現今世界趨勢已朝向全球整合的方向邁進,隨著科技日新,世界各國跨越地域隔閡,不論是在政治、經濟、科技、文化等各方面往來接觸愈來愈頻繁,中國大陸近年來與世界經貿關係連結更為緊密,同時亦對外開放直接投資,使跨國企業逐漸擴大進軍中國大陸之版圖,享受中國大陸豐沛之廉價勞動力。
然而,開放外人直接投資(Foreign Direct Investment, FDI)勢必為中國大陸相關之產業或總體經濟帶來某種程度之影響,儘管外人直接投資可帶來充沛之資本及先進之技術,但亦有可能加劇國內市場競爭,不利於本土廠商。
本文運用1998-2006 年「中國工業企業統計數據庫」中之電子業廠商,建構追蹤資料模型(Panel Data),並運用隨機邊界法(stochastic frontier approach)估計中國大陸本資、台港澳資及外資企業生產效率,藉以衡量FDI之外溢效果。根據實證結果我們發現:中國大陸電子業之外人直接投資存在正向外溢效果及正向之技術移轉,顯示FDI之進入將有助於提升中國大陸電子業本土廠商之生產力。此外,我們同時發現FDI集中投資的結果將可能造成外溢效果的減低,除此之外,經濟區位亦是影響外人直接投資所帶來之外溢效果及技術移轉效果之重要因子之一。 / Global integration is the world trend nowadays. With the breakthrough of technology, the geographical barriers no longer exist. It would be much closer with other countries in many fields, such as politics, economics, technology and culture. In recent years, China has a closer economics and trades linkage with the world. As the results of openness to foreign direct investments, more and more multinational enterprises enter to China, expanding their scale and being benefited from the low-cost labor of China.
China is benefited from the plentiful capital and advanced technologies of foreign direct investments; however, the openness to FDI might cause the competition which can aggravate in domestic market and hurt the domestic firms.
The research uses the data of electronic firms from Chinese Industrial Enterprises Database. We apply panel data model and stochastic frontier approach to estimate the production efficiency of Chinese, Taiwanese, Hong Kong, Macanese and Other foreign enterprises.
According to the empirical results, we discover that there are positive spill-over effects and technology transformation from foreign direct investments in Chinese electronic industry. These results indicate the entry of FDI will promote the productivity of Chinese electronic firms. Beside the positive results, we also discover the negative deduction stem in concentrated investments; furthermore, the spill-over effects and the technology transformation effects are affected by the economic location.

Effects of diet and crude oil ingestion on growth and biochemistry of captive-reared pigeon guillemots (Cepphus columba)Hovey, Andrew K. 01 October 2002 (has links)
The pigeon guillemot (Cepphus columba) population in Prince William
Sound has failed to recover from declines that occurred both before and after the
Exxon Valdez Oil Spill (EVOS). Post-spill studies of pigeon guillemot breeding
biology have identified three potential factors limiting recovery: (1) predation on
eggs and nestlings; (2) declines in the proportion of high-lipid, schooling forage
fish (sand lance [Ammodytes hexapterus], herring [Clupea pallasi], and capelin
[Mallotus villosus]) in the diet; and (3) continued exposure to residual oil from the
spill. This laboratory study with captive-reared pigeon guillemots at the Alaska
SeaLife Center investigated two aspects of the species' biology that are relevant to
restoration in the aftermath of EVOS. First, we investigated the role of dietary
factors (prey type, quantity of food consumed, dietary fat content, and energy
intake rate) in limiting the growth, development, survival, and fledging condition of
nestling pigeon guillemots. The objective was to understand how changes in prey
availability and prey quality might affect pigeon guillemot productivity. Second,
we fed nestlings sublethal doses of weathered Prudhoe Bay crude oil (PBCO) and
then measured several potential biomarkers of effects from this pollutant. These
dose-response experiments were designed to (1) better understand the impact on
nestling guillemots of petroleum hydrocarbons in food, (2) calibrate existing and
potential biomarkers of exposure to PBCO in pigeon guillemots in a controlled,
laboratory setting, and (3) develop better nondestructive biomarkers of exposure to
PBCO in pigeon guillemots in particular, and seabirds in general.
Results of feeding experiments indicated that most variation in nestling
growth rates could be explained by variation in daily energy intake. The type of
forage fish consumed, the lipid or protein content of the forage fish, and even the
quantity of food consumed daily did not have as strong an effect on nestling
guillemot growth as did daily energy intake. The metabolic efficiency and growth
performance of nestling guillemots was not enhanced on high-lipid diets, contrary
to results with nestlings of some other seabird species. Instead, structural growth
(wing length) in nestling guillemots was somewhat stunted on high-lipid diets.
These attributes of guillemot nutritional requirements are associated with the
guillemots' nearshore foraging niche and high food provisioning rates to nestlings.
The average lipid content of sand lance, juvenile herring, and capelin may represent
the optimal dietary lipid content for nestling pigeon guillemots. This study supports
the hypothesis that guillemot productivity is limited by the availability of these forage fishes through effects on energy provisioning rates to nestling guillemots.
Consequently, recovery of pigeon guillemot populations injured by EVOS is likely
linked to recovery of these key forage fish stocks.
Results of the oil-dosing experiments indicated that nestling guillemots are
resistant to small doses of weathered PBCO in their food. No nestlings died or
suffered noticeable health effects following dosing. The high dose in this study (0.5
ml kg����� day�����) was sufficient to induce hepatic cytochrome P450A1 (a liver enzyme
indicative of contaminant exposure), but growth rate, fledging mass, and blood
chemistry were largely unaffected. None of the 12 plasma or hematological
markers examined responded in a dose-dependent manner to ingestion of weathered
PBCO, except lactate dehydrogenase (LDH). Although baseline stress hormone
(corticosterone) levels were not different between oil-dosed and control nestlings, a
standardized acute stress protocol revealed that corticosterone was more elevated
during stress for oiled nestlings compared to controls. Although we were not
successful in identifying a noninvasive biomarker (e.g., growth) or a blood
biomarker (e.g., haptoglobin) of crude oil exposure in nestlings, we were able to
confirm that levels of hepatic cytochrome P4SO1AI and corticosterone during
stress were elevated by the sublethal doses administered during our experiments.
Based on this and other studies, it is unlikely that the failure of pigeon guillemots to
recover from EVOS is due to effects on nestling health of residual oil in food. / Graduation date: 2003

Behavioral constraints on harlequin duck population recovery from the Exxon Valdez oil spill in Prince William Sound, AlaskaRizzolo, Daniel J. 05 February 2004 (has links)
I investigated the relationship between harlequin duck (Histrionicus
histrionicus) behavior and lack of recovery from the Exxon Valdez oil spill in
Prince William Sound, Alaska. First, I evaluated the hypothesis that harlequin
ducks in winter have little flexibility to increase foraging time in response to
disturbance because they are constrained to forage during daylight. Eight radio-tagged
harlequin ducks wintering in Resurrection Bay, Alaska were monitored for
evidence of dive-feeding at night. Each radio-tagged individual was detected
during an average of 19.5 of 22 nocturnal monitoring sessions and signal loss
indicative of diving behavior was not detected during a total of 780 minutes of
signal monitoring. In contrast, the same 8 radio-tagged birds were detected during
an average of 9.1 of 12 daytime signal monitoring sessions and signal loss
indicated diving behavior during an average of 62 �� 7% of 5-minute daytime
monitoring periods (total of 364 minutes of signal monitoring). Thus the harlequin
ducks monitored in this study rarely, if ever, fed by diving at night, possibly due to
reduced foraging efficiency and (or) increased predation risk at night. This result
suggests that harlequin ducks in mid-winter may be severely time-limited in their
foraging, especially in northern parts of their winter range. Therefore, subtle
changes in energy requirements and (or) time-activity budgets as a result of
continued exposure to residual oil from the Exxon Valdez oil spill may affect the
ability of harlequin ducks to meet their daily energy requirements.
Second, I tested the hypothesis that exposure to crude oil affects time-activity
budgets of harlequin ducks. Controlled oil-dosing and plumage-oiling
experiments were conducted using adult female harlequin ducks in captivity. I
found no evidence that ingestion of weathered Prudhoe Bay crude oil affected the
occurrence of feeding activity during 30-minute observation periods, nor was there
evidence of effects on time spent feeding. Effects of crude oil ingestion on
maintenance activity were detected, but were neither consistent between the 2 years
of the study, nor dose-dependent for the 2 doses administered (2 and 20 mL kg�����
wk�����), and therefore did not strongly support an oil-dosing effect on maintenance
activity. Consequently, these results provided little support for the hypothesis that
oil ingestion affects time-activity budgets of captive harlequin ducks, at least for
the doses and conditions of captivity used in this study. Plumage-oiling reduced
feeding activity in captive harlequin ducks. The estimated probability of feeding
during 30-minute observation periods for birds in the high-exposure oiling group (5
mL of crude oil) was 53% less than that of non-oiled controls. Oiled birds
exhibited a trend of reduced time feeding with increasing level of external-oiling;
this effect was greatest among birds in the high-exposure oiling group, which spent
43% less time feeding than non-oiled birds. Reduced feeding was associated with
less time in the water dive-feeding and presumably lower heat loss. Trends in the
occurrence of maintenance activity and time spent in maintenance activity for birds
in the high-exposure treatment suggested plumage-oiling increased maintenance
activity, but results were not conclusive. The behavioral changes associated with
plumage-oiling in captivity would likely reduce fitness in the wild, where a high
proportion of time must be spent in the water feeding. If residual Exxon Valdez oil
sequestered in beach sediments enters the water column where it may be
encountered by harlequin ducks, external exposure may lead to reduced feeding
activity. This, in turn, may compromise survival, particularly during mid-winter
when the time available for diurnal foraging is low and maintenance energy

Development and application of a proteomic approach to the assessment of pollution in the marine environmentApraiz Larrucea, Itxaso January 2009 (has links)
Today, assessment of the health of coastal waters is recognized as being important for both the conservation of nature and well-being of humans. Anthropogenic pollution has been the focus of extensive research for some time and a variety of programs for the monitoring and assessment of environmental pollution have been developed. Determination of the levels of pollution in sensitive ‘sentinels’ such as mussels, allows monitoring of these levels in a given area over a prolonged period of time. Furthermore, the biological effects of pollution are reflected in a series of biomarkers, none of which provides a general picture of the sentinel’s state of health and all of which are individually specific for certain pollutants and influenced by both biotic and abiotic factors. In an attempt to improve biomonitoring of marine pollution, we have developed two proteomic approaches here. In the first portion of the thesis, a proteomic analysis was performed on peroxisomes isolated from mussels exposed either to one of three model anthropogenic pollutants, or two different types of crude oil, or from mussels exposed to the Prestige oil spill. Application of two-dimensional electrophoresis (2-DE) provided protein expression signatures (PES) for exposure to these different pollutants.Furthermore, several individual protein components of these PES could be putatively identified. In the second portion of this work, such analysis of subproteomes was developed further in order to improve the applicability of this approach to biomonitoring. A simple fractionation procedure in combination with liquid chromatography and 2-DE provided samples from mussels residing in different regions of a pollution gradient around the harbor of Gothenburg, as well as from mussels exposed to two types of fuel oil similar to that of the Prestige that were suitable for environmental proteomics. In addition, we constructed a model for this approach that can be cross-validated in the future and applied to assess sources of fuel oil pollution in connection with biomonitoring programs.

近年來,企業開始利用聯合品牌策略、以合作的方式有效提升自身的品牌權益;學術界亦有許多關於聯合品牌的研究,但多專注於產品導向品牌應用該策略的效益,少有以服務導向的聯合品牌為研究對象。本研究從消費者的觀點探討服務業進行聯合品牌策略時,其本身與合作夥伴不同層級的品牌權益組合與聯合品牌服務成效對於企業本身、合作夥伴以及聯合品牌品牌權益的影響。
本研究透過4 x 2準實驗設計的方式進行假說驗證。首先,透過前測篩選出消費者心中最熟悉且兩者之間適配度最高的雞排店與手搖飲料店做為研究情境的素材;進一步操弄四種品牌權益組合(高高、高低、低高與低低)以及聯合品牌的服務成效(成功與失敗),形成八種實驗問卷,共回收257份有效樣本;最後以配對樣本T檢定以及雙因子變異數分析做為研究方法進行資料分析,本研究的研究結果證實:
一、品牌權益組合對於聯合品牌的品牌權益具有顯著影響:
當二母品牌皆具高品牌權益時,該聯合品牌品牌權益將低於合作前二母品牌的品牌權益,反之,聯合品牌的品牌權益將比合作前二母品牌都高;當合作前兩母品牌的品牌權益為一高一低時,聯合品牌的品牌權益將介於二者之間。
二、品牌權益組合對於各母品牌有顯著影響:
當企業與具備較高品牌權益的夥伴合作時,該企業的品牌權益將於合作後提升,反之則下降;當兩企業皆具高品牌權益時,合作後二者品牌權益皆會下降,反之,合作後兩者的品牌權益皆會上升。
三、聯合品牌服務成效對於各母品牌與聯合品牌的品牌權益有顯著的正向效果。
四、品牌權益組合與聯合品牌服務成效之間不具備交互效果。 / Recently, the companies start utilizing the co-branding strategy to efficiently enhance their brand equity. This concept also appear on the academic paper, which focus on most product-intention brands but seldom service-intention ones. This research is to clarify the effects of brand equity mixes and service effects to the mother brands and the co-brand after the co-branding strategy in the aspect of consumers.
This research examines the hyposises by 4 x 2 quasi-experiment design. First, after executing the pre-test, this research picked fried-chicken and soft drink stores as the matirials of experiment situation. Then, this research designed 8 versions of questionnaire to manipute 4 brand equity mixes and the service performance of the co-brand. The amount of efficient samples is 257 and the research methods are pair-T test and two-way ANOVA. The research results are:
1. Brand equity mixes have significant effects of the co-brand’s brand equity:
When two mothers’ brand equity is both high, the co-brand will be lower than its mothers; in contrast, when they are both low, it will higher than them. When one mom is high and the other is low, the brand equity of the son will be between the two.
2. Brand equity mixes have significant effects of the mother brand’s brand equity:
When the company co-operate with the one with higher brand equity, its brand equity will rise after co-operating. When both companies are high, they will drop after co-branding; in contrast, when both are low, they will rise.
3. Service performance of the co-brand has significant positive effects to all parties.
4. Brand equity mixes and the service performance of co-brand have no interaction.

Plastex slöserier : En undersökning i syfte att kartlägga och reducera kostnader relaterade till slöserier på ett företag som tillverkar plastprodukterHollström, Linnéa January 2018 (has links)
Plastex är ett företag med 20 anställda i Skellefteå som tillverkar strängsprutade plastprodukter. I dagsläget försöker de återanvända och återvinna plaster så mycket de kan, men möter svårigheter i återanvändningen eftersom blandprocessen mellan nytt och återvunnet material är komplicerad. Detta skapar mycket spill som i sin tur kostar företaget onödigt mycket. Syftet med arbetet har varit att undersöka ifall det finns smidigare och billigare sätt att återanvända och återvinna material, jämfört med hur Plastex gör i dagsläget. Detta genom att först kartlägga produktionen och sedan ta fram förbättringsförslag gällande materialhanteringen. Målet med arbetet har varit att presentera lösningsförslag till Plastex, som eventuellt kan leda till minskade spill och kostnader, och därmed även en effektivare produktion. Relevant teori togs också fram för att underlätta vid idégenereringen. Teorin användes också för att utvärdera och vidareutveckla de olika idéerna. Genom arbetet användes den iterativa metoden projektcirkeln och projektspiralen vilket innebar att alla faser skulle genomgås flera gånger. Ett Gantt-schema upprättades också för att få koll på givna deadlines. Olika metoder användes sedan för att samla in relevant information om Plastex, bland annat intervjuer och enkäter. Denna analyserades medan idégenereringen påbörjades, genom bland annat Gordonmetoden, brainstorming, och diskussionsmetoden. Alla idégenereringsmetoder resulterade i ett antal lösningsförslag vilka vidareutvecklades och sedan utvärderades med hjälp av grovsållning, för- och nackdelar, en relativ beslutsmatris, och en kriterieviktmetod. Här användes även kravspecifikationen för att kunna vikta de olika idéerna mot krav och önskemål som ansågs viktiga. Till sist kvarstod några lösningsförslag som ansågs relevanta att gå vidare med i ett framtida arbete. Plastex rekommenderas utbilda sin personal i hantering av spill och sedan även förenkla sorteringen av detta genom att skapa tydligare markeringar på återvinningskärl. Företaget rekommenderas också köpa in automatiska sugar för att förbättra arbetsförhållandena för de anställda som i dagsläget tvingas tömma spillådorna under stansarna manuellt. Vidare rekommenderas företaget också sträva mot att bli bättre på att ta vara på sina medarbetares kunskaper och idéer, eftersom det är arbetarna som är experter på sina respektive områden och vet vad som fungerar och vad som bör förbättras. / Plastex is a company with 20 employees in Skellefteå, which manufactures extruded plastic products. Today, they are trying to re-use and recycle as much as they can, but they face difficulties in the re-use process since the mixing procedure between new and re-used material is complicated. This creates a lot of waste, which in turn cost the company unnecessary amounts of money. The purpose with this work has been to examine if there is a smoother and cheaper way to re-use and recycle materials, compared to the way Plastex does today. This by first mapping the production and then create suggestions regarding the material handling. The objective has been to present suggestions to Plastex that may lead to a reduced amount of waste and costs in the future, and therefore also a more effective production. A search for relevant theory was completed to facilitate the idea generation. The theory was also used to evaluate and further develop the different ideas. The iterative method called project circle and project spiral was used throughout the project, which meant that each phase was reviewed several times. A Gantt chart was also created to keep track of given deadlines. Different methods were used to gather information about Plastex, including interviews and polls. This was analyzed while the idea generation began, using the Gordon method, brainstorming, and the discussion method to name a few. All idea generation methods resulted in a number of solutions which were further developed and then evaluated with coarse screening, pros and cons, a relative decision matrix, and a criteria-weighted method. A requirement specification was also used to weigh the different ideas against demands and wishes that were considered important. Finally, there were some solutions that were considered relevant to proceed with in a future work. Plastex is recommended to educate its personnel in waste management and also to simplify the sorting of waste by creating clearer markings on recycling containers. The company is also advised to purchase automatic suction machines to improve the working conditions for the employees who currently have to manually empty the bins under the punches. Furthermore, the company is advised to strive towards being better of taking care and use their employees’ knowledge and ideas, since it is the workers who are experts in their respective areas and know what works and what should be improved.

La situation actuelle des règles relatives à la responsabilité civile de l'entrepreneur pour les dommages environnementaux provoqués par l’exploitation offshore d’hydrocarbure et le transport de ce produit par des navires pétroliers, démontre que le législateur a été de plus en plus concerné par la question de la santé environnementale. Cependant, il y a beaucoup de lacunes dans les lois nationales qui peuvent entraîner une incertitude juridique considérable pour l'entrepreneur et en même temps, ne pas fournir une protection adéquate à l'environnement et à l’homme. L’étude comparée des systèmes juridiques démontre qu’il est extrêmement important que les pays qui sont exposés aux périls des marées noires, notamment ceux qui exploitent des hydrocarbures dans la mer, disposent d’un fonds spécial d’indemnisation pour garantir et faciliter la restauration de l’environnement et le payement des indemnisations aux victimes. Outre la protection de l’environnement et des droits des citoyens, le fonds offre aussi la possibilité d’application des cas exceptés et de la limitation de responsabilité. Le fonds serait utilisé pour couvrir les préjudices au-delà de la limite de responsabilité de l’entrepreneur ou dans les cas où la responsabilité de celui-ci est écartée par un cas excepté. / The current situation of the rules governing the liability of the entrepreneur for environmental damage caused by offshore oil exploration and by the transportation of this product by oil tankers, shows that the legislator is more concerned with environmental health issues. However, there are many gaps in national legislations that can lead to considerable legal uncertainty for the responsible parties. While, at the same time it does not provide adequate protection for the environment and to human beings. The comparative study of legals systems shows the importance that countries that are exposed to the dangers of oil spills, especially those exploiting oil in the sea, to have a special indemnisation fund to guarantee and facilitate environmental restoration and payment of compensation to victims. Besides protecting the environment and citizens' rights, the fund also offers the possibility of applying the defenses of liability and limitation of liability. The funds would be used to cover the losses beyond the limit of liability of the responsible partie or when the responsibility for the accident is ruled out by a liability defense cause.

This diploma thesis deals with finding the minimal countercurrent distance of the water surface sensors used in practice for use with a V-notch weir. The thesis complements the previously obtained results of measurements in the longitudinal vertical plane of symmetry of the inlet channel with measurements on the whole countercurrently located plane of the inlet channel. The measurements are obtained experimentally in the water management research laboratory at the Department of the Water Structures Faculty of Civil Engineering in Brno. Measurements on each individual weir with top angle cutouts of 90°, 53°8´ and 28°4´ are taken at five possible positions of the sensor towards the plane of the measuring weir. All measurements are also repeated for three different vertical distances between the lowest level of the spillway edge and the bottom of the inlet channel. The obtained data are evaluated and subsequently the minimal distances for the location of the water surface sensor in front of a counter weir is determined. The thesis also includes recommendations for practical application presented in the form of text, tables and also graphically.

Dans l’attente d’une augmentation de la part des énergies renouvelables dans le mix énergétique, les énergies fossiles, telles que les hydrocarbures, restent encore la première source d’approvisionnement énergétique de l’Homme. La raréfaction des hydrocarbures sur le continent conduit les industriels à se tourner vers l’offshore. Ainsi, aux Etats-Unis (1er pays producteur de pétrole au monde en 2015), la production pétrolière offshore (principalement concentrée dans le Golfe du Mexique) représente plus de la moitié de la production nationale totale de pétrole. La France, quant à elle, se tourne désormais vers l’exploration de sa très grande zone offshore s’étendant sur les quatre coins du monde (notamment au large des côtes guyanaises). Une telle importance économique ne doit pas passer sous silence la dangerosité de l’exploitation pétrolière offshore. L’explosion du Deepwater Horizon en avril 2010, au large des côtes de la Louisiane (Golfe du Mexique ; Etats-Unis) en est une parfaite illustration (11 salariés tués, endommagement de l’écosystème, victimes collatérales, etc.). Le droit doit pouvoir appréhender efficacement les risques générés par l’exploitation des hydrocarbures en offshore. L’étude comparative des législations française et états-unienne met en exergue les carences du droit français. L’exploitation des ressources minérales du plateau continental des Etats-Unis, la répression des déversements illicites d’hydrocarbures et, la réparation des dommages qui en résultent, sont régies par des lois fédérales spéciales. A contrario, l’exploitation du plateau continental et de la Zone économique exclusive française s’inscrit dans un cadre législatif et règlementaire plus général. Il apparaît donc nécessaire de proposer une réforme de la législation actuelle. Dans cette optique, ce travail a vocation à émettre des propositions de réforme. La nouvelle législation française spéciale doit être pensée dans une approche systémique. Les éléments qui composent le système doivent interagir. Le premier élément est un régime optimal de prévention qui, s’articule autour de la sécurité des travailleurs et des installations. Le second élément est un régime de répression des infractions à la législation de prévention et, du délit de pollution par les hydrocarbures. Le troisième élément est un régime d’indemnisation civile de plein droit des conséquences dommageables de l’accident pétrolier (lorsqu’il n’est pas couvert par le régime exclusif d’indemnisation des accidents du travail) et du déversement d’hydrocarbures. Responsabilités pénale et civile concourent par ailleurs à la prévention par la dissuasion, cela en vue d’une meilleure internalisation des risques dans la politique managériale des entreprises pétrolières et parapétrolières intervenant sur les sites. / Waiting for a complete change to the development of renewable energies, fossil energies, such as conventional oil and gas, remain still the primary source of energy supply. The rarefaction of conventional oil on the continent has lead major oil companies to turn to the offshore. Thus, in the United States (First oil producer country in the world in 2015) the offshore oil exploitation (mainly concentrated in the Gulf of Mexico) represents more than half of the national oil production. France, as for it, turns now to the exploration of its very great offshore zone extending on the four world’s corners (particularly, off the Guyana’s coasts). This significant economic development should not overlook the dangerousness of offshore oil activities. The explosion of Deepwater Horizon in April 2010, off the Louisiana’s coasts (Gulf of Mexico, The United States) is a perfect illustration (11 killed employees, ecosystem damaged, collateral victims, etc). The Law must be able to frame the risks generated by the offshore oil activities. The comparative study of French and American legal systems highlights French law’s gaps. The exploitation of the American continental shelf’s mineral resources, the repression of unlawful oil discharges and, the remedies of damages, which result from it, are governed by special federal laws. A contrario, the exploitation of the French continental shelf and exclusive economic Zone is governed by general laws. It thus appears necessary to promote a reform of the current legislation. Accordingly, this work is to put forth reform proposals. The special French new legislation must be worked out in a systemic approach. The elements which compose the system must interact. The first element is an optimal prevention that is articulated around the security of the workers and the installations. The second element is the repression of the offenses to the legislation of prevention and, unlawful oil discharges. The third element is a strict liability for the damages result from oil accident (when they are not covered by the exclusive liability for the damages result from occupational accidents) and oil spill. Criminal and civil liabilities also contribute to the prevention by the deterrent for better consideration of risks in the management of oil companies and others companies involving in offshore oil activities.

A Study on the Integration of Multivariate MetOcean, Ocean Circulation, and Trajectory Modeling Data with Static Geographic Information Systems for Better Marine Resources Management and Protection During Coastal Oil Spill Response – A Case Study and Gap Analysis on Northeastern Gulf of Mexico Tidal InletsKnudsen, Richard Ray 06 November 2015 (has links)
The Oil Pollution Act of 1990 requires the development of Regional and Area Contingency Plans. For more than 20 years, the State of Florida, under both the Department of Environmental Protection and the Florida Fish and Wildlife Commission, has worked closely with the U.S. Coast Guard and the National Oceanic and Atmospheric Administration to develop these plans for coastal and marine oil spill response. Current plans, developed with local, state and federal stakeholder input, use geographic information systems (GIS) data such as location and extent of sensitive ecological, wildlife, and human-use features (termed Environmental Sensitivity Index data), pre-defined protection priorities, and spatially explicit protection strategies to support decision-making by responders (termed Geographic Response Plans). However, they are long overdue for improvements that incorporate modern oceanographic modeling techniques and integrated data from coastal ocean observing systems. Better understanding of circulation in nearshore and estuarine waters, at a scale consistent with other spatial data, is especially lacking in Area Contingency Plans. This paper identifies the gaps in readily available information on the circulation-driven causes and effects missing in current oil spill contingency planning and describes a sample methodology whereby multiple coastal and ocean spatial science disciplines are used to answer questions that no single, non-integrated discipline can answer by itself. A path forward for further integration and development of more comprehensive plans to better support coastal protection in Florida is proposed. The advances made here are applicable to other coastal regions of the world.
