The study aims to illustrate how women victims of male violence in intimate relationships are treated during the legal process and with professional perspective describe what women’s experiences considered to be in the legal process. The study also aims to draw attention to the interventions for abused women during the legal process. The results are based on interviews with professionals in the justice system, and on observations in the courtroom. Overall our results show that abused women are in need of a great quantity of help and support before, during and after the negotiation. The legal process is very stressful for the women. In conclusion, we believe that the social services should take greater responsibility for abused women during the legal process and provide support to women so that they are able to get through the legal process without a great deal of emotional damage.

Os atuais modelos de atenção à saúde minimizam a comunicação entre médicos e pacientes. Cresce o número de queixas formalizadas contra atitudes médicas. É grande o impacto social dessas denúncias. Faltam estudos, no Brasil, que lhes dêem significado. Objetivo: Este trabalho pretende quantificar e qualificar as reclamações apresentadas ao Conselho Regional de Medicina do Estado de Goiás contra médicos ali inscritos. Método: Estudo descritivo, retrospectivo, sobre as denúncias formalizadas em Goiás, entre 2000 e 2006. Leitura interpretativa da evolução processual das queixas ajuizadas no CREMEGO e cálculo da eficácia das ações dali decorrentes. Resultado: Foi significativa a flutuação na freqüência de reclamações entre 2000 e 2006, no Estado de Goiás; 62% das queixas alegaram incompetência do profissional e inadequada relação médico/paciente. O número de queixas contra as especialidades de Cirurgia Plástica e Ortopedia representam 50% das queixas em relação a todos os especialistas. Houve 73 denúncias contra quatro profissionais da cirurgia plástica e um médico foi denunciado 49 vezes. Em 60% dos casos a denúncia foi feita por pessoa física. Discussão: Foram considerados improcedentes 17% das denúncias e 35% das restantes se transformaram em processos éticos (10% arquivados); O julgamento levou à advertência e censura em alguns casos e suspensão (5%) e cassação do exercício profissional (3%). Mais de 90% dos casos anuais foram resolvidos. Conclusão: O problema tem sido abordado com eficácia e eficiência, apesar de imperfeições na gestão do banco de dados, que impedem algumas análises qualitativas da questão. / Introduction: The strengthening of citizenship reinforces the instruments to defend the individual rights. The health care models currently used minimize the communication between doctors and patients. The number of formal complaints against attitudes of doctors has been increasing. The social impact of these accusations is great, but there is lack of studies in Brazil and in the state of Goiás to make them meaningful. Objective: This work was intended to quantify and qualify the complaints presented to the Regional Medical Council of the state of Goiás against medical acts. Methodology: Descriptive, retrospective study of the denouncement formally registered in the state of Goiás between 2000 and 2006; interpretative reading of the processual evolution of the complaints formalized in the Regional Medical Council of the state of Goiás and calculation of the efficacy of the actions resulting from this. Results: The variation in the complaint frequency between 2000 and 2006 was not high; 62% of the complaints concerned professional incompetence and inadequate doctor–patient relationship. The number of complaints regarding plastic surgery and orthopedics corresponded to 50% of the ones related to specialists. There were 73 charges against four plastic surgeons and one doctor was denounced 49 times. In 60% of the cases the accusations were made by individuals. Discussion: The Regional Medical Council considered 17% of the charges groundless and 35% of the remaining accusations turned into ethical processes (10% of which were filed). The Regional Medical Council session resulted in admonition and censure in some cases, suspension (5%), and cancelation of the register to practice medicine (3%). Over 90% of the annual cases were solved. Conclusion: This problem has been effectively and efficiently approached, in spite of imperfections in data base management, which prevents qualitative analyses of this matter. / BV UNIFESP: Teses e dissertações

A sanção jurídica da sociedade / The legal sanction of society

A teoria dos sistemas sociais autorreferenciais é uma teoria sociológica inovadora. Na verdade, trata-se de uma superteoria baseada em premissas construtivistas que se pretende universal, ou seja, capaz de descrever qualquer fenômeno social, incluindo as teorias rivais. O criador da teoria, o sociólogo alemão Niklas Luhmann, escreveu obras sobre uma grande variedade de temas: desde do Direito até a Arte; de uma teoria geral dos sistemas sociais até uma teoria abrangente da sociedade. Como uma teoria de base construtivista, a teoria dos sistemas sociais autorreferenciais observa observações, mais especificamente, observa comunicações. A teoria adota, assim, um fundamento teórico singular que exige novas descrições dos fenômenos sociais, ainda que já tenham sido exaustivamente estudados. Esse é o caso de sanções legais. Luhmann, contudo, não fornece uma descrição sistêmica das sanções legais. Ao invés disso, usa o termo de maneiras diferentes em seus estudos. As sanções a que ele se refere em seus estudos sobre o sistema político parecem estar mais relacionadas à violência física do que aquelas que ele mencionou ao descrever o sistema jurídico. Esta indefinição é, provavelmente, fruto do que chamei \"noção comum de sanção\". A noção comum, menos do que um conceito de sanção, é o acumulado de séculos de esforços para definir medidas de controle social. Portanto, além de vaga, a noção comum de sanção é baseada em premissas que são estranhas à teoria dos sistemas sociais. Assim, é necessária uma nova descrição dos fenômenos sociais associados à noção comum de sanção, a fim de expandir as possibilidades da teoria dos sistemas sociais. A observação desses fenômenos do ponto de vista da teoria dos sistemas sociais autorreferenciais resultou na descrição de não apenas uma, mas de quatro estruturas sociais diferentes. A primeira foi identificada como sanção simbiótica e pode ser tanto negativa - se associada ao uso da violência - como positiva - se associado à satisfação das necessidades. A segunda é o programa do sistema jurídico que cumpre a função de memória no sistema, mantendo assim as expectativas normativas. A terceira estrutura é uma variação da segunda; são programas oriundos dos processos legais que também cumprem função de memória. Estes programas diferem das sanções simbióticas na distância do uso da violência física. Enquanto a sanção simbiótica demonstra claramente a sua conexão com a violência frente à desobediência, os programas apontam para outros programas sancionatórios antes de se referirem à violência física. De um modo muito diferente, o quarto tipo de estrutura social, os programas sancionatórios de exclusão, identificados com as penas privativas de liberdade, estão intimamente ligados à violência física. Estes programas, embora realizem também a função de memória, cumprem outra função: a gestão de exclusão na sociedade moderna. / The theory of self-referential social systems is an innovative sociological theory. In fact, it is a super theory based on constructivist premises that claims to be a universal theory, meaning, being able to describe any social phenomenon, including rival theories. The creator of the theory, German sociologist Niklas Luhmann, wrote works on a great variety of themes: from Law to Art, from general social systems theory to a comprehensive theory of society. As a constructivist based theory, Self-referential social systems theory observes observations, more specifically, observes communications. The theory adopts, thus, a singular theoretical background that demands new descriptions of social phenomena, no matter if already thoroughly investigated. That would be the case of legal sanctions. Nonetheless, Luhmann does not provides a systemic description of legal sanctions. Instead, he uses the term in different ways on his studies. The sanctions to which he refers in his studies on the political system seem to be more related to physical violence than those he mention while describing the Legal system. This vagueness is most probably due to what I have called common notion of sanction. The common notion, less than a concept of sanction is the gathering of many efforts to define social order generating measures. Therefore, besides vague, the common notion of sanction is based upon premises that are strange to the self-referential social systems theory. A new description of the social phenomena associated with the common notion of sanction is therefore required in order to expand the theory\'s possibilities. The observation of these social phenomena from the viewpoint of the self-referential social systems theory resulted in the description of not just one, but four different social structures. The first one is to be called symbiotic sanction and may be both negative if associated with the use of violence as positive if associated with the satisfaction of needs. The second one is a legal system\'s program that fulfills memory function in the system, thus retaining normative expectations. The third structure is a variation of the second one; a program originated from legal processes that also fulfills memory function. These programs differ from the symbiotic sanctions in the distance from the use of physical violence. While the symbiotic sanction clearly demonstrates its connection with violence when contradicted, the programs point to other sanction programs before refer to physical violence. In a much dissimilar way, the fourth type of social structure, exclusion sanction programs, identified with detentions, are closely linked to physical violence. These programs, although capable of memory function, fulfill yet another function: managing exclusion in modern society.

The development of a protocol to ensure the recognition of the rights of children during a legal process

Children’s rights are a world wide clarion call – yet, when it comes to implementing it in practice, the hearts of everybody starts racing because suddenly the issue is not just academic, it’s personal. In practice it is evident that children’s voices are not being heard or taken into consideration – while adults are solely responsible for making decisions that affects the lives children have to live. Children continue to suffer and are being traumatised due to the fact they have to live a life decided by adults who presumed to know the best. The fact that there is no consistency when working with children, specifically during the legal process, has been experienced as a serious problem. Research was undertaken to rectify the situation. The hypothesis for the intended study was formulated as follows: A protocol that can be followed by professional role-players can ensure that children’s rights will be protected during a legal process. The key professional role-players involved with children during a legal process have been identified as social workers, commissioners of child welfare, lawyers, family advocates and judges. In the qualitative study, a semi-structured schedule was utilized as guide for the personal interviews with each of the respondents. From this data, a protocol was developed and evaluated after implementation in order to determine whether such a protocol will enable the professional role-player to protect the rights of children during a legal process. The quantitative results proofed that a protocol as a hands-on guideline, is a much needed tool for the professional role-player in practice. From the study it was concluded that the existence of a protocol will enable the professional role-player to protect children’s rights during a legal process. Important recommendations included the following: <li>Specific skill training of the professional role-players in working with children.</li> <li>The value of implementing a separate family court system, involving all the professional role-players.</li> <li>The different professional role-players should respect each other’s profession, their abilities and skills and perform as a team to the benefit of the children in the legal process. The aim of this thesis is description of the EU legal process during and after Brexit. The thesis includes description of functioning of European Union institutions. Also, there is a description of the legislative process, a description of the course of the referendum on Brexit and a summary of the impacts, especially the economic ones. One of main themes of the practical part is the analysis of changes that will occur in institutions after the departure of Great Britain - what will be the new composition and what specific changes will happen here. In the practical part, the research question was set: How will the failure of the British mandate influence the course of voting in the EU Council? For finding answer on the research question, was made an analysis of legal acts which was approved by the ordinary legislative procedure 2014-2018. There is a special focus on the UK position during the vote analysis. The analysis is based on data that comes from the EU portal, which allows access to EU law - Eur-lex.europa.com. Data was collected and divided by reference years and by the country's position.

The central question is to know whether in the rituals of the current procedural law one can find permanence, similarities and even identity with religious rituals, with special reference to the jury trials. Looking for an answer we made a historical research for anthropological and sociological works which show that law was born from religion and that they remained tied together until modern age with the separation between church, religion and state, and the secularization of society, when law acquired its autonomy in the general practice and procedure. However, despite the separation, the research seeks to demonstrate that the current judicial rituals, especially those of the jury trials in the Brazilian context, still maintain similarities and even identity with religious rituals that since the Middle Age integrated and inspired the practice of law in general and particularly the jury. To elaborate this position a field observation was made in a jury trial, with the aid of theoretical scholars that study religious ritual within the phenomenology of religion and others who support the permanence of religious rituals in the rituals of the legal process / No amplo campo do Direito, delimitamos para nossa pesquisa o tema Religião e Direito. A pergunta central busca saber se nos rituais do direito processual atual podemos encontrar permanência, semelhanças e até identidade com os rituais religiosos, com especial referência ao Tribunal do Júri. Em busca de resposta elaboramos uma pesquisa histórica que mediante referenciais da antropologia e sociologia demonstrou-se que o Direito nasceu no berço da Religião e nele permaneceu até a modernidade com o advento da separação entre Igreja e Estado e a secularização da sociedade, ocasião em que adquire sua autonomia na prática em geral e no âmbito processual. Entretanto, apesar da separação, a pesquisa busca demonstrar que nos rituais atuais do judiciário, em especial nos rituais do Tribunal do Júri, no contexto brasileiro, permanecem semelhanças e até identidade com os rituais religiosos que desde a Idade Média integraram e inspiraram a prática do Direito em geral e peculiarmente no Tribunal do Júri. Para trabalhar esta posição foi feita uma observação de campo em um Tribunal do Júri e se recorreu a teóricos que trabalham a ritualística religiosa no âmbito da fenomenologia da religião e outros que sustentam a permanência dos rituais religiosos nos rituais do processo jurídico

L'étude vise à dépasser le constat paradoxal d'une notion omniprésente et pourtant inconsistante endroit public. La parcimonie des études consacrées à la coordination tranche avec les nombreuses occurrences du vocable dans les textes juridiques. Comment interpréter une telle circonspection doctrinale ? Une première réponse consiste à estimer que la coordination n'a aucune existence endroit ; une autre posture est de considérer que la coordination n'a aucune pertinence en droit. Le postulat selon lequel ces deux affirmations sont erronées constitue le point de départ d'une recherche qui a permis d'esquisser une définition fonctionnelle de la coordination : il s'agit d'un mode d'ordonnancement flexible de l'organisation, de l'action et du droit de l'Etat, congruent avec le cadre juridique pluriel et complexe actuel qui interroge les procédés classiques verticaux. Trois figures de la coordination en droit public ont été dégagées : une « coordination-integration » qui permet de préserver la cohésion de la structure administrative de l'Etat en dépit d'un phénomène de fragmentation ; une « coordination-articulation » qui recherche la cohérence de centres de décision politique dans un contexte de polycentrisme ; une « coordination-harmonisation » qui tend à la concordance de règles juridiques marquées par le pluralisme. / The study aims to overcome the paradox of an omnipresent, yet inconsistent notion in Public Law.The sparsity of studies on coordination contrasts with the many occurrences of the term in the legalcorpus. How to interpret this doctrinal caution? One answer is to deem that coordination is non existentin Law; another position is to consider that coordination is irrelevant in Law. Theassumption that both statements are wrong is the starting point of this research that had led to a functional definition of coordination seen as a flexible method of ordering the State organization,action and law, congruent with the current plural and complex legal framework that query vertical legal processes. Three figures of coordination in Public Law were identified: a "coordination integration" helping to preserve the cohesion of the administrative structure of the State despite a fragmentation phenomenon; a "coordination-articulation" which seeks consistency in political decision centers in a polycentric context; "coordination-harmonization" which tends to the concordance of legal rules characterized by pluralism.

O trabalho tem por objetivo analisar em que medida o Poder Executivo está autorizado pela Constituição Federal e pela lei estadual paulista a conferir a contribuintes do Imposto sobre Operações relativas à Circulação de Mercadorias e sobre Prestação de Serviços de Transporte Interestadual e Intermunicipal e de Comunicação (ICMS) tratamentos tributários diferenciados, mediante a expedição de norma individual e abstrata que modifique a sua regra-matriz de incidência ou a forma de cumprimento de obrigações instrumentais. Cumpre-nos examinar a legitimidade da concessão de regime especial diante dos princípios da legalidade, igualdade e devido processo legal. Esta análise pressupõe o exercício da função administrativa discricionária quando da identificação dos casos especiais nos quais o contribuinte encontra dificuldades para cumprir com suas obrigações tributárias sem prejuízo de sua atividade econômica. A preocupação é como compatibilizar a possibilidade de modificação do tratamento tributário aplicável a este contribuinte com (i) a regra-matriz de incidência do ICMS delineada no texto constitucional e veiculada pelo Poder Legislativo estadual e (ii) a manutenção da neutralidade do Estado e das condições de livre concorrência. Buscaremos examinar em quais condições normativas poderia o Poder Executivo Estadual conceder regimes especiais consensuais de tributação pelo ICMS. / The work aims to analyze to which extent the Executive Branch is authorized by the Federal Constitution and by the São Paulo State law to grant to taxpayers of the State Value Added Tax (ICMS) special tax treatments upon the issuance of an individual and abstract rule that modifies the general legal provision on the levy of this tax or that modifies how to comply with the instrumental obligations. We shall examine the lawfulness of the concession of the special tax regime in view of principles of legality, equality and due process of law. This analysis assumes the exercise of discretionary administrative function when identifying the special cases in which the taxpayer finds it difficult to meet their tax obligations without jeopardizing its economic activity. The concern is how to reconcile the possibility of modifying the tax treatment applicable to that taxpayer with (i) the general legal provision on the ICMS levy outlined in the Constitution and enacted by the state Legislative Branch and (ii) maintaining the neutrality of the state and the free competition conditions. We will seek to examine in which normative conditions the State Executive Branch could grant consensual special ICMS tax regimes.

It focuses on the sanctioning competence of regulatory agencies, notably what concerns the procedural guide that conditions its exercise. It aims at gathering varied elements, many times dispersed over the legal system, so it is possible to list, with a satisfactory degree of detail, the procedural constitutional guidelines which are indispensable to the sanctioning of private entities through punitive action by regulatory agencies. It highlights the due legal process clause, for the abundance of the protective set there is around it, as a guiding constitutional principle for the application of sanctions by regulatory agencies. It examines the repercussion of the constitutional principle of the due legal process on Administrative Law, focusing on the most relevant principles on which the first unfolds itself. It analyzes, in light of the due legal process principle, the sanctioning administrative procedure developed in regulatory agencies. In conclusion, it is asserted that there is no room, in the Brazilian legal system as a whole, for sanctions to be applied summarily; that there reigns, in our system, an absolute presumption, dictated by the Constitution, that only through regular procedures can the best and fairest decision, concerning cases in which the rights of private parties could be affected, be taken by the public administration; that, respecting the principle of the right to a fair hearing, it is indispensable that there be motivation of a decision that imposes a sanction; that there should be, in homage to the principle of full defense and for the need to preserve the autonomy of the regulatory party, an appeal court in every agency; that the principles listed in the federal law No. 9.784/1999 should be mandatorily monitored by the agencies, for this is the only alternative consistent with the Constitution / Aborda o crescente destaque que, nas ?ltimas d?cadas, tem adquirido o processo administrativo dentro do Direito Administrativo, ao mesmo tempo que ressalta a sintonia que guarda a processualidade com a nova fei??o assumida por este ramo jur?dico.
