Righteous and Wicked in the Psalms: The Poetic Functions of the Contrast Between קידִּ צַ and עשָׁרָ in Biblical Hebrew Psalmody

This study examines the figures of theיקדִּ צַ and עשָׁ רָ in psalms. Drawing on both semantics and poetics, this study argues that the contrast between the figures represented by these terms is part of the conventions of Hebrew psalmody and, as such, can serve various discursive functions within an individual psalm. Using insights from the field of lexical semantics, the study clarifies the possible uses of the words Justand עשָׁ רָ, emphasizing a wider range of uses than is typically offered within a broad behavioral domain for these terms. The study summarizes ways that various books in the Hebrew Bible use the contrast of these figures to develop a description of the literary features related to their presentations. The analysis of 18 psalms that include both figures utilizes insights from narratological theories of character to explore the functions of the contrast between קידִּ צַ and עשָׁ רָ as literary figures within the overall discourse of the psalm. Focusing on the setting of an individual psalm and embracing the possibility of variation reveals that קידִּ צַ and עשָׁ רָ are not only, or even usually, employed to describe the “prototypically good” or “prototypically bad” person in psalms. Rather, the עשָׁ רָ is often a designation for an antagonist, and the קידִּ צַ is often understood as one who is innocently wronged. As such, the literary pattern of their contrast does not focus on the moral character of these figures but on the fairness or justice of God to eventually elevate the position of the קידִּ צַ and destroy the עשָׁ רָ.

Drawing especially on Donna Haraway's notion of the cyborg, this thesis argues that Eoin Colfer's Artemis Fowl novels, through their depiction of the cyborg and their use of metafiction, intertextuality, and irony, subvert binaries and hierarchies that cause social injustice. Chapter one argues that Colfer's characters disrupt the oppressive binary opposition between innocence and experience that characterizes children's literature. Chapter two argues that Colfer's fairy hierarchy satirizes the human hierarchy. Chapter three argues that Colfer's cyborg, by disrupting the boundary between machine and organism, breaches the wall around the pervasive garden hierarchy of childhood innocence. Chapter four argues against the traditional textual hierarchies which classify children's literature as inferior, and which give adult writers power over child readers.

Avec son ouvrage L’Enfant et la vie familiale sous l’Ancien Régime, Philippe Ariès a découvert l’enfant comme objet de recherche interdisciplinaire. Cependant, une étude systématique sur le thème dans la littérature française des XVIIe et XVIIIe siècles n’a pas encore été entreprise. C’est pourtant à cette époque que le regard sur l’enfant change considérablement. La littérature de ces deux siècles ne témoigne pas seulement de cette évolution, mais joue un rôle décisif dans l’élaboration d’une nouvelle conception de l’enfance qui préfigure en bien des points le renouveau rousseauiste. S’appuyant sur un appareil critique interdisciplinaire, qui invite à envisager l’enfant comme une construction de la réalité adulte dont les critères définitoires sont souples, cette thèse se propose d’étudier la représentation des personnages enfants dans un corpus de textes en prose, leur fonction dans l’économie du récit et leur implication dans les débats sociaux et philosophiques de l’époque. Une première partie est consacrée à l’enfant comme objet de la réalité adulte. Suivant la logique de la sociologie de la connaissance, nous avons défini l’enfant comme objet de la réalité sociale et soumis au discours adulte. L’objectif de cette première partie est de montrer dans quelle mesure l’enfant apparaît dans les textes de notre corpus comme objet de représentation, modelé selon le discours adulte. Cependant, l’enfant de la littérature classique ne se laisse pas réduire au seul statut d’objet. Dans tous les textes dans lesquels un personnage enfant occupe plus qu’un instant, les auteurs s’intéressent à sa formation, personnelle, mais surtout sociale. Ainsi, une deuxième partie est consacrée à l’enfant dans son dynamisme car il fascine les auteurs de l’âge classique précisément pour son caractère éphémère. Enfin, la troisième partie rend compte de l’enfant comme sujet, au sens sociologique du terme, c’est-à-dire comme individu doté d’une certaine subjectivité – dans la mesure où l’on peut appliquer ces notions anachroniques aux siècles classiques. Dès le XVIIe siècle, mais surtout à partir du début du XVIIIe siècle, certains auteurs commencent aussi à réfléchir davantage sur les origines de l’être humain, sur sa faculté de raisonnement et sur ce qui le distingue des autres espèces – sujets qui paraissent impossibles sans le détour par l’enfant. / Philippe Ariès’ work, L’Enfant et la vie familiale sous l’Ancien Régime, founded the child as an object of interdisciplinary interest. However, a systematic study of the theme in 17th and 18th century French literature has not up until now been realised, although it appears to be during this period that the perception of the child evolves to a considerable extent. The literature of these two centuries not only shows this evolution, it also plays a major role within the elaboration of a new conception of the idea of childhood, which prefigures in many points the rousseauist renewal. Basing our study on an interdisciplinary corpus of critical works, we endeavour to study the representation of childcharacters within a prose corpus, their function of within the narration and their implication in the social and philosophical debates of the times. Our first chapter focuses on the child as an object of the adult reality. Adopting a sociology of knowledge perspective, we have defined “the child” as an object of social reality and subject to the adult discourse. The objective of this first chapter is to analyse the way the child appears in the writings of our corpus as an object of representation, sculptured according to adult discourse. However, the child as a character in classical French literature cannot be reduced to this status of objectivation. In all the texts in which a childcharacter occupies more than a passing role, the author shows his interest in the child’s personal, and most of all, social, development. For that reason, the second chapter analyses the child’s dynamism, because in 17th and 18th century, the child is considered fascinating due to his fleeting identity. Finally, the third and last chapter focusses on the child as a subject in a sociological meaning, as an individual provided with a certain degree of subjectivity. From the 17th century onwards, but mainly within the first part of the 18th century, some authors also start to think about the origins of the human species, man’s intellectual faculties and the points that enable us to differentiate between human beings and other species – questions that can’t be answered, or even asked, without taking the child as a central question.

The synthesis and characterisation of metal complexes containing chemically reduced bipyridyl ligand systems

This thesis describes the synthesis and characterisation of metal complexes that contain chemically reduced bipyridyl ligands. The crystal structures of twenty-six novel complexes are reported alongside detailed discussions on the electronic and spectroscopic effects and trends associated with the different oxidation states within these species. Chapter One introduces the isomers of bipyridine and their redox chemistry, the concept of non-innocent ligands and the spectroscopic techniques that are currently used in determining ligand oxidation states. Subsequently, examples of main group, transition metal, lanthanide and actinide species that contain or may contain reduced forms of the ligand are discussed. Chapter Two details the synthesis and structural characterisation of alkali metal salts of singly and doubly reduced forms of the three commercially available bipyridine isomers. The effects of this reduction are investigated with the aim of developing diagnostic fingerprints for each of the ligand oxidation states. Chapter Three discusses the synthesis of an homologous series of compounds of the form [M(2,2'-bipy)(mes)<sub>2</sub>]<sup>n–</sup> where M = Cr, Mn, Fe, Co, Ni and n = 0, 1. Trends in magnetism, bonding and electronic structure are investigated with reference to theoretical calculations and the diagnostic fingerprints identified in the previous chapter. Chapter Four describes the synthesis and characterisation of three compounds containing the isostructural motif [Zn<sub>2</sub>(4,4'-bipy)(mes)<sub>4</sub>]<sup>n–</sup> where n = 0, 1, 2. Structural and spectroscopic changes are discussed and com- pared to theoretical calculations. Chapter Five contains descriptions of the spectroscopic techniques employed in the above research and synthesis routes to all compounds featured in this thesis.

American ways and their meaning : Edith Wharton's post-war fiction and American history, ideology, and national identity

This thesis argues that Edith Wharton’s assessment of American ways and their meaning in her post-war fiction has been widely misread. Its title derives from French Ways and Their Meaning (1919), which she wrote to educate her countrymen about French culture and society. Making sense of America was as great a challenge to Wharton. Much of her later fiction was for a long time dismissed by critics on the grounds that she had failed to ‘make sense’ of America. Wharton was troubled by American materialism and optimism, yet she believed in a culturally significant future for her nation. She advocated – and wrote – an American fiction that looked critically at society and acknowledged the nation’s ties to Europe. Sometimes her assessment of American ways is reductive, and presented in a tone that her critics, then and since, found off- putting and snobbish. But her skepticism about American modernity was penetrating and prophetic, and has not been given its due. In criticism over the last two decades, a case for the place of Wharton’s post-war fiction in canons of feminism and modernism has been persuasively made. The thesis responds to these positions, but makes its own argument that the post-war writing reflects broader shift in American identity and ideology. The thesis is broadly historicist in its strategy, opening with a discussionofthereputationofthesetextsandthatoftheauthormoregenerally. Afterthat entry-point, it is organized thematically, with four chapters covering topics that are seen as key components of American ideology in Wharton’s post-war writing. These include modernity, gender equality, the American Dream of social mobility, and American exceptionalism. The thesis concludes with an assessment of Wharton’s prognostications in the context of twenty-first century America.

We aimed to establish the general objective points of reflection on the subject based on the analysis of necessity and uniqueness of precautionary detention, on the right to implement its temporary and possible conflict between that law and preserving the right to freedom. The specific objectives are delimited to present the history and characteristics of precautionary detention, its types and analyze the personal and social consequences of temporary detention. It was also subject of consideration the seriousness of the injunction, on an extremely exceptional character, imposed in order to establish the desired balance between the two duties of the State: - protection and security to society and security and protection of fundamental rights and freedom of the individuals it includes. The types of precautionary detention were reconsidered in light of the constitutional principles and guarantees by considering the purposes of preventive detention. According to the understanding of the Federal Supreme Court, the legitimacy of precautionary detention must be viewed based on the principle of non-culpability. It is necessary to study and demonstrate that precautionary detention is protected by its extraordinary character following the modern trends of Superior Courts of Law, attaching jurisprudence. For this research, we opted for bibliographical study on doctrines, jurisprudence and legislation pertinent to the theme. Thus, the study was justified and was relevant to show that all rules prior to the Federal Constitution which determines automatic and mandatory prison without real justification are revoked. All rules which prohibit the bail, when not justified in real need of arrest, such as those based solely on the seriousness of the crime, should be considered unconstitutional / O trabalho tem como proposta abordar os princípios constitucionais nas prisões de natureza cautelar previstas no ordenamento jurídico processual penal brasileiro. Procurou-se como objetivo geral estabelecer pontos de reflexão sobre o tema, a partir da análise da necessidade e excepcionalidade das prisões cautelares, do direito à sua execução provisória e eventual conflito entre esse direito e a preservação do direito de liberdade. Os objetivos específicos se delimitaram a apresentar o histórico e as características da prisão cautelar, suas espécies e analisar os reflexos pessoais e sociais da prisão preventiva. Foi também objeto de consideração a gravidade da medida cautelar, em caráter de extrema excepcionalidade, imposta com a finalidade pretendida de estabelecer o equilíbrio entre os dois deveres do Estado: - proteção e segurança à sociedade e garantia e proteção das liberdades e direitos fundamentais dos indivíduos que a integram. As espécies de prisão cautelar foram repensadas à luz dos princípios e garantias constitucionais considerando-se os fins da prisão preventiva. De acordo com o entendimento do Supremo Tribunal Federal, a legitimidade das prisões cautelares deve ser aferida tendo como norte o princípio da não culpabilidade. Procuramos estudar e demonstrar que as prisões cautelares são agasalhadas pelo manto da excepcionalidade seguindo as modernas tendências dos Superiores Tribunais, anexando para tanto jurisprudência pátria. Para o desenvolvimento desta pesquisa, optou-se pelo estudo bibliográfico em doutrinas, jurisprudências e legislações pertinentes à temática abordada. Assim, o estudo justificou-se e fez-se relevante para demonstrar que estão revogadas todas as normas anteriores à Constituição Federal que determinam a prisão processual automática e obrigatória sem justificação concreta. Devem ser consideradas inconstitucionais todas as normas que vedam a liberdade provisória, quando não justificadas na necessidade concreta da prisão, como aquelas baseadas exclusivamente na gravidade do delito

La protection des droits de l’accusé est tributaire du respect du procès équitable dans presque tout débat judiciaire. Ce faisant, la création de la CPI suscite une attention particulière en vertu non seulement de son caractère permanent et universel, mais aussi de l’ampleur des crimes internationaux qu’elle connait. Sous l’effet de cette configuration, la recherche laisse découvrir une protection à l’efficacité relative et utopique malgré l’exigence de compatibilité du droit applicable aux droits de l’homme internationalement reconnus. Toutefois, le respect apparent de ces droits, l’application du principe du contradictoire et l’exigence de la présence de l’accusé dans son procès ne garantissent pas l’effectivité de l’égalité des armes, l’exercice des droits de la défense et le respect de la présomption d’innocence. Au contraire, la prééminence du déséquilibre processuel, de la durée excessive des procès et du maintien en détention de l’accusé conduit à faire objection sur l’existence possible de la protection efficace des droits de l’accusé. La dite protection cède plutôt devant la lutte contre l’impunité, la délicatesse des victimes et témoins et la souveraineté des Etats. A l’issue de cette étude, il est nécessaire de procéder à un rééquilibrage des droits entre les parties et à une reconceptualisation de la compétence de la Cour. / Protecting the rights of the accused depends in any legal debate on respect for a fair trial. In doing so, the creation of the ICC merits special attention by virtue not only of its being permanent and universal, but also the extent of international crimes with which it deals. As a result of this broad scope, research suggests any protective coverage is relative in its effectiveness and utopian, despite the requirement of compatibility of the law applicable to internationally recognized human rights. The apparent respect for these rights, the principle of due process and the requirement of the presence of the accused at his or her trial do not guarantee an effective equality of arms, the exercise of one’s rights or respect for the presumption of innocence. Instead, the procedural rule of imbalance, the excessive length of trials and the continued detention of the accused have led to objections about effectively protecting the rights of the accused. So-called protection gives way instead to the fight against impunity, the reticence of victims and witnesses and the sovereignty of States. Following this study, it is necessary to rebalance the rights of the parties and rethink the jurisdiction of the Court.
