[pt] Este estudo visa mostrar que a experiência de mulheres pobres e anônimas que se destacam por trabalhos sociais em suas comunidades pode nos revelar várias questões plurais dentro de um conjunto supostamente homogêneo. As mulheres escolhidas neste estudo se destacaram através da resistência individual, ou por não se submeter aos padrões sociais que tentam impedir sua inserção em espaços supostamente privilegiados, e da persistência em fazer de trabalhos sociais um caminho de luta rumo à conquista plena de seus direitos enquanto cidadãs. Talvez, ao final deste estudo, se consiga contribuir com a história social das Mulheres no Brasil. O jogo social de consentimentos e conflitos invisíveis que aparece na luta de poder entre as próprias mulheres raramente é exposto como nessa oportunidade em que mulheres pobres e faveladas têm de contar sua história. Para além da visão clássica da condição feminina que uniformiza mulheres e homens, este estudo pretende mostrar os deslocamento destas posições dicotômicas de gênero que englobam questões de raça / etnia, classe e geração. / [en] This study doesn't seek to portray histories of heroines and of executioners, but show that the women's experience can reveal us several plural subjects of a group supposedly homogeneous. The chosen women in this study, got if it highlights through the individual resistance in not submitting to the effective social patterns that try to impede their inserts supposedly in spaces privileged and of the persistence in doing a fight road of their social works heading for the full conquest of their rights while citizens. Maybe, at the end of this study, I get to contribute with the social history of the Women in Brazil putting in prominence the social game of consents and invisible conflicts that appear in the fight of power also among the own women, because rarely, the poor and slum dwellers women have the opportunity to count their history. For besides the classic vision of the feminine condition that it equalizes women and men, this study intends to show the displacement of these divided positions gender that include race / ethno, class and generation.

[pt] Esta dissertação tem por objeto de análise a rede de proteção social aos trabalhadores alocados na iniciativa privada. Objetiva desvelar os elementos de influência de tal rede sobre a construção das concepções de direitos sociais e cidadania por parte destes trabalhadores, na atualidade. Com o processo de retração do papel do Estado como provedor da assistência ao trabalhador, as empresas, através dos benefícios que compõem suas redes de proteção social privada, vêm suprindo esta lacuna. Tal movimento reafirma o conceito de cidadania regulada, na medida em que somente os seletos grupos de trabalhadores contemplados por tais benefícios têm acesso à saúde, alimentação e educação, em níveis considerados dignos e de qualidade. Paralelamente a este processo, constata-se, de um modo geral, o sucateamento dos mecanismos de prestação de bem estar social à população, especialmente em relação à saúde e à educação. Baseado em levantamento documental e bibliográfico, bem como em pesquisa de campo exploratória, que contou com uma amostragem de trabalhadores do sistema de Furnas Centrais Elétricas, o estudo demonstrou que as concepções sobre direitos sociais e cidadania, por parte dos trabalhadores pesquisados, sofrem influências da rede de proteção social privada à qual têm ou não acesso. Contudo, das entrevistas emergiu outro ponto de influência significativo, que diz respeito à fragmentação da classe-que-vive-do-trabalho, no universo pesquisado, que estabelece uma estreita ligação com o acesso daqueles trabalhadores aos benefícios disponibilizados pela empresa. Outro ponto relevante, apontado pelo estudo, diz respeito às fragilidades de organização destes trabalhadores, na atualidade, para que tais benefícios sejam de fato considerados como direitos conquistados e não como benesses ou mecanismos de formas de gestão empresarial com o objetivo de atingir maiores níveis de produtividade e de consenso. / [en] This work aims to analyze the social protection network of the private initiative workers. It has also as its objective to reveal some elements of influence of this network on the construction of the conceptions of social rights and citizenship by the workers. With the process of retraction of the State as a supplier of assistance to the worker, private companies, through the benefits that compose its nets of private social protection, are supplying this gap. This process reaffirms the concept of regulated citizenship in the sense that just a selected group of workers is contemplated for such benefits - and only this group has access to quality health, food and education. At the same time it is possible to point out the trashing of the mechanisms of the welfare state, especially in the cases of health care and education. Based in a documentary and bibliographical survey and also in a field research with a sampling of the workers of the Furnas Power Plants System, Brazil, this study demonstrated that the conceptions on social rights and citizenship, on the part of the searched workers, suffers influences from private network of social protection. However, the interviews had demonstrated another significant influence: the spelling of the class that lives of the work what establishes one strong linking with the access (or no access) of the works to the benefits of the company. Another interesting point is the fragility of organization of these workers in the present time. Because of this, these benefits are not considered rights but instead favors or mechanisms of enterprise management with the objective to reach greater consensus and productivity levels.

[pt] Considerada uma das áreas de maior empregabilidade para o assistente social, a saúde ao longo dos anos tem reservado um espaço de inúmeras produções acadêmicas na área. Essas produções trouxeram para a discussão do Serviço Social na saúde as atividades desenvolvidas pelos profissionais, o trabalho, a multidisciplinaridade e a integralidade das ações que, cotidianamente, podem promover ao usuário do serviço de saúde a possibilidade de acesso a outros direitos sociais. A área da saúde no Brasil passou por marcos de movimentos sociais, como o da Reforma Sanitária e a construção do Sistema Único de Saúde, que hoje se tornou um dos maiores exemplos da idealização e concretização de sistema de saúde pública. Um sistema que garante o acesso universal e acolhe os usuários sob a perspectiva de um conceito ampliado de saúde que compreende o bem estar físico, psicológico e social e interliga a saúde do sujeito a condicionantes como o trabalho, educação, assistência, saneamento básico e lazer, ou seja, outros direitos e benefícios sociais que complementam o atendimento integral ao usuário. Mas este SUS e toda a sua proposta de cuidado em saúde também foi diretamente atingido pelos reflexos de políticas de corte neoliberal e sofreu com as transformações que levaram ao sucateamento dos equipamentos e serviços, bem como da força de trabalho atuante nas unidades de saúde, dentre elas o assistente social. A discussão proposta nesta dissertação tem como objetivo abordar, através de uma análise crítica e construtiva da política de saúde e do espaço institucional da saúde, o trabalho desenvolvido por assistentes sociais de uma unidade de saúde pública de um hospital universitário do Rio de Janeiro, numa equipe multiprofissional. / [en] Considered one of the areas of bigger empregability for the social assistant, the health throughout the years has reserved a space of innumerable academic productions in the area. These productions had brought for the quarrel of the Social Service in the health the activities developed for the professionals, the work, the multidisciplinarity and the completeness of the actions that, daily, can promote to the user of the service of health the possibility of access to other social rights. The area of the health in Brazil passed for landmarks of social movements, as of the Sanitary Reformation and the construction of the Only System of Health that today became one of the biggest examples of the conception and concretion of system of public health. A system that guarantees the universal access and receives the users under the perspective of an extended concept of health that understands the welfare physicist, psychological and social and establish connection the health of subject to they establish conditions as the work, education, assistance, basic sanitation and leisure, that is, other social rights and benefits that complement the integral attendance to the user. But this SUS and all its proposal of care in health also directly was reached by the consequences of politics of neoliberal cut and suffered with the transformations that had taken to the trashing of the equipment and services, as well as of the force of operating work in the units of health, amongst them the social assistant. The quarrel proposal in this research has as objective to approach, through a critical and constructive analysis of the politics of health and the proper space of the institution of the health, the work developed for social assistants of a unit of public health of a university hospital of Rio de Janeiro, Brazil, inside of the multiprofessional team.

[pt] A presente dissertação aborda o tema da cidadania como um objeto de análise autônomo, complexo e historicamente definido. Com base no conceito de cidadania elaborado por T.H. Marshall e no referencial analítico de José Murilo de Carvalho, desenvolveu-se uma investigação acerca das dimensões política e social da cidadania no Brasil Contemporâneo. A partir de uma perspectiva histórica a respeito do processo de construção da cidadania no Brasil, sustentamos que a vigência concomitante dos direitos políticos e dos direitos sociais no contexto atual assume uma relação intrinsecamente dissonante, o que implica, de um lado, reconhecer a novidade desta convivência, ainda que não virtuosa, no curso histórico do Brasil republicano, e destacar, por outro lado, a natureza e o significado dessa dissonância para a realização da cidadania brasileira. Portanto, o objetivo principal consistiu em verificar o significado e a natureza da dinâmica entre as dimensões política e social da cidadania no contexto do Brasil Contemporâneo. A nossa contribuição consiste, neste sentido, em desenhar a moldura atual em que se encontram colocadas as dimensões da cidadania brasileira, bem como evidenciar o significado desta nova configuração para o alcance de uma cidadania plena no país. / [en] The present dissertation boards the subject of the citizenship like an autonomous, complex and historically definite object of analysis. On basis of the concept of citizenship prepared by T.H. Marshall and the analytical referential system of José Murilo of Carvalho, an investigation was developed about the political and social dimensions of the citizenship in Contemporary Brazil. From a historical perspective as to the process of construction of the citizenship in Brazil, it was supported that the concomitant validity of the political rights and of the social rights in the current context assumes an intrinsic dissonant relation, what it teases, from a side, to recognize the novelty of this contact, still that not virtuous, in the historical course of republican Brazil, and to make, on the other side, the nature and the meaning of this dissonance for the problem of the Brazilian citizenship. So, the principal objective consisted in checking the meaning and the nature of the dynamic one between the political and social dimensions of the citizenship in the context of Contemporary Brazil. Our contribution consists, in this sense, in drawing the current frame in which there are put the dimensions of the Brazilian citizenship, as well as showing up the meaning of this new configuration for the reach of a full citizenship in the country.

[pt] Trata-se de dissertação na qual se procura analisar criticamente a efetividade dos direitos sociais no Brasil, sob o duplo aspecto, jurídicoobjetivo, com ênfase às prestações, e os meios jurídicos colocados à disposição pela Constituição de 1988 para cumprimento dos deveres estatais nela consignados. O estudo se desenvolve a partir da trajetória dos direitos fundamentais nos modelos constitucionais que permearam o Estado liberal e o Estado social, passando pela análise de alguns conceitos-chave relacionados ao tema escolhido da estrutura e entraves à plena efetividade dos direitos sociais, culminando por fazer em exame da conjuntura atual do modelo de direito social, em termos de efetividade, no Brasil e nos sistemas global e regionais de proteção dos direitos humanos. / [en] This work intends to analyse the effectiveness of social rights in Brazil, under both points of view, the juridical- objective and the juridicalsubjective ones, emphasizing, about the last one, the existence of a subjective right and the juridical means set forth by the 1988 Constitution to accomplish the duties of State which this constitution comprehends. The study starts at the trajectory of fundamental rights in the constitutional models of the liberal State and the Social State, moving on the analysis of some key concepts related to the chosen subject and of the structure and difficulties to the real effectiveness of social rights, and ending with an exam of the current scenario of social rights model, in terms of effectiveness, in Brazil and in global and in regional systems of protection of human rights.

[pt] O presente estudo foi realizado na Universidade Aberta da Terceira Idade - UnATI/UERJ, tendo por objetivo compreender o significado do fenômeno da amizade, na perspectiva dos direitos, privilegiando a sua dimensão política, enquanto ação desenvolvida nos espaços público e privado, pelos idosos do Projeto Idosos Colaboradores, coordenado pelo Serviço Social, através de uma revisão da literatura e de uma pesquisa empírica realizada junto aos referidos idosos. A pesquisa foi desenvolvida através da metodologia qualitativa apoiada no estudo de caso, através do depoimento em entrevistas semi- estruturadas com idosos, na faixa etária entre 64 a 82 anos de idade. O presente estudo está baseado fundamentalmente na teoria política de Hannah Arendt. Os principais resultados revelam a grande importância da amizade para os idosos, cuja definição, características, dimensões, foram compreendidos de forma semelhante entre eles, que também valorizam a amizade como fonte de suporte social, associada ao bem estar subjetivo, ação solidária, fraternidade, direito e dever e ação no espaço público pelo diálogo franco, aberto e sincero de conteúdo diverso, inclusive sobre política. / [en] The present study was accomplished in the Universidade Aberta da Terceira Idade - UnATI/UERJ, tends for objective to understand the meaning of the phenomenon of the friendship, in the perspective of the rights, privileging your political dimension, while action developed in the spaces public and private, for the seniors of the Projeto Idosos Colaboradores, coordinated by the Social Work, through a revision of the literature and of an empiric research accomplished close to the referred senior. The research was developed through the qualitative methodology, leaning in the case study, through the deposition in interviews semistructured with seniors, in the age group among 64 to 82 years of age. The present study is based fundamentally in Hannah Arendt political theory. The principal results reveal the great importance of the friendship for the seniors, whose definition, characteristics, dimensions, they were understood in a similar way among them, that they also value the friendship as source of social support, associated to the good to be subjective, solidary action, fraternity, right and to owe and action in the public space for the dialogue frank, open and sincere of several content, besides on politics.

[pt] O presente trabalho apresenta um estudo sobre a eficácia dos direitos sociais no Brasil, em especial os direitos a prestações e a justiciabilidade desses direitos perante o poder judiciário. O abismo existente entre o ideal de transformação da Constituição Federal de 1988 e a inércia demonstrada pelos costumes políticos e sociais na história recente de nosso país ressaltam o quanto o Estado e a sociedade estão falhando ao garantir as condições mínimas de existência humana digna, sem as quais se torna inviável o gozo e a fruição dos direitos fundamentais, frustrandose a efetividade da maioria das normas constitucionais. Este estudo se inicia pela análise da trajetória dos direitos fundamentais até o seu reconhecimento e positivação na Constituição Federal de 1988, passando-se em seguida, à análise dos direitos sociais como direitos fundamentais, sua aplicabilidade e os limites à eficácia dos direitos a prestações, reunindo elementos que possam justificar a crescente atuação do poder judiciário, em especial do Supremo Tribunal Federal no cenário econômico e social, na medida em que se tem atribuído a ele um novo papel no quadro da Separação de Poderes, qual seja, atender à tarefa de realização dos direitos sociais que compete, primariamente ao legislativo e ao executivo. As fontes de pesquisa são doutrinárias, além do estudo de algumas normas constitucionais pertinentes ao tema do trabalho e de jurisprudência selecionada principalmente nos julgados do Supremo Tribunal Federal. / [en] This work presents a study on the efficacy of social rights in Brazil, in special the rights to benefits and justiciability in front of judiciary. The lack between the ideal transformation of Federal Constitution of 1988 and the tendency of do not change shown by political and social values in the recent history of our country highlights how much the State and the society are weakened to support the minimum conditions to the existence of human dignity, without which becomes impossible enjoy the fundamental rights, frustrating to the effectiveness of most constitutional rules. This study bigins by the analysis of the fundamental rights trajectory until its recognition on the Federal Constitution of 1988, going through the analysis of social rights as fundamental rights, their applicability and limits the efficacy of rights to benefits, grouping elements that can justify the increasing role of Judiciary, especially the Supreme Court in the economic and social set, according to his new role into the Separation of Powers, that is, comply with realization of social rights that belongs first to the legislature and the executive. The research sources are doctrinal, besides the study of some constitutional rules relevant to the theme and the jurisprudence selected mainly on the judged from the Supreme Court.

[pt] O surgimento do Capitalismo produziu uma sociedade segmentada entre classes sociais, que em razão do conflito de interesses instaurou no seio social as lutas entre os proprietários dos meios de produção e o proletariado. O embate derivado desse conflito consubstanciou conquistas históricas determinantes das bases políticas e adventos de novos direitos. Se por um lado, a ideologia capitalista adentrou à atividade Estatal, fazendo com que as decisões políticas fossem tomadas em seu favor, de outro, o abandono das questões sociais acirrou a luta de classes. No contexto das crises cíclicas do Capitalismo, o Estado Liberal necessitava retroceder. O reconhecimento de direitos a classe trabalhadora era necessário a sua própria estabilidade, determinando a mudança do seu paradigma em Estado Social. O advento dos direitos sociais, como resultado desse acirramento, foi resultado desse retrocesso liberal, que determinado pelo embate das lutas de classes, garantia a diminuição da distância promovida entre elas. O direito educacional emergiu como um dos principais fatores responsáveis por essa diminuição, que em razão da dilatação da concepção da cidadania, criou um complexo de interação entre elas e fortaleceu as bases democráticas, geradora de uma nova concepção de participação no poder político do Estado. Diante dessa interdiciplinariedade entre Política e Direito, instâncias participativas, como o Orçamento Participativo, têm assumido grande importância na efetivação dos direitos sociais, diminuindo o traço de dependência econômica e ideológica entre as classes sociais existentes. / [en] The emergence of capitalism has made a divided society between social classes, which on grounds of conflict of interest brought within the social struggles between the owners or the means or production and the proletariat. The shock derived of this conflict has created historical politics conquests and new rights for the people. Thus, the capitalist production engaged to his State activity, taking the politics decisions on its favor, the abandonment of social issues increase the struggles of classes. In the context of the cyclical crises of capitalism, the State Liberal needed go back. The recognition or rights the working class was needed its own stability, determining the change of its paradigm on Social State. The advent of social rights as a result of that increasing was a result of this liberal backlash, which determined by the clash of the struggles of classes, guarantee the reduction of the distance between them promoted. The educational right emerged as one of the main factors responsible for that decline, owing to the expansion fo the concept of citizenship, has created a complex interaction between them and strengthened the democratic foundations, creating a new design for participation in the political power of the State. Given this relation between politic end law, participatory for such as the Participatory Budget (Orçamento Participativo), have assumed great importance in the effectiveness of social rights, reducing the trace or ideological and economic dependence between social class exist.

[pt] O presente trabalho tem, por fim, analisar o procedimento de regularização fundiária como um instrumento de defesa do direito social à moradia no espaço urbano. Nesse sentido, serão apresentados o conceito e a evolução teórica do direito social à moradia, bem como as tensões sociais que contribuíram para a sua previsão atual. Para além, será apresentado o conceito de regularização fundiária sob uma interpretação plena, seus instrumentos de aplicação e sua competência para se verificar como um importante aliado na luta pela concretização do direito à moradia. Por fim, serão apresentadas as razões para que se defenda uma política pública ampla e contínua de regularização fundiária no espaço urbano brasileiro. / [en] This paper is headed to the analysis of the procedure of land regulation as an instrument for the defense of Social Right of Housing in Urban Space. To reach that point, it will be presented the concept and the historical evolution of the social right of housing, as well as social tensions that contributed for present prevision. Beyond that, it will be presented the concept of land regulation under a wide sense interpretation, its applying instruments and its talent as an important alliance in the struggle for fulfilling the right of housing. At last, it will be presented the reasons by which it is needed the defense of a wide and continuous land regulation public policy in brazilian urban space.

[pt] O presente trabalho visa a examinar, por meio de uma abordagem analítica, a trajetória da cidadania e sua materialização em termos de políticas sociais, no contexto da América Latina e de sua conjuntura política e social contemporânea, como contraponto aos modelos clássicos desses conceitos. Desta maneira, será problematizada a efetivação da cidadania social, enquanto elemento da noção de cidadania ampliada. Para tanto, será necessário identificar as ligações entre o pano de fundo histórico, político e social da cidadania moderna e seu desenvolvimento teórico. Isso servirá de marco para a análise da incorporação desse conceito na prática política da América Latina, e a compreensão dos significados dos déficits de efetivação da cidadania social em termos democráticos. Tal demonstra a relevância da escolha do tema ante as acentuadas desigualdades verificadas atualmente na região. Nas conclusões, serão agrupadas as problematizações extraídas das análises feitas ao longo da pesquisa e apresentadas novas questões que permanecem em aberto e demandam futuras reflexões. / [en] This research intends to examine, through an analitical approach, the path of citizenship and its implementation in terms of social policies, in the context of Latin America and its contemporary political and social conjuncture, as a counterpoint to the classical models of these concepts. Therefore, in order to present questions about social citizenship efetivation, considered as an element of the enlarged citizenship notion. For this, it will be necessary to identify the conections between the historical, social and political background of the modern citizenship and its theoretical development. Thus, it will be applied as a landmark to analyse the insertion of this concept in Latin American political practice and in the comprehension of the deficit´s of execution meanings of the social citizenship, in a democratic sense. So, the afore mentioned shows the subject´s choice relevance in view of the extremed inequalities identified nowadays in the region. Moreover, during the conclusion, it will be gathered the problems extracted from the analysis made throughout the research and news questions will be launched to demand future reflection.
