Managing the meltdown rhetorically : economic imaginaries and the Emergency Economic Stabilization Act of 2008

From September 19th through October 3rd, 2008, Congress debated the largest government bailout in America history—the Emergency Economic Stabilization Act (EESA). Those sixteen days generated a vibrant conversation regarding the nature and severity of America’s economic crisis and the proper role of government in responding to such juggernauts. In this dissertation I explore the rhetoric generated by this bill and its context in hopes of illuminating the more general role of rhetoric in mitigating and exacerbating crises in capitalism. My hypothesis is that, in a global capitalist economy increasingly dependent on immaterial production (i.e., finance, the Internet, mass media, etc.), economic crisis rhetoric has become as essential to economic order as monetary and fiscal policy. To explore this claim, I focus on two key rhetorical tensions that drove much of the crisis rhetoric produced. The first of these battles is a rhetorical struggle over the spatial delineation between Wall Street and Main Street, while the second is a conflict between Keynesianism and neoliberalism in a rhetorical contest over the values of government interventionism. By analyzing a variety of policy and expert discourses that constitute the parameters of these discrete areas of debate, I argue that all rely on moral and ethical appeals to substantiate their meaning and validity. At the same time, I contend that these discourses are indebted to logics of institutional form and therefore cannot be abstracted from the financial and political contexts in which they reside. This insight leads me to forward a new theory of economic crisis rhetoric called the economic imaginary. By beginning with real economic events and then taking into account the discursive and extra-discursive forces that “overdetermine” its mediated understanding, the economic imaginary offers us a more empirical and cartographic account of how economic rhetoric actually operates in society. / text

Les rapports entre l'ordre juridique constitutionnel et les ordres juridiques européens : analyse à partir du droit constitutionnel grec / The relationship between constitutional legal order and European legal orders : an analysis based on the Greek constitutional law

L'ordre juridique constitutionnel, l'ordre juridique de l'Union européenne et l'ordre qui se dégage progressivement de la Convention européenne des droits de l'homme, malgré leurs différences, sont étroitement liés. Toutefois, cette relation ne se traduit pas en une fusion. Il importe donc d'appréhender les rapports entre ces trois ordres en termes d'interdépendance mais aussi de concurrence. L'interdépendance se manifeste notamment grâce à la place de la Constitution comme vecteur principal de la construction européenne, garantissant l'intégration et la mise en œuvre des droits d'origine européenne dans l'ordre interne. La Constitution grecque correspond aux finalités européennes et l'enrichissement normatif de l'ordre interne par les deux droits européens est évident. A l'inverse, la concurrence se manifeste par le fait que l'ordre constitutionnel national est largement saisi par les ordres européens et ses faiblesses s'érigent en sources de conflits avec eux. Une transformation forcée de l'ordre interne est donc constatée afin de se conformer aux exigences européennes. La situation concurrentielle suscite l'intérêt pour la recherche d'une résolution institutionnalisée de conflits. Une systématisation des influences européennes dans l'ordre interne est mise en évident afin de renforcer l'autorité constitutionnelle et restructurer le système procédural. Si la complexité des rapports entre les trois ordres étudiés paraît indéniable, il y a lieu de mettre en avant les moyens institutionnels et procéduraux qui permettent de privilégier la complémentarité et d'atténuer la concurrence entre eux. / Despite their differences, the constitutional legal order, the EU legal order and the ECHR legal order, in progress, are strictly bound. However, this kind or relation is not equal to a fusion. Thus, the relationship of the three orders should be studied through the notions of interdependence and competition. Interdependence is manifest if one takes into account the role of the Constitution as the major vector in the building of Europe, ensuring the integration and the implementation of European rights in the national legal order. Hence, the Hellenic Constitution responds to the European rationale and both European legal orders contribute in the enrichment of the national legal order. Likewise, competition is manifest as the national constitutional order is seized by the European orders and its weaknesses appear as conflict sources with them. Therein, a forced transformation of the domestic law is apparent in order to adapt to the European conditions. This conflict situation gives rise to the research of an institution-based solution. A systematic approach of European influences in the national legal order is used in order to reinforce the authority of the Constitution and to restructure the procedural system. While the complexity of the aforementioned orders appears undoubtful, one should stress the institutional and procedural means that allow to favour complementarity and to mitigate competition between these orders.

Italian entrepreneurs of the construction business in a time of economic recession : ideas, strategies and movements

This thesis is based on an ethnographic study of entrepreneurs of the construction business in Lombardy, Northern Italy. The aim is to gain some understanding of this business, of entrepreneurialism, and of individuals in a non-stereotypical light through a full and complex account of their daily lives. The aim is to reveal the thoughts, actions and strategies of particular local actors in their everyday contingency and contradictoriness. No attempt is made to simplify the complexity of their understandings and practices for the sake of producing a single encompassing and consistent image. Many similarities were found between the practices of entrepreneurialism and those of the discipline of anthropology. Knowledge and information are constantly sought after but are recognised as emerging in unexpected places and times and as being socially negotiated. Apprenticeship is often used as a methodology, and learning often happens through experience. Contextual application of knowledge is seen as essential. In order to exchange information and knowledge, to collaborate with other businessmen or to simply get a job, trust is fundamental and constantly negotiated. Personal relationships and trust become particularly important in an uncertain market situation, as ways to face risk. Trust is acquired slowly and accorded contextually, through face-to-face interaction and cultivated relationships, but also through positive recommendations or simply a feeling of sympathy. Knowledge, apprenticeship, trust and risk are key themes of the thesis. The blurred borders between the distinct individual personalities of my informants and their collective identities and commonalities are also discussed. The personality of an entrepreneur is seen as ideally complex, in which many (possibly contradictory) characteristics can be expected to be present, but also ideally balanced, each manifesting itself in specific situations. The ethnography also explores the fragility of the entrepreneur, in apparent contradiction to their strong and charismatic personalities. It is seen to be despite and because of their positions of power that they also feel vulnerable: their discourse is imbued with their fears for their businesses in a difficult period of economic crisis. Finally, through a ubiquitous desire to control markets and the future, we also encounter forms of corruption; corruption that is often condemned verbally but nevertheless is present in the business world and amplified by public and media discourses. The mechanisms by which work that is put out to tender is subject to possible manipulation are examined, and the ideas of the entrepreneurs about these practices are described—again demonstrating how thoughts and practices are often self-contradictory in their contextual relevance and application.

Com base nas ferramentas teóricas obtidas, revisa o conceito de constituição econômica como a relação de acoplamento estrutural entre o direito e a economia, e a Constituição do Estado como a relação de acoplamento estrutural entre o direito e a política. As crises econômicas são então explicadas pelas tendências inflacionárias na produção de símbolos e pelos choques entre racionalidades sistêmicas parciais. A crise de 2008 consolida a constatação de que a globalização restringe a capacidade de influência da política e do direito sobre o sistema econômico desterritorializado. Em vista disso, propõe-se a adoção da teoria do constitucionalismo societal de Teubner como proposta para a democracia no século XXI; através dela, é possível reconhecer a constitucionalização no interior de cada subsistema social e o desenvolvimento de foros de razão pública internos, nos quais a política pode ser desenvolvida de forma autônoma em relação à política institucionalizada do Estado. Finalmente, vê-se como o combate à crise econômica invariavelmente redesenha os papéis dos Poderes de Estado, reconhecendo certa liberdade ao Executivo, embora isso não signifique ausência de quaisquer freios e contrapesos. / The presentwork seeks elements in Niklas Luhmanns systems theory as developed by Gunther Teubner and Marcelo Neves, amongst others to explain the interrelations between the legal, economic and political social subsystems in current society. Economic crisis is then explained by the inflationary tendencies in the production of symbols and by the conflicts between partial rationalities. The crisis of 2008 strengthened the conclusion that globalization restrains politics and laws capacities to influence the international economic system. In view of that, it is suggested the adoption of Teubners societal constitutionalism as a proposal for XXI centurys democracy. Societal constitutionalism allows the recognition of internal constitutions in each social subsystem and the development of internal public reasoning institutions, where politics can be developed autonomously from State Politics. Finally, the last chapter considers how the measures against economic crises invariably redefine the roles of the Executive, the Legislative and the Judiciary, recognizing some freedom to the Executive, although such freedom does not mean the absence of any checks and balances.

Por meio da caracterização do modelo de negócio anterior e posterior à crise político-econômica com implicações sobre a pós-graduação lato-senso, procura-se identificar quais influencias e quais adequações foram estrategicamente significativas para essa instituição. A luz das abordagens teóricas de Estratégia e de Modelo de Negócios identifica-se, a necessidade de estudos que investiguem os antecedentes e suas implicações no modelo de negócio. Por meio da abordagem qualitativa de estudo de caso, com o emprego de dados primários e secundários, utilizando observação direta não participante, análise documental e entrevistas semiestruturadas, foram investigadas e identificadas as principais influências oriundas da crise econômica no modelo de negócio. Os dados sugerem que a crise econômica modificou o modelo de negócio da escola de negócios pesquisada. Wirtz et al. (2016) defendem que a adequação do modelo de negócio ocorre somente no longo prazo, entretanto, este trabalho identificou que a adequação do modelo de negócio pode ocorrer no curto prazo. Adicionalmente, é evidenciado empiricamente a resposta de uma escola de negócio durante o período de crise. / The moment of great political and economic instability in Brazil since its worsening in 2015 until the first semester of 2018 is analyzed by this research through its implications on the business model of a business school. Through the characterization of the previous business model and subsequent to the political-economic crisis with implications on the Lato-Sensu post-graduation, it is sought to identify which influences and which changes were strategically significant for this Institution. The theoretical approaches of strategy and business model identifies the gap for future studies that investigate the background and antecedents of changes in the business model. Through the qualitative approach of case study, with the use of primary and secondary data, using direct non-participant observation, documentary analysis and semi-structured interviews, the main influences were investigated and identified from the economic crisis in the business model. The data suggests that the economic crisis modified the business model of the business school surveyed. These research findings were contrary to Wirtz et al. (2016) showing change of the business model may occur in the short term. Additionally, this research contribution shows empirically evidenced of the response of a business school during the crisis period.

Esta dissertação tem por objetivo analisar a realização da Copa do Mundo de Futebol de 2014 no Brasil, levando em consideração não apenas seus legados e impactos mais evidentes, mas principalmente compreendendo-a como parte substantiva da dinâmica mais geral do modo de produção capitalista em sua relação com as cidades-sede, os lugares. Como maiores eventos do planeta, as Copas apresentam-se como veículos passageiros e particulares do processo de totalização do capitalismo, sendo simultaneamente matrizes parciais do tempo e do espaço desse período histórico marcado pela crise econômica internacional. Nesse movimento, tendo os lugares como espaços finais de sua realização, esses megaeventos deixam marcas profundas; promovem a qualificação de uma determinada fração do tempo no qual ocorrem, determinados pelas necessidades do capital de se reproduzir lucrativamente, algo complexo nesse momento crítico. A totalidade, essa trama de eventos emaranhada entre as necessidades e possibilidades concretas dos lugares, ganha novos desenhos nas cidades a partir do contato com a agenda estabelecida pelo megaevento. Desde 2007, quando o Brasil foi escolhido como sede do Mundial e a crise econômica já aparecia no horizonte dos Estados Unidos e da Europa, as cidades brasileiras vivem a realidade desta agenda crítica pautada pela Federação Internacional de Futebol (FIFA). Tendo como pano de fundo as estratégias rígidas das corporações patrocinadoras e interessadas no evento, promove-se um verdadeiro estado de emergência para o atendimento das normas e padrões FIFA. Tomadas por uma avalanche de obras e negócios imobiliários desvinculados de planos estratégicos associados às necessidades mais sentidas da população, as cidades-sede tornam-se experimentos de novas formas de privatização e espoliação, sob o regime de leis de exceção e violações de direitos. Tal dinâmica imposta às cidades da Copa como um todo é manifesta de forma evidente na elaboração de uma nova centralidade na Região Metropolitana de Recife por meio da construção do grande empreendimento imobiliário Cidade da Copa, a partir do novo estádio construído para o evento. Trata-se pois, da eclosão no Brasil de uma crise fundamentalmente urbana que, se por um lado estrutura verdadeiras cidades de exceção, no outro vértice promove também a força criativa das resistências. Como demonstraram as manifestações urbanas multitudinárias de junho de 2013 e os protestos ininterruptos que se seguiram a elas, a revanche dos lugares à agenda da Copa pode estruturar também cidades rebeldes como legados. / This dissertation aims to examine the implementation of the World Cup 2014 in Brazil, taking into consideration not only its legacy and most obvious impacts, but mostly understanding it as a substantive part of the wider dynamics of the capitalist way of production in its relationship with the host cities, the places. As some of the biggest events on the planet, the World Cups are presented as individual and transitory vehicles of the aggregation process of capitalism, while being simultaneous matrices of time and space during this historical period marked by global economic crisis. In this movement, having spaces as the places of their full realization, these mega events leave deep marks; they promote the qualification of a certain fraction of the time in which they occur, determined by the needs of capital to play profitably, something complex during this critical moment. The totality, this \"web of events\" tangled between the concrete needs and possibilities of places, gains new designs in cities from contact with the agenda set by the mega event. Since 2007, when Brazil was chosen to host this event and the economic crisis had already appeared on the North American and European horizon, Brazilian cities are living the reality of a critical agenda guided by the International Football Federation (FIFA). In the background of the rigid strategies of the sponsors and corporations interested in the event, a true state of emergency is promoted to meet norms and \"FIFA standards\". Taken by an avalanche of construction sites and real state negotiations unrelated to strategic plans that take into account the needs of the population, the host cities become experiments in new forms of privatization and dispossession, under the regime of emergency laws and rights violations. Such dynamics - imposed on the World Cup cities as a whole - is clearly manifested in the drafting of a new central location in the metropolitan area of Recife through the construction of large real estate project called \"Cidade da Copa\", around the stadium built for the event. This is the outbreak in Brazil of a fundamentally urban crisis, where on the one hand \"cities of exception\" are structured, and in another vertex a creative power of resistance is also promoted. As demonstrated in the multitudinous urban protests of June 2013 and the uninterrupted protests that followed them, the requital that took places in host cities can also structure \"rebellious cities\" as legacies.

Crescimento, flutuações e endividamento externo na economia dos Estados Unidos: 1980-2000 / Economic growth, business cycles and external indebtedness of the US economy, 1980-2004

Este trabalho buscar explicar como o endividamento externo da economia norte-americana, a partir do início da década de (19)80, atenuou (e atenua ainda hoje) as decorrências macroeconômicas advindas da tendência para a estagnação do produto interno bruto. Segundo o argumento usado aqui, tal tendência para a estagnação origina-se da queda ao longo do tempo da parcela da acumulação produtiva sobre o produto. A tendência é explicada por um crescente diferencial no desempenho das taxas de lucro intersetoriais na economia, no qual as desvantagens para os setores industriais podem ser explicadas por suas mais elevadas razões capital/produto e conseqüentes menores taxas de lucro. Tal é intensificado por (a) pelo comportamento dos preços relativos, os quais conhecem uma queda maior dos preços dos bens industriais face a outros preços na economia; e (b) pelos crescentes déficits comerciais em bens. Particularmente, a tendência ao declínio foi intensificada pelas crises do petróleo (1974-1979) e pela política de juros altos no fim da década de (19)70 e meados de (19)80. O crescimento da financeirização surge assim como a outra face da moeda do movimento de diminuição da acumulação produtiva. Em segundo lugar, além de se tentar abordar as causas das flutuações em tendência decrescente do produto no período, tentou-se demonstrar como, em meio às flutuações do produto, o nível de endividamento correlacionou-se com a economia norte-americana no sentido de funcionar como elemento estabilizador. Dentro disto, buscou-se mostrar como a recuperação das taxas de lucro industriais, a partir do final da década de (19)80, e em meados da de (19)90, não levaram à queda da dívida externa. Isto se deu porque o nível de crescimento do setor industrial não logrou levar a economia a um patamar de crescimento que tornasse possível prescindir da dívida externa. Isto significava que a acumulação produtiva continuava insuficiente como mecanismo que permitisse uma diminuição do endividamento externo, principalmente devido às dificuldades relativas das taxas das de lucro industriais e das perdas no comércio exterior em bens tangíveis, não contornadas completamente pelo crescimento visto no período. Isto mostra que para sustentar os níveis de investimento e consumo, sem auxílio do endividamento externo, um volume muito maior de investimento teria de estar ocorrendo, o que não é possível pela queda relativa das taxas de lucro nos setores produtivos. Argumenta-se, assim, que o endividamento externo atenuou mas não solucionou fundamentalmente a continuidade da queda do investimento produtivo ao longo do tempo, processo que teria conduzido a economia a ainda menores taxas de crescimento na ausência do papel hegemônico do dólar na economia mundial. / This work aims to explain how the external indebtedness of the U.S. economy since the 1980s attenuated and still attenuates the macroeconomic effects originated from the tendency of the gross domestic product to stagnate. This tendency comes from the fall of the productive accumulation in its relation to the national product, explained by the growing disadvantages of the industrial profit rates when compared to the financial ones. These disadvantages can be explained mainly by the bigger capital/product rates in the industrial sectors, lowering its rates of profit. This is intensified by (a) the performance of the relative prices, which shows an ongoing fall in goods prices and a increase in nongoods prices, and (b) by the increasing trade deficits, stressing domestic production. Particularly, these tendencies were intensified by the oil crisis and the high interest rates of the middle 1970s. The growing participation of the financial sectors in the national economy is the other face of this tendency of the productive accumulation to fall. Moreover, this work intended to discuss how the external indebtedness is correlated to the instability of the economy, showing how, during all the period, the external indebtedness worked as a mechanism of stabilization. The work then tried to describe this process of stabilization. After this, the work intended to explain why the absolute rise of the industrial rates of profit, since the middle 1980s, was not able to diminish the rate of the external indebtedness. This occurred because the financial rates of profit expanded still more rapidly, expressing the persistence of the above mentioned different performances between productive and non-productive sectors in the U.S. economy. It explains why the increase in profitability of productive capital during the 1990s continued insufficient to conduct the economy to smaller degrees of external indebtedness. This is the specific conclusion of chapter 9, which tries to demonstrate how a faster process of accumulation of capital did not take to a lesser external debt during the middle 1990s. It occurred because that process of economic growth needed a still more vigorous rate of productive investment to make possible a fall in external indebtedness. Hence, the conclusion that emerges is that only a much more stronger process of productive accumulation would be able to diminish the external indebtedness process - a not easy process, given the poorest domestic performance of industrial sectors in face of the other domestic sectors and in face of the international ones. That is, the external indebtedness attenuated but did not solve the occurrence of a falling rate of productive accumulation. So, this fall of the rate of profit in industrial sectors would have conducted the economy to a still more fragile degree of investment and consumption if there was not the hegemonic role of dollar in the international economy, which permits the above mentioned strategy of external indebtedness.
