Previous issue date: 2008-11-14 / This work has the purpose of examining the legal regime of the Neighborhood Impact Preliminary
Study - NIS, with the interest to define and delineate the requirements and conditions for its application
by Brazilian municipalities. The NIS is a new instrument created by the Statute of the City - Federal Law
No. 10.257, 2001-7-10, which for its application on behalf of the municipality while carrying out its
urban policy, must initially be regulate by a specific law, based on the Director Plan. Relevant, in this
sense, the delimitation of their content so that it not be confused with the Environmental Impact Study
- EIS, since the NIS will be required by municipal agencies for projects and activities, as defined in
specific municipal law, private or public, causing a great neighbourhood impact of the urban order, as a
requirement for obtaining licenses or permits for construction, expansion or operation under municipal
supervision. Therefore, by being an instrument still little discussed and addressed in the Brazilian
doctrine and jurisprudence and that requires a legislative act in the various municipalities of the country,
the current study is clearly justified. To this end, the present monographic study will be developed
based on research of national doctrine, based on consultation of books, monographs and articles, plus
analysis of case studies and homeland legislation. Finally, we note its importance in planning the use
and occupation of urban land to be held by municipalities as an instrument of democratic management
that will secure the balance of the urban order and well-being of its inhabitants / O presente trabalho tem o intuito de analisar o regime jurídico do Estudo Prévio de Impacto de Vizinhança
EIV, com o interesse de definir e delimitar os requisitos e condições para a utilização do mesmo
pelos Municípios brasileiros. O EIV é um instrumento novo criado pelo Estatuto da Cidade Lei Federal
n.º 10.257 de 10-7-2001, segundo o qual para que a municipalidade possa utilizá-lo na execução de
sua política urbana deverá regulamentá-lo mediante lei específica, baseada no Plano Diretor. Relevante,
neste sentido, a delimitação de seu conteúdo para que o mesmo não seja confundido com o Estudo
Prévio de Impacto Ambiental EIA, uma vez que o EIV será exigido pelo Poder Público municipal para
empreendimentos e atividades, definidos em lei municipal específica, privados ou públicos, causadores
de grande impacto de vizinhança à ordem urbanística, como requisito para a obtenção das licenças ou
autorizações de construção, ampliação ou funcionamento a cargo do mesmo. Por tais razões, por ser
um instrumento ainda pouco debatido e abordado na doutrina e jurisprudência brasileira e que demandará
uma atuação legislativa nos diversos Municípios do país, justifica-se tal estudo. Para tanto, a monografia
será desenvolvida com base na pesquisa da doutrina nacional, fundamentada na consulta de livros,
monografias e artigos, além de análise de casos práticos e legislação pátrias. Por fim, constatamos
sua grande importância no planejamento do uso e ocupação do solo urbano a ser realizado pelos
Municípios como instrumento de gestão democrática garantidor do equilíbrio da ordem urbanística e
do bem-estar de seus habitantes

Previous issue date: 2009-05-25 / Since the 1970s the number of petrol stations in Brazil has increased a lot.
It s known that nowadays there are about 32.000 petrol stations working in Brazil
in which 8.500 are in São Paulo state and 2.000 are in São Paulo capital.
These petrol stations use underground containers to store automotive fuel
and sell it afterwards. Although this is a potencially polluter activity, the
establishments had never been asked by the government any kind of urban or
environmental license in order to protect the environment.
The situation started to change in the beginning of this decade when a law
passing number 38.231/99, from São Paulo City Hall, determined the changing of
the underground containers and the adequacy of the petrol stations equipments to
environmental and security rules, and when a Resolution CONAMA 273/00
determined that not only the new petrol stations, but also the old ones had to have
a license at the environmental organ called CETESB in São Paulo state.
The importance of this subject is getting clearer as far as CETESB declared
in its last report (November 2008, published in March 2009), that from 2.514
contaminated areas in the state of São Paulo, 1.953 are caused by petrol stations.
Therefore, in this paper several theorical and practical issues will be
mentioned about the development and implementation of a license for the new
petrol stations and for the ones that are already working in São Paulo city. There
will be also mentioned the interpretations and the possible solutions of the conflicts
that can come from this process as well as the explanations and conclusions for
each case / A partir da década de 1970 houve um aumento significativo do número de
postos no país. Hoje estima-se que existam cerca de 32 mil postos de gasolina
em operação no Brasil, dos quais aproximadamente 8.400 situam-se no Estado
de São Paulo e em torno de 2.000 na Capital paulista.
Estes postos utilizam tanques subterrâneos para armazenar os
combustíveis automotivos que revendem ao consumidor final e, apesar de
exercerem uma atividade potencialmente poluidora, nunca lhes foi exigido
qualquer tipo de licenciamento ambiental e nem urbanístico para defesa do meio
ambiente.
Essa situação só mudou no início desta década, em razão, primeiro, do
Decreto 38.231/99, da Prefeitura de São Paulo, que determinou a troca dos
tanques e adequação dos equipamentos dos postos da Capital às normas
ambientais e de segurança, e, segundo, da Resolução CONAMA 273/00, que
determina que todos os postos, novos e em operação, devem se licenciar perante
o órgão ambiental competente, a CETESB no caso do Estado de São Paulo.
A importância deste tema fica ainda mais evidente quando se verifica,
pelas informações que a CETESB forneceu em seu último relatório, sobre as
áreas contaminadas no Estado de São Paulo, em novembro de 2007, que, das
2.272 áreas contaminadas, 1.745 são postos de combustíveis.
Portanto, serão abordados os diversos aspectos, teóricos e práticos, que
influem no desenvolvimento e implementação do licenciamento dos postos de
gasolina (novos e em operação), situados no município de São Paulo, e como são
interpretados e aplicados na solução dos conflitos decorrentes desse processo,
com explanação, em cada caso, das posições e conclusões adotadas pela autora

La tesis doctoral "Urbanismo Ambiental y Evaluación Estratégica" investiga y propone un renovado papel del urbanismo y muy especialmente de la ordenación del territorio como instrumentos no tan sólo de valor para la protección del medio ambiente sino también para la consecución de las políticas hacia un desarrollo sostenible. Con tal fín se reflexiona y potencia la visión/función del suelo como recurso ambiental, también en su función urbanística, y de su mano las consecuencias e interacciones que tal conceptuación puede tener en la Comunidad Europea desde su competencia compartida con los Estados Miembros en materia de medio ambiente, concretamente en su capacidad para incidir, mediante técnicas normativas y no normativas en el urbanismo y la ordenación del territorio en cuanto instrumentos de regulación y ordenación del recurso ambiental suelo. En esta nueva andadura del urbanismo ambientalizado o, si se prefiere, en la carrera hacia el desarrollo urbanístico sostenible, la técnica de evaluación ambiental estratégica de determinados planes y programas se revela como fundamental, especialmente si se consigue que su transposición a los ordenamientos internos de los Estados Miembros se lleve a cabo con pleno respeto a las notas insosyalables defendidas en la tesis de técnica preventiva y no reparativa, dinámica, con capacidad de incidencia en la elección misma del modelo de plan y con miras finalistas a la sostenibilidad. Con ella podrá generalizarse el urbanismo ambiental y acelerarse el proceso de revisión que tienen pendiente las materias de urbanismo y ordenación del territorio desde la nueva concepción del suelo como recurso ambiental y mediante la recepción e integración de los principios ambientalistas. / The doctoral thesis "Environmental Urban Planning and Strategic Evaluation" investigates and proposes a renewed paper of the urban planning and very especially of the ordering of the territory like instruments not so only of value for the protection of the environment but also for the achievement of the policies towards a sustainable development. With this purpose is reflected and promotes the vision/function of the land as an environmental resource, also in its urbanistic function, and of its hand the consequences and interactions that such name can have in the European Community from their shared competence with the Member States on the subject of environment, precisely in their capacity to hit, through normative and non normative techniques in the urban planning and the ordering of the territory when instruments of regulation and ordering of the resource environmental land. In this new stage of the environment urban planning or, if the technique is preferred, in the career towards the sustainable urbanistic development, of strategic environmental evaluation of determinate plans and programmes reveals how fundamental, especially if is achieved that its transposition to the internal ordering of the Member States defended in the thesis of technique is carried out with plenum with respect to the notes preventive and dynamics, with capacity of incidence in the same choice of the model of plan and with sights finalist to the sustainability. With her the environmental urban planning will be able to be generalised and to speed up the process of revision that they have pending the matters of urban planning and ordering of the territory from the new conception of the floor as an environmental resource and through the reception and integration of the environmentalist principles.

Análise da vulnerabilidade e risco como subsídio ao planejamento urbano : município de Pirambu (SE)Silva, Adriano Ezequiel 16 March 2016 (has links)
The city of Pirambu, located in the north shore of the Sergipe state highlights
itself because of the relatively preserved natural characteristics. Inside the area
of the county, the coastal zone concentrates the biggest interest of the realty
agents due to its 23km of shoreline, including some parts that are protected by
the environmental law. In the interphase zone the presence of dunes,
mangroves, rivers and lagoons stand out, for example, the Sangradouro Lagoon
and the Redonda Lagoon. This study has evaluated the environmental risk and
vulnerability, with urban focus, of this county. In order to do that a theoretical
review approach was made with the fundaments of the Geosystemical method,
starting with the theoretical contributions of Bertrand (1971) and the
Ecodynamical analysis of Tricart (1977), addressing the mapping and diagnosis
techniques proposed by the INPE (National Institute of Space Research), which
were adequately adapted to the local reality, complemented by mapping
campaigns. As results, a thematic map was made with the interpretations of the
geofacies of the studied area, introducing the natural and anthropic risks and
the legal restrictions existents in the area, with the finality of subsidize the
planning of the soil use and occupation, with suggestions of aptitude for urban
purposes in future studies. / O município de Pirambu localizado no litoral norte do estado de Sergipe se
destaca dentre os demais devido às suas potencialidades naturais,
relativamente preservadas. Dentro da área do município, a zona costeira é a
que desperta maior interesse imobiliário, devido aos 23 km de praias, sendo
algumas dessas protegidas por Lei. Na zona interfásica o destaque fica por
conta da presença de dunas, manguezais, rios e lagoas, como por exemplo,
Lagoa do Sangradouro e a Lagoa Redonda. Este estudo avaliou a
vulnerabilidade e o risco ambiental, com enfoque urbano, nesse município. Para
tanto foi realizado uma abordagem teórica “estado-da-arte” fundamentada no
método Geossistêmico, partindo inicialmente nas contribuições teóricas de
Bertrand (1971) e na análise Ecodinâmica de Tricart (1977), passando pelas
técnicas de mapeamento e diagnósticos propostos pelo INPE - Instituto
Nacional de Pesquisas Espaciais (Zoneamento Ecológico Econômico – ZEE), as
quais foram devidamente adaptadas à realidade local, complementadas por
incursões de campo. Como resultados, obtive-se um mapa temático com as
interpretações das geofácies da área de estudo, introduzindo os riscos naturais
e antrópicos, as restrições legais em algumas dessas áreas, tendo como
finalidade subsidiar o planejamento do uso e da ocupação do solo, com
sugestões de aptidão para fins urbanos em trabalhos futuros.

The aim of this diploma thesis is to elaborate an area which belongs to one of the proposed development directions of Brno city. The area is located under the D1 highway adjacent to the confluence of Svratka and Svitava rivers in the Brno-jih district. There are two villages in the area – Dolní Heršpice and Přízřenice – which are surrounded by buildings of mainly business and industrial character. The objective of this work is to review the possibility of utilizing the defined area for living as the number of similar areas in Brno is decreasing. The result of the diploma thesis is an urbanistic idea outlining possible functional use of a large area covering 380 ha, and a thematic study of an urbanistic structure in a particularly defined part.

The diploma thesis The Images of a City: the Resident's View of the Town of Nymburk deals with the issue of why people behave differently. The thesis is inspired by the approach of behavioral geography, which is represented by Kevin Lynch's work. Lynch has proposed the concept of the image of the city, the people's vision about the surroundings of a place where they live. The image of the city consists of its visible features evoking a strong impression and having an effect on people's sensory perception. Moreover, the direct influence of the city represented by architectural-urbanistic determinism and environmental psychology is also taken into account. I have found out during the research that both of theoretical approaches are important for identifying the relation between the town and his residents which relates to the behavior in the town. The aim of the diploma thesis is to find out which images of the town of Nymburk its inhabitants have, which components create their images and what is the composition of these components. The thesis focuses both on universal image of Nymburk and on images of the town with regard to the current lifecycle stage and respondents' sex. The diploma thesis was preceded with the specification of specialised atelier TG02 of which the purpose was to prepare an urbanistic study of sport area Hněvkovského territory that is found in the municipal district Brno - Komárov. The urbanistic design was aimed to create an important territory for sport professional as well as relax activities. The specification included also the design of current BMX area and creation of background for sportsmen as well as visitors. The diploma thesis that deals with the building of cycling stadium in form of a study links to this theme. The stadium is situated in the North-East part of the areas, near Hněvkovského road. The design regards sufficient scattering surfaces around the building, simple orientation in the building´s surroundings as well as in the building itself is emphasised. Its glass façade is an important expression element of the building as well as the video mapping systems proposed for projection and lighting of this façade. The attractiveness of the whole area is underlined with parking areas, refreshment point of current cycling track and new area of sport activities (dirt park, ball games).

Previous issue date: 2007-06-04 / The present paper work aims at showing that the urban property social function
principle has a minimum content, legal and mandatory, that can be extracted of the
Brazilian constitutional system since the promulgation of the Federal Constitution in
October, 5, 1988 and that does not depend on City Plannig Law presence to happen
in a full form, direct and immediate on all urban property in the domestic territory. To
support that affirmation, first we chose the study of the principles, searching to find its
importance and to identify the points of contact and distance of these in relation to
the juridical rules; after that we tried to locate the role of the managing plan, pointing
the hypotheses of obligatoriness in constitutional and infraconstitutional levels and
the consequences of not editing that plan, when it is obligatory; then we made some
relevants questionings about the new constitutional profile of the property by the
positioning of the social function as an intrinsic and forming element of its concept,
capable to assure its effectiveness in a State of social welfare. Finally we had
proceeded an analysis of the property social function in general and then of the
urban property in special. The study concludes that, in fact, it is possible to extract of
the Brazilian constitutional system after-1988 an essential legal content to the social
function of the urban property principle, capable to make valid the underlying idea of
fulfilment of the city social functions and fulfilment of the human life dignity basic
principle. In this context, the managing plan it figures as an instrument to ensure the
power of the urban property social function and not as a conditional circumstance of
its existence and applicability / O presente trabalho tem como objetivo demonstrar que o princípio da função social
da propriedade urbana tem um conteúdo mínimo, jurídico e cogente, que pode ser
extraído do sistema constitucional brasileiro instituído a partir da promulgação da
Constituição Federal de 5 de outubro de 1988 e que não depende da edição de
plano diretor para incidir de forma plena, direta e imediata sobre toda propriedade
urbana localizada no território nacional. Para dar suporte à afirmação que se
pretende demonstrar, elegeu-se primeiramente o estudo dos princípios, buscando
revelar sua importância e identificar os pontos de contato e de distanciamento destes
em relação às regras; em seguida buscou-se a identificação do papel do plano
diretor, apontando-se as hipóteses de obrigatoriedade nos planos constitucional e
infraconstitucional e as conseqüências da não edição do plano, quando obrigatória;
seguiram-se questionamentos a respeito do novo perfil constitucional da propriedade
diante do posicionamento da função social como elemento intrínseco e conformador
de seu conceito, capaz de assegurar sua efetividade num Estado de bem-estar
social. Por fim teve vez a análise da função social da propriedade em geral e da
propriedade urbana em especial. O estudo conclui que, de fato, é possível extrair do
sistema constitucional brasileiro pós-1988 um conteúdo jurídico essencial para o
princípio da função social da propriedade urbana, capaz de fazer valer a idéia
subjacente de cumprimento das funções sociais da cidade e de cumprimento do
princípio fundamental da dignidade da vida humana. Nesse contexto, o plano diretor
se afigura como um instrumento de efetivação da função social da propriedade e
não como circunstância condicionante de sua existência e aplicabilidade
