From an internal perspective, the aim is to investigate the regulatory mechanisms that govern this society and the way that such rules are manifested on their oral expression and customs. The assumptions are based on research of the alleged inferiority of customary law in relation to positive law in force. In order to verify legal monism theoretical foundations, questions are raised on the veracity of the proposition according to what the written law, codified and based on the figure of the State, promotes more legal certainty than the common law, characterized by orality and the absence of the State. The analyses made in this work are based on theoretical and empirical research. By undergoing a literature review, it is intended to discuss the treatment given by State law to indigenous rights and to demonstrate the importance of recognizing legal pluralism in order to secure ethnic diversity in the country and for the construction of intercultural dialogue. To elucidate this plurality, Kamaiurá society is used as a study case, being this society structured by rules immersed in their social body. The field surveys, which were divided into two stages, allowed identifying the way customary law is organized in relation to the dynamics of this society. In general terms, the research demonstrates that the regulation and organization of the Kamaiurá society are not dependent upon positive law in force. They communicate in an effective way their entire cultural structure to set standards of social behavior, adopting postures sometimes rigid, sometimes more flexible. Taking into account the valorization of the community, rules enforcement is guided by joint deliberation, which transcends the idea of an unchanging traditionalism in order to ensure social welfare / Com base no reconhecimento do pluralismo jurídico, a presente tese tem por objetivo fazer uma análise das normas próprias do povo indígena Kamaiurá. A partir de uma perspectiva interna, pretende-se levantar quais os mecanismos normativos que regulam esta sociedade e como essas regras se manifestam diante da oralidade e dos costumes. As hipóteses se fundam na investigação da suposta inferioridade do direito consuetudinário frente ao direito positivo vigente. Buscando verificar as bases teóricas do monismo jurídico, questiona-se a veracidade da proposta de que o direito escrito, codificado e fundado na figura do Estado promove mais certezas jurídicas do que o direito costumeiro, caracterizado pela oralidade e pela ausência do Estado. As análises do trabalho se baseiam em pesquisas teóricas e empíricas. Por meio de uma revisão bibliográfica, pretende-se discutir o tratamento dado pelo direito estatal aos direitos indígenas e demonstrar a importância do reconhecimento do pluralismo jurídico para a garantia da diversidade étnica no país e para construção do diálogo intercultural. Para elucidar a referida pluralidade, tem-se como estudo de caso a sociedade Kamaiurá, que se estrutura por meio de normas imersas no corpo social. As pesquisas de campo, divididas em duas etapas, permitiram identificar como o direito costumeiro se organiza diante da dinâmica própria da sociedade em questão. Em linhas gerais, a pesquisa demonstra que a regulação e a organização da sociedade Kamaiurá independem do direito positivo vigente. De forma eficaz, comunicam toda a sua estrutura cultural para definir os padrões de conduta social, adotando, ora posturas rígidas, ora posturas mais flexíveis. The focus of this master thesis is the library politics of the French Right wing party the National Front and the debate that followed the application of this politics. This qualitative study is divided into two parts where the critics to this politics represents one side and the adherents the other. The critics are composed by representatives from the French, Swedish and – to some extent – international library sector, while the adherent side is made up of politicians from the National Front and their adherents. The empiric material mostly consists of articles published in library, Right wing and daily press. The aim is to investigate to what extent the ideas proposed by opponents and adherents correspond to basic ideological elements of deliberative democracy respectively populism. The documents have been interpreted with an ideology analysis formulated by Herbert Tingsten and developed by Sven-Erik Liedman. In the analysis the results are also associated with the history and the role of the public library as well as the cultural politics of the National Front. The result of this study discloses that the ideas of the critics as well as those of the adherents correspond to a large extent to respective ideology, thou certain aspects contradict them. The opinions of the critic side are also shown to be closely related to those presented in documents concerning the role of the public library. Extravagant Practices: Experiencing Religious Pluralism in the Victorian Fantastic

This dissertation explores how Victorian fantastic fiction reimagined an experience central to its era: the full range of affective responses to religious pluralization, from devotion to disillusionment. Indeed, "Extravagant Practices" argues that authors of the fantastic gave voice to late Victorian Britain’s dawning awareness of creeds outside the Judeo-Christian tradition. Toward the close of the nineteenth century, three interrelated developments fueled this awareness: unprecedented proximity to Asian traditions, made possible by imperial circuits of knowledge; comparativist accounts of world religions, which stressed their hidden unity; and the array of esoteric spiritual movements, such as Theosophy and occultism, in which “Christian Britain” took increasing interest. These developments exerted powerful but conflicting pressures on believers and freethinkers alike. In yoking supernatural events to naturalistic detail, authors such as Rider Haggard, Rudyard Kipling and Bram Stoker found a way to capture the sometimes exhilarating, often disorienting experience of exploring religious difference at the fin de siecle. Far from offering mere escapes from disenchanted modernity, then, the fantastic fictions surveyed in this dissertation illumine the complex religious lives of the late Victorians.

Value Pluralism and Liberal Democracy

As the title indicates, this three-essay dissertation explores the relations between value pluralism and liberal democracy. The first essay, “Negative versus Positive Freedom: Making Sense of the Dichotomy,” starts with the puzzling appeal of the negative-versus-positive-freedom dichotomy. Why has this distinction, despite forceful criticisms against it, continued to dominate mainstream discourses on freedom in contemporary political theory? Does it grasp something fundamental about the phenomenology of freedom? In this essay I examine four main approaches to making sense of the appeal of this dichotomy, and the challenges they each face. Both the conventional, naive contrast between “freedom from” and “freedom to,” and the revisionist strategy to distinguish between the “opportunity-concept” and the “exercise-concept” of freedom, upon close scrutiny, fail to survive MacCallum’s triadic argument against all dichotomous views on the concept of freedom. The third account, which reduce the negative/positive dichotomy of freedom to the divide between “phenomenal” and “nounemal” conceptions of the self, or of the range of preventing conditions, is both interpretively misleading and conceptually uninformative, as I illustrate by using Berlin’s discussion on self-abnegation as an example. In the fourth place, I analyze why both the historical bifurcation account that take the negative/positive dichotomy of freedom as merely genealogical, on the one hand, and the republican critique of it based on the presumably sublating conception of non-domination, on the other hand, are unsatisfying. Finally, I argue that grounding the negative/positive dichotomy of freedom on the idea of value pluralism avoids the pitfalls of those approaches examined. According to this account, the dichotomized instantiation of freedom is necessary insofar as we live not in isolation but with other moral agents. The “negative” freedom instantiated in the access to an extensive sphere of permissible choices and actions, and the “positive” freedom instantiated in the access to collective decision-making and democratic self-government, reflect two equally genuine yet incommensurable modes of freedom as a basic value. Many believe that value pluralism and liberalism are ultimately incompatible, however, since liberalism implies the prioritization of liberal values over other basic values, which is contradictory to the value pluralist idea that all basic values are equally genuine and incommensurable. The next two essays take up this challenge, arguing on the contrary that a persuasively elaborated version of value pluralism is not only compatible with liberal commitments, but can also provide distinctive grounds for liberal democracy and have significant political implications. In the second essay, “Value Pluralism and Its Compatibility with Liberalism,” I explain the methodology of my argument, elaborate three key concepts underlying value pluralism – value objectivity, value incompatibility, and value incommensurability – and then develop an account of modal heterogeneity of value instantiation, as opposed to valuative hierarchy. Whereas valuative hierarchy is in tension with value incommensurability, the idea of modal heterogeneity allows that different values have different modes of instantiation that warrant differentiated prioritization of certain values in relevant practical contexts, without implying anything about the comparative moral worth of relevant values. I use a mathematical analogy to illustrate the modal heterogeneity of value instantiation, as well as how we may accord freedom a special institutional role on the basis of its modal specialty vis-à-vis other basic values, rendering liberalism compatible with value pluralism. The argument is completed in the third essay, “Value Pluralism, Liberal Democracy, and Political Judgment,” where I compare my account based on the idea of modal heterogeneity, developed in the second essay, with three existing versions of liberal pluralism. Whereas Berlin’s argument from choice, Crowder’s proposal of pluralist virtues, and Galston’s presumption of expressive liberty all fail to pass either the Jump Test or the Trump Test, my modal account overcomes these two basic difficulties faced by liberal pluralism. The rest of the essay discusses three main political implications of the modal account of liberal pluralism. First, it helps us better understand the nature of demarcating and overstepping the so-called “frontiers” of a “negative” area of permissible choices and actions free from interference, or put another way, of balancing the protection of civil liberties and rights, on the one hand, with the procurement of certain important social goods through policies, on the other hand. Second, the modal account entails the dichotomization argument for democracy, and as a consequence supports not only liberalism, but liberal democracy. Recognizing the tension between negative and positive modes of freedom as immanent to the dynamic of liberal democracy, value pluralists nonetheless have reason to cherish, rather than to decry, such dynamic. Third, the modal account also suggests we appreciate the contentious yet indispensible role of political judgment in democratic life, and attend to the normative theorizing of its implications. On the one hand, it recommends institutional designs that diversify forms of political decision-making, such as by introducing adequate mechanisms of checks and balances and establishing relevant sites of expertise. On the other hand, it calls for the appreciation of the ideal of statespersonship, even in a liberal democratic society.

Aplicação da metodologia módulo didático como estratégia para o ensino-aprendizagem de fotossíntese e cadeia alimentar / Application of the Didactic Module methodology as a strategy for teaching and learning about photosynthesis and the food chains

A presente pesquisa teve por objetivo conhecer as concepções de alunos de Ensino Médio em relação à fotossíntese e a cadeia alimentar e aplicar a metodologia Módulo Didático visando favorecer o processo ensino-aprendizagem. A metodologia Módulo Didático, concebida por Delizoicov e Angotti (1990), consiste em três etapas: problematização inicial (PI), organização do conhecimento (OC) e aplicação do conhecimento (AC). A pesquisa foi desenvolvida com uma classe de 35 alunos do 1º Ano do Ensino Médio de uma escola pertencente à Rede Estadual de Ensino, localizada no município de Lorena, SP. O desenvolvimento da pesquisa ocorreu em quatro etapas: aplicação de um questionário socioeconômico e de uma avaliação diagnóstica inicial, desenvolvimento do Módulo Didático, aplicação de uma avaliação diagnóstica final ao término da aplicação da metodologia e uma nova aplicação da avaliação diagnóstica final após o período de férias escolares dos discentes. A aplicação da metodologia foi pautada no pluralismo metodológico por meio dos seguintes recursos: questões problematizadoras, leitura e análise de textos de divulgação científica, vídeos, simuladores, jogo e mapa conceitual. Dentre os resultados relacionados à análise do perfil socioeconômico dos discentes, percebeu-se que 41% possui preferência por desenvolver as atividades em um grupo pequeno, enquanto 38% tem preferência por trabalhar com outra pessoa. A análise comparativa das avaliações diagnósticas inicial, final e final após o período de férias escolares revelou tendências ao se considerar o processo ensino-aprendizagem de fotossíntese e de cadeia alimentar. Para a temática fotossíntese, alguns assuntos necessitam ser abordados a partir de recursos distintos dos utilizados para o desenvolvimento da pesquisa, uma vez que não houve efetividade no conhecimento construído; para outros, o conhecimento construído se mostrou efetivo. Em relação à temática cadeia alimentar, o conhecimento construído apresentou efetividade. Os resultados obtidos, portanto, revelaram que o Módulo Didático se constitui como uma estratégia metodológica viável para desenvolvimento com alunos de Ensino Médio. A efetividade do processo ensinoaprendizagem está atrelada a outros fatores condicionantes, tais como os recursos utilizados, o modo pelo qual os discentes preferem desenvolver as atividades bem como o número de alunos por classe. / The following research has the aim to discover the views of secondary school (high school) students in relation to photosynthesis and the food chains, and the application of the Didactic Module methodology to facilitate the teaching-learning process. The Didactic Module methodology, designed by Delizoicov and Angotti (1990), consists of three stages: initial questioning, organization of knowledge, and the application of knowledge. The research was conducted with a class of 35 students from the 1st year of a secondary school which belonged to a network of public schools, located in the city of Lorena, SP. The development of the research took place in four steps: the application of a socioeconomic questionnaire and an initial diagnostic evaluation, the development of the Didactic module, the application of a final diagnostic evaluation at the end of the methodology application and a new application of the final diagnostic evaluation after a period of the student\'s school holidays. The methodology was based on methodological pluralism through the following resources: questions which cause problems, the reading and the analysis of scientific texts, videos, simulators, games and concept map. Among the results related to the analysis of the socioeconomic profile of students, it was noticed that 41% have preference for developing activities in a small group, while 38% have a preference for working with someone else. The comparative analysis of the diagnostic evaluations from the beginning, middle and end of the school holiday period revealed trends when considering the teaching-learning process of photosynthesis and the food chain. For the theme photosynthesis, some issues need to be addressed from different resources used for the development of the researches, since there was no effectiveness in the knowledge which was constructed; for others, the knowledge built was effective. Regarding the thematic food chain, the knowledge built was showed to be effective. The results obtained show that the Didactic Module is constituted as a viable methodological strategy for the development of students in high school (secondary school). The effectiveness of the teaching-learning process is linked to other conditioning factors such as the resources used, the way in which students prefer to develop the activities and the number of students per class.

Dentro do movimento de pluralização confessional ensejado pela secularização (característica da modernidade religiosa brasileira), recorto para fins de estudo um processo mais específico, a saber: o de adensamento institucional do espiritismo kardecista entre as décadas de 1920 e 1960. Por meio do exame de trajetórias de agentes de relevância desse segmento e de sua produção intelectual religiosa, a análise que se pretendeu realizar levou em consideração as disputas materiais e simbólicas entre formas distintas de visões espíritas de mundo. Sob esse enquadramento, o objetivo foi o de compreender e explicar como são articulados os sistemas de crenças espíritas e quais são as fontes de autoridade em jogo. Foram abertas duas frentes de trabalho. A primeira delas consistiu basicamente na reconstituição histórica de algumas coordenadas importantes para a compreensão tanto do cenário quanto do elenco espíritas. Na segunda, foi levado a cabo um trabalho de definição sociológica do que poderia vir a ser um clero espírita, e mais particularmente, quais os contornos que caracterizam os diferentes papéis desempenhados pelos vários atores em cena / Within the movement of confessional pluralization led by secularization (a characteristic of Brazilian religious modernity), I circumscribe, for the purpose of this study, a more specific process, namely, the institutional densification of Kardecist Spiritism between the decades of 1920 and 1960. Through the examination of trajectories of relevant agents in this segment and their religious intellectual production, the analysis took into account the material and symbolic disputes between distinct forms of spiritist worldviews. Through this prism, the objective was to understand and explain how spiritist belief systems are articulated and what are the actual sources of authority. There are two work fronts. The first one basically consists in a historical reconstitution of some important coordinates for the understanding of both the scenery and the spiritist cast. On the second work front, the purpose was to build a sociological definition of what could be a spiritist clergy, and, more particularly, what outlines characterize the different roles played by the various actors on the scene

Em suma, seu objetivo é descobrir de que maneira o princípio do dano funciona como um limite à regra da maioria. Diante disso, ao longo desta dissertação, examinam-se as dificuldades enfrentadas por Mill para conciliar utilitarismo e democracia, liberdade e razão. Este trabalho analisa, também, algumas ideias permanentemente presentes na reflexão histórica sobre o liberalismo: os conceitos de liberdade positiva e liberdade negativa; os diversos conceitos de paternalismo; e as muitas críticas dirigidas à regra da maioria / This investigation studies the link between the majority rule and the harm principle by John Stuart Mill. To sum up, the purpose is to find out how the harm principle operates as a limit on majority rule. As a result, throughout this study, we examine the difficulties faced by Mill to reconcile utilitarianism and democracy, liberty and reason. This dissertation analyzes, still, some ideas that were constantly present in historical reflection about liberalism: the concept of the positive liberty and the concept of negative liberty; the various concepts of paternalism; and the many criticisms of the majority rule.

Margens, tecnologias de controle e (i)legibilidades : etnografia sobre a produção do estado e do comércio popular no camelódromo de Porto Alegre/RS

Esta dissertação aborda a constituição do camelódromo de Porto Alegre e de suas práticas de comércio popular, em sua relação com as tecnologias de (i)legibilidade produzidas na sua relação com o Estado. Este trabalho parte de uma etnografia realizada entre os anos de 2013 e 2014, que se focou tanto nas práticas e sentidos elaborados pelos comerciantes do camelódromo, quanto nas visões dos atores representantes dos órgãos de controle e vigilância estatal. A partir da perspectiva teórica de Veena Das & Deborah Poole, destaco que o Estado e suas margens interagem de forma coprodutiva. Inspirada nesta abordagem, percebendo o camelódromo como uma “margem”, objetivo demonstrar como o Estado e a margem em questão estabelecem uma relação de produção mútua a partir de suas práticas. Utilizo-me dos conceitos de (i)legibilidade e pluralismo jurídico para compreender os limites e as mobilidades de tal interação. A partir da análise dos dados coletados, pode-se depreender que o Estado é reforçado, ao mesmo passo que redefinido, pelas atividades informais do camelódromo. Por sua vez, tal fortalecimento também acontece, na relação com o Estado no comércio popular em questão, onde as tecnologias de controle estatais estimulam redes de solidariedade a se organizarem e produzirem práticas diversas, que relacionam códigos legais e condutas locais. / This dissertation approaches the constitution of Porto Alegre’s “camelódromo” and its popular trade’s practices, in relation with (i)legibility technologies produced in its nexus with the State. This study consists in an ethnography carried out between 2013 and 2014, which focused on practices and meanings produced by camelódromo’s vendors, as in the visions of the actors that represents the organs of state control and surveillance. From the theoretical perspective of Veena Das & Deborah Poole, I emphasize that the State and its margins interact in a coproductive way. Inspired by this approach, perceiving camelódromo as a margin, my purpose is to demonstrate how the State and the margin in question establish a mutual relation of production from their practices. I use, in this work, the concepts of (i)legibility and legal pluralism to understand the limits and mobilities of such interaction. From the analysis of the collected data, it is possible to deduce that the State is reinforced and redefined by camelódromo’s informal activities. In turn, this strengthening also happens between the relation of the State and popular trade in question, where State’s control technologies stimulate solidarity networks to organize and produce themselves various practices that relates legal codes and local behavior.

Law, love and freedom

How does one lead a life of law, love and freedom? This inquiry has very deep roots in the Judeo-Christian tradition. Indeed, the divergent answers to this inquiry mark the transition from Judeo to Christian. This dissertation returns to those roots to trace the routes that these ideas have taken as they move from the sacred to the secular. The argument of this dissertation is threefold. First, it argues that the concepts of law, love and freedom are each internally polarized. Each concept contains, within itself, conflicting values. Paul's equivocation in his letters is a striking manifestation of this internal polarization. Second, it argues that, while values are many, my life is one. Hence, one needs to combine the plurality of values within a singular life. Values find their coherence within a form of life. There are, at least, two ways of leading a life of law, love and freedom: monastic versus antinomian. Third, it argues that the Reformation transformed these religious ideals into political ideologies. The monastic ideal is politically manifested as constitutionalism, and the antinomian ideal is politically manifested as anarchism. There are, at least, two ways of creating a polity of law, love and freedom: constitutional versus anarchic. To mount the threefold argument, the dissertation deploys a whole range of disciplinary tools. The dissertation draws on analytic jurisprudence in its analysis of law; ethics and aesthetics in its analysis of love; political philosophy in its analysis of freedom; biblical scholarship in its interpretation of Paul; the history of ideas in its study of the formation and transformation of these ideas; and moral philosophy in concluding how one could lead a life of law, love and freedom.

Normatização e uso do território na metrópole paulistana: o caso da Operação Urbana Consorciada Água Branca / Standardization and use of the territory in the Metropolis: the case of Joint Urban Operation White Water

O objetivo desta dissertação é analisar a implantação da Operação Urbana Consorciada Água Branca, localizada no distrito da Barra Funda, bem como a produção da lei que a regulamenta. Observou-se em campo e em pesquisas a órgãos ligados à Prefeitura Municipal de São Paulo que houve o direcionamento de recursos públicos para o fomento de atividades econômicas em detrimento de demandas sociais na área de estudo. Nossas categorias de análise foram o território usado e a norma, que utilizamos para compreender a construção de uma lei que visa à transformação dos usos do território de passado industrial e que agora incidem propostas de adensamento habitacional e de uso comercial. A produção normativa contou com a participação da sociedade civil, com destaque aos moradores da região e dos promotores imobiliários, mediados pelo Poder Público municipal, caracterizando, assim, um caso de pluralismo jurídico. Por meio das audiências públicas e de entrevistas realizadas com os vereadores, representantes dos moradores da área de estudo e do mercado imobiliário, verificou-se a conflituosa relação entre os diferentes setores da sociedade civil. Desta forma, a norma jurídica, criada em 2013, reflete os desejos e necessidades do uso do território do período atual no município de São Paulo evidenciando as práticas sociais vigentes e as especificidades do distrito da Barra Funda / The objective of this dissertation is to analyze the implementation of the Joint Urban Operation Agua Branca, located in the Barra Funda district; as well as the creation of the law that governs it. It was observed in the field and research, in this area of study, which was done with bodies linked to the Municipality of São Paulo that public resources were directed to the promotion of economic activities to the detriment of social demands. Our categories of analysis were: the used territory, and the standard, and were used to understand and help in the creation of a law aimed at the transformation of the use of the territory of an industrial past which is now proposed for housing and commercial use. The normative creation also took into consideration the participation of civil society, especially local residents and property developers, mediated by the municipal government, thus characterizing a case of legal pluralism. Through public hearings and interviews with councilors, representatives of the residents of the studied area and the real estate market, it was verified a conflicting relationship between the different sectors of civil society. Thus, the normative (rule of law), created in 2013 , reflects the desires and needs of the use of the territory of the current period (nowadays) São Paulo highlighting current social practices and the specifics of the Barra Funda district
