano São Miguel Arcanjo. A pesquisa partiu da convicção de que, em seu percurso pelo território brasileiro, este componente curricular encontra-se relacionado ao espaço das tensões políticas, que envolvem negociações entre Estado e religiões. Para além das questões pedagógicas, estão em jogo elementos de ordem legal, religiosa e epistêmica. O objetivo principal da pesquisa foi analisar modelos e práticas do Ensino Religioso nessas duas escolas, considerando nelas a presença de um público religioso plural. Levaram-se em conta seus dilemas e complexidade a partir de uma classificação tríplice dos modelos de ER (catequético, teológico e das Ciências da Religião) presentes na teoria e na prática. O trabalho foi dividido em três passos. Inicialmente, mostrou-se de que maneira o ER se faz presente nas Constituições brasileiras e na legislação educacional dos Estados de São Paulo e Rio de Janeiro, para depois explicitar os modelos presentes no decorrer da prática do ER na educação brasileira. Em seguida, a pesquisa de campo feita nas escolas procurou identificar os conflitos gerados entre os alunos e os professores nas aulas do ER, e tentou apurar de que forma o modelo das Ciências da Religião poderia se configurar como importante opção na formação docente para o ER, além de poder ser aquela que supera com mais ganhos os desafios da pluralidade religiosa entre os alunos. Finalmente, foram apresentados os principais resultados obtidos pela pesquisa, os quais apontam para a necessidade de se ter maior clareza quanto à definição do objeto do ER e da contribuição das Ciências da Religião para esta área de conhecimento, uma vez que será preciso contar sempre mais, nos planos pedagógicos escolares, com uma multiplicidade religiosa entre os alunos

Hannah Arendt: entre a contingência e o absoluto / Hannah Arendt: between contingency and the absolute

Da crítica de Hannah Arendt à pretensão da soberania extrapolamos, na primeira parte desta tese, uma problematização do recorrente equívoco do pensamento projetar o absoluto, impróprio a nossa existência plural. Observamos, em Hobbes e em Berlin, como esse absoluto, em seu existir simulado, sempre se apresenta ao modo de uma dualidade, na qual a verdade ou emancipação plena equivale à falsidade ou opressão plena, a revelação divina, à dedução jurídica, e vice-versa. Enquanto, por detrás dessa farsa, a realidade se reproduz, contingentemente, nos conflitos entre limites que se tensionam, contorcendo-se sobre si mesmos. Após uma breve problematização da permanência da farsa do absoluto e da dualidade, mesmo no pensamento que se levanta contra ela, retornamos a Arendt, uma pensadora que se diferencia em sua aceitação da prática política e da espontaneidade, a partir da qual busca compreender como os valores e possibilidades republicanas a beleza plural da dignidade comum, mesmo que imperfeitamente defendida em seus escritos efetivam-se sem precisarem se sustentar no absoluto. Na segunda parte, considerando-se que ela, não obstante, retorne ao e ilustre os equívocos do retorno ao absoluto, iniciamos uma requalificação de seu pensamento, com intuito de mantê-lo coerente com a condição de contingência. Partindo do tema do conflito e tensão entre passado e futuro, o qual recorta toda a sua obra, concentramo-nos nos escritos do início de sua carreira acadêmica, mais diretamente dedicados à compreensão da experiência totalitária que a afetou como judia alemã. Após uma breve introdução aos traços gerais do que seria uma ontologia consistente da pluralidade e da contingência, exploramos a questão da responsabilidade, observando como alguns desses traços se apresentam. Do pária ao parvenu, da conservação à mudança, do idealismo ao realismo, da antiguidade à modernidade, observamos como não somos soberanos, nem vassalos: somos a responsabilidade que se manifesta em sua contingência e espontaneidade, nas tensões dos conflitos entre pluralidades. / From Hannah Arendts critique of the pretension of sovereignty, we extrapolate, in the first part of this thesis, a problematization of the recurring mistake of thought projecting the absolute, improper to our plural existence. We observe, in Hobbes and Berlin, how this absolute, in its simulated existence, always presents itself as a duality, in which full truth or emancipation corresponds to full falsehood or oppression, divine revelation corresponds to juridical derivation, and vice-versa. Throughout, behind this farce, reality is reproducing itself, contingently, in the conflicts between limits that tension each other, writhing over themselves. After a brief problematization of the perpetuation of the farce of the absolute and of duality, even by thinkers that rise against it, we return to Arendt, a thinker that differentiates herself by her welcoming of politics and spontaneity, from which she seeks to understand how republican values and possibilities the plural beauty of common dignity, even if imperfectly advanced by her become effective without having to find support on the absolute. In the second part, considering that Arendt, nonetheless, returns to and illustrates the mistakes of returning to the absolute, we begin a requalification of her thought, with the intention of keeping it coherent with the condition of contingency. Starting from the theme of conflict and tension between past and future, which traverses her entire academic production, we focus on her early writings, more directly devoted to understanding the totalitarian experience that affected her as a German Jew. After a brief introduction to the general traits of a consistent, however incipient, ontology of plurality and contingency, we explore the question of responsibility, observing how some of these traits present themselves. From the pariah to the parvenu, from conservation to change, from idealism to realism, from antiquity to modernity, we observe how we are neither sovereigns nor vassals: we are the responsibility that manifests itself in its contingency and spontaneity, in the tensions of the conflicts between pluralities.

The Changing Role of Soft Money on Campaign Finance Reform.The Birth of the 527 and its Consequences.

In a time when record numbers of dollars are being spent on campaigns the unregulated dollars are flowing faster than ever. Hundreds of millions of dollars in independent expenditures are being used for “issue advocacy”, print and broadcast advertising, which does not expressly endorse or oppose a candidate for office. The one-time campaign finance ceiling has become the campaign finance basement. Individuals are able to give unlimited dollars to 527 organizations, which function outside of all campaign finance regulation and provide a new path for the flow of political dollars. Since the passage of the Bipartisan Campaign Reform Act, commonly known as the McCain-Feingold Act, federally regulated lobbyists and PACS are being edged out of the political dollar due to contribution limits. It is in 1996 that we witness the birth of 527 organizations and the flourishing growth of soft money spending in the campaign process.

Élections expérimentales : la désertion stratégique et la participation sous différents modes de scrutin

Cette thèse s'intéresse au lien qui existe entre le système électoral et deux comportements importants de la vie civique, soit la participation à une élection et la désertion stratégique du candidat préféré vers un autre candidat. Ces thèmes sont abordés dans de nombreux et de très importants ouvrages en science politique. En passant par la théorie (Downs, 1957) jusqu'à des études de terrain par l'entremise de sondages (Abramson, 2010; Blais, 2010), diverses méthodologies ont été employées pour mieux expliquer les choix des électeurs. Ma contribution à l'avancement des connaissances dans ce domaine passe par l'usage de la méthode expérimentale pour mieux saisir les similitudes et différences dans les comportements des électeurs sous le système uninominal à un tour (UT) et la représentation proportionnelle (RP) ainsi que les mécanismes au niveau individuel qui produisent ces similitudes et différences. Le cœur de la thèse est composé des trois articles dont voici les résumés : Article 1. Des élections expérimentales faites à Montréal, Paris et Bruxelles permettent d'estimer l’influence directe du mode de scrutin sur la décision des électeurs de voter ou non, et de voter pour leur parti préféré ou non. En tout, 16 groupes de 21 électeurs votent sous différents systèmes électoraux, soit le UT et la RP. Les préférences sont attribuées aléatoirement et connues de tous les participants. Nos résultats indiquent que le vote n'est pas globalement plus sincère et que la participation électorale n'est pas plus élevée sous le système proportionnel. Toutefois, nous observons moins de désertion d'un petit parti sous le système proportionnel. Article 2. Les expériences permettent également d'expliquer pourquoi les électeurs votent parfois pour un parti autre que leur parti préféré. La conclusion principale est que la décision de voter de façon sincère ou non est influencée par les préférences individuelles, mais aussi par les perceptions des chances de gagner des candidats ainsi que des chances que son propre vote puisse décider le résultat de l'élection. Les électeurs qui désertent leur premier choix prennent en considération quel candidat est le plus près de leurs positions politiques, mais également de la viabilité de cette alternative. De plus, les électeurs qui aiment prendre des risques ont davantage tendance à déserter. Article 3. Le modèle de l'électeur pivot est mis à l'épreuve pour mieux comprendre la décision de voter ou non lors d'une élection. Nos expériences permettent de répliquer, avec un devis expérimental différent, les résultats importants des travaux de Duffy et Tavits (2008). Nos résultats confirment que la perception d'être pivot augmente la participation, que ces perceptions sont sujettes à la surestimation et que cette surestimation ne décline pas complètement dans le temps. Nous allons également plus loin que les recherches de Duffy et Tavits et nous trouvons que la participation n'est pas plus forte sous RP que sous UT et que la probabilité d'être pivot a un impact plus important chez les électeurs évitant de prendre des risques. / This thesis focuses on the relationship between the electoral system and two important behaviors of civic life: participation in an election and the strategic desertion of the preferred candidate. These topics are addressed in very important books in political science. From theory (Duverger, 1954; Downs, 1957) to empirical research using surveys (Abramson, 2010; Blais, 2010), various methodologies have been used to better explain voter's choices. My contribution to knowledge is the use of experimental methods to better understand both similarities and differences in voter behavior under the plurality system (PLU) and the proportional representation (PR) system and the individual level mechanisms that produce these similarities and differences. The core of the thesis consists of three articles summarized below: Article 1. Experimental elections conducted in Montreal, Paris and Brussels estimate the direct influence of the voting system on the voters' decision whether to vote or not, and vote for their preferred party or another party. In all, 16 groups of 21 voters take part in elections under different electoral systems. The systems are simple plurality and proportional representation. Preferences are randomly assigned and known by all participants. Our results indicate that voting is globally not more sincere and that voter turnout is not higher under the proportional system. However, we observe less desertion of small parties under the proportional system. Article 2. We perform a laboratory experiment to explain why voters sometimes vote for a party other than the preferred one. The main conclusion of the paper is that in addition to voter preferences, perceptions of winning chances and belief in the possibility of affecting the outcome are key factors in the voter’s decision to vote sincerely or not. When they desert their first choice, voters consider their preferences and the viability of the alternatives. Voters who like to take risks are more prone to desert. Article 3. This paper examines the decision to vote or not in experimental elections. We replicate the important findings of Duffy and Tavits (2008) with a different design. Our results support their finding, that is, turnout is affected by the belief that one's vote counts and overestimation of the probability that one's vote counts does not decrease completely over time. Going beyond previous research, we also find that turnout is not higher under a proportional system than under a plurality system, and beliefs about being in a pivotal disposition have a greater impact on turnout among the risk averse.

From this position I highlight the limitations of social action in theories of organisation and work. Moreover, I theoretically derive a model of work participation that acknowledges broader orientations to work. I interrogate that model of work participation in a study of four dominant forms of industrial organisation. Those organisations are SEQEB the South East Queensland Energy Board, Eagle Boy Pizzas in Queensland, the New South Sugar Milling Cooperative Ltd, and Budge -Ellis Staff Co-operative. Gathering data for this study involved both primary and secondary research. I used a comparative and longitudinal field research approach, unstructured interviews with an interview guide, and the collection of documents recommended by interviewees. I interviewed people working in the organisations and relevant government agencies. My research involved travel in Queensland and New South Wales, Australia. Ultimately, I produce a sociologically informed model for the establishment of 'willing and social' work participation. I conclude work participation exists within the context of capitalism, and social relations - either formally free or free; that work participation is directly influenced by rational configurations of the world of work comprising economic, political and social worldviews; and I argue the dominance of a worldview depends on whether the political action premises of buffering and shoring successfully neutralise competing worldviews; and whether the moral dictums or espoused values of work are prescribed or invoked and result in the exploitation or deployment of internal values. My thesis points in the direction of further work on co-operative forms of organisation and work and their commonweal ideologies. In particular, my findings demonstrate a crowding out of co-operative forms and ideologies, not only by capitalist forms but also by trade union collectives. The type of research I suggest has the potential to increase the legitimation of co-operative forms of organisation. Although, the Australian co-operative movement has many achievements there remains the problem of establishing a socially progressive rationality that makes practical or operational sense to people at work. The emancipator ideal of willing and social work participation is intended to epitomise the goals of the enlightenment project, and to lead in that direction.

Die doel van die verhandeling is om pluraliteit binne die Sewendedag-Adventistekerk aan te toon. Die konsep "pluraliteit" word gebruik om verskille en groepvorming aan te toon, terwyl die konsep "pluralisme" verwys na 'n ideologiese standpunt ten opsigte van pluraliteit. Verskille en groepvorming is kenmerkend van die Milleriete of Adventbeweging waaruit die Sewendedag-Adventistekerk ontwikkel het. Die oortuiging dat die Sewendedag-Adventistekerk die "oorblyfselkerk" is, lei daartoe dat Adventiste eksklusief aanspraak maak op die "waarheid". Gevolglik staan die "oorblyfselteologie" voor die uitdaging om verskille en groepvorming sinvol te verdiskonteer. Daar is tans polarisasie rondom verskillende sake. Sewendedag-Adventiste sal dit voordelig vind om dialoog te voer oor die moontlikhede wat 'n prakties-teologiese benadering bied in die hantering van pluraliteit. Die benaderings van Van der Ven en Tracy word bespreek. / The aim of the dissertation is to create awareness regarding plurality within the Seventh-day Adventist Church. The concept "plurality" refers to differences and group forming, while "pluralism" refers to an ideological view regarding plurality. Differences and disputes were very much part of the Millerites or Advent movement out of which the Seventh-day Adventist Church developed. The conviction that the Seventh-day Adventist Church is God's remnant church leads to the exclusive "truth" claim of Adventists. Consequently, the remnant theology is facing the challenge to deal with differences and group forming in a constructive manner. Presently there is polarization within the church on various issues. Seventh-day Adventists will find it beneficial to dialogue about the opportunities that a practical-theological approach offers in dealing with plurality. Theory that accounts for empirical realities will contribute to the development of a theology that will be aware of the needs of people.
