This thesis deals with the value orientation and life plans of children and adolescents who are placed into young offenders' institutions because of their behavioural disorders. The theoretical part elucidates basic conceptions related to values and value orientations. It applies to individual development, family issues and education, behavioural disorders and refers to the difficulty of education and re-education in school facilities for the practice of institutional and protective education. The empirical part is a combination of a quantitative and a qualitative research. The questionnaire survey was used to determine the value orientation, life goals, preferred leisure activities, some attitudes and information about clients from the young offenders' institutions. The questionnaires were handed over to respondents from the six children's homes with school and young offenders' institutions. The established values hierarchy and life goals were compared with the results of a similar research. The unstructured interviews with children ending the compulsory education were mainly focused on the choice of study and career orientation. Il est une idée généralement admise consistant à dire que la fonction de Compliance officer est conçue autour d'une obligation de moyen, négative pour la fonction. Nos travaux nous ont amenés à conclure de la nécessité de poser une notion d'intégrité financière dont la définition réponde également aux exigences des missions du Compliance officer. il s'agit ainsi d'envisager les outils techniques et juridiques inhérents au poste de Compliance officer. Ces outils trouvent leur fondement logique dans la notion d'intégrité financière, à l'issue d'un examen clinique du poste de Compliance officer. La nécessité d'une notion qui soit fonctionnelle amène à retenir que l'intégrité financière consiste en la protection de la circulation légitime de la monnaie et des obligations monétaires. Les réflexions autour de cette notion d'intégrité financière permettent d'isoler une notion d'intégrité qui est opératoire dans la lutte contre la criminalité financière. Ainsi, au même titre qu'il y a dans les sciences criminelles un champ d'étude consacré à l'intégrité physique ou morale de la personne, il était souhaitable que fût identifié un champ d'étude consacré à la circulation de la monnaie. La conséquence d'une telle approche consiste en la reformulation des besoins des institutions impliquées dans la lutte contre la criminalité financière et à une redéfinition de l'offre de formation universitaire sur cette thématique. / People think that the function of Compliance Officer is conceived on an obligation of means. Then, the Compliance Officer is rather seen as "spoilsport". Therefore, seeking for the element for lack of which the Compliance Officer could not be effective became a necessity. Our thoughts lead us to conclude about the need to put down a financial integrity notion whose definition also answers to the duty of the Compliance Officer. Furthermore, we wanted to have a clinical look on the position of Compliance Officer. The will to have a definition of the financial integrity that can be practical has leaded us to retain that financial integrity was the guarding of the rightful flow of money and monetary debentures. Put in those terms, the definition of the financial integrity firstly required presenting monetary items and their protection system. Then, the operating qualities of such a notion in the achievement of the Compliance Officer duty needed to be presented secondly. Beyond the only purpose of the Compliance Officer, our thoughts about the notion of financial integrity aimed at isolating an integrity notion that could be functional in the fight against financial criminality. In other words, as there is a field dedicated to the study of physical or moral integrity of a person, it was desirable that a field dedicated to the flow of money and monetary items could be identified in criminal sciences. Such an approach could participate to reword the needs of financial institutions involved in the fight against crime, and to redefine the university schedule of training by basing the learning process of financial methods on the circulation of items and the monetary objects.

in States public security policies. There is a need for further thinking on
this topic, especially over the proliferation of criminal organizations, which
terrorize and frighten not only Brazilian population but also others.
Society claims for more severe measures against the upraising of
criminality, many times attended by ineffective legislative proliferation.
Difficulties in this subject s analyses initiate due to the lack of a
legal definition of criminal organization and its many expressions.
The aim is, therefore, the detailed comprehension of the organized
crime, taking the hand of foreign legislation, with the intent to assure
balance between efficiency in the fight against organized crime and respect
for the civil rights of those accused or investigated, respecting the human
dignity, not leaving them unprotected against occasional abuses perpetrated

A critical analysis of the crime prevention role of the military police division in the South African National Defence Force (SANDF)Mathebula, Esewu Mxolisi 04 February 2019 (has links)
The purpose of this research study was to offer a critical analysis of the crime prevention role of the MPD in the SANDF. A recent development in SA where military personnel are deployed to quell acts of violence and xenophobic attacks, makes this requisite and pertinent research.
A qualitative research method was adopted, which goes well with the pragmatist worldview. A pragmatist worldview affords researchers the flexibility to choose the type of technique, method and procedures to be utilised in the research study. A literature review was conducted, followed by interviews with members of the MPD. The researcher interviewed a total of 23 members from the MPD. These members were chosen based on their experience and knowledge as military police officials. The data received from participants was analysed using a computer software programme called Atlas.ti.
The findings of this research study revealed that crime prevention in SA is the responsibility of the SAPS, not the SANDF. The defence force can be deployed as a last resort in extreme cases when the SAPS are not able to contain the situation. Members of the defence force are not trained to deal with matters of maintenance of law and order. However, the defence force has its own crime fighting component in the form of the MPD, which can perform policing functions anywhere and at any time as long as it is aimed at enforcing the Defence Act (Act 42 of 2002).
The conclusion reached by this research study is that MPD members must be capacitated in terms of both human resources and training so that they are able to deal effectively with crime within the SANDF. An exploration on the criminal capacity of child offenders with psychiatric disordersGeoffrey, Leandre Christina 28 November 2018 (has links)
The aim of this explorative study is to establish if psychiatric disorders influence the criminal capacity of child offenders. A qualitative approach was adopted in the study to develop an in-depth understanding of the issues pertaining to criminal capacity assessments for child offenders with psychiatric disorders. The risks associated with various psychiatric disorders in relation to childhood criminality, and the methods that are used to deal with child offenders who suffer from psychiatric disorders, were also explored.
The data collection tool for this study was a semi-structured interview schedule. Telephonic and face-to-face interviews were conducted with child justice and mental health experts from four provinces in South Africa, namely, KwaZulu-Natal, Gauteng, Eastern Cape and Western Cape. These experts included psychiatrists, psychologists, social workers, academic professors of law, a criminologist and an advocate. Snowball sampling was employed and although this is a pure qualitative study, the open coding, axial coding and selective coding process from the grounded theory was applied to analyse and interpret the data.
The findings from this study indicate that psychiatric disorders are a risk factor associated with the causation of criminal behaviour. A high prevalence of psychiatric disorders, such as intellectual disability, learning disorder, attention deficit hyperactivity disorder, oppositional defiant disorder and conduct disorder, were generally found in children in conflict with the law. The influence and consequences of these psychiatric disorders, in conjunction with environmental and societal factors, were found to influence criminal behaviour and were highlighted as factors that ought to be taken into consideration when determining the criminal capacity of a child who is in conflict with the law.
Findings from the study identified that adequate recognition was not granted to the influence of a psychiatric disorder in the assessment of a child‟s criminal capacity. It was established that, in the criminal capacity assessment, the emphasis should not be on the psychiatric disorder per se, but on the effect that the disorder and associated symptoms may have on the child‟s ability to distinguish between the wrongfulness of their actions and to act in accordance with this understanding.
Operational challenges and ambiguities identified in the legislative framework pertaining to child offenders with psychiatric disorders were found to negatively influence criminal capacity assessments for children in conflict with the law. The lack of services available to child offenders with psychiatric disorders, as well as child offenders without psychiatric disorders, was found to hamper the best interest of the children in conflict with the law. Lastly, legislative and service recommendations for good practice to deal with child offenders with psychiatric disorder were identified by the experts. / Criminology and Security Science / M.A. (Criminology)

Ce travail essaie d’analyser l’affirmation courante dans la dogmatique brésilienne de ce que les règles de la responsabilité civile objective sont destinées à concrétiser la valeur de la solidarité sociale inscrite dans la Constitution Fédérale du Brésil (article 3, III, in fine) et la directrice de la socialité présente dans le Code Civil de 2002. L’étude commence par la description d’un risque social – la criminalité urbaine violente – et par la présentation de la relation entre une certaine forme historique de manifestation de ce risque et de l’augmentation des cas judiciaires concernant la responsabilité des entreprises de transport urbain pour dommages subis par leurs passagers à cause d’actes violents pratiqués par des tiers lors du trajet. Dans la deuxième partie, on présente les origines du discours de solidarisme juridique et les influences de celui-là sur certaines constructions dogmatiques concernant le phénomène de la responsabilité civile. Finalement, ayant pour base des recherches menées à propos de la jurisprudence de deux tribunaux supérieurs brésiliens (le Supremo Tribunal Federal et le Superior Tribunal de Justiça) on analyse le fond de ces décisions, essayant d’identifier à quel point le discours théorique de la dogmatique est effectivement incorporé au moment de l’application des concepts juridiques implicite dans certains problèmes concrets. / O presente trabalho pretende analisar a afirmação corrente, na dogmática civilística brasileira, de que as regras da responsabilidade civil objetiva se destinam a concretizar o valor da solidariedade social inscrito na Constituição Federal (art. 3º, III, in fine) e a diretriz da socialidade presente no Código Civil de 2002. O estudo é feito, inicialmente, por meio da descrição de um risco social – criminalidade urbana violenta – e da apresentação da relação entre uma determinada forma histórica de manifestação desse risco e o aumento dos casos judiciais envolvendo a responsabilidade das empresas de transporte urbano em face de danos sofridos por seus passageiros em razão de atos violentos praticados por terceiros durante o trajeto. Em um segundo momento, são apresentadas as origens do discurso do solidarismo jurídico e as influências desse sobre certas construções dogmáticas relativas ao fenômeno da responsabilidade civil. Por fim, com base em pesquisa realizada sobre a jurisprudência dos dois tribunais superiores brasileiros (Supremo Tribunal Federal e Superior Tribunal de Justiça), realizou-se a análise de conteúdo das decisões, buscando identificar em que medida o discurso teórico da dogmática é efetivamente incorporado no momento da aplicação dos conceitos jurídicos implicados no tratamento de determinados problemas concretos. / This text aims at analyzing the current belief held by the authors of the Brazilian dogmatic of civil law, that rules concerning objective civil responsibility must realize the value of social solidarity described by the Federal Constitution (Article 3, III, in fine) and the principle of sociality presented by the Civil Code of 2002. The study is done initially through the description of a social risk – violent urban criminality – and the presentation of a relationship between a certain historical form this risk takes and the increase in legal cases involving the responsibility of public transportation companies for damage incurred upon their passengers due to violent acts practiced by third parties on the itinerary. In the second part, we present the origins of the discourse of legal solidarism, and its influence upon certain dogmatic constructions concerning the phenomenon of civil responsibility. Finally, based on research done about the jurisprudence of two Brazilian superior tribunals (the Supremo Tribunal Federal and the Superior Tribunal de Justiça), we analyze the contents of those decisions, aiming at identifying to what extent the theoretical discourse of dogmatic is actually incorporated into the moment of applying the legal concepts implicit in the treatment of certain concrete problems.

Esta dissertação trata dos processos de socialização primária e secundária das adolescentes autoras de ato infracional que cumprem medida sócio-educativa de internação na Fase – Fundação de Atendimento Sócio-Educativo do Estado do Rio Grande do Sul, em Porto Alegre. O objetivo deste trabalho é, através da socialização primária, elaborar o perfil dessas jovens e, a partir da socialização secundária, compreender as condições em que elas vivem na instituição e como vivenciam a medida sócio-educativa de internação. Para tal, a análise desses processos considera quatro dimensões principais: a individual, a familiar, a coletiva e a educacional/profissional. A problematização deste trabalho se insere na perspectiva da sociologia da conflitualidade, que centra a sua análise nos mecanismos de controle social exercidos pelo Estado. De modo a articular distintas áreas do conhecimento, lança-se mão também das contribuições teóricas da sociologia jurídica e da criminologia através da perspectiva do labeling approach, que mostra como esse controle social acaba “selecionando” alguns indivíduos em detrimento de outros. Desta forma, busca-se elaborar o perfil das adolescentes, com intuito de verificar quem são as jovens “selecionadas” pelos mecanismos de controle social e como são construídos seus processos de socialização primária. Em relação à internação, procura-se compreender como as jovens vivenciam a privação de liberdade, como constroem as relações no cotidiano institucional, quais estratégias elas lançam mão nesse universo. O estudo possibilitou verificar que o controle social não atua somente na “seleção” das condutas para ingresso no sistema, mas ele persiste durante a internação das jovens, através de práticas que configuram um tipo de atendimento específico destinado somente às meninas, que procura “adequá-las” a determinados padrões socialmente aceitos. O trabalho também problematiza o ECA, pois, ainda que represente uma conquista em relação aos direitos das crianças e adolescentes, muitas das suas garantias são utilizadas como recurso para aumentar o controle sobre as internas. / This paper deals with the primary and secondary socialization process of female juvenile transgressors who are sentenced to a social-educational measure of detention at Fase (Fondation of Social and Educative Service of do Rio Grande do Sul, in Porto Alegre. The goal of this study is, through primary socialization, to establish the profile of those girls and, trough secondary socialization, to understand the conditions which they live in that institution as well as how they experiment the social-educational measure of detention. For this, the analyze of those processes considers four main dimensions: the individual, familiar, collective and educational/professional ones. The problematization of this research is in the sociology of conflictuosity perspective that focus on the analyze of social control mechanisms used by State. In order to articulate different fields of knowledge, it is also used theorical contributions from Law sociology and criminology through labeling approach point of view which demonstrates how that social control ends up “selecting” some individuals to the detriment of others. Through this, the profile of those girls is elaborate in order to check who are the girls selected by social control mechanisms and how they primary socialization processes are built. In relation to detention, the aim is to understand how those girls live without their liberty, how they build relationships inside the institutional routine, what strategies they use in that universe. The study has allowed to verify that social control does not only act in the “selection” of behaviors that can make part of this system, but it remains during the detention of the girls through practices that characterize a kind of specific care designated only to the girls and that try to “fit them” to new socially accepted patterns. The study also reflects about ECA (Statute of the Child and the Adolescent), once, even if it still represents a success in relation to child and adolescent rights, many of the guarantees are used as a tool to increase control over the interns.

The diploma thesis deals with one of the precautions of criminality - Urban camera supervising system, which is constantly more often used in cities and villages in the public. Together with the requirements of citizens to secure their safety it brings the risk of privacy loss. The main intention of this thesis is to place the Urban camera supervising system into the focus point of the dilemma between two basic human rights: the right of human privacy and personal safety right. Next to the description of the terms privacy and safety, the writer examines the harmony of legal regulations of Urban camera supervising system with the concept of human liberty and the status of the state in the point of securing human safety. This thesis thinks of the problem by empirical facts and different theoretical aspects of political philosophy and political thinking, especially liberalism and conservatism. The thesis also looks into the quality of the connection between the citizen and local public administration in the realization of the project of Urban camera supervising system.

Finalement, ayant pour base des recherches menées à propos de la jurisprudence de deux tribunaux supérieurs brésiliens (le Supremo Tribunal Federal et le Superior Tribunal de Justiça) on analyse le fond de ces décisions, essayant d’identifier à quel point le discours théorique de la dogmatique est effectivement incorporé au moment de l’application des concepts juridiques implicite dans certains problèmes concrets. / O presente trabalho pretende analisar a afirmação corrente, na dogmática civilística brasileira, de que as regras da responsabilidade civil objetiva se destinam a concretizar o valor da solidariedade social inscrito na Constituição Federal (art. 3º, III, in fine) e a diretriz da socialidade presente no Código Civil de 2002. O estudo é feito, inicialmente, por meio da descrição de um risco social – criminalidade urbana violenta – e da apresentação da relação entre uma determinada forma histórica de manifestação desse risco e o aumento dos casos judiciais envolvendo a responsabilidade das empresas de transporte urbano em face de danos sofridos por seus passageiros em razão de atos violentos praticados por terceiros durante o trajeto. Em um segundo momento, são apresentadas as origens do discurso do solidarismo jurídico e as influências desse sobre certas construções dogmáticas relativas ao fenômeno da responsabilidade civil. Por fim, com base em pesquisa realizada sobre a jurisprudência dos dois tribunais superiores brasileiros (Supremo Tribunal Federal e Superior Tribunal de Justiça), realizou-se a análise de conteúdo das decisões, buscando identificar em que medida o discurso teórico da dogmática é efetivamente incorporado no momento da aplicação dos conceitos jurídicos implicados no tratamento de determinados problemas concretos. / This text aims at analyzing the current belief held by the authors of the Brazilian dogmatic of civil law, that rules concerning objective civil responsibility must realize the value of social solidarity described by the Federal Constitution (Article 3, III, in fine) and the principle of sociality presented by the Civil Code of 2002. The study is done initially through the description of a social risk – violent urban criminality – and the presentation of a relationship between a certain historical form this risk takes and the increase in legal cases involving the responsibility of public transportation companies for damage incurred upon their passengers due to violent acts practiced by third parties on the itinerary. In the second part, we present the origins of the discourse of legal solidarism, and its influence upon certain dogmatic constructions concerning the phenomenon of civil responsibility. Finally, based on research done about the jurisprudence of two Brazilian superior tribunals (the Supremo Tribunal Federal and the Superior Tribunal de Justiça), we analyze the contents of those decisions, aiming at identifying to what extent the theoretical discourse of dogmatic is actually incorporated into the moment of applying the legal concepts implicit in the treatment of certain concrete problems.

A "casa de bonecas" : um estudo de caso sobre a unidade de atendimento sócioeducativo feminino no RSFachinetto, Rochele Fellini January 2008 (has links)
Esta dissertação trata dos processos de socialização primária e secundária das adolescentes autoras de ato infracional que cumprem medida sócio-educativa de internação na Fase – Fundação de Atendimento Sócio-Educativo do Estado do Rio Grande do Sul, em Porto Alegre. O objetivo deste trabalho é, através da socialização primária, elaborar o perfil dessas jovens e, a partir da socialização secundária, compreender as condições em que elas vivem na instituição e como vivenciam a medida sócio-educativa de internação. Para tal, a análise desses processos considera quatro dimensões principais: a individual, a familiar, a coletiva e a educacional/profissional. A problematização deste trabalho se insere na perspectiva da sociologia da conflitualidade, que centra a sua análise nos mecanismos de controle social exercidos pelo Estado. De modo a articular distintas áreas do conhecimento, lança-se mão também das contribuições teóricas da sociologia jurídica e da criminologia através da perspectiva do labeling approach, que mostra como esse controle social acaba “selecionando” alguns indivíduos em detrimento de outros. Desta forma, busca-se elaborar o perfil das adolescentes, com intuito de verificar quem são as jovens “selecionadas” pelos mecanismos de controle social e como são construídos seus processos de socialização primária. Em relação à internação, procura-se compreender como as jovens vivenciam a privação de liberdade, como constroem as relações no cotidiano institucional, quais estratégias elas lançam mão nesse universo. O estudo possibilitou verificar que o controle social não atua somente na “seleção” das condutas para ingresso no sistema, mas ele persiste durante a internação das jovens, através de práticas que configuram um tipo de atendimento específico destinado somente às meninas, que procura “adequá-las” a determinados padrões socialmente aceitos. O trabalho também problematiza o ECA, pois, ainda que represente uma conquista em relação aos direitos das crianças e adolescentes, muitas das suas garantias são utilizadas como recurso para aumentar o controle sobre as internas. / This paper deals with the primary and secondary socialization process of female juvenile transgressors who are sentenced to a social-educational measure of detention at Fase (Fondation of Social and Educative Service of do Rio Grande do Sul, in Porto Alegre. The goal of this study is, through primary socialization, to establish the profile of those girls and, trough secondary socialization, to understand the conditions which they live in that institution as well as how they experiment the social-educational measure of detention. For this, the analyze of those processes considers four main dimensions: the individual, familiar, collective and educational/professional ones. The problematization of this research is in the sociology of conflictuosity perspective that focus on the analyze of social control mechanisms used by State. In order to articulate different fields of knowledge, it is also used theorical contributions from Law sociology and criminology through labeling approach point of view which demonstrates how that social control ends up “selecting” some individuals to the detriment of others. Through this, the profile of those girls is elaborate in order to check who are the girls selected by social control mechanisms and how they primary socialization processes are built. In relation to detention, the aim is to understand how those girls live without their liberty, how they build relationships inside the institutional routine, what strategies they use in that universe. The study has allowed to verify that social control does not only act in the “selection” of behaviors that can make part of this system, but it remains during the detention of the girls through practices that characterize a kind of specific care designated only to the girls and that try to “fit them” to new socially accepted patterns. The study also reflects about ECA (Statute of the Child and the Adolescent), once, even if it still represents a success in relation to child and adolescent rights, many of the guarantees are used as a tool to increase control over the interns.
