O presente trabalho tem por objetivo apresentar as principais questões envolvidas no projeto da Filosofia das Formas Simbólicas de E. Cassirer, nome da obra considerada sua maior contribuição para a história da filosofia. Abordamos as questões epistemológicas e contextuais que motivam a elaboração da obra, sua estrutura e seus principais postulados metodológicos para, finalmente, entendermos os resultados de sua proposta, qual seja, transformar a crítica da razão iniciada por Kant numa crítica da cultura humana, entendendo por esta última o conjunto de todas as manifestações do espírito em sua atividade, caracterizada como um processo de autolibertação em relação à imediaticidade da vida. Para tanto, são apontados os principais interlocutores de Cassirer ao longo do desenvolvimento de seu programa filosófico, bem como as tendências filosóficas em relação às quais o filósofo quer marcar posição. / This text aims to show some of the main issues involved in the Project of The Philosophy of the Symbolic Forms of Ernst Cassirer, name of the work which turns out to be considered as his major contribution to the history of Philosophy. We dealt with epistemological and contextual issues that motivate the elaboration of Cassirers work, its structure and its main methodological postulates to, eventually, understand the results of his proposal, that is, to transform Kants critic of reason in a critic of human culture, understanding by the latter the set of all manifestations of spiritual activity, characterized as a process of self-liberation from the immediacy of life. To do so, we point Cassirers main interlocutors throughout the development of his philosophical project, as well as the philosophical tendencies which the philosopher wants to differentiate his own work from.

O presente trabalho tem como escopo central a análise da regra do prejuízo relacionada às nulidades no processo penal. Corolário da teoria da instrumentalidade das formas, a regra do prejuízo dispõe que somente será reconhecida a nulidade se do ato viciado resultar algum prejuízo para a acusação ou para a defesa. A despeito de sua importância para a construção de um modelo finalístico, referida categoria do prejuízo vem sendo aplicada de forma caótica pela jurisprudência pátria. Na realidade, o entendimento daquilo que de fato configura o prejuízo para efeitos do artigo 563 do Código de Processo Penal se perdeu em meio a decisões controversas e confusas acerca do tema. A regra, inicialmente adotada no processo civil, foi transportada ao processo penal sem as devidas cautelas e desprovida dos necessários ajustes. Inexiste uma sistematização mínima para aferição do prejuízo, sendo certo que hodiernamente se confere uma discricionariedade absoluta ao magistrado para determinar se no caso concreto há alguma lesão às partes. Nesse cenário, a precípua função da forma, que é assegurar uma proteção ao acusado contra eventuais arbitrariedades do Estado, muitas vezes é deixada de lado. Toda essa problemática tem gerado um ambiente instável para correta aplicação das nulidades, o que acaba por acarretar uma notável insegurança jurídica. O presente estudo tem a pretensão de propor um modelo racional de aferição do prejuízo, com base no qual o magistrado encontrará critérios mais claros para a aplicação das nulidades no processo penal. / This research aims to analyze the harmless error rule, strictly related to the subject of nullities in the criminal procedure. As a deployment of the theory of instrumentality of the procedural forms, the harmless error rule provides that a mistake will only cause the nullity of the procedure if there is evidence to support that the prosecution or the defense were actually harmed by that error. Although extremely important for the incorporation of teleological model of nullity, the mentioned harmless error rule has been wrongfully applied by Brazilian courts. In reality, the understanding of the actual meaning of the word harm, as per article 563 of the Criminal Procedure, has been lost throughout so many different confusing and controversial court decisions. The harmless error rule, initially used in civil cases, was brought to criminal procedure without the needed adjustments. There is no minimum systematization in order to identify a harmful error and, therefore, nowadays the judge has total discretion to determine in each case the severity of the error. Given this reality, the most important function of a procedural form, which is to protect the defendant against eventual arbitrary measures committed by the State, is normally forgotten. All these issues have caused an unstable background regarding the correct application of the nullities, leading to a noticeable legal uncertainty in this subject. This research has the intention to come up with a rational model of application of the harmless error rule, based on which the judges will find the necessary criteria to recognize nullities in criminal procedures.

Esta tese visa contribuir para a reflexão educacional e ética a partir da filosofia de Ernst Cassirer. Trata-se de uma pesquisa bibliográfica qualitativa com enfoque na produção teórica do referido filósofo. Embora Cassirer, em sua produção intelectual, não tenha escrito diretamente sobre pedagogia ou educação, nem explorado sistematicamente a questão ética, os problemas com os quais se preocupou no decorrer de sua produção filosófica fornecem subsídios importantes para uma reflexão nesse sentido. Para Cassirer, o ser humano é um animal symbolicum, um ser que cria signos e símbolos e, dessa forma, \"constrói\" a \"realidade\". Tal fato implica, para ele, a coexistência de diferentes formas de compreensão do mundo igualmente válidas, diferentes formas simbólicas, como ele denomina, por exemplo, o mito, a religião, a ciência. Tal pluralismo epistemológico e axiológico desencadearia, segundo ele, as antinomias da cultura, uma vez que cada uma das formas simbólicas também se julga como a portadora e detentora da verdade. Dessa forma, faz-se necessário explorar a concepção filosófica cassireriana em busca de respostas para uma coexistência equilibrada entre as diferentes visões de mundo. Assim, o objetivo geral desta pesquisa é expor as principais teses de Cassirer, explicitar o que está implícito ou difuso em sua obra no que se refere à ética e à educação e, deste modo, pensar como sua filosofia pode colaborar para reflexão sobre alguns problemas concernentes a tais temas. Pensar a ética na perspectiva da Filosofia das formas simbólicas implica considerar a coexistência de tais construções simbólicas, bem como a tolerância frente à conseqüente diversidade epistemológica e axiológica, destacando-se o fundamental papel da educação nesse processo. Dessa forma, considerou-se, também, outras abordagens éticas, especialmente a kantiana e habermasiana, visando destacar a especificidade da concepção cassireriana. Defende-se, por fim, a tese de que a filosofia, na perspectiva de Cassirer, é o instrumento mais adequado para a construção de uma ética universal, constituindo o meio decisivo para uma mediação competente entre as diversas formas de atribuição de sentido à realidade. / This thesis seeks to contribute to the educational and ethical reflection from the philosophy of Ernst Cassirer. It happens to be a qualitative bibliographic research focused on the theoretical production of the above mentioned philosopher. Although Cassirer, in his intellectual production, has not directly written about pedagogy or education, nor systematically explored the ethical issue, the problems which concerned him throughout his philosophical production, provide important subsides for a reflection on such matter. For Cassirer, the human being is an animal symbolicum, a being that makes signs and symbols and, thus, \"builds\" the \"reality\". Such fact implies, for him, the coexistence of equality valid different ways of understanding the world, different symbolic forms, as he names, for instance, the myth, the religion, the science. Such epistemological and axiological pluralism would trigger, according to him, the antinomies of culture, since each one of the symbolic forms also judges itself bearer and owner of the truth. This way, it is necessary to explore the cassirerian philosophical conception in search of answers for a balanced coexistence between the different visions of the world. Thus, the general purpose of this research is to expose the main theses by Cassirer, to turn explicit what is implicit or diffuse in his work regarding ethics and education and, therefore, think of how his philosophy is able to help the reflection over some problems related to such issues. Thinking of ethics under the perspective of Philosophy of Symbolic Forms means considering the existence of such symbolic constructions, as well as the tolerance towards the consequent epistemological and axiological diversity, highlighting the paramount role of education in this process. This way, it has also been considered some other ethical approaches, specially the kantian and habermasian ones, with the purpose of stressing the specification of the cassirerian conception. It is claimed, at last, the thesis that philosophy, under Cassirer\'s perspective, is the most suitable instrument for the construction of a universal ethics, building the ultimate means for a competent mediation between the several forms of attributing sense to reality.

O presente trabalho trata do reconhecimento das formas de uso da noção de representação estrutural no Ensino Superior de Química, interpretando-as à luz de um referencial teórico que relaciona a Mediação Semiótica de Lev Vigotski e a Filosofia das Formas Simbólicas de Ernst Cassirer. O sentido principal dessa relação é oferecer uma função representativa diferenciada para o tema. Procura-se informar sobre a urgência dessa nova função representativa a partir da demarcação do caráter degenerativo que pode ser encontrado em uma revisão das pesquisas sobre educação em química que tratam do tema. A realização combina uma ampla leitura teórica tanto acerca da representação em geral quanto no Ensino de Química, que serve à interpretação de treze episódios obtidos por meio de registros de áudio e vídeo, conseguidos através do acompanhamento de disciplinas em cursos de diferentes universidades e institutos superiores. Os episódios destacam o uso de signos não lingüísticos característicos da representação estrutural em temas da química orgânica e da química inorgânica. Em termos de sua atribuição semiótica, focalizamos nosso olhar na relação entre representante e representado. Destaca-se o caráter inovador de um aporte metodológico que considera o estudo de habilidades espaciais a partir de situações de ensino. A metodologia usada na interpretação dos episódios pressupõe que as diferentes formas de representação estrutural em uso no Ensino Superior de química podem ser qualificadas como ferramentas mediais, portadoras de um conteúdo espacial, que produzem formas simbólicas típicas. Os resultados contribuem para reafirmar o caráter crucial da mediação em situações de uso prioritariamente intralingüísticas, a partir da relação entre ferramentas destacadas como: gráficas, materiais e gestuais. Conclui-se que uma função representativa de uso mais própria para a semiose derivada do ensino da representação estrutural deve ser configurada pela assunção de uma atividade prioritariamente simbólica dos diferentes tipos de signos, em detrimento de seu reconhecimento como ícones, e que considere uma base normativa para sua realização. / The work deals with the recognition of the different uses of chemical structure representation in undergraduate courses. The theoretical framework is based under the semiotic mediation of Lev Vigotsky and the symbolic forms of Ernst Cassirer. The meaning of this theoretical combination is to provide a new representative function for structure representation. The need of this new way of interpreting the chemical structure representation is addressed by the degenerative character found through a wide revision of the literature. The lack of epistemological and ontological considerations is considered the most related cause for the inappropriate interpretation concerning the studies of chemical representation widespread. The methodology is implemented in disciplines related to the domain of both organic and inorganic chemistry. The episodes selected focalizes the semiotic domain among representative and represented. The study considers a new way of studying spatial abilities, considering class study situations and interpreting the different uses of chemical structure representation as related to graphic, material and gestural tools. The results indicate the prior character of the chemical structure representation as a medial intralinguistic element working in a symbolical meaning rather than an iconic one.

Propomos o estudo da realização do objeto direto no Português Brasileiro (PB) na referência ao interlocutor, a partir de um corpus formado essencialmente por textos produzidos por alunos do Ensino Fundamental II de uma escola particular da cidade de São Paulo. Estes textos consistem em uma proposta de redação direcionada à produção do objeto direto na referência ao interlocutor, orientados aos registros formal e informal da língua. Objetivamos identificar o tipo de complemento produzido pelos alunos nos dois registros. Interessa-nos investigar, sobretudo, as formas pronominais acusativas de 2a pessoa bem como a posição dos clíticos para estabelecer diálogo com os trabalhos que tratam das formas pronominais acusativas de 3a pessoa. Para isto, utilizamos o método variacionista de análise quantitativa, conforme estabelecido por Labov, e já consagrado em inúmeros estudos. Os resultados obtidos serão norteados pelas hipóteses descritas ao longo da introdução deste estudo, e a partir da confirmação de algumas e descarte de outras, buscaremos estabelecer uma adequação descritiva suficiente para comprovar o desaparecimento do clítico acusativo de 3a pessoa aplicado em referência ao interlocutor (Ramos 1999), substituído pela forma \"te\", ou para realinhar o clítico \"o\" no sistema pronominal da variedade paulistana do português brasileiro. / The aim of this study of the effectiveness of the direct object in Brazilian Portuguese (BP) at the interlocutor\'s reference, from a corpus essentially made by texts produced by students from a private school at São Paulo city. These texts consist in a request for composition directed to the production of the direct object at the interlocutor\'s reference, guided to the formal and informal registers of the language. The objective defined here is identifying the kind of complement that is produced by the students at the formal and informal registers. The main intention is investigate the second person accusatives pronominal forms as well as the clitics position, to establish connection with studies that work with the third person accusatives pronominal forms. In this sense, it was used the quantitative method of analysis, as establish by Labov, and already considerate in many studies. The results will be guided by the hypotheses described at the introduction of this study and from the confirmation of some hypotheses and the discard of others there will be establish a suit descriptive sufficient to corroborate the useless of the third person accusative clitic applied at the interlocutor\'s reference (Ramos 1999), replaced by the form \"te\" or to align the clitic \"o\" at the pronominal system of varieties of the Brazilian Portuguese from São Paulo.

Advinda da cana-de-açúcar, planta exótica introduzida no Brasil em meados de 1504, a cachaça tornou-se um produto tipicamente nacional e sua história desenvolveu-se juntamente com a história do país. Atualmente, a bebida é produzida em grande quantidade e alguns estados produtores já são reconhecidos como símbolos de qualidade, como por exemplo, o Rio Grande do Sul. O estado gaúcho é o quarto colocado em relação à produção de cachaça artesanal e destaca-se pelas iniciativas de melhoria e de apresentação dos produtos. A iniciativa mais marcante foi a criação, no ano de 2005, do grupo chamado Alambiques Gaúchos, o qual se constitui no objeto de estudo desse trabalho. O setor da cachaça sofre influência de diversos fatores, como a informalidade, questão cultural, conflitos internos, tributos, concorrência entre outros e a relação entre estes reflete na forma como a organização estudada se governa. A teoria que compreende esse estudo é a Nova Economia Institucional (NEI), principalmente na corrente microanalítica chamada Economia dos Custos de Transação (ECT), contemplada pelos trabalhos de Williamson. Por meio de um estudo de caso baseado no Esquema da Indução das Formas de Governança, proposto por Zylbersztajn, pretende-se compreender o encadeamento dos fatores que influenciam as transações do grupo Alambiques Gaúchos, identificando sua estrutura de governança e seus mecanismos de coordenação. Uma pesquisa quanti-qualitativa foi realizada e utilizou-se a estatística descritiva e a Análise Estrutural Discreta Comparada para a análise e interpretação dos dados. Concluiu-se que a estrutura de governança que poderia ser adotada pelo grupo seria a do tipo híbrida, no entanto, não há coordenação, o que impossibilita uma maior organização das empresas integrantes, prejudicando a inserção da cachaça gaúcha, tanto nos nichos de mercado nacionais quanto internacionais. / Coming from the sugar cane, exotic plant introduced in Brazil around 1504, the cachaça become a typical product and its history has developed along with the country. Nowadays, this drink is produced in large scale and some States producers are known for its high quality, Rio Grande do Sul is an example of that. This State is the fourth regarding the production of handmade cachaça, mainly because its initiatives of improvement and presentation of products. The most remarkable initiative was the creation, in 2005, of the group called Alambiques Gaúchos, that is the object of study on this paper. The sector of cachaça is influenced by several factors, such as informality, cultural issues, internal conflicts, taxes, competition, and it reflects on the way an organization governs itself. The theory in this study is the New Institutional Economics (NIE), mainly in the micro analytical method called Transaction Cost Economics (TCE), covered by the work of Williamson. Through a case study based on the Induction Scheme of the Forms of Governance, proposed by Zylbersztajn, the aim is to understand the factors that influence the transactions of the group Alambiques Gaúchos, identifying the governance structure and its mechanisms of coordination. A quantitative and qualitative research was done and descriptive statistics and Comparative Structural Analysis Discrete to the analysis and interpretation data. It was concluded that the governance structure concluded that the governance structure that could be adopted by the group, would be hybrid, however, there is no coordination. It makes not possible a larger organization of members, prejudicing the inclusion of the handmade cachaça both in national or international markets.

Este estudo se propõe a analisar como ocorre o processo de organização do Global Shapers Porto Alegre, a partir da perspectiva do pensador Georg Simmel, considerando que o processo é estruturante e as formas de sociação são ao mesmo tempo parte do processo e suas cristalizações. Para tal, realizou-se uma pesquisa etnográfica. Os dados produzidos em campo foram analisados a partir das formas de sociação de Simmel, tomadas como abstrações para interpretá-los: A Sociabilidade, o Conflito, a Subordinação e Superordenação e o Estrangeiro. A forma de se organizar deste grupo salienta a busca dos indivíduos por expressarem-se. Ao mesmo tempo em que revela traços marcantes da tragédia da cultura moderna, descrita por Simmel, se aproxima ao método do Campo Aberto proposto por Robert Cooper. / This study aims to analyze how the Global Shapers Porto Alegre organizing process happens, from the perspective of Georg Simmel, considering that the process is structuring and that the forms of sociation are both part of the process and its crystallization. For this, an ethnographic research was carried out. The field data was analyzed using Simmel‟s forms of sociation, taken as abstractions to interpret them: Sociability, Conflict, Subordination and Superordination and The Stranger. The way this group organizes itself emphasizes the pursuit of individuals for expressing themselves. At the same time as it reveals strong features of the tragedy of modern culture, described by Simmel, it also approaches the Open Field method proposed by Robert Cooper.

Muitas informações disponíveis na Web estão armazenadas em bancos de dados on-line e são acessíveis somente após um usuário enviar uma consulta por meio de uma interface de busca. Essas informações estão localizadas em uma parte da Web conhecida como Web Oculta ou Web Profunda e, geralmente, são inacessíveis por máquinas de busca tradicionais. Uma vez que a forma de acessar os dados na Web Oculta se dá por intermédio de submissões de consultas, muitos trabalhos têm focado em como preencher automaticamente campos de formulários. Esta tese apresenta uma metodologia para o preenchimento de formulários na Web Oculta. Além disso, descreve uma categorização das técnicas de preenchimento de formulários existentes no estado da arte de coleta na Web Oculta, produzindo uma análise comparativa entre elas. A solução proposta descreve um método automático para seleção de valores para campos de formulários combinando heurísticas e técnicas de aprendizagem de máquina. Experimentos foram realizados em formulários reais da Web, de vários domínios, e os resultados indicam que a abordagem proposta apresenta desempenho comparável aos obtidos pelas técnicas do estado da arte, sendo inclusive significativamente diferente com base em avaliação estatística. / A large portion of the information on the Web is stored inside online databases. Such information is accessible only after the users submit a query through a search interface. TheWeb portion in which that information is located is called HiddenWeb or DeepWeb, and generally this part is inaccessible by traditional search engines crawlers. Since the only way to access the Hidden Web pages is through the query submissions, many works have focused on how to fill in form fields automatically, aiming at enhancing the amount of distinct information hidden behind Web forms. This thesis presents an automatic solution to value selection for fields in Web forms. The solution combines heuristics and machine learning techniques for improving the selection of values. Furthermore, this proposal also describes a categorization of form filling techniques and a comparative analysis between works in the state of the art. Experiments were conducted on real Web sites and the results indicated that our approach significantly outperforms a baseline method in terms of coverage without additional computational cost.
