Resumé The topic of this master thesis is selected issues of an adoption (comparative fragments). I chose not to deal with the theme as a whole because of its extent, which would have inevitably lead to mere scratch of the surface of such complex issue as an adoption. Picking and choosing some interesting aspects enabled me to go more into detail and elaborate on them in depth. When approaching this thesis I chose to use combination of analytic and comparative method. The thesis itself is composed of the introduction, six chapters and the conclusion. The purpose of the Introduction is to make the reader aware of the structure of the thesis and to outline the complicated legal nature of adoption. The objective of this thesis, which is also announced within this section, is to provide the reader with issues not usually dealt with within theses or academic works. Chapter One is divided into three parts and subsequently shed light into the concept of the adoption, its types and sources of the legislative. Chapter Two is dedicated to historical excursion and is divided into two parts. Tendo como foco a educação popular, procurou entender como os educadores sociais ministram suas aulas e as estratégias por eles vivenciadas que corroboram para transformar os educandos do Programa Jovem Aprendiz em sujeitos críticos e reflexivos. Com o intuito de atender as demandas investigativas, o estudo pautou-se numa pesquisa qualitativa e ouviu por meio de entrevistas em profundidade e pela escrita da memória pedagógica, quatro educadores, sendo dois da Obra Social Murialdo de Porto Alegre e dois da Obra Social Murialdo de Caxias do Sul. Para complementar os dados coletados ouviu-se quatro educandos da Obra Social Murialdo de Porto Alegre, utilizando-se da escrita da memória pedagógica e diálogos em roda. Os aportes teóricos principais, que deram base ao estudo, foram Freire, Brandão, Gohn,Tardif, Giroux, Arroyo, Nóvoa, Vasconcellos. Para responder os objetivos da pesquisa, algumas questões – dimensões foram necessárias: Formação e concepções do educador social; Saberes e a práxis pedagógica do educador social; Desafios encontrados na gestão das aulas; Educandos: construção de sujeitos críticos-reflexivos; Ser educador social nas obras sociais Murialdo. O estudo concluiu que os saberes que favorecem a construção de sujeitos críticos e reflexivos não estão prontos, nem são dados, precisam ser constantemente construídos na parceria educador/educando, considerando as suas histórias pessoais e o contexto onde se inserem. / This research sought to understand how the construction of knowledge, proposed by social educators, is taught in the classes of the Young Apprentice Program of two Social Works of the Leonardo Murialdo Institute, one in Porto Alegre and the other in Caxias do Sul. Popular education, sought to understand how social educators teach their classes and the strategies they experience that corroborate to transform the learners of the Young Apprentice Program into critical and reflective subjects. In order to meet the research demands, the study was based on a qualitative research and heard through in-depth interviews and written pedagogical memory, four educators, two from the Murialdo Social Work of Porto Alegre and two from the Murialdo Social Work Of Caxias do Sul. In order to complement the collected data, four students of the Murialdo Social Work of Porto Alegre were heard, using pedagogical memory writing and dialogues in wheel. The main theoretical contributions, which gave basis to the study, were Freire, Brandão, Gohn, Tardif, Giroux, Arroyo, Nóvoa, Vasconcellos. To answer the objectives of the research, some questions - dimensions were necessary: Formation and conceptions of the social educator; Knowledge and pedagogical praxis of the social educator; Challenges encountered in class management; Educandos: construction of critical-reflexive subjects; Be a social educator in social works Murialdo. The study concluded that the knowledge that favors the construction of critical and reflexive subjects is not ready, nor is it given, needs to be constantly built in the educating / educating partnership, considering their personal histories and the context in which they are inserted.

Cette recherche s’inscrit dans trois perspectives. Celle d’abord de l’histoire des idées : quels sont les liens précis entre la pensée de Nietzsche et l’œuvre de Foucault ? Ce dernier ne cesse de revendiquer son nietzschéisme, mais, par –delà des références allusives, il n’a consacré à Nietzsche qu’un article, des cours – dont certains seulement ont été publiés, et une conférence. Réciproquement, dans quelle mesure la pensée de Nietzsche trouve-t-elle un éclairage dans les analyses foucaldiennes ? Celle ensuite plus proprement philosophique : quels sont les liens entre volonté de savoir et volonté de puissance ? Ces deux concepts sont au cœur de l’entreprise généalogique, et c’est leur articulation qu’elle vise à mettre en lumière. La généalogie permettrait ainsi de produire une analyse conjointe de la subjectivité et de l’espace social. Celle enfin de la politique : en quoi la généalogie permet-elle de comprendre le jeu du pouvoir et du savoir dans notre civilisation ? L’hypothèse de départ est que la généalogie permet de mettre au jour des mécanismes qui demeurent inintelligibles à partir des savoirs positifs traditionnels. La psychè contemporaine ne serait compréhensible qu’à partir des concepts élaborés par la généalogie. Cette dernière permettrait de dévoiler le biais idéologique des savoirs qui sont à l’origine de nos actions. Corrélativement, elle permettrait de montrer que le fonctionnement de l’idéologie n’est pas celui qui jusqu’à présent a été théorisé. La méthode utilisée est celle d’une mise en tension de textes choisis dans les œuvres respectives de Friedrich Nietzsche et de Michel Foucault. Il s’agit donc d’une démarche comparative permettant non une superposition ni une juxtaposition, mais un éclairage réciproque des textes entre eux, et, partant, des pensées entre elles. / This research follows three perspectives. First, that of the history of ideas: what are the precise links between Nietzsche’s thought and Foucault’s work? The latter keeps asserting his Nietzscheanism but, in spite of allusive references, he has only devoted to Nietzsche one article, courses –among which some have not been published yet, and a conference. Conversely, to which extent is Nietzsche’s thought clarified by Foucault’s analyses? Then, a more strictly philosophical perspective: what are the links between the will to learn and the will to power? These two concepts are at the heart of the genealogical undertaking, which aims at shedding light on the way they link up together. Genealogy would thus allow a joint analysis of subjectivity and social space. Last, the political perspective: does genealogy allow a better understanding of the interplay between knowledge and power in our civilization? The initial assumption is that genealogy can bring to light mechanisms which remain unintelligible on the basis of positive traditional knowledge. The contemporary psychè could only be understood with the help of the concepts elaborated by genealogy. The latter would allow to unveil the ideological distortion of knowledge which is at the bottom of our actions. Correlatively, it would allow to make clear that the mechanisms of ideology do not correspond to what has been theorized so far. The method used consists in confronting texts selected in the respective works of Friedrich Nietzsche and Michel Foucault. So - far from superposition or juxtaposition - this is a comparative approach allowing a reciprocal illumination of texts, and hence thoughts, with one another.

Virtually Uninhabitable: A Critical Analysis of Digital Environmental Anti-Toxics Activism

In this dissertation, I analyze online environmental anti-toxics activism. Environmental activist groups have created a presence on the World Wide Web to help empower people to become aware of and struggle against pollution. The sites that I explore (http://www.epa.gov/tri/, http://www.epa.gov/enviro/wme/, http://www.rtknet.org/, and http://www.scorecard.org/) serve as devices of this empowerment and by extension recruit people to the political goals of anti-toxics activism. In my analysis, I focus on a series of questions germane to this context. How can/does this movement go online and utilize that presence to sway others to their cause and ideology? How then is that cause represented digitally, in the online medium? What are the reciprocal impacts of that representation on the movement itself? Most importantly, what form of activist identity is being promoted through the mediation of the online interface? That is, how are the identity of the self as activist and the related understanding of space and place altered through their translation into a digital environment? What are the parameters and limitations of digitally mediated, informed empowerment? I undertake to critique empowerment as found through the digital translation of environmental anti-toxics activism into the virtual space of the Web. I show that particular uses of this Internet application invent (reinvent/reinforce) versions of environmental anti-toxics activism, digitized versions which must be understood in terms of their wider assumptions and implications. I break the study into three main parts. The first part lays theoretical groundwork for studying Web-based entities. The second part deals with more particular foundational elements for digital environmental anti-toxics activism, especially in terms of information. In the final section, I analyze and critique the forms of digital identity and empowerment that the websites create. I conclude that digital empowerment, defined primarily through access to expert information, actually represents an impoverished version of empowerment which may do little to aid real-world toxic struggles. / Ph. My thesis deals with the child's right to know his or her genetic origin. It is a universal human right guaranteed by the Convention on the Rights of the Child. The Article 7, paragraph 1 states that every child has a right to know his or her parents, if possible. European Court of Human Rights repeatedly postulated that the right to know one's origin is an integral part of the right to respect for private and family life provided by the Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms. The purpose of my work is to explain on particular problems, to what extent is this right respected in the Czech Republic, in conformity with its international obligations. The text is based on valid legal status to June 21, 2011, with regard to proposed changes in the upcoming adoption of the new Civil Code. The text is systematically divided into seven chapters. The first chapter is focused in general on the right to know one's own origin in the human rights dimension. The following chapters examine particular relevant sections of family law and its imperfections. Firstly, I discuss the issue of determination and denial of parenting with an emphasis on emerging deliberate disharmony between biological and legal parenthood. O direito à verdade frente a graves violações de direitos humanos foi criado recentemente e tem um significado jurídico que permanece incerto em diversos aspectos relevantes. As divergências em torno do seu conceito, que ainda está em formação, geram problemas práticos quando se busca tornar esse direito efetivo. A tese analisa a questão que está na base do debate jurídico-dogmático sobre esse direito, a saber, o significado que o termo verdade adquire ao se tornar o seu objeto. É feita uma investigação sobre a forma como este tema é abordado pelos estudos sobre justiça de transição e sobre como se deu a emergência e o desenvolvimento do direito à verdade no direito internacional dos direitos humanos, nas esferas universal e interamericana. O objetivo é, depois, buscar compreender o que, de um ponto de vista teórico, fez com que surgisse na história e no pensamento político-jurídico a necessidade de sua criação e passou a alimentar o esforço para a sua conceituação. Essa análise aponta que a verdade almejada com o direito em estudo tem outras dimensões para além da busca de informações desconhecidas sobre casos individuais de violações a direitos humanos. Como o tema da verdade, sabidamente, é de enorme extensão no campo filosófico, o presente trabalho faz uso de temas de reflexão de Hannah Arendt, que para essa temática tem tido grande repercussão inclusive em sede doutrinária, com o fim de, por meio de um desenvolvimento extensivo, examinar as diferentes dimensões do problema. / The right to the truth concerning gross human rights violations was created recently, and has a legal meaning that remains uncertain in many relevant aspects. The disagreements about its concept, which is still in development, cause practical problems when one tries to make this right effective. The thesis analyses the issue that underlies the legal-dogmatic debate about this right, i.e., the meaning of the term truth when it becomes its object. An investigation is undertaken on how this theme is addressed by studies on transitional justice and also on the emergence and development of the right to the truth in international human rights law, in the universal and in the inter-American systems. The goal is then to try to understand what, from a theoretical point of view, led to the emergence in history and political-legal thought of the need for its creation, and began to feed the effort to its conceptualization. This analysis indicates that the truth sought with the right examined here has dimensions other than the search for unknown information about individual cases of human rights violations. The theme of truth being, as known, a subject of enormous extension in the philosophical field, the present study makes use of topics of reflection by Hannah Arendt, which have had a great repercussion on this subject even in legal dogmatic thought, in order to examine, through an extensive development, the different dimensions of the problem. By doing so, it is intended to shed light on the way the conceptualization of the right to the truth is being consolidated and on the difficulties it faces.
