The economy of knowledge in migration policy : Understanding Georgia's migration policy within the modern world system

The study aims to analyze Georgia's Migration Strategy 2021-2030 and its elaboration process within a multi-stakeholder format. The Strategy along with the annual action plans and a logic framework, sets a state policy on migration. The development of migration policy and cohesive field management is a novel and largely understudied phenomenon in the local context. It also falls beyond the general research focus of migration policies within the Western liberal democracies. In addition, conditions related to Georgia's specific location, introduced by the thesis, give relevance to studying the contemporary manifestation of migration in the state policy. The research is interested in the knowledge paradigms and its sources that form the policy, and their role in creating salience of certain topics, while muting others. The research uses an ethnographic method and a poststructural policy analysis to interrogate the strategy and its development process. The results are assessed with the use of a conceptual framework assembled from Brown and Balibar's theorization of relationship between neoliberalism and democracy, and its consequent impact on democratic governance. The findings reveal the prominence of neoliberal rationality as a political and normative form of reason and display some of its sources of power. In this process, best practices function as perceived neutral forms of knowledge and further carry a legitimizing effect due to their intrinsic contingency on the European geopolitical space. In overall, the results reveal a certain 'disorganic' development of migration policy, dislocated from Georgia's historical and contemporary realities.

In light of recent persuasive appeals which promote a food product's health or nutritional benefits in advertisements, this exploratory study investigates the ways in which individuals read and understand health and nutrition-related claims in advertising and make subsequent judgments about the product, brand, and purchase intentions. Using the Elaboration-Likelihood model of persuasion, this study looks at how motivational (e.g., health consciousness, need for cognition) and ability (nutrition knowledge) factors influence attitudes toward three food products following exposure to manipulated advertisements containing a nutrition-related claim. Although the results do not demonstrate much support for the predicted relationships, the findings nonetheless provide researchers useful information that may benefit future studies. / Master of Arts

Contribution à l'étude de la propriété des créances / Contribution to the study of property claims

Sous l'effet de l'utilisation répétée de la notion de propriété des créances par le législateur et par les juridictions, l'urgence de l'élaboration d'une théorie de la propriété des créances apparaît. Or ce sujet suscite encore controverses, réserves, interrogations et incertitudes. L'alliance de la propriété et des créances apparaît souvent comme une hérésie. En effet, la notion de propriété des créances est généralement condamnée, non seulement parce que la propriété des biens corporels est considérée comme la seule propriété authentique, mais aussi parce qu'elle semble s'intégrer difficilement dans la distinction traditionnelle des droits réels et des droits personnels. Pourtant n'est-il pas logique de se poser la question de savoir si cet usage réitéré de l'expression « propriété des créances » ne constitue qu'un dérapage linguistique sans portée réelle, ou s'il s'agit de l'expression d'une réalité qui se serait manifestée par le vecteur du langage ? La condamnation doctr inale de la propriété des créances ne repose-t-elle pas sur des présupposés théoriques ? Le principal enjeu de cette thèse consiste à se prononcer sur la possibilité théorique de la notion de propriété des créances. Peut-on juridiquement employer le terme propriété, dans son sens technique, pour désigner la relation qui unit le créancier à sa créance, ou bien s'il faut s'en tenir à la notion de titularité ? Au vrai, cette question de l'existence du concept de propriété des créances est primordiale car elle est aussi préjudicielle à celle de la protection de la créance par le biais du droit de propriété. Une fois l'adaptation du droit de propriété aux créances réalisée, ces biens incorporels n'auront effectivement plus qu'à se glisser dans le moule de la propriété et qu'à se nourrir de l'intérêt fondamental de cette notion, le bénéfice de sa protection assurément très efficace. Au fil de ces travaux, l'on découvre néanmoins que seul l'assouplissement de la rigueur de la défin ition classique de la propriété concilié à l'affermissement de celle des créances rend possible la compatibilité des deux notions. / Under the effect of repeated use of the concept of ownership of receivables by the legislature and the courts, the urgency of developing a theory of property claims appears. This subject still arouses controversy, reservations, questions and uncertainties. The combination of property and debt is often seen as a heresy. Indeed, the notion of ownership of the claims is generally condemned, not only because the ownership of tangible property is considered the only real property, but also because it seems to fit easily into the traditional distinction between real rights and personal rights. Yet is it not logical to ask whether the repeated use of the phrase "property claims" only a linguistic slippage without real significance, or whether the expression a reality which would have emerged by the vector of language? The doctrinal condemnation of property claims is not she pa on theoretical assumptions? The main goal of this thesis is to decide on the theoretical possibility of the concept of property claims. Can we legally use the term ownership in its technical sense, to designate the relation between the creditor's claim, or whether to stick to the notion of authorship? In truth, this question of the existence of the concept of ownership of receivables is important because it is also referred to the protection of the debt through property rights. Once the adjustment of property rights claims made, these intangible assets will effectively more than slipping into the mold of the property and that feed on the fundamental interest of this notion, the benefit of its certainly very effective protection. Throughout this work, however, one discovers that only the relaxation of the rigor of the classical definition of property reconciled to the consolidation of claims that makes possible the compatibility of both concepts.

A partir d’un corpus télévisé issu des chaînes publiques hertziennes, cette recherche analyse les modalités discursives de traitement télévisuel des contentieux postcoloniaux,- au cœur des mobilisations afro-antillaises articulées autour de trois pôles de luttes (visibilité, discriminations et reconnaissance mémorielle),- réapparus sous la forme d’une nouvelle «Question noire» française durant les années 2000. Il est question plus précisément d’identifier les régimes de monstration de ces mobilisations dont la mise en débat public révèle leur problématisation éristique, à travers un mode d’accès essentiellement polémique à l’agenda médiatique. Ce mode d’admission télévisuel a pour effet l’exhumation en permanence d’un clivage ethno-racial dans les discours publics et médiatiques. En outre, la monstration se déploie à travers le registre d’une mise en scène symbolique de l’opposition entre deux types de figures médiatiques : d’un côté, les Ultra-républicains, dans le rôle des défenseurs autoproclamés de la république et de l’autre, les figures minoritaires engagées dans les actions de contestation de leur statut en son sein. Enfin, cette étude met au jour le déploiement, d’un côté, des procédures discursives de disqualification du minoritaire et de l’autre, celles liées à la re-légitimation du modèle républicain d’intégration dans le processus de prise en charge publique des contentieux postcoloniaux. Cette thèse est structurée autour de deux parties. La première partie s’ouvre sur l’histoire de la présence afro-antillaise en France. Elle met en exergue, dans un premier chapitre, les fondements historiques de la présence noire hexagonale. La deuxième partie concerne notre enquête sur la monstration des revendications afro-antillaises. Charpentée autour de cinq chapitres, cette partie est consacrée à l’analyse des 38 émissions de notre corpus reparties sur une période de dix ans entre 1998 et 2008. / From a French public channels corpus, this study aims to analize Tv representions of postcolonial contentious issues, in the heart of French Blacks mobilisations which are structured around three mean claims (visibility, discriminations and memory recognition). Describing the will of French Blacks to exist on public sphere, these claims make the historic debate of the “Question noire” reappeared from the 2000s. The research, which intends to question the way in which Afro carribean mobilisations were told and represented on French public television, identifies following major trends. Fisrtly, the television debates analysis underlines an “eristic problematisation” of “Question noire” related issues with essentially polemical media coverage. The result of this type of access to the media agenda is a constant exhumation of an ethnoracial split in media and public discourses. Secondly, Tv coverage analysis reveals a symbolic production of an opposition between two dominant media figures. In one side, the “Ultra-républicains” playing the rôle of self-proclaimed defenders of French republic, and, on the other side, a coalition of minoriy claims defenders. The study, at last, reveals both discourses of disqualification of the minorities, and, discourses of re-legitimation of the French model of integration. This thesis consists of two parts. The first one deals with French Black history. It presents historic reasons of their presence from slavery up to decolonization. The second part explores the representation of postcolonial contentious issues in French public televisions. Structured on five chapters, it proposes a content analysis of our corpus based on 38 broadcasts between 1998 and 2008.

Die aard en werking van retensieregte : 'n regsvergelykende studie

Text in Afrikaans / This thesis deals with the nature and operation of liens in South African law. Whereas enrichment liens are classified as real rights, debtor creditor liens are not (sometimes they are referred to as personal rights). The South African law of lien is principally founded on Roman Dutch law and is similar to Dutch law before the enactment of the current Burgerlijk Wetboek (BW). In Dutch law the BW specifies which persons have a lien and under what circumstances. In South African law a creditor can establish a lien against an owner who has a duty to perform in terms of an agreement between the parties or, in the absence of such an agreement, on the basis of unjustified enrichment. My research has shown that a lien is not a subjective right but a capacity vested in a creditor by operation of law. It empowers him to retain an owner’s (debtor) thing until the creditor’s claim against him has been discharged. Extra-judicially the lien holder can rely on his lien or he can raise it as a defence against the owner’s rei vindicatio. The categorisation of liens as either enrichment liens, or debtor creditor liens is at the most an indication of the different sources of the creditor’s right to which the lien is accessory. In Dutch law liens are classified as verhaalsrechten on the owner’s estate. These rights (verhaalsrechten) are further classified as specific opschortingsrechten. A lien is therefore a capacity granted to certain creditors by law to retain an owner’s (debtor) thing. Regarding the operation of liens against third parties (derdenwerking), Dutch law distinguishes between a third party with an older right to the thing and a third party with a later right to the thing. In South African case law derdewerking (real operation) of liens is often used to explain the fact that the lienholder may, in the absence of an agreement with the owner, retain the owner’s thing until his claim against the owner has been discharged. In South African law a lien is a defence to the owner’s rei vindicatio. Reliance on real operation (derdewerking) is often a means of explaining that a lien exists against an owner with whom the creditor had no agreement. Real operation, however, refers to the question against whom other than the owner the lien may be enforced once its existence has been established. A lien can be enforced against the creditors of the owner (debtor), the curator of the debtor’s insolvent estate, heirs, mortgagees and servitude holders. In Dutch law the BW grants preference to liens. Owing to the particular provisions of the Insolvency Act 24 of 1936 liens in South African law enjoy preference above other secured creditors of the insolvent owner (debtor). / Hierdie proefskrif handel oor die aard en werking van retensieregte in die Suid- Afrikaanse reg. My navorsing toon dat ‘n retensiereg nie ‘n subjektiewe reg is nie, maar ‘n terughoudingsbevoegdheid wat deur regswerking totstandkom. Dit stel die skuldeiser in staat om die eienaar (skuldenaar) se saak te hou totdat die eienaar voldoen aan die vorderingsreg wat die skuldeiser teen hom het. Die retensiereghouer kan buitegeregtelik daarop steun, of dit as ‘n verweer teen die eienaar se rei vindicatio aanwend. Die kategorisering van retensieregte in skuldeiser-skuldenaar-retensieregte en verrykingsretensieregte is hoogstens aanduidend van die verskillende ontstaansbronne van die vorderingsreg waartoe die retensiereg aksessoor is. Cultural forests of the Southern Nuu-chah-nulth: historical ecology and salvage archaeology on Vancouver Island's West Coast

Cedar, represented by Western redcedar (Thuja plicata) and Yellow Cedar (Chamaecyparis nootkatensis) was known as the “Tree of Life” to the Nuu-chah-nulth on Vancouver Island’s west coast, and most other groups of the Pacific Northwest. This thesis investigates the Culturally Modified Trees (CMTs), or more specifically Tapered Bark Strips (TBS), created through the extraction of cedar bark removed for all manner of material goods. CMTs are now the most common archaeological site type within British Columbia. Current regional chronologies have inherent biases that make interpretations difficult. The chronologies created through Archaeological Impact Assessments (AIAs) are weighted heavily to the contact period and the highest frequency of use corresponds with indigenous population collapse rather than peak. Investigations are made into the true distribution of existing CMT features. This thesis details the survey of 16 recent old growth cedar clearcuts which found extensive unrecorded CMT features that have recently been logged throughout the southern Nuu-chah-nulth study region. Half of all TBS scars in exposed stumps were found embedded within healed trees, otherwise invisible to archaeologists. Comparing all AIA report dates (surveyed prior to logging activity) with all post-impact assessments surveys it was found the latter contain a greater and older distribution of scarring events corresponding to high First Nations populations before the contact period. The study also compares CMT chronologies with local histories, investigates the antiquity of Northwest Coast CMTs and the indigenous management of cedar trees to maximize bark harvests. The findings of this research hint at the expanded extent of anthropogenic forests in the Northwest Coast, the inadequate recording and heritage protections of CMTs, and what it all means for Aboriginal Land Rights in British Columbia. / Graduate / 0324 0740 0329 / kinze.earnshaw@gmail.com

Homeowner satisfaction and service quality in the repair of UK flood-damaged domestic property

Flooding is a global challenge that has plagued mankind throughout history, affecting over 164 million people worldwide in 2007 alone. As the frequency of flooding increases in England and Wales coupled with an increase in the number of properties at risk of flooding and the attendant huge (insured) economic costs of flooding, the services received by homeowners during flood damage repair works, have not been spared criticism, Both the Welsh Consumer Council report and the Warwickshire Trading Standards report raised serious questions about the level of service in insurance claims for the repair of flood-damaged domestic property. This research project was therefore aimed at investigating the level of service quality and determinants of homeowners’ satisfaction in England and Wales with respect to flood damage repair works during insurance claims. A comprehensive literature review was conducted on customers’ needs, satisfaction and service quality, flooding and related issues, and the repair of flood damaged domestic property, in order to set the framework for the research and shape the development of the research questions/hypotheses. The study employed a two-phased sequential mixed methods approach, commencing with 20 in-depth interviews with homeowners, repairers, insurers and loss adjusters. Findings from the initial exploratory study (and from the literature review) informed the development of a questionnaire instrument, which incorporated elements of SERVQUAL, the generic service quality measurement instrument. Survey data were collected for the quantitative phase of the study from a sample of 126 homeowners, which was then analysed to test the hypotheses put forward in the study. The data did not yield a set of reliable and interpretable factors of service quality from the three service quality scales used to measure homeowners’ perceptions of the performance of insurers, loss adjusters and contractors. However, of the three key service providers, the contractor’s performance was the best predictor of homeowners’ overall satisfaction during flood damage reinstatement claims, accounting for seven times the combined unique contribution of insurance and loss adjusting firms. In addition, satisfaction levels were significantly different for homeowners whose claims for repair works were completed within six months compared to those repairs exceeded twelve months. The thesis concludes with implications of the findings for practice as well as recommendations for further research. It is argued that knowledge of the determinants of homeowners’ satisfaction with services during the repair of flood damaged property, is beneficial not only to insurers, loss adjusters and repairers but to homeowners as well.

Tail Estimation for Large Insurance Claims, an Extreme Value Approach.

<p>In this thesis are extreme value theory used to estimate the probability that large insuranceclaims are exceeding a certain threshold. The expected claim size, given that the claimhas exceeded a certain limit, are also estimated. Two different models are used for thispurpose. The first model is based on maximum domain of attraction conditions. A Paretodistribution is used in the other model. Different graphical tools are used to check thevalidity for both models. Länsförsäkring Kronoberg has provided us with insurance datato perform the study.Conclusions, which have been drawn, are that both models seem to be valid and theresults from both models are essential equal.</p> / <p>I detta arbete används extremvärdesteori för att uppskatta sannolikheten att stora försäkringsskadoröverträffar en vis nivå. Även den förväntade storleken på skadan, givetatt skadan överstiger ett visst belopp, uppskattas. Två olika modeller används. Den förstamodellen bygger på antagandet att underliggande slumpvariabler tillhör maximat aven extremvärdesfördelning. I den andra modellen används en Pareto fördelning. Olikagrafiska verktyg används för att besluta om modellernas giltighet. För att kunna genomförastudien har Länsförsäkring Kronoberg ställt upp med försäkringsdata.Slutsatser som dras är att båda modellerna verkar vara giltiga och att resultaten ärlikvärdiga.</p>

The aim with this study was to analyze and understand how begging is constructed as a social problem in Sweden between September of 2010 and the end of February in 2014 in debate articles in Dagens Nyheter. To do this I have chosen to use a social problems theory and critical discourse analysis to highlight some aspects in the process of defining the social problem. The study's main finding is that the construction of beggars and begging appears to be in a relatively extensive redefinition in the current situation. It is shown by, for example, a shift in focus in the discourse. For this reason, it is relevant for social work to examine how the construction progresses.
