For this to be achieved, the evolution of human rights was highlighted, as well as its importance and reflection in the national and international setting. In the Brazilian law, human rights are fundamental in a society that is considered impartial and is characterized by solidarity, being strictly defended by the Federal Constitution of 1988. In the international setting, this situation was not different. The human rights have been proved to be a powerful shaping instrument of the sovereign States, setting the limits and boundaries to be followed as the way of elevating the human being as the heart of the international legal system. Facing the importance and relevance of the international treaties, the conventional phenomenon and its integration in the domestic law have been studied. Therefore, the main concern of this project was to make evident the reflex of the defense of human rights in the analysis of relations between the international and domestic legal systems, emphasizing the existence of antimonies between them and also their solutions, especially those regarding the existing conflict between Brazil s Federal Republic Constitution of 1988 and the Pact San Jose of Costa Rica, concentrating on the possibility of civil arrest caused by indebtedness. This treaty was rightly validated in Brazil and it examines the human rights issue. Through a bibliographical research on this normative conflict, criteria were obtained in order to be used as a solution for the antinomy between the national law and the international treaty. The Constitution of 1988 acknowledges the hypothesis of civil arrest for the unfaithful trustee. However, the Pact of San Jose of Costa Rica does not grant it. The analysis of this conflict is highlighted by its solution achieved by specific criteria related to human rights, since the Pact of San Jose of Costa Rica is an international treaty that considers these rights, and that it has a distinctive judicial hierarchy granted by the Federal Constitution itself. The results and conclusions show that the procedure that favors the individual is the one that prevails, being this the international treaty, since it has been granted a constitutional hierarchy. However, this positioning deals with a divergence in its doctrine and legal system. / Esta dissertação abordou a influência dos direitos humanos frente aos tratados internacionais incorporados ao direito brasileiro. Para tanto, destacou a evolução dos direitos humanos, sua importância e reflexos no cenário nacional e internacional. No direito brasileiro, os direitos humanos são imperativos a uma sociedade justa e solidária, sendo defendidos a rigor na Constituição Federal de 1988. No cenário internacional, não aconteceu diferente. Os direitos humanos se mostram valoroso instrumento modelador dos Estados soberanos, impondo limites e parâmetros a serem seguidos, como forma de enaltecer o ser humano como cerne do ordenamento jurídico internacional. Face à importância e relevância dos tratados internacionais, estuda-se o que vem a ser esse fenômeno convencional e a sua integração no direito interno. A preocupação fundamental deste trabalho foi, portanto, evidenciar o reflexo da proteção dos direitos humanos quando da análise das relações entre os ordenamentos jurídicos internacionais e o interno, ressaltando, inclusive, a existência de antinomias entre esses diferentes ordenamentos e a forma de solução, principalmente quanto ao conflito existente entre a Constituição da República Federativa do Brasil de 1988 e o Pacto de San Jose da Costa Rica, especificamente quanto à possibilidade da prisão civil por dívidas, tratado esse devidamente ratificado pelo Brasil e que versa sobre direitos humanos. Através de uma pesquisa bibliográfica acerca do respectivo conflito normativo, obtiveram-se critérios a serem utilizados para solucionar a antinomia entre o direito nacional e o tratado internacional. A Constituição/88, por sua vez, admite a hipótese de prisão civil do depositário infiel, contudo, o Pacto de San Jose da Costa Rica não a contempla. A análise desse conflito tem como destaque a sua solução por meio de critérios específicos aos direitos humanos, uma vez que o Pacto de San Jose da Costa Rica por ser um tratado internacional que versa sobre esses direitos, possuiu hierarquia jurídica diferenciada conferida pela própria Constituição Federal. Os resultados e conclusões apontam para a prevalência da norma mais favorável ao indivíduo, qual seja a do tratado internacional, uma vez que lhe é conferida hierarquia constitucional. Esse posicionamento, contudo, enfrenta divergências na doutrina e jurisprudência.

Starting from the idea that the decisions of the ministers do not consist of a mere formal activity, a subsumption of the fact to the legal norm, but sometimes interfere in the political arena, this research seeks to delineate the political role played by the Court and to reveal the decision-making standard of ministers in respect to various issues, through the empirical analysis of their decisions. In this context, this paper proposes to study the behavior of Ministers decision of the Supreme Court on an issue unexplored by these studies: the incorporation of international human rights treaties to domestic law. [pt] A Internalização dos Tratados Internacionais de Direitos Humanos e a Constituição de 1988. A partir da promulgação da Constituição da República de 1988 a doutrina brasileira vem tentado defender a tese de que os pactos internacionais de direitos humanos são incorporados de forma automática ao direito interno, bastando para tanto sua ratificação no plano internacional. Os mesmo autores defendem, ainda, o status de norma de direito fundamental destes pactos uma vez incorporados. Partindo dessas duas assertivas, a presente dissertação, rejeita o primeiro postulado para afirmar que o caráter de norma constitucional das normas internacionais internalizadas decorre antes de tudo de seu conteúdo e não da forma de sua internalização. Do mesmo modo, pugna o presente trabalho que a adoção do rito tradicional para a internalização de tratados internacionais que versem sobre os direitos humanos não significa outorgar ao Executivo uma carta branca para postergar a prática dos atos necessários para a sua incorporação. Ao final, defende a possibilidade da intervenção do Poder Judiciário para assegurar a proteção dos direitos individuais ameaçados ou lesados por tal omissão. / [en] The relationship between International Human Rights Law and municipal law in Brazil has taken a new turn with the adoption of a new Constitution in 1988. Human Rights lawyers and law teachers support the idea that the new Constitutional Charter allow for a monistic approach to the relationship between International Human Rights Law and municipal law. The present dissertation contends that even in the case of a Human Rights treaty the Brazilian Constitution demands an act destined to transform International Law in domestic law. Contrary to what these Human Rights advocates and theorists believe, the dualist theory allows, not only for the International Human Rights Law to be adopted in Brazil as material Constitutional Law, but for its prompt adoption after the entry in force of any human rights treaty ratified by Brazil. Also, this dissertation contends that in those cases that the delay in transforming International Law in municipal law harms individual rights, the Judiciary branch can offer a quick and effective response.

The title of the dissertation: Law of Treaties - subsequent agreements and subsequent practice The topic of the dissertation is the codification of the rules of interpretation of international treaties, with special focus on the phenomenon of subsequent agreements and subsequent practice of the state parties. In its general introductory section, the thesis defines international treaties as a source of international law and presents a comprehensive analysis of methods of interpretation and their codification. The fundamental part is devoted to the subsequent agreements and subsequent practice, their definition, including the difference from other similar methods, and the use of them for the interpretation of treaties before international courts and in international organizations. This thesis also focuses on the issue of evolutionary interpretation. The practical part of the thesis is based on the interpretation of treaties in three branches of international law (investments, cultural cooperation, taxes), with emphasis on the use of subsequent agreements and subsequent practice and on the current developments in the negotiation of new treaties and in the activities of international organizations.

Canadian federalism and treaty powers: existential communities, functional regimes and the Canadian constitution

La Loi constitutionnelle de 1867 ne contient aucune disposition expresse concernant un quelconque pouvoir pour les gouvernements fédéral et provinciaux de conclure des traités internationaux - ce pouvoir étant réservé, à l'époque de l'adoption de la Loi constitutionnelle de 1867, au pouvoir impérial britannique. Aussi, une seule disposition prévoyait les modalités de mise en oeuvre des traités impériaux au sein de la fédération canadienne et cette disposition est aujourd'hui caduque. Puisque l'autonomie du Canada face à l'Empire britannique ne s'est pas accompagnée d'une refonte en profondeur du texte de la constitution canadienne, rien n'a été expressément prévu concernant le droit des traités au sein de la fédération canadienne. Le droit constitutionnel touchant les traités internationaux est donc Ie fruit de la tradition du «constitutionnalisme organique» canadien. Cette thèse examine donc ce type de constitutionnalisme à travers le cas particulier du droit constitutionnel canadien relatif aux traités internationaux. Elle examine ce sujet tout en approfondissant les conséquences juridiques du principe constitutionnel du fédéralisme reconnu par la Cour suprême du Canada dans le Renvoi relatif à la sécession du Québec, [1998] 2 R.C.S. 217. De manière plus spécifique, cette thèse analyse en détail l’affaire Canada (P.G.) c. Ontario (P. G.), [1937] A.C. 326 (arrêt des conventions de travail) ou le Conseil prive a conclu que si l'exécutif fédéral peut signer et ratifier des traités au nom de l'État canadien, la mise en oeuvre de ces traités devra se faire - lorsqu'une modification législative est nécessaire à cet effet - par le palier législatif compétent sur la matière visée par l'obligation internationale. Le Conseil Prive ne spécifia toutefois pas dans cet arrêt qui a compétence pour conclure des traités relatifs aux matières de compétence provinciale. Cette thèse s'attaque donc à cette question. Elle défend la position selon laquelle aucun principe ou règle de droit constitutionnel canadien ou de droit international n'exige que l'exécutif fédéral ait un pouvoir plénier et exclusif sur la conclusion des traités. Elle souligne de plus que de très importants motifs de politique publique fondes notamment sur les impératifs d'expertise, de fonctionnalité institutionnelle et de démocratie militent à l’encontre d'un tel pouvoir fédéral plénier et exclusif. L'agencement institutionnel des différentes communautés existentielles présentes au Canada exige une telle décentralisation. Cette thèse démontre de plus que les provinces canadiennes sont les seules à posséder un pouvoir constitutionnel de conclure des traités portant sur des domaines relevant de leurs champs de compétence - pouvoir dont elles peuvent cependant déléguer l'exercice au gouvernement fédéral. Enfin, cette thèse analyse de manière systématique et approfondie les arguments invoques au soutien d'un renversement des principes établis par l'arrêt des conventions de travail en ce qui concerne la mise en oeuvre législative des traités relatifs à des matières provinciales et elle démontre leur absence de fondement juridique. Elle démontre par ailleurs que, compte tenu de l'ensemble des règles et principes constitutionnels qui sous-tendent et complètent le sens de cette décision, renverser l’arrêt des conventions de travail aurait pour effet concret de transformer l'ensemble de la fédération canadienne en état quasi unitaire car le Parlement pourrait alors envahir de manière permanente et exclusive l'ensemble des champs de compétence provinciaux. Cette conséquence est assurément interdite par le principe du fédéralisme constitutionnellement enchâssé. / The Constitution Act, 1867 contains no express provision on federal or provincial treaty-making powers. These powers were reserved to the Imperial government at the time when the Constitution Act, 1867 was adopted by the Imperial Parliament. The Constitution Act, 1867 also contained only one provision that dealt with the implementation of Imperial treaty obligations in the Canadian federation and that provision is now obsolete. Because Canada's gradual autonomy from the British Empire was not accompanied by a thorough modification of the text of the Canadian constitution, nothing has been expressly provided in relation to treaty powers in the Canadian federation. Canadian constitutional law dealing with treaty powers is therefore a pure product of the Canadian "organic constitutionalism" tradition. This thesis examines this form of constitutionalism through the specific case of the treaty powers in Canada. In particular, this study hopes to deepen our understanding of the multiple legal consequences of the constitutionally entrenched principle of federalism recognized by the Supreme Court of Canada in the Reference re Secession of Quebec, [1998] 2 S.C.R. 217. More specifically, the thesis presents an in-depth analysis of Canada (A. G.) v. Ontario (A.G.), [1937] A.C. 326 (the Labour Conventions case) where the Privy Council decided that the federal executive power could sign and ratify treaties in the name of Canada but that the implementation of treaty obligations - when legislative action is required - is the responsibility of the legislature that has jurisdiction over the obligations' subject-matters. The Privy Council did not specify, however, which institution(s) has the power to conclude treaties in relation to provincial subject-matters. This thesis tackles this problem. It is demonstrated in this thesis that no rule or principle of Canadian constitutional law nor of international law grants plenary and exclusive treaty-making powers to the federal executive. It highlights some very important policy reasons based on the needs for expertise, for institutional effectiveness and for respect for democracy not to recognize such plenary and exclusive treaty-making powers to the federal executive. The institutional arrangements necessary for the survival and flourishing of the diverse existential communities require that the federal executive does not possess such powers. It is moreover demonstrated that only provinces possess the constitutional powers to conclude treaties related to their subject-matters - the exercise of which powers may however be delegated to the federal government. Finally, the thesis presents a systematic and in-depth analysis of the arguments invoked in favour of reversing the rules set out in the Labour Conventions case in relation to legislative implementation of treaty obligations related to provincial subject-matters. It demonstrates that those arguments have no legal basis. Moreover, the thesis shows that because of the many underlying and interconnected constitutional rules and principles that support and give meaning to the Labour Conventions case, reversing that decision would have the concrete effect of transforming the Canadian federation into a quasi-unitary state because Parliament would thus be allowed to oust provinces from the entirety of their legislative jurisdiction. This consequence is most certainly prohibited by the federal principle entrenched in the Constitution.

Plusieurs problèmes d’environnement se posent aujourd’hui à l’humanité : pollutions diverses, réchauffement climatique, désertification, inondations, accumulation de déchets, pénurie d’eau, extinction progressive des espèces animales et végétales etc. Pour traiter ces problèmes, diverses activités et initiatives sont menées, aux plans local, national, sous-régional, régional et international. Parmi celles-ci figure la négociation des conventions internationales dans le domaine de l’environnement. La présente étude procède en deux temps : en premier lieu, elle analyse les justifications de la négociation telle qu’elle repose sur des déterminants non juridiques et juridiques. En second lieu, elle procède à l’évaluation de l’issue des négociations telle que celles-ci se jouent entre conflits d’intérêt et recherche de consensus. La thèse identifie les éléments, les facteurs et les principaux acteurs qui influent sur les décisions et les positions adoptées dans le cadre des négociations internationales. Ainsi, les négociations des traités environnementaux sont-elles à la fois l’expression d’une pratique classique en matière d’adoption des engagements internationaux et d’un contexte particulier propre à la thématique environnementale, au carrefour précisément du juridique, de l’économique, du politique et du social. A cet égard, on peut observer qu’il y est recherché plus le consensus plus que la confrontation, des principes généraux plus que des obligations plus strictes.Le bilan est que la négociation des traités environnementaux reste une oeuvre non seulement utile mais nécessaire car elle vise à répondre aux problèmes évoqués ci-dessus, au fur et à mesure où ils se posent, par la recherche de cadres juridiques contraignants appropriés. / Humankind is facing many environmental problems nowadays: diverse forms of pollution, climate warming, desertification, floods, waste accumulation, water scarcity, progressive extinction of animal and plant species etc. To deal with these problems, diverse activities and initiatives are carried out, at local, national, sub-regional, regional and international levels. Among these, is the negotiation of international conventions in the area of environment. The current thesis sets about two folds: firstly, it analyses the justifications of the negotiation as it lays on non-legal and legal determinants. Secondly, it assesses the negotiations issue as these are played between conflicts of interest and seeking of consensus. The thesis identifies elements, factors and key stakeholders that have effect on decisions and positions taken in the sphere of international negotiations. Thus, the negotiations of environmental treaties are both the expression of a classical practice for adopting international commitments and of a particular context for environmental thematic, at the crossroads, precisely of law, economy, politics and social. Then, it can be said that consensus more than confrontation, general principles more than strict obligations, are sought. The assessment to be made is that the negotiation of environmental treaties remains an activity which is not only useful but also necessary as it seeks to respond to the problems considered above, as they occur, looking for appropriate and strict legal frameworks.

The importance of this study is translated in an attempt to correlate part of the constitutional theory of human rights to national labor law for the application of appropriate standards. For this purpose, the study begins with an analysis of the conception and denomination of human rights for a better understanding of the topic. The origin of human rights is further assessed to confirm its progressiveness in time, which would certainly influence the manner in which these rights must be interpreted. Taking into account the historical evolution of human rights, these rights may be classified according to different generations and dimensions. Subsequently, a study on international treaties is conducted to observe whether the ILO Conventions are international treaties for human rights protection and the Federal Constitution is related to the International Human Rights Treaties. The study further analyzes the constitutional regime of human rights treaties (its hierarchical threshold in Brazilian law, formation, incorporation and denouncement) indicating the main theories about the subject. Furthermore, the study addresses the impact of human rights treaties on our legal system, and more specifically on Brazilian Labor Law. With this intent, Convention number 158 of the ILO is evaluated because it is a relevant and modern topic. The study also discusses the compatibility of rules predicted in Convention number 158 with constitutional precepts, in order to assess the constitutionality (or lack of constitutionality) of its content and its denunciation by the Brazilian State. In conclusion, after detailing precepts of the Convention, the study indicates doctrinal and jurisprudential criteria to compensate for the failure to apply Convention number 158/ILO / O presente trabalho destina-se ao estudo do impacto da teoria constitucional dos tratados internacionais sobre direitos humanos na Convenção 158 da Organização Internacional do Trabalho (OIT). Sua importância se traduz na tentativa de relacionar parte da teoria constitucional dos direitos humanos ao direito do trabalho nacional, para a aplicação da normativa correta. Para tanto, inicia-se com a análise da conceituação e da denominação dos direitos humanos para melhor compreensão do tema. Em seguida, verifica-se a origem dos direitos humanos para que seja comprovada sua progressividade no tempo, o que certamente influi na forma pela qual esses direitos devem ser interpretados. Levando em conta a evolução histórica dos direitos humanos, esses podem ser classificados segundo diferentes gerações ou dimensões. Posteriormente, é realizado estudo acerca dos tratados internacionais, observando-se as Convenções da OIT são tratados internacionais de proteção aos direitos humanos e relacionando a Constituição Federal com os Tratados Internacionais sobre Direitos Humanos. Em seguida, analisa o regime constitucional dos tratados de direitos humanos (seu patamar hierárquico no direito brasileiro, formação, incorporação e denúncia), apontando as principais teorias a respeito do tema. Ainda, trata do impacto dos tratados de direitos humanos em nosso ordenamento e, especificamente, no direito do trabalho brasileiro. Para tanto, estuda a Convenção 158 da OIT, pela relevância e atualidade do tema. Nesse sentido, discorre sobre a compatibilidade das normas previstas na Convenção 158 com os preceitos constitucionais, a fim de verificar a constitucionalidade ou não de seu conteúdo e de sua denúncia pelo Estado brasileiro. Por fim, após detalhar os preceitos da Convenção, aponta os critérios doutrinários e jurisprudenciais para que seja suprida a omissão decorrente da não aplicação da Convenção 158/OIT

Regras multilaterais no direito internacional: elementos de uniformidade e variação linguísticas

The theoretical and methodological basis comes from the combination of Corpus Linguistics (cf. Berber Sardinha, 2004) with Genre Analysis (cf. Bhatia, 1993). We investigate what is implied in the legislative provision contained in article 33, 3, of the Viena Convention on the Law of Treaties, done on May 23, 1969, i.e.: The terms of the treaty are presumed to have the same meaning in each authentic text . Our corpus of study is composed of texts of multilateral treaties written in four languages: Portuguese, English, Spanish, and French. Since we highlight the importance of identifying elements which allow us to describe what is understood as same meaning of the terms employed in treaties: 1) we focus the communicative purpose of conduct prescriptions; 2) we adopt the main text (i.e., the body of articles) as a representative exemplar of the treaty concerned, as it is the part traditionally reserved to conduct prescriptions in the internal segmentation of this genre; and 3) we analyze the uniformity and variation of linguistic elements: a) in the designation of the subject whose conduct is at stake; and b) in verbal combinations which delimit the action prescribed to this subject. We combine in a situated manner the tools of Corpus Linguistics. We use the classic software WordSmith Tools in the first stage, aiming to identify a term designating an International Law subject in order to select the legislative provisions to be analyzed. Subsequently, we use the software Multialigner, developed in partnership with our research tutor, to align the segments of the treaties written in four languages and select the sentences containing the search word(s) nominated. Afterwards, we use the software Multi-Systemic Coder 4.68 to tag the linguistic elements concerned. And to finish, we use the computational script Getcodings, developed by our research tutor in order to extract from Systemic Coder 4.68 the linguistic data processed. That is the fountain of statistical data on linguistic uniformity and variation they are here regarded under a qualiquantitative perspective which represents the routes of contemporary Applied Linguistics / Esta pesquisa almeja proporcionar novos subsídios para o estudo da uniformidade e variação linguísticas em tratados internacionais multilaterais. O embasamento teórico-metodológico provém da combinação da Linguística de Corpus (cf. Berber Sardinha, 2004) com a Análise de Gênero (cf. Bhatia, 1993). Investigamos o que implica a disposição legislativa contida no art. 33, 3, da Convenção de Viena sobre o Direito dos Tratados, de 23 de maio de 1969, ou seja: Presume-se que os termos do tratado têm o mesmo sentido nos diversos textos autênticos (Decreto Legislativo n. 214, de 2-12-1992). Nosso corpus de estudo é composto por textos de tratados multilaterais redigidos em quatro idiomas: português, inglês, espanhol e francês. Como destacamos a importância de identificar elementos que possibilitem descrever o que se entende por mesmo sentido dos termos empregados em tratados: 1) focamos o propósito comunicativo de prescrever condutas; 2) adotamos o articulado (i.e., corpo de artigos) como exemplar representativo de cada tratado em questão, por ser a parte tradicionalmente reservada à prescrição de condutas na segmentação interna desse gênero; e 3) analisamos a uniformidade e variação dos elementos linguísticos: a) na designação do sujeito cuja conduta está em foco; e b) nos arranjos verbais delimitadores da ação prescrita a esse sujeito. Empregamos de modo situado o ferramental da Linguística de Corpus. Recorremos ao consagrado software WordSmith Tools na etapa inicial da pesquisa, visando identificar um termo designativo de sujeito de Direito Internacional para selecionar as disposições legislativas a analisar. Em seguida, recorremos ao software Multialigner, desenvolvido em parceria com nosso orientador, para alinhar os segmentos dos textos de tratados redigidos nos quatro idiomas e selecionar as frases que contenham a(s) palavra(s) de busca que indicamos. Depois, recorremos ao software Systemic Coder 4.68 para etiquetar os elementos linguísticos dos quais nos ocupamos. E, por fim, recorremos ao aplicativo computacional (script) Getcodings, desenvolvido pelo orientador desta pesquisa para extrair os dados processados no software Systemic Coder 4.68. Originam-se daí os dados estatísticos acerca da uniformidade e variação linguísticas submetidos a uma perspectiva qualiquantitativa de pesquisa que bem representa os rumos da Linguística Aplicada contemporânea
