The diploma thesis concerns with public procurements of transport constructions in the South Moravian Region. The work is focused on the analysis of the bill of quantities selected public procurement, which consists in observance regulation No. 169/2016 Coll., of the determining the scope of documentation of public procurement and the bill of quantities, supplies and services with a bill of quantities. The conclusion of the thesis deals with the evaluation of the analysis and it focuses on the cause and effect of deficiencies in bill of quantities.

The Hurdles Analysis : A method to identify and analyse hurdles for green procurement in municipalities

Public procurement amounts to approximately 12% of the gross domestic product of industrialized countries. The greatest part of it is controlled by municipalities. Consequently, their procurement decisions have an enormous potential to initiate and support sustainable development. But measures that have been taken so far did not have a substantial impact on production processes and products yet. This was the starting point for heading toward one of the objectives of the European research project RELIEF (Environmental Relief Potential of Urban Action on Avoidance and Detoxification of Waste Streams through Green Public Procurement): to identify existing hurdles for green public procurement and to develop strategies for overcoming those hurdles. For this a decision-oriented view on public procurement was chosen, possible hurdles, revealed in practice, were identified with the help of a therefore developed questionnaire and their relevance for the cities participating in the RELIEF project was examined. Thus the concept of the hurdles analysis was developed. Subsequently the method was improved by expanding the questioning on other European municipalities than those taking part in the RELIEF project as well as using it within the German research project NaBesI where a case study was accomplished. Based on the experiences and outcomes of these first hurdles analyses a self-evaluation tool was developed. It shall enable municipalities to assess their hurdles for green procurement and deduce strategies on their own.

Dipart Entreprenad AB har ett affärsområde som är specialiserat på byggservice och det är verkligen något som de satsar på. Byggserviceverksamhet är något som många företag ute i den svenska byggbranschen håller på med, men i olika stor uträckning och med skillnad i kvalité på utfört arbete. Affärsområde är under ständig utveckling, detta för att både klara beställarnas men även samhällets förväntningar. I och med detta måste företaget förbättra och kartlägga det nuvarande arbetet med olika ramavtalskunder, för att vara mindre känslig för uppsägningar och ge högre kundnöjdhet. Denna rapport kommer hjälpa Dipart att hitta utvecklingsmöjligheter och se saker från en ny synvinkel, men även för att kunna uppfylla beställarnas förväntningar inom byggservice. Vilket i sin tur skall ge företaget chansen att följa med i utvecklingen men även ge en förutsättning för att ligga i framkant i branschen. Syftet med denna rapport är att upprätta en grund för processer speciellt för SigtunaHem, kolla samarbetet mellan entreprenörer och beställare samt lyfta fram svaga aktiviteter inom byggservice. Arbetsmetoden vi använt för att ta fram denna rapport är granskning av dokumentation. Såsom förfrågningsunderlag och diverse handlingar från olika beställare som använder sig av tjänsten byggservice av Dipart.  Det har även skett intervjuer med kunniga personer inom området, både inom Dipart och hos deras beställare men även utomstående aktörer har deltagit med deras kunskap.  Resultatet av detta arbete är en grund till en process för SigtunaHem och en lathund med frågor till beställaren som skall underlätta samlararbetet mellan parterna. Analysen av arbetet där vi diskuterar olika faktorer som påverkar Diparts byggservice, är ett resultat i sig själv av det som undersökts. Slutsatsen är att detta examensarbete ska vara en hjälp för företaget Dipart att uppnå högre kundnöjdhet samt så ska företaget vara mindre känslig för uppsägningar. / Dipart Entreprenad AB is a company that specializes in building services and it´s really something they are working hard with. Building Service is something that many companies, out there in the Swedish construction industry is doing, but in different large extent a difference in the quality of work performed. The construction business is under constant development, in order both to meet clients' but also the expectations of society. In doing so, the company needs to improve and identify the existing work with current clients , in order to be less vulnerable to layoffs and provide higher customer satisfaction. This report will help Dipart to find development opportunities and see things from a new point of view, but also to meet the client’s expectations in the building service. Which in turn will give the company the chance to keep up with developments but also give a condition for being at front of the industry. The purpose of this report is to establish a basis for processes specifically for Sigtunahem, check cooperation between contractors and clients as well as highlighting weak activities within building services. The work method we have used to develop this report is the examination of documentation. As specifications and various documents from different clients who use the building services of Dipart. There have also been interviews with knowledgeable individuals in the field, both within Dipart and with their clients but also external actors have participated with their knowledge. The result of this work is due to a process of SigtunaHem and a checklist of questions to the client to facilitate collects the work between the parties. The analysis of the work in which we discuss various factors that affect Diparts building services, is a result in itself of what is investigated. The conclusion is that this thesis will be a help to the company Dipart to achieve higher customer satisfaction and Dipart themselves will be less vulnerable to layoffs.

Enhancing Environmental Performance by Green Procurement : A study of environmental procurement preferences in the construction industry

In recent years, the general awareness of the environmental impacts that industrial production gives rise to has radically increased throughout the world. Finding ways to minimise these impacts has become a major concern of the authorities in many countries. In order to promote a more sustainable industrial production, different incentives can be used. Among these incentives, the consideration of environmental issues in public procurement is increasingly being emphasised. While much attention regarding sustainable procurement has centred on the purchase of products, this thesis focuses on green procurement of construction contracts. The construction industry is a major contributor to environmental pollution. It consumes about half of all resources humans take from nature and accounts for about 25 – 40 per cent of all energy used and about 30 – 50 per cent of all waste generated in OECD countries. In the procurement of products, the environmental impacts of the available products can be estimated and compared, for example by using tools such as life cycle assessments. When construction contracts are procured, assessing the suppliers’ environmental capabilities can be more challenging, as the contract to be procured has not yet been performed. However, at the same time, there are considerably more opportunities to steer the construction towards more environmentally friendly alternatives. In the thesis, it is suggested that the environmental requirements and the environmental criteria for tender evaluation should be used in combination, in order to safeguard environmental performance in the construction project and at the same time stimulate a green development within the industrial sector. Procurer-Supplier Interaction for Circularity : A multiple-case study of product-service systems in Swedish public procurement

Problem: Public procurement constitutes a large part of the global economy, accounting for 15% of GDP. But it is also responsible for 15% of global greenhouse gas emissions and consumes vast amounts of raw materials as it is strongly focused on linear products. A more circular alternative is the procurement of Product-Service Systems (PSS), which combine products and services. However, research shows that Circular Public Procurements, such as procurements of PSS, are more complex and require deeper procurer-supplier interaction. Yet, the procurer-supplier interaction in the context of public procurement of PSS has not been empirically explored.  Purpose: The purpose of this study is to explore how the interaction between the procurer and supplier throughout the public procurement process can facilitate public procurement of PSS. Method: A qualitative multiple-case study was conducted, exploring four cases of public procurements of PSS between Swedish municipalities and Swedish private companies. Seven semi-structured interviews with interviewees from both sides were conducted. The data was triangulated with case-specific procurement documents.  Results: Procurer-supplier interaction was found to be crucial for procurers and suppliers throughout the public procurement process to make PSS happen and to improve its quality. In both, the preparation and utilisation phase of public procurement, the interaction can bring benefits for procurers as well as for suppliers, thus facilitating PSS.

[pt] O presente estudo tem como objetivo avaliar os impactos dos fatores comportamentais e organizacionais sobre as decisões relacionadas à inserção de critérios de sustentabilidade nas compras públicas do setor público brasileiro. Com base nas lentes teóricas da estratégia comportamental e das compras públicas sustentáveis, foram relacionados dados do levantamento (Survey) e das pesquisas bibliográfica e documental. Assim, foram identificadas as variáveis extraídas da literatura e selecionadas, por meio da Análise Fatorial Exploratória. Em seguida, foram utilizadas Análise de Cluster e as técnicas MANOVA e ANOVA, o que permitiu constatar que os órgãos do Poder Executivo tendem a considerar o Controle como fator organizacional menos importante e a Capacitação como o mais importante em relação aos outros fatores da categoria – comportamento observado na maioria dos órgãos estaduais e municipais. Por outro lado, percebeu-se que há uma tendência nas instituições federais de considerarem o Controle como o fator organizacional que mais impacta as decisões sobre inclusão de critérios de sustentabilidade nas contratações públicas, enquanto, para este grupo, as variáveis Custo, Capacitação e Normas são as que menos impactam. No que diz respeito aos fatores comportamentais, nota-se uma maior tendência das instituições do Executivo e de grande parte das instituições estaduais e municipais em considerarem as variáveis Viés Disponibilidade, Comportamento Tendencioso e Viés Status Quo como mais impactantes nas decisões de sustentabilidade nas contratações públicas em comparação com as instituições do Judiciário, dos Ministérios Públicos e das Cortes de Contas. Por fim, pôde-se observar ainda que as instituições do Executivo e de grande parte das instituições estaduais e municipais tendem a enfatizar mais os fatores organizacionais e comportamentais que as instituições de outros poderes e de outros entes federativos. / [en] The present study aims to evaluate the impacts of behavioral and organizational factors on decisions related to the inclusion of sustainability criteria in public procurement in the Brazilian public sector. Based on the theoretical lens of behavioral strategy and sustainable public procurement, data from the survey (Survey) and bibliographic and documentary research were related. Thus, the variables extracted from the literature and selected through Exploratory Factor Analysis were identified. Then, Cluster Analysis and the MANOVA and ANOVA techniques were used, which made it possible to verify that the Executive Power bodies tend to consider Control as the least important organizational factor and Training as the most important in relation to the other factors of the category - behavior observed in most state and municipal agencies. On the other hand, it was noticed that there is a tendency in federal institutions to consider Control as the organizational factor that most impacts decisions on the inclusion of sustainability criteria in public procurement, while, for this group, the variables Cost, Training and Standards are the ones with the least impact. With regard to behavioral factors, there is a greater tendency of Executive institutions and a large part of state and municipal institutions to consider the variables Availability Bias, Biased Behavior and Status Quo Bias as the most impacting on sustainability decisions in public procurement compared to the institutions of the Judiciary, Public Prosecutors Offices and Courts of Accounts. Finally, it was also possible to observe that the institutions of the Executive and most of the state and municipal institutions tend to emphasize organizational and behavioral factors more than the institutions of other powers and other federative entities.

Social sustainability is one of the three dimensions that make up sustainable development. The social dimension has for long been seen as the weakest and has often been ignored in favour of the economic and ecological dimension. The importance of the social dimension is getting more recognition both by the private and the public sector and as a result of external pressures, companies have started to work with their social responsibility to strengthen their competitiveness on the market. From this way of working, the concept of creating shared value has been introduced by professor Michael E. Porter and lecturer Mark R. Kramer who suggests that companies can create economic value by creating societal value and thereby create shared value. They argue that companies can, by addressing a social issue and using their power, create shared values in our society. Employment requirements in public procurement is one way of addressing the social sustainability in the society and together with the prevailing construction boom and the shortage of manpower, companies must look for new places to recruit. Hence, the purpose of this descriptive research is to contribute with knowledge on how employment requirements are used in Sweden and study the development of the concept creating shared value. Additionally, it is investigated if employment requirements in public procurements can be used to create shared value. Two examples of varied character serve the basis of the empirics. The theory of creating shared value originates, as mentioned earlier, from creating social value and thereby creating economic value which, in turn, creates shared value. The study shows that, even though Porter and Kramer’s theory of creating shared value might not be fully applicable in public procurement, employment requirements can be a way of creating shared value in the society. Through collaboration between the private and the public sector, social issues such as unemployment, can be addressed and mitigated. / Social hållbarhet är en av tre dimensioner som utgör hållbar utveckling. Den sociala dimensionen har länge setts som den svagaste och har ofta ignorerats till förmån för den ekonomiska och ekologiska dimensionen. Betydelsen av den sociala dimensionen börjar uppmärksammas alltmer, både av den privata och offentliga sektorn och som ett resultat av yttre påtryckningar har företag börjat arbeta med sitt sociala ansvar för att därigenom stärka sin konkurrenskraft på marknaden. Från detta arbetssätt har konceptet creating shared value introducerats av professor Michael E. Porter och föreläsaren Mark R. Kramer som menar att företagen kan skapa ekonomiskt värde genom att skapa ett socialt värde vilket tillsammans i sin tur resulterar i ett delat värde. De menar att företag, genom att adressera ett socialt problem och använda sin makt, kan bidra till att skapa ett delat värde i samhället. Sysselsättningskrav i offentliga upphandlingar är ett sätt på vilket den sociala hållbarheten i samhället kan adresseras och tillsammans med den rådande högkonjunkturen i byggbranschen och byggföretagens personalbrist måste de se till alternativa platser för rekrytering. Därför har syftet med denna beskrivande uppsats varit att utöka kunskapen om hur sysselsättningskrav används och studera utvecklingen av konceptet creating shared value. Dessutom har det undersökts om sysselsättningskrav i offentliga upphandlingar kan skapa delat värde. Två exempel av varierande karaktär ligger således till grund för den empiriska inhämtningen. Teorin om att skapa delat värde utgår, som tidigare nämnt, från att skapa socialt värde och därigenom ekonomiskt värde vilket i sin tur skapar delat värde. Studien visar att även om Porter och Kramers teori om värdeskapande inte är helt applicerbart i offentlig upphandling, kan sysselsättningskrav vara ett sätt att skapa detta. Genom samarbete mellan den privata och offentliga sektorn kan sociala problem såsom arbetslöshet, adresseras och minskas.

Skada vid överprövning : Skaderekvisitet i mål om överprövning av offentliga upphandlingar / Harm in Review Procedures

This thesis examines the requirement that a supplier must have been harmed or risked being harmed in the review procedures of public procurements. The requirement for harm is analysed using the Swedish legal dogmatic method in connection with EU law. The requirement for harm is part of the implementation of the Remedies Directive, which balances the interest of protecting suppliers from unlawful decisions against the interest of effective and rapid procurement and review procedures. A review is a non-financial remedy in which the purpose is to act against unlawful decisions, preferably at a stage when no actual harm has occurred. In the case of a review, harm means that the supplier's ability of being awarded the contract is impaired. The concept of harm is thus more abstract than the required harm within tort law to receive damages (skadestånd). There are two kinds of requirements for harm in the Swedish Public Procurement Act for the review procedure. The first is that a supplier according to Chapter 20. Section 4 must consider itself to have been harmed or risked being harmed to apply for a review. Thus, it is the supplier's own perception of harm that is relevant, and the requirement is of a subjective nature. However, according to a precedent from the Swedish Supreme Administrative Court in conformity with the Remedies Directive, the supplier is also required to have an interest in obtaining the particular contract that is up for review. The second requirement is in the court's review according to Chapter 20. Sections 6 or 13-13(b), depending on the type of case. It means that a supplier must show that it has been harmed or risked being harmed due to an infringement of the Swedish Public Procurement Act. The harm must have a causal link with the alleged infringement and the particular contract up for review. Thus, the supplier needs to describe in a clear and explicit manner how the infringement has resulted in harm or risk of harm and the requirement is of a more objective nature. According to another precedent from the Swedish Supreme Administrative Court, the second requirement is not fulfilled unless the supplier has done enough to limit the harm which it is subject to. For example, by asking questions regarding an infringement in the contract documents before submitting a tender. The European Court of Justice has ruled that the objectives of the Remedies Directive are not fully implemented if a supplier is allowed to apply for a review at any stage, as has long been the case in Swedish law. However, there is no limitation period or general obligation for suppliers to limit harm in the event of a review according to EU law or previous Swedish law. Som bådejuridiskt och ekonomiskt styrmedel kan upphandlingen både höja den lägsta ribban och varaföregångare i en samhällsomställning.Att bidra med kunskapsspridande och skapa förståelse för miljömässigt hållbarupphandling är syftet med den här studien. Ett svenskt och operativt fokus med målet attkartlägga målbilden och behoven för den i Dalarna belägna organisationenUpphandlingscenter Falun Borlänge regionen. Vilka behov som finns, hur målbilden ser utsamt hur handlingsplaner kan formuleras för att nå och genomföra en miljömässigt hållbarupphandling var frågeställningar som styrde arbetet.Genom att använda workshoppar med teman kring behoven, målbilden ochhandlingsplaner av miljömässigt hållbar upphandling som datakälla samlades och skapadesbevis och analys för en kategoriserad kartläggning. Sammantaget åtta generiska kategorierhar använts genom hela processen. Samarbete- och samordningsaspekter dominerar ibehoven och målbilden för en miljömässigt hållbar upphandling. En målkonflikt mellanmiljömässiga och ekonomiska perspektiv identifierades som ett första hinder, däremot finnsindikationer på att den målkonflikten är uppfattad istället för reell. Studien indikerar attsamordning av offentliga och decentraliserade verksamheter kan vara det mestproblematiska behovet att tillgodose.Upphandlingscentret Falun Borlänge regionen vandrar inte ensam på vägen till enmiljömässigt hållbar upphandling. Tidigare studier visar på att likartade hinder ochmöjligheter existerar över långa avstånd i rum och tid. As a financial andlegal instrument, public procurement can both raise the bar and be a forerunner for a societaltransformation.The aim of this study is to contribute to spreading and creating awareness andunderstanding of green public procurement. Centered around a Swedish and operationalperspective, the goal is to map the vision and needs for a regional organization calledUpphandlingscenter Falun Borlänge regionen. What needs exist, how the vision can bedefined and how action plans can be formulated to implement green public procurementwere questions guiding the paper.Evidence and analysis for a categorized mapping was gathered and created by usingworkshops with themes of needs, vision, and action plans as a data source. Eight genericcategories in total have been used throughout the process. Dominant aspects of needs andvision for green public procurement are cooperation and coordination. A conflict betweenenvironmental and financial goals was identified as a first obstacle, although there wereindications this conflict was perceived, rather than real. The analysis of the study indicatesthat coordination of public and decentralized organizations could be the most problematicneed to fulfill.Upphandlingscentret Falun Borlänge regionen does not walk alone on the road towardsgreen public procurement. Previous studies show that similar obstacles and opportunitiesexist over great distances in time and space.
