Child participation and representation in legal matters

The child’s participation in any legal matter involving him/her is crucial whether received directly or indirectly through a legal representative. The significance of the child’s views in legal matters is accepted internationally and is entrenched in South African law. This is the main feature of the present research. In Roman law the paterfamilias was the complete antithesis of the best interest of the child with his paternal power entirely serving his own interests. The best interests of the child progressively improved his/her participatory rights and the dominance of paternal authority in Roman, Germanic, and Frankish law eventually gave way to parental authority and assistance in Roman-Dutch law. This advanced the child’s participation in legal matters and under Roman-Dutch law, his/her right of participation included legal representation by way of a curator ad litem. The child’s best interests were consistently viewed from an adult’s perspective and resulted in an adult-centred assessment of his/her best interests. Statutory intervention increased the child’s participatory and representation rights, however, the tenor of these items of legislation remained parent-centred. The Appeal Court later dispelled any uncertainty regarding the paramountcy with respect to the best interests of the child. During the 1970s in South Africa, the emphasis began shifting from a parent-centred to a child-centred approach in litigation between parents in cases involving their children. An open-ended list of factors comprising the best interests of the child accentuated this shift. Courts were encouraged to apply the paramountcy rule in legal matters concerning children and to consider the views of children in determining their best interests. The new democratic constitutional dispensation in South Africa, followed by the ratification of the Convention on the Rights of the Child and the African Charter, obligated South Africa to align children’s rights with international law and standards. The South African Law Reform Commission set out to investigate and to formulate a single comprehensive children’s statute. The resultant Children’s Act 38 of 2005 is the most important item of legislation for children in private law in South Africa. The Children’s Act provides for the widest possible form of child participation in legal matters involving the child. It revolutionises child participation requiring no lower age limit as a determining factor when allowing the child, able to form a view, to express that view. The child’s right to access a court and to be assisted in doing so further enhances his/her participatory right. Effective legal representation is the key in ensuring that children enjoy the fundamental right of participation equal to that of adults in legal matters involving children. Comparative research of child laws in Australia, Kenya, New Zealand and United Kingdom confirms that South Africa is well on the way in enhancing children’s participatory and legal representation rights in legal matters concerning them. This illustrates that only the child’s best interests should serve as a requirement for the legal representation of children in legal matters. In Romanian, the word lăutari refers to highly skilled professional Romani (Gypsy) musicians. By interacting with Romanian culture and tradition, the lăutari settled down in the country and developed a unique musical tradition. Their music is characterized by intricate, elaborate, and refined ornamentation; its execution requires a highly level of technique. George Enescu, regarded as Romania's most influential musician, was affected by lăutari music. He created a unique musical language that recreates Romanian character by using lăutari elements. This dissertation examines how to approach Enescu's Violin Sonata No. 3 and perform it by understanding the characteristics of lăutari music as well as the work's use of such lăutari violin techniques as diverse expressive slides, vibrato, double stops, various ornaments, artificial harmonics, imitation of folk instruments, and a variety of bow strokes. Enescu's Violin Sonata No. 3 is regarded as a challenging work in the violin literature requiring a high level of violin technique. Although the standard violin repertoire is enormous, many violinists are looking to rediscover new and challenging repertoire, distinguish themselves from others, and promote themselves as professional performers. Therefore, this study should help violinists to approach the idiomatic violin writing of Enescu's sonata, especially its lăutari techniques and style.

This case study is conducted through ten weeks of field studies in South-Eastern Uganda. Both authors have received funding from Minor Field Study scholarships. These scholarships were provided by Sida, Sweden's government agency for development cooperation. This entails that the authors are contract bound to comply with the terms and regulations established by Sida and Jönköping University as well as write and submit a report to the Swedish Council of Higher Education upon return to Sweden.  Without the substantial contributions from the local community in Kamuzinda and neighbouring villages, this thesis would not have been completed. First and foremost, profound gratitude is expressed to the many people who contributed to making this study a reality, be it big or small. Mobile Banking Adoption in an Emerging Economy: An Empirical Analysis of Users in Myanmar : A Minor Field Study

This study aims to provide an overview of the attitude toward mobile banking among early adopters in Myanmar. By conducting exploratory interviews with ten bank employees, factors that are important for the adoption of mobile banking were also identified. The qualitative method allowed factors beyond the existing technology adoption frameworks to emerge. From the results, it was concluded that the attitude toward mobile banking is overall positive among the early adopters. Findings were aligned with the Technology Acceptance Model (TAM), suggesting that perceived usefulness and perceived ease of use are important factors for the usage of mobile banking. Social influence did not show any consistent results, but external barriers such as regulations and cash-based society were evidently important factors for adoption. Moreover, experience showed to have an impact on the participants’ attitude and the adoption of mobile banking. The findings from this paper could work as a foundation when formulating future hypotheses for mobile banking adoption in Myanmar. Regarding practical contributions, banks can get an insight into what is important to focus on when designing a strategy to increase the rate of mobile banking adoption. For future research, it would be of interest to extend the sample and collect data from both users and non-users. / Denna studie syftar till att ge en övergripande bild av attityden mot mobila banktjänster bland tidiga användare i Myanmar. Genom explorativa intervjuer med tio bankanställda, identifierades också faktorer som är viktiga för att anamma mobila banktjänster. Den kvalitativa metoden möjliggjorde faktorer som ligger utanför de befintliga teoretiska ramverken att vara del av studien. Från resultaten drogs slutsatsen att attityden mot mobila banktjänster är övergripande positiv bland de tidiga användarna. Resultaten låg i linje med modellen Technology Acceptance Model (TAM), vilket tyder på att uppskattad användbarhet och uppskattad användarvänlighet är viktiga faktorer för anammandet av mobila banktjänster. Socialt inflytande visade inga konsekventa resultat, men externa barriärer som regleringar samt kontantbaserat samhälle visade sig vara viktiga faktorer för anammandet till mobila banktjänster. Dessutom påverkade erfarenhet deltagarnas attityd mot och anammandet av mobila banktjänster. Resultaten från denna rapport kan användas som en grund vid formulering av hypoteser i framtida forskning inom implementering av mobila banktjänster i Myanmar. Vad gäller det praktiska bidrag från denna studie, kan bankerna få en inblick i vad som är viktigt att fokusera på vid utformning av strategi för att öka användningen av mobila banktjänster. För framtida forskning vore det intressant att utöka urvalet av deltagare och samla in data från både användare och icke-användare.

Essential Factors for Usability and Acceptance of Mobile Learning in Ugandan Primary Schools : Minor Field Studies

Two different focus groups in primary schools in Uganda participated in this study to investigate critical aspects of usability comparing two different educational mobile applications. The first group was already familiar with both applications, while the second group had no previous experiences of the applications. Furthermore, interviews were performed with a head teacher as well as two CEOs and founders of two start ups developing educational mobile applications for children, in order to investigate challenges with implementation of mobile learning in schools in Uganda. The results showed that one of the applications was not fully compatible with the devices used by the target group and that swiping was perceived less natural than clicking. Regarding organizational factors of implementation in schools, financial limitations and insufficient computer literacy among employees were revealed as critical obstacles. Moreover, improvements of the method used during the user tests with children in foreign contexts are discussed. / I denna studie deltog två fokusgrupper med barn från två olika grundskolor i Uganda för att undersöka kritiska aspekter gällande användarvänlighet genom att jämföra två mobilapplikationer som används i utbildningssammanhang. Den första gruppen var redan bekant med båda applikationerna, medan den andra gruppen var obekant med applikationerna. Vidare undersöktes utmaningar med implementation av mobile learning i grundskolor i Uganda genom intervjuer med en rektor från en ugandiansk grundskola samt två VDs tillika grundare från två ugandianska edTech-start-ups. Resultaten visade att en av applikationerna inte var fullständigt kompatibel med de enheter som användes av målgruppen i Uganda samt att "swipea" uppfattades mindre naturligt än att klicka. Gällande organisatoriska faktorer av implementering i skolorna visades finansiella begränsningar och anställdas otillräckliga datakunskap vara kritiska hinder. Utöver resultaten som ämnar svara på de definierade frågeställningarna diskuteras förbättringar av metoden som användes för användartesterna, i syfte att ge riktlinjer till framtida projekt i liknande sammanhang.
