The facultative arbitration in labor matters procedures allows either party of   the employment relationship to compel the other to submit their disputes to an arbitral tribunal. One of the application assumptions of the facultative arbitration in labor mattersprocedures when bad faith of a party during the negotiation of the statement is noticed,which should be tested.What happens with the decision of the Arbitral Tribunal which admits the claim and establishes that it has jurisdiction to hear the case? In this article, the author analyzes the procedural effects of this decision, in the light of the doctrine and jurisprudence. / El arbitraje potestativo en materia laboral permite que cualquiera de las partes de la relación de trabajo pueda forzar a la otra parte a someter sus diferencias a un Tribunal Arbitral. Uno de los supuestos de procedencia del arbitraje potestativo  en materia  laboral es que se advierta la mala fe de una de las partes durante la negociación del pliego, lo cual deberá ser probado.Ahora bien, ¿qué ocurre con aquella decisión del Tribunal Arbitral que admite a trámite la demanda y se declara competente para conocer el caso? En el presente artículo, el autor analiza los efectos procesales de esta decisión, a la luz de la doctrina y la jurisprudencia.

A adi??o do composto proporcionou o aumento nos valores de pH, MO, SB, CTC, V e nutrientes (P, K, Ca2+ e Mg2+) e promoveu a redu??o de Al3+, H + Al e m. O substrato minerado apresentou valores elevados de Rp indicando a compacta??o na ?rea degradada pela extra??o de cascalho, mesmo ap?s a aplica??o do composto. A adi??o de doses crescentes do composto promoveu o aumento significativo de CBM e C-CO2 ao substrato minerado. O maior valor de qCO2 indicou efici?ncia da biomassa microbiana com a incorpora??o das menores doses do composto ao substrato quando comparado ao controle. Ap?s 12 meses, verificou-se que n?o houve diferen?a significativa entre os tratamentos para sobreviv?ncia e incremento em altura, di?metro e cobertura de copa para cada esp?cie. Ainda, de forma preliminar foi poss?vel determinar que a adi??o de 4,5 g dm-3 de composto na cova proporcionou maiores valores de incremento em altura, di?metro e cobertura de copa para Plathymenia reticulata e Bowdichia virgilioides. No quarto cap?tulo, foi realizado o plantio em linha de Chamaecrista debilis submetida a quatro tratamentos, 0,0; 30,0; 60,0 e 120,0 g dm-3 de composto como adubo por cova, dispostos em tr?s blocos casualizados. Os resultados indicaram que n?o houve diferen?a significativa entre as doses de composto aplicado para incremento em altura, di?metro e cobertura de copa. Programa de P?s-Gradua??o em Ci?ncia Florestal, Universidade Federal dos Vales do Jequitinhonha e Mucuri, 2012. / ABSTRACT The objective of the work was to evaluate the effect of the use of composed of organic residue spinning industry and weaving on the quality of the substratum and growth of arboreal species of the thicket in a gravol-pit in the municipality of Diamantina, MG. The dissertation was structured in four chapters. Being the first, regarding the bibliographical revision seeking the understanding of the concepts and theoretical questions of what was borded in the study. In the second I chapter, the influence of the compound in the substratum was evaluated through the alterations in the chemical attributes (pH, organic matter (MO), sum of bases (SB), CTC, saturation for bases (V), match (P), potassium (K), calcium (Ca2+), magnesium (Mg2+), exchangeable acidity (Al3+), potential acidity (H + Al) and saturation for aluminum (m)) and physical (mechanical resistance the penetration (Rp) and texture) of the substratum. As well as in the microbial activity of the same: carbon of the microbial biomass (CBM) microbial breathing (C-CO2) and metabolic quotient (qCO2) after application of five treatments: without application of organic composition and different concentrations 0; 4,5; 9,0; 18,0 and 36,0 g dm-3 for hole. The delineation was systematic type "fan" being the treatments disposed in three blocks unexpected. The addition of the compound stimulated the increase in the pH values, MO, SB, CTC, V and nutritious (P, K, Ca2+ and Mg2+) and it promoted the reduction of Al3+, H + Al and m. The mined substratum presented high values of Rp indicating the compactation in the area degraded by the gravel extraction, even after the application of the composed. The addition of growing doses of the compound promoted the significant increase of CBM and C-CO2 to the mined substratum. The largest qCO2 value indicated efficiency of the microbial biomass with the incorporation of the smallest dosages of the compound to the substratum when compared to the control. The third chapter, refers to the study of the growth of the native species Kielmeyera lathrophyton Saddi (sacred Wood), Plathymenia reticulata Benth (Vinh?tico), Dalbergia miscolobium Benth (Jacaranda of the Thicket) and Bowdichia virgilioides Kunth (Sucupira-black) planted in delineation systematic type " fan " submitted to five treatments: without application of organic composition and different doses of compound 0,0; 4,5; 9,0; 18,0 and 36,0 g dm-3 for hole disposed in three blocks unexpected. After 12 months, it was verified that there was not significant difference among the treatments for survival and increment in height, diameter and top covering for each species. Still, in a preliminary way it was possible to determine that the addition of 45 g dm-3 of compound of organic residue of textile industry in the hole stimulated larger increment values in height, diameter and top covering for Plathymenia reticulata and Bowdichia virgilioides. In the fourth chapter, the planting was made in line of Chamaecrista debilis submitted to four treatments, 0,0; 30,0; 60,0 and 120,0 g dm-3 compound dm-3 as fertilizer for hole, disposed in three blocks inexpected. The results indicated that there was not significant difference among compound applied for increment in height and diameter. The largest increment value in height and diameter happened without the addition and with the application of 60,0 g dm-3 of compound of organic residue of textile industry, however it is necessary the accomplishment of future evaluations. The survival rate presented significant decrease with the application of the largest doses of organic compund. The species Chamaecrista debilis presented important characteristics for recovery of degraded area, as fast growth and biomass production.

Por?m, pouco se conhece sobre a composi??o qu?mica e efeitos biol?gicos dos res?duos de seus frutos. Diante disso, o presente trabalho teve como objetivo avaliar a composi??o qu?mica, o potencial antioxidante (in vitro) e hipolipid?mico (in vivo) da farinha das cascas do fruto de Myrciaria cauliflora. Para tanto, frutos (jabuticabas) maduros foram despolpados manualmente e suas cascas secas e trituradas at? a obten??o de uma farinha homog?nea (FCJ). Avaliou-se sua composi??o centesimal, conte?do mineral, fen?licos totais, flavon?ides e antocianinas, assim como sua atividade antioxidante in vitro atrav?s de diferentes m?todos (DPPH, ABTS?+, FRAP e ?-caroteno/?cido linol?ico). A FCJ foi submetida ? extra??o hidroalco?lica e os extratos fracionados em Cromatografia em Coluna (CC). Os fitoconstituintes isolados foram caracterizados por IV e RMN. O potencial hipolipid?mico foi avaliado em grupos de ratos machos alimentados com dietas semipurificadas, sendo a dieta Padr?o (PDR) baseada na AIN93M, a dieta Controle (CTRL) semelhante ? PDR e suplementada com 7% de banha de porco, e tr?s dietas experimentais semelhantes ? CTRL, por?m suplementadas com 7, 10 e 15% de FCJ (JAB1, JAB2 e JAB3, respectivamente). N?veis s?ricos e hep?ticos de colesterol, bem como n?veis s?ricos de HDL, triglicer?deos e glicose foram avaliados. A excre??o fecal de lip?deos foi avaliada tamb?m. A FCJ foi classificada como fornecedora de alto teor de fibras (15,26%). Os teores de fen?licos totais (1895 mg ?cido g?lico/100 g), flavon?ides (8,960 g de catequina /100g) e antocianinas (0,6823 g de cianidina-3-glicos?deo/100g) foram altos assim como a atividade antioxidante verificada pela captura de radicais-livres DPPH (3,184 g de FCJ/g DPPH) e ABTS?+ (1017 ?mol Trolox/g de FCJ), redu??o dos ?ons Fe+3 (167,7 mM de Fe2SO4/100g) e capacidade de inibi??o do branqueamento do ?-caroteno (75,96% de inibi??o para a concentra??o de 1000 mg/L). O ?cido c?trico, o sitosterol e o sitosterol-D-glicopiranos?deo foram isolados, sendo, os dois ?ltimos, citados pela primeira vez nesta esp?cie. A inclus?o da FCJ, nas tr?s propor??es, reduziu o colesterol total (CT) e os triglicer?deos (TG) s?ricos em rela??o ? dieta CTRL. A dieta JAB3 elevou os n?veis de HDL s?ricos e reduziu os de colesterol hep?tico em rela??o ? CTRL. A dieta JAB3 reduziu a glicose s?rica em compara??o ? JAB2, mas essa diferen?a n?o foi significativa em rela??o ? PDR, ? CTRL ou ? JAB1. N?o houve diferen?a na excre??o fecal de lip?deos entre os grupos experimentais. Programa de P?s-Gradua??o em Qu?mica, Universidade Federal dos Vales do Jequitinhonha e Mucuri, 2011. / ABSTRACT Myrciaria cauliflora (jabuticabeira) is a fruit specie, native in Brazil and created mainly in domestic gardens in Minas Gerais. However, little is known about its chemical composition and biological effects in the fruit residue. In front of this, the present work had as a goal to evaluate the chemical composition, antioxidant potential (in vitro) and hypolipidemic (in vivo) of Myrciaria cauliflora fruit peel flour (FCJ). For that, mature fruits (jabuticaba) were pulped manually and its peel was dried and crushed to obtain a homogeneous flour (FCJ). There had been evaluated the proximate composition, mineral content as well as total phenolic, flavonoids and anthocyanins as their antioxidant activity in vitro through different methods (DPPH, ABTS?+, FRAP and ?-caroten/acid linoleic). The FCJ was also subjected to extraction with water-alcohol extracts fractionated in column chromatography (CC). The phytochemicals isolated were characterized IR and NMR. The lipid-lowering activity was evaluated in groups of male rats, fed with semipurified diets, being a PDR diet based on AIN93M; a CTRL diet based on PDR, but added 7% of pork lard; and three experimental diets similar to CTRL, but added MPF at 7, 10 and 15% (JAB1, JAB2 and JAB3, respectively). Serum and liver cholesterol as well as serum levels of HDL, triglycerides and glucose were evaluated. Fecal output of lipids was also evaluated. The FCJ was classified as a supplier of high-fiber (15,26%). The levels of total phenolic (1895 mg gallic acid/100 g), flavonoids (8,960 g de catechin /100g) and anthocyanins (0,6823 g de cyanidin-3-glucoside/100g) were high as the antioxidant activity verified to capture of free radicals DPPH (3,184 g de FCJ/g DPPH) and ABTS?+ (1017 ?mol Trolox/g de FCJ), to reduction of ions Fe+3 (167,7 mM de Fe2SO4/100g) and capacity in inhibition of whitening of ?-caroten (75,96% of inhibition of concentration of 1000 mg/L). The citric acid, sitosterol and sitosterol-?D-glucopyranoside were isolated, being the last two, mentioned in this specie for the first time. The inclusion of the MPF, at the three ratios reduced serum cholesterol and triglycerides compared to CTRL. JAB3 diet raised serum HDL cholesterol and reduced liver cholesterol compared to CTRL. JAB3 diet reduced serum glucose compared to JAB2, but this difference was not significant compared to PDR, CTRL or JAB1. There was no difference in fecal output of lipids between the groups. The results obtained may serve as an aid to better utilization of residue and to understand the MFP metabolic effects in addition to ensure the safety of its intake as a food.

As doses de composto org?nico de res?duos da ind?stria t?xtil foram 0; 7,5; 15; 30 e 60 m3 ha-1 e essas foram comparadas as mesmas doses de vermicomposto e a dose de 40 m3 ha-1 de esterco bovino (tratamento adicional). Os tratamentos foram dispostos em delineamento em blocos ao acaso, com quatro repeti??es em esquema de parcela subdividida, sendo as parcelas as fontes de fertilizantes e as subparcelas as doses. A dose econ?mica m?xima de composto para a massa fresca da parte a?rea foi de 27,9 m3 ha-1. Em rela??o ao vermicomposto, o composto promoveu maiores teores de P, Cu e Mn e resultado semelhante quanto ? respira??o basal, n?mero de folhas, perda acumulada de massa fresca, senesc?ncia e teores de N, K, Ca, S, B, Zn e Fe. Em rela??o ao esterco, estimou-se que dose equivalente do composto promove maiores teores de carbono org?nico e de macronutrientes, e foi semelhante quanto ? respira??o basal, perda acumulada de massa fresca, senesc?ncia e teores B, Zn, Fe e Mn. Em rela??o a outros res?duos citados na literatura o composto promoveu maior ou igual di?metro m?ximo da cabe?a, n?mero de folhas, massa fresca da parte a?rea, perda acumulada de massa fresca, teores de N, P, K, S, B, Zn e Cu. Os teores de Cu e Mn nas plantas de alface fertilizadas com o composto foram abaixo dos valores considerados t?xicos para consumo humano. This study aimed to evaluate the use of compost waste from the textile industry in lettuce in the field. The doses of organic waste from the textile industry were 0; 7,5; 15, 30 and 60 m3 ha-1 and these were compared with the same doses of vermicompost and the dose of 40 m3 ha-1 of cattle manure (additional treatment). The treatments were arranged in randomized blocks, with four replications in a split-plot, and the sources of fertilizer plots and subplots doses. The economic dose of compound for maximum fresh weight of shoots was 27,9 m3 ha-1. In relation to humus, compost showed higher levels of P, Cu and Mn and a similar result as the basal respiration, leaf number, cumulative loss of weight, senescence and N, K, Ca, S, B, Zn and regarding Fe manure, it was estimated that the equivalent dose of the compound promotes higher levels of organic carbon and nutrients, and was similar for basal respiration, accumulated loss of weight, senescence and B levels, Zn, Fe and Mn. For other wastes reported in the literature the compound promoted or greater diameter of the head, leaf number, shoot fresh weight, cumulative loss of weight, N, P, K, S, B, Zn and Cu . The Cu and Mn in lettuce fertilized with compost were below those toxic for human consumption. Composting is effective for treatment of toxic waste from the textile industry and the compound can be used in place of manure on lettuce.

With this, the drops of this equipment also grow at the same rate. A year in the world, it is estimated that more than 25 million tons of electronic waste are disposed.This work developed a new environmentally safe hydrometallurgical method for the selective extraction of copper, nickel and silver from waste printed circuit board (PCB) using Aqueous Two-Phase Systems (SAB) as extraction technique. The extraction behavior of metal ions Cu (II), Ni (II), Fe (III) and Ag (I) SAB formed by tri-block copolymer L64 + MgSO4 + H2O was evaluated for the optimization of the method by checking the influence of the following experimental parameters on the extraction of analytes: the SAB pH (3.0, 6.0, 9.0 and 11.0); nature and concentration of agents extractors 1- (2-pyridyl-azo) -2-naphthol (PAN) Cu for the extraction method (II), the 1-nitroso-2-naphthol (1N2N) and dimethylglyoxime (DMG) for ion extraction Ni (II), thiocyanate (SCN) and dithizone (Dz) for the extraction of Ag (I).The selective metal recovery efficiency was evaluated by the percentage extraction analysis (% E) and separation factor (S) between the ions of interest. The best conditions for selective extractions were NAP [3,5 mmol.Kg-1] at pH 6.0 in 6 consecutive stages for separation of Cu (II) DMG [5.00 mmol.Kg-1] pH = 9.0 for Ni (II) and SCN [5,20 mmol.Kg-1] at pH = 9.0 for Ag (I). In all cases they were obtained separation factor values (S) between the analyte and the larger metal Concomitant 103. The obtained optimum conditions were applied to the PCI leached copper extraction, nickel and silver sequentially, yielding if high S values between the analyte and the metal concomitant (SCU, Ni = 1.46 x 103, SCU, Fe = 1.55 x 104, SCU, Ag = 1.59 x 104, SNI, Fe = 3.27 x 104, SNI, Ag = 3.47 x 104 and SAg, Fe = 4.80 x 103).After extraction of each metal it was made a study stripping in one step, where 89.5%, 92.5% and 82.5% Cu (II), Ni (II) and Ag (I), respectively, were available for the electroplating step. Therefore, the method using BSA was efficient and within the principles of green chemistry, because it uses non-toxic, biodegradable and recyclable and fast phase separation without the formation of stable emulsions components. Understanding the Role of Rab22A in Recycling Endosome Biogenesis and Melanocyte Pigmentation

Recycling embosoms (REs) are transient intermediates of endosomal network, constantly generated from early/sorting endosomes (EEs/SEs). Conventionally, these organelles function in recycling of many growth/nutrient/signalling receptors from SEs to the cell surface and maintain the cellular homeostasis in all cell types. Recent studies have shown that REs slightly diverted their function in specialized cells such as melanocytes for the delivery of melanogenic cargo to a set of lysosome-related organelles (LROs) called melanosomes. However, it is unknown how melanocytes modulate the trafficking routes of REs towards the biogenesis of melanosomes. Any alterations in this process result in occulocutaneous albinism, commonly observed in autosomal recessive disorder, Hermansky-Pudlak Syndrome (HPS). HPS is caused by mutations in nine genes in human and fifteen genes in mouse and the protein products of these genes were grouped in multiple endosomal protein complexes; BLOC (Biogenesis of Lysosome-related Organelles Complex)-1, -2, -3, AP (Adaptor Protein)-3 and HOPS (homotypic fusion and protein sorting). Studies from our laboratory and others have shown that REs deliver the melanin-synthesizing enzymes to melanosome in BLOC-1 and BLOC-2 dependent manner. On the other side, studies in fibroblasts have shown that the adaptor AP-1 and microtubule-dependent motor, KIF13A also regulates the formation of REs. In these studies, it was proposed that AP-1 binds to the cargo tails and interacts with motor KIF13A to generate the RE tubules, where BLOC-1 initiates the biogenesis. Nevertheless, the mechanism behind the biogenesis of REs and how these molecules synergistically control these processes is largely unknown. Additionally, the role of BLOC-2 in REs biogenesis never been implicated. Here we have attempted to study the mechanism of RE biogenesis and their role in pigment granule formation using HeLa and mouse melanocytes as model systems. In general, Rab GTPases (Rabs) regulate the several process of membrane trafficking including cargo sorting, membrane domain organization, tethering and fusion. We hypothesized that the biogenesis of RE is also regulated by one of the endosome localized Rab GTPases. Our RNAi screening against Rabs involved in regulating the RE length/number showed Rab22A as a potential candidate. Thus, we aim to study the role of Rab22A in RE biogenesis and its regulation in melanocyte pigmentation. The current study entitled as “Understanding the role of Rab22A in recycling endosome biogenesis and melanocyte pigmentation” is divided into five chapters. Chapter-I outlines the review of literature on cell biology of intracellular organelles such as endocytic network and melanosomes. Chapter-II details the experimental procedures used in the study. Chapter-III to Chapter-V describes the results and discussion. Chapter-III: Identification of endosomal Rab GTPases required for the dynamics of recycling endosomes Endosomal Rabs are known to regulate various functions such as vesicle biogenesis, transport, tethering and fusion, but their role in generation of tubulo-vesicular carriers of endocytic system, REs is unknown. It has been shown that REs possibly derived from EEs/SEs and characterized by the association/localization of multiple proteins such as transferrin receptor (TfR), SNARE STX13, Rab11 and motor KIF13A. In this study, we have used YFP-KIF13A as a marker to label the REs. YFP-KIF13A in HeLa cells localized to long tubular structures throughout the cell and also to the clusters of peripheral endosomes. To identify the endosomal Rabs that regulate the RE dynamics (both length and number), we have transfected the HeLa cells with shRNA against endosomal Rabs such as Rab4A, Rab5A, Rab5B, Rab5C, Rab7A, Rab9A, Rab11A, Rab14A and Rab22A. Post transfection and shRNA selection, cells were transfected with YFP-KIF13A, analyzed and quantified the RE dynamics using ImageJ. Here, we have measured two parameters for the identification of Rab/s that potentially regulates the REs biogenesis: first, average number of tubules per cell and second, average length of tubules per cell. These studies identified Rab22A as a potential candidate, depletion of this Rab affects both number and average length of KIF13A-positive tubules. As described above, REs deliver several melanocyte specific cargoes to melanosomes in melanocytes. However, the function of Rab22A in controlling these transport steps to melanosome/its biogenesis or pigmentation has not been addressed. Thus, we have studied the mechanism of Rab22A in RE biogenesis and its role in pigmentation in the following sections. Chapter-IV: Characterization of Rab22A function in regulating the recycling endosomes Initially, we tested whether Rab22A localizes to the REs. Our co-expression studies show that Rab22A localizes to KIF13A- or STX13-positive RE compartments in HeLa or melanocytes, respectively. In general, Rab GTPases mediate their function through cycling between GTP (membrane bound) and GDP (cytosol) bound state. These states can be achieved by point mutation of active site residues in the protein. We have generated Rab22A constitutive active mutant (Rab22AQ64L, defective in GTP hydrolysis) and dominant negative mutant (Rab22AS19N, defective in GTP binding) to understand the role of Rab22A in regulating REs. Interestingly, overexpression of Rab22AQ64L mutant in HeLa cells increases the average number of KIF13A-positive REs relative to the wild-type Rab22A (Rab22AWT). As predicted, overexpression of Rab22AS19N mutant reduces the number as well as length of RE tubules relative to the control HeLa cells. Consistent to these studies, Rab22A-knockdown did not affect the endogenous KIF13A protein levels or its recruitment to endosomes, however recycling of TfR (measured through Tf-Alexa 594) was significantly affected in these cells. These studies suggest that Rab22A possibly regulates the formation or function of REs. Likewise, overexpression of Rab22AQ64L and Rab22AS19N mutants in melanocytes resulted in reduction of total melanin content in the cells. To confirm these results, we have performed immunofluorescence microscopy (IFM) analysis, which showed Rab22AQ64L localized to the enlarged vacuolar structures, positive for melanosomal cargo TYRP1 (tyrosinase-related protein 1), whereas Rab22AS19N localized to the cytosol. Further, Rab22A depletion in melanocytes causes the hypopigmentation in the cells concurrently reduces the stability of TYRP1 but not other melanocyte specific proteins, indicating a role for Rab22A in regulating TYRP1 transport to melanosomes. Altogether, our studies suggests that Rab22A regulates the TfR recycling in HeLa cells and TYRP1 transport in melanocytes by controlling the RE dynamics. Chapter-V: Molecular mechanism of recycling endosome biogenesis: a role for Rab22A Rabs perform their function by recruiting specific effector/s to the membrane upon Rab activation. It is unknown, how Rab22A regulates REs through its effectors. We hypothesize that Rab22A may regulate the recruitment and function of BLOC-1 and BLOC-2 complexes during RE formation. To validate these hypothesis, we carried out the knockdown of individual BLOC-1 and -2 subunits (destabilize the entire complex) separately in HeLa and studied the dynamics of RE through YFP-KIF13A expression. As expected, the length and number of KIF13A-postive tubules were significantly reduced in both BLOC-1- and BLOC-2-deficient HeLa cells and was phenocopying the Rab22A knockdown cells. Moreover, subcellular fractionation in HeLa, co-fractionated Rab22A with BLOC-1 (Muted) or BLOC-2 (HPS6) subunits along with KIF13A. Additionally, endogenous subunit levels of BLOC-1 and BLOC-2 were moderately reduced in Rab22A knockdown HeLa cells. Consistent to these results, recycling kinetics of Transferrin (Tf) was altered in Rab22A depleted cells as similar to BLOC-1- or BLOC-2-deficient cells as reported earlier. Likewise, Rab22A knockdown in melanocytes affected STX13-positive tubules and also the stability of endogenous BLOC-1 subunit, Pallidin, suggesting that Rab22A possibly works with BLOC-1 and BLOC-2 independent of cell types. To understand the regulation among these molecules, we overexpressed Rab22A in BLOC-1-deficient cells and analyzed the cells for BLOC-1-deficient rescue phenotypes such as pigmentation and cargo localization. However, Rab22A could not compensate the BLOC-1 function, suggesting that Rab22A possibly functions upstream of BLOC-1. Our subcellular and membrane associated fractionation studies of homogenates depleted with Rab22A, BLOC-1 and BLOC-2 showed that subunit levels of BLOC-1 and BLOC-2 in the membrane pool were significantly reduced upon Rab22A depletion compared to control cells. However, membrane association of Rab22A in BLOC-1 deficient cells was not affected. Further, our biochemical interaction studies showed that Rab22A interacts physically with BLOC-1 and BLOC-2 subunits as well as with KIF13A. Thus, these studies indicate that Rab22A possibly recruits and interacts with BLOC-1 and BLOC-2 for the generation of REs. We have summarized the study by proposing a model wherein Rab22A localizes to the limiting membrane of endosomes that are positive for KIF13A and then recruits and associates with BLOC-1 and BLOC-2 complexes which subsequently pulled by KIF13A for the generation of RE tubules.

In order to carry out the case study on ACAD, the methodology used in this research consisted of a bibliographic, legal and documentary survey on various themes and problems related to this type of experience. Firstly, central issues were discussed concerning the principles of solidarity economy, its objectives and problems, as well as the work of collectors of recyclable materials. Subsequently, a survey was carried out on the public policies of solid waste at national, state and municipal levels. In the last chapter, a study was carried out on the documents and part of the quotidian of this association observed during the participation in an extension project, with the objective of understanding it?s functioning, its characteristics, its challenges and its relations with local public power. Finally, it was verified that ACAD has presented difficulties to maintain its operation in accordance with the principles of the solidarity economy and to maintain itself autonomously in relation to the Municipality of Diamantina.

Aspects of double jeopardy

The common law right of the accused to be protected against double jeopardy recently acquired constitutional status in South Africa. Although South African courts previously applied this rule in various procedural contexts, there has been very little critical discussion of the values on which the rule is based. Nor have all contexts in which the rule should be applied been recognised. In the light of the new constitutional dispensation, it has become necessary to identify and analyse the values which determine the application of the rule. This thesis addresses the treatment of various aspects of double jeopardy in other constitutionally·grounded jurisdictions. Double jeopardy jurisprudence in the jurisdictions of England, Canada, India, Germany and the federal system of the United States of America is considered on a comparative basis. The historical origin and development of the rule are considered first. This is followed by an assessment of the current application of the rule in the various jurisdictions. The study demonstrates that South African courts have relied largely on outdated principles derived from English common law, rather than applying the rule by focusing on the values that underlie the rule. This approach has become unacceptable in the new constitutional dispensation, inter alia, because a teleological, value·orientated interpretative approach has been adopted by the Constitutional Court. This thesis indicates which of the principles that developed in foreign constitutional double jeopardy jurisprudence may be of value in developing an appropriate body of South African constitutional double jeopardy principles. Proposals are made for future implementation of the rule in various procedural contexts. O presente trabalho pretende apresentar um modelo unificado para o tratamento das estabilidades processuais (coisa julgada e preclusões). Para tanto, parte de duas premissas fundamentais: a segurança como continuidade jurídica, uma forma dinâmica de proteger a estabilidade sem impedir alterações de conteúdo nos atos jurídicos estáveis; e, de outro lado, a concepção das estabilidades processuais como uma cadeia de vínculos em contraditório. A combinação destas premissas resgata o papel da argumentação jurídica no sistema da coisa julgada, retomando a importância da vinculatividade das razões de decidir; e também incorpora ao modelo uma dimensão interprocessual que visa a garantir harmonia e coerência ao tráfego jurídico. Com base nestes pilares, tenta-se propor parâmetros para uma nova compreensão dos limites objetivos e temporais da coisa julgada. No campo dos limites objetivos, destaca-se a elaboração em torno dos esquemas argumentativos, estruturas aglutinadas de elementos processuais referentes ao exercício do contraditório. Em relação aos limites temporais, procura-se elaborar um modelo de revisão das estabilidades que incorpore o novum sem impedir a mudança. Neste contexto, trabalham-se também mecanismos compensatórios para a superação das estabilidades, tais como o ônus argumentativo no procedimento de quebra, e as regras de transição editadas pelo próprio Poder Judiciário. / The present work intends to present a unified model for the juridical treatment of the procedural forms of stability (res iudicata and issue preclusions). For this purposes, it has two fundamental premises: on the one hand, security as legal continuity, a dynamic way to protect the stability without preventing changes in the content of stable acts. On the other hand, the conception of procedural stabilities as chains of binding links operated through the right to a fair hearing. With the combination of these aspects, the role of the argumentation and the exercise of procedural rights gain in importance to the system of res iudicata, reviving the bindingness not only of the conclusion but also of the reasoning of the judgement; and also provides an inter-procedural dimension in order to guarantee harmony and coherence to the whole of juridical relations. By means of this ideas, the present work proposes parameters to verify the objective and time limits of claim and issue preclusions. In regard of the object of preclusions, a bigger role plays the concept of argumentative schemes, linked structures of procedural elements that refer to the exercise of the right to a fair hearing. In terms of the time limits of preclusions, the present thesis focus on establishing a model of review that incorporates the novum without preventing change of content. Therefore it works with compensatory mechanisms to overcome stabilities like, for instance, the burden of argumentation in the proceeding and transition rules edited by the Judiciary.

Esta Dissertação tem por objetivo conceituar, analisar e interpretar a chamada coisa julgada inconstitucional no campo doutrinário, no seu tratamento normativo e na aplicação prática da jurisprudência dos tribunais nacionais, no âmbito do direito público. O Instituto da coisa julgada é tratado no direito brasileiro pelo Texto Constitucional, pelo Código de Processo Civil Brasileiro e pela Lei de Introdução ao Código Civil Brasileiro, além de legislação esparsa. Ante a multiplicidade de esferas normativas cuidando do Instituto, para uma parte da doutrina, ele não teria proteção constitucional e poderia ser modificado e até abolido por normas infraconstitucionais. Por tal premissa, foi construída doutrina conhecida como relativização da coisa julgada, que vincula os efeitos da coisa julgada ao seu fundamento normativo de validade ou à justiça do decisum. Face as características muito próprias do tema escolhido, - de desenvolvimento quase que exclusivo na doutrina nacional -, privilegiou-se o exame da doutrina e jurisprudência nacionais, sem olvidar, no entanto, as contribuições da doutrina estrangeira, quando, efetivamente, puderam auxiliar na análise das questões abordadas nesta Dissertação. O texto apresenta as origens da coisa julgada e conceitua os elementos processuais essenciais para a compreensão do Instituto como categoria jurídico-processual. Examina o princípio da segurança jurídica, sua evolução histórica e sua interpretação no direito atual, bem como a natureza da coisa julgada como categoria normativa, face a posição que o Instituto ocupa no texto constitucional brasileiro. Aborda, também, a natureza jurídica das sentenças formadas em contrariedade à Constituição Federal vigente e os efeitos do posicionamento doutrinário que apregoa a inexistência da coisa julgada inconstitucional. Procede, ainda, ao estudo da nova redação dos arts. 475-L 1 e 741, parágrafo único, do Código de Processo Civil brasileiro, cristalizada pela Lei n 11.232/2005, que acolheu, ao menos em parte, a teoria acima indicada. Por fim, dedica considerações sobre decisões judiciais representativas das dificuldades práticas que a aplicação do Instituto tem gerado na jurisprudência brasileira / This essay has the objective to appraise, analyze and to interpret what is unconstitutional resiudicata, and in the practical application of jurisprudence of national courts in public law. The Institution of the res iudicata is treated in the Brazilian Law by the Constitutional Text, by the Brazilian Civil Process Code, besides the Law of the Introduction to the Brazilian Civil Code and sparse legislation. Due to the multiplicity of Law subjects taking care of the Institution, for one part of the doctrine, it would not have constitutional protection and it could be modified and even abolished under infraconstitutional norms. Under that premise, it was built the doctrine known as relativism of the judged thing, that links the effects of the resiudicata thing to its normative fundament of validity or the justice of decisum. Once the chosen subject has its very own characteristics of almost exclusive development in the national doctrine it was privileged the doctrine exam and national jurisprudence, not failing to remember, nevertheless, the contributions of the foreign doctrine, when, effectively, they could support the analyzes of the approached issues in this Essay. The text presents the origins of the res iudicata and classifies the essential process elements for the understanding of the Institution as a process-juridical category. It examines the principle of juridical reliability, its historical evolution and its interpretation in the current law, as well as, the nature of the judged thing as a normative category, to the Institution position in the Brazilian Constitutional text. It also mentions, the juridical nature of the formed sentences in rejoinder to the present Federal Constitution and the effects of the doctrinaire positioning that states the no existence of the unconstitutional res iudicata. Yet, it proceeds, to the study of the new writing of the articles 475-L 1st and 741, single clause, of the Brazilian Process Civil Code, consolidated by the Law number 11.232/2005, that partially accepted, the above indicated theory. At last, it dedicates considerations on representative judicial decisions of practical difficulties that the application of the Institution has had in the brazilian jurisprudence
