[pt] O depoimento especial, no Brasil, tem sido tema de muitos debates há quase duas décadas, principalmente, entre profissionais de Serviço Social, Psicologia e Direito que atuam no campo da proteção de direitos de crianças e adolescentes. A presente dissertação teve por finalidade identificar e analisar elementos indicativos de tensionamentos entre o princípio da proteção integral e violação de direitos presentes nas práticas dos agentes atuantes em depoimento especial. Para tanto, foram abordados aspectos relativos à infância e à adolescência; à tutela do Estado realizada pelo Sistema de Justiça; à proteção integral de crianças e adolescentes; às violações de direitos a que são submetidos, especialmente a violência sexual; ao campo jurídico do tribunal; e às relações estabelecidas neste campo entre agentes institucionais, vítimas e acusados. Para construção do corpus da pesquisa foram selecionados processos judiciais oriundos de varas criminais da Comarca da Capital, que continham depoimentos de crianças ou adolescentes vítimas. Para sistematização e análise do material selecionado, foi empregada a técnica de análise documental em diálogo com contribuições teóricas e metodológicas de Pierre Bourdieu, no que se refere ao habitus, campo e capital, bem como estudos sobre infância, sociedade e sistema de justiça. Os resultados encontrados sistematizaram a presença de oito elementos indicativos de tensionamentos na condução da prática judicial do depoimento especial, demonstrando a existência de um potencial latente de violação tanto dos direitos de crianças e adolescentes, como de garantias dos acusados, mesmo em ações voltadas à proteção, e evidenciando que o habitus sócio-historicamente construído ao longo do processo de formação da sociedade e das instituições incide fortemente nas relações sociais empreendidas no campo analisado. / [en] In Brazil, Special Testimony has been the subject of many debates among professionals who work with Children and Adolescents rights protection, particularly, in the areas of Social Work, Psychology and Law School for almost two decades. The aim of this work is to identify and analyze indicative elements of tension between the Full Protection principle and the violation of rights present in the actions of Special Testimony agents. Therefore, aspects related to childhood and adolescence were addressed; as well as the State tutelage executed by the Justice System; the full protection of children and adolescents; the violations of rights to which they are subjected, especially about sexual violence; the legal field of the Court; and the relations established in this context between the institutional agents, the victims and the defendants. Legal proceedings conducted by Criminal Courts of the Federal District involving the testimony of children or adolescents as victims were selected to build the corpus of the research. The selected data was organized and analyzed using the documentary analysis technique in conjunction with theoretical contributions by Pierre Bourdieu on the habitus, field and capital, as well as studies on childhood, society and the justice system. The results showed the presence of eight indicative elements of tension in the Special Testimony judicial practice which demonstrates a latent potential for violation of the children and adolescents’ rights and the defendants rights, even on protection judicial proceedings; making evident the social-historical habitus built throughout the society and its institutions formation process has a strong impact on the social relations undertaken in the analyzed field.

Syftet med följande studie är att undersöka vilken verkan lagändringen i Brottsbalken (SFS1962:700, 4 kap. 3 §), avseende barnfridsbrott, har fått för socialtjänstens arbete. Vidare ämnarstudien belysa socialarbetares upplevelser av att arbeta med barn som upplevt våld mellannärstående. Studien antar en hermeneutisk utgångspunkt och använder sig av organisationsteorin,professionsteorin och begreppet handlingsutrymme för att tolka och förstå resultatet. Femsemistrukturerade intervjuer genomfördes med socialarbetare som dagligen kommer i kontaktmed barn i sitt arbete. Intervjuerna transkriberades och analyserades därefter genom kodning ochen tematisk analys, vilket resulterade i att två huvudteman och sju delteman identifierades. Avstudiens resultat framgår att lagändringen inte haft någon större påverkan på det praktiskaarbetet, då socialtjänsten redan arbetade utifrån barnets bästa i stor utsträckning. Däremotupplever respondenterna att arbetet för rättsväsendet och andra samverkanspartner har förändratstill följd av lagändringen. Likaså har samverkan ökat, både internt inom socialtjänstens olikaenheter, och externt mellan olika myndigheter och andra samverkanspartner. Studien påvisar attbarns rättigheter delvis har stärkts då barn i allt större utsträckning ses som egen part. Samtidigtfinns brister i samverkan och begränsningar i svensk lagstiftning och praxis, som gör det svårtför socialarbetare att tillförsäkra barns rättigheter. / The aim of this study is to examine what effect the new law regarding violation of children’sintegrity has had on social services’ work. The study adopts a hermeneutic approach and usesorganizational theory, professional theory and social worker's use of discretion to interpret andunderstand the results. Semi-structured interviews were conducted with five social workers. Theinterviews were transcribed and subsequently analyzed through coding and a thematic analysis,which resulted in the identification of two main themes and seven sub-themes. The studyconcluded that the change in the law did not have a particularly large impact, since the socialservices were already working in the best interest of the child to a large extent. However, socialworkers feel that the work of the judiciary and other cooperation partners has changednoticeably. Likewise, collaboration has increased, both internally within the social services, andexternally between different authorities and other collaboration partners. Furthermore, the studyshows that children's rights have been partially strengthened, as they are increasingly seen astheir own party. Despite this, there are shortcomings in cooperation and other limitations inSwedish legislation and practice that make it difficult for social workers to ensure that children'srights are met.

[pt] Neste trabalho de tese investigaremos um novo método para medir a fase leptóonica de violação CP, CP , com um set up experimental chamado LiquidO e, estudaremos a possibilidade do futuro experimento Hyper-Kamiokande de pôr um limite sobre o tempo de vida do neutrino. Ambos são experimentos que detectam neutrinos de acelerador que performarão as próprias medições através do estudo do bem conhecido fenómeno da oscilação de sabor de neutrinos. O primeiro experimento considerado possui duas novas características: primeiramente utiliza como fonte de neutrino um fluxo de Vμ e Vμ produzidos por pions (pi+) em repouso a uma distância de 16 km e secondariamente vai usar uma nova forma de detecção. Essa detecção é feita utilizando cintilador liquido opaco com fibras ópticas que permitem distinguir entre e+ e e-. Nós explicaremos as principais propriedades fenomenológicas desta configuração e calcularemos a significância estatística de exclusão da hipótese CP = (0, pi), a precisão de medição de CP com 1δ de confiança estatística e também as regões permitidas no espaço dos parámetros sin2 023 - δ CP . Na segunda parte do nosso trabalho, nos concentraremos no experimento Hyper-Kamiokande, versão melhorada do experimento Super-Kamiokande que se adjudicou o prémio Nobel em 2015. Este é um detector de luz Cherenkov que utiliza um fluxo de Vμ (Vμ) com energias < 10GeV produzido no acelerador JPARC e colocado a uma distância de 295 km. Neste trabalho identificaremos este experimento como T2HK enquanto para a sua estensão na Korea, que utilizará a mesma fonte mas será colocada a 1100 km de distância, utilizaremos a sigla T2HKK. Nós introduziremos brevemente as modalidades de decaimento do neutrino que podem ser classificadas em dois tipos: um é chamado decaimento invisível, ou seja, quando o neutrino de origem decai em um estado estéril mais uma partícula escalar, e o outro e chamdo de decaimento visível, ou seja, quando o neutrino de origem decai em um autoestado de massa ativo mais uma partícula escalar. Em fim calcularemos as sensitividades no limite da vida média do autoestado V3 para os casos de decaimento visível e invisível para as configurações de T2HK e T2HKK. / [en] In this thesis we will study a novel method to measure the leptonic CP violation phase, CP , in an experimental set up called LiquidO, and the possibility by the future experiment Hyper-Kamiokande to put a limit on the neutrino lifetime. Both experiment are accelerator based ones that will use the well established neutrino flavour oscillation phenomenon to perform their measurement. The first experimental set up uses two new features: firstly it uses as a source a flux of Vμ and Vμ coming from pions (pi+) decay at rest with a baseline of 16 km and secondly it uses a new detection method. This new detection is performed using opaque Liquid Scintillator (LS) with optical fibers that allows e+ e- identification. We will discuss the phenomenological main characteristics of this set up and we will calculate the expected significance to exclude the δ CP = (0, pi) hypothesis, the 1δ precision of the CP measurement and also the expected allowed regions in the sin2 023 - δ CP plane. For what it concerns the second part of our work, we will focus on the Hyper-Kamiokande experiment, upgrade of the 2015 Nobel prize awarded Super-Kamiokande. This is a water Cherenkov detector that will use a Vμ (Vμ) flux with a typical neutrino energy < 10 GeV coming from the JPARC facility with a baseline of 295 km. We will call this source-detector configuration T2HK to distinguish T2HKK, the possible extension of this experiment in Korea that will use the same beam but it will be located at 1100 km from the source. We will briefly introduce the neutrino decay mode that can be classified in two types: one is what is called invisible decay , i.e. when neutrino decays into a sterile neutrino state plus a scalar particle, and the other is called visible decay, i.e. when neutrino decays into an active mass eigenstate plus a scalar particle. We will calculate the limit on the V3 lifetime for the invisible and the visible case for both configurations T2HK and T2HKK.

<p>This paper studies the structural issues concerning possible human rights violations found in the Dublin Regulation; An EU regulation aiming to allocate a responsible member state to a third-country-nationals asylum application. It is one of the criticized legal documents within the scholarly field of human rights. Hence, this study aims to study the details of the regulation to find out the elements of the regulation that are prone to human rights violations. Asking the question: What are some details of the Dublin Regulation that could potentially result in human rights violation of the third-country nationals seeking international protection within the territory of member states? Hence, exploring the gap found between the regulation and human rights of the asylum seekers. This was done by a normative legal analysis study of the law, studying the text of the regulation, relevant human rights law, and jurisprudence from two courts of law: ECHR and ECJ. The findings of the study highlights, first, the regulation upholds only the superficial elements of human rights law. Second, the regulation assumes that every member state is a safe country. Third, there is an imbalance of responsibility on either of the two or more member states involved. These are the details of the regulation highlighted in this study that is potentially the result of possible human rights violations and the criticism of the topic. </p>

Beyond the Standard Model Orders of Charge–Parity Violation

In dieser Arbeit verwenden wir Flavourinvarianten, um systematisch Lösungen für Probleme des Standardmodells (SM) der Teilchenphysik mit Hilfe verschiedener effektiver Feldtheorien (EFTs) zu untersuchen. In Teil I untersuchen wir die CP-Verletzung im SM und in der SM EFT erweitert mit leichten, sterilen Neutrinos. Wir konstruieren die erzeugende Menge von Flavourinvarianten im νSM, mit der jede Observable als Polynom der Invarianten, sowie die Bedingungen für die CP-Verletzung auf flavourinvariante Weise ausgedrückt werden können. Anschließend weiten wir die Ergebnisse auf die EFT-Wechselwirkungen für verschiedene Szenarien der Neutrinomassen aus. Hier ändert sich die Form der EFT-Flavourinvarianten und ihre Unterdrückung mit der Skala der neuen Physik drastisch mit der untersuchten Art der Neutrinomassen. In Teil II untersuchen wir verschiedene Aspekte der Symmetriebrechung in EFTs von axionartigen Teilchen (ALPs). Wegen ihrer pseudo-Nambu–Goldstone-Natur ist eine wesentliche Eigenschaft der ALPs ihre Shiftsymmetrie (ShS). Wir formulieren flavourinvariante Ordnungsparameter der ShS, die das Powercounting der EFT führender Ordnung bei einer leicht gebrochenen ShS korrekt implementieren lassen. Mit der Hilbertreihe zählen wir die Anzahl der Operatoren, die in der ALP EFT mit und ohne ShS oberhalb und unterhalb der elektroschwachen Skala auftreten, womit wir Operatorbasen konstruieren, die Beziehungen der ShS auf höhere Ordnung verallgemeinern und die CP-verletzenden Flavourinvarianten führender Ordnung konstruieren. Die Axionlösung des starken CP-Problems kann durch neue CP-Verletzung im Ultravioletten durch kleine Instantonen gestört werden. Mit einer SMEFT-Parametrisierung der neuen CP-Verletzung zeigen wir, dass neu konstruierte CP-verletzende SMEFT-Flavourinvarianten explizit in den Instantonberechnungen auftauchen und zur Systematisierung der Berechnungen verwendet werden können, wodurch wir bessere Limits für kleine Instanton- und Flavourszenarien ableiten. / In this thesis, we use flavour invariants to systematically study solutions to problems of the Standard Model (SM) of particle physics with different effective field theories (EFTs). In Part I, we study Charge–Parity (CP) violation in the SM and SM EFT extended with light sterile neutrinos. We construct the generating set of flavour invariants in the νSM allowing us to express any observable as a polynomial of those invariants. In addition, the invariants enable us to express the conditions for CP violation in a flavour-invariant way. We extend the results to the EFT interactions with different scenarios for the neutrino masses. Here, the form of the EFT flavour invariants and their suppression with the scale of new physics changes drastically depending on the nature of the neutrino masses. In Part II, we study different aspects of symmetry breaking in the EFTs of axionlike particles (ALPs). An essential property of ALPs is their shift symmetry (ShS) due to their pseudo-Nambu–Goldstone nature. We formulate flavour-invariant order parameters of ShS, which allow us to properly impose the power counting of the leading order EFT in the presence of a softly broken ShS. Using the Hilbert series, we count the number of operators appearing in the ALP EFT with and without a ShS above and below the electroweak scale. We use this information to construct operator bases, generalise the relations imposing ShS to higher orders and construct the leading order CP-odd flavour invariants. The axion solution to the strong CP problem can be spoiled by new CP violation in the ultraviolet in the presence of small instantons. Parameterising the new CP violation in the SMEFT, we show that newly constructed CP-odd SMEFT flavour invariants, featuring the strong CP angle, explicitly appear in the instanton computations and vice-versa that they can be used to systematise the computations. Using these results, we derive bounds on different small instanton and SMEFT flavour scenarios.

La question de la responsabilité de l’État sans faute du fait des engagements internationaux devant le juge administratif français est soumise aux évolutions jurisprudentielles. En 2011, le Conseil d’État a consacré la responsabilité de l’État sans faute des coutumes internationales. Cette consécration a provoqué un débat sur l’assimilation entre la responsabilité du fait des lois et la responsabilité du fait des conventions internationales. Pour le comprendre, il faut se tourner vers le passé: le régime de responsabilité du fait des conventions internationales inauguré avec l’arrêt Compagnie générale d’énergie radioélectrique. En 1966, le Conseil d’État a dépassé la problématique de la théorie des actes de gouvernement et a constitué un régime de responsabilité fondé sur le principe d’égalité devant les charges publiques. La règle de réparation est destinée à réparer non pas les dommages résultant directement de la convention, mais ceux causés par son application. Elle ne concerne que les dommages anormaux et spéciaux. Ce régime de responsabilité a été accepté dans des termes proches du régime de la responsabilité du fait des lois. Aujourd’hui, et avec l’évolution jurisprudentielle, une dissociation s’opère entre la responsabilité du fait des engagements internationaux et la responsabilité du fait des lois. Il semble possible de consacrer l’indépendance du régime de la responsabilité du fait des engagements internationaux de celui des lois. / The question of the state’s responsibility towards international engagements is subject to jurisprudential evolutions. In 2011, the Counsel of the State dedicated the responsibility without fault due to the international customs. These dedications provoked a debate about the founded assimilation between the responsibility of the acts of laws and the responsibility due to the international conventions. Concerning this, one must turn to the past: the system of responsibility based on the occurrences of international conventions inaugurated with the stop of the company of radio electric energy. In 1966, the Counsel of the State overtook the problem of the theory of government act and constituted a system of responsibility based on the principle of equality before the public charges. The rule of reparation is not destined to repair the damages directly resulting from the convention, but those caused by its application. It only concerns the abnormal and particular damages. This state of responsibility was accepted under the close terms of the system of responsibility on the acts of laws.Today and with the jurisprudential evolution, a disassociation operates between the responsibility of actions on international engagements and the responsibility of the acts of law. It seems possible to sanction independence from the system of responsibility of actions of international engagements and that of law.

Exploring the construction of white male identity in selected novels by J.M. Coetzee

Coetzee's own experience of living in apartheid South Africa provides the backdrop for novels infused with sardonic irony and rich metaphoric systems. In modes of metafiction that emphasize the destructive and violent nature of language, he optimizes his unique oeuvre to interrogate global, national and domestic power relations. This dissertation relies on psychoanalytical theories that examine microstructures of power within the individual, and in his domestic domain. Each of Coetzee's chief protagonists carries a secret related to a dysfunctional mother/son relationship. This hampers their psychosocial dynamics, their masculinity and sexuality. As they respectively strive toward an elusive new life they confront patriarchal power structures that speak on behalf of individuals, '[whose] descent into powerlessness [is] voluntary' (Coetzee 2007: 4-5). Coetzee's constructed white males perform their several identity roles in milieux that span divergent phases of colonial history. His critique points to white patriarchal hegemonic ideological discourses that bespeak the self/other dichotomy in a postcolonial world where the language of dominance supports an oppressive status quo. / English Studies / M.A. (English)

A mixed method research study on parole violations in South Africa

The researcher conducted a mixed method research study on parole violations from a South African perspective. In South Africa, there is limited research regarding the causes of parole violations. Thus, the study is mainly descriptive, but also exploratory in nature and considered a first of its kind. The study aimed to explore parole violation as a phenomenon through the perceptions, opinions, attitudes and incident recall of re-incarcerated parolees. Furthermore, the study aimed to describe the causes for parolees to fail on parole. A two-phase sequential mixed methods research design was used that involved the collection and analysis of primarily quantitative data from self-administered questionnaires. These questionnaires were complemented by a qualitative data collection phase consisting of focus group interviews. A representative sample (n=111) chosen according to the various ethnic groups was drawn from a population of 1 111 adult male parole violators in the Gauteng region (aligned to the regional divisions used by the Department of Correctional Services and not to the provincial borders) for the quantitative phase. Non-probability sampling was used to select 22 participants who volunteered for the second, qualitative phase of the study (focus group interviews). Descriptive statistical analysis was used to analyse the data collected from the questionnaires. The data was analysed by means of frequencies (frequency tables and graphs) to describe one variable and cross tabulations (contingency tables) to show bivariate quantitative data. All the focus group interviews were recorded and transcribed verbatim for analysis. The transcripts provided a complete record of the discussions and helped to facilitate the analysis of the data according to identified, recurring themes. On release, many stigmatised and rejected parolees face widespread post-release challenges that prevent successful reintegration. The study revealed that poor pre-release planning and post-release support, a lack of education, unemployment, substance abuse, and a loss of family support are described as the main causes of parole violations. The recommendations from the research findings showed the importance of pre-release planning, risk assessment, employment, education, treatment for drug and alcohol abuse, community partnerships, family involvement, and graduated responses to parole violations that are fair, consistent, and legal. / Penology / D.Lit. et Phil.
