Magistro darbe yra nagrinėjami ne tik nutraukiant darbo sutartį taikomi apribojimai, bet ir nutraukiant darbo sutartį taikomos garantijos, nes tai yra vienos bendros sistemos sudedamieji elementai. Apribojimai ir garantijos yra analizuojamos tiek teoriniu, tiek praktiniu aspektu. Visų pirma, darbe stengiamasi išnagrinėti apribojimų bei garantijų, kaip darbo teisės poinstitučių, kurių dėka yra užtikrinamas darbuotojui įtvirtintų teisių realizavimas, prigimtį ir paskirtį. Didelis dėmesys yra skiriamas apribojimų bei garantijų sąvokų reikšmės suvokimui bei šių sąvokų vartojimu sukurto teisinio nenuoseklumo atskleidimui. Vienas iš darbo tikslų yra surasti tinkamus garantijų ir apribojimų kaip sąvokų apibrėžimus, atitinkančius Darbo kodekse įtvirtintą teisinį reguliavimą, ir pateikti originalią Darbo kodekse įtvirtintų nutraukiant darbo sutartį taikomų garantijų bei apribojimų klasifikaciją, tokiu būdu padarant šių poinstitučių skirstymą teisiškai nuoseklesnį. Kiekvienas apribojimas bei garantija, išskirti remiantis gramatiniu teksto aiškinimo metodu, yra aptariami atskirai. Analizuojant nutraukiant darbo sutartį taikomų garantijų ir apribojimų laikymąsi praktikoje, didelis dėmesys yra skiriamas Lietuvos Aukščiausiojo Teismo jurisprudencijai, atskleidžiančiai nemažą dalį praktikoje kylančių problemų. [toliau žr. visą tekstą] / In the present Master thesis there are examined not only the restrictions applicable to the employer upon terminating the employment contract, but the applicable guarantees as well, because they are the constituent elements of the same general system. The restrictions and the guarantees are analyzed by theoretical and practical aspect. First of all, the restrictions and the guarantees are considered as the post institute of the labour law, by courtesy of it, the realization of established rights of employee are ensured. Therefore, the nature and the purpose of them are approached in this work. Great attention is payed to the perception of the meaning of the restriction and guarantee terms and to the revelation of the juridical incoherence that establishes by the usage of the mentioned terms. One of the aims of the present paper is to find appropriate definitions for guarantees and restrictions as terms, adequate to the firmed juridical regulation in the Labour code. In this perspective, the present study aims at analyzing the persuasion which permeates the conversation turns in an interview with the deputy Denise Frossard, on Jô talk show program, with a view to answering the following question: what discursive resources Jô Soares and Denise Frossard mostly employ to persuade their audience in the interview? Considering the dynamics of the realizations of various meaning combinations which this analysis implies, my study has an eclectic theoretical support, including Fowler (1991), based on Critical Discourse Analysis, and theories complementing the Systemic-Functional Linguistics, particularly the interpersonal metafunction. In so being, I make use of these persuasive notions which help me understand both explicit and implicit persuasion that pervade the interview interloctions, according to the following elements: dialogism (Bakhtin, 1981); frame and footing (Goffman, 1981), smuggling information (Luchjenbroers e Aldridge, 2007); directed information (Coffin e O Halloran, 2006), notions of cryptic-argumentation (Kitis e Milapides, 1996) and finally Analysis of Conversation (Eggins e Slade, 1997), which sheds light on the existing phenomena in the conversation turns. The data showed that amongst the occurrent persuasive elements, the implicit ones are the most frequent in the speech of the interlocutors. However, the host resorts to a discourse apparently friendly and capable of facilitating the exposure of the interviewee s opinion. Nessa perspectiva, o presente estudo objetiva analisar a persuasão que percorre os turnos conversacionais, na entrevista realizada com a deputada Denise Frossard, no talk show Programa do Jô, e deve responder à seguinte pergunta: que recursos discursivos são mais utilizados por Jô Soares e por Denise Frossard, visando a persuadir seu interlocutor na entrevista? Para abranger a dinâmica da realização da conjunção de significados diversos que essa análise implica, meu estudo tem um suporte teórico eclético , na esteira de Fowler (1991), com base na Análise Crítica do Discurso, formado por teorias que complementam a proposta da Lingüística Sistêmico-Funcional, em especial, no que diz respeito à metafunção interpessoal dessa teoria. Assim, apóiome em noções discursivas que ajudam a compreender a persuasão, por meios explícitos e implícitos, que entremeiam as interlocuções da entrevista, conforme os seguintes elementos: o dialogismo (Bakhtin, 1981); o frame e o alinhamento (Goffman, 1981); a inserção sub-reptícia de informação (Luchjenbroers e Aldridge, 2007); a informação direcionada (Coffin e O Halloran, 2006), e a noção de criptoargumentação (Kitis e Milapides, 1996) e, finalmente, à Análise da Conversação (Eggins e Slade, 1997), que esclarece fenômenos ocorrentes nos turnos conversacionais. Mainly characterized by his performance in the spheres of war and politics, the trajectory of Silva Tavares was marked by social, economic and spatial mobility, and all of these elements directly linked. The Viscount managed to ascend social and economically, by navigating through many paths of the Empire that was being built in Brazil in that time. His strategies allow us to compare the distinct moments of his life with the societies that he was inserted in different contexts, at the same time that enable us to explore typical socioeconomic hierarchies that were in place in Brazil?s southernmost province. The analysis of certain circumstances of his trajectory, furthermore, gives the opportunity to address conjunctural and structural phenomena of the Brazilian Empire ? especially wars, political disputes, and migrations. For that reason, we accessed a diverse set of sources, such as biographical narratives, letters, post mortem inventories, ecclesiastical records and nominative lists. The text is divided into three chapters: the first one, ?Rising?, focuses on the early years of Silva Tavares life and his trajectory until the beginning of the Ragamuffin War; the second chapter, entitled ?Moving?, addresses two turning points of Serro Alegre?s life: his military activities during the Ragamuffin War and his subsequent migration to Bag?; the third, ?Rebuilding?, is dedicated to the last years of his trajectory, revealing his insertion into Bag? and into the Brazilian Empire structures. / O objetivo geral deste trabalho ? analisar a trajet?ria de Jo?o da Silva Tavares, Bar?o e depois Visconde de Serro Alegre, ao longo do s?culo XIX. Caracterizada principalmente por sua atua??o nas esferas da guerra e da pol?tica, a trajet?ria de Silva Tavares foi marcada tamb?m pelas mobilidades social, econ?mica e espacial, estando todos esses elementos diretamente ligados entre si. Percorrendo diferentes veredas do Imp?rio que se constru?a no Brasil durante o mesmo per?odo, Jo?o da Silva Tavares conseguiu ascender econ?mica e socialmente, o que nos permite comparar os distintos momentos de sua vida com as sociedades nas quais esteve inserido em diferentes contextos, ao mesmo tempo em que possibilita tamb?m perscrutar acerca das hierarquias socioecon?micas existentes ao sul do Imp?rio. In the intention to fulfill this goal, surveys were firstly made to show formal and philosophical characteristics in each artist s work. Further, it was carried out a comparative study regarding to such properties, through which it was possible to obtain subsidies in order to corroborate the hypothesis of this study, the existence of identification points concerning the two artists. Asked the descriptions of the main cohesive themes between both authors, the dissertation has focused its interest on the writer's production, proceeding with the analysis of a series of compositions, which represents different moments and stages of his work. Finally, the influences originating from the biographies of the masters were added to the points of contact previously observed, which led to further research and to the clarification of unsolved questions. As a result of this study, it was concluded that, due to the shared use of a considerable number of elements such as philosophical principles, thematic aspects and visual elements, among others, it is clear that there is an identity between modern architecture, represented by Le Corbusier, and Jo?o Cabral s poetry, which is considered a subsidiary, in some measure, of architect s theory and practice / Este texto tem por objetivo estabelecer pontos de contato entre a poesia de Jo?o Cabral de Melo Neto e os preceitos da arquitetura moderna, personificados na produ??o do franco-su??o Le Corbusier, considerado grande precursor do movimento. Na inten??o de cumprir com tal objetivo, primeiramente foram feitos levantamentos de caracter?sticas filos?ficas e formais presentes nas obras de cada artista. Na seq??ncia, foi levado a cabo um estudo comparatista relativamente a tais propriedades,por meio do qual foi poss?vel obter subs?dios mais concretos no sentido de corroborar a hip?tese de trabalho do estudo, a de que existem pontos de identifica??o os dois artistas. Feitas as descri??es dos principais temas coesivos entre os autores, a disserta??o concentrou seu foco de interesse sobre a po?tica do escritor pernambucano, praticando a an?lise de um conjunto de composi??es que representam distintos momentos e est?gios de sua obra. This work considered relevant to deepen the knowledge about those people who passes their lives jailed by the walls of psychiatric hospitals and compose significant part of the world population. It also aimed to investigate the problem relative to the condition of being an inhabitant of a psychiatric hospital the Dr. Jo?o Machado Hospital (HJM), in the city of Natal/RN. The paper used different points of view (patients , families and professionals ) to define the profile of the inhabitants, to identify the possibility of insertion in substituting social equipment, to know the expectations of the inhabitants and their relatives regarding to the exit of the life shelter, to investigate the demands related to the net of cares social support for making feasible the discharge and to identify the difficulties that are involved in the exit of the chronic inhabitant of the hospital. There were defined three methodological phases: delineation of the identification, socio-economic and clinical profile of the inhabitants of the HJM; semi-structured interviews with professionals; and open interviews with inhabitants and family. It concluded that the psychiatric institutionalization contributes to the generation of chronic inhabitants in the psychiatric hospitals. Among the professionals, it was detached the defense of desospitalization, but an existence of devices of the asylum model. The relatives showed a resistance to participate in the care and the inhabitants exposed their desire to leave the hospital, as well like the wish of permanence. It was considered important: the construction of an extra-hospital net that enables to desinstitutionalization; the qualification of the technical; orientation to the family, stimulating its participation in the process of caring; give freedom to the individuals in mental suffering, enabling them to be ahead of their lives and express their desires and opinions; the implementation of an extended clinic that is capable of building new possibilities; and a subjectivity guided by the social enclosure / A exist?ncia de moradores cr?nicos nos hospitais psiqui?tricos imp?e um desafio ? desinstitucionaliza??o proposta pela Reforma Psiqui?trica, na medida em que o hospital se coloca como ?nica alternativa assistencial, enquanto n?o h? uma rede de servi?os substitutivos suficiente para acolher essa demanda. Considerou-se relevante aprofundar o conhecimento acerca desses sujeitos que passam suas vidas isoladas pelos muros de hospitais psiqui?tricos e comp?em parcela significativa da popula??o mundial. Objetivou-se investigar a problem?tica relativa ? condi??o de ser morador de um hospital psiqui?trico Hospital Dr. Jo?o Machado (HJM), na cidade de Natal/RN por parte dos t?cnicos, dos familiares e dos moradores, com vistas a: definir o perfil destes; identificar a possibilidade de inser??o em equipamentos sociais substitutivos; conhecer as expectativas dos moradores e familiares em rela??o ? desinstitucionaliza??o; investigar as demandas de cuidados e suporte social para viabiliz?-la e identificar as dificuldades envolvidas nesse processo. Realizaram-se tr?s etapas metodol?gicas: delineamento do perfil identificat?rio, s?cio-econ?mico e cl?nico dos moradores do HJM; entrevistas semi-estruturadas com t?cnicos do HJM e entrevistas abertas com moradores e familiares. Constatou-se que a institucionaliza??o psiqui?trica contribui para a gera??o de moradores cr?nicos nos hospitais psiqui?tricos. Entre os t?cnicos, destacou-se a defesa pela desospitaliza??o, mas tamb?m a exist?ncia de discursos institucionalizantes. Os familiares expuseram uma recusa ? participa??o no cuidado e os moradores evidenciaram a vontade de sair do hospital, bem como o desejo de perman?ncia. Verificou-se a import?ncia: da constru??o de uma rede extra-hospitalar que possibilite a desinstitucionaliza??o; da capacita??o da equipe t?cnica em rela??o ao exerc?cio de pr?ticas desinstitucionalizantes; da orienta??o ? fam?lia, estimulando a participa??o desta no cuidado; de possibilitar a apropria??o de suas vidas pelos sujeitos em sofrimento mental e a express?o de seus desejos e opini?es e da efetiva??o de uma cl?nica ampliada instauradora de uma subjetividade pautada na inclus?o social

Magistro darbo objektas – ryšių su visuomene panaudojimo galimybės prekinio ženklo komunikacijoje. Darbo tikslas - išanalizuoti ryšių su visuomene panaudojimą prekinio ženklo komunikacijoje. Pagrindiniai darbo uždaviniai: identifikuoti prekinį ženklą bei ryšius su visuomene, jų elementus bei ypatumus; išanalizuoti ryšių su visuomene panaudojimo prekinio ženklo komunikacijai galimybes ir daromą poveikį; ištirti ryšių su visuomene naudojimą Lietuvos prekinių ženklų komunikacijoje. Naudojantis literatūros šaltinių analizės bei lyginamuoju metodais bei kiekybine publikacijų analize, prieita prie išvados, kad efektyviausiai ryšiai su visuomene panaudojami prekinio ženklo sukūrimo, įvedimo į rinką stadijoje. Prekinis ženklas - tai prekės ženklas su pridedamąja jo verte, kuri sukuriama naudojant įvairias marketingo komunikacijos priemones, todėl prekinis ženklas egzistuoja tik vartotojo sąmonėje. Stiprus prekinis ženklas sukuriamas atsižvelgiant į tam tikrus dėsnius: vienas prekinis ženklas gali asocijuotis tik su vienu produktu ar produktų kategorija (kategorijoje produktai turi būti panašūs savo charakteristikomis); prekinio ženklo komunikacija turi būti nuoseklus procesas; sukurtą prekinį ženklą reikia įvesti į rinką ir palaikyti atitinkamai ryšių su visuomene ir reklamos pagalba; kiekvienas prekinis ženklas turi atrasti ir „pasisavinti“ tam tikrą žodį, kuris vėliau sukeltų norimas asociacijas vartotojo sąmonėje bei sukurti kokybės iliuziją, naudojant vardą ir aukštą kainą... The fundamental objectives are to identify brand and public relations, their elements and peculiarities; to analyze public relations practice opportunities and impacts in brand communication process; to analyze public relations practice in Lithuania’s brands communication. Using survey of analytical-theoretical method, there was come to a conclusion, that the most effective public relations practice exist in brand establishing and in introducing stage. Brand is the product or services with added values, which is created through marketing communication elements and exist only in consumers mind. Strong brands are created using special laws, which determines that: one brand could be connected only with one product or service; brand communication should be a consistent process; public relations should be used in brand introducing to the market stage while for the brand maintenance it is effective to use advertising; every brand should be associated with one main word. Seg?n Alter y Kermode (1997), la poes?a de Jo es asombrosa en su fuerza e inventiva. Se pretende demostrar que las poes?as de Walflan de Queiroz poseen dos corrientes definidas: si, por un parte, se vinculan al tema de Jo, mon doux Job , como ?l escribi? en un poema; por otra, diseminan una postura amorosa. Con el objetivo de situar al autor y a su obra, se discuten el contexto hist?rico y la agitaci?n cultural en R?o Grande do Norte en la d?cada de 1960. La lectura de O testamento de Jo nos llev? a realizar inicialmente una comparaci?n de la po?tica walflaniana con textos b?blicos para la construcci?n de una atm?sfera m?stica en el libro.
