Strategies for the privatisation of black education with reference to teacher training

The poor quality of state controlled black education in South Africa in the past was mainly caused by low pupil per capita expenditure and poor teaching. This resulted in many problems. Because of past neglect, as well as the increase in number of children to be educated, black education must be revitalised. Government funding is not adequate, therefore, privatisation and semi-privatisation of education is a recommended solution. Community and business involvement is encouraged, and state control should be reduced. Short-term strategies have been fairly successfully implemented. With a view to proposing strategies for the upliftment of black education, the upgrading of teachers through improved INSET and PRESET Q!_Qfil_~mmes is considered a priority. Already implemented models, such as Promat, TOPS and the Molteno Project should be investigated. These programmes have been successful to varying degrees. Strategies have been proposed based on the above findings and guidelines for further research suggested. / Educational Studies / M. Ed. (Comparative Education)

Návrh a realizace demonstračního modelu dvojítého kyvadla / Design and implementation of demonstration model "double inverted pendulum"

This thesis describes the process of rebuilding an experimental model of a single pendulum on a cart into the double pendulum on a cart. The control algorithm in MATLAB/Simulink environment for stabilization of the pendulum in the inverse position is designed. For this purpose, LQR state feedback control was implemented. Also method for swinging the pendulum into inverse position from stable state (swing-up) was designed. Feedforward method was utilised for swing-up control. In the thesis, functionality of these algorithms is shown.

Le principe du contradictoire, cause de contrôle étatique des sentences arbitrales internationales / The adversarial principle, case for state control of international arbitral awards

Le principe du contradictoire post-arbitral en matière d’arbitrage international est établi dans la majorité des systèmes juridiques. Toutefois, les décisions des juges étatiques montrent que l’adhésion générale à ce concept masque d’importantes différences concernant sa portée et son application. Cette thèse ne vise point à établir une description théorique du contenu du principe, elle propose une analyse qualitative, dont l’objectif essentiel est la vérification de son individualité, et non le fait qu’il est une simple application du principe civiliste classique. Loin de constater l’adoption définitive d’un concept arbitral autonome, la solution retenue démontre l’opportunité et, donc, le besoin de sa légitimation, ayant un impact direct sur la circulation des sentences arbitrales internationales. En fin de compte, hors de tout encadrement statique, il y a lieu de détecter, à travers la progression de l’étude, une évolution logique et une activité d’apurement au niveau du droit comparé. Cette évolution, d’un principe classique vers un concept arbitral international, à lecture contractuelle et non-statutaire, contenant une règle d’égalité, puis vers un outil technique en état de disparition, ne peut que dévoiler la période d’agonie dans laquelle se place le concept en cause. Cet aboutissement ne contribue pas seulement à souligner les errements conceptuels préjudiciables en jurisprudence comparée, il concourt également à marquer l’un des traits les plus émancipatoires du processus arbitral international. Dans cette optique, une telle conjoncture participerait à l’accélération de la privatisation de la justice arbitrale internationale. / The post-arbitral adversarial principle in international arbitration is established in most legal systems. However, decisions of state judges show that general support for this concept masks significant differences in terms of its scope and application. This thesis does not aim to outline a theoretical description of the principle’s content ; it provides a qualitative analysis, the main objective of which is to ascertain its individuality, and not the fact that it is a mere application of the classic civil principle. Far from establishing the definitive adoption of an autonomous arbitral concept, the solution demonstrates the appropriateness and, therefore, the need for its legitimation, and has a direct impact on the movement of international arbitral awards. Ultimately, beyond any static framework, through the progress of the study, a logical development and regularisation activity with respect to comparative law should be detected. This development, from a classical principle to an international arbitration concept, to a contractual and non-statutory reading, containing a rule of equality, and thereafter to a technical tool which is disappearing, can only reveal the death throes in which the concept in question finds itself in. This outcome not only serves to highlight the detrimental conceptual errors in comparative case law, it also helps to mark one of the most emancipatory features of the international arbitration process. In this respect, such a situation would contribute to the accelerated privatisation of international arbitration proceedings.

No. of bitstreams: 0 Previous issue date: 2014-02-14 / The theses is about the control of production, commerce, use and publicity of tobacco by the State, in three ways of performance (state control), according to Federal Constitution of 1988, the Framework Convention on Tobacco Control and the internal Legislation. It is due to the Legislative Power, to elaborate the restritive rules of the using of tobacco; it is due to the Executive Power the planning and the execution of public politics concerning to the prevention of tobacco use; and to Judiciary, to judge the compensation procedure by the healthy damage caused by tobacco use. Because it involves the fundamental right to the health of the smoking and non-smoking citizen (second hand smoking), this work analyses the collision of fundamental rights and the acting of the tobacco industry, for misinformation from the 1920 decade in XX century. At last, it stablishes a comparison between hard cases to judge, taking into account the relationship between right and reality, specially the conclusions of science concerning to the diseases caused by cigarette smoking which can lead to death. / A tese aborda o controle pelo Estado da produção, comercialização, consumo e publicidade do tabaco, numa tríplice esfera de atuação, denominada de dirigismo estatal, de acordo com a Constituição Federal de 1988, a Convenção-Quadro de Controle do Tabaco e a legislação infraconstitucional no Brasil. Cabe ao Poder Legislativo, notadamente, a elaboração de normas restritivas à utilização do tabaco; cabe ao Executivo o planejamento e a execução de políticas públicas voltadas à prevenção do tabagismo; e, ao Judiciário, o julgamento das ações de indenização pelos danos causados à saúde pelo consumo de cigarro. Em razão de envolver direito fundamental à saúde do cidadão fumante e não fumante (fumante passivo), este trabalho analisa a colisão de direitos fundamentais e a conduta da indústria de tabaco, por defeito de informação perpetrado desde a década de 1920, do século XX. Por fim, estabelece um parâmetro de julgamento de casos difíceis, levando-se em conta a relação direito e realidade, especialmente as conclusões da ciência no tocante às doenças causadas pelo cigarro, que podem levar à morte.

A Study of Experience Mapping Based Predictive Controller as Applied to Switching Converters

Experience Mapping based Prediction Control (EMPC) is a new type of controller presented in literature, which is based on the concept of Human Motor Control (HMC). During the developmental phase, called the initial learning phase, the controller records the experience in a knowledge base, through online interactions with the system to be controlled. This knowledge base created using the experience maps is termed as Experience Mapped Knowledge Base (EMK). The controller envisages the development of EMK only through interaction with the system, without the need for knowledge of the detailed plant model. The EMPC controls the system through prediction of actions based on the mapped experiences of EMK. Depending on the nature of control required for the system chosen, various strategies can be used to achieve control using the EMK. The above controller has previously been utilized for motion control applications. In the present work an effort has been made to study the suitability of the EMPC for the voltage regulation of switching converters. The plant chosen for the control study is a discontinuous conduction mode (DCM) buck converter. The parameter to be monitored for the purpose of control is the load voltage. The control input from the EMPC to the converter is a duty ratio value based pulse-width modulated (PWM) signal. Two strategies of control have been proposed: steady state control and transient control. Steady state control action maintains the steady state output voltage at the required value for a given load. The transient control action is used to improve the transient performance of the system. Iterative predictive action and iterative transient actions are used to facilitate convergence of the output voltage to within the required range in presence of non-linearities and uncertainties in the system. Impulse action is introduced to further improve the transient performance of the system. The EMPC is compared a proportional-integral (PI) controller for the given DCM buck system.

Delegering av flaggstatsskyldigheter : Hur påverkas sjösäkerheten av flaggstatens delegering av skyldigheter till klassificeringssällskap?

Arbetet har syftat till att undersöka och problematisera flaggstatens och klassificeringssällskapens roller såsom kontrollfunktion avseende sjösäkerhet. Frågor har ställts angående vilka skyldigheter flaggstater å ena sidan, och klassificeringssällskap å andra sidan, har vad gäller fartygskonstruktion och fartygssäkerhet. Vidare har arbetet även behandlat frågan vilka sjösäkerhetsrelaterade effekter som kan uppkomma av att flaggstaten delegerar skyldigheter avseende konstruktion till klassificeringssällskap. För att besvara frågorna har en kvalitativ dokumentstudie gjorts, med vissa inslag av rättsdogmatik i de delar som avsett finna gällande rätt på området. Materialet för dokumentstudiens del har till stor del valts ut genom en bred sökning i litteratur och avhandlingar på området. På så vis har det använda materialet redan genomgått en urvalsprocess och därmed ansetts vara relevant för arbetet. Resultatet visar att det finns en viss överlappning i kontrollfunktionsrollen för både flaggstaten och klassificeringssällskapen. Att delegering av skyldigheter sker från flaggstaten till klassificeringssällskapen är inte nödvändigtvis problematiskt. Dock kan en delegering få negativa effekter på sjösäkerheten i de fall klassificeringssällskapen inte är i paritet med flaggstaten eller båda parter saknar en effektiv kontrollfunktion med högt ställda krav. Skulle delegering ske till ett klassificeringssällskap som har en god kontrollfunktion med höga krav kan brister som finns inom flaggstaten, såsom bristande resurser och kompetens, avhjälpas. Trots att systemet till stor del verkar fungera tillfredsställande finns anledning att fortsätta forska inom området för att undersöka hur de problem som belysts i detta arbete kan åtgärdas eller förhindras i framtiden. / The aim of this paper has been to investigate and problematize the roles of the flag state and the classification societies in regard to their maritime safety control function. Questions have been raised regarding what obligations flag states on one hand, and classification societies on the other hand, have regarding ship construction and ship safety. Furthermore, the paper has also addressed the question of what maritime safety-related effects may arise from the flag state delegating their duties to classification societies. To answer the questions, a qualitative document study has been conducted, with some elements of legal dogmatics in certain parts in order to find the current legal situation. The material for the document study has been selected by thorough research into literature and dissertations in the area. Therefore, the chosen material has been previously reviewed and gone through a selection process and was thus considered relevant for this paper. The result has shown that there is some overlap in the control function for both the flag state and the classification societies. Delegating obligations from the flag state to the classification societies is not necessarily problematic. However, delegation of the said duties can have negative effects on maritime safety in cases where the classification societies are not on par with the flag state or both parties lack an effective control apparatus to enforce high standards. Should delegation occur to a classification society that has a good control apparatus with high requirements, possible shortcomings that exist within the flag state, such as lack of resources and skills, can be remedied by the high standard performance of the classification society. Even though the system might seem satisfactorily at first glance, there is room for further research in the area in order to investigate how the existing problems can be managed and prevented in the future.
