Viewing the expressions of contemporary social issues, there is also a reflection on the science role now, approaching ideological expressions and its implications in the adopted methodologies. The reflections on instrumentality, teleology and professional ethics were inherent to the research sequence. In addition, this research is guided by an ideopolitical horizon. This set of elements appears in the lines, which support this analysis. In relation to the field research, jurisprudential cases were elected, in which conformed conflicts are expressed in a civil action. Among the cases judged in ten years (1991 to 2001), an intentional sample with significant cases was extracted. Eight cases were wholly studied and three cases presented in detail due to their complexity and for the study relevance. It is affirmed that law professionals acknowledge the importance of the social worker performance because it supplies them with data to support their performance, so the research brought up the elements used in this way. Also, oriented through a criticalpropositive prospective, it identified some fragilities. Therefore, the study makes evident some clues for a professional exercise that contributes for not only law enforcement, but also mainly for decisions which are the most beneficial in order to bring into effect social justice and rights / A partir do conhecimento acumulado sobre a atuação do assistente social junto ao Poder Judiciário, a pesquisa buscou levantar a contribuição deste profissional nos casos relacionados ao direito da criança e do adolescente. Frente às expressões da questão social contemporânea, também refletiu sobre o papel da ciência na contemporaneidade, abordando as expressões ideológicas e suas implicações nas metodologias adotadas. As reflexões sobre instrumentalidade, teleologia e ética profissional foram inerentes ao percurso da pesquisa. Há, inclusive, um horizonte ideopolítico que orienta este pesquisar. Esse conjunto de elementos se mostra nas linhas de sustentam esta análise. Para a pesquisa de campo, elegeram-se casos jurisprudenciais, em que se expressam conflitos conformados num processo judicial. Do conjunto de casos julgados em dez anos (1991 a 2001) extraiu-se uma amostra intencional, com casos significativos. Numa reavaliação, oito casos foram estudados integralmente e três casos apresentados em detalhes, por sua complexidade e sua relevância para o estudo. Afirma-se que os operadores do Direito reconhecem a importância do trabalho do assistente social para subsidiar sua atuação, e a pesquisa, então, levantou os elementos que foram utilizados com esse fim. Pautado num olhar crítico-propositivo, identificou algumas fragilidades. Assim, o estudo evidencia algumas pistas para um exercício profissional que contribua não apenas para a aplicação das leis, mas, principalmente, para que as decisões sejam as mais benéficas para a efetivação de direitos e da justiça social

Working with this theme enables understanding of the conceptions of men and of professional world, built through their experiences, of determinant cultural aspects that are part of their choices and their daily professional actions in socialinstitutional places, through the used language. The language understood in this research as the materiality of conscience, product of social relationships and personal, and professional, experiences. Experiences understood from its historicity and as a result of professional relationships. The methodology of Oral History was a key part in this research, once it looks for historicity and for experience, bringing the subject of this matter to the investigation's center. Working with testimonials related to life's history of subjects, their professional and personal experiences, allowed me to understand how social workers build language in professional exercise. Using Oral History's methodology it was possible to search for the meaning that social works assign to their social practices bound with language that is daily built. When raising the memory, through oral history, I understood the construction of professional language as a historic process filled with movement and transformations. One important aspect regarded in this essay was the relation of professional language and the ethical-political project of Social Service, the professional language reveals this project, as it shows evidence that these projects are in dispute, amongst each other and in institutional spaces, once, when hiring a social workers, the employer prescribes its duties, in this sense, many times, it may, confront the professional project with the institutional project. So the language, fruit of experience, of historical, social and cultural determinations, builds its own place, as a form of existence and resistance, a strategy. This autonomous place where experience is in a special place, as a knowledge producer / A presente dissertação tem como objetivo principal compreender a construção da linguagem profissional dos assistentes sociais e sua relação com a consciência, cultura e experiência. Trabalhar com esta temática possibilita compreender as concepções de homem e de mundo dos profissionais, construídas através de suas experiências, dos determinantes culturais que compõem suas escolhas e da sua ação profissional efetivada no cotidiano dos espaços sócio-institucionais, por meio da linguagem utilizada. Linguagem compreendida nesta pesquisa como materialidade da consciência, produto das relações sociais e das experiências profissionais e pessoais. Experiências compreendidas a partir de sua historicidade e como resultado das relações sociais profissionais. A metodologia de História Oral foi fundamental nesta pesquisa, uma vez que, busca pela historicidade e pela experiência trazendo o sujeito ao centro da investigação. Trabalhar com depoimentos relacionados à história de vida dos sujeitos, suas experiências profissionais e pessoais, permitiu-me compreender como os assistentes sociais constroem a linguagem no exercício profissional. Por meio da metodologia de História Oral foi possível buscar os significados que os assistentes sociais atribuem as suas práticas profissionais vinculadas às linguagens construídas no cotidiano. Ao suscitar a memória, por meio da História oral, compreendi a construção da linguagem profissional como processo histórico repleto de movimentos e transformações. Um aspecto importante abordado nesta dissertação foi a relação da linguagem profissional e o projeto ético-político do Serviço Social, a linguagem profissional revela este projeto, assim como evidencia que estes projetos estão em disputa, entre si e nos espaços institucionais, uma vez, que ao contratar o assistente social o empregador prescreve suas atribuições; neste sentido pode, muitas vezes confrontarem-se os projetos profissionais e os projetos institucionais. The study focalizes the constituent elements of the political ethical project professional, that keeps it narrows relationship with the beginnings that base the current Code of the social worker Professional Ethics considering the scenery of transformations by which goes the Brazilian society (immersed in the background of 'globalization') Determinations are macroeconomic and socio-political posing the Service to the test, as far as social demands and political outlook, since social policies represent broad occupational area of the profession. The approach on the rights of children and youth population, is the movement that led to the Statute of the Child and Adolescent - SCA, incorporating it into its doctrinal foundations. Among the rights and the need for 'resistance' training before the cross' global ', stands out in this study that the Service, through the representative bodies of the category in its deliberative body - the National Meetings CFESS / CRESS, is present and active in defending the rights of children and adolescents. O estudo aborda os elementos constitutivos do projeto ético político profissional, que guarda estreita relação com os princípios que fundamentam o atual Código de Ética Profissional do Assistente Social considerando o cenário de transformações pelo qual passa a sociedade brasileira (imersa no panorama de globalização ). São determinações macroeconômicas e sóciopolíticas que colocam o Serviço Social à prova, no que tange as demandas sociais e perspectivas políticas, visto que as políticas sociais representam amplo espaço ocupacional da profissão. A abordagem sobre os direitos da população infanto-juvenil, corresponde ao movimento que originou o Estatuto da Criança e do Adolescente ECA, contemplando-o em suas bases doutrinárias.Dentre os direitos e a necessidade de resistência profissional diante da cruzada globalizante , destaca-se neste estudo que o Serviço Social, através das entidades representativas da categoria em sua instância deliberativa os Encontros Nacionais CFESS/CRESS, se faz presente e atuante na defesa dos direitos da criança e do adolescente. In order to make it happen, a investigative path has been ridden on Education and social service altogether. In this theses I try to explore the limitations and possibilities as to critical and ethical social workers are majored, highlighting academician role in the information process, taking into account the ethical-political project and its ethical code as a craft as well. One of the major promises in which the research has its heart on, is a acknowledgement that the social worker as a social services majoring academician needs some knowledge from teaching to exercise this practice, for only professional exercise doesn t make them eligible for such. To perform such research it was necessary to study a graphic learning process for the Social Services graduates in its completion comprehending the ground rules and peculiarities of this process. For such, it has been searched as a Universe of research the Universidade Estadual de Londrina, PR, the social work majoring course. The aim of researching the academician professional exercise in graduation level in social services from UEL/ PR, had been reaching and yet, knowing the requirements which are made for those professionals, concerning the determiners and peculiarities of this kind work detect as the teaching/learning process has been happening to the Social services majoring undergraduates. In closing the thesis, considerations are composed retrieving the limitations and mostly the possibilities held in the concrete reality on the daily basis, in school vicinity, where soon-to-be social workers are majored, highlighting some purposes in a sense of collaborating with such category. Directing enabling actions to enhance the social worker majoring as a permanent challenge / A presente tese tem como tema O processo de formação profissional do assistente social: desafio permanente, cujo problema foi o de investigar a atuação docente nesse processo. Para sua realização foi percorrida um trajetória investigativa sobre Serviço Social e a Educação. Nesta tese procuro explorar os limites e possibilidades para que se formem assistentes sociais críticos e éticos, destacando o papel docente no processo de formação, tomando por base o Projeto ético político de profissão e o seu Código de Ética. Um dos principais pressupostos no qual a pesquisa se apoia é o reconhecimento de que o assistente social enquanto docente do curso de Serviço Social necessita de conhecimentos de natureza didática e pedagógica para exercer essa prática, pois só o exercício profissional não o qualifica para isso. Para realização da pesquisa buscou-se conhecer o processo de ensino aprendizagem dos alunos de graduação de Serviço Social na sua concretude, compreendendo as determinações e as particularidades deste processo. Para tanto buscou-se como universo de pesquisa o curso de Serviço Social da Universidade Estadual de Londrina-PR. O objetivo de pesquisar a prática profissional docente do professor do curso de graduação em Serviço Social da UEL/PR, foi alcançado conhecendo-se ainda as requisições que são postas para estes profissionais, compreendendo os determinantes e as peculiaridades deste tipo de atuação, detectando como tem ocorrido o processo de ensino-aprendizagem dos alunos do curso de Serviço Social. Sempre s’havia pensat que el concepte religiós i el concepte esportiu pertanyien a dues esferes excloents de la vida de l’ésser humà, dos conceptes vitals contraposats: la vida de l’espiritualitat i la de l`ànima, en contraposició amb una concepció més corpòria de la vida. Per tant, l’atleta de l’esperit i l’atleta del cos no podien conviure plegats en el recorregut vital de les persones. L’aparició del cristianisme, com una escissió del judaisme, es va trobar fortament impregnada d’elements de la cultura clàssica helenística. Com a fil conductor de la tesi doctoral ens centrarem en el pensament de Pau de Tars, cap visible de la comunitat cristiana d’Antioquia. A les seves cartes pastorals va emprar un estil metafòric impregnat d’elements que provenien de la concepció esportivo-afonística que va caracteritzar la “paideia” grega, un mètode pedagògic que unia el desenvolupament de l’intel.lecte amb les pràctiques físico-esportives com a únic camí per a aconseguir la virtut. Creiem que l’herència clàssica al pensament de l’Apòstol quant a la seva concepció agonística de la vida pot incidir de manera positiva en el món del futbol formatiu. Aspectes com l’ascetisme, la negació dels ídols, la professió de fe paulina centrada en l’existència d’un únic Déu han estat alguns dels elements que hem pogut comparar amb el món del futbol contemporani. Les anomenades metàfores esportives paulines centraven un discurs on es feia una crida a la lluita, a l’esforç i a la cooperació que serien presents a la difícil vida dels primers cristians. Atenent a aquests supòsits, en el treball doctoral s’estableixen un seguit de principis axiològics derivats de l’essència del missatge epistolar de Pau i que poden ser utilitzats en la millora de la pedagogia esportiva del futbol fins al punt de poder establir un codi ètic, que pugui ser útil en el terreny de les escoles formatives i també com a eina vàlida per als educadors d’aquest esport. Els elements que van caracteritzar el “corpus paulinum” han estat comparats, en aquest treball, amb trets que es produeixen en el futbol actual. D’igual manera que l’Apòstol aconsellava les comunitats cristianes, podem extrapolar aquest missatge per tal d’aconseguir un esport més pur, on el “fair play” esdevingui un dels elements que el defineixin. En els darrers anys, el futbol ha assolit una dimensió extraordinària, fins al punt que podem afirmar que ha esdevingut un substitut de la religió. El naixement mateix del futbol ens traslladaria a l’àmbit d’allò religiós, perquè quan va aparèixer, durant l’època victoriana anglesa, pedagogs com ara Thomas Arnold van proposar un nou sistema educatiu recuperant aspectes de l’antic mètode clàssic d’educació. Així doncs, les pràctiques esportives (com a element complementari i necessari al curriculum escolar) van tornar a prendre volada després de romandre durant segles a l’oblit. En l’aparició del futbol, remarquem el paper de l’Església anglicana, que (de la mà del cardenal Newton) va potenciar el futbol com a element terapèutic per a la classe obrera industrial i també com a mecanisme d’evangelització. El discurs que abans era propi d’allò sagrat s’ha instal.lat actualment en el món profà, i més concretament en el món del futbol; d’aquesta manera, aspectes com ara la salvació, la resurrecció, els miracles i els precs han entrat a formar part del context esportiu. Considerant tots aquests supòsits, a la present tesi doctoral es realitza un acurat estudi comparatiu dels ritus i dels símbols característics del context religiós cristià i la seva relació amb el món del futbol contemporani. La religió com a fet cultural fa referència a un fet humà complex i específic, un conjunt de sistemes de creences, de pràctiques, de símbols i d’estructures socials, a través de les quals l’ésser humà viu la seva relació amb el món d’allò sagrat. En reemplaçar el fet religiós, el futbol contemporani ha assumit bona part d’aquestes pràctiques en un context profà. / El concepto religioso y el concepto deportivo siempre se había pensado que pertenecían a dos esferas excluyentes de la vida del ser humano, dos conceptos vitales contrapuestos. La vida de la espiritualidad y del alma en contraposición a la concepción más corpórea de la vida. Así pues, el atleta del espíritu y el atleta del cuerpo no podían convivir juntos en el recorrido vital de las personas. La aparición del cristianismo, como una escisión del judaísmo, estuvo fuertemente impregnada de elementos de la cultura clásica helena. Como hilo conductor de la tesis doctoral nos centraremos en el pensamiento de Pablo de Tarso. Cabeza visible de la comunidad cristiana de Antioquia. En sus cartas pastorales utilizó un estilo metafórico impregnado de elementos que provenían de la concepción deportivo-agonística que caracterizó la paideia griega. Un método pedagógico que unía el desarrollo del intelecto con las prácticas físico-deportivas como único camino para alcanzar la virtud. La herencia clásica en el pensamiento del Apóstol en cuanto a su concepción agonística de la vida creemos que puede incidir de manera positiva en el mundo del fútbol formativo. Aspectos como el ascetismo, la negación de los ídolos, la profesión de fe paulina centrada en la existencia de un sólo dios han sido algunos de los elementos que hemos podido comparar con el mundo del fútbol contemporáneo. Las llamadas metáforas deportivas paulinas centraban un discurso donde se apelaba a la lucha, al esfuerzo y a la cooperación que debían de estar presentes en la difícil vida de los primeros cristianos. Atendiendo a estos supuestos en el trabajo doctoral se establecen una serie de principios axiológicos derivados de la esencia del mensaje epistolar de Pablo y que pueden ser utilizados en la mejora de la pedagogía deportiva del fútbol hasta el punto de poder establecer un código ético, que pueda ser útil en el terreno de las escuelas formativas y también como herramienta válida para los educadores de este deporte.Los elementos que caracterizaron el corpus paulinum han sido comparados en el trabajo con rasgos que se producen en el fútbol actual. De la misma manera como el Apóstol aconsejaba a las comunidades cristianas podemos extrapolar dicho mensaje en aras a conseguir un deporte más puro donde el fair play se convierta en uno de los elementos que lo definan. El fútbol, ha alcanzado en los últimos tiempos una dimensión extraordinaria, hasta tal punto, que podemos afirmar que se ha convertido en un sustituto de la religión. El mismo nacimiento de este deporte nos trasladará al ámbito de lo religioso, pues su aparición durante la época victoriana inglesa, donde pedagogos como Thomas Arnold propusieron un nuevo sistema educativo retomando aspectos del antiguo método clásico de educación. Así pues, las prácticas deportivas como un elemento complementario y necesario en el currículo escolar volvieron a alcanzar una gran dimensión después de siglos en el olvido. En este nacimiento del fútbol destacamos el papel relevante de la iglesia anglicana, que de la mano del cardenal Newton potenciaron el fútbol como elemento terapéutico para la deprimida clase obrera industrial y también como un mecanismo de evangelización de la misma. El discurso propio de lo sagrado actualmente se ha instalado en el mundo profano, concretamente en el mundo del futbol, de esta manera aspectos como la salvación, la resurrección, los milagros y los rezos han entrado a formar parte del contexto deportivo. Atendiendo a estos supuestos en la tesis doctoral se hace un minucioso estudio comparativo de los ritos y símbolos característicos del contexto religioso cristiano y su relación con el mundo del fútbol contemporáneo. La religión como hecho cultural se caracteriza por partir del supuesto que el término designa un hecho humano complejo y específico, un conjunto de sistemas de creencias, de prácticas de símbolos y de estructuras sociales a través de las cuales el ser humano vive su relación con el mundo de lo sagrado. El fútbol contemporáneo ha sustituido al hecho religioso. Las prácticas del ser humano actual van dirigidas hacia el mundo de lo profano, hacia el mundo del fútbol. / The religious concept and sporty concept had always thought they belonged to two areas exclusive of human life, two conflicting vital concepts. The life of spirituality and the soul as opposed to the bodily conception of life. Thus the spirit of the athlete and the athlete's body could not live together in the life journey of the people. The emergence of Christianity as a splinter group of Judaism, was strongly imbued with elements of classical Hellenic culture. As the central theme of the doctoral thesis will focus on the thought of Paul of Tarsus. Visible head of the Christian community of Antioch. Based on these assumptions in the dissertation establishes a series of axiological principles derived from the essence of the message of Paul and letters that can be used in improving the teaching soccer sports so much to establish an ethical code that can be useful in the field of training schools and also as a valid tool for educators of this sport. The elements that characterized the Pauline corpus have been compared in working with features occurring in football today. In the same way as the Apostle advised the Christian community we can extrapolate the message in order to get a pure sport where fair play to become one of the elements that define it. Football has recently reached an extraordinary dimension to such an extent, we can say that it has become a substitute religion. The very birth of this sport will take us to the realm of religion, since its emergence in Victorian England, where teachers like Thomas Arnold proposed a new education system aspects of the former returning to the classical method of education. So, sports practices as complementary and necessary in the school curriculum again reached a large size after centuries of oblivion. In this birth of football highlight the important role of the Anglican Church, which the hand of Newton boosted Cardinal football as a therapy for the depressed industrial working class and also as a means of evangelization itself. The discourse of the sacred itself has now been installed in the secular world, particularly in the world of football, so things like salvation, resurrection, miracles and prayers have become part of the sporting context. Based on these assumptions in the doctoral thesis is a thorough comparative study of the rites and symbols of Christian religious context and its relationship to the world of contemporary football. Religion as a cultural phenomenon is characterized by the assumption that the term designates a specific complex human fact, a set of belief systems, symbols, practices and social structures through which human beings live their relationship with the sacred world. The contemporary football has replaced the religious fact. The current human practices are directed towards the world of the profane, to the world of football.

This paper shows a mismatch between a real and pressing demand for a philosophical analysis that allows us to explain the emergence of new phenomena in law, and the limited supply of theoretical tools to satisfy this demand by the traditional model of positivistic science of law. After an initial diagnosis of a mismatch between supply and demand, the resistance of legal positivism to accept practical rationality stands out as a core problem of the traditional model of positivistic science of law and the viability of this way of rationality is defended. The paper concludes with a proposal for the reinvention of the philosophy of law of the 21st century that incorporates new objectives and rethinks its method. / En este trabajo se constata un desajuste entre una demanda real y acuciante de un análisis filosófico que permita dar cuenta de la irrupción de nuevos fenómenos en el panorama del derecho y la limitada oferta de herramientas teóricas con que satisfacer esta demanda que aporta el modelo tradicional de ciencia positivista del derecho. Tras el diagnóstico inicial de desajuste entre la oferta y la demanda, se destaca como un problema medular del modelo tradicional de ciencia positivista del derecho su resistencia a asumir una racionalidad de tipo práctico y se defiende la viabilidad de esta forma de pensamiento. El trabajo concluye con una propuesta para la reinvención de la filosofía del derecho del siglo XXI, redefiniendo sus objetivos y replanteando su método.

This work has as an objective to check if in a relation among people supported for ethics and trust improves the employee´s performance in the company. It presents a fundamental bibliographic review about ethics and trust, aiming to give a sustainability theorical contribution. It offers a concept’s view based in the organization: professional ethics, organizational ethics, the ethical company, code of practice, organizational culture and ethics background, the importance of trust and the cognitive trust, as well as a general prospect between the difference, the concept and the history of ethics and moral. In this work, positive and negative aspects that ethics and trust create to the organizations are mentioned. Some discussions were elaborated trying to extend the traditional concepts inside the organizations. To study the thesis central hypothesis, that is to check if the existence of ethics and trust among people promotes an adequate organizational environment, resulting in an improvement of employee´s performance,the theorical reference offered a direction in the questions elaboration. It was made a research with professionals that work in Grande São Paulo´s enterprises. It was stipulated patterns scores, in which the results were submitted and analysed. These results suggests that the people who answered this research believe, in a moderated way, that the existence of ethics and trust among coworkers, results in an improvement of employee’s performance.I must emphasize the mentioned authors affirmations, the contributions that ethics and trust bring to the organizations. The thesis still points the study’s limitations, and suggests ways to be explored by new researches in this field. / O interesse pelo tema foi motivado pelo debate sobre questões éticas em todas as áreas de atividade das organizações e pela atenção dada à confiança em contextos organizacionais. Esta Tese tem por objetivo verificar se uma relação entre as pessoas apoiada na ética e na confiança promove uma melhora no desempenho do empregado nas organizações. O trabalho apresenta uma revisão bibliográfica dos fundamentos sobre ética e confiança, visando uma contribuição teórica para esses conceitos. Oferece um panorama desses conceitos com vistas à organização: a ética profissional, a ética na organização, a empresa ética, o código de conduta, a cultura organizacional e o clima ético, a importância da confiança e a confiança cognitiva. Faz também um resgate histórico, aborda os conceitos e as diferenças entre ética e moral. Na Tese são levantados os aspectos positivos e negativos que a ética e a confiança geram para as organizações. Algumas discussões foram elaboradas com a finalidade de ampliar os conceitos tradicionais dentro das organizações. O referencial teórico proporcionou um direcionamento na elaboração das questões da pesquisa para estudar a hipótese central da Tese, que é verificar se a existência de ética e da confiança nas relações entre as pessoas promove um clima organizacional adequado, resultando em uma melhora no desempenho dos empregados. Foi realizada uma pesquisa com profissionais que atuam em empresas localizadas na Grande São Paulo. Foram estipulados escores padronizados, em que os resultados foram submetidos e analisados. Estes resultados da pesquisa sugerem que os respondentes acreditam, de forma moderada, que a existência de ética e de confiança nas relações interpessoais na empresa resultam em uma melhora no desempenho dos empregados. Merecem destaque as afirmações feitas pelos autores citados, das contribuições que a ética e a confiança trazem para as organizações. A Tese ainda aponta as limitações do estudo e sugere caminhos a serem explorados por novas pesquisas na área.
