Previous issue date: 2015-06-19 / This study addressed the process of creating and educational paths taken in Agricultural Employers of Bananeiras, and the helpless child's condition that was entering the institution, between the years 1924 and 1947. We seek, through the raised sources, to trace the trajectory from Learning to Employers, highlighting the characters, primary education, work in the workshops, the practice of scouting, the Swedish gymnastics and agricultural education as an expression of social relations and power locked to articulate a systematic rural teaching model, involving education and productivity at the time. Based on this temporality, we use laws, decrees, regulations, crafts, among other sources in order to highlight the role dispensed to training for the world of work within the educational process, tending to a pragmatic style education to the poor children of the region. The theoretical and methodological bases substantiate the principles of the history of educational institutions (MAGALHÃES, 2004) according to which the structures of educational institutions are inseparable from a certain historical temporality. / Esse estudo abordou o processo de criação e os caminhos educacionais percorridos no Patronato Agrícola de Bananeiras, bem como a condição da criança desvalida que ingressava na Instituição, entre os anos de 1924 e 1947. Buscamos, por meio das fontes levantadas, traçar a trajetória de Patronato à Aprendizado, ressaltando os personagens, o ensino primário, o trabalho nas oficinas, a prática do escotismo, da ginástica sueca e o ensino agrícola como expressão das relações sociais e de poder travados para articular um modelo de ensino rural sistemático, envolvendo escolaridade e produtividade à época. Com base nessa temporalidade, utilizamos leis, decretos, regulamentos, ofícios, dentre outras fontes com o objetivo de ressaltar o papel dispensado à formação para o mundo do trabalho inserida no processo educativo, tendendo para um modelo de educação pragmática destinada aos meninos pobres da região. As bases de cunho teórico e metodológico fundamentaram-se nos princípios da história das instituições educativas (MAGALHÃES, 2004) segundo a qual as estruturas das instituições educativas são indissociáveis de uma determinada temporalidade histórica.

O presente trabalho é dedicado ao estudo do direito à intimidade do empregado e busca definir o papel do empregador diante de conflitos entre esse direito e outros direitos fundamentais no ambiente de trabalho. No primeiro capítulo examina-se o poder diretivo, dando-se ênfase à sua natureza jurídica, ao seu fundamento jurídico e aos limites que lhe são impostos, a fim de delimitar o âmbito de atuação legitimamente reconhecido ao empregador. No segundo capítulo analisa-se a teoria geral dos direitos da personalidade, a fim de compreender as características gerais aplicáveis ao direito à intimidade. O terceiro capítulo é dedicado exclusivamente ao estudo do direito à intimidade: sua origem, evolução histórica, conceito, alcance, características específicas, limitações e regime jurídico. No quarto capítulo o direito à intimidade é examinado enquanto direito fundamental. Nesse capítulo também é estudada a eficácia horizontal dos direitos fundamentais, a fim de compreender de que forma eles devem ser observados nas relações de trabalho. São apresentadas, ainda, duas propostas de solução para a colisão entre esses direitos: a de José Joaquim Gomes Canotilho e a de Virgílio Afonso da Silva. Por fim, são avaliadas algumas situações hipotéticas em que frequentemente se observa o conflito entre o direito à intimidade e outros direitos fundamentais no ambiente de trabalho e propostas soluções para esses conflitos com base nas ideias dos constitucionalistas mencionados. / This work is devoted to the study of the right to the employees intimacy and its attempt is to define the role of employer before the conflicts between this right and other fundamental rights in the working environment. The first chapter examines the employers directive power, emphasizing their legal nature, legal base and the limits imposed, in order to delimit the scope of action legitimately acknowledged the employer. The second chapter analyzes the general theory of the personality rights, in order to understand the general characteristics applied for the intimacy rights. The third chapter is exclusively devoted to the study of the intimacy rights: their origin, historical evolution, concept, scope, specific characteristics, limitations and legal regime. In the fourth chapter the intimacy right is examined as a fundamental right. In this chapter is either studied the horizontal effectiveness to the fundamental rights, in order to understand how they should be observed in working relationships. There are, in addition, two proposals presented as the solution to the collision between these rights: José Joaquim Gomes Canotilho and Virgílio Afonso da Silva. Finally, some hypothetical situations are assessed where the conflict between the intimacy right and other fundamental rights can be frequently observed in the work environment and it is proposed various solutions to these conflicts based on the ideas of the scholars mentioned.

Previous issue date: 2008-12-04 / O presente trabalho analisa o cotidiano da Justiça do Trabalho, através do estudo de Processos Trabalhistas, no município de Juiz de Fora, durante o período de 1944 a 1954. O trabalho aborda a relação entre trabalhadores, empresários e Justiça do Trabalho, com enfoque na interação dos fatores econômicos, sociais e políticos envolvidos. As questões centrais são: as variações anuais dos processos recebidos pela Junta, os momentos de tensão entre empregadores e empregados, as reivindicações, os benefícios esperados, o grau de consciência política dos operários, assim como a relação entre Justiça do Trabalho e movimento operário. O objetivo é compreender, bem como levantar novos debates, sobre a forma de utilização da Justiça do Trabalho, se para a simples resolução de questões imediatas ou, como instrumento de luta pela melhoria das condições de trabalho. A pesquisa aborda, ainda, a relação entre a promoção da justiça e a possibilidade da existência de tendências favoráveis para quaisquer dos grupos envolvidos. / The present work analyses the daily life of the Labor Justice, through the study of Labor Processes, in the city of Juiz de Fora, during the period from 1944 to 1954. The work boards the relation between workers, employers and Labor Justice, with approach in the interaction of the economical, social and politician factors involved. The main questions are: the annual variations of the processes received by the Labor Justice, the moments of tension between employers and employees, the claims, the expected benefits, the degree of political conscience of the workers, as well as the relation between Labor Justice and work movement. The objective is to understand, as well as to raise new discussions, about the way of use of the Labor Justice, whether for simple resolution of immediate questions or as instrument of improvement of work conditions. The research still boards the relation between promotion of justice and the possibility of existence of favorable tendencies for any of the wrapped groups.

Este estudo contribui para a compreensão da formação da fração industrial da burguesia de São Paulo. Procuramos examinar a atuação da patronal da indústria a partir dos conflitos e negociações ocorridos desde este acontecimento, buscando apreender a experiência de coesão e organização do empresariado industrial de São Paulo. Nossa hipótese principal é de que, tal como o operariado, a patronal industrial também passou a se organizar e se mobilizar de forma mais consciente e programática. O que se pode inferir na análise de sua atuação nas greves gerais de 1919 e 1920. Em ambas as greves, posteriores a 1917, notamos uma atuação coesa no processo de negociação, com destaque para a forma organizacional das entidades patronais, tais como o Centro Industrial de Fiação e Tecelagem de São Paulo e a Associação Paulista das Indústrias Mecânicas e Metalúrgicas. / This study contributes to the compreehension of the establishing of the industrial fraction of the bourgeosie of Sao Paulo. We seek to examine the Sao Paulo industry employers actions from conflicts and negotiations that have occured since this event, trying to understand their experience of organization and cohesiveness. Our main hypothesis is that, as well as the working class, the industrial employers also began to organize and mobilize themselves in a more consciously and programmatically way. What can be inferred from the analysis of their action in the general strikes of 1919 and 1920. In both strikes, subsequent to 1917, we observed a cohesive representation in the negotiation process, highlighting the organizational form of the employers, such as the Spinning and Weaving Industrial Center of Sao Paulo and the Metallurgical and Mechanical Industry Association of Sao Paulo.

Major changes have occurred in the workplace in the past decades. Technology has changed dramatically, innovative ways of utilising nuclear power have been developed, new chemicals have been introduced to the market and the adverse effects of other chemicals on both human health and safety and the environment have been discovered. This has influenced the nature of the workforce itself. Regulators in the different jurisdictions were required to react to the challenges that these changes represent. This thesis explores the responses in the United Kingdom, the United States of America and the Republic of South Africa by identifying the occupational safety and health (OSH) regulations, administration, enforcement and penalties which have been put in place to address the above mentioned challenges. It is impossible to mention all the changes in the workforce and workplace that have occurred in the recent years, and this thesis therefore focuses on the possibilities that different types of regulation offer to address some of these changes. Alterations to existing approaches are proposed to ensure that enforcement is improved and better targeted. The utilisation of third parties as surrogate regulators is also addressed. The central theme of this thesis is how the law can stimulate self-regulation by adopting a Safety Management System (SMS) within enterprises to encourage “self-critical reflection about their OHS performance”. The purpose of criminal sanctions in occupational safety and health regulation, the role of the prosecution in the enforcement of OSH strategies and the possibility of combining prosecutions of corporations with prosecutions of individual managers and directors who are responsible for non-compliance with OSH standards are also addressed. Although it is most important to ensure that workers are not injured or do not contract occupational diseases, in practice this does unfortunately happen. The workplace has evolved dramatically in the past decades. Technology has improved, innovative ways of utilising nuclear power have been developed, new chemicals have been introduced to the market and the adverse effects of other chemicals on both human health and safety and the environment have been discovered. This has influenced the nature of the workplace itself. While employees enjoy a common law right to a safe working environment and health and safety, state intervention currently provides restricted claims to an employee who has sustained injuries or contracted occupational diseases. This thesis explores the effect of section 35 of the Compensation for Occupational Injuries and Diseases Act 130 of 1993 which deprives an employee of its common law right to institute civil action against an employer for an injury sustained or disease contracted during the course and scope of employment. Furthermore, this thesis also explores the marriage between the Occupational Health and Safety Act 89 of 1993 and the Compensation for Occupational Injuries and Diseases Act 130 of 1993 as well as the position of ‘employee’ and ‘employer’ insofar as the scope and application of these two acts are concerned with specific reference to the position of labour broker employees. The use of indemnity clauses and its validity in South Africa will also be explored and discussed. This thesis also dedicates a chapter to the leading case authority of Jooste v Score Supermarket Trading (Pty) Ltd and its effect insofar as the enforcement and application of section 35 of the Compensation for Occupational Injuries and Diseases Act 130 of 1993 is concerned. It is impossible to mention all the changes in the workplace that have occurred in the recent years, and this discussion therefore focuses on the current position of employees who have been deprived of their common law right to institute delictual action for damages resulting from an injury sustained while on duty as well as the impact of the current restrictive claims available to them. Alterations to existing approaches are also proposed to resurrect the common law right of employees to institute action against their employers. / Abstract

This thesis is focused on an analysis of the working atmosphere in one international company which is producing and distributing fuel cards and registering trucks to different European toll systems. The aim is to analyze the influence of a toxic person on the people around him/ her and the working atmosphere in general. This thesis consists of two parts: theoretical and practical. The first part deals with the theoretical basis of the topic including toxic leadership in general, toxic working place, health reasons for such destructive behavior, different types of toxic behavior, and the influence of a toxic person on people around him/her. These points form the basis of the practical aspect of the thesis which focuses on a case study of toxic leadership behavior in the fuel cards company mentioned above. I conclude that a toxic leader can have a profound impact on the workplace environment, in particular employee rotation.

Varför väljer SME:s att engagera sig i CSR? : En studie av SME:s företagsledare upplevelser av CSRNiebudek, Marek, Zakholy, Avan January 2017 (has links)
Syfte: Syftet med denna studie är att öka förståelsen för SME:s företagsledares val att tillämpa CSR med fokus på kundmotivet och affärsmotivet. Metod: Studien utgår från ett socialkonstruktivistiskt och hermeneutiskt perspektiv, med en abduktiv forskningsansats. I studien används en kvalitativ undersökningsmetod, med anledning av att den empiriska datainsamlingen genomförs med hjälp av semistrukturerade intervjuer. Den teoretiska referensramen baseras på tidigare forskning och det empiriska materialet är grupperat efter kategorier som uppkommit vid intervjuerna. Resultat & slutsats: Studien tyder på att ekonomin och finansiella resultat inte är den främsta faktorn till att SME:s företagsledare tillämpar CSR på sina företag, utan att deras beslut att tillämpa CSR är grundat i icke-finansiella anledningar, såsom medarbetarnas trygghet och kundernas önskemål. Vi fann även att en vanligt förekommande faktor var att man gjorde det för att man hade ett genuint intresse för det som berörs av CSR. Uppsatsens bidrag: Ur ett teoretiskt perspektiv bidrar studien med att fördjupa förståelsen för vikten av icke-finansiella faktorer vid SME:s implementering av CSR. Ur ett praktiskt perspektiv föreslås att SME:s bör sträva efter att ha en tydlig, långsiktig struktur, då studien tyder på att det ger konkurrensfördelar och kan vara viktigt ur ett medarbetarperspektiv. Förslag till fortsatt forskning: Vi ser ett behov av att vidare undersöka effekten CSR har på individer samt det inflytande individer har på utformningen av CSR. Vi föreslår även att vidare forskning angriper CSR i SME:s ur både medarbetares och företagsledares perspektiv, för att kunna belysa likheter och skillnader mellan dessa två gruppers upplevelser. / Aim: The aim of this study is to create an understanding of why SME:s’ decision-makers choose to incorporate CSR in their business, focusing on the customer motive and business motive. Method: The study assumes a social constructivist perception of reality and builds on the hermeneutic research tradition, with abduction as the approach to analyzing the empirical findings. Semi-qualitative interviews were conducted to collect the empirical evidence. The theoretical framework of reference builds heavily on previous research, and the empirical evidence has been categorized appropriately. Results & conclusion: The study indicates that financial performance is not a major factor for why SME:s decision makers’ engage in CSR. Rather, our findings show that the decision to implement CSR is motivated by non-financial reasons, such as employee security and customer demands and expectations. We also found that SME:s engage in CSR because they have a genuine interest in the issues within CSR. Contribution of the thesis: From a theoretical standpoint, this study contributes by further highlighting the importance of non-financial factors in the way SME:s implement CSR. From a practical standpoint, we suggest that SME:s should aim towards achieving a clear long-term CSR-structure, since our findings suggest that it provides companies with competitive advantages and may be important from an employee point of view. Suggestions for future research: There is a need to further examine the effects of CSR on individuals as well as the influence individuals have on how CSR is implemented. We also suggest that future research studies CSR in SME:s from both employees’ and management’s point of view, to be able to explore the similarities and differences between their experiences.
