The indigenous law of contract with particular reference to the Swazi in the Kingdom of Swaziland

This study was undertaken to establish whether the legal phenomenon known as a contract exist in indigenous legal systems and in particular, among the Swazi. As the underlying aims and consequences of indigenous contracts differ not only between indigenous peoples but is also affected by the degree of westernisation that has taken place, a micro study has been done in semi-rural areas in the Kingdom of Swaziland to establish if the existing value systems are altered or replaced when western legal institutions are introduced. Data was obtained by way of interviewing a panel of experts and compared with available literature. Through the process of gathering information, the legal principles were described and the functioning of social processes noted. Different indigenous contracts and general principles were identified. It must, however, be noted that a contract is more than a device for establishing the economic and legal implications of a transaction. Most contractual disputes are resolved outside the courts through negotiated settlements to restore harmony in the community. Although the Swazi law of contract is showing clear signs of adapting to new developments, there is proof that established legal principles and Swazi values are being retained. This study will not only be useful as a source of information for both Swazi courts and administration, but could also serve as a basis for codification intended by the Swazi Government. For that purpose, a memorandum has been compiled for consideration by the Swazi authorities. The compatibility of Swazi law and custom with a Bill of Rights was also evaluated and suggestions were made for possible law reform in the Kingdom of Swaziland. / Jurisprudence / LL.D.

Provision of education to minority groups in Austria

Austria's aim to provide equitable education to its citizens is an ongoing process. In 1747 a decree opened schools to all children. From 1891 to 1941 schooling was compulsory for children between 6 and 14. In 1955 the Austrian Constitution guaranteed Austrian minority groups equal access to education. In 1966 and 1976 legislation further guaranteed minority groups' right to be taught in their home language subject to certain provisos. Currently minority groups are supposed to be taught in their horne language for the frrst three years of school and school is compulsory for nine years. This study wished to establish whether minority groups are, in fact, provided with education as provided for by law, and examined the situation in the United States of America, the United Kingdom and Canada as well. An insurer should not be allowed to cancel in the event of misrepresentation (nondisclosure) if it would still have concluded the contract, knowing the truth. In the event of affirmative warranties a right to cancel should be available if breach of warranty reasonably affected the particular insurer's assessment of the risk, but not if the contract would still have been concluded. In the event of promissory warranties, cancellation should only be available if breach of warranty reasonably caused the loss. Milletsystemet : Minoritetsskydd och grupprättigheter i ett historiskt perspektiv

Minority protection mechanisms in international law aim to guarantee certain individual rights to persons belonging to ethnic, religious or linguistic minorities, such as freedom of culture, religion and language. These rights can be considered to be of collective interest for minority group identity and therefore often require the possibility of collective enjoyment. In addition to general human rights and principles of non-discrimination, minority protection can alternately be ensured through minority specific rights. However, minority specific rights would not operate effectively without evolving a concept of collective (or group) rights in international law. Hence, while this kind of approach can provide legal methods for balancing the interests of individuals, groups and the state, it creates the possibility of conflicts with the international framework of individual rights. The ottoman millet system sets a historical example of minority protection instruments based on a collective concept of human rights. Furthermore, the ottoman history offers an illustration of what could go terribly wrong with a collective rights model. By analyzing the millet system and the ottoman legal reforms in the nineteenth century I will discuss reoccurring issues with collective rights. I will argue that incorporating collective rights within a structure founded on individual rights is a problematic way of protecting individuals belonging to minorities and other vulnerably ethnic groups. Looking through the historical development of universal human rights some important aspects of its main principles will be brought up in this paper.

Infrastructure, Participation and Legal Reforms: An Analysis of the Politics and Potentials of Village Elections in China

Inspired by critiques of controlled elections under “single-party rule,” this dissertation explores the performance, implications and potentials of China’s village elections. It first reviews the most important studies on the progress of China’s grassroots democracy and then analyzes the social-political background of village self-management which to date has been neglected in the academic literature. Based on empirical studies conducted in Sichuan, this dissertation investigates the roles and attitudes of various participatory groups in village elections and in the course of electoral reforms. It also discusses the failure of the existing law to set out fundamental rules for village elections and to effectively guide people’s behavior. The mischiefmakers: woman’s movement development in Victoria, British Columbia 1850-1910

This thesis examines the beginning of Victoria, British Columbia’s, women’s movement, stretching its ‘start’ date to the late 1850s while arguing that, to some extent, the local movement criss-crossed racial, ethnic, religious, and gender boundaries. It also highlights how the people involved with the women’s movement in Victoria challenged traditional beliefs, like separate sphere ideology, about women’s position in society and contributed to the introduction of new more egalitarian views of women in a process that continues to the present day. Chapter One challenges current understandings of First Wave Feminism, stretching its limitations regarding time and persons involved with social reform and women’s rights goals, while showing that the issue of ‘suffrage’ alone did not make a ‘women’s movement’. Chapter 2 focuses on how the local ‘women’s movement’ coalesced and expanded in the late 1890s to embrace various social reform causes and demands for women’s rights and recognition, it reflected a unique spirit that emanated from Victorian traditionalism, skewed gender ratios, and a frontier mentality. Chapter 3 argues that an examination of Victoria’s movement, like any other ‘women’s movement’, must take into consideration the ethnic and racialized ‘other’, in this thesis the Indigenous, African Canadian, and Chinese. La fonction réformatrice du droit comparé : essai de conceptualisation à la lumière du droit civil iranien

Cette recherche est axée sur deux sujets principaux. Premièrement, dans l’objectif de réforme du droit et d’amélioration des systèmes juridiques, nous nous intéresserons à l’étude des formes d’application du droit comparé. La première partie portera sur la fonction réformatrice du droit comparé, notamment au travers d’analyse de la méthodologie et des évolutions contemporaines de la science du droit comparé. De plus, le concept de réforme et les conditions préliminaires nécessaires à l’opération de réforme seront étudiés ici et nous permettrons de démontrer comment cette opération impose davantage de complexité que la seule révision législative via la transplantation des règles et des institutions étrangères. Ces difficultés rendent nécessaire une mobilisation de différentes méthodes fonctionnelle et culturelle pour augmenter la chance de prise de la greffe juridique du droit des pays plus développés vers les pays en voie de développement. Une étude interdisciplinaire du contexte des ordres juridiques variés pourrait nous aider à prendre en compte les diverses circonstances de chaque nation. Dans une seconde partie, nous tenterons d’appliquer ou de conceptualiser ce modèle concernant la réforme sur un cas concret : le droit civil iranien. Ce droit est en effet un bon exemple de métissage des règles traditionnelles du droit musulman (Charia ou plus précisément feqh) chiite avec la tradition civiliste romano-germanique. Nous tenterons de présenter une perspective historique de la modernisation du droit iranien et du contexte dans lequel ce droit a évolué et s’est transformé. Tout au long du siècle suivant la Révolution constitutionnelle (Mashrouteh) et visant la modernisation de la structure politique et juridique, l’Iran a connu différentes époques, parfois favorisants les valeurs traditionnelles et d’autres fois, donnant avantage aux valeurs modernes. Un mouvement de modernisation inspiré des pays européens est amorcé, mais le manque d’institutionnalisation de la modernité en Iran et la Révolution islamique ont fait reculer la majorité des fruits du Mashrouteh vers une idéologie traditionnelle-islamique. La méthode comparative nous aide donc à concrétiser la phase de diagnostic juridique et social en Iran, notamment à la lumière de la comparaison avec les systèmes juridiques québécois et français. Finalement, nous essaierons de présenter certaines solutions par le biais de la comparaison internormative (avec d’autres interprétations du feqh) et législative (avec l’observation d’autres droits positifs étrangers) pour bâtir un nouvel ordre juridique iranien en harmonie avec les évolutions contemporaines en Iran. / This research focuses on two main topics. First, with the aim of reforming the law and improving legal systems, we will study various forms of applying the science of comparative law. At the first part, we will focus on the reforming function of comparative law through an analysis of the methodology and contemporary developments in this discipline. Moreover, the concept of reform and the preliminary conditions necessary for the reform operation will be studied, and we will demonstrate how this operation imposes more complexity than merely legislative revision through the transplantation of foreign rules and institutions. These difficulties make it necessary to mobilize different functional and cultural methods to increase the chance of taking legal transplant from the more developed countries to the developing countries. An interdisciplinary study of the context of various legal orders could help us to take into account the varying circumstances of each nation. In a second part, we will try to apply or conceptualize this model concerning the reform on a concrete case: the Iranian civil law. This law is a good example of the interbreeding of the traditional rules of Shiite Muslim law (Sharia or more precisely feqh) with the RomanoGermanic civil law tradition. We will present a historical perspective of the modernization of Iranian law and the context in which it has evolved and transformed. Throughout the century following the Constitutional Revolution (Mashrouteh) and aimed at modernizing the political and legal structure, Iran went through different eras, sometimes favoring traditional values and other times giving advantage to modern values. A movement of modernization inspired by European countries was initiated, but the lack of institutionalization of modernity in Iran and the Islamic Revolution have pushed the majority of the fruits of the Mashrouteh towards a traditional-Islamic ideology. The comparative method therefore helps us to concretize the phase of legal and social diagnosis in Iran, particularly in the light of the comparison with the Quebec and French legal systems. Finally, we will try to present some solutions through the internormative (with other interpretations of the feqh) and legislative (with the observation of other positive foreign laws) comparisons to build a new Iranian legal order in harmony with the contemporary evolutions in Iran

L'action extérieure de l'Union Européenne en faveur du renforcement du regime des droits de propriété intellectuelle en Chine / The European Union’s external action in favor of strengthening the intellectual property rights regime in China

Malgré l’amélioration du régime des droits de propriété intellectuelle (DPI) en Chine après l’accession de celle-ci à l’Organisation mondiale du commerce (OMC) en 2001, la question relative aux DPI demeure l’un des « sujets de vive préoccupation » dans le commerce sino-européen. Selon la stratégie européenne visant à assurer le respect des DPI dans les pays tiers, adoptée en 2005 et renouvelée en 2014, la Chine est ciblée par la Commission européenne comme le premier pays tiers dans lequel les autorités locales ne prennent pas de mesure efficace pour s’attaquer aux problèmes de violations des DPI. En raison des enjeux politiques et économiques importants pour l’UE, son intervention est nécessaire pour améliorer le régime des DPI et l’environnement de l’investissement en Chine. L’analyse de l’action extérieure de l’UE s’appuie sur l’étude des instruments auxquels elle recourt en vue de renforcer la protection et le respect des DPI en Chine. L’objet de notre recherche est d’examiner la manière dont l’Union choisit d’exploiter les instruments à géométrie variable au sein des enceintes multilatérale et bilatérale. Deux axes distincts mais complémentaires orientent la mise en œuvre de l’action extérieure de l’UE vis-à-vis de la Chine : l’approche coopérative, d’une part, et de l’approche conventionnelle, d’autre part. L’approche coopérative vise d’abord à rapprocher le régime juridique chinois des standards les plus élevés du droit de l’UE. En dépit d’un certain nombre de difficultés limitant l’efficacité de l’action extérieure de l’UE, la coopération bilatérale avec la Chine permet de contribuer à l’amélioration du régime juridique chinois. La convergence normative devrait ensuite faciliter l’apparition d’une approche commune entre l’UE et la Chine sur le plan conventionnel. Il importe à cet égard de souligner la position divergente de la Chine face à la promotion de l’UE, par la voie conventionnelle, d’un renforcement de la protection et du respect des DPI. Malgré la convergence accrue des positions européenne et chinoise favorables à la protection « ADPIC-plus » des DPI, la Chine se montre réticente voire hostile envers les initiatives conventionnelles de l’UE tendant à renforcer les mesures relatives au respect des DPI. / Despite the improvement of China’s intellectual property rights (IPR) regime after this country’s World Trade Organization (WTO) accession in 2001, the IPR remains one of “major concerns” in Sino-European trade relation. According to European strategy for the enforcement of intellectual property rights in third countries, adopted in 2005 and renewed in 2014, China is identified by the European Commission as first priority country, in which the local authority does not take effective measures to tackle the problems caused by IPR violations. Taking into account the EU’s important political and economic concerns, his action is necessary in order to improve the IPR regime and the investment environment in China. The analysis of EU’s external action is based on the instruments used to strengthen IPR’s protection and enforcement in China. The purpose of our research is to examine the EU’s method to use the different instruments within the multilateral and bilateral fora. Two distinct but complementary axes orientate the undertaking of EU’s external action vis-à-vis China: cooperative approach, on the one hand, and the conventional approach, on the other hand. Firstly, the cooperative approach aims to bring Chinese legal system closer to higher standards in EU law. In spite of certain difficulties limiting the efficacy of EU external action, the bilateral cooperation with China can contribute to a better legal system in China. Then, the normative convergence should be able to facilitate the emergence of a common approach between the EU and China in the conventional framework. In this respect, it is important to emphasis Chinese divergent position with regard to EU’s conventional approach aiming to strengthen IPR protection and enforcement. Despite the increasing convergence of European and Chinese positions favorable toward “TRIPs-plus” protection, China seems reluctant even hostile to EU’s conventional initiatives intending to strengthen IPR enforcement measures.
