This thesis deals with public procurement law in the Czech Republic. It captures the latest trends in public procurement law, together with the amendment to the Public Procurement Act, which entered into force on 1 April 2012. The opening chapter introduces the concepts that are closely related to the issue of public procurement and corruption. There are explained key institutional control mechanisms in the Czech Republic and criminal liability of corruption. The analytical part of this thesis describes the changes, which the amendment brought into the Public Procurement Law. These changes are mainly assessed in terms of impact on the suppression of corruption. This thesis presents and analyzes the arguments of proponents and opponents of the amendment. The analysis is accompanied by a brief look at the development of legislation on public procurement in the European Union in general and in two selected countries of the European Union. The conclusion contains a summary assessment of the issue along with an outlook for a possible further developments in the legal regulation of public procurement. Based on the analysis, the thesis leads to the conclusion that the amendment of public contracts, despite some shortcomings, is leading to a more transparent procurement environment.

The Swedish public procurement system is well regulated and developed and can also be very hard to understand. The public sector annually carries out public procurements to a large amount of money, and thus constitutes a large part of Sweden’s total GDP. The value of the purchases covered by the procurement acts was estimated at approximately SEK 782 billion in 2018. The purpose of public procurement is to guarantee competition on equal terms, contribute to the efficient use of society's resources and taxpayers' money, while promoting innovative solutions, and have environmental considerations in mind. The purpose of this paper is to examine what the procurement process looks like at one of Sweden's largest authorities, the Swedish Transport Administration (Trafikverket) and if improvements should be made. Questions about how tenders are received and evaluated, about what the market looks like, about what improvements that are desired and about what is good about the procurement process. These questions linked to a trust-based governing will be answered and discussed. The main conclusion that are made in this paper is that the Swedish procurement process require some improvements, but the hard thing is to decide what should be improved. My conclusion is that tender evaluation and the review process are areas that needs the most improvement from the empirical data that I have collected, but other areas came to discussion as well. A discussion regarding the trust-based governing is also included in the conclusion.

The practical part is focused on the specific case of brownfield revitalization through public procurement including its economic assessment. The use of econimic analysis, namely Cost Benefit Analysis (CBA), will be utilized to assess the effectiveness, and socio-economic impacts will also be determined. The purpose of the second part is to determine whether the revitalization thus made more economically advantageous for the city of Brno.

Cette thèse de doctorat s’intéresse à deux thèmes distincts : la prise de décision en situation de risque et l’efficacité économique. Ces deux questions sont traitées dans un cadre empirique en utilisant des bases de données uniques. Le premier chapitre teste les modèles théoriques de décision en situation de risque sur des données réelles de paris hippiques pour identifier la théorie qui permet la meilleure description des choix des individus. Ce chapitre montre que les théories comportementales de la décision en situation de risque (théorie des perspectives cumulées et modèle de l’utilité dépendante du rang) sont mieux adaptées pour expliquer le comportement des parieurs observé dans les données que la théorie de l’utilité espérée. Le second chapitre estime l’effet d’une concentration entre deux grandes entreprises du secteur des transports urbains en France sur leurs coûts. Les résultats obtenus mettent en évidence que la fusion n’a pas entraîné de gains d’efficacité pour les parties à la fusion. Ce résultat s’explique notamment par le contexte dans lequel la fusion a été menée, en particulier les raisons du choix de la cible, la perception des clients et des employés de la fusion, les différences de culture entre les entreprises et la préparation opérationnelle de l’opération. Le troisième chapitre examine l’impact d’une plus grande discrétion dans les procédures d’appels d’offres sur la sélection des opérateurs, en particulier leur productivité. Le résultat principal est que la procédure qui accroît potentiellement le pouvoir discrétionnaire des acheteurs publics conduit à la sélection d’entreprises moins efficaces qu’une procédure n’impliquant pas ou peu de discrétion. Nos analyses complémentaires suggèrent que le résultat s’explique par l’effet d’une plus grande discrétion à l’étape de sélection des entreprises. / This doctoral thesis focuses on two distinct themes: decision-making in situations of risk and economic efficiency. These two questions are treated in an empirical framework using unique databases. The first chapter tests the theoretical models of decision under risk on bets on horseraces to identify the theory that allows the best description of individuals’ choices. This chapter shows that behavioral theories of decision under risk (cumulative prospect theory and rank-dependent utility) are better suited to explain the behavior of bettors observed in the data than the expected utility theory. The second chapter estimates the effect of a merger between two large companies in the urban transport sector in France on their costs. The results show that the merger did not result in efficiency gains for the merging parties. This result can be understood in light of the context in which the merger was conducted, in particular the reasons for the choice of the target, the perception of customers and employees of the merger, the differences in culture between the companies and the operational preparation of the merger. The third chapter examines the impact of greater discretion in tendering procedures on the selection of operators, particularly their productivity. The main result is that the procedure that potentially increases the discretion of public purchasers leads to the selection of less efficient companies than a procedure involving little or no discretion. Further analyzes suggest that the result is due to the effect of greater discretion at the screening stage.

Extensive published literature shows that hydrated lime improves Hot Mix Asphalt (HMA) durability. Its impact on the environmental impact of HMA has not been investigated. This paper presents a comparative Life Cycle Assessment (LCA) for the use of HMA without hydrated lime (classical HMA) and with hydrated lime (modified HMA) for the lifetime of a highway. System boundaries cover the life cycle from cradle-to-grave, meaning extraction of raw materials to end of life of the road. The main assumptions were: 1. Lifetime of the road 50 years; 2. Classical HMA with a life span of 10 years, maintenance operations every 10 years; 3. Modified HMA with an increase in the life span by 25%, maintenance operations every 12.5 years. For the lifetime of the road, modified HMA has the lowest environmental footprint compared to classical HMA with the following benefits: 43% less primary total energy consumption resulting in 23% lower emissions of greenhouse gases. Partial LCAs focusing only on the construction and/or maintenance phase should be used with caution since they could lead to wrong decisions if the durability and the maintenance scenarios differ. Sustainable construction technologies should not only consider environmental impact as quantified by LCA, but also economic and social impacts as well. Avoiding maintenance steps means less road works, fewer traffic jams and hence less CO2 emissions.

Public procurement-related crimes (in Czech republic) (summary of the dissertation) Vladislav Hřebíček In his paper, the author focuses on the area of public procurement-related crimes in the Czech Republic. As there has been no comprehensive coverage on the subject so far, the paper's primary ambition is to sum up the current state of knowledge while critically considering particular resources (mainly legislation and practice of courts), overlapping significantly into the area of daily practice of detecting such crimes and gathering evidence. In the first chapter, the author provides definitions for key terms and examines the term procurement from the perspectives of its legal definition as well as its interpretation based on court practice. Furthermore, the chapter specifies what is to be understood as procurement-related crime, placing this type of crime within the broader context of economic crime. At the same time, it offers answers to the related criminological questions and presents statistical data provided by the Police of the Czech Republic and the Czech Ministry of Interior. The second chapter gives the reader a historical overview of this area of law mainly from the perspective of criminal law.
